We reflect, using a vignette, on conceptual tensions and the value judgements that lie behind difficult decisions about whether or not the older person with dementia should return home or move into long-term care following hospital admission. The paper seeks, first, to expose some of the difficulties arising from the assessment of residence capacity, particularly around the nature of evaluative judgements and conceptual tensions inherent in the legal approach to capacity. Secondly, we consider the assessment of best interests around place (...) of residence, which demonstrates significant conceptual tensions. In addition, ‘best interests’ raise issues around the perception of risk and the perceptions of the family and crucially involve the notions of autonomy and trust. Finally, we not only gesture at some practical considerations based on insights from values-based medicine, but also make the suggestion that we require tighter functional assessments of residence capacity coupled with broader judgements about best interests. Educators and students alike face an enormous number of new fields of study and new medical technologies. Health care professionals and institutions are also facing new challenges in the form of shrinking economic resources, and the AIDS epidemic. They must (...) also respond to increased patient participation in health care decisions, and public concern about abortion and euthanasia. These challenges to the health care professional have compelled educators to accommodate ethics within their already overcrowded curriculum. Those same dilemmas have influenced health care institutions to become active in health care ethics education.Medical ethics education gained a foothold in the United States during the late 1960s, when the medical schools of Pennsylvania State University, the University of Florida, and the State University of New York at Stonybrook established programs in the humanities (Pellegrino 1982). In 1978 Robert Veatch noted that formal teaching in medical ethics was rare; most institutions that taught medical ethics used "informal instruction in the apprenticeship mode" (Veatch 1978). However, by 1982 a survey by the American Medical Association (AMA) revealed that all but one of the 127 medical schools had courses that included medical ethics. Thirty eight of these had medical ethics as a required course (Pellegrino 1985). And by 1989, 43 of the 127 medical schools had separate courses in medical ethics, while 100 covered medical ethics within required courses. Medical ethics is now an accepted part of medical curriculum, though it is not fully mature, and its future remains somewhat unclear (Miles 1989).The evolution of ethics in the nursing curriculum has essentially mirrored that of the medical curriculum. A 1977 survey of baccalaureate nursing programs revealed that only 7 percent of nursing programs required courses in ethics [End Page 171] (Aroskar 1977). The factor structure of the Multidimensional Ethics Scale (MES; Reidenbach and Robin: 1988, Journal of Business Ethics 7, 871–879; 1990, Journal of Business Ethics 9, 639–653) was examined for the 8-item short form (N = 328) and the original 30-item pool (N = 260). The objectives of the study were: to verify the dimensionality of the MES; to increase the amount of true cross-scenario variance through the use of 18 scenarios varying in moral intensity (Jones: 1991, Academy of Management Review (...) 16, 366–395); and, to examine the items for measurement precision using item-response theory (IRT) methods. Results of confirmatory and exploratory factor analysis failed to conclusively support the hypothesized 3- (short form) or 5-factor (long form) structure; both instruments were instead dominated by a general factor. Item response theory analyses using Samejima’s (1969, Psychometrika Monograph Supplement 34, (4, Pt. 2)) graded response model revealed that many items in the 30-item pool performed very well, and suggested that a different collection of items be used to form a short-form version of the MES. Our proposed 10-item instrument includes more discriminating items than the 8-item version, and has the added advantage of including two items from each of the five ethical philosophies represented in the original 30-item pool. Understanding the clinical significance of variants associated with hereditary cancer risk requires access to a pooled data resource or network of resources—a “cancer gene variant commons”—incorporating representative, well-characterized genetic data, metadata, and, for some purposes, pathways to case-level data. Several initiatives have invested significant resources into collecting and sharing cancer gene variant data, but further progress hinges on identifying and addressing unresolved policy issues. This commentary provides insights from a modified policy Delphi process involving experts from a range of stakeholder (...) groups involved in the data-sharing ecosystem. In particular, we describe policy issues and options generated by Delphi participants in five domains critical to the development of an effective