La couverture allemande dans le Welt plutôt conservateur, dans le Süddeutsche Zeitung libéral et dans le quotidien économique Handelsblatt du référendum français sur la Constitution européenne est analysée entre le 25 mai et le 4 juin 2005. Dans la couverture de ces trois quotidiens, dominent les ténors de la politique tandis que la voix du peuple n'apparaît qu'à travers la publication des sondages. Les articles se fondent sur des dépêches d'agences de presse et des médias français. Des rapports de correspondants (...) sont l'exception. Cette base d'informations conduit à une perte de réalité du contenu dans la couverture allemande parce que le point de vue de l'élite politique y est repris et que les peurs des citoyens en ce qui concerne les conséquences de l'intégration européenne y sont négligées.Coverage in the German Welt rather conservative in the liberal Süddeutsche Zeitung and Handelsblatt business daily in the French referendum on the European Constitution is analyzed between May 25 and June 4, 2005. Coverage in three newspapers, dominate the political tenor while the people's voice appears only through the publication of opinion polls. The articles are based on dispatches of news agencies and the French media. Corresponding reports are the exception. This information base leads to a loss of reality contained in the German coverage because the point of view of the political elite is over and that the fears of citizens regarding the implications of European integration are neglected. La 4e de couverture indique : "Avec l'accélération de la mondialisation, une opinion qui aurait, jusqu'il y a peu, été taxée d'incongruité, semble avoir gagné le statut d'évidence : le système étatique mondial serait menacé et appellerait à une profonde redéfinition des attributs, des structures et du rôle traditionnellement dévolus aux Etats. Dans l’opinion publique, la mondialisation a ouvert les vannes de l’immigration internationale, les migrants circulant désormais aussi facilement que les capitaux et les marchandises. En phase avec cette représentation relevant du sens commun, le domaine de la migration internationale tend à subir l’influence des théories de la mobilité qui jouissent d’un véritable effet de mode. Cette pensée emprunte à des courants d’idées privilégiant l’effacement des frontières. Le concept de « mobilité » repose sur deux visions contradictoires. La première suppose que (...) les populations se déplacent à travers les frontières pour vendre et négocier leurs « capital social », là où les avantages économiques et sociaux sont les plus grands. La seconde considère que les obstacles à la mobilité sont la cause de nouvelles inégalités et de nouvelles hiérarchies dans le système mondial. Critiques de ces visions, certains spécialistes de l’immigration internationale estiment que les facteurs historico-structurels à l’œuvre dans les pays d’émigration et d’immigration ont une plus grande pertinence explicative que le recours à la question de la circulation. What should the EU do about the fact that some Member States are backsliding on their commitments to democracy, supposedly a fundamental value of the EU? The Treaty provisions under Article 7 TEU are widely criticized for being ineffective in preventing such developments. Are they legitimate? I argue that the ultimate sanction of Article 7 TEU falls into a performative contradiction, which undermines its ability to coherently defend fundamental values. Instead, expulsion from the EU is the appropriate, coherent and legitimate (...) final political sanction for democratic and rule of law backsliding by a Member State. The argument has the following steps: In Part 1, I argue that the current Article 7 framework for responding to democratic and rule of law backsliding in the EU is normatively problematic, in that the mechanism currently in the Treaty undermines the values it purports to defend; in other words, it falls into a performative contradiction. It is undemocratic to deprive Member States of their right to vote in the Council while holding them subject to Council decisions. However, Part 2 studies relevant philosophical arguments from an adjacent literature on criminal disenfranchisement, concluding that allowing backsliding Member States to keep their voting rights in the Council _also_ taints the democratic character of Council decision-making. In Part 3, I consider the resulting paradox in light of the literature on militant democracy. Could militant democracy justify Article 7? I argue not; even if we accept the hypothetical justifiability of militant measures, they are not legitimate here since a democratically acceptable alternative exists that would safeguard the democratic character and legitimacy of Council decision-making: expulsion from the Union. I also address a central objection to an expulsion mechanism—that it would require treaty change and is therefore practically impossible. (shrink)

This paper critically engages the legal and political framework for responding to democracy and rule of law backsliding in the EU. I develop a new and original critique of Article 7 TEU based on it being democratically illegitimate and normatively incoherent qua itself in conflict with EU fundamental values. Other more incremental and scaleable responses are desirable, and the paper moves on to assess the legitimacy of economic sanctions such as tying access to EU funds to performance on democratic and (...) rule of law indicators or imposing fines on backsliding states. I hold such sanctions to be a priori legitimate, and argue that in some cases economic sanctions are even normatively required, given that EU material support of backsliding member states can amount to material complicity in their backsliding. However, an economic conditionality mechanism would need to be designed to minimize unjust and counterproductive effects. One way to pursue this could be to complement sanctions against the backsliding government with investment for prodemocratic actors in that state. (shrink)

