In this paper I present an interpretation of J. G. Fichte's transcendental argument for the necessity of mutual recognition in Foundations of Natural Right. Fichte's argument purports to show that, as a condition of the possibility of self-consciousness, we must take ourselves to stand in relations of mutual recognition with other agents like ourselves. After reconstructing the steps of Fichte's argument, I present what I call the ‘modal dilemma’, which highlights a serious ambiguity in Fichte's deduction. According to the modal (...) dilemma, the conclusion to Fichte's transcendental argument—that as a condition of the possibility of our self-consciousness, we must recognize and be recognized by others—expresses either metaphysical or normative necessity. However, no normative conclusion follows from Fichte's premises, and the metaphysical claim that does follow from his argument appears to be implausibly strong. Thus the argument looks like a failure on either interpretation of the conclusion's modality. In the penultimate section of the paper, I propose a new interpretation of the argument that avoids the modal dilemma and provides a normative grounding of Fichte's concept of right. (shrink)

This paper addresses the following questions: what is Fichte’s first principle of right, how does he argue for it, and how does it function as the first principle of his substantive political theory? To answer these questions, the paper offers an overview of the main steps of Fichte’s derivation of the principle of right, explains its relationship to Fichte’s account of individual personhood, and then specifies some of the senses in which the resulting principle serves as the foundation of the (...) rest of Fichte’s political and economic theory. I focus on the developmental logic of Fichte’s account of the “summons” and the “relation of right.” This developmental logic, I argue, is both recapitulated and completed within Fichte’s political theory and political economy. My paper reconstructs Fichte's property theory and political economy in Foundations of Natural Right and The Closed Commercial State. Fichte's theory of property requires the rejection of the classical liberal theory of property rights. Fichte's alternative theory of property, in conjunction with his republican account of the state's role in guaranteeing individual rights, further requires the rejection of a market economy in favor of a planned economy. For Fichte's view entails the normative necessity of a political economy in which the (...) production and transfer of goods and services, across large sectors of the economy, are mandated by the state in advance in accordance with an economic plan. As a result, Fichte reconceives his contractualism as necessarily including the negotiation of a state‐enforced plan for eco- nomic activity. Thus, Fichte's new theory of property in Foundations of Natural Right has extremely wide‐ranging implications for the rest of his political and economic thought. The negotiation of fair terms of political associa- tion characteristic of classical contractualist thought becomes in Fichte's hands the negotiation of an economic plan that defines each individual's socioeconomic rights. I conclude with some brief remarks on the sense in which Fichte's theory serves as a cautionary tale for later socialists. (shrink)

Abstract In his 2009 article "Right and Coercion," Marcus Willaschek argues that the Categorical Imperative and the Universal Principle of Right are conceptually independent of one another because (1) the concept of right and the authorization to use coercion are analytically connected in Kant's "Doctrine of Right", but (2) the authorization to coerce cannot be derived from the Categorical Imperative. Given that the principle of right just is a principle of authorized coercion, the fact that the authorization to coerce cannot (...) be derived from the Categorical Imperative implies that the Principle of Right cannot be derived from the Categorical Imperative. Against this claim, I first argue that a satisfactory deduction of the concept of right can be constructed out of the Categorical Imperative, the fact that we are embodied, and the fact that we act from motives other than duty. I then argue that the insufficiency of the Categorical Imperative, by itself, to generate the Principle of Right does not prevent us from interpreting the Principle of Right as a specification of the Categorical Imperative. I develop this point by means of an analogy with Kant's discussion of the moral law and the Categorical Imperative in the Groundwork. (shrink)

