This article advocates employing John Stuart Mill's harm principle to set the boundary for unregulated free speech, and his Greatest Happiness Principle to regulate speech outside that boundary because it threatens unconsented-to harm. Supplementing the harm principle with an offense principle is unnecessary and undesirable if our conception of harm integrates recent empirical evidence unavailable to Mill. For example, current research uncovers the tangible harms individuals suffer directly from bigoted speech, as well as the indirect harms generated by the systemic (...) oppression and epistemic injustice that bigoted speech constructs and reinforces. Using Mill's ethical framework with an updated notion of harm, we can conclude that social coercion is not justified to restrict any harmless speech, no matter how offensive. Yet certain forms of speech, such as bigoted insults, are both harmful and fail to express a genuine opinion, and so do not deserve free speech protection. (shrink)

Abstract:Vulnerability is an important criterion to assess the ethical justification of the inclusion of participants in research trials. Currently, vulnerability is often understood as an attribute inherent to a participant by nature of a diagnosed condition. Accordingly, a common ethical concern relates to the participant’s decisionmaking capacity and ability to provide free and informed consent. We propose an expanded view of vulnerability that moves beyond a focus on consent and the intrinsic attributes of participants. In this article we focus on three key precepts shared by Confucianism and the African ethic of Ubuntu: the central value of community, the desirability of ethical partiality, and the idea that we tend to become morally better as we grow older. For each of these broad similarities, there are key differences underlying them, and we discuss those as well as speculate about the reasons for them. Our aim is not to take sides, but we do suggest ways that Ubuntu (...) and Confucianism might have something to learn from each other and perhaps come closer. We hope that our preliminary reflections can inspire further debate and thinking on a theme – dialogues between long-standing and large-scale non-Western traditions – that is bound to increase in importance as non-Western societies play a greater role in the global system and as the search continues for a 'global ethic'. The aim of this book is to provide an in-depth account of Hegel’s writings on human action as they relate to contemporary concerns in the hope that it will encourage fruitful dialogue between Hegel scholars and those working in the philosophy of action. During the past two decades, preliminary steps towards such a dialogue were taken, but many paths remain uncharted. The book thus serves as both a summative document of past interaction and a promissory note of things to come. (...) Equivalences and translations between consequence relations abound in logic. The notion of equivalence can be defined syntactically, in terms of translations of formulas, and order-theoretically, in terms of the associated lattices of theories. W. Blok and D. Pigozzi proved in [4] that the two definitions coincide in the case of an algebraizable sentential deductive system. A refined treatment of this equivalence was provided by W. Blok and B. Jónsson in [3]. Other authors have extended this result to the cases of (...) k-deductive systems and of consequence relations on associative, commutative, multiple conclusion sequents. Our main result subsumes all existing results in the literature and reveals their common character. The proofs are of order-theoretic and categorical nature. (shrink)

Neuroscientists are increasingly put into situations which demand critical reflection about the ethical and appropriate use of research tools and scientific knowledge. Students or trainees also have to know how to navigate the ethical domains of this context. At a time when neuroscience is expected to advance policy and practice outcomes, in the face of academic pressures and complex environments, the importance of scientific integrity comes into focus and with it the need for training at the graduate level in the (...) responsible conduct of research . I describe my experience teaching RCR in a graduate neuroscience program and identify three personal reflections where further dialogue could be warranted: mobilizing a common set of competencies and virtues standing for professionalism in the neurosciences; tailoring RCR for the neurosciences and empowering students through the active engagement of mentors; soliciting shared responsibility for RCR training between disciplines, institutions and governmental or funding agencies. Early discussions of ?climate justice? have been dominated by economists rather than political philosophers. More recently, analytical liberal political philosophers have joined the debate. However, the philosophical discussion of climate justice remains in its early stages. This paper considers one promising approach based on human rights, which has been advocated recently by several theorists, including Simon Caney, Henry Shue and Tim Hayward. A basic argument supporting the claim that anthropogenic climate change violates human rights is presented. Four objections to this (...) argument are examined: the ?future persons? objection; the ?risk? objection; the ?collective causation? objection; and the ?demandingness? objection. This critical examination leads to a more detailed specification and defence of the claim that anthropogenic climate change violates human rights. (shrink)