This chapter describes a philosophical approach to theorizing justice, mapping out some main strands of the tradition leading up to contemporary political philosophy. We first briefly discuss what distinguishes a philosophical approach to justice from other possible approaches to justice, by explaining the normative focus of philosophical theories of justice – that is, a focus on questions not about how things actually are, but about how things ought to be. Next, we explain what sorts of methods philosophers use to justify (...) theories of justice. Following this, in the longest section, we highlight major questions about justice that have drawn the attention of philosophers, and indicate how competing conceptions of justice have arisen from differing answers to these questions. The goal here is not to answer but to elucidate some of the larger questions about justice, as well as to establish a framework for understanding and distinguishing different kinds of claims about justice and some of the relations between them. This chapter describes how philosophical theorizing about justice can be connected with empirical research in the social sciences. We begin by drawing on some received distinctions between ideal and non-ideal approaches to theorizing justice along several different dimensions, showing how non-ideal approaches are needed to address normative aspects of real-world problems and to provide practical guidance. We argue that there are advantages to a transitional approach to justice focusing on manifest injustices, including the fact that it enables us to set (...) aside some reasonable disagreements about justice. The ‘bottom-up’ approach we advocate, for which we borrow Wolff’s term ‘real-world political philosophy’, is an empirically-informed normative analysis that attends to specific, identifiable injustices, and thus is partial, though not isolationist. We illustrate our approach by considering how different models of the nature of disability suggest different kinds of remedy for injustices faced by persons living with disabilities. We reflect on the nature and significance of vulnerabilities, and we assess the role of public opinion in normative theorizing, suggesting a particular significance for the opinions and experiences of marginalized groups. We finally reflect on the relevance of European legal and institutional frameworks for theorizing justice in Europe. (shrink)

Next SectionObjectives A statute enacted in 2005 modified the legislative framework of the rights of terminally ill persons in France. Ten years after the EURONIC study, which described the self-reported practices of neonatal caregivers towards ethical decision-making, a new study was conducted to assess the impact of the new law in neonatal intensive care units (NICU) and compare the results reported by EURONIC with current practices. Setting and design The study was carried out in the same two NICU as in (...) the EURONIC qualitative study. A third centre was added to increase the sample size. From February to October 2007, 19 physicians and 17 nurses participated in semistructured interviews very similar to those for EURONIC. Content analysis identified the recurring themes emerging from the interviews. Results Compared with the EURONIC results, the caregivers reported that they pay greater attention to the views of parents and provided respectful support to the neonates when life-sustaining treatment is withdrawn. Active termination of life has become exceptional. The possibility of withdrawal of treatment, the administration of sedatives to control pain even at the risk of hastening death, the emphasis on sparing parents the burden of decision, and the relative ignorance of the law were very similar to the EURONIC findings. Conclusion Both the medical and the legal regulation of practices has allowed more dialogue with the parents and more humane care for dying newborns. A new European study is necessary to investigate the possible changes in practices and attitudes also in other countries. (shrink)

This article defends three basic premises. First, the same conditions and forces favorable to revolution may serve to impede efforts at post-revolutionary consolidation. Second, one can assess prospects for consolidation based on the capacity of prospective hegemonic parties to achieve several interrelated objectives: developing a shared worldview among disparate segments of the population, delivering social and economic goods, and establishing order. Third, while democratization is a home-grown process, it may require particular forms of limited intervention to offset anti-democratic forces. The argument that sectarian conflicts in the Arab Middle East have been persistent since time immemorial is erroneous. While these views may seem compelling with the rise of ISIL, they are in fact very dangerous: they downgrade Islamic societies to primordial, selective and static features. I will argue for a different set of propositions. First, violence is not unique to Islamic societies. Extreme illiberal ideologies prevailed in Christian Europe both during the Thirty Years War and during the fascist interwar period. (...) Second, Islamist belligerence was partly a response to the ill-effects of globalization, just as European fascist movements were exacerbated by the advance of industrial capitalism in Europe. Third, post-Second World War human rights efforts may inform new paths beyond the tragedies that continue to plague the Middle East. (shrink)

In three experiments involving 104 children and 86 adults we investigated the extent to which harm brought about by physical contact is judged to be worse than harm caused by impersonal, no-contact actions. In Experiment 1, Italian monolingual children aged 4 to 6 were asked to indicate whether they would prioritize saving five persons through contact over saving three persons without contact with both courses of action involving harm to a single victim. A preference for saving more persons did not (...) emerge until the age of 6 years. By contrast, in Experiment 2, children with a Slovenian-Italian linguistic and cultural background judged that to save five with contact was preferable even at the age of 4 and 5 years. In Experiment 3, Slovenian-Italian adults were also significantly more likely than Italian-only speakers to advocate using contact, although in a direct comparison, both groups prioritized saving five over three persons, regardless of the means. Moral diversity is discussed in terms of cultural and linguistic constraints that may serve to mediate the use of considerations of contact in an intuitive moral psychology. (shrink)

Résumé Les textes auxquels on se réfère ici émanent tous de sociétés qui, en dépit des différences culturelles, ont en commun la croyance que la mort n’est jamais sans lendemain (exemples pris de contes d’Europe, de la Méditerranée et du Maghreb). Le héros/l’héroïne agissent en vertu d’une loi ancestrale : le devoir de respect à l’égard du corps du défunt. Les contes semblent vouloir établir une continuité et suggérer la relation d’interdépendance entre les vivants et les morts.

