ABSTRACTThis powerful piece by Shain Jackson introduces us to the bringer of natural law and justice to the shishalh people, Ch’as-kin, the Golden Eagle. Sadly, Ch’as-kin does not remain forever to continue guiding the people to maintain the good ways set out for them. The story Shain tells goes on to paint a picture of the pain, loss, death and suffering that follows when we are left without a protective spirit guide. Like all great stories of courage, redemption (...) and reconciliation, it is up to the people to find their way back to the good life; to a place of justice, healing and a re-newed way of living. The Protestant ethic — a moral code stressing hard work, rigorous self-discipline, and the organization of one's life in the service of God — was made famous by sociologist and political economist Max Weber. In this brilliant study (his best-known and most controversial), he opposes the Marxist concept of dialectical materialism and its view that change takes place through "the struggle of opposites." Instead, he relates the rise of a capitalist economy to the Puritan determination to work out anxiety over (...) salvation or damnation by performing good deeds — an effort that ultimately discouraged belief in predestination and encouraged capitalism. Biohacking involves individuals determining, developing, and directing relevant activities to meet their personal biological goals. Biohacking fertility is a resilient method that trans and genderqueer people use to meet their reproductive and family-planning needs in the face of historic medical marginalization and oppression. In this study, nine participants were recruited from three different Facebook groups specific to queer and trans fertility, family planning, pregnancy, and parenting. Each participant’s posts and comments to their respective Facebook group(s) were analyzed, followed by interviews (...) with participants. A total of 1,155 Facebook posts were collected. Biohacking activity—understood as a web of activity including gathering information, applying knowledge to personal circumstances, and sharing personal experiences and knowledge—was found in each of the three groups. Participants identified these online groups as safer spaces to learn more about their own fertility and find community. Participants were active in these groups to biohack their fertility at home and to become empowered at the doctor's office or fertility clinic, ultimately achieving agency in their fertility and family planning. This book is a defense of the methods of analytic philosophy against a recent empirical challenge to the soundness of those methods. The challenge is raised by practitioners of “experimental philosophy” and concerns the extent to which analytic philosophy relies on intuition—in particular, the extent to which analytic philosophers treat intuitions as evidence in arguing for philosophical conclusions. Experimental philosophers say that analytic philosophers place a great deal of evidential weight on people’s intuitions about hypothetical cases and thought experiments. This (...) book argues that this view of traditional philosophical method is a myth, part of “metaphilosophical folklore.” Analytic philosophy makes regular use of hypothetical examples and thought experiments, but philosophers argue for their claims about what is true or not true in these examples and thought experiments. It is these arguments, not intuitions, that are treated as evidence for the claims. The book discusses xphi and some recent xphi studies; critiques a variety of other metaphilosophical claims; examines such famous arguments as Gettier’s refutation of the JTB theory and Kripke’s Gödel Case argument against descriptivism about proper names, and shows that they rely on reasoning rather than intuition; and finds existing critiques of xphi, the “Multiple Concepts” and “Expertise” replies, to be severely lacking. The book "Philosophical Foundations of Neuroscience" is an engaging criticism of cognitive neuroscience from the perspective of a Wittgensteinian philosophy of ordinary language. The authors' main claim is that assertions like "the brain sees" and "the left hemisphere thinks" are integral to cognitive neuroscience but that they are meaningless because they commit the mereological fallacy—ascribing to parts of humans, properties that make sense to predicate only of whole humans. The authors claim that this fallacy is at the heart of Cartesian (...) dualism, implying that current cognitive neuroscientists are Cartesian dualists. Against this claim, we argue that the fallacy cannot be committed within Cartesian dualism either, for this doctrine does not allow for an intelligible way of asserting that a soul is part of a human being. Also, the authors' Aristotelian essentialistic outlook is at odds with their Wittgensteinian stance, and we were unconvinced by their case against explanatory reductionism. Finally, although their Wittgensteinian stance is congenial with radical behaviorism, their separation between philosophy and science seems less so because it is based on a view of philosophy as a priori. The authors' emphasis on the a priori, however, does not necessarily commit them to rationalism if it is restricted to conceptual or analytical truths. (shrink)

