Ils délimitent en effet plusieurs territoires distincts en fonction de la nature des impacts qu’ils provoquent, lesquels, chacun, sont soumis à leurs propres législations et rentrent dans les compétences d’autorités différentes, y compris celle dont dépend la décision sur l’infrastructure envisagée. De telles situations normatives complexes empêchent la sémantisation légitimante que le droit est censé assurer dans les décisions de l’appareil étatique: elle sera (...) toujours partielle, voire lacunaire. Les compensations ne peuvent être que procédurales, et celles-ci sont insuffisantes à atteindre l’idéal postulé par le principe de légalité des activités publiques. In the social system in which we live, the imaginary body is an able body. The able-bodied has established its representations that are the projection of able-bodied subjectivities. In this article, I shall develop a psychoanalytic account of physical disability in order to open up possibilities for physical disability beyond its position as castrated able-bodiedness. Psychoanalysis, to me, is not simply about `sexuality' but can also be used to analyse `physical disability', indeed all aspects of one's subjectivity. I shall propose (...) the appropriation of psychoanalysis to explain the construction of subjectivity, whether it is able-bodied or disabled, in a way that parallels the male/female dichotomy. Within an able-bodied symbolic, in which the able-bodied takes itself as normal, it is impossible to illustrate the multiplicity of the disabled. Following Irigaray's claim that the ambiguity of female sexuality does not conform to male notions of sexuality, I argue that the complexity of the disabled body does not fit into the able-bodied norm of subjectivity. In this article, I shall be drawing on Irigaray's theory of embodied subjectivity to argue against the masculine-able-bodied-based theory of subjectivity found in Freud and Lacan. (shrink)

The Greek identification of certain Indian people as philosophoi at the end of the fourth century bce provides unique information about the meaning of the term philosophia, especially with respect to its reference to a certain kind of “way of life” (bios), at the time of its greatest maturity (at the start of the Hellenistic period). The Indica of Megasthenes, an ambassador to northern India after the death of Alexander, is our most important evidence; fragments from earlier works by Nearchus (...) and Onesicritus, intellectuals in Alexander’s cortege, provide corroboration. This essay argues that late classical Greeks did largely think of philosophia as a way of life. (shrink)

Research Ethics, Volume 18, Issue 2, Page 163-168, April 2022. Citation is an essential practice in scientific publishing. However, it is mandatory that citing the sources in a scientific work is performed in a proper manner. Manipulating citations in research articles is one form of academic research misconduct that violates publication ethics. Citation manipulation simply occurs for the purpose of increasing the number of citations of a researcher or a journal. Unfortunately, there has been a growing trend for this type (...) of misconduct recently and this has not received much attention from the science community. The most effective solution to prevent the growth of such unethical practices is for reputable journals to impose stricter rules on reference evaluation criteria in order to emphasize on the appropriateness of the citations. My reply to the comments of Parkinson (2010) and Kuppens (2010) is organized in three parts. The first part deals with Parkinson’s claim that the scope of our research is limited because no real emotions were elicited. I suggest that the outcomes in our studies are structurally similar to real emotions but that they lack intensity. In the second part, I try to correct three potential misunderstandings regarding the nature of the comparison process that I proposed. In the third part, (...) I respond to Kuppens’ suggestion that we also need to consider the transition of appraisal values into the other components of emotion (actions tendencies, responses, and subjective experience). I argue that uniquely human forms of ‘Theory of Mind’ are a product of cultural evolution. Specifically, propositional attitude psychology is a linguistically constructed folk model of the human mind, invented by our ancestors for a range of tasks and refined over successive generations of users. The construction of these folk models gave humans new tools for thinking and reasoning about mental states—and so imbued us with abilities not shared by non-linguistic species. I also argue that uniquely human forms of (...) ToM are not required for language development, such that an account of the cultural origins of ToM does not jeopardise the explanation of language development. Tout ce qui n’est pas reconnu par le droit comme norme juridique est traité par lui comme un fait—normes sociales, connaissances scientifiques, mœurs, événements, etc. Le droit, système autoréférentiel, institue les compétences et les procédures par lesquelles une assertion quelconque, portant sur des faits, devient une norme juridique. Le présent texte analyse les différents lieux de passage par lesquels des faits peuvent ainsi être reconnus par le droit comme normes juridiques. Il analyse d’abord la réception et la construction des faits (...) à considérer comme pertinents au regard de la norme applicable. Il introduit ensuite le concept de notions juridiques indéterminées, dont le sens ne peut être concrétisé que par référence à des faits de toute nature, ce qui requiert une argumentation propre à justifier cette référence. Les faits sont donc construits avant qu’une autorité instituée par le droit décide de leur donner la forme abstraite d’une norme juridique. Cette construction va être structurée comme un récit, dont la cohérence doit être assurée par référence à des schémas tirés de l’expérience sociale, de telle manière qu’elle puisse être acceptée comme raisonnable par la collectivité. Le juge comme le législateur apparaissent alors sous la double face d’une fonction juridique et d’un individu plongé dans la société, ce qui les met en mesure faire du droit avec des faits en les comprenant l’un et les autres. This paper provides a stagewise overview of the important issues that play a role in technology adoption and use in organizations. In the current literature, there is a lack of consistency and clarity about the different stages of the technology adoption process, the important issues at each stage, and the differentiation between antecedents, after-effects, enablers, and barriers to technology adoption. This paper collected the relevant issues in technology adoption and use, mentioned dispersedly and under various terminologies, in the recent literature. (...) The qualitative literature review was followed by thematic analysis of the data. The resulting themes were organized into a thematic map depicting three stages of the technology adoption process: pre-change, change, and post-change. The relevant themes and subthemes at each stage were identified and their significance discussed. The themes at each stage are antecedents to the next stage. All the themes of the pre-change and change stages are neutral, but the way they are managed and executed makes them enablers or barriers in effect. The thematic map is a continuous cycle where every round of technology adoption provides input for the subsequent rounds. Based on how themes have been addressed and executed in practice, they can either enhance or impair the subsequent technology adoption. This thematic map can be used as a qualitative framework by academics and practitioners in the field to evaluate technological changes. (shrink)

