Democracy is both an obvious and dubious idea. Here's why democracy is an obvious idea: For most of history, most governments divided people into the few who rule and the many who obey. The few then used the state to advance their own private interests at the expense of the many. Rulers were less like noble protectors appointed by God and more like intestinal parasites. The obvious solution is to eliminate the distinction between those who rule and those who obey. (...) Make every citizen both a ruler and a subject of that rule. This ensures government promotes everyone's interests. Thus, democracy is the best form of government. It's too bad it took most of civilized history to realize this-and too bad that the world isn't more democratic than it is. Here's why democracy is a dubious idea. Government decisions are high stakes. It decides matters of war and peace, prosperity and poverty, freedom or oppression. Yet we let incompetent people steer the ship of state. Most voters are ignorant and process what little information they have in biased and irrational ways. They fall prey to propaganda and demagogues. They are conformists and don't even try to vote their interests. Democracy is the political equivalent of drunk driving. Thus, democracy is a defective form of government. Democracy is a method by which the masses shoot themselves in their feet. Philosophy students often start essays by writing, "Since the dawn of time, humanity has pondered..." In this case, these arguments and concerns are old, if not dawn-of-time old. We find laypeople, pundits, social scientists, and philosophers making these two arguments today. A non-standard reading appears to be gaining traction, however. ISBN: 9780198812739. $91.00.In his brief autobiography, “My Own Life,” Hume reports that “almost all [his] life has been spent in literary pursuits and occupations” (E-MOL: xxxi). This is one (...) of at least ten places in this brief work in which he associates himself with “letters” or “literature”—as compared to at most four associations with philosophy. The moral to be inferred is not that Hume considered himself not to be a philosopher. Rather, he conceived of philosophy as a kind of literature. The Treatise was itself a “literary attempt.” Indeed, opposition between the “literary” and “philosophical” aspects of a text would have been foreign to Hume and his contemporaries—a notion for a later age, despite his occasional loose distinction between the relevant genres, as in his list of writings “historical, philosophical, or literary” in “My Own Life” (E-MOL: xxxvi).Yet despite Hume’s own understanding of the continuity between philosophy and literature, broadly conceived, it is still common for contemporary philosophers to ignore literary questions in their examination of Hume’s work, or to presume that one can easily distinguish the “philosophical” parts from the “literary” ones. Tim Milnes’s The Testimony of Sense is therefore a welcome addition to the Hume literature (pun intended). With a particular focus on the essay—a genre of great importance to Hume—Milnes contributes to the small set of engagements with Hume from the disciplinary perspective of English literature. With training in both philosophy and literature, as well as established expertise on Romanticism and its own essays, Milnes is well-qualified for the task. The Testimony of Sense includes sustained engagement with Hume’s contemporaries and successors, but for the purposes of this review, I engage the book primarily as a Hume scholar for Hume scholars.Milnes’s story plays out in three acts. The first establishes the need for public trust created by a skeptical crisis, itself a product of Hume’s criticism of the epistemic program of thinkers in the Cartesian and Lockean traditions. The second explains how the essays of the long eighteenth century constitute a response to that need in various ways. The third reveals in detail how the Romantic essayists, particularly William Hazlitt and Charles Lamb, both respond to and deviate from the “neoclassical” essayists, typified by Hume and Samuel Johnson.The first chapter, “Self and Intersubjectivity,” lays the groundwork by articulating how Hume, Adam Smith, Thomas Reid, and Dugald Stewart identify the need for what we now call intersubjectivity. Milnes describes the common thread as a kind of “natural transcendentalism.” In what sense are these thinkers properly understood as [End Page 175] transcendentalists? The central idea seems to be that all posit things other than reason as “conditions of meaningful thought” (72). For Hume, it is the social, linguistic experience of a community of virtuous judges. The intricate relations between self and other essential to such a community get “internalized within the specular drama of the impartial spectator” (72) in Smith’s writing, which itself takes part in the drama through his “halting, qualified syntax” that mimics “everyday speech” (44). Reid posits a “prescience” of trust, which grounds our reliance on both human testimony and the uniformity of nature, itself undergirded by the design of a benevolent God. Stewart, who posits axiomatic truths that help constitute the “stamina of intellect,” goes furthest, actually calling these truths transcendental (55). This chapter also puts these eighteenth-century thinkers in conversation with twentieth-century