Greenwashing is a phenomenon that is linked to scandals that often occur at the supply-chain level. Nevertheless, research on this subject remains in its infancy; much more is needed to advance our understanding of stakeholders’ reactions to greenwashing. We propose here a new typology of greenwashing, based on the locus of discrepancy, i.e. the point along the supply-chain where the discrepancy between ‘responsible words’ and ‘irresponsible walks’ occurs. With three experiments, we tested how the different forms of greenwashing affect stakeholders’ (...) reactions, from both ethical and business perspectives. We developed our hypotheses by building on attribution theory, which seeks to account for how observers construct perceptions about events. We had anticipated that the more internal, controllable and intentional the discrepancy is, the greater the blame attributed to a company is, and the lower the intention to invest will be. When greenwashing occurs at a company level, this results in a higher level of blame attribution, while the intention to invest falls. Indirect greenwashing refers to a misbehaviour perpetrated by a supplier who claims to be sustainable, and which results in a less negative impact on a supplied company. We also propose the vicarious greenwashing, which occurs when the behaviour of a supplier is in breach of a company’s claims of sustainability. This type of greenwashing is nevertheless detrimental to investment. The findings here advance our understanding of how greenwashing shapes stakeholders’ reactions, and highlight the need for the careful management of the supply-chain. (shrink)

This book attempts a conceptual clarification of Kant’s approach to culture, given the lack of systematic study of this aspect of his thought. At its origin there was only a thematic interest in the manifold meanings of the term “culture”, as well as the underlying persuasion that Kant’s moral philosophy could provide us with a systematic framework to understand the increasing relevance of “culture” in modern thought. Specifically, the hypothesis was that the emergence of culture as a relatively autonomous realm (...) was implied in Kant’s refusal to let nature play a role in the constitution of the moral norm, and his requirement that the moral norm be defined through pure reason alone. As a result, culture would appear as a middle terrain: being neither empirical nature nor pure morality. Accordingly, culture can be approached either from the perspective of nature, or from the perspective of morality. Both approaches represent what can be termed “Kant’s explicit account of culture”. Behind this explicit, two-fold account of culture, however, an implicit account of culture in terms of “projection of man’s subjectivity” can be discovered. This latter account, itself a consequence of the critical enterprise, constitutes Kant’s most original contribution to the philosophy of culture. (shrink)

Advance directives have been hailed for two decades as the best way to safeguard patients’ autonomy when they are totally or partially incompetent. In many national contexts they are written into law and they are mostly associated with end-of-life decisions. Although advocates and critics of ADs exchange relevant empirical and theoretical arguments, the debate is inconclusive. We argue that this is so for good reasons: the ADs’ project is fraught with tensions, and this is the reason why they are both (...) important and deeply problematic. We outline six such tensions, and conclude with some positive suggestions about how to better promote patients’ autonomy in end-of-life decision. We argue that ADs should continue to be an option but they cannot be the panacea that they are expected to be. (shrink)

The article addresses the problem of disability in the context of reproductive decisions based on genetic information. It poses the question of whether selective procreation should be considered as a moral obligation of prospective parents. To answer this question, a number of different ethical approaches to the problem are presented and critically analysed: the utilitarian; Julian Savulescu's principle of procreative beneficence; the rights-based. The main thesis of the article is that these approaches fail to provide any appealing principles on which (...) reproductive decisions should be based. They constitute failures of imagination which may result in counter-intuitive moral judgments about both life with disability and genetic selection. A full appreciation of the ethical significance of recognition in procreative decisions leads to a more nuanced and morally satisfying view than other leading alternatives presented in the article. Bioethics laws in France have just undergone a revision process. The bioethics debate is often cast in terms of ethical principles and norms resisting emerging social and technological practices. This leads to the expression of confrontational attitudes based on widely differing interpretations of the same principles and values, and ultimately results in a deadlock. In this paper I would like to argue that focusing on values, as opposed to norms and principles, provides an interesting perspective on the evolution of norms. (...) As Joseph Raz has convincingly argued, “life-building” values and practices are closely intertwined. Precisely because values have a more indeterminate meaning than norms, they can be cited as reasons for action by concerned stakeholders, and thus can help us understand how controversial practices, e.g. surrogate motherhood, can be justified. Finally, norms evolve when the interpretations of the relevant values shift and cause a change in the presumptions implicit in the norms. Thus, norms are not a prerequisite of the ethical solution of practical dilemmas, but rather the outcome of the decision-making process itself. Struggling to reach the right decision in controversial clinical ethics situations indirectly causes social and moral values to change and principles to be understood differently. (shrink)

