The scientific evidence and understanding underpinning societal responsibility for the accelerating pace of climate change has become increasingly strong over the past hundred years. Although many nations have begun to take actions that have the potential to eventually slow the pace of change, contention over the issue continues in the United States, particularly in the nation's capital. A major cause appears to arise from different interpretations of the evidence arising from different perspectives on the issue, including those of the scientific, (...) environmental, fossil-fuel generating, technological, economic and ethical communities. In addition, the public encounters a cacophony of intermixed perspectives from the media and elected officials. While each perspective provides some useful insights, each alone contributes to inhibiting development of the national political consensus needed to responsibly address climate change. Without leadership that balances and reconciles competing perspectives, it is unlikely that a sufficient limiting of emissions will be enacted to prevent significant changes in climate that will impose increasing challenges for those in both developing and developed nations. Perelman’s view of the role of persons in argument is one of the most distinctive features of his break with Cartesian assumptions about reasoning. Whereas the rationalist paradigm sought to minimize or eliminate personal considerations by dismissing them as distracting and irrelevant, Perelman insists that argumentation inevitably does and ought to place stress on the specific persons engaged in an argument and that the relationship between speaker and what is spoken is always relevant and important. In taking this position, Perelman (...) implicitly revives the classical conception of proof by character (ethos or “ethotic” argument), but despite an extended discussion of act and person in argument, The New Rhetoric does not give much consideration to the classical concept and confuses differing approaches to it within the tradition. The result is that Perelman treats the role of the speaker in argument only by reference to abstract techniques and does not recognize the importance of examining particular cases in order to thicken understanding of how ethotic argument works in the complex, situated context of its actual use. Consequently, Perelman’s account of the role of persons in argument should be supplement by reference to case studies, and to that end, I consider ethotic argument in W.E.B. Du Bois’ famous essay “Of Mr. Booker T. Washington and Others”. (shrink)

In her new memoir, The Education of an Idealist, Samantha Power reflects on her eight years in the Obama administration. Although she claims that the experience did little to change her views, there is a considerable disjuncture between her point of view in her award-winning earlier book “A Problem from Hell,” in which she criticizes U.S. officials for not doing the right thing, and her point of view in The Education of an Idealist, in which she defends indifference of U.S. (...) officials under somewhat similar circumstances during the Obama years. The author of Problem could not have written Education, and the author of Education could not have written Problem. What does this tell us about the possibility for ethics in foreign policy? It offers a robust encounter with major figures and questions, providing historical recovery as well as critical and constructive engagement. That said, depth can work against breadth, with essays like Oliver O'Donovan's demanding a familiarity with Augustine Confessions that will send the reader back to his or her bookcases. Missing too are other notable figures and topics, such as the Protestant Reformers, Christian mystics, and feminist ethicists. Nevertheless, these gaps do not diminish the volume as a whole. I found myself again and again excited by the insights offered by the contributors, unsettling easy assumptions regarding the relation between eudaimonia and love, illustrating the depths of accounts of friendship for thinking about polity and mediating institutions, and cautioning against overconfidence in sexual ethics as its boundaries destabilize.Love and Christian Ethics would benefit scholars, teachers, and students alike. Its broad engagement with contemporary scholarship on love makes it a useful starting point for any researcher dipping or diving into this field. Progressive taxation has historically been discussed primarily in the context of developed, Western nations. This Article considers its application in two developing, nonwestern economies, emphasizing the differences in political, economic, and cultural contexts and their effect on the progressivity equation. In India these differences include long-standing attitudes, such as the Hindu tradition’s historic ambivalence towards utilitarian arguments, and shorter-term institutional arrangements, such as the division of power within India’s federal system and the tax exemption for agricultural income. In China they (...) include the legacy of Marxism as well as a more long-standing tendency to resolve legal and policy issues based on notions of communal rather than individual welfare. Both countries have limited administrative resources and a relatively small middle class, so that the income tax remains a relatively small albeit growing source of national revenues. In this Article I consider the impact of these factors, and conclude by asking whether a similar "tax life cycle" will