theorists, including Habermas, Davidson, and Rorty.Chapter 2, “The Subject of Trust,” deepens the analysis by situating these “natural transcendentalisms” in the broader enlightenment context. In contrast to Descartes, Bacon, and Locke, who were suspicious of our reliance on the opinions of others, the eighteenth-century thinkers understand trust as prior to reason in various ways—though not prior to solidarity. The everyday concept of a social group is approached by examining the concept of going for a walk together, an example of doing something together, or "shared action". Two analyses requiring shared personal goals are rejected, since they fail to explain how people walking together have obligations and rights to appropriate behavior, and corresponding rights of rebuke. An alternative account is proposed: those who walk together must constitute the "plural subject" of a goal. Simone de Beauvoir’s early enthusiasm for the philosophy of Henri Bergson (1859-1941)—denied in her 1958 autobiography, Memoirs of a Dutiful Daughter—is a surprising discovery in her 1927 handwritten student diary, as I reported in 1999 and explored at more length in 2003 (Simons 1999; Simons 2003). Discovered by Sylvie Le Bon de Beauvoir after Beauvoir’s death in 1986 and now housed in the Bibliothèque nationale, Beauvoir’s student diary first appeared in print in the 2006 volume, Diary of a Philosophy Student: (...) 1926-27, followed in 2008 by the French publication, Cahiers de jeunesse: 1926-1930. Since my 1999 analysis of the 1927 diary, the publication of the 1926 diary and other posthumously discovered texts has deepened and complicated the evidence of Bergson’s influence.1 In this chapter, I propose to take up and expand upon my earlier analyses in the light of this new evidence, arguing that Beauvoir’s methodological turn to the description of immediate experience, especially her method of writing philosophy in literature and her lifelong interest in describing the subjective experience of time, drew upon Bergson’s philosophy before her first encounter with Husserl’s phenomenology which may have come as early as 1927; that her concept of bad faith and interest in exposing distortions in perception and thinking, as in the chapters in The Second Sex on myths about women, drew upon Bergson’s philosophy long before she had read Marx; and that her earliest formulation of the problem of the Other drew upon Bergson’s distinction between the “social self and the deep self,” two years before she met Jean-Paul Sartre and two decades before she first read Hegel’s Phenomenology. Despite the extensiveness of top-down control in his ideal city, Plato takes seriously the idea that the market does not require total regulation via legislation and that participants in the market may be capable of self-regulation. This paper examines the discussion of market regulation in the Republic and argues that the philosopher rulers play a very limited role in regulating market activities. Indeed, they are concerned only with averting excesses of wealth and poverty. The rules and regulations that are foundational (...) to the daily functioning of the market – enforcement of contracts, resolution of disputes, etc. – are endogenous to the market participants themselves. The second conjunct of the Republic’s account of justice—that justice is “not meddling in the work of another”—has been neglected in Plato literature. This paper argues that the conjunct does more work than merely reiterating the content of the first conjunct—that justice is “doing one’s own work.” I argue that Socrates develops the concept at work in this conjunct from its introduction with the Principle of Specialization in Book II to its final deployment in the finished conception of justice in (...) Book IV. Crucial to that concept’s development is the way in which the notion of “another” comes to refer to members of distinct classes or parts, i.e. takes on an inter-part connotation beyond a mere intra-part connotation. The first conjunct—that justice is “doing one’s own work”—does not connote the same divisions, and so the conjuncts should not be understood as equivalent or mutually entailed. (shrink)

This book re-imagines law as ecolaw. The key insight of ecological thinking, that everything is connected to everything else - at least on the earth, and possibly in the cosmos - has become a truism of contemporary theory. Taking this insight as a starting point for understanding law involves suspending theoretical certainties and boundaries. It involves suspending theory itself as a conceptual project and practicing it as an embodied and material project. Although an ecological imagining of law can be metaphorical, (...) and can be highly imaginative and suggestive, this book shows that it is also literal. Law is part of the material 'everything' that is connected to everything else. This means that once the previous certainties of legal thinking have been dismantled, it is after all possible to think of law as 'natural' - as embedded in and emergent from a normative biophysical nature. The book proposes that there exists a natural nomos: animals, plants, and Earth systems that produce their own values and norms from which human norms and laws emerge. This book, then, proposes a new way to understand law, and pursues specific arguments to demonstrate the feasibility of law as ecolaw.
