The purpose of legal theory seems to be a perpetually debated issue among legal scholars. Koskenniemi argues that the history of international legal theory is conditioned by a dialectical movement between a position justifying any given positive law based on the power of states, and a position arguing for a theory of the state where laws are justified only in accordance with certain substantial conditions. According to Lauterpacht there is very little support in Spinoza's political philosophy for a “separate and (...) independent theory of international law”. The chapter aims to contextualize the passages pointed to by Lauterpacht in order to investigate whether such an endeavor may produce an understanding of Spinoza's political philosophy that makes it apt to function as a basis for a practical theory of international law. Lauterpacht's critique of Spinoza's statements on international law hinges on the argument that they deviate from his general explanation of the mechanisms of law‐making. (shrink)

What do spelling errors look like in children with sign language knowledge but with variation in hearing background, and what strategies do these children rely on when they learn how to spell in written language? Earlier research suggests that the spelling of children with hearing loss is different, because of their lack of hearing, which requires them to rely on other strategies. In this study, we examine whether, and how, different variables such as hearing degree, sign language knowledge and bilingualism (...) may affect the spelling strategies of children with Swedish sign language, Svenskt teckenspråk, (STS) knowledge, and whether these variables can be mirrored in these children’s spelling. The spelling process of nineteen children with STS knowledge (mean age: 10.9) with different hearing degrees, born into deaf families, is described and compared with a group of fourteen hearing children without STS knowledge (mean age: 10.9). Keystroke logging was used to investigate the participants’ writing process. The spelling behavior of the children was further analyzed and categorized into different spelling error categories. The results indicate that many children showed exceptionally few spelling errors compared to earlier studies, and they demonstrated good typing skills. Also, deaf children showed a tendency to rely on a visual strategy during spelling, which may result in incorrect, but visually similar, words, i.e. a type of spelling errors not found in texts by hearing children with STS knowledge. The deaf children also showed direct transfer from STS in their spelling. A sounding strategy was found in the hard-of-hearing children with STS knowledge, together with hearing children of deaf adults (CODAs), rather than a visual strategy. Nevertheless, the children with STS knowledge demonstrated fewer spelling errors in general, that may also derive from their early exposure of STS, also enabling them to use the fingerspelling strategy. Overall, this study suggests that the ability to hear and to use sign language, together and respectively, play a significant role for the spelling patterns and spelling strategies used by the children with and without hearing loss. The development of the modern world which is marked by very rapid progress in the fields of science and technology not only has a very positive impact but also has a very negative impact on the realization of Christian family life. The magnitude of the negative impact that has occurred has resulted in many Christian families, especially Christian husbands and (...) wives, experiencing difficulties in realizing their essence as a communion of love. Responding to situations like this, the Church is required to continuously proclaim and awaken Christian families, especially married couples, about the love of God as the basis, power, direction and goal of Christian family life. Pope Francis through the Apostolic Exhortation Amoris Laetitia invites married couples as main actors in building a Christian family to always cultivate their love as the foundation of Christian family life. Because the strength of the Christian family lies in the ability of married couples to experience and manifest and teach God's love in Christian family life. That means, God's love which is manifested in the love of husband and wife becomes the determining foundation in building the Christian family as a communion of love. (shrink)

There has been considerable controversy surrounding the routine circumcision of male infants in the United States. This is of particular concern, since the medical establishments of all the other countries of the developed world have abandoned this procedure as having dubious benefits. This article examines the medical pros and cons of neonatal male circumcision in a historical perspective and suggests that the circumstances that led to its establishment as a routine practice are largely absent today. Reasons for its continued use (...) and ethical and moral issues associated with its practice are then examined closely, especially in light of the current debate surrounding female circumcision. The article concludes that the medical and ethical issues surrounding this practice should be more broadly debated until there is some consensus as to its benefits. Prudence dictates that until such a consensus emerges, the practice should be suspended. (shrink)

Corporations are increasingly forced to widen their agendas to include social and environmental concerns, or corporate social responsibility (CSR). This development has been recorded in the current academic debate, and the views regarding its implications for business, the state, and civil society diverge. However, there is agreement within the CSR and corporate governance literatures that there is a lack of thorough empirical studies of these effects. Based on a case study of the multinational wind energy company Suzlon Energy's CSR projects (...) in rural India, this article contends that CSR projects implemented through cross‐sector partnerships can help to build the capacities of civil society organizations (CSOs). Although the risk of corporate steering of the civil society agenda is reduced when CSR prioritizes community needs over business imperatives, CSOs tend to bear the highest costs in partnerships, through credibility losses and insecurity concerning project terms and funding, reinforcing the importance of critical cooperation and complementary core competencies in cross‐sector partnerships. The results have implications for the strategies of corporations, CSOs, and governments as well as for the planning of national and international development aid. (shrink)

