The principal aim of this book is to develop and defend an analysis of the concept of moral obligation. The analysis is neutral regarding competing substantive theories of obligation, whether consequentialist or deontological in character. What it seeks to do is generate solutions to a range of philosophical problems concerning obligation and its application. Amongst these problems are deontic paradoxes, the supersession of obligation, conditional obligation, prima facie obligation, actualism and possibilism, dilemmas, supererogation, and cooperation. By virtue of its normative (...) neutrality, the analysis provides a theoretical framework within which competing theories of obligation can be developed and assessed. Words such as “good” and “bad” give expression to value, while words such as “right,” “wrong,” “ought,” and “reason” give expression to normativity. Some philosophers hold the view that value is to be understood in terms of normativity, others hold the view that normativity is to be understood in terms of value. This chapter examines both views, explaining how each is plausible and yet also problematic.

Frequent public uproar over forms of data science that rely on information about people demonstrates the challenges of defining and demonstrating trustworthy digital data research practices. This paper reviews problems of trustworthiness in what we term pervasive data research: scholarship that relies on the rich information generated about people through digital interaction. We highlight the entwined problems of participant unawareness of such research and the relationship of pervasive data research to corporate datafication and surveillance. We suggest a way forward by (...) drawing from the history of a different methodological approach in which researchers have struggled with trustworthy practice: ethnography. To grapple with the colonial legacy of their methods, ethnographers have developed analytic lenses and researcher practices that foreground relations of awareness and power. These lenses are inspiring but also challenging for pervasive data research, given the flattening of contexts inherent in digital data collection. We propose ways that pervasive data researchers can incorporate reflection on awareness and power within their research to support the development of trustworthy data science. (shrink)

Many drugs used in paediatric medicine are off-label. There is a rising call for the use of adaptive clinical trial designs in responding to the need for safe and effective drugs given their potential to offer efficiency and cost-effective benefits compared with traditional clinical trials. ADs have a strong appeal in paediatric clinical trials given the small number of available participants, limited understanding of age-related variability and the desire to limit exposure to futile or unsafe interventions. Although the ethical value (...) of adaptive trials has increasingly come under scrutiny, there is a paucity of literature on the ethical dilemmas that may be associated with paediatric adaptive designs. This paper highlights some of these ethical concerns around safety, scientific/social value and caregiver/guardian comprehension of the trial design. Against this background, the paper develops a non-static conceptual lens for understanding PADs. It shows that ADs are epistemically open and reduce some of the knowledge-associated uncertainties inherent in clinical trials as well as fast-track the time to draw conclusions about the value of evaluated drugs/treatments. On this note, the authors argue that PADs are ethically justifiable given they have multiple layers of safety, exposing enrolled children to lesser potential risks, create social/scientific value generally and for paediatric populations in particular, specifically foster the flourishing of paediatric populations and can significantly improve paediatric trial efficiency when properly designed and implemented. However, because PADs are relatively new and their regulatory, ethical and logistical characteristics are yet to be clarified in some jurisdictions, the cooperation of various public and private stakeholders is required to ensure that the interests of children, their caregivers and parents/guardians are best served while exposing paediatric research subjects to the most minimal of risks when they are enrolled in paediatric trials that use ADs. There are two aspects to this debate: the first concerns how the concept of a good life is to be understood; the second concerns what kinds of life fall within the extension of this concept. In this paper, I will attend only to the first, conceptual aspect and not to the second, substantive aspect. Kant refers to analytic cognition in several prominent places. The prevailing wisdom, however, denies the possibility of analytic cognition within his theory of cognition. I shall argue that this is mistaken. I show that we can account for analytic cognition’s possibility by appealing to variants of the more familiar conditions on the cognition of objects. I also highlight analytic cognition’s connection to insight and analytic knowledge. In the process, I provide a fuller account of Kant’s view of our mental lives (...) than has been typically acknowledged. (shrink)

In a recent article in this journal, I argued against the popular twofold Strawsonian claim that there can be no moral responsibility without a moral community and that, as a result, moral responsibility is essentially interpersonal. Benjamin De Mesel has offered a number of objections to my argument, including in particular the objection that I mischaracterized Strawson’s view. In this article, I respond to De Mesel’s criticisms.

