Economic and sanitary crises have great repercussions on access to food and the health of the population. In this context, austerity policies can have devastating effects on social rights. The purpose of this essay is to reflect on the impact of various types of crises on the Human Right to Adequate Food and Nutrition (DHANA) and on Food and Nutritional Security (SAN) of vulnerable populations and to identify of public policies, programs and actions developed based on the relief of the (...) damage caused by the COVID-19 pandemic. From the collection of information carried out in a non-systematic way on government websites and scientific databases, documents were read in full, categorized, and critically analyzed. Three different contexts, Africa, Latin America, and Portugal, are presented by the authors who work in these realities, with the intention of contributing to mitigate the food problems that worsen and are derived from the pandemic situation. The purpose of this article is to initiate a philosophical discussion about the ethical component of professional competence in nursing from the perspective of Brazilian nurses. Specifically, this article discusses professional competence in nursing practice in the Brazilian health context, based on two different conceptual frameworks. The first framework is derived from the idealistic and traditional approach while the second views professional competence through the lens of historical and dialectical materialism theory. The philosophical analyses show that the idealistic view of (...) professional competence differs greatly from practice. Combining nursing professional competence with philosophical perspectives becomes a challenge when ideals are opposed by the reality and implications of everyday nursing practice. (shrink)

La discussione generale sulla filosofia della scienza contemporanea è complicata dal numero e dall’eterogeneità delle scienze, mentre lo studio di temi specifici porta inevitabilmente a dissertazioni specialistiche che mancano nel dare ragione della trama di senso sottostante. Questo Piccolo trattato di epistemologia intende occupare uno spazio vuoto, proponendo alcuni temi chiave per la comprensione dei meccanismi alla base della conoscenza scientifica: i rapporti tra filosofia e scienze, siano esse naturali o umane; la complessa relazione tra fatti e valori; la distinzione (...) tra scoperta e giustificazione; la necessità di un discorso etico sulla ricerca, che chiami in causa categorie come fiducia, empatia, altruismo ed egoismo. The diagnosis of idiopathic short stature refers to children who are considerably shorter than average without any identified medical reason. The US Food and Drug Administration authorised marketing of recombinant human growth hormone for ISS in 2003, while the European Medicines Agency refused it in 2007. This paper examines the arguments for these decisions as detailed in selected FDA and EMA documents. It combines argumentative analysis with an approach to policy analysis called ‘What’s the problem represented to be’. It argues (...) that the FDA presents its approval as an argument for equity of access to the treatment, describing short stature as a potential disadvantage, and assuming that height normalisation is a clinically meaningful result. The EMA, instead, refuses marketing authorisation with an argument that there is an imbalance of risks and benefits, describing ISS as a healthy condition, and arguing that hGH should provide some psychosocial and/or quality of life benefits to children with ISS other than height gain. This paper then discusses how these arguments could be read through different models of disability, particularly through the medical model of disability and the relational, experiential, and cultural understandings of disability. This volume offers a meta-philosophical reflection on feminist philosophies of science. It emphasizes and discusses both the connections and differences between "traditional" philosophies of science and feminist philosophies of science. The collection systematically analyses feminist contributions to the various philosophies of specific sciences. Each chapter is devoted to a specific area of philosophy of science: general philosophy of science, philosophy of biology, philosophy of climate sciences, philosophy of cognitive sciences and neurosciences, philosophy of economics, philosophy of history and archaeology, philosophy (...) of logic and mathematics, philosophy of medicine, philosophy of psychology, philosophy of physics, and philosophy of social sciences. Since some of these areas have so far rarely been addressed by feminist philosophers, this new collection provides new angels and stimulates the debate on pivotal issues that are part and parcel of both "traditional" philosophies of science and feminist philosophies of science. Over the last three quarters of a century, international guidelines and regulations have undergone significant changes in how children are problematised as participants in biomedical research. While early guidelines enacted children as vulnerable subjects with diminished autonomy and in need of special protection, beginning in the early 2000s, international regulatory frameworks defined the paediatric population as vulnerable due to unaddressed public health needs. More recently, ethical recommendations have promoted the active engagement of minors as research partners. In this paper, I (...) adopt a post-structuralist approach to policy analysis to examine deep-seated assumptions and presuppositions underlying the changes in the problematisation of children as biomedical research participants over time. While biomedical research ethics focuses on the autonomy and vulnerability of minors, ethical guidelines are situated in specific sociocultural contexts, shaped, among other things, by contingent public health needs and changing conceptions of the value of research and science for society. In the process, I demonstrate the challenge of moving away from an approach that in taking adults as the model overshadows the complexity of children’s lived experiences as well as their personal, cultural, and social lives. The lack of acknowledgement of this complexity makes children vulnerable to epistemic injustice, which is particularly crucial to address in public involvement initiatives. (shrink)

