Cameron and Williamson have provided a provocative and timely review of the ethical questions prompted by the birth of Dolly. The question Cameron and Williamson seek to address is “In the world of Dolly, when does a human embryo acquire respect?”. Their initial discussion sets the scene by providing a valuable overview of attitudes towards the embryo, summarising various religious, scientific, and philosophical viewpoints. They then ask, “What has Dolly changed?” and identify five changes, the first being that fertilisation is (...) no longer required to create an embryo. Following this analysis they then ask when an embryo created other than by fertilisation begins to acquire respect. Ronald Preston wrote little of feminism, and feminism appears to have ignored Preston. There is much, however, in Preston's work which feminists would have found sympathetic, as well as some areas for acute disagreement. This article discusses what Preston did write about feminism, and goes on to examine areas of common approach: the hermeneutic of suspicion, social ethics, and a priori commitments. It also, briefly, discusses areas of disagreement: common consensus, universalism, and eschatological realism. In this review essay Stanton Wortham explores how philosophy of education should both turn inward, engaging with concepts and arguments developed in academic philosophy, and outward, encouraging educational publics to apply philosophical approaches to educational policy and practice. He develops his account with reference to two recent ambitious projects: The Oxford Handbook of Philosophy of Education, edited by Harvey Siegel, and the two-volume yearbook of the National Society for the Study of Education (NSSE), titled Why Do We Educate? edited (...) by Gary Fenstermacher (series editor), David Coulter and John Wiens (volume 1), and Mark Smylie (volume 2). These two projects initially appear to be opposed, with the Handbook emphasizing elite philosophy and the Yearbook emphasizing public engagement. Wortham argues that each project is in fact more complex, and that they are in some respects complementary. He concludes by making a case against a simple hierarchy of basic and applied knowledge and calling for a more heterogeneous philosophy of education. (shrink)

