ABSTRACT The phrase “Enlightenment rhetoric” typically denotes discourses bent on rejecting classical oratorical styles in favor of purportedly scientific ones. Likewise, scholars often associate Enlightenment rhetorical styles with the scientific epistemologies that emerged in the seventeenth and eighteenth centuries. This article reconsiders Enlightenment rhetoric by analyzing David Hume’s 1742 essay “Of Eloquence.” More specifically, the article argues that the Scottish Enlightenment context necessitated a rhetoric that compensated for the discursive limitations of new scientific worldviews. In so doing, the article argues (...) that Hume verbalizes the transcendent dimension of classical eloquence in ways commensurate with the emphasis on perspicuity emerging in English culture, a rhetorical maneuver that the author calls discursive transcendence. Hume’s “Of Eloquence” thus serves as a case study demonstrating how an Enlightenment writer advanced a rhetoric that both rejects and pulls from prior rhetorical traditions, constituting a new understanding of Enlightenment rhetoric. Barzykowski and Moulin suggest that déjà vu and involuntary autobiographical memories recruit similar retrieval processes. Here, we invite the authors to clarify three issues: (1) What mechanism prevents déjà vu to happen more frequently? Counterpossibles, counterfactuals conditional with impossible antecedents, are notoriously contested; while the standard view makes them trivially true, some authors argue that they can be non-trivially true. In this paper, I examine the use of counterfactuals in the context of games, and argue that there is a case to be made for their non-triviality in a restricted sense. In particular, I examine the case of retro problems in chess, where it can happen that one is tasked with evaluating counterfactuals about illegal (...) positions. If we understand illegality as a type of restricted impossibility, those counterfactuals are non-trivial counterpossibles. I suggest that their non-triviality stems from their role in practices of rule coordination and revision, and suggest that this model could be generalized to counterpossibles in different domains. I then compare the approach to the accounts of Vetter 2016 and Locke 2019. (shrink)

The article carries out a critical examination of J.-L. Marion's latest work, "Sur la pensée passive de Descartes", whose main thesis is that the problems posed by the union of body and soul confuse two terms: body and my body. This confusion leads to the application to the former of categories inherent to the latter. The paper examines the "ontic paradoxes" that my body (the flesh) gives rise to (a); it clarifies the thesis of two interpretations of the First and Sixth Meditations (b); it discusses the "exception to metaphysics" established by the knowledge of my body (c); and, following an indication by the author, it proposes an opening to the ethical dimension, which demands an examination of the union, through love, with a fellow human being and with the community of human beings, rather than of the union of body and soul (d). This study evaluated the functioning of children in early childhood education classroom routines, using the 3M Functioning in Preschool Routines Scale. A total of 366 children aged 36 to 70 months and 22 teachers from six early childhood education centers in Spain participated in the study. The authors used the Rasch model to determine the item fit and the difficulty of the items in relation to children's ability levels in this age range. The Rasch Differential Item Functioning analysis by child (...) age groups showed that the item difficulty differed according to the children's age and according to their levels of competence. The results of this study supported the reliability and validity of the 3M scale for assessing children's functioning in preschool classroom routines. A few items, however, were identified as needing to be reworded and more difficult items needed to be added to increase the scale difficulty level to match the performance of children with higher ability levels. The authors introduced the new and reworded items based on the results of this study and the corresponding ICF codes per item. Moreover, the authors indicate how to use the ICF Performance Qualifiers in relation to the 3M scale response categories for developing a functioning profile for the child. (shrink)

In the context of a new wave of women’s activism for equality, the body is once again at the centre of the discussion today, in the USA and globally. Analysing American discourses about health and illness at the turn of the twenty-first century, Tasha Dubriwny has argued that the current narratives are dominated by neoliberal and postfeminist philosophies that have thrived in a framework of biomedicalisation and self-surveillance. What happens, then, when a successful feminist artist is diagnosed with uterine cancer? (...) How does Eve Ensler, author of The Vagina Monologues and founder of V-Day, face the fact that her life may have a painful ending? How does a woman so aware of her physical and psychological self come to terms with illness? Is she willing to put her political project aside to become a patient? Through a close reading of Ensler’s uterine cancer memoir In the Body of the World, and focusing particularly on its structure and narrative strategies, this article situates her work within the corpus of female literature about health and illness in the twenty-first century, exploring her meaning-making process in the light of the current tensions between feminism and postfeminism. The judiciary is a key policy actor that is involved in deciding health rights and policy by intervening in the policy process through a variety of judicial mechanisms, yet the appropriate extent of its involvement remains contentious. Taking the competence objection seriously requires understanding it as an epistemic problem about how courts assess empirical and scientific evidence in order to competently adjudicate controversial health claims. This paper examines recent advances in social epistemology to develop insights for the epistemic competence of (...) the judiciary from a system‐oriented approach. I outline three epistemic features that set the judiciary and the judicial decision‐making process apart from other types of decision‐makers in health policy: the distribution of epistemic power, the epistemic authority of a justified believer, and the principle of disinterestedness. Finally, I relate these insights back to the judicial decision‐making process with a specific focus on recent court decisions in health rights and health policy in Chile. (shrink)

