Conscientious objection in the health care field—that is, refusal on the part of a medical professional to perform or cooperate in a procedure when it violates his or her conscience—is a growing concern for international legislators and a source of contentious debates among ethicists and the general public. Recognizing a general right to conscientious objection based on individual liberty, and thus a subjective right, could have negative consequences. Conscientious objection in health care settings should be fully protected, however, when the (...) objection is based on principles that are fundamental to the medical profession and the legal system. As improvements in neuroscience have enabled a better understanding of disorders of consciousness as well as methods to treat them, a hurdle that has become all too prevalent is the denial of coverage for treatment and rehabilitation services. In 2011, a settlement emerged from a Vermont District Court case, Jimmo v. Sebelius, which was brought to stop the use of an “improvement standard” that required tangible progress over an identifiable period of time for Medicare coverage of services. While the use (...) of this standard can have deleterious effects on those with many chronic conditions, it is especially burdensome for those in the minimally conscious state, where improvements are unpredictable and often not manifested through repeatable overt behaviors. Though the focus of this paper is on the challenges of brain injury and the minimally conscious state, which an estimated 100,000 to 200,000 individuals suffer from in the United States, the post-Jimmo arguments presented can and should have a broad impact as envisioned by the plaintiffs who brought the case on behalf of multiple advocacy groups representing patients with a range of chronic care conditions. In this essay, we suggest practical ways to shift the framing of crisis standards of care toward disability justice. We elaborate on the vision statement provided in the 2010 Institute of Medicine (National Academy of Medicine) “Summary of Guidance for Establishing Crisis Standards of Care for Use in Disaster Situations,” which emphasizes fairness; equitable processes; community and provider engagement, education, and communication; and the rule of law. We argue that interpreting these elements through disability justice entails a commitment to both (...) distributive and recognitive justice. The disability rights movement's demand “Nothing about us, without us” requires substantive inclusion of disabled people in decision‐making related to their interests, including in crisis planning before, during, and after a pandemic like Covid‐19. In diesem Beitrag wird das Verhalten des Papstes im europäischen Dialog der Religionen und Weltanschauungen kritisch erörtert. Am Anfang steht eine kurze Analyse der Sprache der Religionen bzw. Weltanschauungen, die in Anlehnung an Joseph Maria Bochenski durchgeführt ist. Es wird dabei die Auffassung vertreten, dass Religionen und manche Weltanschauungen Behauptungen über die Wirklichkeit aufstellen, Sprache in einer deskriptiv-kognitiven Funktion verwenden, dass ein solcher Sprachgebrauch eine epistemische Verpflichtung auf Bescheidenheit mit sich bringt und dass eine solche Verpflichtung wiederum eine Basis für (...) einen ernstgemeinten europäischen Dialog bieten könnte. Danach werden von einem theologischen Standpunkt ausgehend Bedingungen dafür untersucht, dass ein europäischer Dialog stattfinden kann. Anhand konkreter Beispiele, im Speziellen anhand der "Regensburger Rede" und der "Neuformulierung der Karfreitagsfürbitte für die Juden", wird gezeigt, wie sich der Papst im europäischen Dialog tatsächlich verhält und wie von Seiten der jeweiligen Religion auf dieses Verhalten eingegangen wird. Da er vor allem in der menschlichen Vernunft eine Brücke für einen europäischen Dialog sieht, wird anschließend auf seine Argumentation für eine Ausweitung der Vernunft und seinen Gebrauch der Wörter "Vernunft" und "Glauben" eingegangen. Dabei wird hauptsächlich auf Schriften, in denen der Papst seine Überzeugung ausdrückt, dass Religion und Vernunft sich gegenseitig korrigieren, begrenzen und unterstützen müssen, Bezug genommen. Abschließend wird ein bestimmtes Argument des Papstes für diese Überzeugung expliziert und bewertet. (shrink)

