On 4th of August 2020, the Lebanese capital and port city, Beirut, was rocked by a massive explosion that has killed hundreds and injured thousands more, ravaging the heart of the city’s nearby downtown business district and neighbouring housing areas, where more than 750,000 people live. The waterfront neighbourhood and a number of dense residential neighbourhoods in the city’s eastern part were essentially flattened. Lebanese Government officials believe that the blast was caused by around 2,700 tonnes of ammonium nitrate stored (...) near the city’s cargo port without proper control for six years. -/- The disaster devastating Beirut’s port and city shows the latent danger of safe storage of potentially dangerous goods in modern ports, particularly ones located close to the heart of the city. The huge blast tore through major grain silos, stoking fears of shortages in a nation that imports nearly all its food and is already reeling from economic crisis. As the WFP (World Food Programme) said in a statement: the blast will “exacerbate the grim economic and food-security situation.” The Beirut blast also reminds us of the importance of ports in the contemporary globalized world. It calls our attention to safety and security, of governance and collaboration between port and city or region and of accessibility to the hinterland. What do local governments and port cities need to do to enhance the safety and security issues in port terminals? Or, to put it differently, how do we reconcile this challenge between the ports we need to feed us, serve us, provide us with medicines, equipment, etc. and the ports that threatens us? (shrink)

In "On Social Facts" (1989) and subsequent works, Margaret Gilbert has suggested a plural subject account of the semantics of ‘we’ that claims that a central or standard use of ‘we’ is to refer to an existing or anticipated plural subject. This contrasts with the more general approach to treat plural pronouns as expressions referring to certain pluralities. I argue that (i) the plural subject approach cannot account for certain syntactic phenomena and that (ii) the sense of intimacy, which Gilbert (...) cites as evidence for her plural subject account, has a different source than the existence of joint commitments constituting a respective plural subject. Moreover, (iii) there is a wide varie-ty of phenomena in the linguistic record, which, while not constituting conclusive evidence against the plural subject account, nevertheless, are dealt with better by the plurality account. ‘We’ thus refers to pluralities, which may or may not be plural subjects. The precise analysis of ‘we’ thus reveals a multi-layered ontology of groups. (shrink)

Free will is difficult to classify with respect to determinism or indeterminism, and its phenomenology in consciousness often shows both aspects. Initially, it is felt as unlimited and indeterminate will power, with the potentiality of multiple choices. Thereafter, reductive deliberation is led by determinism to the final decision, which realises only one of the potential choices. The reductive deliberation phase tries to find out the best alternative and simultaneously satisfying vague motivations, contextual conditions and personal preferences. The essential sense of (...) free will is the introduction of personal preferences, which allows a higher diversity of reactions to vague motivations. With an oversimplified model of determinism as a chain of events, incompatibilists define “free” as “undetermined” so that determinism becomes incompatible with any free choice between alternatives. In consciousness, free will requires a more complex model of network determinism as well as the consideration of unconsciousness as a causal factor. When “free” defined as “undetermined” is applied to the context of consciousness, it should be reinterpreted as “unconscious of being determined” or not aware of underlying determinism. Lacking information on determinism generates a feeling of “free” in consciousness and, therefore, gives the impression of indeterminism. Lacking information may be induced by an uncertain future without determined events—an unconscious past with biological reactions suddenly emerging from the unconsciousness or an unknown present unable to distinguish determinism of complex events. Therefore, at the level of human consciousness, the experience of free will is associated with apparent indeterminism although it is based on unconscious determinism. The concepts of compatibilism and incompatibilism are only two different aspects of the same phenomenon and correspond to consciousness and unconsciousness. Nevertheless, they can be considered together with a free will concept based on relativity depending on two different reference frames—the first person’s experience frame or the Laplace’s demon frame with knowledge on every molecule of the universe. Only relativity of the free will concept avoids the contradiction between “free” and “unfree” for the same phenomenon and could be a compromise for considering compatibilism and incompatibilism equally. After a short sketch of Lowe’s account of his four basic categories, I discuss his theory of formal ontological relations and how Lowe wants to account for dispositional predications. I argue that on the ontic level Lowe is a pan-categoricalist, while he is a language dualist and an exemplification dualist with regard to the dispositional/categorical distinction. I argue that Lowe does not present an adequate account of disposition. From an Aristotelian point of view, Lowe conflates dispositional predication with hôs epi (...) to poly statements about what is normally or mostly the case. (shrink)