Cases—be they real or fictional—are commonplace both in the medical ethics literature and in the public media. Cases take on a variety of forms: from streamlined to book length narratives. They also serve a variety of different purposes, from illustration, to decision making, and from debunking to heuristics. Drawing on the rhetorical analysis of « exemplum », I shall describe what cases are, and what their role is in the practice of clinical ethics. I identify two basic ways in which (...) cases can be brought to bear on ethical thinking and practice: a « tamed » and a « wild » way, and show how « wild cases » can serve a useful heuristic function despite their appeal to emotions and their unusual and striking character. In conclusion, I will argue that cases, both in their wild and their tamed form, are not only useful pedagogical tools, but can serve as a legitimate empirical basis for medical ethics. (shrink)

An elderly patient in his early eighties is hospitalized in a long-term facility, with advanced Alzheimer disease. He is otherwise relatively strong and free from other life-threatening conditions, except for the fact that he has difficulties swallowing. After several episodes of acute aspiration pneumonia doctors prescribe “strict fast”: only hydration through an IV catheter should be administered during the night, in order to relieve the feeling of hunger, provide comfort, and stave off death. The patient is surrounded by a warm (...) and extremely close-knit Mediterranean family. His wife and six adult children take turns feeding him properly mixed food twice a day and prefer to take the risk of causing another... (shrink)

The French bioethics laws of 1994 contain the principles of the anonymity and non commodification of all donations of body parts and products including gametes in medically assisted reproduction. The two revisions of the law, in 2004 and 2011 have upheld the rule. In view of the latest revision process, the French government organized a large public consultation in 2009. Within the event a “consensus conference” was held in Rennes about different aspects of assisted reproduction. In what follows we shall (...) first describe the anonymity clause for gamete donations in the French law and the debates surrounding it. We shall then analyse the procedure used for the 2009 public consultation and the related consensus conference, as well as its upshot concerning the anonymity doctrine. In this respect we shall compare the citizens’ own recommendations on the gamete anonymity issue and its translation in the consultation’s final report drafted by a philosopher mandated by the organizing committee. Whereas the final report cited some fundamental ethical arguments as reason for upholding the provisions of the law—most notably the refusal of the ‘all biological’ approach to reproductive issues—citizens were more careful and tentative in their position although they also concluded that for pragmatic reasons the anonymity rule should continue to hold. We shall argue that the conservative upshot of the public consultation is due to some main underlying presuppositions concerning the citizens’ role and expertise as well as to the specific design of the consensus conference. Our conclusion will be that public consultations and consensus conferences can only serve as an empirical support for devising suitable bioethics norms by using second-order normative assumptions. I explore Hume’s argument for the existence of government, in which he articulates psychological and social elements. Given the human tendency to satisfy the proximate above the remote interests, the fulfilment of the rules of justice, which makes social cooperation possible, must be warranted by the artifice of government. Once the government is in place, it also performs a coordinating function, which strengthens preexistent activities, such as commerce. Indirectly, the government fulfils also a civilizing function -/- Resumen. Se explora el (...) argumento con el que Hume justifica la existencia del gobierno, articulando elementos psicológicos y sociales. Dada la tendencia natural a satisfacer antes los intereses próximos que los remotos, el cumplimiento de las normas de justicia, que hace posible una cooperación social efectiva, debe remediarse mediante un artificio, el gobierno. Una vez introducido, cumple también una función coordinadora, que potencia las actividades que naturalmente le preceden, especialmente el comercio. While in Europe the debate over clinical ethics consultants’ expertise and professionalization is ongoing, in France it remains rather marginal. In this article, we illustrate how the “commitment model” adopted by the Clinical Ethics Center of the Greater Paris University Hospitals situates itself in such a debate. We first present the commitment model by drawing upon an emblematic case of consultation, and then describe, in turn, its understandings of democratic expertise and of the professionalization of clinical ethics consultation. Accordingly, the (...) commitment model advocates against individual consultants’ certification, but it does not rule out the need for training nor a certain form of professionalization of clinical ethics consultation services. The chapter provides an analysis of the concept of the dignity of the person in Polish legal culture. It begins with a brief description of the historical background in which the legal status of human dignity has been framed. Then it turns to the analysis of the philosophical doctrines which have shaped the concept, in particular those which influenced Polish legal scholarship to the highest degree. The subsequent section attempts to clarify the meaning of the concept, specifying its features and (...) providing distinctions between dignity of the person and dignity of personage. In this paper, there were presented ethical arguments concerning the application of modern techniques of genetic intervention in human procreation. In particular, the rationalistic arguments in favour of genetic interventions were critically presented, namely the argument on ethical neutrality of technology, liberal argument on procreative freedom and argument on genetic enhancement. There were also analysed the negative emotional reaction to genetic engineering. The main aim of the paper was to express the cognitive element from these emotions enabling a wider understanding (...) of human procreation and the values of parent-child relations. (shrink)