This article discusses three topics that have been the subject of debate in recent scholarship on Hegel's social and political philosophy: first, the relevance of Hegel's systematic metaphysics for interpreting Hegel's social and political writings; second, the relation between recognition, social institutions, and rational agency; and third, the connection between the constellation of institutions and norms that Hegel calls “ethical life” and Hegel's theory of freedom. This article provides a critical overview of the positions in these three debates. In the (...) case of the first debate, I clarify the conceptual terrain by distinguishing between several kinds of systematicity that are at issue. In the case of the second debate, I argue that the views of two of the major participants, Axel Honneth and Robert Pippin, are in fact compatible. In the case of the third debate, I seek to clarify the connection in Hegel between two different ideas of freedom in ethical life, each of which has been emphasized by different interpreters of Hegel: the idea of freedom as non-alienation and the idea of freedom as social freedom. I conclude with a discussion of the ways in which ethical life, for Hegel, enables the freedom of individuals. (shrink)

Review of Foundations of Evidence Law, by Alex Stein.

This book defends a form of ethical intuitionism, according to which (i) there are objective moral truths; (ii) we know some of these truths through a kind of immediate, intellectual awareness, or "intuition"; and (iii) our knowledge of moral truths gives us reasons for action independent of our desires. The author rebuts all the major objections to this theory and shows that the alternative theories about the nature of ethics all face grave difficulties.

Nations are in relations with each other in cultural, economic, political and military fields. It is unthinkable for the languages of nations to be independent of this relationship and closed to influence. Interlingual interaction, exchange of words and phrases is a requirement of the natural structure of the language. Therefore, languages have exchanged words with each other. Throughout history, Turkish has borrowed words from other languages and given them words. Arabic is one of the languages with which Turkish exchanges words. (...) In this study, some words used in the dialects of Karaman and Konya region and thought to be related to Arabic were emphasized. In the process of selecting and compiling the words, first of all, the literature was reviewed and the dictionary parts of the studies on the dialects of the mentioned regions were examined in detail. The words compiled by the literature review were confirmed from the first mouths, sometimes by structured and sometimes semi-structured interview method. In this way, example sentences about the use of words were recorded and the regions where they were used were pointed out. The words identified during the compilation process were classified as nouns, verbs, adjectives, adverbs and pronouns in terms of type. It was seen that all of them would exceed the volume of one article and it was necessary to consider them in separate studies. In this respect, in this study, words such as adjectives, adverbs and pronouns used in the dialects of Karaman and Konya regions and thought to be of Arabic origin are discussed, and it is planned to examine nouns and verbs in other studies. The words were compared with the information in the Compilation Dictionary (Dictionary of Turkish Dialects), it was seen that some words were not included in the Compilation Dictionary and it was proposed to add these words to the dictionary. In the study, a total of 37 words, 22 in the Compilation Dictionary and 15 not in the Compilation Dictionary, were discussed. (shrink)

Contemporary discussions of skepticism often frame the skeptic's argument around an instance of the closure principle. Roughly, the closure principle states that if a subject knows p, and knows that p entails q, then the subject knows q. The main contention of this paper is that the closure argument for skepticism is defective. We explore several possible classifications of the defect. The closure argument might plausibly be classified as begging the question, as exhibiting transmission failure, or as structurally inefficient. Virtually all philosophers agree that for a belief to be epistemically justified, it must satisfy certain conditions. Perhaps it must be supported by evidence. Or perhaps it must be reliably formed. Or perhaps there are some other "good-making" features it must have. But does a belief's justification also require some sort of awareness of its good-making features? The answer to this question has been hotly contested in contemporary epistemology, creating a deep divide among its practitioners. Internalists, who tend to focus (...) on scientific or theoretical beliefs as the ideal, insist that such awareness is required for justification. Externalists, who think children's ordinary beliefs in obvious facts are paradigm cases of justified belief, say it isn't required. Nance reads these texts against the social and cultural conditions of their making, establishing a solid historical basis for the interpretation of key beliefs and doctrines.

Externalist theories of justification create the possibility of cases in which everything appears to one relevantly similar with respect to two propositions, yet one proposition is justified while the other is not. Internalists find this difficult to accept, because it seems irrational in such a case to affirm one proposition and not the other. The underlying internalist intuition supports a specific internalist theory, Phenomenal Conservatism, on which epistemic justification is conferred by appearances.

