This thesis develops a theory about the structure of modal judgment and knowledge. Arguing in favour of pluralism about the source of modal knowledge, it focuses on the questions of the varieties of modal judgment and their relations, the function of modal judgment and the scope of modal knowledge. It offers a hypothesis about the development of the framework of modal knowledge, grounding it on the capacity to evaluate temporal judgments, from which the capacity to evaluate alternatives comes from, (...) and it suggests that the most basic framework of modal judgments consists in that of agentive modality, and in particular, about what one can do, and how. Then, it is argued that the rest of the framework of modal judgment can be developed on this basis, although this imposes certain restrictions about the scope of modal knowledge. Additionally, the thesis provides analyses of various agentive modal notions, such as imaginability, what is a way to do something, and discusses how to understand counterfactuals with impossible antecedents. This book advances a new interpretation of Hart's penal philosophy. Positioning itself in opposition to current interpretations, the book argues that Hart does not defend a mixed theory of punishment, nor a rule-utilitarian theory of punishment, nor a liberal form of utilitarianism, nor a goal and constraint approach. Rather, it is argued, his penal philosophy is based on his moral pluralism, which comprises two aspects: value pluralism and pluralism with respect to forms of moral reason. (...) It is held that this means, on the one hand, that criminal law has an irreducible complexity due to the compromises it makes to accommodate competing values, and on the other hand, that there need not be one single justification of punishment. This original interpretation is not based only on Hart's key volume on the subject Punishment and Responsibility, but on a careful reading of his complete works. Moral reasoning typically informs environmental decision-making by measuring the possible outcomes of policies or actions in light of a preferred ethical theory. This method is subject to many problems. Environmental pragmatism tries to overcome them, but it suffers also from some pitfalls. This paper proposes a new method of environmental pragmatism that avoids the problems of both the traditional method of environmental moral reasoning and of the general versions of environmental pragmatism. We call it 'justificatory moral (...) class='Hi'>pluralism' - it develops the intuition that normative ethical theories need not be mutually exclusive. This leaves room for important forms of pluralist environmental ethics that do not require a once-and-for-all prior commitment to an ethical theory when deciding about policies or courses of action related to the protection of the environment. Justificatory moral pluralism offers a viable solution to the recurrent conflicts between efficient environmental decisions and the need for moral reasoning. (shrink)

Cost-benefit analysis makes the assumption that everything from consumer goods to endangered species may in principle be given a value by which its worth can be compared with that of anything else, even though the actual measurement of such value may be difficult in practice. The assumption is shown to fail, even in simple cases, and the analysis to be incapable of taking into account the transformative value of new experiences. Several kinds of value are identified, by no means all (...) commensurable with one another – a situation with which both economics and contemporary ethical theory must come to terms. A radical moral pluralism is recommended as in no way incompatible with the requirements of rationality, which allows that the business of living decently involves many kinds of principles and various sorts of responsibilities. In environmental ethics, pluralism offers the hope of reconciling various rival theories, even if none of them is universally applicable. (shrink)

In the face of the moral pluralism that results from the death of God and the abandonment of a God's eye perspective in secular philosophy, bioethics arose in a context that renders it essentially incapable of giving answers to substantive moral questions, such as concerning the permissibility of abortion, human embryonic stem cell research, euthanasia, etc. Indeed, it is only when bioethics understands its own limitations and those of secular moral philosophy in general can it better (...) appreciate those tasks that it can actually usefully perform in both the clinical and academic setting. It is the task of this paper to understand and reevaluate bioethics by understanding these limits. Academic bioethicists can analyze ideas, concepts, and claims necessary to understanding the moral questions raised in health care, assessing the arguments related to these issues, and provide an understanding of the different moral perspectives on bioethical issues. In the clinical setting, bioethicists can provide legal advice, serve as experts on IRBs, mediating disputes, facilitating decision-making and risk management, and clarifying normative issues. However, understanding this is only possible when one understands the history, genesis, and foundations of bioethics and its inability to provide a resolution to postmodern moral pluralism. (shrink)