apply to both countries or political and cultural differences will result in divergent tax patterns. Furthermore I also evaluate the progressivity problem as a case study in comparative taxation and assess the need to develop a more sophisticated methodology for dealing with institutional, attitudinal, and other cultural differences. In the aftermath of World War II, U.S. policy toward the Asian colonies of the European powers followed a simple rule: where the nationalists in a territory were leftist (as in Vietnam), Washington would support the reimposition of European colonial rule, while in those places where the nationalist movement was safely nonleftist (India, for example), Washington would support their independence as a way to remove them from the exclusive jurisdiction of a rival power. At first, Indonesian nationalists were (...) not deemed sufficiently pliable, so U.S.-armed British troops (assisted by Japanese soldiers) went into action against the Indonesians to pave the way for the return of Dutch troops, also armed by the United States. In 1948, however, moderate Indonesian nationalists under Sukarno crushed a left-wing coup attempt, and Washington then decided that the Dutch should be encouraged to settle with Sukarno, accepting Indonesian independence. Michael Novak's eyewitness report on the second and pivotal session of Vatican II in 1964 vividly inter weaves pageantry, politics, and theology. An unusually well-informed lay intellectual, who had earned a theological degree just before the Council, Novak applauded the purposes of Pope John XXIII and his successor Paul VI-"to throw open the windows of the church." In this report, he coined the classic description of the foes of the reforms at Vatican II as the party of "nonhistorical orthodoxy," (...) emphasizing the eternal and unchanging, neglecting history and contingency. The author recounts many moments of high drama-Pope Paul VI's opening speech, the vote on the collegiality of bishops, the plea of Cardinal Bea on behalf of the chapter on Jews, and Bishop De Smedt's defense of religious freedom. His colorful chapter on the American bishops in 1964 serves as a fascinating benchmark, as do his many insights into the new role of the laity. His final chapter is a moving tribute to the Open Church engaging the contemporary world, and his new introduction brings this report up to date. This work will be of compelling interest to those interested in the post-conciliar fall of Communism, under the great John Paul II-who took his name from his two predecessors at Vatican II. The winner of the million-dollar Templeton Prize for Progress in Religion, Michael Novak is a theologian, author, and former U.S. ambassador. Marshall and O’Leary’s thoughtful response to our article suggests that dismissal policies are ethically justifiable because they might induce parents to immunize their children. This outcome is conceivable, but we have only anecdotes about how often it occurs. Such evidence became the thin reed on which the American Academy of Pediatrics rested its new policy of tolerating the practice of dismissing vaccine-hesitant parents. It seems likely that relatively few parents would agree to vaccinate because they were threatened with dismissal. Other (...) heavy-handed interventions have failed to move most such parents. When Washington state made nonmedical exemptions more difficult to obtain, nearly two-thirds of vaccine refusers were unmoved and their children remained unvaccinated. Even if dismissal threats led some parents to accept vaccines, this alone would not justify a dismissal policy. The benefits would still have to be weighed against the risks of dismissing those families who do not change their minds. (shrink)

Few such simple words have had such a crucial impact on the history of Christian theology. In the summer of 386, Augustine of Hippo was a torn man. He had come to believe the Gospel, but he could not bring himself to break with sinful habits, habits so ingrained he (...) called them "necessities." His soul was torn between two wills within him, he said, each pointing in a different direction. Nothing seemed able to be able to break the interior logjam. He says that he willed that he would will the good, but not with a complete will, and so he remained paralyzed. After hearing a friend and mentor describe the conversion of Victorinus, a famous Roman teacher of rhetoric, and another friend speak of the monastic retreat of St. Anthony, the spiritual conflict within Augustine reached a fever pitch and he retreated to a corner of the garden in the house he was staying at. Suddenly, from over the wall, he heard a child chanting the words tolle, lege: "take up, read." He could not think of any childhood rhyme or chant that involved those words—they must be a sign from God. So, he rushed over to where a copy of St. Paul's letters was lying, opened it, and read at random. His eye fell on Romans 13:13: "Let us conduct ourselves becomingly as in the day, not in reveling and drunkenness, not in debauchery and licentiousness, not in quarreling and jealousy." Green (bio)Early in 1995, the National Human Genome Research Institute (then known as the National Center for Human Genome Research) began a novel experiment. It established the Office of Genome Ethics in its Division of Intramural Research (DIR). An extramural “ELSI” funding program for research on the ethical, legal, and social implications of the Human Genome Project had been in existence (...) since 1990, and a