Do we have control over the content of our imaginings? More precisely: do we have control over what our imaginings are about? Intentionalists say yes. Until recently, intentionalism could be taken as the received view. Recently, authors like Munro & Strohminger (2021) have developed some arguments against it. Here, I tentatively join their ranks and develop a new way to think about the way in which imaginings develop their contents that also goes against intentionalism. My proposal makes use of what (...) we may call a ballistic framework for mental dynamics, which I sketch to some length. In this model, imaginings are articulated by ballistic events sensitive to constraints that modify the trajectories that imaginings trace in a special working space. This framework leaves room for alternatives to pre-assigned-content models, such as Kung’s (2016). In the ballistic-based models sketched here, and against intentionalism, imaginings can fail to be about what we intend them to be about. The framework also has applications beyond the intentionalism debate, some of which I will sketch. (shrink)

The goal of achieving Universal Health Coverage (UHC) can generally be realized only in stages. Moreover, resource, capacity and political constraints mean governments often face difficult trade-offs on the path to UHC. In a 2014 report, Making fair choices on the path to UHC, the WHO Consultative Group on Equity and Universal Health Coverage articulated principles for making such trade-offs in an equitable manner. We present three case studies which illustrate how these principles can guide practical decision-making. These case studies (...) show how progressive realization of the right to health can be effectively guided by priority-setting principles, including generating the greatest total health gain, priority for the worse off, and financial risk protection. They also demonstrate the value of a fair and accountable process of priority setting. (shrink)

Are words like ‘woman’ or ‘man’ sex terms that we use to talk about biological features of individuals? Are they gender terms that we use to talk about non-biological features e.g. social roles? Contextualists answer both questions affirmatively, arguing that these terms concern biological or non-biological features depending on context. I argue that a recent version of contextualism from Jennifer Saul that Esa Diaz-Leon develops doesn't exhibit the right kind of flexibility to capture our theoretical intuitions or moral and (...) political practices concerning our uses of these words. I then float the view that terms like 'woman' or 'man' are polysemous, arguing that it makes better sense of the significance of some forms of criticisms of mainstream gender ideology. (shrink)

This article concerns the morality of establishing regulated kidney markets in an effort to reduce the chronic shortage of kidneys for transplant. The article tries to rebut the view, recently defended by James Taylor, that if we hold autonomy to be intrinsically valuable, then we should be in favor of such markets. The article then argues that, under current conditions, the buying and selling of organs in regulated markets would sometimes violate two Kantian principles that are seen as moral (...) constraints. One principle forbids expressing disrespect for the dignity of humanity; the other forbids treating others merely as means. In light of the moral danger posed by regulated markets, the article advocates an alternative way of diminishing the current organ shortage, namely opt-out systems of cadaveric organ donation. Cosmopolitan education aims to transmit cosmopolitan forms of life in order to participate morally in the world community. The primary characteristics of this cosmopolitan education are its acceptance of the shared humanity of all persons as a fact of human existence and as a motivating guide for human interaction, and the requirement of democratic inclusion in deliberations of the governance of those interactions, including morality. Such an education in cosmopolitan morality requires means that befit its core components. This paper contrasts (...) the concepts of strict and moderate cosmopolitanism, empirical and deliberative morality, and structural and dispositional cosmopolitanism to show that the moderate, inclusive and deliberative processes of deliberative dispositional cosmopolitanism are more suited to cosmopolitan education in morality than strong, empirical-focused structural cosmopolitan efforts. Though strong, structural and empirically based forms may be more likely to guarantee preferred outcomes in the learning of specific morals or the implementation of institutional norms, they are also more likely to run afoul of the core components of cosmopolitanism because they will privilege outcomes over processes, and are thus more likely to be less inclusive and more coercive. In contrast, and even though they are less certain to guarantee preferred moral outcomes or actions, moderate, deliberative dispositional forms of cosmopolitan education embody the morality they seek to inform, and are more likely to find sustained internalised support over time. In this paper, I argue that a modified version of well-being subjectivism can avoid the standard, yet unintuitive, conclusion that morally horrible acts may contribute to an agent’s well-being. To make my case, I argue that “Modified Subjectivists” need not accept such conclusions about well-being so long as they accept the following three theoretical addenda: 1) there are a plurality of values pertaining to well-being, 2) there are some objective goods, even if they do not directly contribute to well-being, and (...) 3) some of these values and goods are bound-up with one another. Solar radiation management (SRM), a form of climate engineering, would offset the effects of increased greenhouse gas concentrations by reducing the amount of sunlight absorbed by the Earth. To encourage support for SRM research, advocates argue that SRM may someday be needed to reduce the risks from climate change. This paper examines the implications of two moral constraints—the Doctrine of Doing and Allowing, and the Doctrine of Double Effect—on this argument for SRM and SRM research. The Doctrine of Doing (...) and Allowing, and perhaps the Doctrine of Double Effect, shows that the argument is weaker than it appears. (shrink)