This book collects seventeen essays published between 1984 and 2020, in which Marina Sbisà develops her distinctive approach to speech acts and related pragmatic phenomena. Drawing inspiration from the work of J. L. Austin, the essays examine the categories of speech act theory and apply these categories in the context of natural discourse and conversation, with the aim of providing an accurate analysis of how speech can be action. Sbisà devotes particular attention to normative aspects of language and language (...) use: speech acts reshape the normative context in which they occur by assigning or unassigning deontic properties to relevant parties. Emphasis is placed on the normative aspect of linguistically mandated presuppositions as well as the rational grounds of implicature. The conventionalist view of speech acts developed here turns on the role of intersubjective agreement in deontic updating, in a framework that shifts focus from single utterances to discursive sequences and conversational interaction. This view challenges the main tenets of a Gricean intentionalist understanding of speech act performance, paving the way for a theory of speech actions centred on the normatively transformative power of illocution. Throughout the essays, examples and applications are given to illustrate how the view put forward contributes to understanding the social and political dimensions of linguistic activity, such as hidden persuasive strategies, power imbalances both within and outside the context of conversation, and the relevance of language and discourse to gender issues. This paper explores the reception of Kant's understanding of consciousness by both Romantics and Idealists from 1785 to 1799, and traces its impact on the theory of religion. I first look at Kant's understanding of consciousness as developed in the first Critique, and then looks at how figures such as Fichte, Jacobi, Hölderlin, Novalis, and Schleiermacher received this theory of consciousness and its implications for their understanding of religion.

Behavioral scientists routinely publish broad claims about human psychology and behavior in the world's top journals based on samples drawn entirely from Western, Educated, Industrialized, Rich, and Democratic (WEIRD) societies. Researchers – often implicitly – assume that either there is little variation across human populations, or that these “standard subjects” are as representative of the species as any other population. Are these assumptions justified? Here, our review of the comparative database from across the behavioral sciences suggests both that there is (...) substantial variability in experimental results across populations and that WEIRD subjects are particularly unusual compared with the rest of the species – frequent outliers. The domains reviewed include visual perception, fairness, cooperation, spatial reasoning, categorization and inferential induction, moral reasoning, reasoning styles, self-concepts and related motivations, and the heritability of IQ. The findings suggest that members of WEIRD societies, including young children, are among the least representative populations one could find for generalizing about humans. Many of these findings involve domains that are associated with fundamental aspects of psychology, motivation, and behavior – hence, there are no obviousa priorigrounds for claiming that a particular behavioral phenomenon is universal based on sampling from a single subpopulation. Overall, these empirical patterns suggests that we need to be less cavalier in addressing questions ofhumannature on the basis of data drawn from this particularly thin, and rather unusual, slice of humanity. We close by proposing ways to structurally re-organize the behavioral sciences to best tackle these challenges. (shrink)

