According to spacetime state realism, the fundamental ontology of a quantum mechanical world consists of a state-valued field evolving in four-dimensional spacetime. One chief advantage it claims over rival wave-function realist views is its natural compatibility with relativistic quantum field theory. I argue that the original density operator formulation of SSR cannot be extended to QFTs where the local observables form type III von Neumann algebras. The signing of the 2007 UN Declaration of the Rights of Indigenous Peoples by over a hundred states is a realization of the importance of the quest of indigenous peoples to direct their present and future existence, together with the knowledge and heritage they have acquired from their ancestors which they constantly mould to survive and thrive in a contemporary world made up of competing interests that are often at odds with their physical, cultural, and spiritual survival. The paper examines (...) some of the interconnected philosophical and legal issues concerning indigenous knowledge and the indigenes' quest to safeguard their knowledge, with indigenous philosophical views given the necessary focus in analyzing these issues. The paper borrows from recent work by classicists on satyr play and demonstrates significant parallels between Plato’s Republic and the structure, theme and stereotypical contents that characterize this newly studied genre of ancient Greek drama. Like satyr play, the Republic includes repeated passages where metatheatricality can reverse the meaning. The frequent occurrence of all the stereotypical elements of satyr play in Plato’s Republic also suggests to readers that they should be responding to Socrates’ narration as they would to a satyr (...) play, again reversing meaning by communicating a set of literary expectations to Plato’s readers over the heads of Socrates’ interlocutors. As is frequently the case with satyr play, the political purpose of the drama is the critique of tyrannical government. The need for a systematically ironic interpretation of the dialogue is raised. Defenders and opponents of judicial review under charters of rights often share political ideals, and yet disagree deeply on the best means to pro- mote them or on the proper way to balance them in the event of conflict. In his most recent book, Wil Waluchow attempts to provide a theory of judicial review which deals adequately with the popular ideals of stability and adaptability. The cornerstone of his argument is the notion of community morality - that which enables constitutional (...) adjudicators to develop charter law (adaptability) while remaining loyal to democratic and rule of law principles (stability). The aim of this paper is to offer a critique of the notion of community morality; in particular, the aim is to challenge the assumption that the morality of the members of modern plural societies is as uniform as Waluchow’s theory requires it to be.Resumen:Los defensores y oponentes de la figura del judicial review que se lleva a cabo a través de la defensa de las garantías individuales en ocasiones comparten puntos de vista en relación con los ideales políticos, sin embargo, existen profundos desacuerdos en cuanto a la mejor forma de promocionarlos o en cuanto a la manera apropiada de decidir casos concretos en casos de conflicto. En su más reciente libro, Wil Waluchow intenta proporcionar una teoría del judicial review que atienda adecuadamente los ideales comunes de estabilidad y adaptabilidad. El punto medular de su argumento es la noción de la moralidad de la comunidad—aquella que permite a los jueces constitucionales desarrollar las garantías y derechos (adaptabilidad) mientras que se continúa leal a los principios de democracia y Estado de derecho (estabilidad)—. Prescriptive rules guide human behavior across various domains of community life, including law, morality, and etiquette. What, specifically, are rules in the eyes of their subjects, i.e., those who are expected to abide by them? Over the last sixty years, theorists in the philosophy of law have offered a useful framework with which to consider this question. Some, following H. L. A. Hart, argue that a rule’s text at least sometimes suffices to determine whether the rule itself covers a case. (...) Others, in the spirit of Lon Fuller, believe that there is no way to understand a rule without invoking its purpose — the benevolent ends which it is meant to advance. In this paper we ask whether people associate rules with their textual formulation or their underlying purpose. We find that both text and purpose guide people’s reasoning about the scope of a rule. Overall, a rule’s text more strongly contributed to rule infraction decisions than did its purpose. The balance of these considerations, however, varied across experimental conditions: In conditions favoring a spontaneous judgment, rule interpretation was affected by moral purposes, whereas analytic conditions resulted in a greater adherence to textual interpretations. In sum, our findings suggest that the philosophical debate between textualism and purposivism partly reflects two broader approaches to normative reasoning that vary within and across individuals. Childcare robots are being manufactured and developed with the long term aim of creating surrogate carers. While total childcare is not yet being promoted, there are indications that it is ‘on the cards’. We examine recent research and developments in childcare robots and speculate on progress over the coming years by extrapolating from other ongoing robotics work. Our main aim is to raise ethical questions about the part or full-time replacement of primary carers. The questions are about human rights, privacy, (...) robot use of restraint, deception of children and accountability. But the most pressing ethical issues throughout the paper concern the consequences for the psychological and emotional wellbeing of children. We set these in the context of the child development literature on the pathology and causes of attachment disorders. We then consider the adequacy of current legislation and international ethical guidelines on the protection of children from the overuse of robot care. (shrink)

Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. He dreams of 'a missionary option' that will transform everything. For Francis, mission is clearly essential to the church. He is continuing a movement that began with Ad Gentes, the missionary document of Vatican II. The fathers at the council insisted, 'The pilgrim Church is missionary by her very nature. For it is from the mission (...) of the Son and the mission of the Holy Spirit that she takes her origin, in accordance with the decree of God the Father'. This was reiterated by Paul VI in Evangelii Nuntiandi: 'Evangelizing is in fact the grace and vocation proper to the Church, her deepest identity. She exists in order to evangelize'; and by John Paul II in Redemptoris Missio: 'the Church is missionary by her very nature'. (shrink)

ABSTRACT In this paper, we will highlight the correspondences between the Socially Engaged Buddhism movement, especially as defined in the practice of the late Thich Nhat Hanh, and the core principles of humanity, impartiality, neutrality and independence originally adopted by the International Red Cross and Red Crescent Movement. These principles also underpin the neutral, impartial and independent approach to humanitarian action, used by agencies working under the auspices of the United Nations’ Inter-Agency Standing Committee and Office for the Coordination of (...) Humanitarian Affairs, along with those who have signed the Code of Conduct for the International Red Cross and Red Crescent Movement and Non-Governmental Organizations in Disaster Relief. We hope this paper is a modest but useful contribution to create better understanding and to generate dialogue among different stakeholders in the humanitarian field, particularly in the context of armed conflict. In this book he discusses the nature and narrative structures of the genre, dealing with horror as a "transmedia" phenomenon. A fan and serious student of the horror genre, Carroll brings to bear his comprehensive knowledge of obscure and forgotten works, as well as of the horror masterpieces. Working from a philosophical perspective, he tries to account for how people can find pleasure in having (...) their wits scared out of them. Dr Noel Semple, Professor Russell Pearce and Professor Renee Knake combine to compare legal profession regulation in the US with that of the countries closest to it institutionally and culturally: Canada, Australia, New Zealand, the United Kingdom and Ireland. This enables them to develop an illuminating taxonomy of legal professional regulation, and to describe the assumptions and objectives underlying the different approaches to regulation. The US and Canada provide a 'professionalist-independent framework' that centres on 'a unified, hegemonic occupation of lawyer' (...) which promotes self-regulation, and the exclusion of non-lawyers from partnership and investment in law practices. By contrast, in other countries that they examine, 'consumerist-competitive approaches' predominate, opening up the profession to co-regulation with executive government and allowing for different forms of legal occupations and non-lawyer influence and investment in law practices. Of course, as they show, in some countries there are combinations and hybrids of these two approaches. Unlike Rhode, who endorses England and Wales' consumerist-competitive approach to regulation in the Legal Services Act 2007, Semple, Pearce and Knake consciously avoid stating a preference for one approach over the other. By employing Peirce’s semiotics, Totalitarianism is distinguished indexically from forms of Dictatorship and Authoritarianism. The former can be cast, as Arendt argued, to initiate a project for world domination dispensing with any sense of Authoritarianism in forwarding some purely fictitious conception where violence is manifested in terror. Alternatively, distortion of intellectual activity may issue within Populism so that the rule of Demagogy emerges initiating Despotism or a form of Dictatorship – either Commissarial or Sovereign form – where lawless violence is (...) sustained by secret police inducing fear but not terror. In the case of Authoritarianism induced iconically in a populace, violence may be tolerated accompanying either lawmaking or lawpreserving, both to be separated from Benjamin’s sense of pure violence. The latter – whether humanistically or spiritually understood – transcends both utilitarianism and sheer arbitrariness. (shrink)