cancer gene variant commons: incentives, financial sustainability, privacy and security, equity, and data quality. Our intention is to stimulate wider discussion and lay a foundation for further work evaluating policy options more in-depth and mapping them to those who have the power to bring about change. Addressing issues in these five domains will contribute to a cancer gene variant commons that supports better care for at-risk and affected patients, empowers patient communities, and advances research on hereditary cancers. Sprint interval training is characterized by intensity of “all-out” effort and superior time-efficiency compared to traditional moderate-intensity continuous training and has been proposed as one viable solution to address the commonly reported barrier of lack of time for physical activity. While substantial physiological benefits of participation in SIT have been well-documented, the psychological responses to SIT are less clear. No systematic review has been conducted thus far to respond to the assumption that its supramaximal intensity will induce adverse feelings. Therefore, (...) the aim of the present study was to synthesize studies analyzing affective and enjoyment responses to SIT and to compare the responses to SIT with MICT and other high intensity interval training protocols with lower intensities. After searching relevant databases up until 22nd March 2021, twenty-five studies meeting the inclusion criteria were included in the present review. Random effect meta-analysis using the pooled data demonstrated that SIT induced similar post-exercise affective valences during the training compared to MICT and HIIT, but lower affective valences immediately post-exercise compared to MICT. Moreover, affective responses during SIT decreased to negative valences according to the results from most included studies, while low-volume SIT protocols with shorter sprint duration and repetitions induced more positive affective responses. Level of enjoyment after SIT were positive and were comparable to MICT or HIIT. Overall, the results from the existing literature indicate that SIT might cause unpleasant feelings during the training and be perceived less pleasurable than MICT immediately post training but could be a comparably enjoyable modality for healthy individuals in relation to MICT or HIIT, despite its supramaximal intensity. Recent financial fraud legislation such as the Dodd–Frank Act and the Sarbanes–Oxley Act (U.S. House of Representatives, Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, [H.R. 4173], 2010 ; U.S. House of Representatives, The Sarbanes–Oxley Act of 2002, Public Law 107-204 [H.R. 3763], 2002 ) relies heavily on whistleblowers for enforcement, and offers protection and incentives for whistleblowers. However, little is known about many aspects of the whistleblowing decision, especially the effects of contextual and wrongdoing attributes on organizational (...) members’ willingness to report fraud. We extend the ethics literature by experimentally investigating how the nature of the wrongdoing and the awareness of those surrounding the whistleblower can influence whistleblowing. As predicted, we find that employees are less likely to report: (1) financial statement fraud than theft; (2) immaterial than material financial statement fraud; (3) when the wrongdoer is aware that the potential whistleblower has knowledge of the fraud; and (4) when others in addition to the wrongdoer are not aware of the fraud. Our findings extend whistleblowing research in several ways. For instance, prior research provides little evidence concerning the effects of fraud type, wrongdoer awareness, and others’ awareness on whistleblowing intentions. We also provide evidence that whistleblowing settings represent an exception to the well-accepted theory of diffusion of responsibility. Our participants are professionals who represent the likely pool of potential whistleblowers in organizations. (shrink)

The world’s first living donor liver transplant from an HIV-positive mother to her HIV-negative child, performed by our team in Johannesburg, South Africa in 2017, was necessitated by disease profile and health system challenges. In our country, we have a major shortage of donor organs, which compels us to consider innovative solutions to save lives. Simultaneously, the transition of the HIV pandemic, from a death sentence to a chronic illness with excellent survival on treatment required us to rethink our policies (...) regarding HIV infection and living donor liver transplantation. Although HIV infection in the donor is internationally considered an absolute contraindication for transplant to an HIV-negative recipient, there have been a very small number of unintentional transplants from HIV-positive deceased donors to HIV-negative recipients. These transplant recipients do well on antiretroviral medication and their graft survival is not compromised. We have had a number of HIV-positive parents in our setting express a desire to be living liver donors for their critically ill children. Declining these parents