The central thesis developed in this paper is that sexual violence is a possibility founded in the — historical — constitutive conditions of the female body, which means that sexual violence against women is possible because of the availability of their bodies. The availability of the female body as a condition for rape is established in three principal moments: 1) The historical and spiritual determination of the subjective female identity as founded in the materiality of her own body —or her (...) reproductive specificity—. 2) The socially ambiguous configuration of the «femenine-I can» derived from the reproduction/sensuality difference; and, 3) The sexual rape as a reassertion of the gender availability in such a way that the rape sexualizes the gender as vulnerable, establishing or adding a wrapping meaning of feminity as something vulnerable. Being an other-body is being, originally, an available body, violable in essence, sexually vulnerable. (shrink)

In this paper I try to clarify the central role that the concept of nature plays in the phenomenological task of criticism and ordination of scientific knowledge. This first goal implies a phenomenological definition of nature, which makes visible the performative stages of world experience. First, I expose the mean of fundamentation and its relationship with the ontological-material limitation of nature —following the course of Husserl’s 1927 Lecture—; next, I develop the theory of attitudes as experiential deconstruction of nature, as (...) exposed in Ideas II, and finally, I draw the basic elements of pre-given-world analytics in its link with nature as material basis of life, according to the descriptions in the xxxix volume of Husserliana. La tesis central de este artículo es que la vejez no se confunde con la enfermedad, y que su distinción arraiga en la dimensión temporal del cuerpo vivido. El tiempo del cuerpo es elemento ingrediente de la autocaptación del sí mismo en el horizonte de sus posibilidades y potencialidades, que en la vejez aparecen bajo una condición frágil y desgastada. Expongo esta tesis en tres partes principales: en la primera trato de deslindar las dimensiones del tiempo de la naturaleza y (...) el tiempo subjetivo en el decurso constitutivo del cuerpo propio. En estas distinciones la vejez se esclarece, respecto del tiempo de la naturaleza, como la fase de cumplimiento normal o del más amplio y unitario desarrollo del cuerpo como cosa viviente. En la segunda parte, defino la fragilidad de futuro como especificidad estructural del horizonte temporal de la vejez; finalmente, en la tercera y última parte, exploro la incidencia de esta condición temporal en la forma de autocaptación del yo, y en la significación de su propio cuerpo en la vejez. RESUMEN La tesis central de este artículo es que la esclavitud es fenomenológicamente descriptible como reducción del esfuerzo a fuerza física, a través de la imposición de la imposibilidad, como fuente de reconocimiento del sí mismo en la derrota. El esclavo se reconoce desde la negación de lo posible para sí en el mundo. Expongo esta tesis en tres momentos principales, en la primera parte desarrollo el concepto de esfuerzo, con base en los análisis husserlianos de la constitución, expuestos en (...) Ideas II. En el segundo apartado expongo el modo en que el esfuerzo, como concreción de una voluntad egoica-encarnada, es reducido a fuerza fisica -productiva- mediante la alienación de las posibilidades del 'yo-puedo'. El correlato de este modo de constitución del cuerpo propio, en la enajenación de su poder, de lo posible para si, es un horizonte que se presenta para el yo en el modo de la clausura o la imposibilidad, desde la que yo se reconoce como derrotado, tema que trato en el último y tercer apartado. La descripción de la derrota pone de manifiesto la condición de la voluntad corporal como limite resistente ante la esclavitud. ABSTRACT The central thesis of this paper is that slavery is phenomenologically describable as a reduction of the effort to a physical force through the imposition of impossibility as a fountain of self-recognition of the ego in the defeat. The slave is constituted from the defeat of its egoic, personal, and concrete possibilities. I develop this thesis in three moments. First, I explore the effort concept on the phenomenological basis of Husserlian analyses of the constitution into Ideas II. In the second part, I describe how effort-as a concretion of an egoic-embodied will-is reduced to physical force-productive-in the slavery, though the alienation of the possibilities for de 'I-can'. The correlate of this way of constitution of the own body, in the alienation, is a horizon of possibilities are present for the ego in the canceled, or impossibility way in which the ego recognizes itself as defeated, issue of the third and last part. The description of the defeat manifests the condition of the embodied will as a resistant limit against slavery. (shrink)