Hidden in Historicism considers how the nineteenth-century philosophy of historicism depicts three "forgotten time regimes": a time of rise and fall, an ambiguous time of synchronicity of the non-synchronous, and a time in which decisive moments dominate. Before the eighteenth century, time was past-oriented. This inversed in the Enlightenment, when the future became dominating. Today, this time of progress continues to be embraced as a "time of the modern". Yet, inequality, increasing violence and climate change lead to doubts over a (...) bright future. In this book, Harry Jansen moves away from the heritage of Reinhart Koselleck and his single time of the modern towards a historicist, threefold temporal approach to history writing. In the time regime of the twenty-first century past, present and future coexist. It is a heterogeneous time that takeson the three forms of historicism. Jansen's study shows how all three times exist together in current historiography and contribute to a better understanding of the world today. Based on the idea that an incarnated time rules everything that happens it reality, the book offers a fresh perspective on the ongoing discussion about time and time regimes in contemporary philosophy and theory of history for students and scholars, both time specialists and the non-specialist. This book provides a theory of the juridification of business ethics. Ethical codes pop up everywhere in the business world and increasingly resemble the code of law. A focus on compliance rather than reflection becomes the norm. Legal perspectives replace ethical perspectives, turning ethicists into lawyers without a law degree. This juridification of business ethics conceals a diminishing trust in ethics, as legal reasoning substitutes philosophical thinking. Joe L. Kincheloe (1950-2008) was one of North America's leading critical pedagogy scholars. He defined post-formalist thought in terms of deconstruction, affectivity, and non-linearity. His deconstruction focused on the context of ideas, ideologies, and teaching. It was a form of sociological deconstruction, and as such, inspired by Derrida, but different from him as well. In effect, Kincheloe was trying to marry Derrida to Foucault by making deconstruction see power in thought, relationships, and the world. Kincheloe's 'turn to affect' was inspired (...) by feminism and radical pedagogy. It was 'affect' focused on (in)justice and the social practices of repression. His 'self-other' construct was inherently politicized by his identification of 'unfreedom' with capitalism and the assumption that this link determines affect. Kincheloe assumed that linear rationality was inadequate to understanding human needs and hopes. Freedom as dynamism was seen to be inherently non-linear. The prison of rationality (it can only repeat the same, over and over again) was the crux of his critique of Newtonian-Cartesian linearity. Kincheloe attempted to construct a concept of 'place'--such as the classroom. But it was a particular, concrete classroom and not an abstract or theoretical one. Here, the three concepts could come together. 'Place' is context, and to understand it, deconstruction is needed. 'Place' exists as it is felt and requires affectivity; it is eventful, alive, and dynamic. It requires non-linearity to be understood. Post-formalism, Pedagogy Lives (in memory of Kincheloe's contribution) encompasses each of the basic principles of Kincheloe's post-formal thought. (shrink)

What standard or principle should guide decisionmaking concerning the permissibility of allowing children to be organ donors? For a long time, it has been widely assumed that the best interest of the child is the appropriate standard. But recently, several critics have charged that this standard fails to give due weight to the interests of the family and the intimate relationships that the family makes possible.1,2 This article reviews and rejects both the best-interest standard and the alternative standard recommended by (...) the critics. I then propose a new standard to help parents, healthcare professionals, and judges decide when it is and is not permissible for children to serve as organ donors. This new standard modifies and broadens the best-interest standard to allow it to account adequately for the contribution that intimate relationships make to the well-being of children. (shrink)

Background: The intentions of clinicians are widely considered to be relevant to the ethical assessment of their actions. A better understanding of the psychological factors that influence the ascription of intentions in clinical practice is important for improving the self-understanding of clinical decision-making and, ultimately, the ethics of clinical care. Drawing on empirical research on intentionality that has been done in other contexts, this is the first study to test whether the “asymmetric effect” of intention ascription is exhibited by respondents (...) when presented with clinical decision-making scenarios. Objective: To assess how individuals attribute intentions to clinical actors in clinical decision-making scenarios. Methods: A total of 149 first and second year medical students was randomly assigned to two groups. Subjects in each group read two scenarios and submitted anonymous responses to questions regarding each scenario. Results: The asymmetric effect was strongly exhibited by the responses given to scenario 2, but it was not exhibited by the responses given to scenario 1. Conclusion: The present study provided evidence for the view that people’s ascription of intentions to others is influenced by their previous evaluative judgement of the conduct in question. Challenging and rewarding in equal measure, _Phenomenology of Perception_ is Merleau-Ponty's most famous work. Impressive in both scope and imagination, it uses the example of perception to return the _body_ to the forefront of philosophy for the first time since Plato. Sparrows fly because they are birds. This mushroom is poisonous because it is an Amanita muscaria. Pointing out the kind to which things belong explains many of their properties. Jonathan Lowe’s four-category ontology and his account of laws of nature provide a framework to account for the explanatory appeal of referring to kind membership. For Lowe, “Electron has Unit-negative charge” is a typical example for a law of nature: a kind universal characterized by a property universal. We present both Lowe’s (...) original account of laws of nature and later developments, and show how Lowe’s account can help to solve notorious problems of other accounts, namely, the regularity view and the Armstrong-Dretske-Tooley view. We argue that there are two challenges that Lowe’s view cannot master. First, Lowe conflates generics and dispositions, which is a considerable problem for Lowe, because his account of dispositional predication and his account of laws of nature are intimately connected. Second, there is the identification problem of fully specifying and identifying the formal ontological relation of characterization between kind universals and property universals. In order to solve these problems, we develop an account of formal causation inspired by Aristotle’s theory of explanation in his Posterior Analytics. Though very close to Lowe’s own account, our neo-Aristotelian account avoids Lowe’s confusion regarding dispositions, avoids overdetermination through several similar laws of nature, and provides an answer to the identification problem: The characterization of a kind universal by a property universal constitutes the relation of formal causation. By virtue of this relation, the kind Amanita muscaria is the formal cause of this mushroom having the attribute of being poisonous. (shrink)

