L'idea di scrivere questo libro sul diritto naturale e nata dal desiderio dell'autore di approfondire il problema della fondazione della norma morale, nella convinzione che un'autentica visione giusnaturalistica apre nuove orizzonti per comprendere meglio la questione di Dio e dell'uomo nel discorso normativo che si inserisce armonicamente nella dimensione ecclesiale. Il tema ha avuto origine dall'osservazione del dialogo interdisciplinare tra toelogia morale, filosofia del diritto e scienze giuridiche. Prende in esame la relazione tra ordine morale e giuridico individuando le questioni (...) che si pongono per la teologia morale in quanto disciplina che tratta i problemi della fondazione della norma morale. La problematica verte sul temine natura normativa la quale si esplica in veste di progetto antropologico. La rinascita del pensiero giusnaturalistico in Germania e il fulcro di questa tesi. (shrink)

The anti-reductionist character of the recent philosophy of biology and the dynamic development of the science of emergent properties prove that the time is ripe to reintroduce the thought of Aristotle, the first advocate of a “top-down” approach in life-sciences, back into the science/philosophy debate. His philosophy of nature provides profound insights particularly in the context of the contemporary science of evolution, which is still struggling with the questions of form, teleology, and the role of chance in evolutionary processes. However, (...) although Aristotle is referenced in the evolutionary debate, a thorough analysis of his theory of hylomorphism and the classical principle of causality which he proposes is still needed in this exchange. Such is the main concern of the first part of the present article which shows Aristotle’s metaphysics of substance as an open system, ready to incorporate new hypothesis of modern and contemporary science. The second part begins with the historical exploration of the trajectory from Darwin to Darwinism regarded as a metaphysical position. This exploration leads to an inquiry into the central topics of the present debate in the philosophy of evolutionary biology. It shows that Aristotle’s understanding of species, teleology, and chance – in the context of his fourfold notion of causality – has a considerable explanatory power which may enhance our understanding of the nature of evolutionary processes. This fact may inspire, in turn, a retrieval of the classical theology of divine action, based on Aristotelian metaphysics, in the science/theology dialogue. The results of econometric modeling are fragile in the sense that minor changes in estimation techniques or sample can lead to statistical models that support inconsistent causal hypotheses. The fragility of econometric results undermines making conclusive inferences from the empirical literature. I argue that the program of evidential pluralism, which originated in the context of medicine and encapsulates to the normative reading of the Russo-Williamson Thesis that causal claims need the support of both difference-making and mechanistic evidence, offers a ground (...) for resolving empirical disagreements. I analyze a recent econometric controversy regarding the tax elasticity of cigarette consumption and smoking intensity. Both studies apply plausible estimation techniques but report inconsistent results. I show that mechanistic evidence allows for discriminating econometric models representing genuine causal relations from accidental dependencies in data. Furthermore, I discuss the differences between biological and social mechanisms and mechanistic evidence across the disciplines. I show that economists mainly rely on mathematical models to represent possible mechanisms. Still, claiming the actuality of the represented mechanisms requires establishing that crucial assumptions of these models are descriptively adequate. I exemplify my approach to assessing the quality of mechanistic evidence in economics with an analysis of two models of rational addiction. (shrink)

The aim of the article is to explain the relationship between the ethical evaluation of scientific research involving personal data and the assessment of compliance with data protection law. The article presents the mutual relationship between the protection of personal data and scientific activity from a dogmatic perspective, the legal regulation of the processing of personal data in scientific research, and the so-called research exceptions that apply when data are processed for scientific research. It also covers the importance of meeting (...) the ethical requirements of scientific research in order to profit from the indicated exceptions. Finally, it provides a comparison between the ethical and the legal systems of personal data protection in research (objectives, criteria, authorities, and procedures). (shrink)