The article aims to contribute to a wider knowledge of the Hilâl epic, a masterwork of popular Arabic literature that tells the story of a nomadic pastoral people from the Arabian deserts. The focus is on the ‘Taghrîba’ cycle, which relates the migration in the 11th century of these Sons of Hilâl to Ifrîqiyya, present-day Tunisia. In this context reference is made to the political act of the Fatimid power that launched the Hilalians on the conquest of Ifrîqiyya, as well (...) as to historians’ and linguists’ perception of it. But interest is centred more on the texts, which are copiously quoted, their poetic quality and their message – the expression of a tribal humanism, composed of grandeur and human dignity, particular to those desert people. In Malta and Southern Italy, legends centred on the prestigious figure of the Sibyl are still known by the older people. In Majorca, the prophetic song attributed to the Greek Sibyl, Erythrea, is still sung on Christmas eve in the monastery-sanctuary of Lluc. This paper focuses on the history of this prophetic song since its adoption by the medieval Church and on its surviving tradition in certain areas of Catalan culture – a fabulous example of cultural continuity.

A dramatic image of death is reflected from a cycle of folktales (Aarne-Thompson Types 505 to 508) in which a man dying in debt is refused burial, until the hero of the tale pays the ransom and fulfills the ancestral funeral ritual. Then the tale may develop into a further sequence centred on the Grateful Dead. The texts alluded to here come from both Northern Europe and the Mediterranean area, and from ancient and modern tales.

While the epic is absent from classical Arabic literature, the genre - although long ignored - plays an outstanding part in popular culture throughout the Arabo-Islamic sphere.

Curiosity is a personality trait that is inversely related to depression and positively related to subjective wellbeing. However, the relationship between curiosity and these two outcomes is still unclear which hampers our general understanding of well-being. Based on research within positive psychology that showed character strengths such as curiosity can indirectly decrease depression, we hypothesized that the inverse relationship between curiosity and depression would be mediated by subjective well-being. Two hundred and fifty seven participants, between 18 and 64 years old (...) completed a web-based survey comprising: The Curiosity and Exploration Inventory - II, Center for Epidemiological Studies - Depression and the Steen Happiness Index. We found that well-being mediated the relationship between curiosity and depression. The results indicate that curious individuals tend to report higher levels of subjective well-being which, in turn, is associated with lower levels of depression. Our findings contribute to the understanding of positive results obtained from clinical samples that underwent positive psychotherapy of depression. (shrink)

Oases have served as sacred landscapes and sources of ritual plants in arid regions of the Old and New Worlds. We evaluate the Jesuit mission oases of the Baja California peninsula for their role in agrobiodiversity persistence, and extend theories of sacred landscapes and biodiversity conservation to agricultural species and practices. Jesuit missionaries on the peninsula introduced a suite of crops species and agricultural and water management systems that persist in the oases and have become an integral part of the (...) cultural and religious identity of the peninsula. The sacred landscapes of the oases are defined by elements of the Jesuit mission systems, such as water capture systems and irrigation canals, stone field borders and terraces, field gardens or huertas, groves of olive trees and date palms, and multi-tiered agroecosystems. Sacred practices—including pilgrimages, religious rites, and Catholic-based community celebrations—depend on the integrated “landscapes” of the oases and on the ritual use of wild and cultivated oasis plant species. We propose that some, though not all, of the peninsula oases may be considered as sacred landscapes responsible for maintaining heritage crop species, biodiversity, and traditional farming and foodways practices. In a recent article published in this journal (van Deemter, Gatt, van der Sluis, & Power, 2012), the authors criticize the Incremental Algorithm (a well-known algorithm for the generation of referring expressions due to Dale & Reiter, 1995, also in this journal) because of its strong reliance on a pre-determined, domain-dependent Preference Order. The authors argue that there are potentially many different Preference Orders that could be considered, while often no evidence is available to determine which is a good one. (...) In this brief note, however, we suggest (based on a learning curve experiment) that finding a Preference Order for a new domain may not be so difficult after all, as long as one has access to a handful of human-produced descriptions collected in a semantically transparent way. We argue that this is due to the fact that it is both more important and less difficult to get a good ordering of the head than of the tail of a Preference Order. (shrink)