This paper is concerned with Bach’s stand on the “semantics-pragmatics” issue. A bit of Good Bach is his skepticism about the evidential role of intuitions. Another bit is his firm stand against the widespread confusion of what constitutes the meanings of utterances with how hearers interpret utterances. The paper argues at length against two bits of Bad Bach. There is no sound theoretical motivation for his excluding the reference fixing of demonstratives, pronouns and names from “what-is-said”. His methodology for deciding (...) what is “semantic” is flawed in three respects: first, in its commitment to the mistaken Modified Occam’s Razor; second, in its placing inappropriate syntactic constraints on conventional meanings; and, third, in explaining many regularities in usage as standardizations rather than conventionalizations. This flawed methodology has the conservative effect of ruling out new meanings. (shrink)

The organizing theme for this special volume raises a momentous question: What are the implications of 21st century science for nursing care? The two terms the question relates – 21st century science and nursing care – are each of central importance for nursing and in philosophical enquiry about nursing as a practice, profession, or institution. These key terms are also highly charged and open to interpretation, as is the relationship of implication between them. Different interpretations or assumptions will steer the (...) search for an answer in quite different directions.Putting the expectation of an answer in abeyance, this paper probes the question precisely in its openness to interpretation and contestation. In elaborating different ways in which the main terms of the question can be taken, and analysing how different interpretations of or assumptions about them lead to different responses, the paper delineates crucial issues and divisions in nursing and commentary about nursing today. Restorative practices are gaining traction as alternative approaches to student conflict and harm in schools, potentially surpassing disciplinary methods in effectiveness. In the current article, we contribute to the evolving understanding of restorative practices in schools by examining qualitative responses from educators regarding restorative interventions for online-mediated conflict and harm, including cyberbullying and sexting. Participants include pre-service educators, as well as junior and senior teachers with varying levels of familiarity with restorative practices. Our findings highlight how educators who have implemented (...) these practices largely hold positive perspectives of their effectiveness for resolving cyber conflicts and restoring a positive classroom environment. Educators emphasize the value of meaningful changes in student behaviour and acknowledge the potential of face-to-face mediation in mitigating online harm and promoting digital citizenship, though some educators raise questions about the appropriateness of restorative responses to serious incidents of online-mediated harm. This research offers fresh insights into the challenges and potential of restorative practices in schools, particularly in addressing cyber-based conflicts. We emphasize implementation challenges related to the distinct contexts in which schools operate and the influence of broader societal and systemic factors on the success of restorative practice initiatives. Contributors to the debate on ethical rationing bring with them assumptions about the proper role of moral theories in practical discourse, which seem reasonable, realistic and pragmatic. These assumptions function to define the remit of bioethical discourse and to determine conceptions of proper methodology and causal reasoning in the area. However well intentioned, the desire to be realistic in this sense may lead us to judge the adequacy of a theory precisely with reference to its ability to deliver apparently determinate (...) answers to questions that strike most practitioners and patients as morally arbitrary. By providing ethical solutions that work given the world as it is, work in clinical ethics may serve to endorse or protect from scrutiny the very structures that need to change if real moral progress is to be possible. Such work can help to foster the illusion that fundamentally arbitrary decisions are ‘grounded’ in objective, impartial reasoning, bestowing academic credibility on policies and processes, making it subsequently harder for others to criticise those processes. As theorists, we need to reflect on our political role and how best to foster virtuous, critical practice, if we are to avoid making contributions to the debate that not only do no good, but may even be harmful. A recent debate in this journal illustrates these issues effectively. (shrink)

We use the apparatus of the canonical formulas introduced by Zakharyaschev [10] to prove that all finitely axiomatizable normal modal logics containing K4.3 are decidable, though possibly not characterized by classes of finite frames. Our method is purely frame-theoretic. Roughly, given a normal logic L above K4.3, we enumerate effectively a class of frames with respect to which L is complete, show how to check effectively whether a frame in the class validates a given formula, and then apply a Harropstyle (...) argument to establish the decidability of L, provided of course that it has finitely many axioms. Frankfurt has attacked the principle that a person is morally responsible for what he has done only if he could have done otherwise, And he has thereby sought to undermine the traditional debate between compatibilists and incompatibilists. The role that the principle plays in this debate is clarified. Frankfurt's type of argument is then assessed for its implications concerning both the principle and the debate. It is argued that the debate, Even if not the principle, May well emerge intact.