Approximately one in six top economic research papers draws an explicitly causal conclusion. But what do economists mean when they conclude that A 'causes' B? Does 'cause' say that we can influence B by intervening on A, or is it only a label for the correlation of variables? Do quantitative analyses of observational data followed by such causal inferences constitute sufficient grounds for guiding economic policymaking? The Philosophy of Causality in Economics addresses these questions by analyzing the meaning of causal (...) claims made by economists and the philosophical presuppositions underlying the research methods used. The book considers five key causal approaches: the regularity approach, probabilistic theories, counterfactual theories, mechanisms, and interventions and manipulability. Each chapter opens with a summary of literature on the relevant approach and discusses its reception amongst economists. The text details case studies, and goes on to examine papers which have adopted the approach in order to highlight the methods of causal inference used in contemporary economics. It analyses the meaning of the causal claim put forward, and finally reconstructs the philosophical presuppositions accepted implicitly by economists. The strengths and limitations of each method of causal inference are also considered in the context of using the results as evidence for policymaking. Based on case studies prepared at the Harvard Business School, the article analyses the content of university courses on business history. Its aim is to answer the question whether or not business history courses are used for discussing the problems of CSR or moral dilemmas behind strategic decisions made by managers. The article argues that the chance of enhancing the understanding of social problems on the part of the managers and shaping their responsiveness to them, created by the presence of (...) courses on history in the academic curriculum, remains, to a large extent, unrealised. Teaching materials are still influenced by the Chandlerian paradigm and thus focus on changes in organisational structures and strategies of large multinational companies. They pay little attention to the social environment of business, rarely pose questions on the motivations of human actions or value hierarchies and avoid discussions on the social consequences of management decisions. A survey of the main approaches in a mind study -oriented part of Artificial Intelligence is made focusing on controversial issues and extreme hypotheses. Various meanings of terms: "intelligence" and "artificial intelligence" are discussed. Limitations for constructing intelligent systems resulting from the lack of formalized models of cognitive activity are shown. The approaches surveyed are then recapitulated in the light of these limitations.

There are several faces of Four-Dimensionalism. Sometimes 4D-ism is formulated as the thesis that the material world is composed of spatial as well as temporal parts. Another version of 4D-ism states that persisting objects are extended over time in the same way that they are extended over space. Some Four-Dimensionalists defend the thesis that all objects persist by perduring i.e. by having different temporal parts at different times. Sometimes 4D-ism means the same as eternalism - the thesis that past and (...) future objects (and times) are just as real as currently existing ones. Finally it can mean the thesis that all objects are in fact four-dimensional i.e. they are in every case a filling of some subregions of space-time. The author examines some varieties of 4D-ism and tries to formulate both a precise meaning of those doctrines and an evaluation of them. (shrink)

Sophie Gibb has recently invented a very interesting strategy against Kim’s causal exclusion argument. This strategy adopts the powers theory of causation and an interpretation of mental causation in terms of double prevention. Gibb’s strategy results both in invalidating the principle of the causal closure of the physical domain in most of its formulations and in disarming the argument in question. In my paper, I present a general procedure for the opponents of reductive physicalism which enables them to _grapple successfully_ (...) with the mentioned principle. I also argue that although it could be possible to adopt Gibb’s strategy as a part of this procedure, there is a simpler one to obtain a similar outcome. This strategy is mainly based on Uwe Meixner’s causal argument against physicalism and it leads to the conclusion that if one accepts the principle of sufficient cause, then one should reject the principle of causal closure in the light of some empirical data. This alternative proposal is more attractive than Gibb’s solution, since it is independent of any conception of causation, does not make any distinction between causal relevance and causal efficacy, and does not refer to the notion of _double prevention_. The idea of the university was never a significant context for researchers of Franz Kafka work. It was the other social institutions that became the natural source of allusive recognition of literary scholars. In this sketch – written on the margins of Kafka’s famous short story: Report for the Academy – we are trying to change it. The university here becomes a “central object of criticism”, an institution in ruins, a place where one does not practice research and does not (...) perfect humanistic virtues. On the contrary, it is a space where the “gate of perception” and „critical thinking” are consistently closed – as a tribute to the particular game of interests. In the worst case – the effect of the Academy’s impact becomes destruction resulting from training and humiliation. (shrink)

W ostatnich latach mamy do czynienia z dynamicznym rozwojem neuroetyki, tj. subdyscypliny nauk o mózgu badającej rozmaite zagadnienia etyczne w kontekście funkcjonowania ludzkiego umysłu i mózgu. Centralnym przedmiotem tych badań jest specyficznie ludzka zdolność do wydawania sądów moralnych oraz jej mechanizmy. Tymczasem twierdzenia neuroetyki mają znacznie szerszy wymiar; wykracza on bowiem poza kwestie czysto opisowe i obejmuje swym zasięgiem zagadnienia teoretyczne etyki. W niniejszym artykule rozważam znaczenie badań neuroetycznych dla analiz przeprowadzanych w obszarze etyki normatywnej oraz metaetyki.