Le discours international actuel sur l’écologie s’est mué en un mouvement qui s’identifie avec le discours de la vérité scientifique. L’exemple de Greta Thunberg et de ses appels à l’action illustre dans quelle mesure l’identité actuelle du mouvement enveloppe un paradoxe qui lui est inhérent. D’une part, elle s’appuie sur la nature auto-explicative et claire des idées vraies. D’autre part, pour propager ces idées, elle fait résider son pouvoir rhétorique dans l’impact émotionnel. L’approche par Spinoza de la relation entre raison (...) et foi, telle qu’elle apparaît quand on juxtapose les passages pertinents de l’ Éthique et ceux du Traité théologico-politique qui décrivent la prophétie, constitue un cadre théorique susceptible de rendre compte de ce paradoxe inhérent à l’écologie moderne. In this article I will argue that the philosophy of Benedict Spinoza may assist us in coming to terms with some of the conceptual challenges that the phenomenon of Artificial Intelligence poses on law and legal thought. I will pursue this argument in three steps. First, I will suggest that Spinoza’s philosophy of the mind and knowledge may function as an analytical tool for making sense of the prevailing conception of AI within the legal discourse on Lethal Autonomous Weapons Systems. Then, I will continue the argument with the aid of Spinoza’s political philosophy which partly complicates the picture as it seems to disqualify a normative process grounded directly upon the means stipulated for achieving a robust understanding of AI. Based on these two separate discussions I will conclude by outlining a composite critique – from the twofolded perspective of Spinoza’s ethical and political discussions – of the ongoing negotiations of a new Conventional Weapons Convention protocol on LAWS. ABSTRACTWhile Spinoza stipulates an ideal moral person in the propositions on the ‘free man’ in Ethics IV, this account does not seem to be intended to function as a pedagogical tool of political relevance. Hence, it does not seem to correspond to the purpose of moral exemplarism. If we look for that kind of practical guidance, Spinoza’s political works seem more relevant. Interestingly, when we approach Spinoza’s political theory with moral exemplarism in mind, we find that instead of constructing his (...) exemplar on the idea of a supremely moral person, he emphasizes the concept of ingenium to chisel out an imperfect model of human behavior. We argue that the purpose of this is to avoid a utopian and inefficient political theory and to work out a moral practice that is capable of assisting people and communities in ethical self-transformation. This text deals with a problem concerning processes of the productive power of knowledge. We draw on so called poststructural theories challenging the classical image of thought – as hinged upon a representational logic identifying entities in a rigid sense – when formulating a problem concerning the gap between knowledge and the object of knowledge. More specifically we are looking at this problem in the contexts of sustainable development and childhood using illustrating examples in order to test the validity of (...) these theoretical accounts. The examples we use range from internationally agreed documents claiming universality concerning environmental protection and childhood to national curricula for the pre-school to a Swedish governmentally produced and distributed TV-series called Needle and Stick save the world, addressing the issue of sustainable development. The aim of the paper is to reconstruct the concept of natural necessity upon which the empirical causal type of a scientific law rests and to enlarge the notion of the conditions of a scientific law. According to regularity theory, what counts in the investigation of causation is the universality of causal proposition. So in this theory priority is given to the explication of the concept “scientific law”. Such an explication was provided by Popper in the first edition of his (...) Logik der Forschung. He defines here the concept “scientific law” by distinguishing between strictly universal propositions and numerical propositions. Later Popper, drawing upon W. Kneale´s criticism, proposed another definition of natural necessity. He expounds his revised view in Chapter X* of the new appendices of the Logic of Scientific Discovery by means of the famous moa-example. He views statement “All moas die before the age of fifty years” as not physically necessary because its truth depends on the presence of conditions different from singular initial conditions. Ba distinguishing between singular initial conditions and modification conditions I, contrary to Popper, claim that that statement can be viewed as naturally necessary. (shrink)

