Because youths are particularly vulnerable to social problems, philosophers since Plato to date have continued to show interest in developing, empowering, and protecting the youths. African youths are particularly far more than ordinarily vulnerable to various social problems including racism especially from outside the continent, mainly because of the shortfall in youth development and empowerment strategies in most African countries. Consequently, young people are pulled to countries with resources and infrastructures that provide them with opportunities to enlarge their capabilities and (...) improve their quality of life, where they are also faced with discriminatory, prejudicial, and antagonistic treatments simply because of their skin colour. So, one way to look at racism and reduce its effects is to examine those socio-political as well as economic structures that constitute obstacles to youth development and empowerment, and which push and expose the young in Africa to the ill-treatments emanating from racism. This paper offers a philosophical response to an aspect of the youth question in Africa – the question of youth vulnerability and its consequences on the human development outcome. To achieve the desired goal, first, I stretch the concept of pathogenic vulnerability from being more than ordinarily vulnerable to being far more than ordinarily vulnerable. Second, I identify two elements of African cultural structure – primacy of community over the individual and the belief that elders always possess superior knowledge over (...) the youth – that influence and restrict capacity/capabilities in African youth and therefore make their transition to adulthood defective. Consequently, the African youth is deprived of the special opportunity to develop, encounter and explore the various character options from which he/she learns, selects and forms her identity. Third, I argue that these restraints of capacity/capabilities make African youths far more than ordinarily vulnerable to human development outcome. (shrink)
The law of informed consent to medical treatment has recently been extensively overhauled in England. The 2015 Montgomery judgment has done away with the long-held position that the information to be disclosed by doctors when obtaining valid consent from patients should be determined on the basis of what a reasonable body of medical opinion agree ought to be disclosed in the circumstances. The UK Supreme Court concluded that the information that is material to a patient’s decision should instead be judged (...) by reference to a new two-limbed test founded on the notions of the ‘reasonable person’ and the ‘particular patient’. The rationale outlined in Montgomery for this new test of materiality, and academic comment on the ruling’s significance, has focused on the central ethical importance that the law now accords to respect for patient autonomy in the process of obtaining consent from patients. In this paper, we dispute the claim that the new test of materiality articulated in Montgomery equates with respect for autonomy being given primacy in re-shaping the development of the law in this area. We also defend this position, arguing that our revised interpretation of Montgomery’s significance does not equate with a failure by the courts to give due legal consideration to what is owed to patients as autonomous decision-makers in the consent process. Instead, Montgomery correctly implies that doctors are ethically obliged to attend to a number of relevant ethical considerations in framing decisions about consent to treatment, which include subtle interpretations of the values of autonomy and well-being. Doctors should give appropriate consideration to how these values are fleshed out and balanced in context in order to specify precisely what information ought to be disclosed to a patient as a requirement of obtaining consent, and as a core component of shared decision-making within medical encounters more generally. This essay explores the positive aspects of resentment in early Confucian thought. Specifically, it argues that from an early Confucian perspective, resentment is a frustration or anger that occurs when those close to us withhold their care or when they otherwise injure us. Stated succinctly, resentment is a result of frustrated desire for affection. It is a sign that we require the care of significant others, and that we are vulnerable to their concern or neglect. When understood appropriately, resentment signals (...) genuine recognition of meaningful relationships; it is a sign that we are affected by those that ought to matter to us. Importantly, resentment has a creative dimension in that it can lead to the production of literature aimed to channel frustrated desire toward realizing the Confucian dao 道. These texts work to connect the author’s resentment with the reader’s possibility of remaking the world in a way desired by the author. (shrink)
