Despite continuing controversies regarding the vital status of both brain-dead donors and individuals who undergo donation after circulatory death (DCD), respecting the dead donor rule (DDR) remains the standard moral framework for organ procurement. The DDR increases organ supply without jeopardizing trust in transplantation systems, reassuring society that donors will not experience harm during organ procurement. While the assumption that individuals cannot be harmed once they are dead is reasonable in the case of brain-dead protocols, we argue that the DDR (...) is not an acceptable strategy to protect donors from harm in DCD protocols. We propose a threefold alternative to justify organ procurement practices: (1) ensuring that donors are sufficiently protected from harm; (2) ensuring that they are respected through informed consent; and (3) ensuring that society is fully informed of the inherently debatable nature of any criterion to declare death. OBJECTIVE: To describe the issues faced, and how they were addressed, by the University of Toronto Critical Care Medicine Program/Joint Centre for Bioethics Task Force on Appropriate Use of Life-Sustaining Treatment. The clinical problem addressed by the Task Force was dealing with requests by patients or substitute decision makers for life-sustaining treatment that their healthcare providers believe is inappropriate. DESIGN: Case study. SETTING: The University of Toronto Joint Centre for Bioethics/Critical Care Medicine Program Task Force on Appropriate Use of Life-Sustaining (...) Treatment. PARTICIPANTS: The 24-member Task Force included physician and nursing leaders from five critical care units, bioethicists, a legal scholar, a health administration expert, a social worker, and a hospital public relations professional. INTERVENTIONS: None. MEASUREMENTS AND MAIN RESULTS: Our specific lessons learned include a) a policy focus on process; b) use of a negotiation and mediation model, rather than a hospital ethics committee model, for this process; and c) the policy development process is itself a negotiation, so we recommend equal involvement of interested groups including patients, families, and the public. CONCLUSIONS: This article describes the key issues faced by the Task Force while developing its policy. It will provide a useful starting point for other groups developing policy on appropriate use of life-sustaining treatment. (shrink)

The revisionist critique of conventional just war theory has undoubtedly scored some important victories. Walzer’s elegantly unified defense of combatant legal equality and noncombatant immunity has been seriously undermined. This critical success has not, however, been matched by positive arguments, which when applied to the messy reality of war would deprive states and soldiers of the permission to fight wars that are plausibly thought to be justified. The appeal to law that is sought to resolve this objection by casting it (...) as a practical concern, a pragmatic worry about implementation, which while germane to debates over the laws of war, need not undermine our convictions in the fundamental principles the revisionists advocate. This response is inadequate. Revisionists have not shown that soldiers should obey the laws of war, in practice, when they conflict with their other moral reasons – our worries about application remain intact. Moreover, a theory of war that offers only an account of the laws of war, and a set of fundamental principles developed in abstraction from feasibility constraints, is radically incomplete. We need to know how to apply those fundamental principles, and whether, when applied, they lead to defensible conclusions. Only two options seem to remain. Perhaps the revisionists’ arguments for their chosen fundamental principles are sufficiently compelling that we should stick with them, and accept their troubling conclusions – in other words, accept pacifism. Alternatively, we need to revise our fundamental principles, so that when applied they yield conclusions that we can more confidently endorse. -/- Though it does not save the revisionist view from the responsibility dilemma and cognate objections, the appeal to law does raise an important, and previously inadequately theorized, question – or, rather, resurrects a neglected topic, discussed in depth by historical just war theorists such as Grotius and Vattel. There are good grounds for distinguishing the laws of war from the morality of war, and for adjusting the former to accommodate predictable noncompliance, that should not impact on our account of the latter. Nonetheless, I have argued that there are some profound moral insights underlying both combatant legal equality and noncombatant immunity: specifically, we cannot infer from a combatant’s side having not satisfied jus ad bellum that he may not justifiably use lethal force; and other things equal, it is more wrongful to harm a nonliable noncombatant than to harm a nonliable combatant. Wars are large-scale conflicts between organized groups of belligerents, which involve suffering, devastation, and brutality unlike almost anything else in human experience. Whatever one’s other beliefs about morality, all should agree that the horrors of war are all but unconscionable, and that warfare can be justified only if we have some compel- ling account of what is worth fighting for, which can justify contributing, as individu- als and as groups, to this calamitous endeavour. Although this question should obviously be central (...) to both philosophical and politi- cal discussion about war, it is at the forefront of neither. In recent years, philosophical discussion of warfare has bloomed, but the debate has focused on whom we may kill, on the assumption that our aims are justified.1 Political debate, meanwhile, is more concerned with matters of prudence, international law, and public justification, than with reassessing what is worth fighting for. For wars of intervention to halt or prevent massive humanitarian crises, this gap is not so troubling. When warfare is the only means to prevent the mass killing or enslavement of the innocent, the purposes of military force are clear enough (though undoubtedly many other problems remain). The problem is more pressing, how- ever, for the justification of national defence.3 Although common-sense morality and international law view national defence as the paradigm case of justified warfare, grounding this consensus is surprisingly difficult.4 We typically believe that any state is justified in using lethal force to protect its territory against any form of uninvited military incursion by any other state. And yet we lack a good argument to explain why this should be so. In this chapter, I explain why one familiar and otherwise plausible approach to the justification of killing in war cannot adequately ground common-sense views of permissible national defence.5 Reductionists believe that justified warfare reduces to an aggregation of acts that are justified under ordinary principles of interpersonal morality.6 The standard form of reductionism focuses on the principles governing killing in ordinary life, specifically those that justify intentional killing in self- and other-defence, and unintended but foreseen (for short, collateral) killing as a lesser evil. Justified warfare, on this view, is no more than the coextension of multiple acts justified under these two principles. Reductionism is the default philosophical approach to thinking through the ethics of killing in war. It makes perfect sense to ask what principles govern permissible kill- ing in general, before applying them to the particular context of war. If it cannot deliver a plausible set of conclusions about when national defence is permitted, then we must either revise our beliefs about which conclusions count as plausible, or else face the significant challenge of developing a different theoretical model for justifying war- fare—an exceptionalist model, which views war as an exception to the regular moral landscape, to which principles apply which apply to nothing else but war.7 We must show, in other words, that there is something worth fighting for in wars of national defence, which is not engaged when we use force in any other context. The chapter proceeds as follows. Section 2.2 sets out the argument against reduc- tionism.8 Section 2.3 considers and rebuts one common response to the argument, which has often been thought sufficient grounds to disregard its conclusion. Section 2.4 then asks whether a modified reductionism would survive unscathed by the argu- ment. Finally, section 2.5 sets out some desiderata on a plausible exceptionalist alterna- tive. This paper elaborates and defends an expressivist account of the claims of mind-independence embedded in ordinary moral thought. In response to objections from Zangwill and Jenkins it is argued that the expressivist 'internal reading' of such claims is compatible with their conceptual status and that the only 'external reading' available doesn't commit expressivisists to any sort of subjectivism. In the process a 'commitment-theoretic' account of the semantics of conditionals and negations is defended.