This article reviews empirical research on social security and social welfare law. It identifies the efforts needs to be carried out to promote empirical research in this area of law and outlines an empirical research agenda of topics that should be given priority. The UK defines social security as based on five key benefits viz. social/contributory, categorical/universal, tax-based, and occupational/means-tested. This article focuses on the primary model of administrative justice. It is a three-fold: bureaucratic rationality/accuracy and efficiency; professional treatment/service; and (...) moral judgment/fairness, each pair in the order of a model and its corresponding legitimizing values, respectively. Research on social security fraud identifies a two-fold basis—reflexivity: reflection/introspection on fraudulent acts, anxiety: the extent of guilt and insecurity, post-action, and anticipation of conviction. Accordingly, based on a relative synthesis of both elements, there is a four-fold categorization which goes as follows: subversive, desperate, fatalistic, and unprincipled. (shrink)

Many philosophers have endorsed G. E. Moore’s principle of organic unities – according to which the value of a whole must not be assumed to be the same as the sum of the values of its parts – claiming this principle to be of fundamental importance to ethics. In this paper, I cast doubt on the principle. In Section 1, I provide a provisional reformulation of the principle of organic unities and contrast such unities with mere sums of value. In (...) Section 2, I do some groundwork in order to arrive at an account of the part–whole relation with which the principle of organic unities is concerned. In so doing, I provide some further reformulations of that principle. In Section 3, I discuss the isolation method that Moore proposes for determining the value of something, and then, in Section 4, I begin an extended discussion of a particular example of an alleged organic unity, namely, Schadenfreude. I explain why some philosophers claim that such pleasure constitutes an organic unity, but I also present reasons for denying this claim. In Section 5, I pursue one of these reasons in particular, a reason that appeals to the concept of what I call evaluative inadequacy, and, in Section 6, I seek to motivate this appeal by drawing on the relation between value and fitting attitudes. In so doing, I provide still further reformulations of the principle of organic unities. In Section 7, I entertain objections to my account of Schadenfreude, one of which requires one final reformulation of the principle of organic unities, and then, in Section 8, I discuss the more general objection that, even if my reasons for denying that Schadenfreude constitutes an organic unity are cogent, these reasons do not extend to other alleged organic unities, such as the related phenomenon of Mitleid. Following the success of Hong Kong Corner Houses, German photographer Michael Wolf continues his collaboration with Hong Kong University Press to produce Small God, Big City. Wolf again uses his creative eye to draw attention to overlooked objects in the visually rich urban environment of Hong Kong. This time the object is the Earth God shrine, found commonly by the doorways of shops and homes throughout Hong Kong. Through his visually stimulating and thought-provoking photographs, Wolf challenges our sensitivity to (...) seemingly familiar everyday things. An interpretative text for the photographs is authored by two familiar names: Lee Ho Yin and Lynne DiStefano, who are well-known academics and practitioners of heritage conservation in Hong Kong. The text is a highly readable curatorial essay that leads readers to a better understanding of the topic and the meaning behind Wolf 's photographs of Earth God shrines in urban Hong Kong. The topic of this book is timely, given the vulnerability of traditional beliefs and practices in an increasingly urbanized Hong Kong. It is hoped that Small God, Big City will provoke deeper thoughts on who we are and what we believe in this modern world. (shrink)

This paper is a response to Nenad Miščević’s “Reply to Michael Devitt”, the latest in an exchange on the source of linguistic intuitions. Miščević defends a modified version (“MoVoC”) of the received view that these intuitions are the product of a linguistic competence. I have earlier rejected all versions of the received view urging instead that intuitions are, like perceptual judgments, empirical theory-laden central-processor responses to phenomena. (1) I emphasize here, against Miščević, that this claim about a speaker’s intuitions (...) about strings is not to be conflated with a claim about her understanding of strings. (2) I develop my claim, addressed by Miščević, that MoVoC is implausible in three ways. But these are not the main problems for MoVoC.