In his book, 'History as a Science and the System of the Sciences', Thomas Seebohm articulates the view that history can serve to mediate between the sciences of explanation and the sciences of interpretation, that is, between the natural sciences and the human sciences. Among other things, Seebohm analyzes history from a phenomenological perspective to reveal the material foundations of the historical human sciences in the lifeworld. As a preliminary to his analyses, Seebohm examines the formal and material presuppositions of (...) phenomenological epistemology, as well as the emergence of the human sciences and the traditional distinctions and divisions that are made between the natural and the human sciences. -/- As part of this examination, Seebohm devotes a section to discussing Husserl’s formal mereology because he understands that a reflective analysis of the foundations of the historical sciences requires a reflective analysis of the objects of the historical sciences, that is, of concrete organic wholes (i.e., social groups) and of their parts. Seebohm concludes that Husserl’s mereological ontology needs to be altered with regard to the historical sciences because the relations between organic wholes and their parts are not summative relations. Seebohm’s conclusion is relevant for the issue of the reducibility of organic wholes such as social groups to their parts and for the issue of the reducibility of the historical sciences to the lower-order sciences, that is, to the sciences concerned with lower-order ontologies. -/- In this paper, I propose to extend Seebohm’s conclusion to the ontology of chemical wholes as object of quantum chemistry and to argue that Husserl’s formal mereology is descriptively inadequate for this regional ontology as well. This may seem surprising at first, since the objects studied by quantum chemists are not organic wholes. However, my discussion of atoms and molecules as they are understood in quantum chemistry will show that Husserl’s classical summative and extensional mereology does not accurately capture the relations between chemical wholes and their parts. This conclusion is relevant for the question of the reducibility of chemical wholes to their parts and of the reducibility of chemistry to physics, issues that have been of central importance within the philosophy of chemistry for the past several decades. While the philosophical study of shame has gained popularity, its application in the interpretation of the Hebrew Bible remains in its early stages. This paper delves into an analysis of shaming and unreasonable shame in the Book of Job, particularly in chapter 19. Through an examination of the Hebrew text and drawing on contemporary philosophical definitions of shame and shaming, I argue that Job perceives his friends, God, and the community to be employing shaming tactics against him, attempting to induce (...) feelings of shame, a sentiment Job considers unjustified. In his case, shame is deemed unreasonable because Job has not violated any cherished values that would warrant such an emotion. Additionally, I demonstrate that while Job senses God shaming him, the biblical character acknowledges that his deity is the sole entity aware of his innocence—God's eyes perceive accurately, in contrast to humans', which only assess outward appearances. The role of God as the perfect witness to Job's life is fulfilled in the epilogue of the book, where Yahweh vindicates Job from the shame he has endured by publicly denouncing the serious faults of his friends. This paper explores three important criticisms of Kant's ethics by Friedrich Schleiermacher, all having to do with Kant's alleged failure to account for the value of the individual. These are: (1) Kant's formalism precludes him from specifying ends for the will, and without such ends, the moral perfection of the individual, and the genuine appreciation of the other in his or her individuality cannot become my end; (2) Kant cannot provide an adequate metaphysical grounding of the value of the individuals (...) comprising a community; (3) Kant cannot give an account of why members of a community should value the individual qua individual in relation to the community. In this paper I discuss these criticisms and their validity in detail. I show that understood properly, Kant has the resources to answer Schleiermacher's first criticism, and I show how Schleiermacher's own system sought to avoid the second and third problems. (shrink)

Does all conscious experience essentially involve self-consciousness? In his Subjectivity and Selfhood: Investigating the First-Person, Dan Zahavi answers “yes”. I criticize three core arguments offered in support of this answer—a well-known regress argument, what I call the “interview argument,” and a phenomenological argument. Drawing on Sartre, I introduce a phenomenological contrast between plain experience and self-conscious experience. The contrast challenges the thesis that conscious experience entails self-consciousness.