What kind of moral principle could be sufficiently restrictive to avoid the kind of large-scale risks that have resulted in catastrophe in the past, while at the same time not be so restrictive as to halt desirable progress? Is there such a principle that is not merely a precautionary principle, but one that could be based on firm moral grounds? In this article, I set out to explore a simple idea: might it be the case that reparability could (...) serve as a moral constraint against risky policy decisions? The idea is simple, but comes in two forms. First, that it is morally wrong to impose a risk for harm that is, in principle, irreparable, such that it would bring about a permanent loss of a kind qua kind. Second, that it is morally wrong to impose a risk for a reparable (but not compensable) harm that exceeds what realistically could be repaired. I set out here to do two things. First, I describe the moral problem to be addressed for any principle-guiding decisions about risk. A central claim in this article is that risk decisions are epistemically impaired decisions, and that we must, alongside outcome uncertainty, also take both epistemic uncertainty and moral uncertainty into account. Second, I introduce the idea of reparability as a moral constraint in the form of two versions of the Reparability Principle. Such a principle, I argue, could have some interesting advantages that seem both morally intuitive and that come with some advantages against some of the epistemic challenges posed by risk impositions. Those who claim to be committed to the moral equality of animals don’t always act as if they think all animals are equal. For instance, many animal liberationists spend hundreds, if not thousands, of dollars each year on food, toys, and medical care for their companion animals. Surely, more animals would be helped if the money spent on companion animals were donated to farmed animal protection organizations. Moreover, many animal liberationists feed their companion animals the flesh of farmed animals, (...) and some let their cats roam outdoors, foreseeing that they will kill wildlife. Maybe these companion-animal loving animal liberationists are moral hypocrites. Or maybe their behavior is justified. I defend the latter claim. By developing an ethic that emphasizes the moral significance of life-meaning and recognizes the important role that companion animals play in giving meaning to human lives, I argue that there are stringent side-constraints that apply to companion animals, but not to other animals. Consequently, it isn’t hypocritical to prioritize companion animals over other animals. We can have (and value) our carnivorous companions and be animal liberationists too. (shrink)

The history of contractarian moral theory is long and varied. It includes the classic social contract theories of Hobbes (1651), Hume (1739/1740), and Kant (1785) as well as modern versions of these theories, such as those of Gauthier (1986), Scanlon (1998), Darwall (2006), and Southwood (2010). In Minimal Morality: A Multilevel Social Contract Theory (2018), I continue this tradition by developing a ‘multilevel social contract theory’ that combines Humean, Hobbesian, and Kantian moral features. In this article, I reply (...) to comments by Fred D’Agostino, John Thrasher, Christopher W. Morris, and Peter Vanderschraaf. I am deeply grateful for these commentators’ constructive and engaging comments that, in their own way, shed light on core assumptions and features of the theory. Due to space restrictions, I focus on what I consider to be the main criticisms and have organized my responses thematically. I hope that doing so will also help readers who are less familiar with my work to understand the relevance of multilevel social contract theory for morally diverse societies. (shrink)

The moral permissibility of organ transplantation is taken for granted by most biomedical ethicists and practitioners. Of contemporary concern is not whether, but by what arrangements, we ought to allow organ transplantation. Should we institute markets for organs, thereby increasing their availability and saving many lives? Should organs be sold to the highest bidder? Should we allow the post mortem taking of organs without prior consent? Among moral theorists, the Kantians are suspected of being the least enthusiastic with (...) respect to these and similar questions. I will show the elements in Kant's theory that account for this lack of enthusiasm and how contemporary Kantians might answer questions about the permissibility of various arrangements for organ transplantation. I will argue that Kant would have had a permissive position on organ transplantation post mortem and a restrictive position on organ markets. These results will be based on a broader Kantian view of obligations to the body which stem from a non-formal theory of value. This non-formal theory, I will argue, is at the foundation of Kantian ethics. (shrink)

