The formal part of this chapter is concerned with measures of need-based justice. According to the measures we propose, a distribution is unjust (i) the more it deviates from absolute need satisfaction and equal degrees of need satisfaction, (ii) the more the given undersupply could have been mitigated by transfers, or (iii) the more resources are used for oversupply instead of need satisfaction. These measures are compared, i.e., as to the satisfaction of need-oriented relatives of axioms prominent in poverty measurement; (...) and we have a critical eye on the proposals of Jasso and Miller. The empirical part reports on three vignette studies conducted to find out how people evaluate the justice of given distributions and how they distribute goods when aiming at justice. The main goal was to measure the significance ascribed to need. This significance was compared with the significance ascribed to effort or equality; and it was shown that a need’s influence decreases when the corresponding person is accountable for having a higher amount of it. In the third study, we found out that needs that are not directed at bare survival, such as the need for participation in social life, are attributed lower degrees of importance. The chapter concludes with some implications of our research for a theory of need-based justice. (shrink)

We present a vignette study conducted with a quota sample of the German population (n = 400). Subjects had to redistribute a good between two hypothetical persons who contributed equally to the available amount but differed in quantity needed and the reason for their neediness. On a within-subjects level, we tested for the effects of need, accountability, and resource availability on their third-party distribution decisions. Between subjects, we further varied the kinds of needs: The persons either needed the good as (...) a means to survive, to live a decent life, to participate in society, or to be autonomous. Despite equal productivity, the mean share allocated to the needier person was significantly higher than an equal share. However, this share turned out significantly smaller when the needier person was accountable for needing more than the other. Nonetheless, even if accountable, the needier person still got a share larger than their contribution would suggest. When there was a surplus of resources, the needier person got an even higher share than when resources were scarce. (shrink)

Bedürfnisse sind etwas, das uns als Menschen grundlegend bestimmt. Der vorliegende Band fasst eine Reihe von Vignettenstudien zusammen, in denen untersucht wird, welche Rolle Bedürfnisse im Umgang mit Problemen der Verteilungsgerechtigkeit spielen. Während sie in Diskussionen zur Verteilungsgerechtigkeit häufig eher unterrepräsentiert sind, wird hier gezeigt, dass sie eine fundamentale Bedeutung im Denken der Menschen haben. Es wird unter anderem deutlich, dass unparteiischen Beobachter*innen graduelle Gerechtigkeitseinschätzungen von Verteilungssituationen vornehmen, die davon abhängig sind, wie umfangreich die beobachteten Parteien mit einem Gut ausgestattet (...) sind. Wenn außerdem bekannt ist, wie hoch deren Bedarf an jenem Gut ist, finden die Einschätzungen relativ zu diesem Referenzpunkt statt. Außerdem werden in der Rolle von unparteiischen Entscheider*innen hypothetische Verteilungsentscheidungen getroffen, die den Bedarf, die Leistung sowie die Verantwortung der betroffenen Parteien berücksichtigen. Hierbei wird der Bedarf einer Partei auch dann zumindest teilweise kompensiert, wenn diese weniger zu der zur Verfügung stehenden Gütermenge beigetragen hat, als sie selbst benötigt. Die Bereitschaft, den Bedarf einer Partei teilweise zu kompensieren, sinkt jedoch, wenn sie dafür verantwortlich ist, mehr als andere zu benötigen oder weniger als andere beigetragen zu haben. Und sowohl in der Rolle von unparteiischen Beobachter*innen als auch in der Rolle von unparteiischen Entscheider*innen wird zwischen unterschiedlichen Bedarfsarten unterschieden, deren Erfüllung verschiedene Wichtigkeit beigemessen wird. Unter dem Dach der Philosophie gingen empirische Forschung und normative Theorie lange Zeit Hand in Hand, bis sie spätestens um die Zeit der Emanzipation der Einzelwissenschaften in eine schwierige, nicht immer eindeutig bestimmbare Beziehung zueinander traten; dieses unterbestimmte Verhältnis tritt uns vor dem Hintergrund aktueller Debatten wieder entgegen. Das zeigt sich zum Beispiel auch bei Fragen der Ethik: In den letzten Jahrzehnten zeigten verschiedene wissenschaftliche Disziplinen verstärktes Interesse an empirischen Bemühungen um ein deskriptives Verständnis von Moral. Hier gibt es nach (...) wie vor eine starke Trennung zwischen den Bereichen der normativen Theorie einerseits und der empirischen Forschung andererseits, wobei in beiden Bereichen dazu tendiert wird, die jeweils anderen Diskurse zu vernachlässigen, wobei Unklarheit über die Möglichkeiten und Grenzen einer fruchtbaren Integration herrscht. Auf der anderen Seite gibt es jüngst auch verschiedene Versuche einer Integration beider Domänen. – Dies macht einen Diskurs über die Bestimmung des Verhältnisses von empirischer Forschung und normativer Theorie nötig, was in diesem Band aus verschiedenen historischen sowie systematischen Perspektiven geleistet wird. The subjective time of an instrumental action is shifted towards its outcome. This temporal binding effect is partially retrospective, i.e., occurs upon outcome perception. Retrospective binding is thought to reflect post-hoc inference on agency based on sensory evidence of the action – outcome association. However, many previous binding paradigms cannot exclude the possibility that retrospective binding results from bottom-up interference of sensory outcome processing with action awareness and is functionally unrelated to the processing of the action – outcome association. Here, (...) we keep bottom-up interference constant and use a contextual manipulation instead. We demonstrate a shift of subjective action time by its outcome in a context of variable outcome timing. Crucially, this shift is absent when there is no such variability. Thus, retrospective action binding reflects a context-dependent, model-based phenomenon. Such top-down re-construction of action awareness seems to bias agency attribution when outcome predictability is low. (shrink)