We explore different ways in which the human visual system can adapt for perceiving and categorizing the environment. There are various accounts of supervised (categorical) and unsupervised perceptual learning, and different perspectives on the functional relationship between perception and categorization. We suggest that common experimental designs are insufficient to differentiate between hypothesized perceptual learning mechanisms and reveal their possible interplay. We propose a relatively underutilized way of studying potential categorical effects on perception, and we test the predictions of different perceptual (...) learning models using a two‐dimensional, interleaved categorization‐plus‐reconstruction task. We find evidence that the human visual system adapts its encodings to the feature structure of the environment, uses categorical expectations for robust reconstruction, allocates encoding resources with respect to categorization utility, and adapts to prevent miscategorizations. Criticism is a staple of the scientific enterprise and of the social epistemology of science. Philosophical discussions of criticism have traditionally focused on its roles in relation to objectivity, confirmation, and theory choice. However, attention to criticism and to criticizability should also inform our thinking about scientific pursuits: the allocation of resources with the aim of developing scientific tools and ideas. In this paper, we offer an account of scientific pursuitworthiness which takes criticizability as its starting point. We call this (...) the apokritic model of pursuit. Its core ideas are that pursuits are practices governed by norms for asking and answering questions, and that criticism arises from the breach of these norms. We illustrate and advertise our approach using examples from institutional grant review, neuroscience, and sociology. We show that the apokritic model can unify several indices of criticizability, that it can account for the importance of criticizing pursuits in scientific practice, and that it can offer ameliorative advice to erstwhile pursuers. Since the very beginning, Confucianism has been troubled by a serious gap between its political ideals and the reality of societal circumstances. Contemporary Confucians must develop a viable method of governance that can retain the spirit of the Confucian ideal while tackling problems arising from nonideal modern situations. The best way to meet this challenge, Joseph Chan argues, is to adopt liberal democratic institutions that are shaped by the Confucian conception of the good rather than the liberal conception of the (...) right.Confucian Perfectionism examines and reconstructs both Confucian political thought and liberal democratic institutions, blending them to form a new Confucian political philosophy. This paper develops a largely neglected parallel between prudence and population ethics. Prudence is generally understood to be concerned with the balancing of well-being over time. How, precisely, well-being ought to be balanced over time, however, is a fervently debated question. I argue that developing a standard guiding such evaluations is exceedingly challenging. This is due to an often overlooked fact about prudence, namely that it shares a structural similarity with population ethics: In both contexts, we assess the comparative value (...) of populations of personstages/people, which may vary in number and level of well-being. Based on this analogy, I show that the development of an adequate theory of prudence runs into very similar impossibility results as obtain in population ethics. In particular, I prove that Arrhenius’ fifth impossibility theorem can be applied to prudence. I develop and compare four possible answers to this challenge. First, I discuss the possibility of accepting the very repugnant conclusion intrapersonally. Second, I present and further develop Donald Bruckner’s Minimax Regret approach, which gives up Transitivity. Third, I apply Jacob Nebel’s Lexical Threshold View to prudence and critically evaluate it. Lastly, I introduce what I call the Negative Lexicality View, which is based on Lexical Threshold View but overcomes some of its problems. (shrink)

Die Relevanz des Buches liegt darin, eine Analyse der Begriffe von Gesundheit und Krankheit (tragischer und schlechter Pessimismus) in direkter Beziehung zu leiblichen Vorgängen vorzulegen, die sich von metaphysisch-dialektischen Voraussetzungen befreit. We offer a new account of the role of values in theory choice that captures a temporal dimension to the values themselves. We argue that non-epistemic values sometimes serve as “inquiry tickets,” justifying scientists’ pursuit of certain questions in the short run, while the answers to those questions mitigate transient underdetermination in the long run. Our account of inquiry tickets shows that the role of non-epistemic values need not be restricted to belief or acceptance in order to be relevant to (...) hypothesis choice: the relevance of non-epistemic values to a particular cognitive attitude with respect to h vary over time. What, if anything, do the ‘square’ protests and ‘occupy’ movements of 2011 bring to contemporary democratic theory? And how can we, as political theorists, analyse their discourse and do justice to it? We address these questions through an analysis of the Greek and Spanish protest movements of the spring and summer of 2011, the so-called aganaktismenoi and indignados. We trace the centrality of the critique of representation and politics as usual as well as the ideas about horizontality and autonomy in (...) the protesters’ discourse. These ideas are not only important to their critique of the contemporary liberal democratic regimes in the two countries, but also important to the way in which the protesters organise themselves. Nonetheless, as we shall argue, the protesters are caught within a tension between horizontality and verticality, between autonomy and hegemony, or between moving beyond representation and accepting representational structures. Given this tension, we examine how the protesters negotiate it in three key areas: politics, representation and organisation. Drawing on Jacques Rancière, we further argue that the protesters can be seen as making a claim to equal voice. This is what Rancière refers to as politics proper, and the question is then whether such a politics is possible without falling back into traditional forms of politics. (shrink)

José Benardete developed a famous paradox involving a beginningless set of items each member of which satisfies some predicate just in case no earlier member satisfies it. The Grim Reaper version of this paradox has recently been employed in favor of various finitist metaphysical theses, ranging from temporal finitism to causal finitism to the discrete nature of time. Here, I examine a new challenge to these finitist arguments—namely, the challenge of implying that the future cannot be endless.
