Le respect de la vie privée et de l’intimité est un droit reconnu aux usagers des services de santé et des services sociaux par différents codes d’éthique, par la Charte des droits et libertés de la personne du Québec et par la Loi sur les services de santé et les services sociaux. Pour autant, la signification que prend ce droit demeure incertaine. Il n’y a pas une signification, mais bien des significations. S’appuyant sur un important travail d’observation dans deux comités (...) d’éthique clinique situés dans des établissements de santé et de services sociaux, les auteurs présentent et analysent ici un certain nombre de situations litigieuses dans lesquelles une interprétation du droit à la vie privée et à l’intimité a été faite. Au terme de l’exercice, il ressort entre autres que, selon les situations analysées, les discussions qui se font dans les CÉC conduisent à des modalités différentes (« déplacement et hiérarchisation », « opposition et évitement », « ouverture et compromis », « élargissement et remise en question ») qui ont pour effet de changer le regard porté sur l’usager et plus spécifiquement de faire comprendre son point de vue. En outre, si le droit à la vie privée et à l’intimité contribue à modifier l’interprétation que l’on se fait d’une situation ou des usagers, il est lui-même objet d’interprétation. C’est la diversité de sens qu’il peut prendre qui lui préserve son pouvoir d’interroger. (shrink)

Québec's complaint examination system has devoted considerable effort to supporting dissatisfied users who may wish to register complaints. It is open to question, however, whether this level of effort has, in fact, aided users in filing their complaints, and whether, once filed, the intake and processing of complaints has been rigorous and fair. Has the intake and handling of complaints at least improved? This is the question we shall attempt to answer here by presenting the results of our study concerning (...) the impact of the Complaint Assistance and Support Centers (CAAPs) on the intake of complaints. The results show that the Québec complaint examination system and its Complaint Assistance and Support Centers help make complaints more admissible and ensure that each complaint is examined. However, the system is also hindered by differences and conflicting interpretations among the various stakeholders regarding the legitimacy of complaints, respect for users’ rights, and the mission of the system. Although complaint examination systems seek to encourage users to express their points of view, users’ voices are still only partly audible. (shrink)

Moral distress is an experience of profound moral compromise with deeply impactful and potentially long‐term consequences to the individual. Critical care areas are fraught with ethical issues, and end‐of‐life care has been associated with numerous incidences of moral distress among nurses. One such area where the dichotomy of life and death seems to be at its sharpest is in the pediatric intensive care unit. The purpose of this study was to understand the moral distress experiences of pediatric intensive care nurses (...) when caring for pediatric patients at the end of life. A secondary analysis was undertaken of seven transcripts from registered nurses across six Canadian pediatric intensive care units and produced three themes: under prioritization of child patient dignity, burden of insider knowledge, and environmental constraints on nursing roles and responsibilities. When caring for patients at the end of life, nurses experienced moral distress when a dignified death was not realized. Furthermore, despite interprofessional collaboration efforts in Canada, the concept of silo mentality persists and contributes to moral distress. Organizational involvement is needed to address moral distress in pediatric intensive care nurses both to achieve a dignified death for child patients and in addressing silo mentality. (shrink)