This paper adopts justificatory moral pluralism – a multilevel framework for justifying the choice by different agents of the most appropriate norms and values to guide their decisions and actions – to climate change. Its main objective is to investigate how ethics may effectively help achieve a better result in deciding how to mitigate, adapt, or compensate by enhancing the moral acceptability of the available policies or actions that are most likely to counter the effects of climate (...) change. JMP presents agents – individuals, nonstate, and state – with a thorough yet flexible process of matching policies and actions with ethical theories, raising the robustness of moral reasons for politically efficient and individually motivating courses of action against climate change. JMP triggers climate responsibility and sensibility in agents, engaging them in discussing and finding out individually and collectively the most acceptable paths for the decarbonisation transition that is fast approaching. Moral pluralism is a reality. It is grounded, in part, in the intractable pluralism of secular morality and bioethics. There is a wide gulf that separates secular bioethics from Christian bioethics. Christian bioethics, unlike secular bioethics, understand that morality is about coming into a relationship with God. Orthodox Christian bioethics, moreover, understands that the impersonal set of moral principles and goals in secular morality gives a distorted account of the moral life. This article retraces progression of Engelhardt’s work so as to place After God in broader context. In The Foundations of Bioethics, Engelhardt argues that given the moral pluralism that is at the core of postmodernity, only a merely formal morality of permission can bind moral strangers in peaceful coexistence. In The Foundations of Christian Bioethics, Engelhardt presents a bioethics that binds Orthodox Christian moral friends. After God shows itself more pessimistic about the possibility of a merely (...) formal morality of moral friends and calls traditional Christians to wage a culture war. Environmental ethics has reached a certain level of maturity; further significant advances require reexamining its status within the larger realm of moral philosophy. It could aim to extend to nonhumans one of the familiar sets of principles subject to appropriate modifications; or it could seek to break away and put forward its own paradigm or paradigms. Selecting the proper course requires as the most immediate mission exploring the formal requirements of an ethical system. In general, are there constraints against (...) bringing our moral relations with different sorts of things under different mIes of govemance? How should common schools in a liberal pluralist society approach sex education in the face of deep disagreement about sexual morality? Should they eschew sex education altogether? Should they narrow its focus to facts about biology, reproduction, and disease prevention? Should they, in addition to providing a broad palette of information about sex, attempt to cover a range of alternative views about sexual morality in a “value-neutral” manner? Should they seek to impart a “thick” conception of sexual morality, which precisely (...) articulates how individuals should lead their sexual lives? In this essay, Josh Corngold cautions against the adoption of each of these various approaches. He argues that schools should instead adopt an “autonomy-promoting” approach, which will aim to empower students, cognitively and emotionally, to exercise sovereignty over their own sexuality. lt is a commonplace that law and morality intersect and interpenetrate in all the areas of legal decision-making; that in order to make sense of constitutional, statutory or common-law questions, judges and other legal decision-makers must first resolve certain philosophical issues which include moral judgments of right and wrang_ This is particularly evident with regard to constitutional interpretation, especially when constitutions give a mandate for the protection of the substantive norms and values entrenched as constitutional rights. In these Situations, (...) as a leading contemporary legal philosopher observed, the "Constitution fuses legal and moral issues, by making the validity of a law depend on an answer to complex moral 1 problems". But the need for substantive value elucidation is not confined, of course, only to constitutional interpretation under Bills of Rights. This, however, immediately raises a dilemma stemming from the moral diversity and pluralism of modern liberal societies. How can law remain sensitive to this pluralism and yet provide clear answers to the problems which call for a legal resolution? Sharply conflicting values in modern societies clash in the debates over the death penalty, abortion, homosexuality, separation of state and religion, the scope of the freedom of the press, or affirmative action. lt would often be difficult to discern a broader consensus within which these clashes of values operate, unless this consensus were described in such vague terms as to render it practically meaningless. In this article, we reflect critically on how moral actions are categorised in some recent studies on moral spillovers. Based on classic concepts from moral philosophy, we present a framework to categorise moral actions. We argue that with a finer classification of moral values, associated behaviour is better understood, and this understanding helps to identify the conditions under which moral licensing takes place. We illustrate our argument with examples from the literature on pro-environmental behaviours. (...) The idea of moral pluralism generates a dilemma for the practice of philanthropy. Characteristically, the practice of philanthropy assumes unity, coherence, or convergence among the diverse virtues and moral aims that it pursues. In the philanthropic tradition, it is recognized that the goals of a particular philanthropy will vary. Yet, if these are sincere expressions of the philanthropic will, each represents some portion of the manifold activity of “doing good” according to particularized choice or style. The relevant (...) analogy should be drawn to the slogan of “giving to the college of your choice” or to worship of the one god in your own way, where the plurality of expression is not only consistent with the residual value of education or of religion, but articulates the pragmatic way to realize the underlying values of a pluralistic society. Historically, this reflects the place of a unifying religious vision of the nature of the good or of a secular conception of a public philosophy which recognized the common good. Even etymologically, the love of mankind suggests a single passion that is directed beneficently to the shared values of mankind. The theory and practice of contemporary philanthropy is necessarily pluralistic, however, and it reflects the range of decisions by individuals with different interests and values in a pluralist, democratic society. The legitimized and recognized range of philanthropies in modern societies demonstrates divergent and even conflicting perceptions of the common good or the public interest. Thus, the range of philanthropies includes support for bird watching and for business opportunities of minorities, which may require some decisions on “comparable worth” and competitive allocation of resources. What role do general principles play in our moral judgment? This question has been much contested among moral theorists of the last fifteen years. When we turn to the British moralists of the eighteenth century, we find that the same question was equally pressing. In this paper, I show that while many of the British moralists thought that general principles could conclusively determine our moral duties, David Hume and Adam Smith were ambivalent about the role of (...) class='Hi'>moral principles, not only giving expression to the common view of principles’ power but also exploring the possibility that principles could not fill the justificatory space typically allotted them. Hume and Smith, I show, constitute fascinating transitional figures in our thinking about the role of general moral principles. (shrink)