This essay highlights an alternative tradition of understanding value conflicts in early Confucian thought. In contrast to a prominent position among interpreters that argues for the resolvability or harmonization of conflicting values, I argue that some early Confucians conceptualized value conflicts as irresolvable. In other words, when meaningful aspects of a situation come into tension with each other and values are threatened to be either left unfulfilled or harmed, early Confucians put forth a variety of views. Some believed that all (...) values could be tended to as long as one had the moral imagination of a sage, whereas others saw the world as a place where irreconcilable conflicts between values could occur for even the most profound people. Within this diversity, I take up a view about irresolvable value conflicts where the confrontation with a deep value conflict leaves behind a moral remainder that can mar even the character of a sage. The purpose of this article is to demonstrate that there are ample resources in the English-speaking academic community to enable philosophers who cannot read Chinese to work with material from the Western Han dynasty in their research or teaching. It discusses three kinds of resources, with the aim of developing a community of philosophers engaged in a sustained conversation about Western Han thought. These resources are histories that describe various aspects of the Han dynasty, translations of key texts, and intellectual (...) histories that examine specific thinkers or texts from the Han. This article also provides a detailed example of one way in which Western Han texts demonstrate the diversity of Chinese philosophy with regard to value conflicts. (shrink)
This article will argue that Tao Yuanming 陶淵明 recognized a tension between being himself and the natural transformations of the world. While he advocated a kind of ziran zhuyi 自然 主義, he did not believe that he, or human beings in general, were predisposed to accept the inevitable changes of the world. Hence, his "naturalism" is not necessarily about fitting into his natural surroundings, despite the fact that he relies on these surroundings in his poetry, and that contemporary scholars sometimes (...) see his work as "pastoral." Thus far, we know much more about the significant outcomes of perceived ethical leadership than we do about its antecedents. In this study, we focus on multiple types of ethical role models as antecedents of perceived ethical leadership. According to social learning theory, role models facilitate the acquisition of moral and other types of behavior. Yet, we do not know whether having had ethical role models influences follower perceptions of one’s ethical leadership and, if so, what kinds of role models (...) are important. We conducted a field study, surveying supervisors and their subordinates to examine the relationship between three types of ethical role models and ethical leadership: the leader’s childhood role models, career mentors, and top managers. We found that having had an ethical role model during the leader’s career was positively related to subordinate-rated ethical leadership. As expected, this effect was moderated by leader age, such that the relationship between career mentoring and ethical leadership was stronger for older leaders. Leader age also moderated the relationship between childhood models and ethical leadership ratings, such that having had childhood ethical role models was more strongly and positively related to ethical leadership for younger leaders. We found no effect for top management ethical role models. Implications for research and practice are discussed. (shrink)
This study examined the role of key causal analysis strategies in forecasting and ethical decision-making. Undergraduate participants took on the role of the key actor in several ethical problems and were asked to identify and analyze the causes, forecast potential outcomes, and make a decision about each problem. Time pressure and analytic mindset were manipulated while participants worked through these problems. The results indicated that forecast quality was associated with decision ethicality, and the identification of the critical causes of the (...) problem was associated with both higher quality forecasts and higher ethicality of decisions. Neither time pressure nor analytic mindset impacted forecasts or ethicality of decisions. Theoretical and practical implications of these findings are discussed. (shrink)
This paper develops twenty hypotheses concerning the relationships among selected individual differences variables (locus of control, delay of gratification, gender, and race) and five different ethical beliefs. The results of a study of collegians provide support for seventeen out of twenty research hypotheses. As predicted, locus of control, delay of gratification, and race are related to ethical beliefs. Also as predicted, gender is not related to ethical beliefs.
The Politics of the Texbook analyzes the factors that shape production, distribution and reception of school texts through original essays which emphasize the double-edged quality of textbooks. Textbooks are viewed as systems of moral regulation in the struggle of powerful groups to build political and cultural accord. They are also regarded as the site of popular resistance around discloding the interest underlying schoolknowledge and incorporating alternative traditions.
Theoretical arguments that psychopathy eliminates individual responsibility for illegal behavior and can therefore serve as a basis for an insanity defense are largely premised on emotional characteristics of psychopathy that impede the individual’s capacity to appreciate right from wrong. We offer arguments and countervailing evidence indicating psychopaths do have the capacity to appreciate right from wrong and therefore should not be absolved of criminal responsibility.
