Transnational reproductive travel is symptomatic of insufficient supplies of reproductive resources, including donor gametes and gestational surrogacy services, and inequities in access to these within domestic health-care jurisdictions. Here, we argue that an innovative approach to domestic policy making using the framework of the National Self-Sufficiency paradigm represents the best solution to domestic challenges and the ethical hazards of the global marketplace in reproductive resources.

While Adorno has tended to be read as a critic of the administered world and the consumer industry rather than a Marxist, Adorno and Marx establishes Adorno's negative dialectics as fundamental for understanding Marx's critique of political economy. This conception of the critique of political economy as a critical theory marks both a radical departure from traditional Marxist scholarship and from traditional readings of Adorno's work and warns against identifying Adorno with Marx or Marx with Adorno. Rather, it highlights the (...) intersection between Adorno's critical theory and Marx's critique of political economy that produces a critical theory of economic objectivity that moves beyond Marxian economics and Adornonian social theory. This essay investigates the rhetorical choices in archived letters to providers at a local abortion clinic through argumentum ad baculum and other fear appeal frames. Analysis of three types of threat—spiritual, physical, and professional—contained in the correspondence suggests that only the professional fear appeals correspond to true theat. The essay contends that while some of the letters contain either true threats or Aristotelian civic fear appeals, the writers more often make arguments that align with a new category I name sideways (...) threats. Sideways threats include praeteritio or apophasis, whereby the writer renounces something like violence in order to invoke it, as well as fear appeals to negative outcomes which could be carried out by a deity rather than the writer. Rather than fitting neatly into the rhetorical categories of ad baculum or civic fear, these artifacts that included multiple rhetorical approaches which open the way for new understanding of fear appeals and their persuasive qualities. We propose a formal theory built upon an abstract argumentation framework for handling argumentation dynamics. To that end, we analyze the acceptability dynamics of arguments through the proposal of two different kinds of sets of arguments which are somehow responsible for the acceptability/rejection of a given argument. We develop a study of the consequences of breaking the construction of such sets towards the acceptance of an analyzed argument. This brings about the proposal of a novel change operation which allows to (...) determine which arguments should be removed from the framework so that another particular argument becomes accepted. Finally, the proposed model is formalized in the light of the theory of belief revision by characterizing the corresponding operations through constructive definition and an axiomatic characterization, connecting them through the corresponding representation theorem. The theoretical proposal constitutes the fundamentals for a system implementation in many dynamic domains of application. In particular, we show its application for handling the dynamics of legal interpretation. In that sense, this proposal constitutes a fundamental approach and theoretical justification to handle the dynamics of legal arguments through changes of interpretative canons. We show a possible concretisation of our abstract theory for the legal domain by analysing a real legal case from the Argentinean jurisprudence. Such a system would be capable of suggesting alternative critical points in the current state of affairs of a legal case towards pursuing a specific goal for which the case is being investigated. American naturalists all agree that traditional theism, with its belief in a supernatural personal god who is absolutely transcendent to nature, is inconsistent with the view that nature is all that there is. Yet despite the rejection of the traditional God of theism, some naturalists have found pantheism, with its belief in a divinity thoroughly immanent to nature, congenial. Nonetheless, no philosophically rigorous and systematic juxtaposition of the metaphysical and ethical commitments of pantheism with those of naturalism has been undertaken. (...) In the brief autobiographical remarks found in the preface of Stuart Rosenbaum’s Pragmatism and the Reflective Life, we discover that Rosenbaum began his philosophical career in the tradition of analytic philosophy. It is precisely this background in the analytic tradition that gives weight to the powerful criticisms he levels against that tradition as he wends his way through his new-found love, American pragmatism. Rabgūzī’s Stories of the Prophets , written in Khwarezmian Turkish contains an account of the life of the biblical prophets and of the Prophet Muḥammed.