This paper discusses the results of the international applied research project ‘UniDiversity – Universities Towards Diversity’ that examined what discriminatory attitudes, beliefs and behaviours based on sexual orientation, gender identity and sex characteristics (SOGISC) exist in the Lithuanian, Greek and Italian academic environment. Specifically, this paper analyses how LGBTI+ individuals conceive of different forms of discrimination in the Lithuanian academic environment. The paper fills the knowledge gap in terms of intolerance and discrimination against LGBTI+ individuals at Lithuanian higher education institutions (...) and provides its theoretical explanation. By focusing on the empirical data collected from survey and focus group interviews, the paper interprets them within the framework of both the sociopolitical context and theoretical debates about heteronormative attitudes. The paper argues that there exists a gap between the declarative openness to LGBTI+ people within Lithuanian universities and persisting stereotypes and discriminatory attitudes towards them. Rapid advancement of technologies continues to revolutionize healthcare foundations and outlook. Technological progress in medicine are not only continuing to improve quality of individual life but also generally improving quality of healthcare services. As a matter of fact, the most significant change in healthcare systems was the shift from standardized, patronizing and rigid physician–patient relationship to more patient-focused, personalized and participatory practice. With this shift came increased attention to the assurance of patient’s right to autonomy. Therefore, this article aims to (...) discuss principal problematic aspects of patient’s right to autonomy hereby the patient’s role in the context of technologies and innovation. It is argued, that one of the effective ways to ensure patient’s right to autonomy is implementation of legal instruments, such as informed consent, advance directives and Ulysses contracts. However, this article also proposes, that with a potential of new technologies and artificial intelligence, these legal instruments need to be reconsidered and transformed in more efficient and eligible model, presenting information in more individualized, appealing and convenient manner. What is data? That question is the fundamental investigation of this dissertation. I have developed a methodology from social-scientific processes to explore how different people understand the concept of data, rather than to rely on my own philosophical intuitions or thought experiments about the “nature” of data. The evidence I have gathered as to different individuals' constructions of data can be used to inform further inquiry of data and the design of information systems. My research demonstrates that people have different (...) constructions of data. The methodology of the SDFN, created for this dissertation, has proven able to probe those understandings. The SDFN, loosely based on a DFD and combined with ideas from SNA, provides a way of discovering practical definitions of hard-to-operationalize terms like data. The process of repeatedly categorizing various items as data allows the methodology to explore how participants actually use the term, rather than relying on theoretical dictionary-based definitions. Analysis of the interviews found three different constructions of data: data as communications, a container for meaning; data as subjective observations, sense-impressions filtered by knowledge; and data as objective facts, measurements revealing the relationships of reality. This article illustrates one way in which philosophical inquiry and empirical research can be combined to illuminate processes like learning and social identification. Over the past 20 years, my empirical work in classrooms and communities has drawn on philosophical discussions about how knowledge is interconnected with social relationships and how we should conceptualize multiple levels of explanation. Both empirical research and philosophy can be done in various ways, and I offer no comprehensive account of how the two relate. I focus (...) instead on one central goal of my work—to clear away assumptions that commonly limit our view of human activity and to offer alternative conceptualizations that open new pathways for thought and action. In pursuing this goal I have drawn on philosophical accounts of knowledge, identity and scientific explanation, as well as on philosophical methods for interrogating assumptions. My empirical analyses also provide philosophers useful cases to think with. Empirical research enriched by philosophical insights and methods can combine tools from both traditions to clear away unproductive assumptions and advance our understandings of the human world. Article 14 Chapter I ‘The State of Lithuania’ of the Constitution of the Republic of Lithuania of 1992 reads as follows: ‘Lithuanian shall be the State language’. This principle is not new in the Lithuanian history of constitutionalization, as Lithuanian was the official language of the State in the interwar period but lost this status during the Soviet occupation. After 1988, when many political, economic and social changes crucial for further development of the State took place in Lithuania, linguistic issues (...) re-emerged. It was recognized back then that language played a vital role in the life of the State and the society, and the Lithuanian language was given back its status of the official language by the Constitution. The principle that Lithuanian is the official language of the State, enshrined in Article 14 of the Constitution of the Republic of Lithuania, was further elaborated by the Constitutional Court of the Republic of Lithuania in its rulings and judgments. According to its official constitutional doctrine, the Lithuanian language should be treated as a very specific constitutional value, as it forms the basis of the ethnic and cultural identity of the Lithuanian nation and is the guarantor of the national identity and survival. The status of Lithuanian as the official language means that the Lithuanian language must be used in all spheres of public life. The Court also holds that having this principle enshrined in Chapter I ‘The State of Lithuania’ of the Constitution implies that the Lithuanian language enjoys particular protection since the provisions of this Chapter may be amended only by a referendum. The Swiss Confederation is characterised by a long constitutional evolution that can be divided into several important periods: the Old Swiss Confederacy (13–14 C.), Helvetica (1798–1848), Mediation (1803–1814), Restoration (1815–1830), Regeneration (1830–1848) and development since 1874. It can be stated that Switzerland adopted a modern, democratic constitution early; this state is the oldest democratic republic in Europe. In 1874, many amendments to the effective Constitution were made and a lot of gaps in legal regulation came to light, which led to (...) the opinion that in order to remove those shortcomings, a few specific amendments were no longer sufficient; therefore, it was decided to make substantial changes to the Constitution. The new Constitution was approved by the people and the cantons in the referendum of 18 April 1999 and came into effect on 1 January 2000. The most significant features of this Constitution include the entrenchment of the principles of democracy, federalism, and of the state of law and social welfare. Pursuant to the principle of division of governmental powers, the governing of the state is carried out by the following federal institutions: the Federal Assembly, the Bundesrat and the Federal Court. While analysing constitutions of various countries in the legal literature, usually not only the form and the content but also the structure of the constitution is discussed. The structure of the constitution is an internal organisational order of the norms of the constitution. Although every state has a unique structure of their constitution, however, certain regularities can be discerned. The analysis of the structure of various constitutions leads to a conclusion that normally each constitution consists of the following standard structural (...) parts: the preamble, the main part, the final, transitional or additional provisions, in some constitutions there can also be annexes. The article ascertains that most of the constitutions begin with the introductory part, the preamble. Only the constitutions of several countries (e.g. Norway, the Netherlands, Belgium, Italy, Greece) contain no preamble. After analysing the preambles of the Lithuanian Constitutions adopted in 1918-1940, the Lithuanian Constitution of 1992, the Constitution of the United States of America of 1787, the Constitution of Federal Republic of Germany of 1949, and the constitutions of several Central and Eastern European countries (the Constitution of the Republic of Estonia of 1992, the Constitution of Czech Republic of 1992 and the Constitution of the Republic of Poland of 1997) it is stated that a preamble is considered as an inseparable part of an official text of a constitution. The preamble reflects the historical context and the circumstances of the adoption of a constitution, names the goals of the constitutional regulation, fortifies the values to be attained, declares the key political principles or even the fundamental human rights and freedoms, etc. Often the preamble reveals the methods of adoption of a constitution. The preamble is an important structural part of the constitution that helps to understand the established constitutional regulation. The principles enshrined in it can be considered as significant argument for the constitutional justice institutions while solving the case of whether the law or any other legal act in question contradicts with the constitution. While interpreting and applying the constitution as a single act, its separate sections, clauses or certain provisions it is necessary to take the content of the preamble into account, since no text of the constitution shall be interpreted in a way to contradict the statements of the preamble and its spirit. The preamble is not only a category of a political, ideological or philosophical nature, it undoubtedly has the legal burden, therefore it is considered to have legal validity. Constitutions usually do not contain any particular preamble amendment procedures. The preambles are characterised to have the so-called higher style; they are usually formulated not in compliance with the requirements of legal technique. Therefore, they differ from other constitutional provisions that are usually set out in official writing style according to certain rules of legal technique. (shrink)

