A timely and penetrating investigation, this book seeks to transform moral philosophy. In the face of continuing disagreement about which general moral principles are correct, there has been a resurgence of interest in the idea that correct moral judgements can be only about particular cases. This view--moral particularism --forecasts a revolution in ordinary moral practice that has until now consisted largely of appeals to general moral principles. Moral particularism also opposes the (...) primary aim of most contemporary normative moral theory that attempts to show that either one general principle, or a set of general principles, is superior to all its rivals. The aim of this paper is to strengthen the point made by Horty about the relationship between reason holism and moral particularism. In the literature prima facie obligations have been considered as the only source of reason holism. I strengthen Horty’s point in two ways. First, I show that contrary-to-duties provide another independent support for reason holism. Next I outline a formal theory that is able to capture these two sources of holism. While in simple settings the proposed (...) account coincides with Horty’s one, this is not true in more complicated or “realistic” settings in which more than two norms collide. My chosen formalism is so-called input/output logic. A bottom-line example is introduced. It raises the issue of whether the conventional wisdom is right in assuming that normative reasons run parallel to epistemic ones. (shrink)

I argue that John Dewey’s analysis of imagination enables an account of learning from imaginary cases consistent with Jonathan Dancy’s moral particularism. Moreover, this account provides a more robust account of learning from cases than Dancy’s own. Particularism is the position that there are no, or at most few, true moral principles, and that competent reasoning and judgment do not require them. On a particularist framework, one cannot infer from an imaginary case that because a feature (...) has a particular moral importance there, that it must have that import in an actual case. Instead, for Dancy, cases can yield “reminders,” and a person with a lot of experience (real or imagined) brings a “checklist” of features that can matter to a situation. Using the Nathan-David exchange from 2 Samuel and Martha Nussbaum’s “Steerforth’s Arm” from Love’s Knowledge, I show that this account does not explain all instances of learning from cases. Drawing on recent work on cases, I argue that cases can be educative by serving an exploratory function, probing what one takes to be known and provoking change in the background one uses in evaluating a situation. I then argue that Dewey’s work on imagination in his comments on sympathy and in A Common Faith and Art as Experience enables such a role for cases on a particularist framework. Mark Johnson’s recent work on metaphor further illuminates how Dewey’s account of art can be exploratory. I contend that this account affords an exploratory role for cases consistent with Dancy’s particularism. (shrink)

Moral particularism is a contentious position at present and seems likely to be so for the foreseeable future. In this Introduction, I outline and detail its essential claim, which I take to be, roughly, that what can be a reason that helps to make one action right need not be a reason that always helps to make actions right. This claim challenges a central assumption on which most, if not all, normative ethical theories are supposedly based. The term ‘moral particularism’ has been used to refer to different doctrines. The main body of this paper begins by identifying the most important doctrines associated with the term, at least as the term is used by Jonathan Dancy, on whose work I will focus. I then discuss whether holism in the theory of reasons supports moral particularism, and I call into question the thesis that particular judgements have epistemological priority over general principles. Dancy’s recent book (...) Ethics without Principles (Dancy 2004) makes much of a distinction between reasons, enablers, disablers, intensi- ers, and attenuators. I will suggest that the distinction is unnecessary, and I will argue that, even if there is such a distinction, it does not entail moral particularism. In the nal two sections, I try to give improved versions of arguments against particularism that I put forward in my paper ‘Moral Particularism: Wrong and Bad’ (Hooker 2000b: 1--22, esp. pp. 7--11, 15--22). Abstract: Particularism is usually understood as a position in moral philosophy. In fact, it is a view about all reasons, not only moral reasons. Here, I show that particularism is a familiar and controversial position in the philosophy of science and mathematics. I then argue for particularism with respect to scientific and mathematical reasoning. This has a bearing on moral particularism, because if particularism about moral reasons is true, then particularism (...) must be true with respect to reasons of any sort, including mathematical and scientific reasons. Can someone be reasonable or justified in accepting a specific moral judgment not based on the prior acceptance of a general exceptioness moral principle, where acceptance of a general principle might be tacit or implicit and might not be expressible in language? This issue is an instance of a wider issue about direct or transductive inference. Developments in statistical learning theory show that such an inference can be more effective than alternative methods using inductive generalization and so can (...) be reasonable. This result carries over to moral transduction, although it is a difficult empirical issue whether people actually engage in any sort of transduction, including moral transduction. (shrink)

