Does private regulation of workers’ rights in global value chains improve working conditions on the factory floor? Drawing on one of the first systematic longitudinal studies of supplier compliance with multinational corporation (MNC) codes of conduct, this paper finds—in contrast to previous research—substantial improvements over time. While in 2004, the four examined Chinese toy suppliers violated most of the evaluated code of conduct criteria and consciously decoupled the code of conduct policy from actual practices, by 2009 they had recoupled policy (...) and practice and complied with nearly all examined criteria (except working hours). The paper contributes to the private regulation literature by challenging previous research claims, identifying factors that could make private regulation effective, and outlining a research method for empirically studying the effects of codes of conduct over time. The paper also contributes to new institutional theory by discussing how recoupling could be influenced by two factors not identified in previous research: (i) trusting relationships between the organization and the stakeholder exerting pressure and (ii) factors unrelated to main external pressures leading to “accidental” recoupling. In the current era, governments are playing smaller roles in regulating workers’ rights internationally, and transnational corporations (TNCs), non-governmental organisations (NGOs) involved in the struggle for workers’ rights, and labour/trade unions have started to fill this governance gap. This paper focuses on the least researched of the relationships among these three actors, the union–NGO relationship, by analysing the ways in which it affects definitions of TNC responsibility for workers’ rights at their suppliers’ factories. Based on a qualitative study of the (...) union–NGO relationship in the Swedish garment industry between 1996 and 2005, we propose that there are six main configurations of union–NGO relationships. By linking these configurations to their effects on TNC responsibility, we propose that co-ordination relationships between unions and NGOs, particularly high-commitment co-ordination relationships, are likely to result in a broadening of the definition of TNC responsibility, while conflictual relationships, both high and low commitment, result in a narrowing of the definition of TNC responsibility. The study indicates that co-operation is generally more beneficial for both unions and NGOs than is any form of conflictual relationship, in terms of broadening the definition of TNC responsibility. While cross-sectoral partnerships are frequently presented as a way to achieve sustainable development, some corporations that first tried using the strategy are now changing direction. Growing tired of what are, in their eyes, inefficient and unproductive cross-sectoral partnerships, firms are starting to form post-cross-sectoral partnerships (‚post-partnerships’) open exclusively to corporations. This paper examines one such post-partnership project, the Business Social Compliance Initiative (BSCI), to analyse the possibility of post-partnerships establishing stable definitions of ‚corporate responsibility’. We do this by creating a (...) theoretical framework based on actor-network theory (ANT) and institutional theory. Using this framework, we show that post-partnerships suffer from the paradox of striving to marginalise those stakeholders whose support they need␣for establishing stable definitions of ‚corporate responsibility’. We conclude by discussing whether or not post-partnership strategies, despite this paradox, can be expected to establish stable definitions of ‚corporate responsibility’. (shrink)

Codes of conduct are the main tools to privately regulate worker rights in global value chains. Scholars have shown that while codes may improve outcome standards (such as occupational health and safety), they have had limited impact on process rights (such as freedom of association and collective bargaining). Scholars have, though, only provided vague or general explanations for this empirical finding. We address this shortcoming by providing a holistic and detailed explanation, and argue that codes, in their current form, have (...) limited impact on trade union rights due to (i) buyers paying lip service to trade union rights, (ii) workers being treated as passive objects of regulation in codes of conduct, (iii) auditing being unable to detect and remediate violations of trade union rights, (iv) codes emphasizing parallel means of organizing, (v) suppliers having limited incentives for compliance, and (vi) codes being unable to open up space for union organizing when leveraged in grassroots struggles. Our arguments suggest that there is no quick fix for codes’ limited impact on trade union rights, and that codes, in their current form, have limited potential to improve trade union rights. We conclude by discussing ways in which codes of conduct, and private regulation of worker rights more generally, could be transformed to more effectively address trade union rights. (shrink)