Do we have control over the content of our imaginings? More precisely: do we have control over what our imaginings are about? Intentionalists say yes. Until recently, intentionalism could be taken as the received view. Recently, authors like Munro & Strohminger (2021) have developed some arguments against it. Here, I tentatively join their ranks and develop a new way to think about the way in which imaginings develop their contents that also goes against intentionalism. My proposal makes use of what (...) we may call a ballistic framework for mental dynamics, which I sketch to some length. In this model, imaginings are articulated by ballistic events sensitive to constraints that modify the trajectories that imaginings trace in a special working space. This framework leaves room for alternatives to pre-assigned-content models, such as Kung’s (2016). In the ballistic-based models sketched here, and against intentionalism, imaginings can fail to be about what we intend them to be about. The framework also has applications beyond the intentionalism debate, some of which I will sketch. (shrink)

Claims concerning the death of the nation-state are often accompanied by postnationalist arguments that emphasize the potential of human rights to contest nation-bounded conceptualizations of membership. Conversely, arguments focusing on the continuing importance of state-bounded social citizenship rights undermine such postnationalist claims. To assess these claims, this article turns to the Irish state and its prohibition of abortion except in cases where the life of the pregnant woman is in danger. The authors focus their analysis on four legal cases that (...) unfolded between 1992 and 2010. These cases reflect how specific women’s social location within interconnected power hierarchies of nationality, gender, class, race/ethnicity positioned them differently vis-a-vis the Irish state, international and supranational bodies. Furthermore, the transnational, in the form of immigration, non-governmental organizations and the Catholic Church, plays an important role in structuring the context within which these cases unfold. Rather than showing that the international, supranational and transnational are conduits for the declining power of the nation-state, this article finds that in the increasingly dense legal-political field there is room for all of these forces. Resumen Este artículo da cuenta de la forma en que el liberalismo del filósofo chileno Jenaro Abasolo (1833-1884), al conceder un rol activo al Estado en la “habilitación de la masa desheredada”, responde al adjetivo “social”. En Abasolo, el deber de asegurar en lo posible la prosperidad de las personas, se sostiene en el derecho natural y en una teología de la historia pan[en]teísta afín al krausismo. Abasolo piensa que la redención del desheredado en naciones aun juveniles debe apoyarse en (...) una forma de Estado “casi socialista”. Esto implica una acción de centralización y de tutela del pueblo que enfrenta a los autores del artículo a la gran dificultad de determinar cómo el autor chileno realiza la transición de una habilitación consumada a través de un buen grado de despotismo, hacia la libertad. Es decir, resulta controversial establecer la factibilidad de la realización de esta vía cuasi socialista a un liberalismo contrafácticamente orientado por el laissez faire. Abstract This article shows how the liberalism of the Chilean philosopher Jenaro Abasolo (1833-1884), by granting an active role to the State in the “empowerment of the disinherited mass”, responds to the adjective “social”. In Abasolo, the duty to ensure as far as possible the prosperity of the people is based on natural law and on a pan[en]theistic theology of history akin to Krausism. Abasolo thinks that the redemption of the disinherited in even juvenile nations must be supported by an “almost socialist” form of state. This implies an action of centralization and guardianship of the people that confronts the authors of the article with the great difficulty of determining how the Chilean author makes the transition from an empowerment consummated through a good degree of despotism, towards freedom. That is to say, it is controversial to establish the feasibility of the realization of this quasi-socialist path to a liberalism counterfactually oriented by laissez faire. (shrink)

This paper focuses on an emergency basic income as a tool for avoiding financial insecurity during the time of pandemic. The authors argue that paying each resident a monthly cash amount for the duration of the crisis would serve to protect them from the economic fallout.They suggest three reasons why the EBI proposal is particularly well-suited to play an important role in a comprehensive public health response to COVID-19: it offers an immediate and agile response; it prioritizes the most vulnerable (...) in the affected population; and it promotes a solidaristic response to the pandemic crisis. To go beyond the need to shut down and restart an EBI assistance scheme each time a pandemic hits, the authors propose considering turning the program into a permanent feature. (shrink)

Although fairness is a key moral trait, limited research focuses on participants' observed fairness behavior because moral traits are generally measured through self-report. This experiment focused on day-to-day interpersonal fairness rather than impersonal justice, and fairness was assessed as observed behavior. The experiment investigated whether a self-reported fairness trait would moderate a situational influence on observed fairness behavior, such that individuals with a stronger fairness trait would be less affected by a situational influence than those with a weaker (...) fairness trait. We used an iterated resource game in which participants could withdraw resources as they chose, and we manipulated the number of resources bogus players withdrew. The number of resources participants withdrew was the behavioral measure of fairness. Results confirmed the expected moderation of the unfairness manipulation by a fairness trait on observed behavior. Those reporting a stronger fairness trait were unaffected by the manipulation, whereas those reporting a weaker fairness trait were more strongly influenced. (shrink)