as living donors has become increasingly unjustifiable given the very small deceased donor pool in SA; and because many of these parents are virally suppressed and would otherwise fulfil our eligibility criteria as living donors. This paper discusses the evolution of HIV and transplantation in SA, highlights some of the primary ethical considerations for us when embarking on this case and considers the new ethical issues that have arisen since we undertook this transplant. What are the conditions under which one biological object is a part of another biological object? This paper answers this question by developing a general, systematic account of biological parthood. I specify two criteria for biological parthood. Substantial Spatial Inclusionrequires biological parts to be spatially located inside or in the region that the natural boundary of t he biological whole occupies. Compositional Relevance captures the fact that a biological part engages in a biological process that must make a necessary contribution (...) to a condition that is minimally sufficient to one or more of the characteristic behaviors of the biological whole. Instead of emphasizing the diversity of part-whole relations in the biological world, this paper asks what biological part-whole relations have in common and what constrains their existence, in general. After presenting the two criteria for biological parthood I discuss in how far my account can cope with hard cases (e.g., redundant parts) and I reveal the merits and limits of monism. (shrink)

Mary Shepherd's An Essay upon the Relation of Cause and Effect, first published in 1824, was a pioneering work in metaphysics and epistemology. Together with her 1827 Essays on the Perception of an External Universe, they make her one of the most important philosophers of her era. Although widely neglected by the history of philosophy in the decades after her death, her works have recently begun to attract the attention and sustained study they deserve. In the course of her writings, (...) Shepherd offers trenchant and detailed rebuttals of the arguments and conclusions of many prominent predecessors-including George Berkeley, Thomas Reid, Dugald Stewart, Thomas Brown, William Lawrence, and especially David Hume-but she is no merely negative thinker. On the contrary, her critiques are always in the service of her own distinctive and highly original doctrines, which are of striking contemporary interest. Appearing two hundred years after its original publication, this is the first full modern edition of her first book, which presents and defends the theory of causation and scientific knowledge that constitutes the cornerstone of her entire philosophy. Anger has potential epistemic value in the way that it can facilitate a process of our coming to have knowledge and understanding regarding the issue about which we are angry. The nature of anger, however, may nevertheless be such that it ultimately undermines this very process. Common non-philosophical complaints about anger, for instance, often target the angry person as being somehow irrational, where an unformulated assumption is that her anger undermines her capacity to rationally engage with the issue about which (...) she is angry. Call this assumption the charge of emotional irrationality regarding anger. Such a charge is pernicious when levelled at the anger of those in positions of marginalisation or oppression, where it can threaten to silence voices on the very issue of the injustices that they face. In this paper I thus provide a much-needed interrogation of this charge. Firstly, and drawing on empirical literature on the effects of anger on decision-making, I flesh out the charge and why it poses a threat to how the epistemic value of anger has been defended. Secondly, I argue that the charge of emotional irrationality regarding anger can nevertheless be unwarranted, at least within a common context of political anger. (shrink)

Discussion of Wittgenstein's Tractatus is currently dominated by two opposing interpretations of the work: a metaphysical or realist reading and the 'resolute' reading of Diamond and Conant. Marie McGinn's principal aim in this book is to develop an alternative interpretative line, which rejects the idea, central to the metaphysical reading, that Wittgenstein sets out to ground the logic of our language in features of an independently constituted reality, but which allows that he aims to provide positive philosophical insights into (...) how language functions. McGinn takes as a guiding principle the idea that we should see Wittgenstein's early work as an attempt to eschew philosophical theory and to allow language itself to reveal how it functions. By this account, the aim of the work is to elucidate what language itself makes clear, namely, what is essential to its capacity to express thoughts that are true or false. However, the early Wittgenstein undertakes this descriptive project in the grip of a set of preconceptions concerning the essence of language that determine both how he conceives the problem and the approach