Our results indicate that global agreements independently address all the aspects included in codes of conduct, while also addressing additional, more process-oriented aspects of workers' rights. Hence, on their own, global agreements seem to comprise the superior approach to promoting workers' rights. Furthermore, our results indicate that promoting codes of conduct has negative interactive effects on global agreements. Stakeholder theory is one of the most influential theories in business ethics. It is perhaps not surprising that a theory as popular as stakeholder theory should be used in different ways, but when the disparity between different uses becomes too great, it is questionable whether all the ‘stakeholder research’ refers to the same underlying theory. This paper starts to clarify this definitional confusion by distinguishing between three different ways in which different lines of stakeholder research are connected with descriptive and (...) instrumental stakeholder theory. First, a distinction is made between research connected with descriptive and with instrumental stakeholder theory as defined by Donaldson & Preston in the narrow or broad sense. Second, a distinction is made between research that interprets descriptive and instrumental stakeholder theories as either hypotheses or research areas. Third, a distinction is made between research that interprets Donaldson & Preston’s central concept of ‘stakeholder management’ as either behaviour or rationale. Finally, the paper discusses the implications of these differences for empirical research into stakeholder theory. (shrink)

Conflicts between labor unions and nongovernmental organizations often impede private labor regulatory attempts to protect worker rights at supplier factories. Based on a study of a failed private regulatory attempt for Swedish garment retailers, we contribute to existing research into union–NGO relations by demonstrating how conflict arises because unions and NGOs act upon different institutional logics. We also contribute to the institutional logics perspective by challenging the current emphasis on either coexistence or conflict among multiple logics, and showing the heterogeneity (...) in how multiple logics manifest on a local level, how this could shift over time, and suggesting an empirically derived typology of manifestations of multiple logics. Anti-sweatshop activists have turned global production networks into contested organizational fields. Although this contest has triggered the growth of an extensive literature on contested GPNs, the scholarly conversation is still limited in two important ways: First, it ignores or dismisses the role of small and medium-sized enterprises in GPNs and, second, it assumes that firms are driven solely by rational profit-maximizing motives. Based on a study of a Swedish SME’s payment of living wages at its Indian supplier, this article addresses (...) these limitations by demonstrating how SMEs’ peculiarities allow them to assume a distinct role in contested GPNs. Furthermore, this article contributes to the scholarly conversation about living wages by providing a much-needed move beyond conceptual discussions into empirical studies of the underlying trade-offs of paying living wages. To address substandard working conditions in global value chains, companies have adopted private regulatory systems governing worker rights. Scholars agree that without onsite factory audits, this private regulation has limited impact at the point of production. Companies, however, audit only a subset of their suppliers, severely restricting their private regulatory attempts. Despite the significance of the placement of suppliers inside or outside firms’ “responsibility boundaries” and despite scholars’ having called for more research into how firms prioritize what suppliers to audit, (...) few, if any, systematic studies have examined the topic. This is problematic, as the placement of firms’ responsibility boundaries determines what suppliers and workers are included in firms’ private regulatory attempts. Based on a study of 12 Swedish firms and the theory of moral disengagement, this paper starts to fill this research gap by exploring how firms’ responsibility boundaries are placed. The paper illustrates how firms’ responsibility boundary placement is best described as a patchwork with firms defining and delimiting their responsibilities differently. The paper also demonstrates that three supplier types are particularly likely to be placed inside firms’ responsibility boundaries, while a fourth type is likely be placed outside. (shrink)

Over the past decade, discussion has flourished among practitioners and academics regarding workers’ rights in developing countries. The lack of enforcement of national labour laws and the limited protection of workers’ rights in developing countries have led workers’ rights representatives to attempt to establish transnational industrial relations systems to complement existing national systems. In practice, these attempts have mainly been operationalised in unilateral codes of conduct; recently, however, negotiated international framework agreements (IFAs) have been proposed as an alternative. Despite their (...) growing importance, few studies have empirically studied IFAs. This paper starts to fill this gap by studying why corporations adopt IFAs, based on a qualitative study of the process leading to the signing of a recent IFA. The study’s findings complement existing research into why corporations adopt IFAs, codes of conduct, and CSR policies by demonstrating that corporate motives can be linked to a desire to retain a trusting relationship with the labour union movement. In addition, the findings indicate that the discrete campaign model of stakeholder pressure dominant in previous research should be complemented by a continuous bargaining model of stakeholder pressure. The paper concludes by discussing differences between these conceptual models of stakeholder pressure and avenues for future research. (shrink)

The protection of workers' rights is at the heart of the ongoing debate on business ethics. In balancing transnational corporations' (TNCs) influence in private regulatory systems intended to protect workers' rights in emerging economies, several authors have emphasized the importance of cooperative relationships between unions and NGOs. In practice, however, conflict has often entered into union-NGO relations, weakening the protection of workers' rights. We argue that cooperative union-NGO relationships are difficult to form in part because of the differences existing between (...) how unions and NGOs organize. More specifically, based on two qualitative studies, we demonstrate that the problems stem from differences in organizing related to (i) identity construction, (ii) governance systems, and (iii) resources. The article concludes with a discussion on the possibility of successful union-NGO cooperation and improved protection of workers' rights in emerging economies. (shrink)