On 27 February 1998, the Indian Institute of Management, Calcutta and the office of the Fulbright binational educational exchanges in Calcutta jointly hosted a seminar on 'The Tradition of Non Violence: The American Experience and the Gandhian' at the Management Centre for Human Values. There were two keynote presentations. The one on the American experience was by Michael True, Professor of English Literature at Assumption College, Massachusetts, who was teaching as Fulbright visiting lecturer at Utkal University, Bhubaneswar. The Gandhian (...) case was presented by Profes sor Amlan Datta, economist and writer, also former Vice-Chancellor of Visva-Bharati University, Santiniketan. The session was chaired by Professor Amitava Bose, Director, Indian Institute of Management. To close the discussions, a summing up was presented by Professor S.K. Chakraborty, Convenor, Management Centre for Human Values. The importance of discussions on the subject of non-violence and the Gandhian alterna tive cannot be overestimated in this year of the 50th anniversary of Indian independence and a nationwide soul-searching over these five decades. The US Educational Foundation in India contributed to the national discussion through this bilateral seminar and its comparative perspective. (shrink)
The rising tide of corporate scandals and audit failures has shocked the public, and the integrity of auditors is being increasingly questioned. It is crucial for auditors and regulators to understand the main causes of audit failure and devise preventive measures accordingly. This study analyzes enforcement actions issued by the China Securities Regulatory Commission against auditors in respect of fraudulent financial reporting committed by listed companies in China. We find that auditors are more likely to be sanctioned by the regulators (...) for failing to detect and report material misstatement frauds rather than disclosure frauds. Further analysis of the material misstatements indicates that auditors are more likely to be sanctioned for failing to detect and report revenue-related frauds rather than assets-related frauds. In sum, our results suggest that regulators believe auditors have the responsibility to detect and report frauds that are egregious, transaction-based, and related to accounting earnings. The results contribute to our knowledge of auditors’ responsibilities for detecting frauds as perceived by regulators. (shrink)
In our view, a central issue in relating brain development to education is whether classroom interventions can alter neural networks related to cognition in ways that generalize beyond the specific domain of instruction. This issue depends upon understanding how neural networks develop under the influence of genes and experience. Imaging studies have revealed common networks underlying many important tasks undertaken at school, such as reading and number skills, and we are beginning to learn how genes and experience work together to (...) shape the development of these networks. The results obtained appear sufficient to propose research-based interventions that could prove useful in improving the ability of children to adjust to the school setting and to acquire skills like literacy and numeracy. What is the value of having medical students engage in creative production as part of their learning? Creating something new requires medical students to take risks and even to fail--something they tend to be neither accustomed to nor comfortable with doing. “Making stuff” can help students prepare for such failures in a controlled environment that doesn’t threaten their professional identities. Furthermore, doing so can facilitate students becoming resilient and creative problem-solvers who strive to find new ways to address vexing questions. (...) Though creating something new can be fun, this is not the main outcome of interest. Rather, the principle reason we recommend devoting precious curricular time to creative endeavors is because it helps medical students become better doctors. (shrink)
When a person engages in a "game," that person may reason and behave in a manner that is inconsistent with non-game-situation moral reasoning. In this study we measured moral reasoning with the Defining Issues Test (DIT). We then engaged the students in a competitive game and collected accounts of their "reasoning" by having them explain their decisions with a forced choice inventory. The results indicate that there were significant inconsistencies in moral reasoning between non-game and game situations. The implications of (...) this for business ethics are discussed. (shrink)
Exploring the construct of social-responsibility orientation across three Asian and two Western societies, we show evidence that top-level executives in these societies hold fundamentally different beliefs about their responsibilities toward different stakeholders, with concomitant implications for their understanding and enactment of responsible leadership. We further find that these variations are more closely aligned with institutional factors than with cultural variables, suggesting a need to clarify the connection between culture and institutions on the one hand and culture and social-responsibility orientations on (...) the other. According to contemporary representationalism, phenomenal qualia—of specifically sensory experiences—supervene on representational content. Most arguments for representationalism share a common, phenomenological premise: the so-called “transparency thesis.” According to the transparency thesis, it is difficult—if not impossible—to distinguish the quality or character of experiencing an object from the perceived properties of that object. In this paper, I show that Husserl would react negatively to the transparency thesis; and, consequently, that Husserl would be opposed to at least two versions of contemporary representationalism. First, (...) I show that Husserl would be opposed to strong representationalism, since he believes the cognitive content of a perceptual episode can vary despite constancy of sensory qualia. Second, I then show that Husserl would be opposed to weak representationalism, since he believes that sensory qualia—specifically, the sort that he calls “kinesthetic sensations”—can vary despite constancy in representational content. Since Horn (1972) the notion of conversational implicature proposed by Grice has been put to use to explain certain interpretive differences between expressions in natural language and their counterparts in formal logic. For example, the sentences in (1) seem to convey more than they would be expected to if the natural language disjunction or had the same meaning as the logical disjunction ∨, or if the quantificational determiner some was interpreted as the existential quantifier ∃.
