While it is generally assumed that large corporations today give rhetorical support for basic human rights in public relations documents, skepticism continues toarise about the behavior of these firms. Do company actions support their rhetoric? This paper provides the initial analysis of our study of both rhetoric and practice regarding human rights in a small sample of large U.S. firms. At this point in the analysis, UNGC membership does not appear to have much influence on corporate rhetoric, but may be (...) partially correlated with several measures of corporate performance on human rights issues. President Barack Obama ordered federal regulatory agencies to engage in a retrospective regulatory review process in early 2011. This paper reports the initial results of an analysis of participation in the notice and comment process by business and public interest groups. The focus of the analysis is on comments given to the Environmental Protection Agency (EPA). Some attention is given to the EPA’s identification of regulations to be reviewed, as a result of this process.

Drawing from contemporary social science studies on the shifting regime of research governance, this paper extends the literature by utilizing a metaphoric image—research is a game—observed in a field engagement with 82 American, British, and Danish crop and plant scientists. It theorizes respondents’ thinking and practices by placing the rules of the research game in dynamic and interactive tension between the scientific, social, and political-economic contingencies that generate opportunities or setbacks. Scientists who play the game exploit opportunities and surmount setbacks (...) by adopting strategies and reinventing tactics in order to maximize their winnings and to minimize their losses. Urban dwellers’ food and nutritional wellbeing are both dependent on infrastructure and can be indicative of wider wellbeing in urban contexts and societal health. This paper focuses on the multiple relationships that exist between food and infrastructure to provide a thorough theoretical and empirical grounding to urgent work on urban food security and nutrition in the context of rapid urban and nutrition transitions in the South. We argue that urban systems and food systems thinking have not been well aligned, but (...) that such alignment is not only timely and overdue but also fruitful for both thematic areas of research and policy. We draw in particular on work within wider urban political economy and political ecology that can be classified as part of the ‘infrastructural turn’ that is influential with urban studies but little acknowledged within food studies. Drawing on these literatures helps us to better understand the interrelationships between people, things and ideas that make up both infrastructure and food systems. Policy, planning and research relating to both food and urban systems cannot afford to ignore such interlinkages, though much policy still operates on the neat assumptions of progressive connectivity to ‘the grid’ and formal food retail. Instead we argue how in many urban governance systems, a variety of hybrid mechanisms—on and off the grid, public and private formal and informal—better represent how urban residents, particularly the most marginalised, meet their everyday food and infrastructural needs along a continuum of gridded and off-grid access. Nurses play a key role in the provision of services in relation to sexuality in both primary and sexual and reproductive health‐care. Given the intersection of sexualities with a range of social injustices, this study reviews research on nursing practice concerning sexuality from an emancipatory/social justice perspective. A systematic review of English articles published in nursing journals appearing on the Web of Science database from 2009 to 2014 was conducted. Thirty‐eight articles met the inclusion criteria. Analysis consisted of a descriptive (...) phase (types and location of studies, aspects of sexualities focused on, target health users and aspects of nursing practice focused on) and a critical/emancipatory phase. In terms of practice, our analysis revealed that: barriers exist to the integration of issues relating to sexuality in nursing practice; the social location of nurses and their personal feelings regarding sexuality influence their practice; content that addresses gendered norms and media that assist in communication underpin some emancipatory practices. Few studies locate analyses of nursing practice within gendered, cultural and social norms; consider advocacy as part of the practice of nurses; or analyse the promotion of health user participation in health services and structures. Results: We analyzed 1,402 surveys and 15 in-depth interviews. Many (32%) CL participants reported greater difficulty refilling medications and a minority (14%) reported greater difficulty accessing HIV care during the pandemic. Most (99%) Opt4Mamas participants reported no difficulty refilling medications or accessing HIV/pregnancy care. Among the CL participants, older women were less likely (aOR = 0.95, 95% CI: 0.92–0.98) and women with more children were more likely (aOR = 1.13, 95% CI: 1.00–1.28) to report difficulty refilling medications. Only 2% of (...) CL participants reported greater difficulty managing FP and most (95%) reported no change in likelihood of using FP or desire to get pregnant. Qualitative analysis revealed three major themes: (1) adverse organizational/economic implications of the pandemic, (2) increased importance of pregnancy prevention during the pandemic, and (3) fear of contracting COVID-19. This book sets stories of morally decent actions in a wider context of the essential barbarism of war. It charts the wider path of obscenity and atrocity in war to highlight moments of moral grace, of goodwill toward the enemy and civilians inside a frame of jarring ugliness and malice. It does not seek traditional war heroes or elevate anyone to secular sainthood. It presents ordinary people caught up in the extraordinary swirl of war, who did not see themselves as (...) saints or heroes at the time yet showed rare courage, notwithstanding. It presents portraits of everyday folk who reacted in a moment of crisis with mercy and sensitivity, with empathy for shared humanity with an enemy or the innocent. The goal is to recognize those brave few who refused immoral acts and orders, even at grave personal risk. Who in the midst of degradation and dehumanization saw common humanity, then chose not to pull the trigger. And others who put themselves outside suffocating conformity, to help rather than kill a wounded enemy or stop an atrocity. And those who made a simple gesture of kindness to a suffering enemy that had no larger consequence. Uninterested in saints, it looks to map a more modest, achievable and relatable lesson taken from the annals of war: an accounting best captured in a simple yet compelling word 'decency.'. (shrink)