In twentieth century Europe and the USA, industrial relations, labour, and workers’ rights issues have been handled through collective bargaining and industrial agreements between firms and unions, with varying degrees of government intervention from country to country. This industrial relations landscape is currently undergoing fundamental change with the emergence of transnational industrial relations systems that complement existing national industrial relations systems. Despite the significance of this ongoing change, existing research has only started to explore the implications of this change for (...) how workers’ rights are governed around the globe. This paper addresses this gap by outlining an agenda for future research into the transnational governance of workers’ rights. Fulfilling such a research agenda would be both challenging, as it requires combining the so far divergent industrial relations and business ethics research streams, and rewarding, as it provides ample scope for promising future research. Local supplier corporate social responsibility in developing countries represents a powerful tool to improve labour conditions. This paper pursues an inter-organizational network approach to the global value chain literature to understand the influence of suppliers’ collective behaviour on their CSR engagement. This exploratory study of 30 export-oriented and first-tier apparel suppliers in Bangladesh, a developing country, makes three relevant contributions to GVC scholarship. First, we show that suppliers are interlinked in a horizontal network that restricts unilateral CSR engagement. This is (...) justified in that unilateral CSR engagement is a source of heterogeneity in labour practices; consequently, it triggers worker unrest. Second, we present and discuss an exploratory framework based on four scenarios of how suppliers currently engage in CSR given their network’s pressure toward collective behaviour: unofficial CSR engagement, geographic isolation, size and competitive differentiation, and external pressure. Finally, we show the need to spread CSR homogeneously among suppliers and to reconceptualize the meaning of CSR in developing countries, encouraging more scrutiny toward horizontal dynamics. This paper develops an empirically grounded, processual view of corporate social performance (CSP) by analyzing how internal organizational processes affect a firm’s social performance. Based on two case studies, we argue that changes in a firm’s social performance are triggered by continuously reoccurring instances of poor fit between the firm’s routines and its institutional environment. We propose that reactive change processes, initiated by stakeholder critique threatening the organization’s legitimacy, will result in isomorphic type of social performance changes. In comparison, proactive (...) change processes, initiated by slack resources, are more likely to result in nonisomorphic type of social performance changes. Furthermore, we propose that top-down driven processes will result in structural social performance changes in the direction of internationally influential stakeholders’ demands, while bottom-up driven processes will result in output social performance changes in the direction of locally influential stakeholders’ demands. Genetic determinism can be described as the attribution of the formation of traits to genes, where genes are ascribed more causal power than what scientific consensus suggests. Belief in genetic determinism is an educational problem because it contradicts scientific knowledge, and is a societal problem because it has the potential to foster intolerant attitudes such as racism and prejudice against sexual orientation. In this article, we begin by investigating the very nature of belief in genetic determinism. Then, we investigate whether (...) knowledge of genetics and genomics is associated with beliefs in genetic determinism. Finally, we explore the extent to which social factors such as gender, education, and religiosity are associated with genetic determinism. Methodologically, we gathered and analyzed data on beliefs in genetic determinism, knowledge of genetics and genomics, and social variables using the “Public Understanding and Attitudes towards Genetics and Genomics” instrument. Our analyses of PUGGS responses from a sample of Brazilian university freshmen undergraduates indicated that belief in genetic determinism was best characterized as a construct built up by two dimensions or belief systems: beliefs concerning social traits and beliefs concerning biological traits; levels of belief in genetic determination of social traits were low, which contradicts prior work; associations between knowledge of genetics and genomics and levels of belief in genetic determinism were low; and social factors such as age and religiosity had stronger associations with beliefs in genetic determinism than knowledge. Although our study design precludes causal inferences, our results raise questions about whether enhancing genetic literacy will decrease or prevent beliefs in genetic determinism. (shrink)

