This article develops a discursive explanation of mixed constitution: mixed constitutional ideas and discourse generate mixed constitutional design and practice. On that base, it explores the nature, factors, and functions of the mixed constitution in Vietnam. The emergence of competing constitutional ideas (Confucian, socialist, liberal, universal) animates a constitutional discourse in which different actors adhere to different ideas. Consequently, the 2013 Constitution of Vietnam embodies a mixture of the ideas in its provisions on political institutions, economy, and especially human rights. (...) The enforcement of the constitution induces competing claims to constitutional meanings. The mixed constitution is shaped by path dependency and global diffusion of constitutional ideas. Given this situation, Mark Amerika made two significant contributions with his new book, “My life as an Artificial Creative Intelligence”. This book added to the emerging literary genre collaborated by human artists and AI, telling the story about the advanced ACI developed in the project FATAL (...) ERROR and its relationship with Amerika as its co-author and creator. Moreover, this book documented an in-depth investigation into the nature of creativity and its processes, asking whether creativity is exclusive to the human mind. (shrink)

Religious beliefs are defined as thinking, feeling and behaving in accordance with the beliefs and teachings of a religious system. In other words, religious beliefs are indicative of the role of religion in the individual and social life of people, as well as adherence to values and beliefs in daily life, performing religious practices and rituals and participating in activities of religious organisations. Religious beliefs are a set of dos and don'ts, and values are considered one of the most important (...) psychological supports that can provide meaning in all moments of life and save a person from meaninglessness by providing explanatory support in specific situations. In addition, work conscience is defined as a feeling of inner commitment to comply with agreed-upon requirements for work. In other words, work conscience means heartfelt satisfaction and practical commitment to the tasks that a person is supposed to perform properly, in a way that there will be no negligence in performing the duty even if no supervisor oversees the activity. Given the significant role of nurses in hospitals, especially during the coronavirus disease 2019 (COVID-19) pandemic, the religious beliefs of healthcare employees have become more important. Therefore, the present study aimed to evaluate the effect of religious beliefs on the work conscience of 1800 Muslim nurses in Iraq during the COVID-19 pandemic in 2021. Standard questionnaires were applied to assess the respondents' religious beliefs and work conscience. In addition, data analyses (Cronbach's alpha, Pearson's correlation, etc.) were performed in Statistical Package for the Social Sciences (SPSS). According to the results, religious beliefs have a positive effect on nurses' work conscience (p = 0.822). CONTRIBUTION: The findings of this study showed that the employees of an organisation, especially nurses and healthcare staff, can rely on their religious beliefs and benefit from their advantages in order to strengthen their work conscience during a hard time such as the COVID-19 pandemic. Purpose This study aims to ascertain the impact of data collecting awareness on perceived information security concerns and information-sharing behavior on social networking sites. Design/methodology/approach Based on communication privacy management theory, the study forecasted the relationship between information-sharing behavior and awareness of data collecting purposes, data collection tactics and perceived security risk using structural equation modeling analysis and one-way ANOVA. The sample size of 521 young social media users in Vietnam, ages 18 to 34, was made up of 26.7% men (...) and 73.3% women. When constructing the questionnaire survey method with lone source respondents, the individual’s unique awareness and experiences with using online social networks (OSNs) were taken into account. Findings The results of the investigation demonstrate a significant relationship between information-sharing and awareness of data collecting, perceptions of information security threats and behavior. Social media users have used OSN privacy settings and paid attention to the sharing restriction because they are concerned about data harvesting. Research limitations/implications This study was conducted among young Vietnamese social media users, reflecting specific characteristics prevalent in the Vietnamese environment, and hence may be invalid in other nations’ circumstances. Practical implications Social media platform providers should improve user connectivity by implementing transparent privacy policies that allow users to choose how their data are used; have clear privacy statements and specific policies governing the use of social media users’ data that respect users’ consent to use their data; and thoroughly communicate how they collect and use user data while promptly detecting any potential vulnerabilities within their systems. Vietnam is a communist country. For a Marxist ideologue, “religion is the opium of the masses.” But many communist countries—over the years—have evolved from a strictly atheistic persuasion to a tolerance for religious practices. Except probably in North Korea, this transformation from an atheistic