Need considerations play an important role in empirically informed theories of distributive justice. We propose a concept of need-based justice that is related to social participation and provide an ethical measurement of need-based justice. The β-ε-index satisfies the need-principle, monotonicity, sensitivity, transfer and several »technical« axioms. A numerical example is given.

Needs play a key role in many fields of social sciences and humanities, ranging from normative theories of distributive justice to conceptions of the welfare state. Over time, different conceptions of what counts as a need (i. e., what is considered a normatively relevant need) have been proposed. Many of them include (in one way or the other) needs for survival, decency, belonging, and autonomy. Little work has been done on how these kinds of needs are evaluated in terms of (...) their significance for distributive justice. To begin closing this gap, we investigate the role of the four aforementioned kinds of needs for impartial observers. We do so in two empirical studies. The first study asks participants to evaluate the importance of each of the four kinds of needs separately. We find that different levels of importance are attributed to the kinds of needs, which places them in a hierarchy. The second study asks participants to make distributive decisions. Results further support the hierarchy found in the first study and, additionally, reveal that participants tend to make coherent allocation decisions. (shrink)

In attempts to compare different distributions with regards to need, so-called “measures of need-based distributive justice” have emerged in recent years. Each of the proposed measures relies on a single dimension of need that is taken into account. This is shown to be problematic since humans experience different kinds of need that appear to be incommensurable. A strategy to deal with this problem is introduced by using multidimensional measures.

We report the results of a vignette study with an online sample of the German adult population in which we analyze the interplay between need, equity, and accountability in third-party distribution decisions. We asked participants to divide firewood between two hypothetical persons who either differ in their need for heat or in their productivity in terms of their ability to chop wood. The study systematically varies the persons’ accountability for their neediness as well as for their productivity. We find that (...) participants distribute significantly fewer logs of wood to persons who are held accountable for their disadvantage. Independently of being held accountable or not, the needier person is partially compensated with a share of logs that exceeds her contribution, while the person who contributes less is given a share of logs smaller than her need share. Moreover, there is a domain effect in terms of participants being more sensitive to lower contributions than to greater need. (shrink)

