Conventional forensic DNA analysis involves a matching principle, which compares DNA profiles from evidential samples to those from reference samples of known origin. In casework, however, the accessibility to a reference sample is not guaranteed which limits the use of DNA as an investigative tool. This has led to the development of phenotype prediction, which uses SNP analysis to estimate the physical appearance of the sample donor. Physical traits, such as eye, hair and skin colour, have been associated with certain (...) alleles within specific genes involved in the melanogenesis pathways. These genetic markers are also associated with ancestry and their trait prediction ability has mainly been assessed in European and North American populations. This has prompted research investigating the discriminatory power of these markers in other populations, especially those exhibiting admixture. South Africa is well known for its diversity, and the viability of these particular SNPs still needs to be assessed within this population. South African law currently restricts the use of DNA for molecular phenotyping, and there are also numerous ethical and social considerations, all of which are discussed. (shrink)

Critical analyses of literatures of the Indian diaspora discuss the “home” of origin as a subtext and a site to which diasporas aspire to return even though it remains an unachievable ideal that is refracted through nostalgic retellings of a space that remains at best “imaginary” (Mishra 2007). Alternatively, some critics, as Roger Waldinger and David Fitzgerald point out, view diasporas’ relationship with the homeland in terms of “loyalty,” obscuring in the process the antagonisms that may arise depending upon one’s (...) circumstances, antagonisms that produce “interactions” between homes of residence and those of origin (2012). In South Asian drama in Canada, many of the concerns regarding race, multiculturalism, job discrimination and violence against women and other marginalized groups are propelled by their links to the playwrights’ “home” of origin. With attention to selected plays, this paper will analyze how the networks between home and spaces of residence in multicultural Canada come alive on theatre stages through visual motifs, actors, props, and photographic collages, which confront the different trajectories of “home” that resurface in these plays. Through live scenes of imagination that speak to spectators, several plays under discussion in this essay expose how, while providing emotional sustenance for some, the baggage of “home” may also pose challenges in the home of residence. So the questions I raise are: How does home appear? To what end? And what does returning “home” teach us about the inequalities and injustices underlying the current global order? (shrink)

This paper contributes to biodiversity and species extinction literature by examining the relationship between corporate accountability in terms of species protection and factors affecting such accountability from forward-thinking companies. We use triangulation of theories, namely deep ecology, legitimacy, and we introduce a new perspective to the stakeholder theory that considers species as a ‘stakeholder’. Using Poisson pseudo-maximum likelihood regression, we examine a sample of 200 Fortune Global companies over 3 years. Our results indicate significant positive relations between ecologically conscious companies (...) that are accountable for the protection of biodiversity and species extinction and external assurance, environmental performance, partnerships with socially responsible organizations and awards for sustainable activities. Our empirical results appear to be robust in controlling for possible endogeneities. Our findings contribute to the discussion on the concern of species loss and habitat destruction in the context of corporate accountability, especially in responding to the sixth mass extinction event and COVID-19 crisis. Our results can also guide the policymakers and stakeholders of the financial market in better decision making. (shrink)

The historical mode may be the dominant mode of constructing the past in most parts of the globe but it is certainly not the most popular mode of doing so. The dominance is derived from the links the idea of history has established with the modern nation-state, the secular worldview, the Baconian concept of scientific rationality, nineteenth-century theories of progress and, in recent decades, development. This dominance has also been strengthened by the absence of any radical critique of the idea (...) of history within the modern world and for that matter, within the discipline of history itself. As a result, once exported to the nonmodern world, the historical consciousness has not only tended to absolutize the past in cultures that have lived with open-ended concepts of the past or depended on myths, legends, and epics to define their cultural selves, it has also made the historical worldview complicit with many new forms of violence, exploitation and satanism in our times and helped rigidify civilizational, cultural, and national boundaries. This book brings together a series of interviews conducted by noted Iranian social scientist Ramin Jahanbagloo. These interviews cover the ideas of Indian-ness, Indian thought, religion, politics, secularism, and pluralism, as well as Gandhi, India and Pakistan, democracy, globalization and culture.

There is an argument according to which there must be something nonrelationally valuable for anything to be of value. The chains of dependence between values must come to an end, and humanity meets the specifications. I explore alternatives to terminating a regress in nonrelational value and give reason to reject the “borrowing” conception of relational value that drives the argument. I doubt that the nonrelational value of humanity can be secured by an argument from the structure of value, but I (...) am optimistic about the prospects for explaining our value relationally and give reason to favor a reflexive relational model. The doctor-patient relationship is the foundation of any medical intervention. Over time, the relationship has changed, from the era of paternalism to the era of self-determination or patient autonomy, following changes resulting from consumerism and lately, in South Africa, socialised medicine as a result of the proposed National Health Insurance. The premise of this article is that patient autonomy is invariably limited by a determination of who will carry the cost of a medical intervention. In recent years, legislative developments have (...) affected the understanding of a patient and doctor through the introduction of new references, such as ‘user’, ‘data subject’ and ‘consumer’ for a patient, and ‘service provider’ and ‘responsible party’ for a doctor, each giving different meanings to the doctor-patient relationship. Recent statutory additions also include new remedies available to aggrieved patients as parties in the doctor-patient relationship. The article concludes with brief observations on how the NHI will alter the essence and nature of the doctor-patient relationship in future. (shrink)

This article explores Albert Stephanus Geyser’s understanding and application of the Christ-hymn, focusing especially on the use of the words μορφή θεοῦ. The tension between a literary-critical approach to the text versus a dogmatic understanding is exposed, as well as the challenge of a political ideology of power. Geyser’s understanding and application are measured in terms of the current state of New Testament exegetical research. In the footsteps of Stendahl and contemporary New Testament scholars, legitimacy is given to a socio-political (...) reading of the text. Geyser is appreciated as a public theologian with a deep consideration for the text as the source for theological and socio-political reflection and practice. (shrink)

L. Nandi Theunissen offers an original and provocative account of the value of humanity. Human beings have value just as anything of value has value: because we are capable of being of value to someone--in the first place, to ourselves. And this explains the key forms of ethical responsiveness that we owe to one another.

