El presente de la Filosofía del Derecho es un libro concebido para mostrar la vitalidad actual de la Filosofía Jurídica. Está escrito en la madurez de su autora, y por lo mismo huye de cualquier extremismo más propio de la juventud. Como ella misma dice, no busca una sola respuesta correcta para las preguntas que en él se formulan, ni para las posiciones que en este libro se defienden. Muy al contrario, simplemente ofrece un punto de vista personal, sobre los (...) principales problemas que tiene planteados en la actualidad la Filosofía del Derecho. A través de sus páginas, se ofrece un relato, sobre el ser de la Filosofía del Derecho, la esencia del Derecho, y el pensamiento filosófico jurídico de los siglos XIX, XX y XXI visto con los ojos de algunos de sus principales protagonistas. También muestra un panorama de las relaciones entre el Derecho y la lógica, especialmente referidas a la interpretación, a la argumentación, y a la metodología jurídicas. Tampoco olvida la importancia del estudio de la relación del Derecho con los valores, especialmente con la justicia, que es el primero y más importante de todos ellos. Por último, reflexiona sobre la deontología profesional, estudiando de forma más concreta, las particularidades deontológicas de los principales operadores jurídicos. Los temas elegidos forman parte de algunos de los más debatidos dentro de la Filosofía del Derecho actual. Reflexionar sobre estos problemas es una labor propia de todo jurista, en realidad lo es, de todo ser humano preocupado por entender y mejorar si es posible, el mundo que le rodea. Este libro modestamente pretende ayudar en ese intento. Milagros Otero Parga, nació en Santiago de Compostela en 1960. Es doctora en Derecho (1987) por la misma Universidad. En la actualidad y desde 2011, es Catedrática de Filosofía del Derecho. Ha publicado 16 libros y 138 artículos en revistas nacionales e internacionales. Los temas a los que presta mayor atención son Axiología Jurídica, Derechos Humanos, Historia del pensamiento Jurídico, Argumentación Jurídica y Mediación. Es profesora invitada en algunas de las más prestigiosas universidades de Bue­nos Aires, Santiago de Chile, Sao Paulo y Montevideo. Asidua visitante de México ha sido conferenciante en las universidades Iberoamericana, Panamericana, Ana­huac, Intercontinental, Autónoma del Estado de México, Instituto Tecnológico de Monterrey, Universidad Judicial de Durango y Universidad Popular Autónoma del Estado de Puebla. Es asesora académica de la Comisión de Derechos Humanos del Estado de México y de la Escuela Judicial del mismo Estado. Este último orga­nismo la nombró también Magister Honoris Causa. Es académica numeraria de la Real Academia Gallega de Jurisprudencia y Legislación. Fue decana de la Facultad de Derecho de la Universidad de Santiago de Com­postela y secretaria de la Comisión de Doctorado y Tercer Ciclo de la Universidad. Tiene en su poder la Medalla de Plata de Galicia, la Insignia de Oro de la Facultad de Derecho, y la Insignia de Oro de la Universidad de Santiago. Ha sido Valedora do Pobo de Galicia (2015-2019). Russellian physicalism is becoming increasingly popular because it promises to deliver what everybody wants, realism and physicalism about consciousness. But Russellian physicalists are not the first to swear on “the promise”, standard Type-B physicalism is a less fanciful view that also claims to give everything and take nothing. In this paper, I argue that our hopes should not be placed on Russellian physicalism because, unlike Type-B physicalism, it cannot explain how phenomenal concepts can reveal the nature of phenomenal properties without (...) weakening its physicalist credentials. The revelation challenge shows that Russellian physicalism is either committed to an anti-realist and self-defeating view of phenomenal concepts or it is physically unacceptable. (shrink)

The relationship between students and higher education is seen to have become increasingly transactional. We approach the study of the student–HE relationship in a novel way, by focusing on students’ behaviour post-university, rather than on student narratives. Conceptually, the article builds on multidimensional views of student engagement and the differentiation between psychological transactional contracts – where students who achieve better academic results are more likely to donate – and relational contracts – where students donate more following engagement in social experiences. Making use of longitudinal data on donation behaviour from over 50,000 alumni from an English university over two decades, we find that while students who get better degree outcomes are more likely to donate, the association between participation in social experiences and donations is much stronger. This questions prevalent transactional models of HE and underlines the limitations of purely consumerist views of the relation between students and higher education institutions, even in the marketized UK context. Timothy Williamson has defended the claim that any philosophically satisfying conception of modality that encompasses possible worlds semantics (PWS) commits us to the Barcan Formula. His argument depends on the assumption that the domain of what there is (the domain of the actual world) has to be identified with the domain D(@), where @ is the index or possible world that in PWS represents , or stands for , the actual world. I work out an interpretation of the relation between (...) PWS and possible worlds terminology that makes it plausible to reject that assumption. (shrink)

The meta-problem of consciousness is the problem of explaining why we think there is a hard problem of consciousness. The meta-problem promises to help us solve the hard problem. The Phenomenal Concept Strategy promises to solve both problems at once while allowing for a metaphysics of mind that avoids dualism, which is hard to defend, and illusionism which is hard to accept. I argue that the strategy fails to fulfil this promise. Standard accounts of the PCS cannot provide an adequate (...) response to the meta-problem because the cognitive isolation of phenomenal concepts is not the basis of our problem intuitions. (shrink)

Sin ningún afán polémico, el presente artículo aspira a presentar algunos rasgos de Menéndez Pelayo, que puedan legitimar su caracterización como filósofo ; faceta esta, quizá, la menos vistosa de este gran historiador y crítico, incansable lector y escritor fecundo. Rastreando sus obras más específicas sobre el particular, se expone su pensamiento al respecto, no solo para saber como entiende los conceptos filosóficos más básicos, sino también para ver la posibilidad de enmarcarlo en alguna corriente filosófica que admita su clasificación.