Ethicists generally agree that there are supererogatory acts, which are morally good, but not morally obligatory. It is sometimes claimed that, in addition to supererogatory acts, there are suberogatory acts, which are morally bad, but not morally impermissible. According to Julia Driver (1992), the distinction between impermissible acts and suberogatory acts is legitimate and unjustly neglected by ethicists. She argues that certain cases are best explained in terms of the suberogatory. Hallie Rose Liberto (2012) denies the suberogatory on the grounds (...) that Driver's cases can be explained without invoking it. In order to make good on this claim, Liberto suggests an account of moral impermissibility that purportedly eliminates the need to posit suberogatory acts. We defend the suberogatory. Our defense is twofold. First, we argue that Liberto's account of moral impermissibility is dubious. Second, we attempt to show that it is possible to construct an argument against the supererogatory that is exactly analogous to Liberto's argument against the suberogatory. The upshot is that if the suberogatory is denied for the reasons that Liberto suggests, then the supererogatory should be denied as well. Few ethicists, however, are willing to deny the supererogatory. (shrink)

At the University of Sheffield during 2011 and 2012, a leading group of philosophers, psychologists, and others gathered to explore the nature and significance of implicit bias. The two volumes of Implicit Bias and Philosophy emerge from these workshops. Each volume philosophically examines core areas of psychological research on implicit bias as well as the ramifications of implicit bias for core areas of philosophy. Volume I: Metaphysics and Epistemology is comprised of two parts: “The Nature of Implicit Attitudes, Implicit Bias, (...) and Stereotype Threat,” and “Skepticism, Social Knowledge, and Rationality.” The first part contains chapters examining the relationship between implicit attitudes and “dual process” models of the mind; the role of affect in the formation and change of implicit associations; the unity (or disunity) of implicit attitudes; whether implicit biases are mental states at all; and whether performances on stereotype-relevant tasks are automatic and unconscious or intentional and strategic. The second part contains chapters examining implicit bias and skepticism; the effects of implicit bias on scientific research; the accessibility of social stereotypes in epistemic environments; the effects of implicit bias on the self-perception of members of stigmatized social groups as rational agents; the role of gender stereotypes in philosophy; and the role of heuristics in biased reasoning. Causation: A Realist Approach Traditional empiricist accounts of causation and laws of nature have been reductionist in the sense of entailing that given a complete specification of the non-causal properties of and relations among particulars, it is therefore logically determined both what laws there are and what events are causally related. It is argued here, however, that reductionist accounts of causation and of laws of nature are exposed to decisive objections, and thus that the time has come for empiricists to (...) break with that tradition. -/- The basic goal of this book, therefore, is to set out and defend realistic accounts of those concepts. In Buddhist texts authored in Indian and Tibetan traditions of scholasticism, one is regularly directed to check one’s understanding against “scripture and reasoning.” To date, however, comparatively little attention has been given to the usage of the latter term of this pair (Skt. yukti , Tib. rigs pa) in Indian Buddhist texts. Building on the work of Scherrer-Schaub, Kapstein and others, this paper discusses divergent glosses of the term yukti as found in Indian Buddhist texts. By highlighting continuities and discontinuities (...) in these accounts, the paper aims to stimulate reflection on the ways in which our assumptions regarding reasoning—and, by extension, what is to count as “Buddhist philosophy”—are represented in, and perhaps contested by, thematizations offered within the tradition. Interest in the Keynesian concept of evidential weight has led to divergent views concerning the burden of proof in adjudication. It is argued that Keynes's concept is properly engaged only in the context of one special kind of decision, the decision whether or not the evidence is ripe for a decision on the underlying merits, whether the latter decision is based on probability, relative plausibility, coherence or otherwise. As a general matter, this question of ripeness is appropriately assigned to the (...) judiciary for resolution as part of the burden of production, rather than to the jury or other factfinder as part of the burden of persuasion.
