By presenting original research into British legal history, this volume emphasises the historical shaping of the law by ideas of authority. The essays offer perspectives upon the way that ideas of authority underpinned the conceptualisation and interpretation of legal sources over time and became embedded in legal institutions. The contributors explore the basis of the authority of particular sources of law, such as legislation or court judgments, and highlight how this was affected by shifting ideas relating to concepts of sovereignty, (...) religion, political legitimacy, the nature of law, equity and judicial interpretation. The analysis also encompasses ideas of authority which influenced the development of courts, remedies and jurisdictions, international aspects of legal authority when questions of foreign law or jurisdiction arose in British courts, the wider authority of systems of legal ideas such as natural law, the authority of legal treatises, and the relationship between history, law and legal thought. Increasing awareness of the importance of the biodiversity of the whole global biosphere has led to further awareness that the problems which arise in connection with preservation and exploitation of our planet’s biodiversity are best tackled from a global perspective. The ‘Biodiversity Convention’ and the ‘Human Genome Project’ are some of the concrete attempts at such globalisation. But, while these efforts are certainly very good at the intentional level and on paper, there is, at the practical level of implementation, the (...) danger that globalisation may simply translate into westernisation, given the Western world’s dominance and will to dominate the rest of the globe. How is ‘global bioethics’ to be possible in a world inhabited by different cultural groups whose material situation, powers, ideas, experiences and attitudes differ rather markedly and who are not, in any case, equally represented in globalisation efforts and fora? One index of the pertinence of this question is that talk about biodiversity, biotechnology, biotrade etc. is being increasingly matched by talk about biopiracy, biorade, biocolonialism etc. In this paper, I attempt to explore and develop these very general concerns. The concept of information has acquired a strikingly prominent role in contemporary biology. This trend is especially marked within genetics, but it has also become important in other areas, such as evolutionary theory and developmental biology, particularly where these fields border on genetics. The most distinctive biological role for informational concepts, and the one that has generated the most discussion, is in the description of the relations between genes and the various structures and processes that genes play a role in (...) causing. For many biologists, the causal role of genes should be understood in terms of their carrying information about their various products. That information might require the cooperation of various environmental factors before it can be "expressed," but the same can be said of other kinds of message. An initial response might be to think that this mode of description is entirely anchored in a set of well-established facts about the role of DNA and RNA within protein synthesis, summarized in the familiar chart representing the "genetic code," mapping DNA base triplets to amino acids. However, informational enthusiasm in biology predates even a rudimentary understanding of these mechanisms (Schrodinger 1944). And more importantly, current applications of informational concepts extend far beyond anything that can receive an obvious justification in terms of the familiar facts about the specification of protein molecules by DNA. This includes: 1 (i) The description of whole-organism phenotypic traits (including complex behavioral traits) as specified or coded for by information contained in the genes, (ii) The treatment of many causal processes within cells, and perhaps of the wholeorganism developmental sequence, in terms of the execution of a program stored in the genes, (iii) The idea that genes themselves, for the purpose of evolutionary theorizing, should be seen as, in some sense, "made" of information.. International regulations governing medical research, healthcare and medical practice, are, obviously, meant to be guidelines and not detailed procedural rules of thumb that can be applied unreflectively without any danger of doing moral wrong. Moreover, such regulations are meant to apply internationally, and no set of straight‐jacketed rules of thumb can conceivably apply to all societies and communities of the world, extremely diverse and differently situated as they are. The mark of a good international guideline or regulation, in my (...) view, is that it should provide a clear principle of action that applies equally to all global communities and societies without seeking to foist the particular or momentary moral dilemmas, quandaries, obsessions and preoccupations of some on all.In this paper, I propose to argue that, because moral obligations are obligations only from the point of view of a particular moral agent, we should avoid making the peculiar problems of any particular moral agent the obsessive concern of all moral agents, and that we need, in particular, to make appropriate distinctions between the ethics of developed world research in the developing world, collaborative or cooperative research between the developed and developing worlds, developed world research in the developed world and developing world research in the developing world. A consequence of looking at things this way is that, while it should be clear that there are ethical concerns, imperatives and obligations at all levels, different standards may and, in fact, cannot but be applied in different contexts at different levels, without resorting to the use of double standards, which can never be morally justified. Finally, I venture to propose a formula for a solemn pledge of moral integrity and noble intent, from the perspective of the agent, that is to say, the investigator, sponsor and funder of any research, to complement and balance the widely accepted informed consent requirement, from the perspective of the patient, the subject of any biomedical research. Is Popper's philosophy alive or dead? If we make a judgment based on recent discussion in academic philosophy of science, he definitely seems to be fading. Popper is still seen as an important historical figure, a key part of the grand drama of 20th century thinking about science. He is associated with an outlook, a mindset, and a general picture of scientific work. His name has bequeathed us an adjective, "Popperian," that is well established. But the adjective is used for (...) very general ideas that, according to most current