Advocates of conceptual engineering as a method of philosophy face a dilemma: either they are ignorant of how conceptual engineering can be implemented, or else it is trivial to implement but of very little value, representing no new or especially fruitful method of philosophizing. Two key distinctions frame this dilemma and explain its two horns. First, the distinction between speaker’s meaning and reference and semantic meaning and reference reveals a severe implementation problem for one construal of conceptual engineering. Second, the (...) distinction between stipulating meanings and conceptually analyzing allows us to see why, on another construal of what conceptual engineering involves, the practice is neither a new nor neglected philosophical methodology. The article also argues that semantic externalism is not the root of the implementation problem for conceptual engineering, and that the usual rationale for adopting the practice, one that ties its value to the amelioration of “conceptual defects”, is unsound. I explore physics implications of the External Reality Hypothesis (ERH) that there exists an external physical reality completely independent of us humans. I argue that with a sufficiently broad definition of mathematics, it implies the Mathematical Universe Hypothesis (MUH) that our physical world is an abstract mathematical structure. I discuss various implications of the ERH and MUH, ranging from standard physics topics like symmetries, irreducible representations, units, free parameters, randomness and initial conditions to broader issues like consciousness, parallel universes and (...) Gödel incompleteness. I hypothesize that only computable and decidable (in Gödel’s sense) structures exist, which alleviates the cosmological measure problem and may help explain why our physical laws appear so simple. I also comment on the intimate relation between mathematical structures, computations, simulations and physical systems. (shrink)

Max Schelers Magnum Opus aus dem Jahr 1913/16 kann als der gründlichste und umfassendste Entwurf einer am Personenbegriff orientierten und auf die Objektivität von Werten setzenden Ethik angesehen werden. Vor dem Hintergrund der Phänomenologie Husserls und in kritisch distanzierender Würdigung der Kantischen Philosophie entwickelt Scheler die Grundlagen der Praktischen Philosophie, indem er die Fülle der menschlichen Wirklichkeit in all ihren Facetten ernst nimmt, um sie zugleich vor dem Hintergrund eines materialen Wertaprioris verständlich zu machen. Die Kritik an formalen Ethikentwürfen und (...) die Zurückweisung von utilitaristischen Ansätzen entwickelt sich vor dem Hintergrund einer subtilen Diskussion des Wertbegriffs, einer höchst differenzierten Analyse der Rangordnung von Werten und einer Phänomenologie der Person, die bis heute einschlägig und wirksam ist. Neben dem Gesamtentwurf besticht die Schelersche Schrift durch feingliedrige phänomenologische Analysen zu einzelnen Fragestellungen, die auch nach einem Jahrhundert nicht an Brisanz verloren haben. Hierzu zählen u.a. die Ausführungen zur Leiblichkeit, die Diskussion der Gefühle oder die Konzeption des Liebesbegriffs. Hundert Jahre nach der Erstveröffentlichung 1913/1916 erscheint Schelers Hauptwerk in einer kritischen Fassung als Ausgabe letzter Hand. Der Text wird durch eine Einleitung und einen editorischen Bericht sowie Begriffs-, Personen- und Literaturregister erschlossen. In Part 1 of this article, the legal and scientific origins of the concept of psychological safety are examined as background to, and support for, the new Canadian National Standard on Psychological Health and Safety in the Workplace (CSA Z1003/bnq 9700). It is shown that five factors influencing psychological safety can be identified as being common to both legal and scientific perspectives: job demands and requirements of effort, job control or influence, reward, fairness, and support. This convergence of evidence from (...) legal and scientific perspectives creates a powerful case for the development of a national standard built around these five factors. In Part 2, it is proposed that the introduction of a national standard can be expected in the long run to have positive social benefits since the health or harm that is generated in the workplace does not remain there but migrates into families, communities, and society at large in the form of either social capital or social exhaust. Consequently, psychological safety is a concept that connects the dynamics of the workplace to the health, resilience, and well-being of society at large. (shrink)

There seem to be topics on which people can disagree without fault. For example, you and I might disagree on whether Picasso was a better artist than Matisse, without either of us being at fault. Is this a genuine possibility or just apparent? In this paper I pursue two aims: I want to provide a systematic map of available responses to this question. Simultaneously, I want to assess these responses. I start by introducing and defining the notion of a faultless (...) disagreement. Then I present a simple argument to the conclusion that faultless disagreement is not possible. Those who accept the argument have to explain away apparent cases of faultless disagreement. Those who want to maintain the possibility of faultless disagreement must deny one of the argument's premisses. The position I want to promote belongs to the latter category and is a form of genuine relativism. (shrink)