According to the minimal version of the traditional analysis of knowledge, there are (at least) three necessary components to knowledge, that is, truth, belief and justification. In this paper we will argue that even in a global sceptical scenario, all three conditions minimally necessary for knowledge can be satisfied. In particular, we will focus on the justification requirement and analyse two “traditional” theories of justification, i.e., coherentism and foundationalism, as well as a more “innovative” one, i.e., reliabilism. Then, we will (...) conclude that if we want to continue to claim that, in a global sceptical scenario, a cognitive subject does not know (almost) anything, we should recognise that she may still have justified true beliefs, and we should, therefore, look elsewhere for the reasons why she lacks knowledge. Many words and thoughts have already been spent trying to define the nature and standards of reason and rationality, what they could or ought to be, and under what conditions something can be said to be rational. This volume focuses instead on the relationships (...) of reason and rationality to some relevant specific topics, i.e., science, knowledge, gender, politics, ethics, religion, aesthetics, language, logic, and metaphysics, trying to uncover and clarify both the connections and differences in their various characterisations and uses. In the ongoing pandemic, death statistics influence people’s feelings and government policy. But when does COVID-19 qualify as the cause of death? As philosophers of medicine interested in conceptual clarification, we address the question by analyzing the World Health Organization’s rules for the certification of death. We show that for COVID-19, WHO rules take into account both facts and values.

El artículo tiene como objetivo fundamental presentar el concepto de repetición bajo tres aspectos. El primero es su ubicación en el contexto de la existencia individual; el segundo, su carácter de exigencia de búsqueda de la libertad; y, finalmente, la consideración de la repetición como acontecimiento de la existencia. El recorrido del artículo revela así el tránsito que se emprende desde la importancia de la figura del lector en su profunda soledad; lector de la vida, de la prueba, de la (...) circunstancia, de lo ineludible; hasta la revelación de la existencia revestida en un acto mimético. Este recorrido aparece evidenciado porque se pone de relieve la preocupación humana no sólo por la existencia, sino por el sentido que ella adquiere frente a la posibilidad del mal desde lo particular, desde lo individual. En este orden de ideas, tras un seguimiento del concepto de repetición se pretende hacer evidente un interés que puede llamarse interés existencial y por ello filosófico: volver la cara hacia el individuo. Exemplos, relatos e anedotas históricas são recorrentes nos Ensaios e revelam a maneira original de Montaigne se apropriar da história: como estudo do passado e das ocorrências particulares; como alimento moral; como referência fictícia ou real; através da relação da história com a retórica e a prova argumentativa; como história contemporânea e a crítica da mentalidade cultural; como história de vida. Em todas essas articulações da narrativa histórica, que podemos sintetizar ao modo de uma conversação com os homens do passado (...) e do presente, encontramos o alvo de Montaigne: ir das ações às intenções, do outro para o conhecimento de si, do diverso para o discernimento. A história, sobretudo aquela à maneira plutarquiana, constitui matéria prima indispensável para o exercício do julgamento de Montaigne. Examples, reports and historical anecdotes are not hard to find in Les Essais and reveal Montaigne's original way of approaching history: as a study of the past and particular events; as moral nourishment; as fictitious or real reference; by relating history to rhetoric and argumentative proof; as contemporary history and criticism of cultural mentality; as life story. In all these articulations of historical narrative, which we can synthesize as a conversation with men of the past and present time, we find Montaigne's target: to go from actions to intentions, from the other to the knowledge of oneself, from diversity to discernment. History, mainly the one that follows Plutarch's style, composes the raw material indispensable to Montaigne's exercise of judgment. (shrink)