An important shift occurs in Martin Heidegger’s thinking one year after the publication of Being and Time , in the Appendix to the Metaphysical Foundations of Logic . The shift is from his project of fundamental ontology—which provides an existential analysis of human existence on an ontological level—to metontology . Metontology is a neologism that refers to the ontic sphere of human experience and to the regional ontologies that were excluded from Being and Time. It is within metontology, Heidegger states, (...) that “the question of ethics may be raised for the first time.” This paper makes explicit both Heidegger’s argument for metontology , and the relation between metontology and ethics. In examining what he means by “the art of existing,” the paper argues that there is an ethical dimension to Heidegger’s thinking that corresponds to a moderate form of moral particularism. In order to justify this position, a comparative analysis is made between Heidegger, Aristotle, and Bernard Williams. (shrink)

In this paper, I intend to argue that this position takes context-sensitiveness of reasons too seriously and has to face many philosophical problems—mainly because its most important argument (the argument from holism of reasons) is not convincing but (...) also because a pluralist generalist account is preferable both from metaethical and normative points of view. Do we need defeasible generalizations in epistemology, generalizations that are genuinely explanatory yet ineliminably exception-laden? Do we need them to endow our epistemology with a substantial explanatory structure? Mark Lance and Margaret Little argue for the claim that we do. I will argue that we can just as well do without them – at least in epistemology. So in the paper, I am trying to very briefly sketch an alternative contextualist picture. More specifically, the claim will be that although an (...) epistemic contextualist should commit himself to epistemic holism he can nevertheless appeal to epistemic principles other than defeasible generalizations in order to provide his epistemology with a structure. I believe most acts of human procreation are immoral, and I believe this despite also believing in the truth of moral particularism. In this paper I explain why. I argue that procreative acts possess numerous features that, in other contexts, seem typically to operate with negative moral valences. Other things being equal this gives us reason to believe they will operate negatively in the context of procreative acts as well. However, most people’s intuitions represent procreative acts to (...) be morally permissible in most circumstances. Given moral particularism, this would normally be good evidence that procreative acts are indeed morally permissible and that the features that operate negatively elsewhere, simply do not do so in the context of procreative acts in particular. But I argue that we have no good reason to think our intuitions about the ethics of human procreation are accurate. Our most reliable source of insight into the ethics human procreative acts are not our intuitions those acts themselves, but our intuitions about the typical moral valences of the features such acts possess. If that is correct, then acts of human procreation are most likely wrong. (shrink)

In this paper I will discuss the problem of justification in moral particularism. The first part is concerned with Jonathan Dancy’s account of justification, which is a narrative one. To justify one’s choice is to present a persuasive description of the context in a narrative fashion, not to subordinate singular cases to universal rules. Since it dismisses arguments and employs persuasiveness, this view seems irrational, so the second part of my paper will consist of a personal reconstruction and (...) reformulation of Dancy’s account that will aim at defending particularist justification from being labeled as “irrational”. Moral particularism is commonly presented as an alternative to ‘principle- or rule-based’ approaches to ethics, such as consequentialism or Kantianism. This paper argues that particularists' aversions to consequentialism stem not from a structural feature of consequentialismper se, but from substantial and structural axiological views traditionally associated with consequentialism. Given a particular approach to (intrinsic) value, there need be no conflict between moral particularism and consequentialism. We consider and reject a number of challenges holding that there is (...) after all such a conflict. We end by suggesting that our proposed position appears quite appealing since it preserves attractive elements from particularism as well as consequentialism. (shrink)