En este artículo intento aclarar qué significa la distinción yo / cuerpo, en el contexto de los análisis de la constitución de Ideas II. Me interesa el énfasis husserliano en la dimensión constituida del cuerpo propio, del cuerpo como «haber» del yo en que desembocan las descripciones del cuerpo vivido. Esta posesión señala una condición antropológica fundamental y entraña la posibilidad de su enajenación o no reconocimiento. En un primer momento describo la esfera vivida del cuerpo propio, su condición animal (...) en los términos husserlianos de la segunda parte de Ideas II; en el segundo apartado expongo la problemática de la constitución de la propiedad del cuerpo en relación con los niveles constitutivos del yo ; finalmente, en un tercer apartado desarrollo los aspectos principales de la alienación o enajenación del yo y el cuerpo a través de experiencias cenestésicas e hiperestésicas en las que la sensibilidad primaria parece opacar la fuerza del yo libre y activo. En cada momento o nivel se muestra el hiatum yo / cuerpo, la condición de una conciencia irreductible al cuerpo y de un cuerpo inapresable en los límites del yo, como conciencia en vigilia.In this paper I wish to clarify the I/ living body distinction, an issue that arises from constitutive analysis in Ideas II. I am interested in Husserlian insistence on the constituted dimension of the own living body, the body as the “have” of I, where all descriptions of living body arrive. This possession points to the fundamental anthropological condition and encloses the possibility of being alienated or not recognized. The first step is to describe the lived sphere of the own body, its animal condition, as exposed in the second part of Ideas II. The second part is aimed at disclosing the constitution of bodily “owness” in relation to different constitutive levels. Finally, in the third part I delve into most important features of alienation of the I and the body through kinaesthetic and hiperaestetic experiences, in which primary sensitivity seems to numb the force of free and active I. The hiatum between I and body reveals itself as awake consciousness on every level of constitution, and it is the condition for a consciousness irreducible to the body and a body which is not apprehended in the limits of I. Iribarne, this paper aims to make a “reading of Iribarne’s vision” of Husserl’s phenomenology —phenomenology as a system—, following with a study of the theory of inter-subjectivity in Iribarne’s work, and the place of ethics as a science founded in this theory. The final purpose is to demonstrate the consistency that lies within Iribarne’s philosophical efforts and Husserl’s philosophical goals throughout his life and career, in order to assert that the practice of phenomenology as a philosophy of life and a transcendental life rooted in human existence itself is a concern of transcendental phenomenology —for this exposure forms part of Julia Iribarne’s valuable legacy to Latin American philosophy. El objetivo central de este artículo es exponer las herramientas que la fenomenología husserliana aporta a la definición, descripción y análisis del mal moral. Parto de la distinción Ricoeuriana entre mal moral y mal sufrimiento, con la intención de justificar la introducción del instrumental husserliano en ambas esferas. Me interesa analizar esta distinción en un marco de interpretación fenomenológico que nos permita explicar el mal sufrimiento como dolor y el mal moral como violencia y envilecimiento. En un primer momento expongo (...) las limitaciones del análisis hermenéutico en relación con la descripción del dolor como pura pasividad; en un se-gundo momento analizo los desarrollos contemporáneos de la fenomenología del dolor a través de los conceptos centrales de la teoría husserliana de la constitución, concretamente, de la teoría de la corporalidad que aparece en este contexto; en un tercer momento trato de definir el mal moral como violencia, y la violencia como acción articulada a través de un conjunto de técnicas de envilecimiento o deshumanización, caracterizadas por la intención de un otro hostil, de dañar o alienar la identidad del yo mediante la manipulación de los sentimientos sensibles de la víctima, a través de la creación de escenarios y condiciones materiales consideradas infrahumanas.The main goal of this paper is to expose the tools offered by Husserlian phenomenology for the definition, description, and analysis of moral evil. My starting point is the Ricoeurian distinction between moral evil and suffering evil, in order to justify the insertion of the Husserlian analysis in both spheres. My purpose to highlight this distinction within a Husserlian interpretation frame so we can understand the suffering evil as pain, and the moral evil as violence and degradation. First, I expose the limitations of hermeneutical analysis in the assumption of pain as pure passivity. Second, I analyze the contemporary developements of the phenomenology of pain through the central concepts of the Husserlian theory of the constitution, specifically, the theory of corporeality. Third, I try to define moral evil–the same contemplated within the Ricoeurian distinction–as violence, and violence as an articulated action through an array of degradation techniques, or dehumanization, characterized by the hostile intention of the other to damage or alienate the identity of the ego by manipulating the sensible feelings of the victim, through the creation of scenarios and material conditions considered as infrahuman. Öz: Bu çalışmama İslam’da bireyin kamuya karşı sorumluluk alanı ile bağlantılı bir ilkesini; “Emr-i bi’l- Ma’ruf ve Nehyi Ani’l-Münker”i İslam İnanç Ekolleri içerisinde nasıl algılandığını ve nasıl uygulandığını ele alacaktır. Bundaki amacım birey- kamu ilişkisinde, bireyin özgürlük alanlarının ihmal edildiği yönündeki varsayımımdır. Bu girişten sonra, çalışmada İslam inanç ekollerinin konuya ilişkin yaklaşımları