Utilitarians think that what matters in ethics is making the world a better place. In that case, it might seem that we each rationally ought to do our best—perform the actions, out of those open to each of us, with the best expected outcomes. In other words, we should follow act-utilitarian reasons. But often the result of many altruistic agents following such individualistic reasons is worse than the result of them following collectivist ‘team-reasons’. So utilitarians should reject act utilitarianism, and (...) accept a dualist view according to which both individualistic and team reasons are fundamental. In order to align these distinct kinds of reason, utilitarians must focus centrally on questions of political and social reform—as did their historical forebears. (shrink)

Between States is the first book that assesses systematically the broad implications of interim governments in the establishment of democratic regimes and on the existence of states. Based on historical and contemporary democratisation experiences, the book presents four ideal types of interim government: opposition-led provisional governments, power-sharing interim governments, incumbent-led caretaker governments, and international interim government by the United Nations. The first part explores the theoretical problems of each of these models from a broad comparative perspective. It uses as illustrations (...) historical and contemporary cases that present a wide spectrum of contexts for comparison. The second part provides extensive case studies that are intended to illustrate, appraise, amplify and criticise the analysis in volume one. Many environmentalists believe that religion has been a major contributor to our ecological crisis, for Judeo-Christians have been taught that they have dominion over the earth and so do not consider themselves part of a biotic community. In this book a philosopher of environmental ethics acknowledges that religion may contribute to environmental problems but argues that religion can also play an important role in solving these problems―that religion can provide an ethical context that will help people to become sensitive to (...) the environment and to elect leaders who are genuinely responsive to the ecological crisis. Examining a broad range of Western religious traditions―from conservative Christianity and orthodox Judaism to Goddess feminism and nature religion―Max Oelschlaeger provides a sociolinguistic analysis of their creation stories and finds environmentally positive aspects in each of them. He asserts that religious discourse in the public arena can offer a way for such environmental issues as biodiversity, pollution, and population to be addressed outside the realm of special-interest politics. And he urges local churches to make "caring for creation" a theme for worship in their services; the majority of Americans, says Oelschlaeger, will discover an environmental ethic only through their religious faith. Research has confirmed the existence of a robust relationship between certain conditions of work (high demand/low control, high effort/low reward) and a variety of adverse health outcomes including cardiovascular disease, mental disorders, and immune system dysfunctions. Recently, these same conditions have been implicated in the defeat of certain capacities, such as adaptability, coping, ability, memory, and creativity. Such conditions appear also to influence the likelihood of making successful recovery from illness or injury and of returning to productive employment. The dynamic (...) processes linking these conditions and outcomes nonetheless remains somewhat unclear. In this article, the role of fairness as a mediator of these connections is explored. In particular, the psychoneuro- immunological significance of promises explicit or implicit in the employment relationship is identified as being crucial to our understanding of how stress affects health and capacities. Bayesianism is the predominant philosophy of science in North-America, the most important school of statistics world-wide, and the general version of the rational-choice approach in the social sciences. Although often rejected as a theory of actual behavior, it is still the benchmark case of perfect rationality. The paper reviews the development of Bayesianism in philosophy, statistics and decision making and questions its status as an account of perfect rationality. Bayesians, who otherwise are squarely in the empiricist camp, invoke a priori (...) reasoning when they recommend Bayesian methods - a recommendation that is not justified by their own standards. The most important of these are the early Heidegger: The Question of Being and History (1964–65) (...) and Theory and Practice (1975–76), no parts of which were published by Derrida. Substantial portions of the first volume of the lectures on Perjury and