L’objet de cette étude est de montrer les enjeux que posent aux droits de l’homme les lois bioéthiques de juillet 1994 en ce qui concerne l’application des biotechnologies à la reproduction. À cette fin, sont analysés des dispositifs juridiques mis en place dans la loi pour sélectionner des embryons et pour transformer leurs caractères génétiques. Ces résultats sont ensuite comparés aux procédés eugéniques employés en Occident dans la première moitié duxx e siècle. Cela conduit à récuser la catégorie d’eugénique pour (...) rendre compte du projet biopolitique des lois bioéthiques. La escritura para la reflexión pedagógica es una competencia profesional docente que debe ser desarrollada durante la formación inicial para que, posteriormente, pueda ser aplicada en diversos contextos educativos, enriqueciendo así el proceso de enseñanza y aprendizaje tanto del propio profesor como de los estudiantes con los que este interactúa. El ámbito de formación práctica es un espacio curricular donde esta competencia asume mayor preponderancia, pues el futuro profesor debe transferir diversos conocimientos teóricos hacia el ejercicio de aula. Bajo este (...) contexto, es posible reconocer la producción y circulación de ciertos géneros escritos específicos que dan cuenta de esta competencia. Esta investigación tiene como objetivo principal caracterizar, desde una perspectiva socioretórica, los géneros de reflexión pedagógica que escriben los estudiantes de dos carreras de pedagogía de una universidad chilena durante su formación práctica. Desde un enfoque metodológico cualitativo y con un diseño de Estudios de Casos Múltiples, se aplicaron dos instrumentos de recolección de datos: entrevistas semiestructuradas y focus group a profesores y estudiantes de la carrera de Educación Especial y Educación Parvularia. Entre los principales resultados destacan el reconocimiento de la escritura como un recurso que recoge la reflexión pedagógica de los profesores en formación; la utilización de determinados géneros pedagógicos en cada carrera y además la existencia de una progresión en el uso de estos de acuerdo a la complejidad y avance en el recorrido formativo del Plan de Estudios. Tenho escrito muitos prefácios para livros, mas nenhum me deu tanto prazer em tempos recentes quanto o livro de Caetano Costa. Estou a falar de quê? De um livro de teoria jurídica, de um livro de sociologia do direito, de um romance que tem como principais personagens dois juízes? Estou a falar de tudo isso e nessa complexidade reside o fascínio desta obra, cuja leitura eu recomendo vivamente a todos e a todas.

Este artigo traz uma reflexão sobre como e por que a Guerra Guasu ou Guerra da Tríplice Aliança permanece na memória dos paraguaios como parte da identidade nacional. Partindo-se do pressuposto de que o Paraguai teve que atravessar por um processo de reconstrução simbólica após a derrota de 1870, se analisam as diferentes ressignificações dos mitos consagrados pelos revisionistas, ao longo do século XX, com o objetivo de identificar de que maneira esses mitos permearam as práticas políticas e culturais.

Este texto analisa três artigos que tratam sobre os ‘usos políticos do passado’ em diferentes momentos das histórias nacionais de El Salvador, Guatemala e Chile. O exame desses textos permite refletir sobre os caminhos escolhidos para a escrita das histórias nacionais durante os pós-guerras e como a hegemonia de uma interpretação histórica pode levar ao silêncio ou a deslocamentos de outras interpretações. Também é analisado o papel dos autores nessas disputas pela memória e história.

Neste trabalho de cunho teórico, buscamos analisar a dinâmica dos afetos na perspectiva filosófica de Baruch Espinosa. Ao projetar esse objetivo, procuramos trazer elementos que favoreçam análises da compreensão escolar como espaço de potencialização. Defendemos como considerações finais do estudo que essa perspectiva e entendimento são nucleares para o debate e compreensão da dinâmica dos afetos no processo de humanização.

In this paper, I argue that the indirect realists’ recourse to mental representations does not allow them to account for the possibility of hallucination, nor for the presentational character of visual experience. To account for the presentational character, I suggest a kind of intentionalism that is based on the interdependency between the perceived object and the embodied perceiver. This approach provides a positive account to the effect that genuine perception and hallucination are different kinds of states. En el presente trabajo examino la tesis de José María Sauca sobre la “liquidez constitucional” y las cláusulas de este tipo que identifica en la Constitución Española. Propondré analizarlas a la luz de la tesis de la cláusula alternativa tácita presentada por Kelsen.