According to situated cognition theory, cognitive accomplishments rely in part on structures and processes outside the individual. This article argues that interactional structures—particularly those created through language use—can make essential contributions to situated cognition in rational academic discourse. Most cognitive accomplishments rely in part on language, and language in use always has both representational and interactional functions. The article analyzes one classroom conversation, in order to illustrate how the interactional functions of speech can facilitate the cognitive accomplishments speakers make through (...) that speech. By showing how closely cognition and interaction can interrelate, the article both supports theories of situated cognition and shows how cognition in at least some educational contexts cannot be extricated from enduring social structures and the construction of social identity. This paper explores the transformation of Twitter from the traditional developer based command and control into something strangely democratic: a social construction of utility, a twisting of this once unique service to serve the needs and desires, ever evolving, of its users. We explore changes in the social constructions of Twitter and use recent research in the Philosophy of Data to suggest potential explanations.

This paper explores recent research done into the philosophy of data. The research utilizes experimental philosophy ideas combined with Information Technology methodologies to assess participants' philosophies of data. Reusing the concept of the Data Flow Diagram, I suggest a methodology of experimental philosophy that allows participants to categorize flows into data, information, and knowledge in order to explore their practical understanding instead of their theoretical understanding. My research has found three distinct philosophies: "data as bits" "data as hard numbers," and (...) "data as recorded observations. (shrink)

In this document, we explore the Philosophy of Data and its roots amongst other disciplines. The Philosophy of Data seeks to understand the nature of data through experimental philosophy. In order to understand the many different ontologies of data, information, and knowledge out there, this paper will describe part of the problem space in terms of other disciplines and make an argument for the establishment of this new philosophical field. Social psychologists have been in the forefront of the development of modern theories of cigarette smoking and obesity. These theories are reductionist: they account for behavior in purely physiological terms and regard cognitive, value, personality, and social class factors as secondary or irrelevant. Yet, from their beginnings, these theories have failed to account for major aspects of the behaviors under investigation, aspects apparently related to personal intention and social background. While it may seem suprising that work by social psychologists denies (...) social and psychological reality, the theories discussed here actually reflect broader trends in social psychology, trends with rather large implications for our ideas about individual and social efforts at change. We explore the implications of a hierarchical structure, consisting of the higher order dimensions of nonspecific Positive Activation and Negative Activation and multiple specific negative affects and positive affects at the lower level. Emotional blends of the same valence are an essential part of this structure and form the basis of the higher order Negative and Positive Activation dimensions. Mixed cross-valence emotions are not central to this hierarchical scheme but are compatible with it. We examine the frequency of pure emotional (...) states, same-valence emotional blends, and cross-valence mixed emotions in a large momentary mood sample. (shrink)

An introduction to the special issue on Hobbes and Locke: Meaning, Method, Modernity.

Locke refrained from engaging explicitly with Hobbes in any of his writings. Locke’s policy of non-engagement should be interpreted, we argue, neither as evidence of his lack of interest in (or ignorance of) Hobbes’s arguments, nor as an attempt to conceal from the uninitiated Locke’s covert Hobbesian commitments. Locke’s silence reveals rather than conceals. What it reveals is an absolute determination to “distinguish between the business of civil government and that of religion, and to mark the true bounds between them”. (...) Approached in this way, precisely because Locke’s account of the “business of civil government” says nothing about ecclesiastical government, the second of Two Treatises can be read, in its entirety, as a powerful critical response to Hobbes. To see why, it is necessary to grasp that Part iii of Leviathan (“Of a Christian Common-wealth”) is integral to Hobbes’s positive argumentative purposes in the work. (shrink)

Neuromarketing is an emerging field in which academic and industry research scientists employ neuroscience techniques to study marketing practices and consumer behavior. The use of neuroscience techniques, it is argued, facilitates a more direct understanding of how brain states and other physiological mechanisms are related to consumer behavior and decision making. Herein, we will articulate common ethical concerns with neuromarketing as currently practiced, focusing on the potential risks to consumers and the ethical decisions faced by companies. We argue that the (...) most frequently raised concerns—threats to consumer autonomy, privacy, and control—do not rise to meaningful ethical issues given the current capabilities and implementation of neuromarketing research. But, we identify how potentially serious ethical issues may emerge from neuromarketing research practices in industry, which are largely proprietary and opaque. We identify steps that can mitigate associated ethical risks and thus reduce the threats to consumers. We conclude that neuromarketing has clear potential for positive impact on society and consumers, a fact rarely considered in the discussion on the ethics of neuromarketing. (shrink)