perspective to religious tolerance has become a phenomenon in communist countries like Russia and China.Vietnam did not have that experience. This paper will show that religious pluralism was tolerated, even accepted, in communist Vietnam. I will show (...) how vibrant this religious amalgamation is in Vietnam and demonstrate, as in the case of market economics thriving in communist countries, that Vietnamese communism and religious pluralism can robustly coexist with each other. Reading Stephen Owen's new book, All Mine!: Happiness, Ownership, and Naming in Eleventh-Century China (hereafter All Mine!), many readers will find that the perspectives of eleventh-century Song scholar-officials on finding (...) happiness in material things are still highly relevant to the increasingly materialistic culture in China and the world in the present day. Under the Song dynasty, the pursuit of happiness through material objects is "what contemporaries themselves recognized as uncomfortable topics" (p. 14). In writing this book, Owen attempts to survey a literary phenomenon in which material-contingent happiness permeated Song literature despite the moral surveillance of classical ideology on happiness and ownership that stretched back to the Lunyu (Analects of Confucius). At the same time, the author elucidates how material-contingent happiness in literature drove and was driven by the sociocultural changes and the growth of commercialization in the Song. All Mine! is a fine balance between literary study and intellectual history. Owen's approach tends to be all-inclusive, as he covers a diverse range of genres (including prose, poetry, miscellany, and biography) and texts with which readers generally have different levels of familiarity. For every text, Owen provides thorough explanation on its background, allusions, and references, while also offering in-depth cultural, aesthetic, and structural analysis. He calls our attention to the subtle differences between similar texts, such as the biographies of Ouyang Xiu 歐陽脩 and Tao Yuanming 陶淵明, to show how they deliver entirely different ideas about happiness and ownership and signal a radical transition from the old to a new world of values. Regarding intellectual history, the book studies the conflicts between different discourses on happiness. Owen reveals different forces of censorship against happiness of acquisition and ownership, presenting them especially clearly with Ouyang Xiu's stories in Chapter 1 ("The Biography of the Retired Layman Six") and Chapter 2 ("The Magistrate of Peach Blossom Spring"). The author also pays close attention to the act of naming as a form of ownership. As he points out, the process of Song literati trying to "get the right name" for objects and sites often converged with the process of elaborating different [End Page 1] person-thing relationships based on the social status of the owner and the characteristics of the object of ownership, thereby grounding the principles for judging the morality of material-contingent happiness. Readers can also see the happiness-ownership paradox in literature as closely related to the commercialization of elite-praised goods that was flourishing in Song society. This validates Owen's choice "to think of cultural and historical phenomena as ecosystems or solar systems in constant change, each particular changed by and changing the whole" (p. 13). Perhaps the most impressive chapters in the book are 3 and 5, which deal with the Song's perspective on ownership as transient and unstable, and its relationship with happiness. Chapter 3 explores the pervasive awareness that "things are held by power, not by right" (p. 67). The source of "power" could be financial, social, political, and military advantage, or something humans can't control, like death. Owen relates many sad Song stories of elites whose things were taken by someone with greater power. The most interesting one is perhaps that of Su Dongpo 苏東坡 and his "Nine Blossoms Mountain in a Jug," in which Su was not willing to give up the little world that he attached to this rock mountain, despite being very conscious about the dangers of possession. "It is alright if the superior man lets his interests be temporarily invested in things, but it is not alright if he lets his interest remain in those things," the author writes (p. 72). Chapter 3 contains many examples of "names as a form of ownership." Ownership of physical things can be transient and infringeable, but the writings on names of objects and sites by famous Song literati like Ouyang Xiu and Su Dongpo... (shrink)

We assessed the attitudes, perceptions, and stereotypes toward Latino immigrants among 247 mental health professionals across 32 U.S. states. We also randomly presented two versions of an attitude measure that varied in their references to immigrants. Participants reported that they did not agree with the anti-immigration law Arizona SB 1070 and other similar bills. Also, greater multicultural awareness was related to positive attitudes and fewer stereotypes toward immigrants. Furthermore, participants who were asked to think about “undocumented immigrants” viewed Latino immigrants (...) more positively than those who were asked think about “illegal aliens.” Findings show the continued need for multicultural awareness and competence training for mental health professionals, which align with the American Psychological Association’s Ethical Principles of Psychologists and Code of Conduct. Limitations and future directions for research are discussed. (shrink)