Background Only a few studies have been conducted to assess physicians’ knowledge of legal standards. Nevertheless, prior research has demonstrated a dearth of medical law knowledge. Our study explored physicians’ awareness of legal provisions concerning informed consent and confidentiality, which are essential components of the physician-patient relationship of trust. -/- Methods A cross-sectional study assessed attending physicians’ legal knowledge of informed consent and confidentiality regulations. The study was conducted in nine hospitals in Dolj County, Romania. Physicians were given a questionnaire (...) with ten scenarios and instructed to select the response that best reflected their practice. We assessed the responses of physicians who claimed their practice to be entirely legal. Their legal knowledge was evaluated by comparing their answers to applicable laws. We also calculated a score for the physicians who admitted to committing a legal breach. -/- Results Of the 305 respondents, 275 declared they never committed any law violation. However, their median correct answer score was 5.35 ± 1.66 out of 10. The specialty was the strongest predictor of legal knowledge, with emergency physicians rating the lowest and non-surgical physicians scoring the highest. Physicians who worked in both private and public sectors were better knowledgeable about legal issues than those who worked exclusively in the public sector. Results indicate that physicians are aware of the patient’s right to informed consent but lack comprehensive understanding. While most physicians correctly answered simple questions, only a tiny minority identified the correct solution when confronted with ethical dilemmas. The physicians who acknowledged breaching the law, on the other hand, had a slightly higher knowledge score at 5.45 ± 2.18. -/- Conclusion Legal compliance remains relatively low due to insufficient legal awareness. Physicians display limited awareness of legal requirements governing patient autonomy, confidentiality, and access to health data. Law should be taught in all medical schools, including undergraduate programs, to increase physicians’ legal knowledge and compliance. (shrink)

O objetivo do presente texto é apresentar algumas das críticas que Origens do Totalitarismo de Hannah Arendt recebeu e as discussões que suscitaram, demonstrando as dificuldades de compreender o sistema totalitário e a novidade que a interpretação de Arendt gerou. Entre os principais críticos estão Raymond Aron, Waldemar Gurian, Kurt Blumenfeld, Eric Voegelin e Karl Jaspers. Serão apresentadas algumas das críticas para, em seguida, estabelecer a discussão a partir da argumentação contida nos textos de Arendt. Serão utilizadas como principais referências (...) as obras de Arendt Origens do Totalitarismo e A condição humana, os textos “Compreensão e política”, “Sobre a natureza do totalitarismo: uma tentativa de compreensão”, “A tradição e a época moderna”, “O conceito de história: antigo e moderno”, “Que é autoridade” e “Uma réplica a Eric Voegelin”. Também serão utilizadas as cartas de Arendt com Karl Jaspers e Kurt Blumenfeld e alguns dos textos dos críticos. As biografias sobre Arendt de Elizabeth Young-Bruehl, Sylvie Courtine-Dénamy e Laure Adler e textos de Odílio Alves Aguiar e Daiane Eccel serão utilizadas como fontes importantes. Concluiu-se que Arendt desafiava a compreensão ao não simplesmente descrever os acontecimentos, mas ao realizar aquilo que acreditava ser a própria filosofia, um exercício de pensamento. (shrink)