In Democracy and Moral Conflict, Robert Talisse defends a folk epistemological justification of democracy. This is a universalist and non-moral justification that he deems necessary to accommodate moral pluralism. In contrast, I argue that this attempt fails to justify democracy, on three grounds. First, democracy cannot accommodate moral pluralism, as Talisse understands it. Second, Talisse's own conception of democracy is inconsistent with moral pluralism. In recent years an increasing number of moral theorists have come to embrace the term "moral pluralism" to describe a particular kind of moral theory. Unfortunately, there has been little consensus regarding what exactly constitutes a pluralistic theory, and what specific commitments such theories involve. My dissertation takes on the task of articulating the underlying schema of pluralist moral theory, and of analyzing the plausibility and implications of pluralism's fundamental commitments. I argue that the (...) most thoroughgoing pluralist theories are shaped by two defining theses; the plurality of the good , and the plurality of the right , and that these are conceptually linked by two additional meta-ethical commitments. My analysis of the plausibility of these commitments is at times friendly to moral pluralism and at times critical of it. For instance, I develop an account of "value incommensurability," an idea upon which pluralism depends, that resists some of more the important attacks within the literature. Yet I also criticize the commitment to the plurality of the right, as held by Susan Wolf and several other pluralists. I argue that this view is less plausible than "limited pluralism"---a view that is pluralistic about the good but monistic about the right. In the final chapter I explore the relationship between moral pluralism and political liberalism, focusing on the role that overriding values play within each type of theory. (shrink)

J. Baird Callicott claims that moral pluralism leads to relativism, skepticism, and the undermining of moral obligations. Buddhist ethics provides a counterexample to Callicott; it is a robust tradition of moral pluralism. Focusing on one of the most significant texts in Buddhist ethics, Śāntideva’s Bodhicaryāvatāra, I show how it draws on a multiplicity of moral principles determined by context and skillful means (upāya kauśalya). In contrast to Callicott’s description of pluralism as detrimental to (...) moral life, I suggest that South Asian Buddhist traditions provide a model of moral reasoning that is both robust and flexible, a model appropriate for the many kinds of moral obligations that arise in the context of environmental ethics. The debate over religious lawmaking pits respect for religious pluralism against moral identity. Peach contends that both sides of the argument are fundamentally flawed and that neither has addressed the gender-based disparities of religious lawmaking. The book offers a pragmatic solution which will respect religious pluralism, moral identity, and gender differences.

Despite Christopher Stone’s recent argument on behalf of moral pluralism, the principal architects of environmental ethics remain committed to moral monism. Moral pluralism fails to specify what to do when two or more of its theories indicate inconsistent practical imperatives. More deeply, ethical theories are embedded in moral philosophies and moral pluralism requires us to shift between mutually inconsistent metaphysics of morals, most of which are no Ionger tenable in light of postmodern (...) science. A univocal moral philosophy-traceable to David Hume’s and Adam Smith’s theory of moral sentiments, grounded in evolutionary biology by Charles Darwin, and latterly extended to the environment by Aldo Leopold-provides a unified, scientifically supported world view and portrait of human nature in whichmultiple, lexically ordered ethics are generated by multiple human, “mixed,” and “biotic” community memberships. This study starts from the observation that there are relatively few controversial issues in corporate social responsibility (CSR). Given its strong normative background, CSR is rather an atypical discipline, especially in comparison with moral philosophy or applied ethics. Exploring the mainstream CSR agenda, this situation was echoed by widespread consensus on what was considered to be "good practice": reducing pollution, shutting down sweatshops, discouraging tax evasion, and so on. However, interpretation of these issues through the lens of moral (...) pluralism unveils latent controversies. The moral appraisal of good practices within CSR depends on key moral concepts (such as harm, responsibility, intention, and consequences), which have various—and often incompatible—interpretations. In a nutshell, this article argues that from a moral pluralist standpoint, all CSR topics are potentially controversial. (shrink)