An account of what Michael Krausz refers to as “a three tiered structure” within the interpretative process is defended. Starting with the employment of Peircian nomenclature, as employed by Joseph Margolis, artworks and persons - cultural entities - are distinguished from physical entities as tokens of types. But even if culturally emergent entities con be attributed to certain physical atributes in relation to their materiality at the first level of interpretation - the elucidatory - in which such culturally emergent properties (...) are embodied, cultural entities possess certain distinctive Intentional attributes, at a second level of interpretation - thc intentional - not assignable to purely physical properties nor, in the case of artworks such as Van Gogh’s The Potato Eaters, their creator’s intentions. But in order to make sense of Krausz’s notion of “aspectual reverberation” for an individual appreciator, a third level of interpretation is required - the elaborative - in order to make sense of Peirce’s notion not only of the type and token status of a work of art, but its tone, This third elaborative sense of interpretation is then considered in two ways: experientially in terms of what the spectator can bring to an appreciation of an artwork and performatively with respect to an artist’s interpretation of the work in performance, as in dance for example. Language can be cast through words and images where truth claims are thought to lie. They may be either embodied within language or indicate what transcends it. Yet expression is formed through the spoken, written words or images. But what about the imagistic: words doing the work of an image without employing the visual? To grasp how the latter has emerged, the shift in authority from the spoken to the written word will be undertaken. The importance of the shift from (...) the written word to the image can be illustrated in the case of the Renaissance, for example, where the image in the book legitimated, the word. Today the word merely amplifies or justifies the image, located on a screen! From that development the imagistic has evolved raising the problem of its authority and thereby the issue of a concern for truth. (shrink)

Standard approaches to ontological simplicity focus either on the number of things or types a theory posits or on the number of fundamental things or types a theory posits. In this paper, I suggest a ground-theoretic approach that focuses on the number of something else. After getting clear on what this approach amounts to, I motivate it, defend it, and complete it.

Which individuals should count in a welfare-consequentialist analysis of public policy? Some answers to this question are parochial, and others are more inclusive. The most inclusive possible answer is ‘everybody to count for one.’ In other words, all individuals who are capable of having welfare – including foreigners, the unborn, and non-human animals – should be weighed equally. This article argues that ‘who should count’ is a question that requires a two-level answer. On the first level, a specification of welfare-consequentialism (...) serves as an ethical ideal, a claim about the attributes that the ideal policy would have. ‘Everybody to count for one’ might succeed on this level. However, on the second level is the welfare-consequentialist analysis procedure used by human analysts to give advice on real policy questions. For epistemic reasons, the analysis procedure should be more parochial than ‘everybody to count for one.’. (shrink)

Recent advances in the theory of dynamical systems, set-valued analysis, and viability theory offer new and interesting perspectives on the shaping of social and historical time. Specific aspects of these theories are presented in several different areas to show their concrete applications in history and historical demo-economy, and a parallel is established with novelist Tanizaki's fictional technique. In connection with this, McCloskey's 1991 comparison of storytelling with deterministic chaos is discussed and a critique of other models concerned with unpredictability in (...) human affairs provided. Finally, the shapings of social and historical time are described in terms of the viable strategies at the heart of evolutionary processes involving human agents interacting with a variety of constraints. Discusses Hobbes's relationship with the French mathematician Gilles Personne de Roberval, with whom he became closely associated in Paris during the 1640s. It examines a text that, commonly assumed to be a statement of Roberval's own views, may rather have been a description of the views of Hobbes. The degree to which Hobbes and Roberval were able to assimilate elements of skepticism is also discussed, particularly in relation to the different ways in which they reacted to the experimental evidence for (...) the production of a vacuum in the late 1640s. This is the first critical edition of Hobbes's Leviathan based on a full study of the manuscript and printing history, and the first to place the English text alongside Hobbes's later Latin version of it. Both texts are fully annotated with explanatory notes. Noel Malcolm's definitive edition sets the study of Hobbes's masterwork on a new basis.

A major obstacle facing interpreters of quantum field theory is a proliferation of different theoretical frameworks. This article surveys three of the main available options—Lagrangian, Wightman, and algebraic QFT—and examines how they are related. Although each framework emphasizes different aspects of QFT, leading to distinct strengths and weaknesses, there is less tension between them than commonly assumed. Given the limitations of our current knowledge and the need for creative new ideas, I urge philosophers to explore puzzles, tools, and techniques from (...) all three approaches. (shrink)