This paper examines the interrelation between justice and mercy in Anselm’s prayers. Divine justice and human injustice seem to rightly cut off a human being from any assistance, grace, or reformation, since human beings has set themselves in a condition of injustice from which they cannot extricate themselves. Mercy then seems the only solution, but appears not only unjust, but also to trump divine justice, a position inconsistent with Anselm’s explicit statements. So then, how are justice and (...) class='Hi'>mercy rendered compatible, even complementary with each other? Human beings are brought into integral roles for each other as intercessors within a divine economy of justice offering mercy within the scope of that very justice. Anselm’s rhetorically and dramatically structured prayers perform an educative as well as petitionary function in assisting the human being to locate, understand, and exert themselves within that divine economy of justice and mercy. Wonder Woman's "Merciful Minerva!" uses the Roman name for Athena, and it is clear that her physical power and skill with weaponry is based on the ancient goddess. Wonder Woman's origin story uses the ancient Greek in exactly the same way the philosopher Georg Wilhelm Friedrich Hegel does in his Philosophy (...) of History. Hegel outlined his theory of history as a threefold progression. In the first stage, only the despot was free; in the second stage, the Greeks discovered that some are free; and in the third stage, the stage of the modern world, we know that all are free. James F. Keenan defines mercy as “the willingness to enter the chaos of another.” Mercy thus defined, he argues, is the distinctive characteristic of Christian morality. This essay asserts that mercy is, in fact, a public virtue, one that can be affirmed across a broad range of religious and moral traditions. Is mercy more important than justice? Since antiquity, mercy has been regarded as a virtue. The power of monarchs was legitimated by their acts of clemency, their mercy demonstrating their divine nature. Yet by the end of the eighteenth century, mercy had become “an injustice committed against society... a manifest vice.” Mercy was exiled from political life. How did this happen? In this book, Malcolm Bull analyses and challenges the Enlightenment’s rejection of mercy. A (...) society operating on principles of rational self-interest had no place for something so arbitrary and contingent, and having been excluded from Hobbes’s theory of the state and Hume’s theory of justice, mercy disappeared from the lexicon of political theory. But, Bull argues, these idealised conceptions have proved too limiting. Political realism demands recognition of the foundational role of mercy in society. If we are vulnerable to harm from others, we are in need of their mercy. By restoring the primacy of mercy over justice, we may constrain the powerful and release the agency of the powerless. And if arguments for capitalism are arguments against mercy, might the case for mercy challenge the very basis of our thinking about society and the state? It can be expressed in emotional, verbal, or relational terms, and it can potentially express a number of important moral values. A theory of punishment should give some account of mercy and yet it is true to say that very little has been said about it at all. It is commonly regarded as a praiseworthy element in moral behaviour—something to be practised occasionally both for the good of the one who punishes and the one who is punished. The suffering that punishment involves is unpleasant for all concerned, and if it is possible to avoid it or lessen it without moral (...) injustice, then it is desirable to do so. In the late twelfth and early thirteenth century, increasingly sophisticated ethical thought made its way out of the theology texts and into pastoral guides and sermons, making it possible for a greater number of ethically informed lay people to share pastoral responsibility. One exercise of this responsibility was fraternal correction, through which a person, motivated by charity, rebukes a neighbor for his or her wrongdoing. This essay argues that the practice of fraternal correction is in fact a sort of blaming, (...) since it includes a judgment of blameworthiness and opprobrium for the offender’s bad choice, moral address directed to the offender, the demand for a response, and holding the offender accountable. However, in contrast to other forms of blame, the source of the offender’s accountability to the corrector in fraternal correction is the social system created by the exercise of mercy. (shrink)