Reproductive tourism is the travelling by candidate service recipients from one institution, jurisdiction, or country where treatment is not available to another institution, jurisdiction, or country where they can obtain the kind of medically assisted reproduction they desire. The more widespread this phenomenon, the louder the call for international measures to stop these movements. Three possible solutions are discussed: internal moral pluralism, coerced conformity, and international harmonisation. The position is defended that allowing reproductive tourism is a form of (...) tolerance that prevents the frontal clash between the majority who imposes its view and the minority who claim to have a moral right to some medical service. Reproductive tourism is moral pluralism realised by moving across legal borders. As such, this pragmatic solution presupposes legal diversity. (shrink)

Moral pluralism of the kind associated with W. D. Ross is the doctrine that there is a plurality of moral principles, which in their application to particular cases can conflict, and that there is no further principle to determine which of these principles takes priority in cases of conflict. Two objections are commonly advanced against this kind of pluralism: that it proposes a rag-bag of moral principles lacking a unifying basis; and that it offers no (...) way to adjudicate moral disputes when our intuitions about what to do conflict. The present paper replies to both of these objections, in particular by responding to versions of them advanced by Brad Hooker. The tying together and justification of different moral principles may be achieved by a general rational justification procedure, rather than by a further moral principle; and such a rational justification procedure can help to adjudicate moral disputes. The organisation of health care is rapidly changing. There is a trend to move away from individual health care institutions towards transmural integrated care and interorganizational collaboration in networks. However, within such collaboration and network there is often likely to be a pluralism of values as different health care institutions often have very different values. For this paper, we examine three different models of how we believe institutions can come to collaborate in networks, and thus reap the potential benefits (...) of such collaboration, despite having different moral beliefs or values. A first way is the pragmatic way in which the different health care institutions avoid ethical reflection and focus on solutions. A second possible route is that of consensus where health care institutions base their collaboration on values that they all share. The third, and final, approach is that of compromise. Although moral compromise is often seen in a negative light, we argue that in many cases compromise might be necessary and ethically justified. In a final section, we will shift our focus from discussing various theoretical methods to allow collaboration to the potential content of consensus or compromise. (shrink)

Moral diversity presents challenges and opportunities for Christian ethics, especially with regard to education and formation. Moral pluralism designates a response to that diversity predicated on the belief that such diversity is good and worthy of protection. Is moral pluralism a viable and authentically Christian stance? Attention to moral pluralism in Christian ethics is often muted or implied. Moreover, features of some Christian moral traditions make it difficult to envision a Christian affirmation (...) of moral diversity as good. This article invites Christian ethics to engage questions around moral diversity and pluralism as a central task for Christian education and formation. (shrink)

Recent work in moral psychology that claims to show that human beings make moral judgements on the basis of multiple, divergent moral foundations has been influential in both moral psychology and moral philosophy. Primarily, such work has been taken to undermine monistic moral theories, especially those pertaining to the prevention of harm. Here, I call one of the most prominent and influential empirical cases for moral pluralism into question, namely that of Jonathan (...) Haidt and his colleagues. I argue that Haidt et al.’s argument is not as strong as it is often made out to be, given significant problems with the design of one of the key experiments used to ground the claim that there are divergent moral foundations across cultures. The flaws that I point out pose a significant challenge to Haidt et al.’s findings and have a detrimental impact on subsequent work based on this immensely influential experiment. Accordingly, I argue that both empirical and normative claims made on the basis of Haidt et al.’s findings should be treated with caution. I conclude by making some suggestions as to how some of the problems that I point out might be addressed. (shrink)

Discussions of environmental ethics, and of applied ethics generally, easily produce a sense of unreality. But they are not a luxury. Faced with a new and monstrous predicament, we do need new thinking. Enlightenment morality, on which we still largely rely, has had enormous merits, but it strongly tends towards egoism and social atomism. This makes it hard for us to think, as we now must, about larger wholes.