In this paper, I argue for two main hypotheses. First, that self-control is not a natural mental kind and, second, that there is no dedicated mechanism of self-control. By the first claim, I simply mean that those behaviors we label as “self-controlled” are a somewhat arbitrarily selected hodgepodge that do not have anything in common that distinguishes them from other behaviors. In other words, self-control is a gerrymandered property that does not correspond to a natural mental or psychological kind. By (...) the second claim, I mean that self-controlled behaviors are not produced by a mechanism that is not utilized in the production of other behaviors. Not only is there no natural mental property of self-control, there is no mechanism that is dedicated to producing self-controlled behavior. I further evaluate whether this account of self-control has enough explanatory power to account for a range of phenomena related to self-control. I argue that my account does a better job of explaining these phenomena than accounts which appeal to a dedicated self-control mechanism. (shrink)

Situationism is, roughly, the thesis that normatively irrelevant environmental factors have a great impact on our behaviour without our being aware of this influence. Surprisingly, there has been little work done on the connection between situationism and moral luck. Given that it is often a matter of luck what situations we find ourselves in, and that we are greatly influenced by the circumstances we face, it seems also to be a matter of luck whether we are blameworthy or praiseworthy for (...) our actions in those circumstances. We argue that such situationist moral luck, as a variety of circumstantial moral luck, exemplifies a distinct and interesting type of moral luck. Further, there is a case to be made that situationist moral luck is perhaps more worrying than some other well-discussed cases of moral luck. (shrink)

In this chapter, I examine the metaphysics elaborated by Viscountess Anne Finch Conway in the effort of determining the meaning she assigned to the notions of transcendence and immanence. In the Early Modern period, her philosophy is one of the most original attempts towards an integration of notions deriving from Lurianic Kabbalah and Sufism into debates stemming from the confrontation of mainstream Protestantism with its most heterodox cognates, such as Quakerism. Alfred Mele presents an influential argument for incompatibilism which compares an agent, Ernie, whose life has been carefully planned by the goddess Diana, to normal deterministic agents. The argument suggests both that Ernie is not free, and that there is no relevant difference between him and normal deterministic agents in respect of free will. In this paper, I suggest that what drives our judgement that Ernie is not free in the Diana case is that his actions are merely an extension (...) of Diana's—he is akin to a tool, which she uses solely for her own purposes, and his behaviour occurs only because of the interest Diana takes in its occurring. This contrasts with normal deterministic universes, in which normal agents are not such tools. (shrink)

Situations are powerful: the evidence from experimental social psychology suggests that agents are hugely influenced by the situations they find themselves in, often without their knowing it. In our paper, we evaluate how situational factors affect our reasons-responsiveness, as conceived of by John Fischer and Mark Ravizza, and, through this, how they also affect moral responsibility. We argue that the situationist experiments suggest that situational factors impair, among other things, our moderate reasons-responsiveness, which is plausibly required for moral responsibility. However, (...) even though we argue that situational factors lower the degree of our reasons-responsiveness, we propose that agents remain moderately reasons-responsive to the degree required for moral responsibility. Nonetheless, those affected by situational factors are arguably less morally responsible than those who are not subject to similar situational factors. We further evaluate an understanding of reasons-responsiveness which relativizes reasons-responsiveness to agents’ circumstances. We argue that the situationist data do not warrant this kind of divergence from Fischer’s and Ravizza’s account. We conclude by discussing what situationist experiments tell us about our relationship to non-reasons. (shrink)