Over the years, the Austrian School of Economics has created the image of a thinker associated with ideas of liberalism. The views of members of this school are often considered controversial. However, the concept of freedom clearly displayed by the Austrians is very popular among economists. Carl Menger is said to be the founder and a leading member of the Austrian School of Economics, and his works are mostly devoted to methodology and economic theory. Nevertheless, you can also find his (...) views on the sphere of economic liberalism and freedom. Almost 150 years after the publication of Menger’s main works, it emerged that he had created not only the timeless foundations of the theory and methodology of economics, but his theory of subjective value had become the bedrock which is used to this day in deliberations on economic liberalism. The economy pursued by Menger (based primarily on the ideas of subjectivism and individualism) continues to be an important and timeless foundation for the development of the doctrine of economic liberalism. The existing philosophical views on what is the meaning of causality adequate to medicine are vastly divided. We approach this question and offer two arguments in favor of pluralism regarding concepts of causality. First, we analyze the three main types of research designs (randomized-controlled trials, observational epidemiology and laboratory research). We argue, using examples, that they allow for making causal conclusions that are best understood differently in each case (in agreement with a version of manipulationist, probabilistic and mechanistic definitions, respectively). (...) Second, we analyze clinical practice and argue that these manipulationist, probabilistic and mechanistic causal claims can be used as evidence for different therapeutic decisions. We differentiate among ‘predicting’ that does not change the relata of causal claims, (mechanistic) ‘interferences’, and ‘interventions’ in the strict sense that act on causes to change effects. The central conclusion is that causal claims agreeing with diverse concepts of causality can deliver evidence for different types of therapeutic decisions. (shrink)

A considerable group of contemporary philosophers and theologians—including those engaged in the science-theology dialogue, such as Barbour, Clayton, Davies, and Peacocke—supports panentheism, i.e., a theistic position which assumes that the world is in God, who is yet greater than everything he created. They see it as a balanced middle ground between the positions of classical theism and pantheism. In this article, I offer a presentation and a critical evaluation of the most fundamental principles of panentheism from the point of view (...) of classical theism. First, I list six main species of panentheism and the motivations of those who support it. In the second part, I analyze the three main difficulties concerning its ontological and theological principles, i.e., (1) the meaning of the preposition ‘in’ (_en_) in ‘pan_en_theism’; (2) the accuracy of panentheistic definition of divine immanence, and (3) the question of whether panentheism is successful in protecting God’s transcendence. I conclude that panentheism fails as a Christian theistic position. Nevertheless, it might still be valuable and play an important role in addressing the cognitive drama of the modern human beings, often seduced by secular (scientific) or spiritual naturalism, or pantheism. The article presents the discussion which begins with a semantic clarification of the Polish terms of ‘sens’ [meaning] and ‘znaczenie’ [reference] in Polish linguistic usus, starting with the basic dictionary and corpus-based determinations, which indicate the subjective dominant element of ‘sens’ and the objective dominant element of ‘znaczenie’. Next, the author indicated the elements of philosophical discourse, which defined additional conditions of meaning as “the meaning of life” and “meaning of action” and which emphasise the subjective and performative nature of (...) meaning, particularly associated with the expressions “meaning of life”. The philosophical context of the discussion was supported by the findings of cognitive sciences which refer to the impact of the subconscious and its cognitive-performative potential introduced using the categories of the “subliminal” and “tacit knowledge”. The final part of the discussion was mainly devoted to the concept of the “cognitive-performative horizon”, it emphasised the dominant impact of the unrealised dimension of individual knowledge about existence and action in the world for meaning-building cognitive and performative activities. The author’s firm belief is that transitional humanity is not yet humanity proper but pre-humanity. He is especially intrigued by the essence and purpose of today’s contradiction between humanity’s immense advancement in micro-electronics, digital technology and social lore and its shocking moral shortcomings, best visible in its stagnant unchangeability—especially regarding the passionate quest for ever-better weaponry. Will our transience turn out to be nothing more but a phase on the road to human perfection, or will it petrify into an “inborn” (...) scar? These are the main questions the author attempts to answer.As a species we are praehomine, pre-humans, a natural phase of ethical and esthetic imperfection. Typical for transitional humanity is the coexistence of progress. Nonetheless transitional humanity also carries the potential necessary to attain Wisdom, Good, Completeness and Perfection. (shrink)