Verteilungsgerechtigkeit befasst sich mit der Verteilung von Gütern innerhalb einer Gruppe, wobei verschiedene Verteilungsprinzipien und -ergebnisse als mögliche Ideale einer solchen Verteilung verhandelt werden. Diese normativen Ansätze sind oft rein verbal formuliert, wodurch ihre Anwendung auf unterschiedliche konkrete Verteilungssituationen, die hinsichtlich ihrer Gerechtigkeit beurteilt werden sollen, häufig schwer fällt. Eine Möglichkeit, fein abgestufte Gerechtigkeitsbeurteilungen verschiedener Verteilungen präzise erfassen zu können, besteht in der formalen Modellierung solcher Ideale durch Maße oder Indizes. Die Auswahl eines geeigneten Maßes, das ein gewisses Ideal abbilden (...) soll, muss ihrerseits eine Fundierung erfahren, was durch die Forderung von begründeten Axiomen erreicht werden kann, denen ein Maß genügen soll. In der vorliegenden Arbeit werden solche Axiome für Maße der Verteilungsgerechtigkeit am Beispiel von Bedarfsgerechtigkeit eingeführt. Ferner werden exemplarische Maße der Bedarfsgerechtigkeit vorgestellt. Damit wird für die Beurteilung und Modellierung von Maßen der Verteilungsgerechtigkeit eine erste diskutable Grundlage gelegt. Distributive justice deals with allocations of goods and bads within a group. Different principles and results of distributions are seen as possible ideals. Often those normative approaches are solely framed verbally, which complicates the application to different concrete distribution situations that are supposed to be evaluated in regard to justice. One possibility in order to frame this precisely and to allow for a fine-grained evaluation of justice lies in formal modelling of these ideals by metrics. Choosing a metric that is (...) supposed to map a certain ideal has to be justified. Such justification might be given by demanding specific substantiated axioms, which have to be met by a metric. This paper introduces such axioms for metrics of distributive justice shown by the example of needs-based justice. Furthermore, some exemplary metrics of needs-based justice and a three dimensional method for visualisation of non-comparative justice axioms or evaluations are presented. Therewith, a base worth discussing for the evaluation and modelling of metrics of distributive justice is given. (shrink)

We examine the role of need satisfaction in non-comparative justice ratings about endowments with goods. As normative approaches, we discuss utilitarianism, prioritarianism, and sufficientarianism. Using a vignette experiment, we show that a need context increases the prevalence of prioritarianistic and sufficientarianistic justice ratings, which leads to an ethically problematic sigmoid shape of the justice evaluation function.

Two questions often shape our view of the world. On the one hand, we ask what there is, on the other hand, we ask what there ought to be. Empirical research and normative theory, the methodological traditions concerned with these questions, entered a difficult relationship, from at least as early as around the time of the advent of modern sciences. To this day, there remains a strong separation between the two domains, with both tending to neglect discourses and results from (...) the other. Contrary to a verdict of strict segregation between »is« and »ought«, there are, nowadays, various attempts to integrate both theoretical approaches. This calls for a newly intensified discourse on the relation between empirical research and normative theory. In this volume, scholars from different disciplines – including psychology, sociology, economics, and philosophy – discuss possible desired or undesired influences on, and limits of, the integration of these two approaches. Dabei sind historisch verschiedenste Positionen verhandelt worden. Es soll nicht versucht werden, eine Antwort auf die Frage nach der Möglichkeit zu liefern; vielmehr sollen methodische Überlegungen zur Klärung der Frage in den Fokus gerückt werden. Es wird gezeigt, dass die eigentliche Frage präzisierungsbedürftig ist. Exemplarisch wird ein ausgewählter Präzisierungsversuch aus dem zeitgenössischen Diskurs kritisch beleuchtet und ihm wird ein (...) Verständnis der Frage entgegengesetzt, das die Diskussion um die Möglichkeit eines doxastischen Voluntarismus in einen neuen Rahmen einbetten kann. (shrink)

Measures of need-based justice that have been proposed lately rely on a single dimension of need that is taken into account. This is shown to be problematic since humans experience different kinds of need that appear to be incommensurable.