Some people argue that the distribution of medical resources should be sensitive to agents’ responsibility for their ill-health. In contrast, others point to the social determinants of health to argue that the collective agents that control the conditions in which agents act should bear responsibility. To a large degree, this is a debate in which those who hold individuals responsible currently have the upper hand: warranted appeals to individual responsibility effectively block allocation of any significant degree of responsibility to collective (...) agents. We suggest that a different understanding of individual responsibility might lead to a fairer allocation of blame. Scaffolded agency is individual agency exercised in a context in which opportunities and affordances are structured by others. Appeals to scaffolded agency at once recognize the role of the individual and of the collective agents who have put the scaffolds in place. (shrink)

I defend hedonism about moral value by first presenting an argument for moral skepticism, and then showing that phenomenal introspection gives us a unique way to defeat the skeptical argument and establish pleasure's goodness.

McKenna’s critique (rather than criticisms) of idealized approaches to epistemology is an important contribution to the literature. In this brief discussion, I set out his main concerns about more idealized approaches, within and beyond social epistemology, before turning to some issues I think he neglects. I suggest that it’s important to pay attention to the prestige hierarchy in philosophy, and to how that hierarchy can serve ideological purposes. Causal theories of action, perception and knowledge are each beset by problems of so-called ‘deviant’ causal chains. For each such theory, counterexamples are formed using odd or co-incidental causal chains to establish that the theory is committed to unpalatable claims about some intentional action, about a case of veridical perception or about the acquisition of genuine knowledge. In this paper I will argue that three well-known examples of a deviant causal chain have something in common: they each violate Yablos proportionality (...) constraint on causation. I will argue that this constraint provides the key to saving causal theories from deviant chains. (shrink)

How may we characterize the intrinsic structure of physical quantities such as mass, length, or electric charge? This article shows that group-theoretic methods—specifically, the notion of a free and transitive group action—provide an elegant way of characterizing the structure of scalar quantities, and uses this to give an intrinsic treatment of vector quantities. It also gives a general account of how different scalar or vector quantities may be algebraically combined with one another. We explain and explore class-theoretic potentialism—the view that one can always individuate more classes over a set-theoretic universe. We examine some motivations for class-theoretic potentialism, before proving some results concerning the relevant potentialist systems (in particular exhibiting failures of the $\mathsf {.2}$ and $\mathsf {.3}$ axioms). We then discuss the significance of these results for the different kinds of class-theoretic potentialists.