In this paper I examine the particularist attack on deductive uses of moral principles, reviewing the critiques of the uniformity of moral reasons and impartiality in ethics, looking principally at arguments from Larry Blum, Jonathan Dancy, and Margaret Walker. I defend the action-guiding-ness of moral principles themselves, but consider various ways to accommodate the objections coming fromparticularism. I conclude that one objection to the impartialist theory of value must be conceded without qualification: generalism is unable to account (...) for the unique and irreplaceable value of individual persons. I present an example which supports my view andshows that, in the context of lived experience, replaceability is contradicted. Indeed there may be few constants of value in the narrative of one’s life, as experiences overlay supposed constants with continual new shading, and create even deeper sorts of transformation in valuing. In the end, both particularized moral judgment and the articulation of fact with principle contribute to moral discernment. (shrink)

This paper argues that moral particularism, defined as the view that moral judgment does not require moral principles, depends upon a constricted and untenable view of rational judgment as simple syllogistic ratiocination. This I demonstrate by re-examining Nussbaum’s (1986/2002) case for particularism based on Sophocles’ Antigone. The central role of principles in moral judgment and in educational theory is supported by explicating ‘mature judgment’, which highlights key features of Thomas Green’s account of norm acquisition (...) and of Kant’s account of the autonomy of rational judgment. According to Jonathan Dancy's moral particularism, the way in which a given moral reason functions as a reason for or against an action can vary from case to case. Dancy also asserts that reasons are resultance bases. But a reason why something ought to be done is that in virtue of which it is something that ought to be done. If the function of a reason can vary, then resultance bases cannot be reasons. Perhaps the particularist might (...) conceive a reason not as a resultance base, but as a specific type of which a resultance base is a token. But this picture of reasons cannot be correct. Moral particularists are united in their opposition to the codification of morality, and their work poses an important challenge to traditional ways of thinking about moral philosophy. Defenders of moral particularism have, with near unanimity, sought support from a doctrine they call “holism in the theory of reasons.” We argue that this is all a mistake. There are two ways in which holism in the theory of reasons can be understood, but neither provides any support for (...) moral particularism. Moral particularists are united in their opposition to the codification of morality in purely descriptive terms, but their opposition takes different forms. Sometimes particularists maintain that codifying the moral landscape is impossible. In other contexts particularists argue that moral principles are in any event unnecessary. In yet other contexts particularists contend that the codification of morality is undesirable, perhaps because it would encourage people to look less carefully at the case at hand.1 These are distinct theses, although particularists often endorse all three. As Jonathan Dancy, citing John McDowell puts it, “Particularism is at its crudest the claim that we neither need nor can see the search for an ‘evaluative outlook which one can endorse as rational as the search for a set of principles.’”2 On any interpretation, particularism poses an important challenge for traditional conceptions of moral philosophy.. Moral particularism, on some interpretations, is committed to a shapeless thesis: the moral is shapeless with respect to the natural. (Call this version of moral particularism ‘shapeless moral particularism’). In more detail, the shapeless thesis is that the actions a moral concept or predicate can be correctly applied to have no natural commonality (or shape) amongst them. Jackson et al. (Ethical particularism and patterns, Oxford University Press, Oxford, 2000) argue, however, that (...) the shapeless thesis violates the platitude ‘predication supervenes on nature’—predicates or concepts apply because of how things are, and therefore ought to be rejected. I defend shapeless moral particularism by arguing that Jackson et al’s contention is less compelling than it firstly appears. My defense is limited in the sense that it does not prove shapeless moral particularism to be right and it leaves open the possibility that shapeless moral particularism might attract criticisms different from the ones advanced by Jackson et al. But at the very least, I hope to say enough to undermine Jackson et al’s powerful attack against it. The plan of this paper is as follows. Section 1 glosses the view of moral particularism and why it is taken to be essentially committed to the shapeless thesis. Section 2 examines a Wittgensteinian argument for the shapeless thesis. I shall argue that the Canberrans’ counter-arguments against it on grounds of disjunctive commonality and conceptual competence do not succeed. Section 3 explicates Canberrans’ predication supervenience argument against the shapeless thesis. Section 4 offers my criticisms of the Canberrans’ predication supervenience argument. In view of the above discussions, in Sect. 5, I conclude that there is no compelling argument (from the Canberrans) to believe that the shapeless thesis fails (as I have argued in Sect. 4). In fact, there is some good reason for us to believe it (as I have argued in Sect. 2). If so, I contend that moral particularism, when construed as essentially committed to the shapeless thesis, still remains as a live option. (shrink)