Ethical dilemmas are common in the neonatal intensive care setting. The aim of the present study was to investigate the opinions of Swedish physicians and the general public on treatment decisions regarding a newborn with severe brain damage. We used a vignette-based questionnaire which was sent to a random sample of physicians (n = 628) and the general population (n = 585). Respondents were asked to provide answers as to whether it is acceptable to discontinue ventilator treatment, and when it (...) actually is discontinued whether or not it was acceptable to use drugs which hasten death unintentionally or intentionally. The response rate was 67 % of physicians and 46 % of the general population. A majority of both physicians [56 % (CI 50–62)] and the general population [53 % (CI 49–58)] supported arguments for withdrawing ventilator treatment. A large majority in both groups supported arguments for alleviating the patient’s symptoms even if the treatment hastened death, but the two groups display significantly different views on whether or not to provide drugs with the additional intention of hastening death, although the difference disappeared when we compared subgroups of those who were for or against euthanasia-like actions. The study indicated that physicians and the general population have similar opinions regarding discontinuing life-sustaining treatment and providing effective drugs which might unintentionally hasten death but seem to have different views on intentions. The results might be helpful to physicians wanting to examine their own intentions when providing adequate treatment at the end of life. (shrink)

Chr. von einem Anonymus verfaßte Vita Aesopi , eine „fiktionale Biographie mit Elementen des komisch-realistischen Romans“ , wurde zu Beginn der Neuzeit in aller Welt dadurch bekannt, daß sie in lateinischer und deutscher Übersetzung als einer von mehreren Texten in Heinrich Steinhöwels Esopus von 1476/77 erschien, einem „Bestseller“ der Frühdruckzeit. Aber das griechische Original des VA-Textes, der im 16. Jahrhundert z.B. den Autoren des Lazarillo de Tormes und des Till Eulenspiegel wichtige Anregungen gegeben haben dürfte, (...) entsprach in seinem Wortlaut nicht dem kaiserzeitlichen Text – dieser ist uns zwar nicht erhalten, aber die Version des Codex 397 in der New Yorker Pierpont Morgan Library steht ihm wahrscheinlich sehr nahe –, sondern stellte eine Epitome der Urfassung dar, die recensio Westermanniana . Diese Version versuchte Ben Edwin Perry durch Kollation von 11 Handschriften zu rekonstruieren , obwohl er bemerkte, daß innerhalb der Kodizes, auch wenn sie in der Wiedergabe des Stoffs einander mehr ähneln als G, wiederum zwei Fassungen zu unterscheiden sind, repräsentiert durch die beiden Handschriftengruppen MORNLFVW und BPS. Da nun der in Steinhöwels Ausgabe publizierte und von neuzeitlichen Autoren mehrfach rezipierte Text der VA – es handelt sich dabei um die lateinische Übersetzung des Rinuccio da Castiglione d'Arezzo – in griechischer Sprache in einem Kodex stand, der als Ahn von P gelten darf, ist es sehr verdienstlich, daß K. die eine der beiden Fassungen von rec. W, die so besonders wirkungsmächtig war – sie ist wahrscheinlich ins frühe 6. Jahrhundert zu datieren, und ihr sind außer B, P und S das Kodexblatt Th und die erst 1991 aufgetauchte Hs. A zuzuordnen –, als selbständigen Text der VA herausgegeben und zugleich sowohl literaturgeschichtlich als auch sprachwissenschaftlich analysiert hat. (shrink)

L’union des deux thèmes hétérogènes « capitalisme » et « utopie », provient d’une description des conséquences d’une différenciation fonctionnelle du système de la société. Si par « capitalisme » on entend la description d’une société possédant un système économique différencié et autonome quant à ses opérations, la question est de savoir comment le système politique peut coexister à côté de lui. Par l’utopie. L’utopie politique, qui permet d’assurer la coexistence des deux systèmes, se nomme « économie sociale de marché (...) ». Mais cette utopie n’est plus définie comme modèle idéal permettant une critique de la société actuelle, c’est une composante de l’autodescription du système, une forme de réplication, dans le système politique lui-même, du caractère non maîtrisable de la société. The aim of the present study was to compare and examine how medical students on term one and nine understand and adopt ideas and reasoning when estimating death-causes. Our hypothesis was that compared to students in the beginning of their medical curriculum, term nine students would be more inclined to adopt ideas about causality that allows physicians to alleviate an imminently dying patient, without being suspected for manslaughter—a practice referred to as proficiency creativity. We used a questionnaire containing two similar (...) cases describing an imminently dying patient who receive a drug in order to treat seizures. The treatment has the foreseen effect of shortening the patient’s life. In one version of the vignette the patient dies immediately and in the other one the patient dies 5 h after having received the drug. We asked medical students in their first term (n = 149) and ninth term (n = 106) to fill in the two randomly distributed questionnaires. We used a χ2 test to examine our hypothesis and choose as significance level 0.05. A majority of term-one students (53 %) stated that the patient died because of the provided drugs when dying immediately after and 32 % stated it when the patient died 5 h after providing the drug. The difference was significant (p = 0.007). A minority of term-nine students (20 vs. 16 %) stated the patient died because of the provided drug. The difference was not significant. The study indicates that term-nine students have espoused the idea that death-causes in such cases should always be classified as the underlying disease—even though another straightforward explanation could be the drug provided. To clinicians this might be a proficiency-creative strategy for managing a difficult legal dilemma. As hypothetical explanation we suggest that experienced clinicians might have transformed a normative issue of shortening life into an empirical issue about death-causes and tacitly transferred this strategy to term-nine students. If our hypothesis is supported by future studies, this kind of transferring proficiency creativity tacitly might impede changing the Penal Code even though it may be needed. (shrink)