he takes to the task of clarification. Nevertheless, the Tractatus contains philosophical insights, achieved despite his early preconceptions, that form the foundation of his later philosophy. -/- The anti-metaphysical interpretation that is presented includes a novel reading of the problematic opening sections of the Tractatus, in which the apparently metaphysical status of Wittgenstein's remarks is shown to be an illusion. The book includes a discussion of the philosophical background to the Tractatus, a comprehensive interpretation of Wittgenstein's early views of logic and language, and an interpretation of the remarks on solipsism. The final chapter is a discussion of the relation between the early and the later philosophy that articulates the fundamental shift in Wittgenstein's approach to the task of understanding how language functions and reveal the still more fundamental continuity in his conception of his philosophical task. Agonistic Democracy explores how theoretical concepts from agonistic democracy can inform institutional design in order to mediate conflict in multicultural, pluralist societies. This paper responds to John Burgess's ‘Mathematics and _Bleak House_’. While Burgess's rejection of hermeneutic fictionalism is accepted, it is argued that his two main attacks on revolutionary fictionalism fail to meet their target. Firstly, ‘philosophical modesty’ should not prevent philosophers from questioning the truth of claims made within successful practices, provided that the utility of those practices as they stand can be explained. Secondly, Carnapian scepticism concerning the meaningfulness of _metaphysical_ existence claims has no force against a _naturalized_ version (...) of fictionalism, according to which our ordinary standards of scientific evidence may show that we have no reason to believe the mathematical existence claims made within the context of our mathematical and scientific theories. Prince Evgenii Trubetskoi, one of Russia’s great philosophers, exemplified what was best in the Russian religious-philosophical tradition. His lifelong pursuit was “integral knowledge.” This ideal affirmed that faith was integral to reason and that inner experience, and not just external sensory experience, offered truthful testimony to the nature of reality—precisely contrary to the reductive positivism and scientism of Trubetskoi’s day and ours. This is the first modern edition of the works of Lady Mary Shepherd, one of the most important women philosophers of the early modern period. Shepherd has been widely neglected in the history of philosophy, but her work engaged with the dominant philosophers of the time - among them Hume, Berkeley, and Reid. This paper examines the cosmological theories of Francis Lodwick (1619-94), the Fellow of the Royal Society, language theorist and close associate of Robert Hooke, concentrating on some unnoticed manuscripts he wrote on this issue. It is demonstrated that Lodwick's account of creation acts as a commentary on the opening chapters of Genesis, influenced in equal measures by the new corpuscular philosophy, and by the heretical, messianic ideas of the Frenchman Isaac La Peyrere, whose Prae-Adamitae (1655) so shocked European scholars. Such (...) a conclusion emphasizes that in the case of Lodwick no clear distinction between biblical criticism and natural philosophy can be maintained, and that the theological ideas he brought to his vortical model of creation were strongly heretical. Such a situation contradicts the proposition insisted upon by early apologists for the Royal Society that the institutionalizing of scientific work would promote orthodox Christianity. (shrink)

Poole*The Moscow Psychological Society, founded in 1885 at Moscow University, was the philosophical center of the revolt against positivism in the Russian Silver Age. By the end of its activity in 1922 it had played the major role in the growth of professional philosophy in Russia. 1 The Society owes its name to its founder, M. M. (...) Troitsky (1835–99), an empiricist psychologist. Although it sponsored significant psychological research, its greater importance in the history of Russian philosophy began to emerge already in 1888, when Nikolai Ia. Grot (1852–99) took over as director. Grot’s principal colleagues in the affairs of the Society included the major Russian idealist philosophers Vladimir S. Solov’ev (1853–1900), Sergei N. Trubetskoi (1862–1905), and Lev M. Lopatin (1855–1920). In 1889 the Psychological Society began publication of Russia’s first regular, specialized journal in philosophy, Questions of Philosophy and Psychology (Voprosy Filosofii i Psikhologii). Grot characterized the journal’s prevailing direction as idealist or, “in respect to method, metaphysical.” 