Livengood and Sytsma (2020) challenge the Compositionality Constraint of Actual Causation (CCAC), according to which each intermediary of a causal chain is an effect of its predecessor and a cause of its successor link. In several studies, they find support for their hypothesis that the CCAC is not in accordance with ordinary causal attributions of laypeople. We argue that there are three interrelated problems in their studies’ design that we call the Causality-Responsibility Confusion (CRC), the Intermediary-Ontology Confusion (IOC), and the (...) Cause-End Questioning (CEQ). Avoiding the CRC, the IOC, and the CEQ leads to strong empirical support for the CCAC. (shrink)

Jonathan Livengood and Justin Sytsma have published a series of studies on “Actual Causation and Compositionality,” in which they investigate causal attributions of laypeople. We use one of their vignettes to follow up on their research. Our findings cast doubt on their conclusion that ordinary causal attributions tend to violate the compositionality constraint if one looks at cases in which someone is responsible for an effect by way of an intermediary that does not share in the responsibility.

The role that need plays in dealing with problems of distributive justice is examined in a series of vignette studies. Among other things, it becomes clear that impartial observers make gradual assessments of justice that depend on the extent to which the observed individuals are endowed with a good. If it is known how high their need for that good is, the assessments are made relative to this reference point. In addition, impartial decision-makers make hypothetical distribution decisions that take into (...) account need, productivity, and accountability. The need of individuals is partially compensated even if they have contributed less to the available amount than they themselves require. However, the willingness to do so decreases if they are accountable for needing more than others or for having contributed less than others. Lastly, both impartial observers and impartial decision-makers distinguish between different types of needs, the fulfillment of which is given different levels of importance. (shrink)

To investigate the impact of framing on rule-breaking behavior in social dilemmas, we incorporated a rule in a one-shot resource game with two framing-treatments: One frame was a give-some dilemma (i.e., a variant of a public goods game) and the other frame a take-some dilemma (i.e., a variant of a commons dilemma game). In each frame, all participants were part of one single collective sharing a common good. Each participant was initially equipped with one of five different endowments of points (...) from which they must give/could take amounts to/from the common good. The exact amounts of contributions/withdrawals were regulated by the rule. Participants decided whether to cooperate and comply with the rule or to break the rule to their own advantage and at the expense of the collective (i.e., giving lower/taking higher amounts). Results of an online-experiment with 202 participants showed a significantly higher proportion of individuals breaking the rule in the take-some frame than in the give-some frame. In addition, endowment size influenced the proportion of rule-breaking behavior in the take-some frame. However, the average amounts of points not given/taken too much were not different between the frames. (shrink)

Imagine that only the state can meet the need for housing but decides not to do so. Unsurprisingly, participants in a vignette experiment deem this scenario unjust. Hence, justice ratings increase when the living situation improves. To a lesser extent, this also holds beyond the need threshold, understood as the minimum amount necessary for a decent life. Surprisingly, however, the justice evaluation function is highly convex below this point. The resulting S-shaped curve is akin to the value function in prospect (...) theory, with the need threshold providing the point of reference and inflection. A control treatment without needs-information supports this interpretation. Needs-information furthermore compresses the perceived injustice of arbitrary inequality. As in prospect theory, such reference dependency suggests biases in judgment and decision making. A consequence may be that the lot of the poorest in society does not receive the attention it would otherwise get. (shrink)

Verschwörungserzählungen sind ein fortdauernd prominentes Thema in der nachrichtlichen Berichterstattung und treten immer wieder in Zusammenhang mit Bewegungen auf, die demokratische Strukturen zu untergraben versuchen. In der aktuellen Diskussion um Verschwörungserzählungen dominieren psychologische, politische, kultur- und sozialwissenschaftliche Perspektiven. Philosophische Zugänge hingegen scheinen dabei unterrepräsentiert zu sein. Der hier vorliegende Schwerpunkt „Verschwörungserzählungen“ soll einen Beitrag dazu leisten, diesem Mangel abzuhelfen, und das Phänomen der Verschwörungserzählungen aus verschiedenen Perspektiven insbesondere der Praktischen Philosophie zu beleuchten.