joint Department of Energy, NIH Working Group to consider larger policy issues raised by the genome project had also been in existence since that date. But the establishment of the Office of Genome Ethics was the first effort to provide an in-house ethics service for the several hundred NHGRI genetic researchers working on the NIH campus.The experiment was also novel by NIH standards. The Clinical Center, which serves all NIH research institutes as a patient-care facility, has long had a bioethics program, but, to my knowledge, none of the 23 other institutes, centers, or divisions of the NIH had ever developed an ethics program to assist its on-campus researchers in identifying and addressing the ethical issues arising from their research. Behind this initiative lay the commitment to ethics in genetic research shared by Francis Collins, Director of NHGRI, Jeff Trent, Scientific Director of the Division of Intramural Research, and other senior scientists and administrators of the Institute.I was fortunate to be asked to serve as Director of this office. My previous experience in the federal context was limited. I had served on many NIH study sections and for a nine-month period had been a member of the Human Embryo Research Panel, but none of this amounted to an “insider’s view” of government bioethics. The preponderance of my bioethics career had transpired in the university and medical school/medical center environment.Because I had to continue to fulfill many Dartmouth commitments, I agreed to serve on an interim and half-time basis (one week in Bethesda; one week at home) for an 18-month period. I was assisted in maintaining this schedule by the appointment of a deputy, Mathew Thomas, a recent bioethics graduate of Duke University, who would serve on a full-time basis and provide continuity for our [End Page 181] work. Our objectives, established in consultation with NHGRI personnel, were to learn which functions would be most useful, to set up a program to provide them, and, eventually, to aid in the process of determining how an office like this might fit into NHGRI’s future.As this 18-month stint draws to a close, I can report that it has been an exhilarating experience. I am grateful for the opportunity to have worked with outstanding scientists in an area of growing importance and interest. I believe we have pioneered in the provision of bioethics education and counsel to a diverse group of genetic researchers. We have helped to “open the doors and windows” of the Genome Institute, facilitating two-way communication between NHGRI researchers and others interested in genetic and ethics. We have assisted with some knotty problems in genetic research while building a base of knowledge about highly specialized issues that is useful to researchers inside and outside NHGRI. What follows is an abbreviated overview and evaluation of our activities during this period.Main ActivitiesWorking with a core of interested supporters from every branch of the DIR, our office quickly established a roster of activities aimed at meeting identified needs. Economic growth as we know it today cannot persist indefinitely if it entails continuous degradation of natural resources and the environment. While in a few countries around the world it appears that environmental degradation has been the result of rapid economic growth, in the vast majority of the developing countries the environment has been equally spoiled despite slow or even negative economic growth. This book provides new insights on the common roots of economic stagnation, poverty and environmental degradation which, unfortunately, (...) generally reside in misguided government policies and priorities. By doing this, the volume seeks to provide a broader policy option framework than those found in conventional policy analyses, mainly dominated by the "Washington Consensus". It shows that a major omission of the conventional view is that governments tend to allocate government expenditures in a biased way favouring subsidies to the economic elites to the detriment of investments in public goods, including human capital, R&D, as well as the development of institutions, which are vital for long run growth, poverty reduction and environmental sustainability. This account is a case-study of a successful (...) attempt of teachers, students, and administrators at one school, in one time and place, unifying the whole curriculum by having an art exhibit at the center of learning. The account is given through many voices, especially those of the students in the school who participated in the curriculum, and the teachers who invented it. I served the school as a faculty advisor and thus the telling is in the voice of a participant-observer but I rely heavily on the experiences of the participants and their ways of telling. The students and teachers are unabashedly enthused about what they were able to accomplish in teaching and learning, and are eager to share their experiences with other learningcommunities. This account begins with a short history of the recently founded school and an overview of its curricular mission. It proceeds with students telling about projects they did and their experiences of the curriculum, which evolved around In the American Grain; teachers talking about their experiences with the curriculum; and the founding principal's responses to the curriculum. It ends with my observations and conclusions. I hope that this account might encourage other educators to initiate their own attempts at school reform by placing the arts at the center of the curriculum. The School Vancouver School of Arts and Academics opened in September of 1996 with 525 middle and high school students (grades 6-11 with 12th grade added the following year) in a renovated building originally constructed as a high school in 1928. 