This paper examined the existence of gender differences in the degree to which leader’s perceptions of successor potential is influenced by interpersonal fit. In Study 1 (n = 97 leaders and n = 280 followers) multi-source field data revealed that for male leaders, ratings of followers’ potential as successors were positively related to interpersonal fit, measured by the degree to which followers’ saw their leadership as being close and interpersonal (i.e., being coaching, transformational and leading by example). For female leaders, (...) these relationships were absent, suggesting that they are less driven by interpersonal fit. In Study 2 (n = 311 leaders) a scenario study provided causal evidence that male leaders rated potential successors more positively when they perceived greater interpersonal fit with followers, whereas female leaders’ successor ratings where not informed by fit perceptions. We discuss the theoretical and practical implications for gendered leadership successor perceptions in organizations. (shrink)

Children’s numeracy competencies are not only relevant for their academic achievement, but also later in life. The development of early numeracy competencies is influenced by children’s learning environment. Here, the home numeracy environment and parent’s own beliefs about mathematics play an important role for children’s numeracy competencies. However, only a few studies explicitly tested these associations separately for mothers and fathers. In our study, we assessed mothers’ and fathers’ mathematical gender stereotypes, self-efficacy and their beliefs on the importance of mathematical (...) activities at home, and tested their associations with parents’ numeracy activities and children’s numeracy competencies in a sample of N = 160 children with an average age of M = 59.15 months. Both, fathers and mothers regarded boys as being more competent in mathematics than girls. Fathers when compared to mothers reported a greater mathematical self-efficacy. Further, only mothers’ self-efficacy was associated with the frequency of numeracy activities with the study child. In contrast, only fathers’ beliefs on the importance of mathematics was associated with their numeracy activities which, in turn, predicted children’s numeracy competencies. However, the non-invariant constructs and varying results lead to the question whether a revision of existing scales assessing parental beliefs and home numeracy activities is needed to investigate differences of mothers and fathers and their potential associations with children’s numeracy outcomes. Aims The aim of this study was to examine if it is plausible to interpret the appearance of shame in a Swedish healthcare setting as a reaction to having one's honour wronged. Methods Using a questionnaire, we studied answers from a sample of long-term sick-listed patients who had experienced negative encounters (n=1628) and of these 64% also felt wronged. We used feeling wronged to examine emotional reactions such as feeling ashamed and made the assumption that feeling shame could be associated (...) with having one's honour wronged. In statistical analyses relative risks (RRs) were computed, adjusting for age, sex, disease-labelling, educational levels, as well as their 95% CI. Results Approximately half of those who had been wronged stated that they also felt shame and of those who felt shame, 93% (CI 91 to 95) felt that they had been wronged. The RR was 4.5 (CI 3.0 to 6.8) for shame when wronged. This can be compared with the other emotional reactions where the RRs were between 1.1 (CI 0.9 to 1.3)–1.4 (CI 1.2 to 1.7). We found no association between country of birth and feeling shame after having experienced negative encounters. Conclusions We found that the RR of feeling shame when wronged was significantly higher compared with other feelings. Along with theoretical considerations, and the specific types of negative encounters associated with shame, the results indicate that our research hypothesis might be plausible. We think that the results deserve to be used as point of departure for future research. (shrink)