For more than 60 years, Chomsky has been an intellectual Colossus bestriding the worlds of language, philosophy, and the cognitive sciences, and focusing attention on the whole field and emphasizing the crucial importance of domains overlooked by the mainstream. One such area is the study of first‐language acquisition. This chapter considers “atypical acquisition” to cover two conceptually related situations. First, it covers a variety of cases where there is an obvious “poverty of the stimulus” in that children either receive or (...) perceive no linguistic input at the essential early stages referred to as critical periods. Second, it covers where there is rather the opposite situation. The chapter presents atypicality in language acquisition that stems from the learner's atypical neurological profile rather than environmental or input properties. This book was written with my University of Mississippi "Philosophy of Religion" students in mind. Many of them have no prior experience with philosophy. That is why Chapter One begins with a crash course in philosophy, with an emphasis on the basic concepts in logic, metaphysics, and epistemology. While not all students may need to cover that material, quite a few will. And for the rest, a refresher never hurts. I am sure this applies to many "Philosophy of Religion" courses (...) taught elsewhere. With that in mind, instructors are advised to begin with Chapter One. The subsequent chapters have been arranged in sequence, with each chapter building on the prior ones. However, the chapters are not that tightly bound, so instructors could cover the chapters out of sequence without much disruption. Key terms are underlined. Sometimes the key terms also occur with an associated hyperlink. Other terms have a hyperlink without a corresponding key term. In the print the hyperlink is included as a footnote, in the ebooks the term is hyperlinked [Production - check the ebooks will have hyperlinbks - amend wording here if not]. In general, the hyperlinks follow a pattern. Informally rigorous mathematical reasoning is relevant. So too should be the premises to the conclusions of formal proofs that regiment it. The rule Ex Falso Quodlibet induces spectacular irrelevance. We therefore drop it. The resulting systems of Core Logic C and Classical Core Logic C+ can formalize all the informally rigorous reasoning in constructive and classical mathematics respectively. We effect a revised match-up between deducibility in Classical Core Logic and a new notion of relevant logical consequence. It matches better the (...) deducibility relation of Classical Core Logic than does the Tarskian notion of consequence. It is implosive, not explosive. (shrink)

I defend ethical hedonism, the view that pleasure is the sole good thing, by arguing that it offers the only answer to an argument for moral skepticism. The skeptical problem arises from widespread fundamental moral disagreement, which entails the presence of enough moral error to undermine the reliability of most processes generating moral belief. We know that pleasure is good through the reliable process of phenomenal introspection, which reveals what our experiences are like. If knowing of pleasure’s goodness through phenomenal (...) introspection is the only reliable way to form our initial moral beliefs, we should accept ethical hedonism. (shrink)

He defends a particular account of consciousness--the global workspace view--and argues that consciousness plays an especially important role in action. There are good reasons to think that the naïve assumption, that consciousness is needed for moral responsibility, is in fact true.

Epistemic akrasia can be rational. I consider a lonely pragmatist who believes that her imaginary friend doesn’t exist, and also believes on pragmatic grounds that she should believe in him. She rationally believes that her imaginary friend doesn’t exist, rationally follows various sources of evidence to the view that she should believe in him to end her loneliness, and rationally holds these attitudes simultaneously. Evidentialism suggests that her ambivalent epistemic state is rational, as considerations grounded in the value of truth (...) justify her beliefs. (shrink)

This magisterial analysis of human history combines the insights of earlier generations of Marxist historians with radical new ideas about the historical process. Reading history against the grain, Neil Faulkner reveals that what happened in the past was not predetermined. Choices were frequent and numerous. The temple is a pivotal event in the religious life of the different cultures. In the article some aspects of the experience of the temple as sacred space are addressed. Qualitative dimensions of sacred space in Christianity and Islam as their directionality, hierarchy and dynamics are analyzed. What is the basis of our capacity to act morally? This is a question that has been discussed for millennia, with philosophical debate typically distinguishing two sources of morality: reason and sentiment. This collection aims to shed light on whether the human capacity to feel for others really is central for morality and, if so, in what way. Our regimentation of Goodman and Myhill’s proof of Excluded Middle revealed among its premises a form of Choice and an instance of Separation.Here we revisit Zermelo’s requirement that the separating property be definite. The instance that Goodman and Myhill used is not constructively warranted. It is that principle, and not Choice alone, that precipitates Excluded Middle.Separation in various axiomatizations of constructive set theory is examined. We conclude that insufficient critical attention has been paid to how those forms of Separation fail, (...) in light of the Goodman–Myhill result, to capture a genuinely constructive notion of set. This book focuses on the nature and importance of harm by providing a sustained defense of the counterfactual comparative account, in particular by extending the account to allow for a certain kind of plural or collective harm. According to the counterfactual comparative account, an event harms a person provided that she would have been better off had it not occurred. On the account defended in this book, there are cases in which some events harm a given individual even though none (...) of them by itself harms the individual. This account aims to solve the most serious problem facing the counterfactual comparative account, a problem involving cases of preemption. In such cases, an intuitively harmful event does not make the victim worse off, since if it had not occurred, another event would have had a similar adverse influence on the victim’s well-being. The book also contains discussion of various competing accounts of harm, and it replies to other challenges to the counterfactual comparative account. It argues, moreover, that an action that would harm a person does not thereby have a strong moral reason against it; if there is a strong moral reason against a harmful act, the reason is due primarily to some of the act’s other features. Emerging from the confusion and chaos of neoliberal economic systems around the world, this book brings together a collection of major philosophical ideas from previous centuries and applies them to the practice of education. The book argues that pragmatist philosophy is the most appropriate to guide the organisation of curriculum, pedagogy and assessment.
