The aim of this paper is to provide a basic understanding of the phenomenon of embarrassment by connecting two general questions. Starting with two illustrative examples, it first examines how the phenomenon could be described and what different aspects can be identified. Apart from having an obvious affective or emotional aspect and being embodied in various forms of expression, embarrassment can be considered as having a social aspect because of its close connection to the social setting of a situation. Furthermore, (...) it seems to have an atmospheric quality in that it is experienced not only by the embarrassed person but also by all those present. Secondly the role that embarrassment plays in the context of a person’s life is addressed. Though it is experienced as unpleasant, it can be understood as a form of adequately responding to certain social situations structured by ambiguity. (shrink)

Telemedicine is a complex field including various applications and target groups. Especially telehealthcare is seen by many as a means to revolutionize medicine. It gives patients the opportunity to take charge of their own health by using self-tracking devices and allows health professionals to treat patients from a distance. To some, this means an empowerment of patient autonomy as well as an improvement in the quality of care. Others state the dangers of depersonalization of medicine and the pathologization of daily (...) life. This paper examines the ethical implications of telehealthcare, focusing on patient autonomy and quality of care by analyzing metareviews, randomized controlled trials and narrative ethical analyses on the topic. As a result, we conclude that the technically enhanced encounter between patients and health professionals may mean an empowerment of patient autonomy when it goes along with a personal relationship based on trust, assistance and support. When it comes to the quality of care, telehealthcare may lead to an improvement as long it is adopted to the patient’s individual needs. (shrink)

This paper discusses ἐπιβολαὶ τῆς διανοίας, which later Epicureans are supposed to have elevated to a fourth criterion of truth to complement perceptions, preconceptions and feelings. By examining Epicurus’ extant writings, the paper distinguishes three different senses of the term: ‘thought in general’, ‘act of attention’ and ‘mental perception’. It is argued that only the sense ‘mental perception’ yields a plausible reading of ἐπιβολαί as a criterion of truth. The paper then turns to the textual evidence on ἐπιβολαί in later (...) authors. While the term ἐπιβολή is not used by Cicero, Lucretius and Philodemus in the sense of mental perception, it is argued that this still is the most plausible way of understanding ἐπιβολή as a criterion of truth. Based on certain passages in Colotes, Hermarchus, and Horace, the Epicureans may be thought to defend a social contract theory that is roughly Hobbesian. According to such a view, human life without the social contract is solitary and brutish. This paper argues that such a reading is mistaken. It offers a systematic analysis of Lucretius’s culture story in On the Nature of Things v as well as the Epicurean passages that at first sight seem to contradict the Lucretian account. The (...) conclusion of such an analysis is not only that all extant evidence is internally consistent, but also that Epicurean social contract theory relies on a ‘dynamic’ conception of human nature: On the Epicurean view, agents have very different psychological motivations when coming together to form societies and when coming together to form political and legal states. This paper discusses the presentation of the Epicurean virtues offered in the Letter to Menoeceus and in Cicero’s On Ends. It evaluates the proposals advanced by Phillip Mitsis and Pierre-Marie Morel. Against Morel, it is argued that Torquatus’ presentation of the virtues in On Ends is not part of an elaborate dialectical strategy. Instead, the paper sides with Mitsis’ more modest proposal: while Torquatus, like any good speaker, with high likelihood adapts his presentation to his audience, his ideas also have (...) a strong foundation in Epicureanism. Given the extant state of textual evidence, it is difficult to determine precisely, however, to what degree his presentation of the virtues (1) directly draws on ideas already present in the founder of the Garden himself, (2) reflects a later development in the Epicurean school, or (3) falsifies Epicurean ideas to make them more palatable for a Roman audience. This paper investigates the Democritean account of human nature and sociability. After briefly discussing what the claim that human beings are social animals means, the paper analyzes two culture stories, preserved in Diodorus of Sicily and John Tzetzes, that are typically taken to be Democritean, arguing that there are prima facie significant differences between the two accounts. The paper then concludes that human beings are not social animals by nature on the Democritean view, but rather that the Democritean account belongs (...) to a different, that is, non-Aristotelian and non-Stoic, tradition of social thought. Abstract. It is commonplace that economic globalization poses new challenges to legal theory. But instead of responding to these challenges, legal scholars often get caught up in heated yet purely abstract discussions of positivist and legal pluralist conceptions of the law. Meanwhile, economics-based theories such as "Law and Social Norms" have much less difficulty in analysing the newly arising forms of private and hybrid "governance without government" from a functional perspective. While legal theory has much to learn from these approaches, (...) we argue that they fail in one crucial point: They cannot uphold the analytical distinction between law and non-law. The reasons for this shortcoming are theory-immanent in that the economic theories' focus on efficiency and their actor-based perspective are necessarily blind to "law's own rationality." We therefore propose to further develop those functional approaches to the study of global governance by complementing them with elements from Niklas Luhmann's systems theory of law. This will provide us with a conceptual framework for analyzing the workings of global governance regimes without ignoring their potential for "legalisation" and "constitutionalisation." As we will show in three concrete examples (Corporate Social Responsibility, lex mercatoria , and internet regulation) we can thus describe the evolution of new forms of legal regulation beyond the nation-state. This will also allow us to draw some preliminary conclusions on the role of law in the context of globalization and, at the same time, show the direction for further empirical research. (shrink)