2 The school has a new theater, recording studio, rehearsal rooms, and art studios. The school is dedicated to "the dual mission [End Page 21] of academic rigor and artistic excellence," with an evolving curriculum in which all areas of study (math, science, language arts, and social studies) and a full spectrum of arts disciplines (music, theater, dance, moving imagery, literature, and visual arts) are focused around artistic themes taught through interdisciplinary approaches. 3All students attend the school full-time. The mornings are devoted to "academics," subjects that are team-taught to "core groups" of students of combined grades (6-7-8, 9-10, 11-12) and the afternoons consist of three hours of arts instruction in elected classes of mixed-age students. There are four teachers for each core of about 100 students. Teaching and learning is project-based, interdisciplinary, on an art-centered school theme pre-selected for the year by the faculty. This account is a case-study of a successful (...) attempt of teachers, students, and administrators at one school, in one time and place, unifying the whole curriculum by having an art exhibit at the center of learning. The account is given through many voices, especially those of the students in the school who participated in the curriculum, and the teachers who invented it. I served the school as a faculty advisor and thus the telling is in the voice of a participant-observer but I rely heavily on the experiences of the participants and their ways of telling. The students and teachers are unabashedly enthused about what they were able to accomplish in teaching and learning, and are eager to share their experiences with other learningcommunities. This account begins with a short history of the recently founded school and an overview of its curricular mission. It proceeds with students telling about projects they did and their experiences of the curriculum, which evolved around In the American Grain; teachers talking about their experiences with the curriculum; and the founding principal's responses to the curriculum. It ends with my observations and conclusions. I hope that this account might encourage other educators to initiate their own attempts at school reform by placing the arts at the center of the curriculum. The School Vancouver School of Arts and Academics opened in September of 1996 with 525 middle and high school students (grades 6-11 with 12th grade added the following year) in a renovated building originally constructed as a high school in 1928. 2 The school has a new theater, recording studio, rehearsal rooms, and art studios. RationaleSurrogates of critically ill patients often have inaccurate expectations about prognosis. Yet there is little research on how intensive care unit clinicians should discuss prognosis, and existing expert opinion-based recommendations give only general guidance that has not been validated with surrogate decision makers.ObjectiveTo determine the perspectives of key stakeholders regarding how prognostic information should be conveyed in critical illness.MethodsThis was a multicenter study at three academic medical centers in California, Pennsylvania, and Washington. One hundred eighteen key stakeholders completed in-depth (...) semistructured interviews. Participants included 47 surrogates of adult patients with acute respiratory distress syndrome; 45 clinicians working in study ICUs, including physicians, nurses, social workers, and spiritual care providers; and 26 experts in health communication, decision science, ethics, family-centered care, geriatrics, healthcare disparities, palliative care, psychology, psychiatry, and critical care.Measurements and main resultsThere was broad support among surrogates for existing expert recommendations, including truthful prognostic disclosure, emotional support, tailoring the disclosure strategy to each family's needs, and checking for understanding. In addition, stakeholders offered suggestions that add specificity to existing recommendations, including: In addition to conveying prognostic estimates, clinicians should help families "see the prognosis for themselves" by showing families radiographic images and explaining the clinical significance of physical manifestations of severe disease at the bedside. Many physicians did not support using numeric estimates to convey prognosis to families, whereas many surrogates, clinicians from other disciplines, and experts believed numbers could be helpful. Clinicians should conceptualize prognostic communication as an iterative process that begins with a preliminary mention of the possibility of death early in the ICU stay and becomes more detailed as the clinical situation develops. Although prognostic information should be initially disclosed by physicians, other members of the multidisciplinary team-nurses, social workers, and spiritual care providers-should be given explicit role responsibilities to reinforce physicians' prognostications and help families process a poor prognosis emotionally.ConclusionsFamily members, clinicians, and experts identified specific communication behaviors that clinicians should use to discuss prognosis in the critical care setting.