We discuss the axiomatization of generalized consequence relations determined by non-deterministic matrices. We show that, under reasonable expressiveness requirements, simple axiomatizations can always be obtained, using inference rules which can have more than one conclusion. Further, when the non-deterministic matrices are finite we obtain finite axiomatizations with a suitable generalized subformula property.

We consider a 2-valued non-deterministic connective \({\wedge \!\!\!\!\!\vee }\) defined by the table resulting from the entry-wise union of the tables of conjunction and disjunction. Being half conjunction and half disjunction we named it _platypus_. The value of \({\wedge \!\!\!\!\!\vee }\) is not completely determined by the input, contrasting with usual notion of Boolean connective. We call non-deterministic Boolean connective any connective based on multi-functions over the Boolean set. In this way, non-determinism allows for an extended notion of truth-functional connective. Unexpectedly, this very simple connective and the logic it defines, illustrate various key advantages in working with generalized notions of semantics (by incorporating non-determinism), calculi (by allowing multiple-conclusion rules) and even of logic (moving from Tarskian to Scottian consequence relations). We show that the associated logic cannot be characterized by any finite set of finite matrices, whereas with non-determinism two values suffice. Furthermore, this logic is not finitely axiomatizable using single-conclusion rules, however we provide a very simple analytic multiple-conclusion axiomatization using only two rules. Finally, deciding the associated multiple-conclusion logic is \(\mathbf {coNP}\) -complete, but deciding its single-conclusion fragment is in \({\mathbf {P}}\). (shrink)

This book addresses some basic questions about intrinsic value: What is it? What has it? What justifies our beliefs about it? In the first six chapters the author defends the existence of a plurality of intrinsic goods, the thesis of organic unities, the view that some goods are 'higher' than others, and the view that intrinsic value can be explicated in terms of 'fitting' emotional attitudes. The final three chapters explore the justification of our beliefs about intrinsic value, including coherence (...) theories and the idea that some value beliefs are warranted on the basis of emotional experience. Professor Lemos defends the view that some value beliefs enjoy 'modest' a priori justification. The book is intended primarily for professional philosophers and their graduate students working in ethics, value theory and epistemology. (shrink)

La ética ambiental se enfoca en la responsabilidad humana hacia el entorno, especialmente debido al abuso de los recursos naturales en la actualidad. Esta relación ha causado impactos graves en el medio ambiente y en la vida humana, señalando la necesidad de un cambio genuino y práctico para que la humanidad asuma su responsabilidad en la preservación del entorno. Al considerar los puntos de vista teológicofilosóficos presentados por el papa Francisco y la propuesta ética de Hans Jonas para la era (...) tecnológica, se busca en este estudio fusionar ambas ideas para lograr que fomenten la biodiversidad. Esto implica reconocer el papel del ser humano como administrador responsable, promoviendo una ética que oriente hacia el futuro, manteniendo el respeto por la posición del ser humano como guardián del ecosistema y su diversidad biológica. Hume argued that inductive inferences do not have rational justification. My aim is to reject Hume's argument. The discussion is partly motivated by an analogy with Carroll's Paradox, which concerns deductive inferences. A first radically externalist reply to Hume is that justified inductive inferences do not require the subject to know that nature is uniform, though the uniformity of nature is necessary condition for having the justification. But then the subject does not have reasons for believing what she believes. I (...) defend a moderate externalist account that seeks to partly accommodate that objection to the radical externalist proposal. It is based on an extension of Peacocke's theory of concepts: possession conditions for predicative concepts standing for natural properties include dispositions to project them to new cases in accordance with inductive inferential patterns. This article briefly presents the relationship between philosophy and religion in the work of Paul Ricœur, demonstrating how he established a dialogue between both languages, both methodologies – that of philosophy and that of religion – in his philosophical and biblical hermeneutics. The article briefly recaps Ricœur’s personal and intellectual trajectory and the way he dealt with this double allegiance, showing the differences between biblical and philosophical hermeneutics but also their relation in Ricœur’s works.

We describe the role of morphosyntactic categories and syntactic dependencies in the process of semantically interpreting composite expressions. Special attention will be paid to the combinatorial properties conveyed by morphosyntactic categories such as nominals and verbs, as well as by syntactic dependencies like subject, direct object, or nominal modification. The semantic characterisation of these grammatical structures is based on cognitive abilities and abstract conceptualisations. This will provide us with theoretical arguments to review and extend some basic assumptions of Cognitive Grammar (...) and related work. (shrink)

Visando contribuir com esse debate, essa resenha apresenta uma visão do livro Formação das Fronteiras Latino-Americanas, que caracteriza-se como uma importante contribuição, com diversas questões diferenciadas na discussão realizada.