Currently, although the implementation of corporate social responsibility (CSR) practices and its incorporation into business strategies is emphasised widely in developed countries as a key to sustainable growth and economic profitability, this term is still new to the Vietnamese market because of the low awareness of the importance of CSR practices, which leads to the failure of many firms. Since Vietnamese firms do not prioritise CSR implementation, Vietnam is experiencing an increasing shortage of skilled employees owing to a lack of (...) motivation. Therefore, this study examines the relationship between the corporate strategic objective (CSO), CSR practices and employee commitment, to provide recommendations to enhance motivation. This study used a quantitative approach and data from a questionnaire delivered to 869 enterprises in 2019 in Vietnam. Results suggest that the CSO had direct and indirect effects on employee commitment through the mediation of CSR practices. (shrink)

This article addresses the problem of automatically extracting legal indices which express the important contents of legal documents. Legal indices are not limited to single-word keywords and compound-word keywords, they are also clause keywords. We approach index extraction using structural information of Japanese sentences, i.e. chunks and clauses. Based on the assumption that legal indices are composed of important tokens from the documents, extracting legal indices is treated as a problem of collecting chunks and clauses that contain as many important (...) tokens as possible. Each token is assigned a weight which is a statistical score, e.g. TF–IDF and Okapi BM25, to indicate its importance. The importance of a chunk or clause is determined based on the average weight of tokens included in that chunk or clause. Then, highly weighted chunks and clauses are recognized as the indices for legal documents. The experimental results on Japanese National Pension Act data show that our proposed method achieves better performance than TextRank, the most popular unsupervised method in extracting single-word and compound-word keywords. In addition, this approach is also applicable to extract clause keywords with high performance. (shrink)

A major challenge for research in artificial intelligence is to develop systems that can infer the goals, beliefs, and intentions of others (i.e., systems that have theory of mind, ToM). In this research, we propose a cognitive ToM framework that uses a well-known theory of decisions from experience to construct a computational representation of ToM. Instance-based learning theory (IBLT) is used to construct a cognitive model that generates ToM from the observation of other agents' behavior. The IBL model of the (...) observer distinguishes itself from previous models of ToM that make unreasonable assumptions about human cognition, are hand-crafted for particular settings, complex, or unable to explain a cognitive development of ToM compared to human's ToM. The IBL model learns from the observation of goal-directed agents' behavior in a gridworld navigation task, and it infers and predicts the behaviors of the agents in new gridworlds across different degrees of decision complexity in similar ways to the way human observers do. We provide evidence for the alignment of the IBL observer's predictions under various levels of decision complexity. We also advance the demonstration of the IBL predictions using a classic test of false beliefs (the Sally–Anne test), which is commonly used to test ToM in humans. We discuss our results and the potential of the IBL observer model to improve human–machine interactions. (shrink)

Computational drug repositioning has been proven as a promising and efficient strategy for discovering new uses from existing drugs. To achieve this goal, a number of computational methods have been proposed, which are based on different data sources of drugs and diseases. These methods approach the problem using either machine learning- or network-based models with an assumption that similar drugs can be used for similar diseases to identify new indications of drugs. Therefore, similarities between drugs and between diseases are usually (...) used as inputs. In addition, known drug-disease associations are also needed for the methods as prior information. It should be noted that those associations are still not well established due to the fact that many of marketed drugs have been withdrawn and this could affect the outcome of the methods. In this study, we propose a novel method named RLSDR to find new uses of drugs. More specifically, it relies on a semi-supervised learning model, Regularized Least Square, thus it does not require definition of non-drug-disease associations as previously proposed machine learning-based methods. In addition, the similarity between drugs measured by chemical structures of drug compounds and the similarity between diseases which share phenotypes can be represented in a form of either similarity network or similarity matrix as inputs of the method. Moreover, instead of using a gold-standard set of known drug-disease associations, we construct an artificial set of the associations based on known disease-gene and drug-target associations. Experiment results demonstrate that RLSDR achieves better prediction performance on the artificial set of drug-disease associations than that on the gold-standard ones in terms of area under the Receiver Operating Characteristic curve. In addition, it outperforms two representative network-based methods irrespective of the prior information of drug-disease associations. Novel indications for a number of drugs are also identified and validated by evidences from a different data resource. (shrink)