The general definition of mental disorder stated in the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders seems to identify a mental disorder with a harmful dysfunction. However, the presence of distress or disability, which may be bracketed as the presence of harm, is taken to be merely usual, and thus not a necessary requirement: a mental disorder can be diagnosed as such even if there is no harm at all. In this paper, we focus on the (...) harm requirement. First, we clarify what it means to say that the harm requirement is not necessary for defining the general concept of mental disorder. In this respect, we briefly examine the two components of harm, distress and disability, and then trace a distinction between mental disorder tokens and mental disorder types. Second, we argue that the decision not to regard the harm requirement as a necessary criterion for mental disorder is tenable for a number of practical and theoretical reasons, some pertaining to conceptual issues surrounding the two components of harm and others pertaining to the problem of false negatives and the status of psychiatry vis-à-vis somatic medicine. However, we believe that the harm requirement can be maintained among the specific diagnostic criteria of certain individual mental disorders. More precisely, we argue that insofar as the harm requirement is needed among the specific diagnostic criteria of certain individual mental disorders, it should be unpacked and clarified. (shrink)

Discute-se a capacidade humana de estabelecer novos começos no mundo. A pergunta que orienta a discussão refere-se à possibilidade da dignidade da política em tempos sombrios e em tempos de crise da democracia e do estado de direito. Parte-se do pressuposto de que a garantia da liberdade compõe o fundamento do Estado Democrático de Direitos, portanto a liberdade deve ser assegurada. No intuito de compreender a liberdade como pressuposto da democracia, objetiva-se elucidar a capacidade humana de trazer a novidade ao (...) mundo, de começar, de iniciar. Para tal utiliza-se como fundamentação teórica os estudos de Hannah Arendt acerca da atividade da ação – onde se faz imprescindível o discurso – e da capacidade de começar; a partir disso busca-se compreender a liberdade. Aponta-se que a dignidade da política encontra resposta na liberdade como o sentido da fundação das comunidades políticas e na possibilidade humana do estabelecimento de novos começos. (shrink)

In 2003, the Food and Drug Administration approved the use of growth hormone treatment for idiopathic short stature children, i.e. children shorter than average due to an unknown medical cause. Given the absence of any pathological conditions, this decision has been contested as a case of medicalisation. The aim of this paper is to broaden the debate over the reasons for and against the treatment, to include considerations of the sociocultural phenomenon of the medicalisation of short stature, by means of (...) a critical understanding of the concept of medicalisation. After defining my understanding of medicalisation and describing both the treatment and the condition of idiopathic short stature, I will problematise two fundamental issues: the medical/non-medical distinction and the debate about the goals of medicine. I will analyse them, combining perspectives of bioethics, medical sociology, philosophy of medicine and medical literature, and I will suggest that there are different levels of normativity of medicalisation. Ultimately, this study shows that: the definition of idiopathic short stature, focusing only on actual height measurement, does not provide enough information to assess the need for treatment or not; the analysis of the goals of medicine should be broadened to include justifications for the treatment; the use of growth hormone for idiopathic short stature involves strong interests from different stakeholders. While the treatment might be beneficial for some children, it is necessary to be vigilant about possible misconduct at different levels of medicalisation. (shrink)

Introduction to special issue "Ricoeur and the Problem of Space".

Paul Ricœur and Jan Patočka are considered among the most important phenomenologists of the 20 th century. As with Ricœur, Patočka ’s philosophy is shaped by an enduring critical confrontation with Husserl’s phenomenology and Heidegger’s phenomenological analyses of Dasein. The present paper aims at analyzing Ricœur ’s and Patočka ’s convergences and mutual inspirations in their perspectives on the topic of history. More precisely, I will take up the question of the meaning of history in Ricœur and Patočka as profoundly (...) influenced by their readings of Husserl’s Krisis. Then, the attention will be turned to Ricœur ’s concept of historicity and Patočka ’s notion of care of the soul as concerns involved in the search for meaning in history as an open-ended mediation. In this context, I will discuss Ricœur ’s and Patočka ’s critical examination of Heidegger’s conception of thrownness and projection, that is, Dasein’s already-being-in-the-world and its disclosedness, as necessary concepts for understanding their own philosophical approaches to history. Human experience has a symbolic structure. By focusing on the symbolism of human action, this essay considers the reciprocal influences and the essential differences between Paul Ricœur’s hermeneutics and Clifford Geertz’s cultural anthropology. Through reference to Ricœur’s Lectures on Ideology and Utopia, the section on “Ideology, Utopia, and Politics” in From Text to Action, and Geertz’s 1973 book The Interpretation of Cultures, this paper aims at reconstructing the dialogue between these thinkers. I begin with a broad framing of the encounter (...) between Ricœur and Geertz, and then turn to the notion of the symbolic mediation of action, considering it as the shared key concept between these authors. These reflections will lead to an examination of the semiotic conception of culture, opening up the discussion of a nonpejorative dimension of ideology. (shrink)