A pardon is an act of mercy according to the law, but is a pardon mercy in an ordinary or genuine sense? What distinguishes a pardon from a lenient judicial sentence, which is not mercy by the law’s lights? These are questions about what mercy as it is understood in law has to do with mercy as it is understood outside of law, and about who in government acts mercifully and when, if indeed anyone in (...) government ever does. Here I propose a general analysis of mercy, then bring that analysis to bear on government action. Three features of my analysis are noteworthy. First, almost all existing analyses say that mercy is unconstrained in a normative sense, but I argue that mercy is unconstrained in the way that arbitrary power is unconstrained. Second, although it’s often assumed that mercy must be motivated by compassion, I show that mercy only requires acting with the intention to benefit the recipient. Third, my analysis says that mercy requires the giver of mercy to overcome a motivation to treat the recipient harshly. Given this analysis, few government acts are merciful, but pardon is an institutional approximation or analog of mercy. -/- . (shrink)

I offer a solution to an old puzzle about how God can be both just and merciful at the same time—a feat which seems required of God, but at the same time seems impossible since showing mercy involves being more lenient than justice demands. Inspired by two of Jesus’ parables and work by Feinberg, Johnson and Smart, I suggest that following a “principle of merciful justice”—that persons ought to receive what they deserve or better—delivers mercy and justice simultaneously, (...) certainly in cases of distributions of goods, and even in cases of distribution of harms as well, if we can accept some qualifications. This paper raises an uncommon question: What can studying Thomas Aquinas and Critical Race Theory teach us about failures to promote mercy across the color-line? I answer this question in five stages. After locating Thomas’s teachings on mercy and its impediments within his masterwork, the Summa theologiae, I excavate Thomas’s account of mercy’s impediments. Sexual experimentation, living together, raising children outside of marriage, remarriage after divorce, and same-sex relationships...These behaviours have become common in the wider society as well as among Christians and Catholic Christians. Not only do they think and act differently than the official Church teaching, but they do so convinced that they are acting rightly. This challenges ethics to respond by what can be called an 'ethics of mercy', by meeting people where they are and helping them to grow towards (...) the fullness of life and love. Such a pastoral and educational ethics of growth should dare to stand within the tension between what is desirable and what is attainable, without surrendering the 'pro-vocative' idea of conjugal covenant as the basis for the family. Mercy is needed not only after ethics but in ethics. In harmony with Pope Francis's plea for a 'gospel of mercy', this book seeks a middle way between merciless rigourism and relativising subjectivism. It proposes an ethics of redemption that accompanies people on their way to meaningful living and loving, grounded in a spirituality that springs from the salvation offered in Jesus. (shrink)

Much contemporary discussion of mercy has focused on what I call ‘beneficent mercy’: compassionately sparing a person from harsh treatment that she deserves. Drawing on Seneca’s discussion of mercy, I articulate a different concept of mercy which I call ‘critical mercy’: treating a person justly when unjust social rules call for harsher treatment. Whereas beneficent mercy is grounded in recognition of imperfection in human individuals, critical mercy is grounded in recognition of imperfection in (...) human institutions. I argue that political communities have reason to authorize judges to grant critical mercy in criminal law. I contend with the objection that critical mercy appears to violate the ideal of the rule of law. I argue that where certain constraints are met, rule of law values in fact provide positive reason to authorize judges to grant critical mercy in criminal law. (shrink)