This book is aimed at analyzing the foundations of medical ethics by considering different moral theories and their implications for judgments in clinical practice and policy-making. It provides a review of the major types of ethical theory that can be applied to medical and bioethical issues concerning reproductive genetics. In response to the debate on the most adequate ethical doctrine to guide biomedical decisions, this book formulates views that capture the best elements in each, bearing in mind their differences and (...) taking into account the specific character of medicine. No historically influential position in ethics is by itself adequate to be applied to reproductive decisions. Thus, this book attempts to offer a pluralistic approach to biomedical research and medical practice. One usually claims that there are some basic principles which constitute the foundations of bioethics and medical ethics. Yet these principles conflict with each other and one needs some criteria to solve these conflicts and to specify the scope of application of these principles. Exploring miscellaneous ethical approaches as introduced to biomedicine, particularly to reproductive genetics, the book shall elucidate their different assumptions concerning human nature and the relations between healthcare providers, recipients, and other affected parties. The book attempts to answer the question of whether the tension between these ethical doctrines generates conflict in the field of biomedicine or if these competing approaches could in some way complement each other. Existem muitas teorias sobre democracia. Na verdade, enquanto se fala de “teoria democrática” como se existisse um consenso acerca do que esta poderia significar, a partir do momento em que nos debruçamos sobre diferentes autores, apercebemo-nos de que há tantas teorias quanto há perspectivas sobre o tema. Neste artigo tenho como interlocutores Robert Dahl, Benjamin Barber, Robert Goodin e David Plotke. O artigo tem três momentos. No primeiro, desenho o contexto geral para uma reflexão crítica sobre democracia, partindo da análise (...) dos seus conceitos constitutivos, nomeadamente, os conceitos de representação, participação e deliberação. Este é o momento “estrutural”. De seguida, apoiando-me nos critérios ou virtudes de Dahl e no conceito de “democracia forte” de Barber, defendo que a instanciação dos vários modelos democráticos depende da importância que se confere a cada um dos critérios. Este é o momento de conteúdo. Dialogando com estes autores procuro identificar as implicações dos modelos representativo, participativo e deliberativo. Por último, procuro uma forma de redefinição da democracia mais positiva para o futuro, tendo o orçamento participativo como prática exemplar a seguir. (shrink)

L'A. si interroga con Tommaso sul dogma trinitario che pone una difficoltà molto grande soprattutto rispetto alla questione degli universali: come è possibile che il Padre sia Dio, allo stesso tempo una persona e allo stesso tempo che la paternità sia una relazione? Questi predicati che si applicano alla Trinità sono predicati con le stesse modalità con cui si usano tutti gli altri? L'A. esamina i modelli G-S e S-I e distingue la dimensione concettuale da quella ontologica, per delineare cosa (...) sia l'essere in una specie e in un genere, per concludere sull'impossibilità di applicare il modello universale-particolare a Dio. L'Aquinate propone un'alternativa ai modelli G-S e S-I che trova insufficienti: propone un modello che può essere chiamato comune-proprio: una cosa può essere comune in due modi distinti, da una parte numericamente, dall'altra secondo la definizione. Quindi communitas secundum rem, che è quella della natura divina; communitas secundum rationem, che è quella del concetto di relazione divina e persona divina. En Sutton 2012, Catherine Sutton presenta una nueva e interesante solución al mayor problema al que se enfrenta el co-ubicacionismo : el problema de la fundamentación. Sin embargo, si es correcto rechazar la tesis defendida por Sutton según la cual los trozos o pedazos de materia están extrínsecamente compuestos,entonces su respuesta al problema de la fundamentación resulta incompleta. Además, es difícil ver cómo podría completarse.

Traditionally inscribed at the margins of moral and political theory, it is time, after centuries of ongoing debates originated and grounded in Modernity’s values, to reflect on the status of Feminist Theory. Defined basically as critical theory —apostille of the mainstream theory—, feminist thought can be defined as theory tout court, in so far as the egalitarian discourses are central parts of moral and political thought and feminism is philosophical. This paper addresses the ambivalent relation between feminist theory and moral-political (...) theory with a critical view that upholds an integral vision that incorporates the dimension of care into the male-stream, and takes into account gender differences as well as the division between the public and private spheres.