Background Physician-assisted suicide is a controversial issue and has sometimes raised emotion-laden reactions. Against this backdrop, we have analyzed how Swedish physicians are reasoning about physician-assisted suicide if it were to be legalized. Methods and participants We conducted a cross-sectional study and analyzed 819 randomly selected physicians’ responses from general practitioners, geriatricians, internists, oncologists, psychiatrists, surgeons, and all palliativists. Apart from the main questions about their attitude toward physician-assisted suicide, we also asked what would happen with the respondents’ own trust (...) in healthcare if physician-assisted suicide were legalized. Response options were that trust would decrease, not be influenced, or would increase. Results We identified a strong statistical association between on the one hand those whose own trust would increase and who were pro physician-assisted suicide, and on the other hand those who were against physician-assisted suicide and whose own trust would decrease [relative risk: 16.7 (95% confidence interval: 10.2–27.2)]. Among those whose own trust would not be influenced (n = 456), 60% were pro pysician-assisted suicide, 16% were against, and 24% were undecided. Of those whose trust would increase or not be influenced, a large majority supported autonomy-based arguments, whereas those whose trust would decrease supported non-maleficence-based arguments. Conclusion Analyzing the answers after having divided respondents into those whose own trust in healthcare would decrease or increase and not be influenced brings about interesting results such as how the three groups prioritize arguments for and against physician-assisted suicide. This way of analyzing the data seems to be a promising strategy when identifying value-impregnated factual claims. (shrink)

O presente trabalho está amparado na hipótese segundo a qual os conceitos de comunicação, informação e intersubjetividade constituem divisores de águas entre as teorias de Niklas Luhmann e Jürgen Habermas. Mesmo assim, e, inclusive, devido à distância que separa os dois projetos teóricos, eles podem ser tomados como perspectivas teóricas extremamente úteis para uma melhor compreensão do homem e da sua sociedade.

Chr. wird Ovid aus nicht bekanntem Grund von Kaiser Augustus nach Tomis am Schwarzen Meer verbannt, an den Rand der zivilisierten Welt, in eine trostlose Gegend, in der niemand Latein spricht und die er bis zu seinem Tod 17 n. Chr. nicht mehr verlassen wird. Er beginnt, verzweifelte Briefe zu schreiben - man würde sie heute "Offene Briefe" nennen - und diese nach Rom zur Veröffentlichung zu schicken. Sie sind sorgsam dichterisch komponiert, der Stil ist geschliffen (...) und sie haben nur ein Ziel: die öffentliche Meinung in Rom für ihn einzunehmen; erfolglos, wie wir wissen. Gleichwohl sind die Briefe bewegende Dokumente frühester Exil-Literatur. Sie wurden das ganze Mittelalter über gelesen und haben das moderne Bewusstsein Europas mitgeprägt. Die neue Einführung des Münchner Altphilologen Niklas Holzberg und die neuen besonders ausführlichen Anmerkungen zu den unzähligen versteckten Anspielungen in den Briefen untersuchen sorgfältig, was an Ovids Klagen echt und was "Literatur" ist, wo er unter der Unerträglichkeit des Exils tatsächlich leidet und wo er nur gängigen Vorstellungen über die Wildnis am Pontos Ausdruck verleiht. More than perhaps any other major social theorist, Niklas Luhmann adopted a perspective on society at the opposite end of the atomistic-holistic spectrum to that of mainstream economics. While the position of mainstream economics is that society is nothing more than a collection of individuals, so that it can be understood simply in terms of those individuals and their interactions, Luhmann abstracts from individuals entirely, understanding social phenomena as being produced by society itself, with individuals playing a merely peripheral (...) or “enabling” role. This radical reconceptualization of society and the relation of the individual to society allowed Luhmann to build from the ground up a highly systematic theory of society which allows one to formulate economic and social questions in new ways, freed from preconceptions that are poorly grounded or simply wrong. After providing a brief overview of Luhmann’s general social theory, this article considers two questions for which Luhmann’s theory can produce a fresh point of view. The first concerns what is the nature of markets. According to Luhmann, markets are not a kind of system, but collections of observations--the observations of market participants of other market participants. The second concerns the old question of what is the appropriate degree of intervention in the economy. Mainstream economics approaches this problem through the distinction between markets and planning. According to Luhmann, this is a false dichotomy, since all economies have markets and planning. The real question is who should do the planning: private organizations or the state. The former operate on the basis of competition, that is, rivalry; the latter operates on the basis of cooperation. The problem with “socialist” or “centrally planned” economies was not that they were planned or centrally organized, since “free market” economies have planning and centralization too; it was that they relied solely on cooperation, with there being no space for competition. The paper concludes with some reflections on whether freemarket economies with minimal intervention by the state are any more sustainable than are “socialist” economies.Niklas Luhmann, peut-être plus que les autres auteurs en théorie sociale, a adopté une approche de la société qui est à l’opposé du spectre individualismeholisme des économistes orthodoxes. Alors que l’économie orthodoxe considère que la société n’est rien d’autre que la somme des individus et qu’elle ne peut être appréhendée qu’en termes d’individus et de leurs interactions, Luhmann fait totalement abstraction des individus et comprend les phénomènes sociaux comme étant produits par la société elle-même dans laquelle les individus jouent un rôle périphérique ou un rôle “d’habilitation”. Cette radicale reconceptualization de la société ainsi que la relation des individus à la société a permis à Luhmann de construire une théorie très méthodique de la société qui permet d’appréhender de façon différente les questions économiques et sociales, sans préreprésentations fragiles ou erronées. Après avoir donné un aperçu général de la théorie sociale de Luhmann, l’article considère deux questions pour lesquelles la théorie de Luhmann peut apporter un nouveau point de vue. La première traite de la nature des marchés. D’après Luhmann, les marchés ne sont pas une sorte de système mais des sommes d’observations faites par les participants au marché sur les autres participants. La seconde question concerne l’éternel problème du degré d’interventionnisme dans l’économie. Les économistes orthodoxes abordent cette question à travers la distinction entre les marchés et la planification. D’après Luhmann cette dichotomie est erronée dans la mesure où toutes les économies connaissent à la fois le marché et la planification. La véritable question est: Qui devrait planifier: les organisations privées ou l’Etat?. Les premières agissent sur la base de la concurrence, i.e de la rivalité; l’Etat agit sur la base de la coopération. Le problème avec les économies “socialistes” ou “centralement planifiées” n’est pas qu’elles sont planifiées ou qu’elles relèvent d’une organisation centralisée puisque les économies de “marché libre” connaissent aussi la planification et la centralisation. Le problème vient du fait qu’elles reposent uniquement sur la coopération et n’accordent pas de place à la concurrence. Le papier conclut en s’interrogeant sur l’idée selon laquelle les économies de libre marché avec une intervention étatique minimale sont plus viables que les économies “socialistes”. (shrink)