This paper describes a traditional SIR type epidemic model with saturated infection rate and treatment function. The dynamics of the model is studied from the point of view of stability and bifurcation. Basic reproduction number is obtained and it is shown that the model system may possess a backward bifurcation. The global asymptotic stability of the endemic equilibrium is studied with the help of a geometric approach. Optimal control problem is formulated and solved. The purpose of this article is to address the questions as to whether a criminal conviction of a healthcare practitioner should affect his or her professional standing, and whether such conviction constitutes ‘unprofessional conduct’ in terms of the Health Professions Act. The article also explores a related matter, namely whether the Health Professions Council of South Africa (HPCSA) has a legal duty to refer complaints regarding unprofessional conduct that displays criminal elements for criminal prosecution. After considering relevant case law on (...) these issues, the article concludes that a practitioner, after being convicted of an offence, should be afforded an opportunity to explain him- or herself to the board, not only in extenuation of the conduct in question, but also in response to the question of whether the conduct constitutes improper or disgraceful conduct. Moreover, the article explains why the HPCSA and professional boards have a legal duty to refer matters of unprofessional conduct with criminal elements in terms of section 34 of the Prevention and Combating of Corrupt Activities Act to law enforcement agencies. With biobank research on the increase and the history of exploitation in Africa, it has become necessary to manage the transfer of human tissues across national boundaries. There are many accepted templates of Material Transfer Agreements that currently exist internationally. However, these templates do not address the specific concerns of South Africa and even of Africa as a continent. This article will examine three significantly important ethico-legal concepts that were deliberated and carefully adapted by a South African Institution to suit (...) the transfer of Human Biological Materials and associated data for biobank research, namely: informed consent; benefit sharing arrangements; and ownership together with intellectual property rights in human tissues. The discussion includes an analysis of current practice; the ethico-legal challenges in the South African/African context; the decisions made with regard to how the related ethico-legal challenges were addressed in the MTA; and justifications for implementing these decisions. The processes considered could be of benefit to other developing world countries who consider it necessary to manage the transfer of HBMs across national boundaries. (shrink)

The authors argue that the chain of events which they describe is the end-product of a century's effort to convert Hindus into a 'proper' modern nation and a conventional ethnic majority. Simultaneously, the effort is equally to turn the followers of other Indian faiths into well-behaved ethnic minorities and nationalities. The American model of a 'melting pot' is being imposed with the expectation that it will dissolve India's primordial identities. A society which has for centuries been a salad bowl of (...) diverse communities, each identifiably different but constituting parts of a whole, is being forced to conform to the pattern of a 'proper' nation-state. Over the last several years, regular evaluation of development programs has become essential in measuring and understanding their true impact. Feminist and gender-sensitive evaluations have gradually emerged, drawing attention to existing inequities--gender, caste, class, location, and more--and the cumulative effect of these biases on daily life. Such evaluations are also deeply political; they explicitly acknowledge that gender-based inequalities exist, show how they remain embedded in society, and articulate ways to address them. Based on four years of research, Voices and Values (...) offers critical insight into how gender, class, and nationality inflect and affect sociological research. It examines how feminist evaluations could make an effective contribution to new policy formulations oriented to gender and social equity. The essays here focus centrally on the structural roots of inequity: giving weight to all perspectives; adding value to marginalized groups and people under evaluation; and taking forward the findings of evaluation into advocacy for change. A definitive feature of Kant's moral philosophy is its rationalism. Kant insists that moral theory, at least at its foundation, cannot take account of empirical facts about human beings and their circumstances in the world. This is the core of Kant's commitment to ‘metaphysics of morals’, and it is what he sees as his greatest contribution to moral philosophy. The paper clarifies what it means to be committed to metaphysics of morals, why Kant is committed to it, and where he (...) thinks empirical considerations may enter moral theory. The paper examines recent work of contemporary Kantians who argue that there is a central role for empirical considerations in Kant's moral theory. Either these theorists interpret Kant himself as permitting empirical considerations to enter, or they propose to extend Kant's theory so as to allow them to enter. With some qualifications, I argue that these interpretive trends are not supported by the texts, and that the proposed extensions are not plausibly Kantian. Kant's insistence on the exclusion of empirical considerations from the foundations of moral theory is not an incidental feature of his thought which might be modified while the rest remains unchanged. Rather, it is the very centre of his endeavours in moral philosophy. If we disagree with it, I argue, we have grounds for moving to a distinctly different theoretical framework. (shrink)

Structural change in the cellular prion protein, PrPC to a ProteinaseK‐resistant β‐sheet‐rich insoluble form PrPSC and its accumulation have been considered to be central to the pathogenesis of the prion diseases (TSE). In a recent paper, Deleault et al have shown that specific endogenous RNA molecules can induce in vitro structural conversion of endogenous PrPC to PrPSC.1 Small highly structured synthetic RNAs can also induce this conversion process.2 However, recent in vivo results show that PrPSC is not directly involved in (...) the prion pathogenesis.3 It is possible, however, that nucleic‐acid‐induced PrPSC associated with the inducer nucleic acid could be the components of the infectious agent.