Pardon were published as separate essays, so the main question concerning this book is what it adds to the published portions.For those readers who are familiar with Derrida's most famous work and are curious about his deconstructive ethics ("ethics beyond ethics") and have not read any of the essays drawn from this book (such as "To Forgive: the Unforgiveable and the Imprescriptible," "Literature in Secret," and "Typewriter Ribbon"), this is a good place to approach the topic. One will find here many of Derrida's classic moves, such as the deconstruction of texts, concepts, and traditions. One will find conditions of possibility that are also conditions of impossibility, concepts that are contaminated from within by their opposites, and appeals to the experience of the impossible and to the distinction between a general and restricted economy.One will also find here those points that seem to be Derrida's weakest, such as the insistence on the privacy of the mental, a rather wobbly treatment of the separation between intending and causality, and the [End Page 545] claim, important for Derrida's "poetico-performative" theory of truth, that all constatives depend on a prior performative—a promise to tell the truth, always already contaminated by failure and hence a "perjury." (The first and third of these are also found in Derrida's published work.)The topics in this book are helpful in situating Derrida vis-à-vis other thinkers, especially those in the Frankfurt School. Derrida's concept of an impossible, paradoxical pardon might be compared with Adorno's concept of utopian moments. The promise of truth implicit in every constative might be compared with Habermas's quasi-transcendental ideal speech situation.Even if one has read one or more of the published portions, if one is unsure how they fit together, these lectures will allow one to see how they cohere. In the third session Derrida provides an outline of the project, which he qualifies with the comment that "I am aware of the grossly schematic character of this outline." Grossly schematic, yes, but grossly schematic outlines are very helpful. Here's the gist of the outline: "stubbornly tracking down in the Biblio-Koranic tradition a logic of economy, an economy, a sublime ruse which... comes to contradict and undermine a demand for finite-infinite forgiveness, forgiveness without condition, the aneconomic forgiveness that is nevertheless at the heart of this same thinking... showing that on the supposed Greek side, the aneconomic notion of forgiveness comes to organize the aneconomic logic and 'syngnomic' rationality of a so-called Greek culture." In short, the concept of forgiveness that is derived from the monotheistic traditions of forgiveness claims not to be pragmatic or goal oriented, but Derrida shows that it is, whereas the Greek concept that is the closest equivalent, and is supposed to be entirely pragmatic, has moments that exceed any limited economy. Derrida's verbal elucidations of the typescript are transcribed from recordings and placed in footnotes. There are quite a few of these, and some of them are interesting. The editorial apparatus will allow one to confirm that one has indeed read all of the published parts, which one should not take for granted since a couple of them are in relatively obscure venues. While industrial wind turbines (IWTs) clearly raise issues concerning threats to the health of a few in contrast to claimed health benefits to many, the trade-off has not been fully considered in a public health framework. This article reviews public health ethics justifications for the licensing and installation of IWTs. It concludes that the current methods used by government to evaluate licensing applications for IWTs do not meet most public health ethical criteria. Furthermore, these methods are contrary to widely held (...) fundamental principles of administrative law and governmental legitimacy. A set of decision-making principles are suggested to address this situation that are derived from existing and emerging legal principles in Canada and elsewhere. These include the Precautionary Principle, the Least Impactful Means (Proportionality) Test, and the Neighbor Principle. (shrink)

Although science and law employ different methods to gather and weigh evidence, their conclusions are remarkably convergent with regard to the effect that workplace stress has on the health of employees. Science, using the language of probability, affirms that certain stressors predict adverse health outcomes such as disabling anxiety and depression, cardiovascular disease, certain types of injury, and a variety of immune system disorders. Law, using the language of reasonable foreseeability, affirms that these adverse outcomes are predictable under certain conditions, (...) typically defined in relation to what a reasonable person should know. Society is arguably in a position to establish standards for the abatement of certain types of workplace stress. As part of this process, we need to conceptualize an ideal form of conduct that exemplifies the standards to which both law and science urge us to aspire. For this purpose, the concept of the neighbor at work is proposed. (shrink)