It is commonly thought that moral rules and principles, such as ‘Keep your promises,’ ‘Respect autonomy,’ and ‘Distribute goods according to need ,’ should play an essential role in our moral deliberation. Particularists have challenged this view by arguing that principled guidance leads us to engage in worse decision making because principled guidance is too rigid and it leads individuals to neglect or distort relevant details. However, when we examine empirical literature on the use of rules and principles (...) in other domains, we find that people can learn to use rules discriminately and that rule-based models tend to outperform even expert judgment. I argue that this evidence poses a problem for the moral particularist. If the particularist claims that we should not rely on decision-making rules when making practical decisions and it turns out that these rules help us make better decisions, then the particularists’ prescriptive account is deficient. However, if the particularist claims that we should rely on practical decision-making rules but not on moral rules, she needs to explain how practical rules are different from moral rules and why we should rely on the former but not the latter. 'Moral Particularism' is a view that questions the role of principles in ethics. Jonathan Dancy, the most eminent particularist, argues that principles which claim that it is right or wrong to do a certain thing in all situations cannot adequately account for the role context plays in moral deliberation. The aim of this dissertation is to critically evaluate the theory of Moral Particularism. The first section discusses various positions opposed to particularism. It considers the (...) emergence of particularism as a response to Hare's Theory of Universalizability and Ross's Theory of Prima Facie Duty. The dissertation then moves on to examine the view that context-sensitivity does not support particularism. The second part of this dissertation analyses Dancy's theory in closer detail. It begins with a clarification of Dancy's conception of principles and is followed by a consideration of the evolution of particularism over time. The plausibility of the various versions of this theory are then compared. The third part of the dissertation looks at criticism of particularism by others apart from Dancy. It argues that context-sensitivity can only ground particularism as an epistemic, and not as a metaphysical theory. Furthermore, it discusses whether thick ethical concepts can ground principles. The dissertation concludes by asserting that whilst the claims of particularism are true, they are no serious threat to traditional moral theories. (shrink)

Moral particularists have seen Wittgenstein as a close ally. One of the main reasons for this is that particularists such as Jonathan Dancy and John McDowell have argued that Wittgenstein's so-called "rule-following considerations" (RFCs) provide support for their skepticism about the existence and/or role of rules and principles in ethics. In this paper, I show that while Wittgenstein's RFCs challenge the notion that competence with language, i.e., the ability to apply concepts properly, is like mechanically following a rule, he (...) does not reject the idea that there are rules that govern proper use of language. I then argue that while the RFCs may, at best, support a weak form of particularism that denies that moral competence is dependent on an explicit grasp of rules, they do not support a stronger version of particularism that denies that there are any true rules or principles in ethics. REPLYING TO CRITICS in the postscript to the second edition of After Virtue, Alasdair MacIntyre took note of the apparently paradoxical--even Quixotic--quality of his own project.