ve bu yaklaşımlarına kaynak teşkil eden metinlere yer verilecektir. Çalışmamızda ekollerin kronolojik tarihlerini göz önünde bulunduran bir sıralama takip edeceğiz. Bundaki amacımız özellikle “Emr-i bi’l- Ma’ruf ve Nehyi Ani’l- (...) Münker” ilkesinin ekollerde ele alınışının erken dönem İslam Siyasal Tarihi ile önemli oranda bir ilişkisi olduğu anlayışımız sebebiyledir. İslam siyaset kuramının birlikte yaşam, özgürlük ve adalet iddia ve idealleri çerçevesinde konuya İslam teolojik mezhepleri yakın ilgi göstermişlerdir. Ekollerin “Emr-i bi’l-Ma’ruf ve Nehyi Ani’l-Münker” ilkesine yoğun ilgilerine karşın, farklı yaklaşımlar gösterdikleri de söylenebilir. İslam geleneği içerisinde bu kurucu ilke birey özgürlüğü ve kamu düzeni arasındaki gerilimler nedeniyle politik yorumları da beraberinde getirmiştir. “Haricî” ekoller her bir Müslüman için gereken bir sorumluluk olarak yorumlamış ve “ayn-i vacib” olduğunu dile getirmişlerdir. Diğer ekoller ise bu ilkeyi ” kifa-i bir vucûb” olarak kabul etmişlerdir. Diğer yandan Mu’tezile ekolü bu ilkeyi usulu’l-hamse’ den biri olarak kabul etmiştir. This interview – conducted by Peter Beilharz and Trevor Hogan with Clinton Walker over the course of three months between Melbourne and Sydney via email and Skype – explores the questions of Australian popular culture writing with, against, and of the culture industries themselves. Walker is a leading freelance Australian cultural historian and rock music journalist. He is the author of seven books, five about Australian music. He has been a radio DJ and TV presenter. He compiled and produced four (...) double CD album collections of Australian music – Inner City Sound, Buried Country, Long Way to the Top, and Studio 22. He has been a key writer in several multi-media projects, including the Powerhouse Museum Real Wild Child exhibition and CD-Rom and ABC TV’s hit documentary series/CD/DVD Long Way to the Top. In 2006, a new US edition of his first book Inner City Sound was published. His Golden Miles: Sex, Speed and the Australian Muscle Car has been published in a revised edition in 2009. In 2012, his eighth book, The Wizard of Oz, will be published. Walker is currently writing with Beilharz and Hogan a book called The Vinyl Age: The History of Australian Rock Music, 1945–1995. The interviewers invited Walker to reflect critically on his 35-year ‘career’ as pop avatar, independent writer and critic in the post-war to post-modern Australian popular culture industries. Going from journalism to his path-finding books and television documentaries, the article traces this work’s development both in personal terms and as a symptom of the broader cultural evolution, from the suburbs to pop to art and rock and back again; between London and the provincial cultures of Oz; from one-way American consumerism to local DIY egalitarianism, analogue to digital to global dialogue, youth culture to multi-culturalism, and from the putative low brow to the legimitization process itself of popular culture. The thesis of situationism says that situational factors can exert a signi cant in uence on how we act, o en without us being consciously aware that we are so in uenced. In this paper, I examine how situational factors, or, more speci cally, our lack of conscious awareness of their in uence on our behavior, a ect di erent measures of control. I further examine how our control is a ected by the fact that situational factors also seem to (...) prevent us from becoming consciously aware of our reasons for action. I argue that such lack of conscious awareness decreases the degree of control that agents have. However, I propose that while being in uenced by situational factors in such ways may impair and diminish one’s control, it (typically) does not eradicate one’s control. I further argue that being in uenced by situational factors, in the way set out above, also decreases one’s degree of moral responsibility. (shrink)

The Muʿtazilī theologians, particularly the later Imāmī ones, developed numerous interesting arguments against divine command theory. The arguments, however, have not received the attention they deserve. Some of the arguments have been discussed in passing, and some have not been discussed at all. In this article, I aim to present and analyse the arguments. To that end, I first distinguish between different semantic, ontological, epistemological, and theological theses that were often conflated in the debate, and examine the logical relation among (...) them. Then I go over the Muʿtazila's arguments determining, among other things, which of the theses was targeted by each argument. In presenting the arguments, I focus mainly on the late kalām period, the period falling roughly between the thirteenth and fifteenth centuries of the common era, as the arguments were at their most sophisticated level by this time. Certain aspects of our situations often influence us in significant and negative ways, without our knowledge (call this claim “situationism”). One possible explanation of their influence is that they affect our abilities. In this paper, we address two main questions. Do these situational factors rid us of our abilities to act on our sufficient reasons? Do situational factors make it more difficult for us to exercise our abilities to act for sufficient reasons? We argue for the answer ‘sometimes’ to both (...) these questions. We then explore the consequences of this view for moral responsibility. (shrink)