In recent years, many states in the United States have passed legislation requiring laboratories to report the names of patients with low CD4 cell counts to their state Departments of Health. This name reporting is an integral part of the growing number of “HIV Reporting and Partner Notification Laws” which have emerged in response to recently revised guidelines suggested by the National Centers for Disease Control (CDC). Name reporting for patients with low CD4 cell counts allows for a more accurate (...) tracking of the natural history of HIV disease. However, given that this test is now considered to be an “indicator” of HIV, should it be subject to the same strict consent required for HIV testing? While the CDC has recommended that each state develop its own consent requirements for CD4 cell testing, most states have continued to rely on the presumed consent standards for CD4 cell testing that were in place before the passage of name reporting statutes. This allows physicians who treat patients who refuse HIV testing to order a CD4 cell blood analysis to gather information that is indicative of their patient’s HIV status. This paper examines the ethical and legal issues associated with the practice of “conscientious subversion” as it arises when clinicians use CD4 cell counts as a surrogate for HIV testing. (shrink)

This paper provides a new rationale for equating brain death with the death of the human organism, in light of well-known criticisms made by Alan D Shewmon, Franklin Miller and Robert Truog and a number of other writers. We claim that these criticisms can be answered, but only if we accept that we have slightly redefined the concept of death when equating brain death with death simpliciter. Accordingly, much of the paper defends the legitimacy of redefining death against objections, before (...) turning to the specific task of defending a new rationale for equating brain death with death as slightly redefined. Ce livre ne vise pas à donner un aperçu de ce que devrait être une religion. Il ne vise pas davantage à mettre en valeur l'argumentaire de l'athéisme. Il entend plutôt montrer qu'une personne qui se dit parfaitement agnostique et adepte d'une philosophie qui valorise la rationalité avant tout peut parfaitement être croyante, voire même pratiquante, sans qu'il y ait là la moindre contradiction. Dans une telle démarche, l'armature cognitive à laquelle de nombreux croyants ont jugé approprié d'arrimer leur foi (...) risque de se voir quelque peu déboulonnée. Et nombre d'arguments qui ont fortement contribué à miner les croyances religieuses pourraient s'en trouver passablement affaiblis. Dans les deux cas, tout découlerait de la simple reconnaissance du fait que la foi n'est en rien un savoir. Croire, expose Maurice Lagueux, en un Dieu transcendant ne veut pas dire connaître quoi que ce soit à propos d'un monde transcendant qui, par définition, échappe à nos capacités cognitives et est conçu comme le lieu de mystères insondables. Croire veut dire avoir sincèrement confiance en ce qui pourrait nous réserver l'existence de ce Dieu qui, toutefois, demeure inconnaissable. Des deux fonctions du médecin, soigner le corps et panser l'âme, la seconde est restée jusqu'au XVIIIe siècle prédominante : on pouvait seulement donner au malade le sentiment qu'il n'était pas abandonné, qu'on luttait avec lui pour obtenir sa guérison. Au début du XIXe siècle, la science, en apportant à la fois des connaissances et une méthode, a permis la naissance de la médecine moderne. Débarrassé des idées reçues et des creuses spéculations, le médecin s'est mis à confronter les signes (...) cliniques avec les lésions anatomiques puis avec les données biologiques, pour définir et classer les affections une à une. Démarche d'une prodigieuse efficacité : en deux siècles, l'espérance de vie est passée de vingt-sept à soixante-dix-sept ans. Mais ces progrès ont fait négliger l'aspect psychologique de la santé. Drogues licites et illicites, maladies sexuellement transmissibles, accidents, suicides : la mortalité des jeunes augmente aujourd'hui. Alors que la victoire semblait à portée de main, le médecin découvre qu'un corps ne petit être sain si l'esprit est malade. Devant le mal-être contemporain, en conservant la rigueur intellectuelle et méthodologique qui lui a valu ses succès, la médecine individuelle et curative doit aussi devenir collective et préventive, tenir compte d'une nouvelle donne économique et sociologique.