Recent work on environmental virtue tends to focus on the role of virtues like love, care, respect, humility and wonder for nature. This essay considers the merits of regarding mercy for nature as an environmental virtue. It argues that mercy for nature is neither conceptually confused nor unacceptably anthropocentric, is exhibited by an important exemplar of environmental virtue, and is compatible with virtues of love, care, respect and humility. In this article I argue that mercy does not prevent the imposition of harsh punishment from being morally permissible. This article has two parts. In the first part, I argue that mercy is an imperfect duty, because only such a duty-type explains the attributes that are commonly ascribed to mercy. In the second part, I argue that mercy does not present a sufficient moral reason against the regular imposition of harsh punishment because it neither undermines nor (...) systematically overrides or weakens the retributive duties. This is in part because the imperfect duty to be merciful can be satisfied by actions taken in nonpunitive contexts alone. This is also in part because mercy is not particularly appropriate given the lack of positive desert of and good moral character in most of the culpable wrongdoers who deserve harsh punishment. Lam, Joseph On 11 April 2015 Pope Francis called for a special of Year of Mercy, which subsequently was symbolically inaugurated with the opening of the Holy Doors of the Basilicas of St Peter and of St John in Rome on 8 December. According to the Argentinian Pontiff, upon whose episcopal ministry is placed the maxim miserendo atque eligendo, mercy is the key element leading to the rediscovery of the spiritual joy that appears to have faded away in (...) the life of the church. To counter this pessimism, Francis reminds his flock of the affectionate and tenderhearted look of God, whose merciful and loving gaze enriches and liberates the life of every Christian: 'Thanks solely to this encounter or renewed encounter with God's love, which blossoms into an enriching friendship, we are liberated from our narrowness and self-absorption'. Yet, Francis in his major teaching documents seems to caution against the concept of happiness, even though his description of the effects produced by the mercy and joy of the Gospel leads to human growth, within which human happiness is understood as a right. He has called for an integral development that includes society's most neglected members,6 and that respects and includes all forms of existence. Nonetheless, it is not a soft choice, as if mercy opens the door to all forms of pleasure as long as they make people happy. (shrink)

This book focuses on the degree to which certain moral and legal doctrines are rooted in specific passions that are then institutionalised in the form of criminal law. A philosophical analysis is developed of the following questions: when, if ever, should hatred be overcome by sympathy or compassion? What are forgiveness and mercy and to what degree do they require - both conceptually and morally - the overcoming of certain passions and the motivation by other passions? Mercy is the defining characteristic of Pope Francis’s leadership. Francis’s words and actions have made visible a discipline of mercy, which does more than illuminate God’s character and purpose; it offers an expansive imaginative framework to spark new possibilities for moral agency and growth. Before Francis, mercy received limited attention in the canon of Catholic social thought. Francis’s signature message of mercy retrieves a central moral duty in Scripture, provides a focal lens for Catholic social thought, (...) and aims to inspire a “revolution of tenderness” capable of inspiring personal conversion and social change. This essay moves forward in three steps. It first unpacks the rich and diverse meaning of the word mercy and explores its undervalued role in CST; it then analyzes how mercy functions as the crux of Francis’s moral imagination; and finally, it explores how mercy expands possibilities for living the principles of Catholic social thought. Masculinity and manhood ideologies remain a serious theological concern in the context of South Africa and the continent of Africa. The masculinity ideology perceives femaleness as a symbol to be lower than maleness and thereby uses this as a strategy to dominate and oppress women. While the oppression and domination of women is experienced in many parts of African society, such experiences also exist within the church walls. The androcentric culture creates an unbalanced theology which then brings the entire discourse (...) of theologisation into question. As this article grapples with these issues, it employs Mercy Oduyoye’s African women theology, particularly the model of ‘partnership between women and men’ in ministry, to reflect and respond to the issues raised. It further argues that as long as African women are subjected to oppression and domination by ideologies that are adiaphora, Oduyoye’s liberative hermeneutics remain relevant and necessary for doing inclusive theology in Africa. Contribution: While the article grapples with African women theologies within a theological terrain, the implications of the outcome are multidisciplinary as they aim to respond to challenges of oppression, masculinity and manhood ideologies that women face in their daily life. The kings of the Achaemenid Empire are known for employing a number of particularly gruesome punishments for those who were deemed guilty of rebellion. While it is certainly true that the Achaemenids punished rebels with utmost severity, it is also true that they were, at times, willing to forgive rebels, and even to rehabilitate them. In this paper, I investigate the mechanisms by which the Achaemenid kings were able to show mercy to rebels. By examining a number of relevant (...) cases from a period of a century and a half, I argue that the decision to be merciful was based on the king’s familial or social relationship with the rebel, the rebel’s relative strength vis-à-vis the king, the geography of the revolt, and the presence of other external factors which might also restrict the king’s powers. By a comparison with royal inscriptions and texts found throughout the empire, I demonstrate the ways in which these reconciliations stood apart from, and even in contradiction to, administrative and ideological norms concerning law and justice within the Achaemenid Empire. Finally, by reviewing the traditions and attitudes towards justice and mercy among the Achaemenids' Near Eastern predecessors, I put this policy in historical context and show that it is a unique response to a problem faced by other ancient empires.