This essay explores how the scientific community interpreted the discoveries of extinct giant birds during the mid-nineteenth century on the islands of New Zealand and Madagascar. It argues that the Aepyornis of Madagascar was understood through the moa of New Zealand because of the rise of global networks and theories. Indeed, their global connections made giant birds a sensation among the scientific community and together forged theories and associations not possible in isolation. In this way, this paper argues for a (...) closer look at how the creation of science emerged from a world framework that involved multiple sites of discovery and interpretation that continually influenced and reshaped scientific theories. Ostriches were filmed running at maximum speed, and forces on the feet were calculated. Measurements were made of the principal structures in the legs of an ostrich. Hence peak stresses in muscles, tendons and bones were calculated. They lay within the range of stresses calculated for strenuous activities of other vertebrates. The ostrich makes substantial savings of energy in running, by elastic storage in stretched tendons. Pachyornis was a flightless bird, much heavier than ostriches and with massively thick leg bones. (...) These bones are shorter than predicted for its estimated body mass, by extrapolation from allometric equations for flying birds. An attempt is made to calculate the stresses that acted in the leg bones in running, for all possible patterns of leg movement. The stresses were probably rather low, unless Pachyornis was capable of running fast. Recently two developments have had a major impact on the field of ancient DNA (aDNA). First, new advances in DNA sequencing, in combination with improved capture/enrichment methods, have resulted in the recovery of orders of magnitude more DNA sequence data from ancient animals. Second, there has been an increase in the range of tissue types employed in aDNA. Hair in particular has proven to be very successful as a source of DNA because of its low levels of contamination and high (...) level of ancient endogenous DNA. These developments have resulted in significant advances in our understanding of recently extinct animals: namely their evolutionary relationships, physiology, and even behaviour. Hair has been used to recover the first complete ancient nuclear genome, that of the extinct woolly mammoth, which then facilitated the expression and functional analysis of haemoglobins. Finally, we speculate on the consequences of these developments for the possibility of recreating extinct animals. (shrink)

In his essay Tracy Lupher (henceforth, TL) is concerned with Robert Kane's (1984) version of the modal ontological argument (MOA). As he correctly points out, Kane's argument is valid only if the accessibility relation between possible worlds is assumed to be symmetric. TL's remarks pave the way to thinking that the MOA is intended to establish the existence of a perfect being as a matter of logical necessity. Moreover, given TL's undisputed supposition (even shared by Kane) that S5 - in (...) which the accessibility relation is symmetric - captures the notion of logical necessity, the real issue becomes whether the premise of the MOA is true. Contrary to TL's main claim, the discussion thus shifts back from technical arguments for why the appropriate modal logic must have a symmetric accessibility relation to metaphysical, theological, or conceptual considerations about the notion of a perfect being itself. I argue that it is only due to such considerations that we even start to ponder the question of what modal logic is the appropriate one to choose. (shrink)

However,conversion of swidden fields to sun-grown cacaoconstrains future food productionopportunities, increases susceptibility todrought stress and potential soil nutrient andorganic matter losses, and increases householddependence on a commodity that is subject toextreme price volatility. Levonorgestrel is widely used as emergency contraception, yet much confusion surrounds its use. Consensus statements and reviews typically attribute its efficacy to prefertilization mechanisms of action, such as suppression of ovulation and interference with cervical mucus or sperm function, yet studies do not rule out a postovulatory MOA. To yield greater clarity, the authors review recent scientific studies examining the MOAs of LNG-EC. They conclude that LNG-EC exerts minimal effects on cervical mucus and sperm function and that suppression of ovulation (...) is not the dominant MOA accounting for the contraceptive efficacy of LNG-EC. Luteal deficiencies and endometrial changes reported in the literature strongly suggest a postovulatory MOA when LNG-EC is given during the critical preovulatory period. African women farmers have an urgent need for adequate agricultural extension information. Training extension agents in gender related issues should have high priority, considering that the majority of farmers are women and have different roles, resources, constraints, and responsibilities from men. This paper examines the extent to which these issues are incorporated into the curriculum of the two Malawian institutions of agricultural education that train extensionists. It also considers the degree to which they are recruiting women officers into fields other (...) than home economics. Administrators and lecturers at both institutions express a desire to integrate gender matters into the curriculum and to recruit more females into agricultural extension; yet both fall far short in meeting these goals. The conclusion provides recommendations on how African institutions of higher learning that train extension personnel might better accomplish these goals and suggests that African MOAs need to employ more women in agricultural research, extension, training, and policy-making positions. Here’s something I’m willing to claim we know: Homo sapiens, in particular the Polynesian settlers who first arrived in Aotearoa around the twelfth century, take the lion’s share of causal blame for the extinction of a lineage of enormous flightless birds: the moa. Stretching to three metres at their tallest, moa were a distinctive and remarkable feature of Aotearoa’s primeval forests, playing the main browser and grazer role in this unique bird-based ecosystem. Once humans turned up forests were burned, moa (...) were stalked, and human-0introduced arrivals such as kiore had dramatic ecological repercussions. Within a few centuries, the moa were gone.