In this paper we present an executable approach to model interactions between agents that involve sensitive, privacy-related information. The approach is formal and based on deontic, epistemic and action logic. It is conceptually related to the Belief-Desire-Intention model of Bratman. Our approach uses the concept of sphere as developed by Waltzer to capture the notion that information is provided mostly with restrictions regarding its application. We use software agent technology to create an executable approach. Our agents hold beliefs about the (...) world, have goals and commitment to the goals. They have the capacity to reason about different courses of action, and communicate with one another. The main new ingredient of our approach is the idea to model information itself as an intentional agent whose main goal it is to preserve the integrity of the information and regulate its dissemination. We demonstrate our approach by applying it to an important process in the insurance industry: applying for a life insurance.In this paper we will: (1) describe the challenge organizational complexity poses in moral reasoning about informational relationships; (2) propose an executable approach, using software agents with reasoning capacities grounded in modal logic, in which moral constraints on informational relatio nships can be modeled and investigated; (3) describe the details of our approach, in which information itself is modeled as an intentional agent in its own right; (4) test and validate it by applying it to a concrete ‘hard case’ from the insurance industry; and (5) conclude that our approach upholds and offers potential for both research and practical application. Background Moral distress is a complex and challenging issue in the nursing profession that can negatively affect the nurses’ job satisfaction and retention and the quality of patient care. This study focused on describing the resources and constraints, consequences, and interventions of moral distress in nurses. Methods In a literature review, an extensive electronic search was conducted in databases including PubMed, ISI, Scopus as well as Google Scholar search engine using the keywords including “moral distress” and “nurses” (...) to identify resources, constraints, consequences, and interventions about moral distress in nurses, from the earliest records up to 26 December 2020. The required data were extracted from 61 relevant studies by two independent reviewers. Results Resources and constraints in the occurrence of moral distress among nurses can be divided into three general categories including internal factors, clinical factors, and external factors. The consequences of moral distress on nurses and the medical system reduced moral sensitivity, development of psychological and physical health problems, and the intention to leave the profession. The potential effective interventions were the implementation of integrated communication programs, strengthening physician–nurse collaboration, nursing involvement in clinical decision-making and end-of-life issues, social support, using a resiliency bundle, interdisciplinary discussion, and promoting nurses’ ethical and communication skills. Conclusion There are a wide range of resources and constraints impacting moral distress in nurses that could lead to negative consequences. Further studies are necessary to identify, evaluate, and implement a range of potential effective interventions for the management of moral distress in nurses. (shrink)

The moral community is a social community, and as such it is vulnerable to social problems and pathologies. In this essay I identify a particular way in which participation in the moral community can be constrained by social factors. I argue that features of the social world—including power imbalances, oppression, intergroup conflict, communication barriers, and stereotyping—can make it nearly impossible for some members of the moral community to hold others responsible for wrongdoing. Specifically, social circumstances prevent some (...) marginalized people from engaging in what Stephen Darwall calls “felicitous moral address” (Darwall 2006). We should think of some members of the moral community as having “second-class moral citizenship” in ways that parallel second-class political citizenship. The injustice of second-class moral citizenship can be understood by drawing an analogy with Miranda Fricker’s notion of “epistemic injustice” (Fricker 2007). Fricker’s account of how people can be undermined in their capacity as knowers can be extended to show how people can be undermined in their capacity as makers of moral claims, which can be called “claimant injustice”. Charles J. Lumsden and E.O. Wilson, in their writings together and individually, have proposed that human behaviors, whether moral or nonmoral, are governed by innate constraints (which they have termed epigenetic rules). I propose that if a genetic component of moral behavior is to be discovered, some sorting out of specifically moral from nonmoral innate constraints will be necessary. That some specifically moral innate constraits exist is evidenced by virtuous behaviors exhibited in nonhuman mammals, whose behavior (...) is usually granted to be importantly governed by genetic factors. Propensities for such virtuous behaviors may have been passed to humans as highly conserved mammalian genes and continue to influence us. I propose that these constitute at least a rudimentary morality and may account in part for the moral intuitions. But other innate constraints which are nonmoral in nature interact with the specifically moral innate constraints and with culture to yield human moral decisions and actions. Any model which aims to identify the genetic component of moral behaviors or behaviors with moral import must provide not only a delineation of cultural causes but must also distinguish between those genetic causes which may have their origin in innate moral constraints from others which are fundamentally nonmoral because the critical faculty necessary to higher level human morality itself arises in part from innate constraints of a nonmoral type; i.e., the processes of inductive reasoning common to both ethics and science. Finally, humans who could bring the nonmoral evaluative capacities to bear upon whatever moral intuitions might be genetically conserved in mammalian heritage would have an advantage over similar beings who could not. Despite the numerous instances of PED use in professional sports, there continues to be a strong negative moral response to those athletes who dope. My goal is to offer a diagnosis of this response. I will argue that we do not experience such disdain because these athletes have broken some constitutive rule of sport, but because they have lied about who they are. In violating the constraints of their own public narratives, they make both themselves and their choices unintelligible. (...) This worry becomes especially profound as we care greatly about who our athletes are. Using cases from both athletics and US politics, I argue that certain kinds of lies so violate our understanding of who a person is that we can no longer recognize them as the person we took them to be. Fundamentally, I believe that PED users have lied about something central to their public narratives. I develop this view through an examination of narrative identity, primarily focusing on J. David Velleman’s work on agency and self-constitution. I do not claim that the athlete using steroids is nonidentical to who she would be in the absence of steroid use, but that through use of PEDs, she has misled us about an important component of her pubic narrative and this is difficult for us to reconcile. Ultimately, this has implications for sport as well as other other aspects of human social life. (shrink)