In order to achieve a desired effect of tax legal interpretation, its linguistic mechanisms are frequently insufficient. Elements of paralinguistic interpretation are more and more often indispensable. It applies inter alia when domestic tax law regulations must be verified in the light of the EU tax law. However, the study depict interpretative problems regarding the institution of remuneration of excess payments, which is regulated in Polish tax law. Considerations presented in this article confirm that legal interpretation of tax law is (...) a complicated process. It is important to establish correct system connection between the analyzed legal regulations and other provisions, often contained in other legal acts. Moreover, it seems necessary to refer to the purpose-oriented interpretation of the law. Only then a chance for a satisfactory final result of the provision’s legal interpretation can be guaranteed. What is more, such an effect will create an element being a part of a logically composed and arranged unity. (shrink)

[The paper is in Polish, an English abstract is given only for information.] This article is intended for philosophers and logicians as a short partial introduction to category theory and its peculiar connection with logic. First, we consider CT itself. We give a brief insight into its history, introduce some basic definitions and present examples. In the second part, we focus on categorical topos semantics for propositional logic. We give some properties of logic in toposes, which, in general, is an (...) intuitionistic logic. We next present two families of toposes whose tautologies are identical with those of classical propositional logic. The relatively extensive bibliography is given in order to support further studies. (shrink)

Can Contemporary Science Inspire Philosophical and Theological Reflection on Causality? The cooperation between natural science, philosophy, and theology in an analysis of the causal structure and co-dependency of entities in the universe seems to be both legitimate and expected. It turns out, however, that in practice it oftentimes raises some tensions, questions and difficulties, leading to the development of alternative and in a sense competitive models of causality and of God’s action in the world. What is more, the attitude of (...) natural sciences since modernity, concentrated on gaining knowledge about natural phenomena to predict and control them, without trying to determine the nature of their ultimate causes, Humean criticism and rejection of the concept of causality as such, and concentration of analytic philosophers on the description of what accompanies phenomena classified as causal, leaving aside the question of the metaphysical status of causes and effects – they all seem to make impossible an interaction and mutual reference of contemporary science, philosophy, and theology in their reflection on the topic of causation. The main goal of this article is to defend the thesis about the possible and actual influence of scientific analysis of cause and effect relationships on the philosophical and theological reflection on causation, not only in the Middle Ages and Modernity, but also in contemporary thought. The presentation of the latest positions in the debate on divine action in the natural world will be followed by an argument in favor of the relevance of the model developed by philosophers and theologians representing the Thomistic school. The current strategy of searching for an effective treatment for COVID-19 relies mainly on repurposing existing therapies developed to target other diseases. Conflicting results have emerged in regard to the efficacy of several tested compounds but later results were negative. The number of conducted and ongoing trials and the urgent need for a treatment pose the risk that false-positive results will be incorrectly interpreted as evidence for treatments’ efficacy and a ground for drug approval. Our purpose is twofold. First, we (...) show that the number of drug-repurposing trials can explain the false-positive results. Second, we assess the evidence for treatments’ efficacy from the perspective of evidential pluralism and argue that considering mechanistic evidence is particularly needed in cases when the evidence from clinical trials is conflicting or of low quality. Our analysis is an application of the program of Evidence Based Medicine Plus to the drug repurposing trials for COVID. Our study shows that if decision-makers applied EBM+, authorizing the use of ineffective treatments would be less likely. We analyze the example of trials assessing the efficacy of hydroxychloroquine as a treatment for COVID-19 and mechanistic evidence in favor of and against its therapeutic power to draw a lesson for decision-makers and drug agencies on how excessive hypothesis testing can lead to spurious findings and how studying negative mechanistic evidence can be helpful in discriminating genuine from spurious results. Awareness of mortality is one of the key aspects of human existence. Death goes beyond the boundary of knowledge, mortality. However, it is actually experienced by man as something inevitable. Death is a fact – the end of life, and the experience of mortality is one of the borderline situations. In the essay, the author puts forward the thesis that the experience of mortality has a significant impact on the human understanding of values. Attitudes towards death be it fear, resignation, (...) indifference, fascination, mourning, sadness, despair after the loss of a loved one, or the desire for death, indicate the wealth of the world of value of axiological experience. The attitude of the person towards death, in some sense, is a test of our humanity, the principal value to which we refer most often. The author of the essay adopts the position of axiological relationalism, it implies that values are independent of the subject, they form a network of relational connections, but they are in a significant way connected with culture. The study of these connections: 1) with the world of people, 2) world of things, 3) internal relations that take place between values, allows us to get to know the complex structure of the world of values. In the article, the author analyzes in what sense mortality influences human understanding of values. (shrink)