The argument from reason states that if naturalism is true, then our beliefs are caused by physical processes rather than being causally based in their reasons, so our beliefs are not knowledge—including the belief in naturalism itself. Recent critics of the argument from reason provide dual process replies to the argument from reason—our beliefs can have both a naturalistic cause/ explanation and be caused/explained by its reasons, thereby showing that naturalism can accommodate knowledge. To rethink history from the perspective of an economy of affects as they are engendered by beings ousted from the definition of the human, I will draw on two Caribbean texts, Anim-Addo's Imoinda: Or She Mho will Lose Her Name and Philip's Zong!. This essay discusses how these two Caribbean texts counterwrite the history of the slave plantation by staging and embodying the work of what I call an affective memory drawn from the history of the black subject as a (...) history of absence and reconstellated in the present as a history of being and community. This affective memory represents the being of the ‘living corpse’ and her making of a community as the subject of a new polity, the polity of decolonised beings. By drawing on these texts to demonstrate how they write the history of spectres, ruins and other communities, I discuss affective memory not as the absolute possession of a body, but rather as the alienated property of the body that can be reclaimed only by a community that, precarious and tentative as it is for it is a community of slaves and subjected bodies, remains the only promise for the future. This study investigates how Human Factors is applied when designing and developing Immersive Visual Technologies, including Augmented Reality, Mixed Reality, and Virtual Reality. We interviewed fourteen people working at different organizations, that develop IVT applications in the Nordic region. We used thematic analysis to derive themes from the interviews. The results showed an insufficient knowledge and application of HF in IVT development, due to the lack of awareness of both scope and significance of HF, resource allocation strategy, market inertia, stakeholder's (...) involvement, standardization of HF application and IVT uses, and technology maturity. This situation could be improved by allocating experts, adjusting organizational strategy to balance resource allocation, training developers and user organizations to raise awareness and to encourage co-creative design and knowledge sharing, create a sense of ownership amongst stakeholders, and ensure the usefulness of the technology to the user's work. This collection explores the subject of conflicts of interest. It investigates how to manage conflicts of interest, how they can affect well-meaning professionals, and how they can limit the effectiveness of corporate boards, undermine professional ethics, and corrupt expert opinion. Legal and policy responses are considered, some of which (e.g., disclosure) are shown to backfire and even fail. The results offer a sobering prognosis for professional ethics and for anyone who relies on professionals who have conflicts of interest. In this far-reaching essay, historian Michael Edward Moore examines modernity as an historical epoch following the end of the medieval period -- and as a "messianic concept of time." In the early twentieth century, a debate over the meaning and origins of modernity unfolded among the philosophers Ernst Cassirer, Hans-Georg Gadamer and Hans Blumenberg. These thinkers tried to resolve the puzzle of the fifteenth-century master Nicholas of Cusa. Was Cusanus the last great medieval thinker, his ideas a summa of (...) medieval tradition? Or was he a mysterious epochal figure, seated at one end of the bridge leading to modern thought? Nicholas of Cusa lived during a time of historical and existential crisis, or kairos, when medieval governments and cherished sources of unity were shaken. Likewise, the debate over his significance took place during a later phase of crisis for Europe, in the decades before and after the Second World War, when the collapse of European civilization was witnessed. Moore argues that modernity, so intently examined as an historical and spiritual problem, has significance for our contemporary sense of crisis. (shrink)

At that time, Kim also refrained from excluding distinct mental explanations of effects that depend upon complete physical explanations of the effect. More recently, he has excluded distinct mental causes of effects that depend upon the sufficient cause of the effect, since the physical cause is individually sufficient for the effect. But there has been, to this point, no parallel (...) shift in the explanatory realm, such that distinct mental explanations of effects that depend upon complete physical explanations of the effect are excluded since the physical explanation is objectively complete. In this paper I consider, defend, and apply this update to the principle of explanatory exclusion—an update, which, in the final analysis, demonstrates a significant advantage that non-reductive physicalism has over reductive physicalism.