In this article we propose to carry out an examination of the notions of ‘other’ based on the philosophical proposals of Maurice Merleau-Ponty and Maurice Blanchot. It seeks to show the common point between both thoughts, from a proposal in which the other is understood as a dislocation, which manifests itself in the way of an opening. For this reason, the notion of opening becomes the central element of this analysis, from which the other manifests itself in an ambiguous way. (...) To this end, the proposals of both authors will be analyzed separately, however, highlighting and relating to each other their respective conceptions of opening and the implications they have regarding the question of the other. Moral concerns about the authority, power, and trustworthiness of physicians have become important topics in clinical ethics during the past three decades. These concerns have come to greater prominence with the increasing involvement of large-scale private institutions in the organization and delivery of medical services, especially managed care organizations, and with the increasing involvement of government in the payment for and organization and delivery of medical services. When physicians act as the agents of large institutions or governments, the (...) power of physicians over their patients increases. Prompted by recent comments on the moral authority of dialogic consensus, we argue that consensus, specifically dialogic consensus, possesses a unique form of moral authority. Given our multicultural era and its plurality of values, we contend that traditional ethical frameworks or principles derived from them cannot be viewed substantively. Both philosophers and clinicians prioritize the need for a decision to be morally justifiable, and also for the decision to be action-guiding. We argue that, especially against the (...) background of our pluralistic society, it is only via unforced dialogue and properly founded argumentation, aiming for consensus, that we can ascribe rightness or wrongness in a normative fashion to dilemmatic situations. We argue that both the process of dialogue, properly constituted, and the consensual outcome itself have moral authority vested within them. Finally, we argue that the consensual decision made is able to withstand moral scrutiny and is action-guiding, without claiming absolute moral authority in other contexts. (shrink)

I discuss a remark made by Gitta Sereny about Treblinka Kommandant Franz Stangl that questions the role and scope of moral authority, viz. “I don’t know now at which point one human being can make the moral decision for another that he should have the courage to risk death.” I provide an illustrative elaboration from her remark of a role for moral authority and a limit on its scope. First, I use the idea of supererogation (...) to introduce the idea and role of moral authority. Second,I argue that there is a parallel understanding of Sereny’s remark that shows moral authority operative in a similar role in Stangl’s case. Third, I make four refinements to what she has expressed about Stangl, each of which further illuminates the nature of moral authority. How should international law figure into the practical reasoning of agents who fall under its jurisdiction? How should the existence of an international legal norm regulating some activity affect a subject’s decision-making about that activity? This is a question concerning the general moral authority of international law. It concerns not simply the kind of authority international law claims, but the character of the authority it actually has. An authority, as I will use the term, is (...) moral obligation producing: if x (e.g., a person, institution, or law) has authority over an agent, then the directives of x produce a significant reason for the agent to comply with the terms of the directive. This article explores the crises and debates surrounding the management of imperial family matters, especially succession, under the Ming Dynasty as an approach to understanding the limits of imperial power and the nature of literati discourse on the imperium. Ming officials and members of the literati community became passionately engaged in the debates on imperial family decisions, regarding the moral order of the imperial family as a key feature of their prerogatives over imperial power. Hypocrites invite moral opprobrium, and charges of hypocrisy are a significant and widespread feature of our moral lives. Yet it remains unclear what hypocrites have in common, or what is distinctively bad about them. We propose that hypocrites are persons who have undermined their claim to moral authority. Since this self-undermining can occur in a number of ways, our account construes hypocrisy as multiply realizable. As we explain, a person’s moral authority refers to a (...) kind of standing that they occupy within a particular moral community. This status is both socially important and normatively precarious. Hence, moral agents are right to be vigilant when it comes to hypocrisy, and are often justified in their outrage when they detect it. We further argue that our view can preserve what is attractive in rival accounts, while avoiding their associated problems. (shrink)

Dale Dorsey considers one of the most fundamental questions in philosophical ethics: to what extent do the demands of morality have normative authority over us and our lives? Must we conform to moral requirements? Most who have addressed this question have treated the normative significance of morality as simply a fact to be explained. But Dorsey argues that this traditional assumption is misguided. According to Dorsey, not only are we not required to conform to moral demands, conforming (...) to morality's demands will not always even be normatively permissible---moral behavior can be wrong. Gerald Gaus’s The Order of Public Reason: A Theory of Freedom and Morality in a Diverse and Bounded World is refreshingly ambitious. It seems to me that our field today is a little too eager to “[stay] on the surface, philosophically speaking” (Rawls 1999, p. 395; cf. 2005, p. 10). However, the scope of Gaus’s ambition complicates the critic’s task. When a philosophical work aims to present something as grand as a “theory of freedom and morality,” it seems plausible to (...) think that the appropriate unit of analysis is the whole rather than any of its elements. This is especially so in the case of a book like Gaus’s, where the author’s philosophical acumen is well-matched to its objectives.