Artykuł stanowi krytyczne omówienie książki Kevina Duttona zatytułowanej Mądrość psychopatów. Lekcja życia pobrana od świętych, szpiegów i seryjnych morderców. Celem pracy jest przybliżenie zasadniczych tez stawianych przez autora oraz zaproszenie do namysłu nad psychopatią – zarówno jako fenomenem naukowym, jak i egzystencjalnym.

The paper aims at presenting Dowgird’s attitude toward various topics in the philosophy of Immanuel Kant – its main objective is to specify and characterise those of Dowgird’s convictions which are of a direct relevance to the issues posed within transcendental idealism. The paper delivers the most important information concerning Dowgird’s life, a general outline of his philosophical conceptions against the background of Polish Enlightenment philosophy, and – in the main part – an articulation of these elements in Dowgird’s philosophy (...) which stand in a clear opposition to Kant’s views. The main aim of analyses presented in the paper is to justify the thesis that Dowgird’s attitude toward Kant’s philosophy was a complex, highly critical one, though different from that of other Polish philosophers of the nineteenth century. Dowgird’s uniqueness lies in the fact, first, that his analyses of Kant’s theories – in comparison with efforts of his Enlightenment contemporaries – were much more substantial, very scrupulous and exceptionally sophisticated, and second, that many of the problems discussed by Kant were approved by Dowgird as rightful philosophical issues. This article examines the dynamics that allowed the derogatory term “Ostjuden” to reappear in academic writing in post-Holocaust Germany. This article focuses on the period between 1980’s and 2000’s, complementing earlier studies that focused on the emergence of the term “Ostjuden” and on the complex representations of Eastern European Jews in Imperial and later Weimar Germany. It shows that, despite its well-evidenced discriminatory history, the term “Ostjuden” re-appeared in the scholarly writing in German and has also found its way into (...) German-speaking public history and journalism. This article calls for applying the adjectival term “osteuropäische Juden”, using a term that neither essentializes Eastern European Jews nor presents them in an oversimplified and uniform manner. The aim of the work is to present the conservative views of the journalist and historian Henryk Lisicki and the role he played in the community with which he collaborated, i.e. the Krakow conservatives called the Stańczyk Circle. The source of the article are monographs, brochures, dissertations, essays and articles published in „Przegląd Polski“ by Lisicki. In order to evaluate to what extent Lisicki’s political thought was original, and to what extent it was in conformity with the Stańczyk Circle, the (...) publications of Walerian Kalinka, Stanisław Tarnowski, Michał Bobczyński, Józef Szujski and Stanisław Koźmian were also used. While working on the topic, the author made use of the works specializing in the history of Polish and Western conservative thought published by Ryszard Ludwikowski, Bogdan Szlachta, Jacek Bartyzel, Józef Szacki and the views expressed by the members of the Stańczyk Circle such as Michał Jaskólski, Wojciech Dutka, Stanisław Filipowicz, Henryk Michalak. When examining the above issues, a comparative method was used, tracing both the similarities and differences in the ideas of Lisicki and his colleagues from the Stańczyk Circle. The main thesis formulated in the work is that although Lisicki did not belong to the group of leaders, his close intellectual ties with Stanisław Koźmian gave him a respected position among Krakow conservatives. The analysis of his works confirmed that he was also capable of original reflections which focused on the attitude of the conservatives to the nineteenth-century democratization processes, the evolution of Western absolute monarchies towards the constitution democracies and the expansion of electoral rights. Hence, it was symptomatic for Lisicki and his community to argue, inter alia, for the necessity of rapprochement with moderate liberals, the aim of which was to weaken the danger coming from the revolted masses which were being under the influence of radicals.