Resumo: Este artigo visa a investigar as críticas que o sociólogo francês Alfred Fouillé faz a Nietzsche acerca de suas concepções morais. Apoiado nos textos de seu enteado, Jean-Marie Guyau, Fouillée contrapõe uma moral do altruísmo ao que entende ser uma moral nietzschiana: individualismo, egoísmo e violência. O texto indica os equívocos da leitura de Fouillée a partir dos próprios comentários de Nietzsche ao sociólogo francês e faz algumas aproximações entre Nietzsche e Guyau.: This article intends to investigate the criticism (...) raised by the French sociologist Alfred Fouillé to Nietzsche related to his moral conceptions. Supported by his stepson´s text, Jean-Marie Guyau, Fouillé opposes an altruism morality to what he understands to be a Nietzschian morality: individualism, selfishness and violence. The text points to errors in Fouillé´s readings based on the very Nietzsche´s comments to the French sociologist and do some approximations between Nietzsche and Guyau. (shrink)

Ecce Homo certainly is an unconventional autobiography. Both its structure and its contents are in fact quite different from that traditionally adopted. First, in Ecce Homo life and literary production basically coincide; second, in that book Nietzsche deals with an “I” which is not the traditional “subject” of Western philosophy. In this paper I shall argue that in Ecce Homo Nietzsche tries to develop a new kind of subjectivity. In particular, Nietzsche rejects the idea of an unchanging, absolute, substance subject, (...) and sees it as a mobile construction, something that can be described only insofar as it “becomes what it is”, that is, as it consciously reacts to its unavoidable destiny. This article seeks to show Pope Francis’ position, right from the beginning of his pontificate, and what he expects from the Roman Catholic Church in relation to LGBT people. In order to do that, some documents of his pontificate are analyzed in relation to this theme. Among them: Community of Community: A new Parish, Preparatory for the III Assembly, III Extraordinary General Assembly of the Synod of Bishops, XIV Ordinary General Assembly, Encyclical Letter Laudato Si, Post-Synodal Exhortation Amoris Latitia etc. (...) Then, we try to understand the meaning of Francisco's gestures, and to understand which church he wants. What changes and perspectives may occur between the Church and LGBT people, based on the Second Vatican Council, which the pope attempts to bring back, and the unconditional love of God found in the gospels. It is important to remember that in Francis' pontificate, dialoguing, welcoming, integrating, and finding points to come together in favor of life, especially the lives of the most vulnerable, is always very important. RESUMEN. La cuestión del mal ocupa un lugar central en el pensamiento de Hannah Arendt al constituir un concepto transversal que recorre todos sus trenes de pensamiento. Se somete a análisis la “naturaleza del mal” a través del estudio de su obra y de su propia experiencia vital, especialmente al cubrir el juicio de Eichmann en Jerusalén, donde ella afirmaría que éste representaba “la banalidad del mal”. Se trata de averiguar si en su particular concepción del mal influyó Voltaire, por (...) qué surge el mal, por qué se manifiesta de forma permanente en la historia y si puede ser destruido ABSTRACT. The topic of evil has a central place in Hannah Arendt’s thinking as it lies at the core of all her trains of thought. We analyze the “nature of evil” in Hannah Arendt’s philosophy through the study of her work and of her life experience, especially when she covered the trial of Eichmann in Jerusalem where she pointed out that Eichmann represented “the banality of evil”. Our goal in this contribution is to understand whether the philosophy of Voltaire could have influenced Arendt’s conception of evil, why it arises, why it persists throughout history, and whether it can be destroyed.