Max Stirner is generally considered a nihilist, anarchist, precursor to Nietzsche, existentialism and even post-structuralism. Few are the scholars who try to analyse his stands from within its Young Hegelian context without, however, taking all his references to Hegel and the Young Hegelians as expressions of his own alleged Hegelianism. This article argues in favour of a radically different reading of Stirner considering his magnum opus “Der Einzige und sein Eigentum” as in part a carefully constructed parody of Hegelianism deliberately (...) exposing its outwornness as a system of thought. Stirner's alleged Hegelianism becomes intelligible when we consider it as a formal element in his criticism of Bauer's philosophy of self-consciousness. From within this framework it becomes quite clear what Stirner meant with such notions as “ownness” and “egoism”. They were part of his radical criticism of the implicit teleology of Hegelian dialectics as it found according to him its highmark in Bauer. In short, this article puts the literature on Stirner into question and tries for the first time in 30 years to dismantle Stirner's entire undertaking in “Der Einzige und sein Eigentum” by considering it first and foremost a radical criticism of Hegelianism and eventually the whole of philosophy while fully engaged in the debates of his time. ☆ The author would like to thank Douglas Moggach for corresponding with me on the idea of the comic and for not sparing me his “critical criticism” in general. Scholarly research on Bruno Bauer (1809-1882) tends to focus on the continuity in Bauer’s writings throughout the 1840s, or situates the older Bauer’s conservatism well before the revolutions of 1848. This review article does not intend to settle this debate, but tries to enrich it by referring to the criticism of two of Bauer’s contemporaries: Karl Marx, and, in particular, Max Stirner. Stirner's critique of Bruno Bauer helps to illuminate the extent to which a creative (...) rendering of Hegelian philosophy was intertwined with distinct political positions, and distinct ethical programmes prior to the Revolutions of 1848. Stirner’s criticisms in fact, highlight, by way of contrast, central features of Bauer’s reformed Hegelianism. (shrink)

This paper clarifies Stirner’s relationship to his Left Hegelian contemporaries, Ludwig Feuerbch and Bruno Bauer, by showing how, in The Ego and Its Own, Stirner sought to exploit a fundamental contradiction that he perceived in the humanisitc atheism of Feuerbach and Bauer, and thereby to complete the critique of religious consciousness initiated by them. After having reconstructed Stirner’s position in relation to those of his contemporaries, the paper goes on to identify a significant weakness in it, and to (...) identify resources in Feuerbach’s program for a future philosophy that might be enlisted in response to Stirner. The author argues that the central claim underlying Stirner’s criticism of Feuerbach involves a misconception of Feuerbach’s notion of the Gattungswesen or species-essence. Furthermore, Stirner’s unmitigated epistemological relativism is ultimately incompatible with his materialist ontology. (shrink)

The Protestant ethic — a moral code stressing hard work, rigorous self-discipline, and the organization of one's life in the service of God — was made famous by sociologist and political economist Max Weber. In this brilliant study (his best-known and most controversial), he opposes the Marxist concept of dialectical materialism and its view that change takes place through "the struggle of opposites." Instead, he relates the rise of a capitalist economy to the Puritan determination to work out anxiety over (...) salvation or damnation by performing good deeds — an effort that ultimately discouraged belief in predestination and encouraged capitalism. Weber's classic study has long been required reading in college and advanced high school social studies classrooms. (shrink)

This book is a defense of the methods of analytic philosophy against a recent empirical challenge to the soundness of those methods. The challenge is raised by practitioners of “experimental philosophy” and concerns the extent to which analytic philosophy relies on intuition—in particular, the extent to which analytic philosophers treat intuitions as evidence in arguing for philosophical conclusions. Experimental philosophers say that analytic philosophers place a great deal of evidential weight on people’s intuitions about hypothetical cases and thought experiments. This (...) book argues that this view of traditional philosophical method is a myth, part of “metaphilosophical folklore.” Analytic philosophy makes regular use of hypothetical examples and thought experiments, but philosophers argue for their claims about what is true or not true in these examples and thought experiments. It is these arguments, not intuitions, that are treated as evidence for the claims. The book discusses xphi and some recent xphi studies; critiques a variety of other metaphilosophical claims; examines such famous arguments as Gettier’s refutation of the JTB theory and Kripke’s Gödel Case argument against descriptivism about proper names, and shows that they rely on reasoning rather than intuition; and finds existing critiques of xphi, the “Multiple Concepts” and “Expertise” replies, to be severely lacking.