2While the cultural revival of the Silver Age mounted a broad-based revolt against positivism, neo-idealist philosophy in the Psychological Society was distinctive in the theoretical depth of its critique. Positivism was remarkably pervasive [End Page 319] in Russia from the middle of the nineteenth century. The main characteristics of this positivist Weltanschauung were reductionism, which dismissed as a meaningless proposition (neither analytic nor empirical) the possibility of being beyond the positively-given data of sense experience, i.e., phenomena in space and time; scientism, the claim, consistent with the positivist reduction of being to natural phenomena, that the methodology of the natural sciences covered eve-rything; and utopianism, the hope that the application of natural scientific methods to man and society would make human existence as regular and well-ordered as nature. 3 The defining trait was reductionism or, in other words, naturalism or atheism: the reduction of being to nature. In ethics, epistemology, ontology, and social philosophy neo-idealism emerged as a response to these characteristics. Its development by philosophers in the Psychological Society, apart from comprising a basic chapter in the history of Russian thought, informs the European-wide revolt against positivism characteristic of fin-de-siècle culture.According to scientistic positivism, philosophy had no distinctive methodology and thus no legitimate right to exist as its own type of scientific (nauchnyi or wissenschaftlich) discipline. Empirical sciences were the only sciences; philosophy could at best serve as a field that systematized empirical research. Against these claims Russian neo-idealists sought to advance the autonomy of philosophy by showing that the positivist measure of reality was far from exhaustive and that what it did not exhaust comprised the domain of philosophy. This domain was human consciousness itself, to the extent it could be shown to be irreducible to empirical experience (the positivist sphere). Neo-idealism thus took shape as a type of philosophy of consciousness. In the inaugural issue of Questions of Philosophy and Psychology S. N. Trubetskoi published the first installment of a large essay bearing the title, “On the Nature of Human Consciousness.” “The question of the nature of consciousness is the principal question of philosophy, not only of psychology,” Trubetskoi wrote, “for in consciousness we know everything that we know.” 4 Trubetskoi and his colleagues in the Psychological Society were convinced that philosophy had to develop through specification of its own internal standards and through autonomization from the spurious criteria positivism applied externally to it. Their goal was to match, in theoretical rigor, the professionalism associated with the natural sciences by making philosophy “scientific,” but on idealist, not empirical grounds. [End Page 320]The Kantian Critique of PositivismIn their defense of the self against positivist reductionism and naturalism, neo-idealists of the Psychological Society were deeply indebted to Kant, in both epistemology and moral philosophy. Lara sugiere que el aprendizaje moral es un proceso en el que intervienen las instituciones sociales, la voluntad de los individuos y de las sociedades para comprometerse a un debate abierto y con ello modelar los juicios colectivos sobre el pasado. Lara enfatiza que el juicio reflexionante se da entre un evento, una narración de dicho evento y la recepción pública de dicha narrativa. In Vodou Cosmology and the Haitian Revolution in the Enlightenment Ideals of Kant and Hegel, Vivaldi Jean-Marie begins with an interpretation of the rise of Vodou practices in Saint-Domingue which is sensitive to the social, spiritual and cultural challenges of the slaves communities in Saint-Domingue, later Haiti. He shows effectively that Vodou cosmology emerged as a spiritual, social and cultural technology for the enslaved to overcome the dissonance and brutality of slavery in Saint-Domingue. Vodou Cosmology thus assumes the tripartite (...) role of spiritual, social and cultural compass for slaves who, concurrently with the development of Vodou, managed to establish a common ethos. Furthermore, to situate the rise of Vodou cosmology within the larger discourse of the Enlightenment and argue that it heralded a radical Enlightenment in the African diaspora, Jean-Marie compares and contrasts some aspects of the philosophies of Kant and Hegel with the social, spiritual and cultural experience of the enslaved communities of Saint-Domingue. This comparison shows that Kant and Hegel's depiction of African Negroes' mores and their religious practices in the colonies fails to capture that Vodou cosmology was both a mechanism of resistance and the medium to restore their social, spiritual, and cultural identity against the backdrop of the Atlantic slave trade. Also, he elaborates the Enlightenment's conception of African Negroes as commercial currency and specifically Hegel's view of slavery in the colonies as the manifestation of divine providence. He concludes that the significance of the Haitian Revolution lies in the fact that it ascribed freedom to people of African descent in the diaspora and is thus implicit in later themes of black freedom. The Haitian Revolution ties blackness with freedom and mapped out a radical enlightenment in the European colonies. (shrink)