The study of cultural evolution has taken on an increasingly interdisciplinary and diverse approach in explicating phenomena of cultural transmission and adoptions. Inspired by this computational movement, this study uses Bayesian networks analysis, combining both the frequentist and the Hamiltonian Markov chain Monte Carlo (MCMC) approach, to investigate the highly representative elements in the cultural evolution of a Vietnamese city’s architecture in the early 20th century. With a focus on the façade design of 68 old houses in Hanoi’s Old Quarter (...) (based on 78 data lines extracted from 248 photos), the study argues that it is plausible to look at the aesthetics, architecture, and designs of the house façade to find traces of cultural evolution in Vietnam, which went through more than six decades of French colonization and centuries of sociocultural influence from China. The in-depth technical analysis, though refuting the presumed model on the probabilistic dependency among the variables, yields several results, the most notable of which is the strong influence of Buddhism over the decorations of the house façade. Particularly, in the top 5 networks with the best Bayesian Information Criterion (BIC) scores and p<0.05, the variable for decorations (DC) always has a direct probabilistic dependency on the variable B for Buddhism. The paper then checks the robustness of these models using Hamiltonian MCMC method and find the posterior distributions of the models’ coefficients all satisfy the technical requirement. Finally, this study suggests integrating Bayesian statistics in the social sciences in general and for the study of cultural evolution and architectural transformation in particular. (shrink)

Vietnam is home to a prospering technology community and numerous enterprises that range from small start-ups to development giants. Virtually all public services are offered online. In fact, the country even has a system for e-residency and “data embassies.” This achievement derives in part from the nation’s transparent and enduring political preferences, but more importantly from Vietnamese law and its regulatory system regarding information, the digital general public, and intellectual property rights (IPR) protection. In this examination of the most pertinent (...) aspects of Vietnam’s digital economy legislation, this study explores the nation’s regulatory structure regarding copyright and patents within the context of digital transformation. The study discusses the relationship between foreign and national regulations in terms of IPR protection and the advancement of digitalization. Research on Vietnamese regulations and the practical application of major patent and copyright regulations has revealed that in many respects, the nation is highly reliant on the effective operation of a broader foreign institutional and legal framework. Thus, in the near future, technological advancement will necessitate the establishment of additional transnational regulatory systems. (shrink)

This paper introduces a novel method to control the operation of the active suspension system. In this research, a quarter-dynamic model is used to simulate the vehicle’s vibrations. Besides, the sliding mode-PID-integrated algorithm with five state variables is proposed to be used. This is a completely original and novel algorithm. The process of establishing the control algorithm is clearly described. The simulation is performed by the MATLAB software. The results of the paper have shown the advantages of the sliding mode-PID (...) algorithm used in this research. Accordingly, the displacement and acceleration of the sprung mass were significantly reduced when this algorithm was used. The maximum and average values of the displacement of the sprung mass are only 1.31% and 1.29%, respectively, compared with the situation of the vehicle using a passive suspension. Similarly, the value of the acceleration is 6.98% and 2.94%, respectively. In addition, the phenomenon of “chattering” has also been significantly reduced when using this controller. In the future, some more complex algorithms can be proposed. (shrink)

Banks play a unique role in society. They not only maximize profits but also consider the interests of stakeholders. We investigate whether banks consider firms’ pollution records in their lending decisions. The evidence shows that banks offer significantly higher loan spreads, higher total borrowing costs, shorter loan maturities, and greater collateral to firms with higher levels of chemical pollution. The costly effects are stronger for borrowers with greater risk and weaker corporate governance. Further, the results show that banks with higher (...) social responsibility account for their borrowers’ environmental performance and charge higher loan spreads to those with poor performance. These results support the idea that banks with higher social responsibility can promote the practice of business ethics in firms. (shrink)