As lawmakers produce norms, the underlying normative system is affected showing the intrinsic dynamism of law. Through undertaken actions of legal change, the normative system is continuously modified. In a usual legislative practice, the time for an enacted legal provision to be in force may differ from that of its inclusion to the legal system, or from that in which it produces legal effects. Even more, some provisions can produce effects retroactively in time. In this article we study a simulation (...) of such process through the formalisation of a temporalised logical framework upon which a novel belief revision model tackles the dynamic nature of law. Represented through intervals, the temporalisation of sentences allows differentiating the temporal parameters of norms. In addition, a proposed revision operator allows assessing change to the legal system by including a new temporalised literal while preserving the time-based consistency. This can be achieved either by pushing out conflictive pieces of pre-existing norms or through the modification of intervals in which such norms can be either in force, or produce effects. Finally, the construction of the temporalised revision operator is axiomatically characterised and its rational behavior proved through a corresponding representation theorem. (shrink)

Whitehead's process view of God has inspired many admirers and provoked many critics. This article does not only examine this view of God as generally opposed to traditional theism, but it also explains why a process God is for Whitehead a necessary requirement for the metaphysical nature of the actual world. After discussing God's necessary functions in the world, the paper assesses the significance of Whitehead's process conception of God through a comparison with the traditional theistic view of God.

This chapter discusses the overall paradigmatic distribution of gaps in the Romance languages of the Iberian Peninsula. It revisits the Spanish data from a historical and comparative perspective, considering the closely related language, Portuguese. Ibero-Romance paradigm gaps are determined by the lexical rarity and the morphemic patterning. Paradigm gaps are also affected by ‘low speaker confidence’. This behaviour defines the avoidance of allomorphy even in the absence of reasonable grounds to expect the occurrence of allomorphy. Such behaviour is triggered by (...) the speaker's sensitivity to a major distributional pattern of root allomorphy in Spanish and Portuguese such as that in non-first conjunction verbs, the first person singular present indicative together with all persons and numbers of the present subjunctive in shared root allomorph. In addition to determining the defectiveness in the Ibero-Romance languages, the chapter also provides a discussion on the general domains and determinants of defectiveness. (shrink)

A collection of original essays that represent the first extended treatment of political philosopher John Rawls' idea of a property-owning democracy.

Amartya Sen cnticises the utilitanan philosophy that underpins neoclassical economics, and suggests the development of an economic theory grounded on a broad conception of freedom. Freedom includes for Sen two dimensions, namely the opportunity aspect and the process aspect. The opportunity aspect of freedom consists in the capability to achieve the goals that freedom provides us with, and, thus, can be seen in a consequentialist fashion. The procedural dimension of freedom, on the other hand, highlights the role ofnghts and procedures, (...) and is in line with deontological approaches to ethics. But since deontological (or procedural) and consequentialist approaches to ethics are often said to be incompatible, the article raises the question of whether Sen's conception is coherent or not. The author of the article argues that consequentialist and deontological approaches need not be incompatible, whereby he underlines in a special way the role of uncertainty as a key element in the understanding of the relationship between those two views of ethics. Finally, the article also assesses the coherence of A. Sen's conception of the economic agent, a conception that resorts both to the notion of "moral sentiments" developed by Adam Smith as well as to the notion of "moral imperatives" developed by Kant. A filosofia utilitansta subjacente à escola neoclássica de economia tern sido amplamente criticada por Amartya Sen, facto esse que, segundo o autor do presente artigo, nos pode sugerir o desenvolvimento de uma teoria económica baseada numa concepção ampla de liberdade. Para Sen, com efeito, o conceito de liberdade comporta duas dimensões bem explícitas, uma relacionada com as oportunidades proporcionadas pela liberdade, e a outra relacionada com os aspectos processuais da mesma. No que se refere à primeira dimensão, o artigo sublinha sobretudo o facto de a liberdade proporcionar a possibilidade de realizar determinados objectivos, numa perspectiva consequencialista. Por outro lado, a dimensão processual da liberdade evidencia a importância dos direitos e dos procedimentos, pelo que o artigo mostra igualmente até que ponto Sen se encontra também em linha com as éticas de cariz deontológico. Dado, porém, que as abordagens consequencialista e deontológica tendem a ser consideradas incompatíveis, o artigo não pode deixar de levantar a questão relativa à coerência da concepção ética do próprio Amartya Sen. No final de contas, a intenção do artigo é precisamente demonstrar que estas duas abordagens (consequencialista e deontológica) não são necessanamente incompatíveis entre si, pelo que o autor procura no conceito de incerteza o elemento necessáno a urna correcta compreensão da relação que existe entre esses dois tipos de abordagem ética. Finalmente, no sentido de evidenciar a coerência da concepção de agente económico defendida por Sen, o artigo recorre também, entre outros, seja ao conceito "sentimento moral" desenvolvido por Adam Smith, seja à noção Kantiana de "imperativo moral".