Central to Watts and Newson’s argument in their seminal paper ‘ Is there a duty to routinely reinterpret genomic variant classifications? ’ is that diagnostic laboratories are not morally obligated to actively reinterpret variants of uncertain significance (VUS) due to the superior outcomes offered by next-generation sequencing (NGS) compared with traditional methods.1 NGS technologies can identify, analyse and interpret millions of genetic variations at once. For example, ‘the use of conventional molecular assays in clinical contexts could require doing a lot (...) of assays for various mutations. Using these different assays, more tissue may be required. These targets can accurately be questioned using NGS technology in a single test.’2 If NGS-based genomic sequencing is reliable and its output outweighs the potential harm of uncertainties, then, it is plausible to say that those test providers cannot incur a moral duty to actively reinterpret VUS because there won’t be any need to do so.1 Despite its seeming reliability, diagnostic laboratories face enormous challenges in implementing NGS-based …. For centuries in the UK and elsewhere, charities have been widely regarded as admirable and virtuous organisations. Business corporations, by contrast, have been characterised in the popular imagination as entities that lack a capacity for moral judgement. Drawing on the philosophical literature on the moral agency of organisations, we examine how the law shapes the ability of charities and business corporations headquartered in England to exercise moral agency. Paradoxically, we find that charities are legally constrained in exercising (...) moral agency in ways in which business corporations are not. The Bible does not in general tell us to maximize or minimize anything. The Ten Commandments and the Sermon on the Mount do n·ot, for example, tell us to maximize the glory of God. Instead they say, do this, don't do that, where ‘this’ and ‘that’ are replaceable by the name for such categories of action as stealing, committing adultery, and loving thy neighbour.Until recently, at least, non-maximizing moralists have appeared irrational when confronted with such questions as: what if stealing (...) or lying will save a life? Because they exclude consideration of particular circumstances, the dicta of traditional morality seem myopic and prejudiced next to ‘end-state’ doctrines like utilitarianism, which require that careful empirical investigation accompany virtually every moral decision. May's careful examination of empirical evidence makes a compelling case against the primacy of emotion in driving moral judgments. At the same time, emotion certainly is involved in moral judgments. We argue that emotion interacts with beliefs, values, and moral principles through a process of coherence-based reasoning (operating at least partially below the level of conscious awareness) in generating moral judgments and decisions.

Many philosophers conceive of freedom as non-interference. Such conceptions unify two core commitments. First, they associate freedom with non-constraint. And second, they take seriously a distinction between the interpersonal and the non-personal. As a result, they focus our attention exclusively on constraints attributable to other people’s choices – that is, on interference. I argue that these commitments manifest two distinct concerns: first, for a wide range of options; and second, for other people’s respect. However, construing freedom as non-interference unifies (...) these concerns in a way that does justice to neither. In particular, it focuses our attention on phenomena that are at best tangential, and at worst hostile, to our interest in respect. If we wish to preserve the distinctive significance of the interpersonal, we would be better served by a conception of freedom that focuses immediately on what I call "the social conditions of respect.". In three experiments we studied lay observers’ attributions of responsibility for an antisocial act (homicide). We systematically varied both the degree to which the action was coerced by external circumstances and the degree to which the actor endorsed and accepted ownership of the act, a psychological state that philosophers have termed ‘identification’. Our findings with respect to identification were highly consistent. The more an actor was identified with an action, the more likely observers were to assign responsibility to the actor, (...) even when the action was performed under constraints so powerful that no other behavioral option was available. Our findings indicate that social cognition involving assignment of responsibility for an action is a more complex process than previous research has indicated. It would appear that laypersons’ judgments of moral responsibility may, in some circumstances, accord with philosophical views in which freedom and determinism are regarded to be compatible. Wilson's book has two aims: a metaethical aim, to provide a non-moral-realist account of moral judgment and moral theorizing in terms of preferences for certain 'paraworlds' over other 'paraworlds,' and a normative ethical aim, to argue for greater socio-economic, and gender, equality. I am sympathetic to the second normative ethical aim, but I do not consider the metaethical redescription of moral judgment and moral theorizing in terms of preferences for paraworlds to be accurate or helpful. Her critique of "immanentism," or merely making visible and understandable the moral aspects of particular ways of life, in the second part of the book, is valuable, along with her criticisms of virtue theory as the most conservative of the Big Three moral theories. Her rejection of Rawlsian redistribution, in favor of a qualified egalitarianism that includes merit, is also worthy of consideration. (shrink)