Residents’ councils in Quebec’s residential and long-term care centres have the mandate to promote the improvement of living conditions for residents, to assess their level of satisfaction, and to defend their rights. Based on two studies on the autonomy of councils, we examined how committees can express themselves on topics other than those the management is already aware of, to reveal various previously unknown aspects of the services, and to voice unexpressed concerns. We are especially interested in what makes management (...) receptive, or not, to what the committee members say. The councils’ ability to express them selves is, in fact, inseparable from its capacity to listen to the management teams, and we seek to determine the conditions required to perform this dual capacity. I present first the challenge for epistemology when it faces the dilemma between rationalism and empiricism, followed by a presentation of the ideas introduced by Ruyer in order to ask if they can be articulated to the "third way" in epistemology. I explore the consequences of Ruyer's inversion of our understanding of space which can be looked upon as psychic. I consider Ruyer's refusal to locate in pure immanence the scheme of eupraxic resolution of successful aggregates–as living forms–in our experience. (...) I then highlight the major principles of Gaston Bachelard's and Michel Serres's respective epistemologies, and in a lesser measure those of Bergon and Deleuze as well, in order to underscore Ruyer's refusal to limit philosophy to what science allows one to say, but also in order to finally situate the verticalism of his position. Based on our respective research programs (psychiatry, forensic psychiatry, public health, HIV/AIDS, harm reduction) this article aims to use purposely non‐conventional means to present the substantial contribution of poststructuralist perspectives to knowledge development in nursing science in general and in our current research in particular. More specifically, we call on the work of Michel Foucault and Deleuze & Guattari to politicize nursing science using examples from our empirical research programs with marginal and often highly marginalized populations. The global response to managing the spread of HIV has recently undergone a significant shift with the advent of ‘treatment as prevention’, a strategy which presumes that scaling-up testing and treatment for people living with HIV will produce a broader preventative benefit. Treatment as prevention includes an array of diagnostic, technological and policy developments that are creating new understandings of how HIV circulates in bodies and spaces. Drawing on the work of Michel Foucault, we contextualize these developments by linking them (...) to systems of governance and discursive subjectivation. The goal of this article is to problematize the growing importance of viral suppression in the management of HIV and the use of related surveillance technologies. For people living with HIV, we demonstrate how treatment-as-prevention’s emphasis on individual and collective viral load is transforming the performative dimensions of embodied risk, affect, subjectivity and sex. Radical democratic thinking is becoming intrigued by the material situatedness of its political agents and by the role of nonhuman participants in political interaction. At stake here is the displacement of narrow anthropocentrism that currently guides democratic theory and practice, and its repositioning into what we call ‘the nonhuman condition’. This Critical Exchange explores the nonhuman condition. It asks: What are the implications of decentering the human subject via a new materialist reading of radical democracy? Does this reading dilute political (...) agency? Or should this be seen, on the contrary, as an invitation for new voices and demands to enter into democratic assemblages? How might engagement with the more-than-human disrupt or extend theories of radical democracy? Hans Asenbaum and Amanda Machin discuss the human democratic subject both through radical democratic and new materialist lenses. They suggest that a new materialist decentred subject does not lose agency but further gains political responsibility in radical democracy. Jean-Paul Gagnon highlights the possibility of becoming through loss. In losing our anthropocentric arrogance—our understanding of being other and better than animal—we become more connected and discover our place in human-nonhuman assemblages. Melissa Orlie agrees that something can be gained through renouncing dominant human fantasies and presents a ‘radical democratic naturalism’. By renouncing land violence and acknowledging nature’s subjectivity, we can further nonexploitative radical democratic politics. This is where the notion of ‘tidalectic’ processes introduced by James L. Smith is helpful. Focusing on water and the Indigenous knowledges around rivers, he considers how democracy and community can be reimagined as plural, cyclical and attentive to the nonhuman with which the human is inevitably entangled. Diana Leong offers a different approach. Considering the nonhuman from the perspective of Black Studies demands an awareness to how blackness has long been constituted as non- or partially human. The concept of democracy is fraught with ambiguity. There are none who know what democracy means, where it came from or indeed where it is going despite it being the system of governance that is most widely heralded for its modernity and promotion of equality. For example, the theory and principles that underpin democracy are unimaginably complicated while its institutions across time and space are contradictory. Que peut nous révéler la phénoménologie au sujet de cette notion centrale pour les sociétés occidentales développées? C'est ce que ce livre propose d'explorer.

This paper investigates the degree to which information theory, and the derived uses that make it work as a metaphor of our age, can be helpful in thinking about God’s immanence and transcendance. We ask when it is possible to say that a consciousness has to be behind the information we encounter. If God is to be thought about as a communicator of information, we need to ask whether a communication system has to pre-exist to the divine and impose itself (...) to God. If we want God to be Creator, and not someone who would work like a human being, ‘creating’ will mean sustaining in being as much the channel, the material system, as the message. Is information control? It seems that God’s actions are not going to be informational control of everything. To clarify the issue, we attempt to distinguish two kinds of ‘genialities’ in nature, as a way to evaluate the likelihood of God from nature. We investigate concepts and images of God, in terms of the history of ideas but also in terms of philosophical theology, metaphysics, and religious ontology. (shrink)

Transhumanism is a means of advocating a re-engineering of conditions that surround human existence at both ends. The problem set before us in this chapter is to inquire into what determined its appearance, in particular in the humanism it seeks to overcome. We look at the spirit of overcoming itself, and the impatience with the Self, in order to try to understand why it seeks a saving power in technology. We then consider how the evolutionary account of the production of (...) organisms does not set them against a perfect standard, but rather injects in them a contingency that seems to be near to the heart of the problem. We then try to assess the objective basis for improvements and manipulation of nature, and although we do not find it forbidden on all occasions, it seems that the criteria for such alterations are impossible to detach from a form of eugenics. We finally open a window toward a theological account of the problem, and find that the desire of autonomy and independence is inevitably going to be challenged by the Christian dogma of creation. In his oft-cited book Descartes' Error, Antonio Damasio claims that Descartes is responsible for having stifled the development of modern neurobiological science, in particular as regards the objective study of the physical and physiological bases for emotive and socially-conditioned cognition. Most of Damasio’s book would stand without reference to Descartes, so it is intriguing to ask why he launched this attack. What seems to fuel such claims is a desire for a more holistic understanding of the mind, the brain and (...) the self. For Descartes however, here allowed to answer back, the question of accounting for the whole diversity of human potential experiences was what could not be left out of sight. Concerning the question of his neglect of the mind said to be "abysmally" detached from the body, it is claimed here that, in the light of Descartes' move which was to break with the scholastic practice of putting more and more things under the control of the soul, the program of using the reality of embodiment to understand the mind was one he actually started. An answer is also suggested to counter the charge that Descartes failed to account for the interaction of the two substances, the mind and the material body, by showing why and how Descartes actually believed in the substantial union of mind and body. Yet, he kept in the picture an ingenium, a faculty of pure understanding overarching a cybernetic model of the body-mind, of which we also here seek to appreciate the significance. This project of accounting for the mind-body interaction ended-up in a study the "passions," as emotions were then called. (shrink)