This volume aims to question, challenge, supplement, and revise current understandings of the relationship between aesthetic and political operations. The authors transcend disciplinary boundaries and nurture a wide-ranging sensibility about art and sovereignty, two highly complex and interwoven dimensions of human experience that have rarely been explored by scholars in one conceptual space. Several chapters consider the intertwining of modern philosophical currents and modernist artistic forms, in particular those revealing formal abstraction, stylistic experimentation, self-conscious expression, and resistance to traditional definitions (...) of "Art." Other chapters deal with currents that emerged as facets of art became increasingly commercialized, merging with industrial design and popular entertainment industries. Some contributors address Post-Modernist art and theory, highlighting power relations and providing sceptical, critical commentary on repercussions of colonialism and notions of universal truths rooted in Western ideals. By interfering with established dichotomies and unsettling stable debates related to art and sovereignty, all contributors frame new perspectives on the co-constitution of artworks and practices of sovereignty. The aim of this paper is to discuss the notion of value presupposed by empirical value-surveys such as the World Values Survey (WVS) or the European Values Study (EVS), using some basic distinctions of philosophical value-theory. I intend to show that the framework of these surveys is grounded on definitions or implicit claims that are systematically problematic, having also a certain impact on the empirical realisation and some of the survey’s outcomes. First, it is shown that the assumption of values (...) as “that what is valued” is not consistent with a taxonomy of four value-groups. Whereas the former leads to an inflation of values, the latter is too narrow even for the conceptualisation of some values mentioned in the survey’s questionnaire. Referring to the philosophical distinction of values and (valuable) goods, it is also shown that the survey’s framework is not able to articulate cases in which we value the same good over time but because of different value-aspects. Second, it is shown that an understanding of the value-groups as fundamentally conflicting does not withstand a critical review: Whereas the conflict of materialist and post-materialist values should be understood as a mere difference of preferences regarding goods that are all evaluated positively, the assumed conflict of traditional and secular-rational values depends on a rigorous, intolerant articulation of value-based worldviews. It is often assumed that Epicurean happiness can be achieved by everyone alike. This paper offers a corrective to this view. While it is true that the Epicureans abolish traditional differences among people like those between the sexes, social classes, and so on, they also maintain that there are people who are incapable of achieving happiness because they lack a certain bodily make-up or because they do not have the right ethnic or cultural origin.

This paper is dedicated to feelings (pathē) as criteria of truth and criteria of choice and avoidance in Epicureanism. The first section reviews two features of the other two Epicurean criteria of truth, perceptions and preconceptions: their non-rational and evident character. The second section extends the account to feelings, showing how, on the basis of their non-rational and evident character, feelings can be used to gain insights. The third section of the paper finally turns to feelings as criteria of choice (...) and avoidance. It examines some neglected textual evidence that shows that perceptions and feelings are closely connected to each other, that is, that Epicurean feelings are defined as perceptions and observances of themselves, shedding some new light on the joint role of feelings and perceptions in choices and avoidances. This paper examines the classification of desires that the Epicureans offer in their writings. It surveys the extant textual evidence for the classification and discusses the relationship between natural and necessary, natural and unnecessary, and unnatural and unnecessary desires. It argues that while the practical significance of the Epicurean classification is clear, which desires fall into which class is not. The paper suggests the reason for this may be that the Epicureans acknowledge some variability in their concept of human nature, (...) arguing for a functional reading of the Epicurean classification of desires. This paper is a commentary on Epicurus’ Kuria Doxa 33, according to which “justice is not anything in itself [τι καθ᾽ ἑαυτό].” It explores what it means for something to exist ‘in itself’ in Hellenistic philosophy, speculating on the sources of Epicurean technical vocabulary and suggesting an ontological reading of KD 33.