Jonathan Dancy, who defends a version of moral particularism, is committed to the view that any feature or reason for action might, in logical terms, have a positive moral valence in one context, a negative moral valence in a different context, and no moral valence at all in yet another context. In my paper, I attempt to demonstrate that, despite the denial by Dancy that proposed grounding properties with invariant moral valences may play a (...) foundational role in morality, his own approach toward moral reasoning unknowingly assumes such foundational grounding properties. I argue that Dancy's moral particularism is unknowingly directed toward moral absolutism, and, in making that argument, uncover reasons, admittedly inconclusive, to favor an absolutist ethic. Some of Jonathan Dancy's strongest arguments in support of moral particularism depend crucially upon the distinction he draws between three different kinds of relevance relations -- favourers, intensifiers and enablers. In this paper I generalize certain features of Dancy's account of the different roles that premises can play in moral argumentation. Most significantly, I argue that both intensifiers and enablers play parallel roles within different kinds of (more primitive) supplementation relations. This matters since it is common for (...) people to accept Dancy's account of intensifiers while remaining suspicious of his notion of enablers. But this asymmetrical response, I argue, cannot be justified. This account also generates a simpler and more elegant argument in support of moral particularism. (shrink)

Biomedical moral enhancement, or BME for short, aims to improve people’s moral behaviors through augmenting, via biomedical means, their virtuous dispositions such as sympathy, honesty, courage, or generosity. Recently, it has been challenged, on particularist grounds, however, that the manifestations of the virtuous dispositions can be morally wrong. For instance, being generous in terrorist financing is one such case. If so, biomedical moral enhancement, by enhancing people’s virtues, might turn out to be counterproductive in terms of people’s (...) moral behaviors. In this paper, we argue, via a comparison with moral education, that the case for the practice of biomedical moral enhancement is not weakened by the particularists’ stress on the variable moral statuses of the manifestations of our virtues. The real challenge from the particularists, we argue, lies elsewhere. It is that practical wisdom, being essentially context-sensitive, cannot be enhanced via biomedical means. On the basis of this, we further argue that BME ought to be used with great caution, for it may wrongly enhance, for instance, a terrorist financier’s generosity, a robber’s courage, or an undercover detective’s honesty. Finally, we sketch how boundaries can be set on the use of BME, and address some potential objections to our position. (shrink)

Moral particularism, as recently defended, charges that traditional moral theorizing unduly privileges moral principles. Moral generalism defends a prominent place for moral principles. Because moral principles are often asked to play multiple roles, moral particularism aims at multiple targets. We distinguish two leading roles for moral principles, the role of standard and the role of guide. We critically survey some of the leading arguments both for and against principles so conceived.

Moral particularism, broadly understood, is the position that morality resists codification into a set of rules or principles.1 Jonathan Dancy, particularism's main contemporary proponent, maintains that there are few, if any, true moral principles, and moral reasoning and judgment do not require them. Instead, acts are justified by the salient features of particular situations, and moral reasoning requires attunement to these elements. In their article entitled “Ethical Particularism and Patterns”, Frank Jackson, Philip Pettit, and Michael Smith (JPS henceforth) argue that moral particularism is a cognitively implausible theory since it appears to entail the view that one might have a skill that is not grounded in an ability to recognise and represent natural patterns in the world. This charge echoes the complaints of computational theorists of cognition against their embodied cognition counterparts, namely that, theories of cognition that eschew talk (...) of mental representation are implausible qua theories of cognition. In both debates, the cognitive role of generalisation is central to the discussion; however, contrary to the received wisdom, I want to suggest that the dispute is not between generalisation or mental representation on the one hand and no generalisation or mental representation on the other, but rather between what I will call global and local generalisation. Using the dialogue between JPS and Dancy (our paradigm particularist) to frame this discussion, I show that by replacing Dancy's connectionist model for particularist reasoning with a case-based one, we not only vindicate his response to JPS, but we also gain insight into how it is the global/local distinction rather than the generalisation/no generalisation distinction that divides the two views.