philosophers, Popper did not develop convincingly. His detailed account is often seen as attractive on first impression, but full of holes that become bigger rather than smaller as discussion continues. The picture and the name remain, which is more than 1 most philosophers can hope for. But the name attaches more and more to a set of instincts and intuitions, less and less to views that are seeing ongoing philosophical development. Inside science itself, Popper's standing is quite different. He continues to be just about the only philosopher who can seize the imagination and command the loyalty of successful professional scientists. And he is popular within science not only for purposes of general commentary and public relations. Popper's philosophy is a resource drawn on by scientists in their internal debates about scientific matters. This has been especially marked in some parts of biology (Hull 1999). From the point of view of philosophers, this affection on the part of scientists may have an unflattering explanation. Popper offers a rather heroic view of the scientific character, featuring an appealing combination of creativity and hard-headedness. It is no surprise that scientists like to be described this way. It is no surprise that they prefer this picture to the one often (though inaccurately) associated with Hempel and Carnap – the scientist as a sort of logic-driven pattern-recognition machine. The same applies to the picture associated with Kuhn, who presents the normal scientist as a narrow-minded, indoctrinated member of a peculiar collective enterprise, an enterprise devoted to solving tiny puzzles most of the time but prone to occasional fits of crisis and chaos.. Why do octopuses matter to philosophy? They matter to the part of philosophy concerned with the mind. To see why, we step back and think about the evolutionary connections between all living things. Biologists think of these relationships in terms of a tree of life. This is a huge tree-like pattern, marking which species are close relatives and which are distantly connected. The vertebrates form one branch of the tree, and that is where we find nearly all the animals with (...) large and complex brains. These include ourselves, other mammals, and birds. In evolutionary terms, these are all cousins. In the huge area of the tree containing other animals, invertebrates, there is only one small branch where we also find large brains. This branch contains the cephalopods – octopuses, cuttlefish, and squid. Large nervous systems evolved separately on these two branches, and nowhere else. Octopuses are a separate experiment in the evolution of the mind. Meeting an octopus is like meeting an intelligent alien. So what did this experiment produce? Here is one thing. The nervous system of an octopus is less centralized than ours. In fact, more than half of the octopus' neurons are not in the animal's central "brain" at all, but in the eight arms. It is as if each arm has a mind of its own. Or perhaps in an octopus we see intelligence without a unified self. (shrink)

Could Mark Antony have had all the properties of Julius Caesar and vice versa? This is a puzzle which was raised by N. L. Wilson, and I shall be concerned with it in Part I of this paper. The answer which we give to this puzzle has important implications for our notion of an identifiable individual. In Part II I examine some important consequences of accepting the coherence of a complete exchange of properties between two individuals—which we might call (...) a “biography-swap.” I argue that one consequence is to establish the inadequacy of some views about reference advocated, for example, by Russell and A. N. Prior. This leads on to a more general problem of how it is that concrete particulars are grasped as objects of thought; and in resolving this problem, I argue in Part III that demonstratives play a crucial role in reference to particulars. The w riting is clear and concise, aptly balancing precision and breadth, and a host of relevant issues are raised and advanced. Although my comments here w (...) ill focus only on the book's fundamental conceptual framew ork for how organisms relate to their environments, I enthusiastically recommend the entire book. This paper reconstructs the teaching of James of Viterbo on the ontological status of the possibles, and compares his position with those of Henry of Ghent and Godfrey of Fontaines. James holds that possibles are real only in a qualified sense, as objects of God’s power and knowledge. While James appears to have been influenced by Henry in his explanation of divine knowledge of creatures, in his analysis of the possibles he makes no use of Henry’s theory of esse (...) essentiae, and he denies Henry’s claim that divine ideas function as exemplar causes of the possibiles. James’ theory is actually much closer to that of Godfrey, although Godfrey himself was highly critical of James’ teaching. (shrink)

Gary Ebbs: Quine's Naturalistic Explication of Carnap's Logic of Science: If one studies Quine's epistemology without appreciating its deep connections to Carnap's logic of science, one can easily get the impression that unlike Carnap, Quine aims to preserve and clarify the traditional empiricist idea that our best theories of nature are justified by, or based on, our sensory evidence, and are for that reason likely to be true. Quine writes, for instance, that [The] human subject is accorded a certain experimentally (...) controlled input—certain patterns of irradiation in assorted frequencies, for instance—and in the fullness of time the subject delivers as output a description of the three‐dimensional external world and its history. The relation between the meager input and the torrential output is a relation that we are prompted to study for somewhat the same reasons that always prompted epistemology; namely, in order to see how evidence relates to theory, and in what ways one's theory of nature transcends any available evidence. Commenting on this and similar passages in Quine, Barry Stroud writes: … the question Quine poses in terms of the “underdetermination” of the “torrential output” by the “meager input” makes essential use of a notion of epistemic priority. It is because the “information” we get at “input” does not uniquely determine the truth of what we assert as “output” that we must explain how we get from the one to the other. I argue that despite its superficial plausibility, this interpretation of Quine is mistaken: following Carnap, yet also radically transforming his views, Quine takes our best current theory as our ultimate arbiter of truth. The goal of Quine's naturalistic account of the relationship between theory and evidence is not to show that our best theories of nature are justified by our sensory evidence, but to