Bu makalede Giritli Sırrı Paşa’nın (1844-1895) Şerhu’l-Akāid Tercümesi analiz edilmektedir. Makalede öncelikle Sırrı Paşa’nın entelektüel arka planı ve diğer eserlerine değinilerek tercüme tarihsel bağlamına yerleştirmeye çalışıldı. Özellikle mütercimin kelâm tasavvurunu yansıtan mukaddime kısmına dikkat çekildi. Mâtürîdî kelâmına dair klasik bir metnin on dokuzuncu yüzyıl Osmanlı okuyucusu için Şerhu’l-Akāid’in diğer şerh ve haşiyelerindeki farklı yorumları içerecek şekilde tercümenin nasıl genişlediği gösterildi. Tercümede farklı görüşlerin bir araya toplanması, aynı mesele karşısında farklı yaklaşımların birbirleriyle karşılaştırılabilmesini sağlamaktadır. Sırrı Paşa sadece metni tercüme edip diğer (...) yorumları nakletmekle kalmamış, kendi yorumlarını da ortaya koymuştur. Bu nedenle bu tercümeyi “yorumlu tercüme” olarak adlandırmaktayız. Örnek olarak bu çalışma Mâtürîdî ve Eşʿarî ekolleri arasındaki temel ihtilaflardan biri olarak görülen irâde-i cüzʾiyye kavramı üzerine odaklanmaktadır. Sırrı Paşa ve faydalandığı kaynaklardan Cevdet Paşa bu meselede Mâtürîdî görüşü benimsemişlerdir. (shrink)

In this paper I discuss logic from a naturalist point of view, characterizing it as those shared patterns of thought which are socially selected from among the various patterns of thought to which we are naturally inclined. Drawing on Evans-Pritchard's anthropology. I discuss a particular example of Zande thought. I argue that Evans-Pritchard's and Timm Triplett's analyses of this example make the mistake of applying Western logic to Zande beliefs and thus find a contradiction. I argue that from the naturalistic (...) point of view. Zande logic is different from Western logic and that there is no contradiction in Zande thought. (shrink)