The article advances an understanding of responsible leadership in global business and offers an agenda for future research in this field. Our conceptualization of responsible leadership draws on deliberative practices and discursive conflict resolution, combining the macro-view of the business firm as a political actor with the micro-view of leadership. We discuss the concept in relation to existing research in leadership. Further, we propose a new model of responsible leadership that shows how such an understanding of leadership can address the (...) challenges of globalization. In professional soccer, players, coaches, and researchers alike recognize the importance of cognitive skills. Research addressing the relevance of cognitive skills has been based on the cognitive component skills approach or the expert performance approach. Our project aimed to combine the strengths of both approaches to develop and validate cognitive tasks measuring inhibition and cognitive flexibility in a soccer-specific setting with a soccer-specific motor response. In the main study 77 elite youth soccer players completed a computerized version of the standard (...) flanker and number–letter tasks as well as flanker and number–letter tasks requiring a soccer-specific motor response in a soccer-specific setting. Results show good reliability for both tasks. For the SoccerBot360 number–letter task, switch effects for response times and accuracy and acceptable convergent validity were shown. A flanker effect for response time but not accuracy was apparent. Due to no acceptable convergent validity, the flanker task was revised and 63 adult soccer players participated in a follow-up validation study in the SoccerBot100. The revised flanker task showed the flanker effect for response time, but not for accuracy. However, acceptable convergent validity for response time was present. Thus, the soccer-specific number–letter and to some extent the soccer-specific flanker task show potential to be used as a valid cognitive diagnostic tool by soccer clubs. (shrink)

Disasters and public health emergencies raise a variety of ethical dilemmas, often including those that require balancing the best interests of individuals against those of groups or communities. The on-going COVID-19 pandemic provides examples of these ethical conflicts, as do other recent outbreaks. Decisions and actions in this context must address different ethical issues, ranging from those directly related to autonomy, consent, privacy and confidentiality to those related to interventions and technologies, such as efficacy, effectiveness, safety and fair access. This (...) paper aims to identify ethical conflicts with complex resolutions involving aspects related to values, rights and needs of individuals and the collective, and to suggest how such challenges could lead to more positive experiences and outcomes when confronted in future emergencies. A person presented with adequate but not conclusive evidence for a proposition is in a position voluntarily to acquire a belief in that proposition, or to suspend judgment about it. The availability of doxastic options in such cases grounds a moderate form of doxastic voluntarism not based on practical motives, and therefore distinct from pragmatism. In such cases, belief-acquisition or suspension of judgment meets standard conditions on willing: it can express stable character traits of the agent, it can be responsive (...) to reasons, and it is compatible with a subjective awareness of the available options. Intentionalism is the claim that the phenomenological properties of a perceptual experience supervene on its intentional properties. The paper presents a counter-example to this claim, one that concerns visual grouping phenomenology. I argue that this example is superior to superficially similar examples involving grouping phenomenology offered by Peacocke (Sense and Content, Oxford: Oxford University Press), because the standard intentionalist responses to Peacocke’s examples cannot be extended to mine. A person sometimes forms moral beliefs by relying on another person''s moral testimony. In this paper I advance a cognitivist normative account of this phenomenon. I argue that for a person''s actions to be morally good, they must be based on a recognition of the moral reasons bearing on action. Morality requires people to act from an understanding of moral claims, and consequently to have an understanding of moral claims relevant to action. A person sometimes fails to meet this requirement (...) when she relies on another person''s moral testimony, and so there are moral limits on such reliance. (shrink)

This essay sketches out the post-feminist narrative employed by the radical-right populist party Alternative für Deutschland in the German national parliament between October 2017 and July 2018. Striving to establish a hegemonic ontology, the Alternative für Deutschland conjures up a social imaginary of a German heartland, where equal rights between ‘naturally’ different women and men have long been achieved – a heartland that has to be protected from ‘Muslim culture’ as much as from the ‘leveling down’ imposed by a ‘radical (...) feminist elite’. Between these frames, the Alternative für Deutschland presents itself as the only true champion of women and, while never asserting to be feminist, implicitly lays claim to a particular and exclusivist post-feminist position. I argue that the Alternative für Deutschland’s capabilities to promote this populist narrative have become further enhanced by its election to the national parliament, presenting a serious challenge and also a chance for German feminism to self-critically engage with issues of intersectionality and representation in public discourse. Questions are everywhere and the ubiquitous activities of asking and answering, as most human activities, are susceptible to failure – at least from time to time. This volume offers several current approaches to the systematic study of questions and the surrounding activities and works toward supporting and improving these activities. The contributors formulate general problems for a formal treatment of questions, investigate specific kinds of questions, compare different frameworks with regard to how they regulate the activities of asking and answering (...) of questions, and situate these activities in a wider framework of cognitive/epistemic discourse. This article provides a re-evaluation of David Hume's intensive reading of the classics at an important moment of his literary and intellectual career. It sets out to reconstruct the extent and depth of this reading as well as the uses – scholarly, philosophical and polemical – to which Hume put the information he had gathered in the course of it. The article contends that Hume read the classics against the grain to collect data on a wide range of cultural information (...) which he could utilise for a number of literary and philosophical projects he was engaged in during the early 1750s. This reading soon came to pervade almost all aspects of Hume's literary activities of that period and resulted in what is here described as a fragmentary history of classical antiquity. As a result Hume's reading of the classics emerges from this article as both more extensive and more significant than has so far been acknowledged. (shrink)