show that we can describe science from within science itself in a way that mirrors and thereby clarifies his doctrinal principle that we can only judge truth from the standpoint of our best current theory. We think about impossible things all the time. We can think about alchemists trying to turn base metal to gold, and about unfortunate mathematicians trying to square the circle. We may ponder whether God exists; and philosophers frequently debate whether properties, numbers, sets, moral and aesthetic qualities, and qualia exist. As we consider both sides of one of these philosophical arguments, we will at some point think about something that’s impossible. Yet most philosophical accounts of meaning and content hold that we can’t meaningfully think or reason about the impossible. -/- In The Impossible, Jago argues that we often gain new information, new beliefs, and, sometimes, fresh knowledge through logic, mathematics, and philosophy. That is why logic, mathematics, and philosophy are useful. We therefore require accounts of knowledge and belief, of information and content, and of meaning which allow space for the impossible. Jago’s aim in this book is to provide such accounts. He gives a detailed analysis of the concept of hyperintensionality, whereby logically equivalent contents may be distinct, and develops a theory in terms of possible and impossible worlds. Heracleides Ponticus, a pupil of the schools of Plato and Aristotle, who lived from about 390 to 310 B.C., shared the wide interests of many of his pre-Platonic predecessors. Diogenes Laertius gives a long list of his works, many of them now known only by their titles, which he divided into writings on ethics, physics, grammar, music, rhetoric, and history. Like most of his predecessors he gave some attention to the heavens and speculated about the nature of the moon , (...) comets , the infinity of the cosmos ; he was best known in antiquity, in this field, for his suggestion that the phenomena could be saved if the heavens were at rest and the earth revolved about the central axis .2 One of two pieces of evidence for his involvement in anything more than this general, inexact speculation in the field of astronomy is contained in the commentary on Plato's Timaeus written in Latin by Chalcidius somewhere at the beginning of the fourth century A.D.; it is this passage which this paper will discuss. Nondescriptivist views in many areas of philosophy have long been associated with the commitment that in contrast to other domains of discourse, there are no propositions in their particular domain. For example, the ‘no truth conditions’ theory of conditionals1 is understood as the view that conditionals don’t express propositions, noncognitivist expressivism in metaethics is understood as advocating the view that there are not really moral propositions,2 and expressivism about epistemic modals is thought of as the view that there is no (...) such thing as the proposition that Jack might be at home, over and above the proposition that Jack is at home.3 Of course, it is nearly always acknowledged that advocates of a nondescriptivist theory need not deny that there are conditional, moral, or modal propositions ‘at the end of the day’ – for if they also endorse a deflationary reading of talk about propositions, as famously advocated by Simon Blackburn, then they can employ such deflationary talk just as much as the rest of us. They just don’t appeal to propositions to do any of the work in their theories. Rather, they ‘earn the right’ to talk about propositions.4 It is the aim of this paper to upset this way of thinking about the proper attitude of nondescriptivists toward propositions, and to advocate a more constructive and in some ways more radical alternative on behalf of the nondescriptivist. I will begin by introducing and developing a set of problems that are faced by any nondescriptivist theory which tries to do without propositions. All of these problems are easily solved by any view which postulates propositions across the board, but none of them are solved by merely deflationary talk about propositions – their most promising solutions require propositions to do real theoretical work, and therefore the problems themselves remind us of and illustrate some of the important reasons why it is worth positing propositions in the first place.. In 1916 Bertrand Russell was prosecuted and fined for publishing (in defence of a conscientious objector) 'statements likely to prejudice the recruiting and discipline of His Majesty's forces.' He was almost immediately afterwards dismissed from his Lectureship at Trinity College, Cambridge, by the College Council. This expulsion provoked a storm of protest and the true facts of the case became obscured by misconceptions, prejudices and uninformed gossip, to the discredit of the College. In 1942, therefore G. H. Hardy the mathematician (...) printed for private circulation to another generation of Fellows at Trinity a full account of the incident in an attempt to explain what really happened. This is now made public. Besides provoking an authoritative record of a celebrated but misinterpreted episode in Russell's eventful academic career, this document contains interesting evidence about attitudes to pacifism in the First World War and in particular about the sympathies of such distinguished colleagues and contemporaries of Russell as Cornford, Housman, McTaggart and Whitehead. We present a dynamic model of the evolution of communication in a Lewis signaling game while systematically varying the degree of common interest between sender and receiver. We show that the level of common interest between sender and receiver is strongly predictive of the amount of information transferred between them. We also discuss a set of rare but interesting cases in which common interest is almost entirely absent, yet substantial information transfer persists in a *cheap talk* regime, and offer a (...) diagnosis of how this may arise. -/- . Our understanding of communication and its evolution has advanced significantly through the study of simple models involving interacting senders and receivers of signals. Many theorists have thought that the resources of mathematical information theory are all that are needed to capture the meaning or content that is being communicated in these systems. However, the way theorists routinely talk about the models implicitly draws on a conception of content that is richer than bare informational content, especially in contexts where false content (...) is important. This article shows that this concept can be made precise by defining a notion of functional content that captures the degree to which different states of the world are involved in stabilizing senders’ and receivers’ use of a signal at equilibrium.