This paper deals with an unpublished lead seal was found during the excavation works within the chandler’s workshop of Vatopedi, a later structure which was added to the eastern face of the bell tower (1427). The seal names a Constantine, chartoularios and epi tou patriarchikou sekretou and dates back to 10th till early 11th century. It is one of the rare direct sources regarding the very early period of the monastery, from which we have no other information, and (...) serves to highlight the attention which the central ecclesiastical administration placed upon it already from the first years after its founding. Psychological eudaimonism is the view that we are constituted by a desire to avoid the harmful. This entails that coming to see a prospective or actual object of pursuit as harmful to us will unseat our positive evaluative belief about that object. There is more than one way that such an 'unseating' of desire may be caused on an intellectualist picture. This paper arbitrates between two readings of Socrates' 'attack on laziness' in the Meno, with the aim of constructing a (...) model of moral education based on PE's implied moral psychology. In particular, we argue against the view that when we come to see - through prudential reasoning - that our blatant evaluative beliefs and desires disserve eudaimonism, we will no longer perceive their intentional objects as choice-worthy. We suggest, instead, that it is by experiencing shame that we cease to see the intentional objects of our evaluative beliefs and desires as worthy of pursuit. This form of 'hydraulic education' bypasses reason-responsiveness altogether. As such, it only allows for practical norms to be derived from the nature of agency indirectly, namely by enabling the use of discursive practical reasoning. (shrink)

In the article “Nudging and Informed Consent”, Cohen argues that the use of “nudging” by physicians in the clinical encounter may be ethically warranted because it results in an informed consent where obligations for beneficence and respect for autonomy are both met. However, the author's overenthusiastic support for nudging and his quick dismissal of shared decision-making leads him to assume that “soft” manipulation is un-problematic and that “wisdom” on the side of medical professionals will suffice to guard against abuse. Opposing (...) this view, we propose that: 1) patient preferences and values should not be boiled down to rational or irrational decisions based on cognitive reasoning alone, 2) potential threats to the physician-patient must be mitigated and could be minimized by employing alternative strategies that acknowledge the impact of cognitive heuristics in shaping decision-making but maintain transparency and trust, and 3) patient preferences and values can be legitimately influenced only under specific circumstances. The latter include: (1) exhaustion of other means; (2) evidence that nudging is effective in a specific context; (3) evidence of clear and active public misinformation (e.g., industry promoting smoking); (4) explicit pubic dialogue between various stakeholders including medical professional societies about nudging; (5) upholding shared decision-making as a preferred approach; and (6) a rich understanding of clinical reality beyond the simple dichotomy of beneficence-autonomy. This article explores the ways in which naturism articulates a set of relationships between the body and nature. We begin by sketching the histories of some Western naturist movements, tracing their lineage back to 19th-century life reform movements and through into inter-war reorientations of citizenship and morality. We consider the problematic of the naked body's relationship to the erotic (and specifically to the erotics of nature), drawing on some materials on outdoor sex; set alongside this is a discussion of the (...) regenerative use of wilderness in the mythopoetic men's movement. These strands are finally drawn together in order to consider the complex negotiation of discourses of nature, human nature, the natural body and the natural landscape - a negotiation embodied in naturism. In the age of surveillance capitalism, the prevailing business model underlying the use of social media applications (“apps”) foresees the exchange of personal data for the allowance to use an online service. Such a data business model comes with many potential negative side effects ranging from violation of privacy issues to election manipulation. Therefore, it is of utmost importance to think of alternatives to the current data business model. The present study investigated how strong the support would be for a (...) monetary payment model among a sample of 210 participants. Participants were asked about their willingness to pay for social media, if in turn their data would be private and other problems concerning social media use would be tackled. Only one-fifth of participants (21.43%) supported such a model. From the Big Five Personality traits, Agreeableness was positively associated with support of such a model. Finally, data are also provided on how much participants would be willing to pay for social media on a monthly basis. The present study’s findings are of a preliminary nature and will contribute to the start of an important discussion. (shrink)