This paper evaluates the claim that it is possible to use nature’s variation in conjunction with retention and selection on the one hand, and the absence of ultimate groundedness of hypotheses generated by the human mind as it knows on the other hand, to discard the ascription of ultimate certainty to the rationality of human conjectures in the cognitive realm. This leads to an evaluation of the further assumption that successful hypotheses with specific applications, in other words heuristics, seem to (...) have a firm footing because they were useful in another context. I argue that usefulness evaluated through adaptation misconstrues the search for truth, and that it is possible to generate talk of randomness by neglecting aspects of a system’s insertion into a larger situation. The framing of the problem in terms of the elimination of unfit hypotheses is found to be unsatisfying. It is suggested that theories exist in a dimension where they can be kept alive rather than dying as phenotypes do. The proposal that the subconscious could suggest random variations is found to be a category mistake. A final appeal to phenomenology shows that this proposal is orphan in the history of epistemology, not in virtue of its being a remarkable find, but rather because it is ill-conceived. (shrink)

Dans les débats contemporains sur la justice, la vulnérabilité est porteuse d’un puissant contenu normatif et pratique. Elle offre des descriptions riches des expériences humaines prenant en considération des relations complexes et ambivalentes qui sont tues sous la seule norme de l’individualisme libéral. Il ne s’agit pas de rejeter l’importance d’une vie autonome, mais de repenser les cadres normatifs qui lui donnent un sens et de revoir les moyens de l’atteindre. La vulnérabilité, bien qu’elle se manifeste comme un idéal normatif (...) fort, révélateur de changements conceptuels et pratiques, n’est toutefois pas un concept univoque. Les chapitres qui composent cet ouvrage illustrent la diversité des significations et des contextes de vie auxquels renvoie la vulnérabilité. Faut-il s’en surprendre? Non, si l’on prend en compte que son usage comme idée phare de la théorie politique est encore récent, et qu’à ce titre sa signification et sa pratique sont encore l’objet de débats. (shrink)

Philosophical suspicions about the place of shame in the psychology of the mature moral agent are in tension with the commonplace assumption that to call a person shameless purports to mark a fault, arguably a moral fault. I shift philosophical suspicions away from shame and toward its absence in the shameless by focusing attention on phenomena of shamelessness. In redirecting our attention, I clarify the nature of the failing to which ascriptions of shamelessness might refer and defend the thought that, (...) as an evasion of moral self-censure, shamelessness can be morally pernicious. Far from foregoing shame, I conclude, we should be mindful of its moral importance and unapologetic in its defense. (shrink)

There is a tendency to take mounted dinosaur skeletons at face value, as the raw data on which the science of paleontology is founded. But the truth is that mounted dinosaur skeletons are substantially intention-dependent—they are artifacts. More importantly, I argue, they are also substantially imagination-dependent: their production is substantially causally reliant on preparators’ creative imaginations, and their proper reception is predicated on audiences’ recreative imaginations. My main goal here is to show that dinosaur skeletal mounts are plausible candidates for (...) art-status. But, what is more, I think they are artworks—specifically, sculptures. (shrink)

It in particular covers Russell and Moore’s different approaches to essence before and after breaking with British idealism, the (pre- and post-)logical positivists’ critique of metaphysics and rejection of essence (Wittgenstein, Carnap, Schlick, Stebbing), the tendency to loosen the notion of logical necessity (...) to accommodate certain metaphysical truths in Wittgenstein and others, Quine’s logical rehabilitation of metaphysics and criticism of de re modality, the modal view of essence promoted by the development of quantified modal logic (C. I. Lewis, Barcan Marcus, Kripke) and direct reference theory (Barcan Marcus, Kripke, Putnam), and the emergence of the notion of metaphysical necessity (Kneale, Kripke), and finally Fine’s re-establishment of a Neo-Aristotelian, hyperintensional notion of essence in contemporary metaphysics. Philosophers disagree about what the folk concept of pain is. This paper criticises existing theories of the folk concept of pain, i.e. the mental view, the bodily view, and the recently proposed polyeidic view. It puts forward an alternative proposal – the polysemy view – according to which pain terms like “sore,” “ache” and “hurt” are polysemous, where one sense refers to a mental state and another a bodily state, and the type of polysemy at issue reflects two distinct but (...) related concepts of pain. Implications with respect to issues in philosophy of pain are also drawn. (shrink)