The central result of this paper provides a simple equational basis for the join, IRLLG, of the variety LG of lattice-ordered groups (-groups) and the variety IRL of integral residuated lattices. It follows from known facts in universal algebra that IRLLG=IRL×LG. In the process of deriving our result, we will obtain simple axiomatic bases for other products of classes of residuated structures, including the class IRL×s LG, consisting of all semi-direct products of members of IRL by members of LG. In this article the Reformer Martin Luther is to be situated against the backdrop of his medieval theological context – considering especially Bernard of Clairvaux. It is well-known that he held in great esteem Bernard and the theology he represented. First of all, Luther's relationship to Bernard is to be investigated by way of a historiographic review of the research that was done in the past 150 years. How did one consider Luther’s attitude toward Bernard, and how did Luther research (...) specifically value this attitude? In this research, denominational positions appear to have played a important role. Secondly, the attempt is made here to sketch Bernard’s place in Luther’s own tradition. Next to the medieval scholastic theology, there were diverse other influences that became important for the young Luther. Bernard’s specific place within the complexity of medieval traditions is to be determined. This is being explained by presenting seven significant texts mainly from Luther’s works, which are added to this article. Finally, the attempt is made to determine more closely Bernard’s place in Luther’s theology between Scholasticism and Mysticism. If one wants to do justice to Bernard in Luther's works, one must take into consideration the way in which Luther has perceived him, namely as a theologian of the Scriptures, a theologian of experience and a preacher of Christ par excellence along the lines of monastic theology. Modes of engagement. The reader may engage with this article in several different modes. It could be approached in straightforward, if quirky, sociological mode as an exploration of the idea that the literature on post‐divorce arrangements and step‐families, and especially literature, that attends to children's contact with their non‐resident fathers, can be re‐read in order to consider the issue of contact via communication technologies, a form of parent‐child contact not captured in the ways that ‘contact’ is measured in present studies. (...) Of interest in itself, perhaps, this point of entrance opens up onto further questions about the management of human affect, and how rearrangements in lines of affect have reverberations beyond those captured by an Oedipal model, insofar as they are not about contact and severance but are various kinds of displacement for all involved. In particular, I am concerned here with the rearrangement of affect for the fathers as their role becomes dispersed, shared and intermittent, a set of problematics that also includes the various ways in which the very body of the mother is removed or circumvented. On a second level the article speaks to a different literature, in that it is an elaboration of the notion of the network as a dispersed hybrid that entails both human and non‐human entities, within which any absolute distinction between human and non‐human is to be prob‐lematised but, I wish to argue, without losing the specificity of human interaction, that is, the questions of human emotion, human desire and human ethics. This elaboration moves toward a critique of the very ubiquity and endless utility of the network idea through the suggestion that its appeal may conceal moments and movements where more unexpected effects are taking place. Indeed, I suggest that there may be some twists in the familial dynamics of ‘households that no longer hold’, where some selected thoughts from a reading of Deleuze and Guattari, specifically around the notion of ‘becoming’, may lead one to read other stories than that proffered through the master trope of the network, ones that are maybe closer to some of the original impulses behind actor‐network theory. And thirdly, the article may be engaged as a reflection on contemporary ways in which familial life is governed in contemporary Britain. The family as both a site of economic arrangements and a site of the arrangement of human affect‐sexuality‐reproduction, are held together and in tension through forms of contemporary government of the family. Contemporary rationalities of familial morality seek to make its members responsible parents without intervening to the extent that they would seek to make them responsible spouses, seen here in the implication that fathers' economic responsibilities for children are not co‐extensive with their emotional connections to women.1 As opposed to any other familial figure ‐ such as the pater familias or the mother of Donzelot's thesis ‐who may have been the link between family and government, it is through the promotion of the figure of the child that familial life is presently and predominantly governed. It is my contention here that it is through the promise of non‐government that a notion of an ethical parent is promoted, whose duties to his children and his nation‐state should mean that the former should not need to be dependent upon the latter. Alongside other policies that seek to simultaneously promote familial life and paid work‐life through the notion of the ethical citizen, and the attendant judgements of those dependent on welfare state provision, contemporary policies surrounding the household that no longer holds expose the various and contradictory modes by which families are ‘made up’ within contemporary regimes.