This article formulates a novel conception of constitutions based on John Finnis’s jurisprudential work. The ‘central case constitution’ transcends the formal or functionalist analyses currently dominant in constitutional theory by considering a constitution as having a ‘double life’. Constitutions are necessarily and intrinsically normative and factual. The article explores Finnis’s natural law philosophy, emphasizing the central case constitution’s alignment with the practical reasonableness viewpoint and its role in directing a political community towards its common good. Focusing on key elements such (...) as the rule of law and the context of a political community, the central case constitution emerges as a legal determination that structures society, frames political institutions and authoritatively directs communities towards justice. This ontological understanding has theoretical and practical implications, including identifying genuine constitutional purposes, safeguarding private associations from the overwhelming state presence, promoting community identity and accommodating diverse constitutional choices for self-determination. Este artículo reflexiona acerca de las especificidades de la constitución de los monumentos conmemorativos en vínculo con la historia reciente. Para ello, la mirada se centrará en la noción de contramonumentos, entendiendo a estos últimos como aquellas producciones que, inicialmente de la mano de un grupo de artistas alemanes, desafían las premisas del monumento tradicional. En base a esto, se expone, en primera instancia el desarrollo histórico del monumento, destacando determinados sucesos que se consideran significativos dentro de la extensa cronología (...) en la que éste se inscribe; en un segundo momento, se recuperan una serie de reflexiones y debates que problematizan y cuestionan la efectividad de estos objetos culturales en relación a la evocación del pasado; y finalmente, se presentan y analizan un conjunto de producciones artísticas que se enmarcan dentro de lo que se reconoce como contramonumentos. En este sentido, se considera que la revisión de los aspectos formales, conceptuales y funcionales a partir de las cuales James E. Young definió en la década de los noventa a los contramonumentos, ilumina y habilita nuevas reflexiones sobre las diversas intervenciones, acciones de resistencia y producciones artísticas que se llevan a cabo en la actualidad, muchas de las cuales pueden ser pensadas como contramonumentos. RESUMO Este artigo analisa a atuação das forças centrípetas e centrífugas em enunciados da esfera religiosa que evidenciam cosmovisões do segmento cristão evangélico acerca da deficiência. Para tanto, selecionamos um vídeo disponível na plataforma YouTube contendo enunciados dos apresentadores Tito Rocha e Leandro Quadros relativos à temática da deficiência, bem como a resposta de uma internauta acerca do posicionamento desses sujeitos. A reflexão teórico-metodológica fundamenta-se na orientação dialógica da linguagem, sobretudo nas considerações acerca das relações dialógicas, vozes e forças centrípetas (...) e centrífugas. Também recorremos a estudos sobre cosmovisão, inclusão da pessoa com deficiência, discurso religioso e teologia cristã. Os resultados indicam que os discursos dos apresentadores refletem e refratam uma cosmovisão cristã que unifica o entendimento da deficiência como resultado da condenação divina ocasionada pelo pecado. O comentário da internauta, por sua vez, apresenta movimentos de centralização e dispersão dessa perspectiva cristã. (shrink)

The Coronavirus Disease 2019 pandemic prompted the need for a teleneuropsychology protocol for the cognitive assessment of older adults, who are at increased risk for both COVID-19 and dementia. Prior recommendations for teleneuropsychological assessment did not consider many of the unique challenges posed by COVID-19. The field is still in need of clear guidelines and standards of care for the assessment of older adults under the current circumstances. Advantages of teleneuropsychological assessment during the COVID-19 pandemic include reduced risk of contracting (...) the virus, eliminating travel time and reducing cost, and more rapid access to needed services. Challenges include disparities in technology access among patients, reduced control over the testing environment, impeded ability to make behavioral observations, and limited research on valid and reliable cognitive assessment measures. The aim of this perspective review is to propose a teleneuropsychological protocol to facilitate neuropsychological assessment utilizing a virtual platform. The proposed protocol has been successful with our clinical and research populations and may help neuropsychologists implement teleneuropsychology services without compromising validity or reliability. However, there is increasing need for research on teleneuropsychological assessment options for both clinical and research purposes. (shrink)

The central thesis developed in this paper is that sexual violence is a possibility founded in the — historical — constitutive conditions of the female body, which means that sexual violence against women is possible because of the availability of their bodies. The availability of the female body as a condition for rape is established in three principal moments: 1) The historical and spiritual determination of the subjective female identity as founded in the materiality of her own body —or her (...) reproductive specificity—. 2) The socially ambiguous configuration of the «femenine-I can» derived from the reproduction/sensuality difference; and, 3) The sexual rape as a reassertion of the gender availability in such a way that the rape sexualizes the gender as vulnerable, establishing or adding a wrapping meaning of feminity as something vulnerable. Being an other-body is being, originally, an available body, violable in essence, sexually vulnerable. (shrink)

Since 1981, Chilean universities experienced profound transformations outlined by what some authors call the New Public Management. Released to the market and mandated to modernize their management systems under an entrepreneurial spirit, the universities went from being providers of a social right, such as education, to becoming an institution that provides educational services. Under the figure of the self-entrepreneur, this article examines the transformations that Chilean university student movements have experienced in the last fifteen years. Specifically, the changes in their (...) demands, tactics and strategies of struggles are problematized, showing the performative effects of the neoliberal order on the subjectivities of the students and the way in which they link with the new teaching subjectivity. ABSTRACT This article analyzes the action of centripetal and centrifugal forces in utterances from the religious sphere, which reveal worldviews of the evangelical Christian segment regarding disability. For that, we selected a video available on YouTube, containing utterances by the hosts Tito Rocha and Leandro Quadros regarding disabilities, as well as the response of an internet user about the positioning of these individuals. The theoretical and methodological reflection is based on the dialogical orientation of language, considering dialogic relations, voices, and (...) centripetal and centrifugal forces. Additionally, we drew upon studies on worldviews, the inclusion of people with disabilities, religious discourse, and Christian theology. The results reveal that the discourses of the hosts reflect and refract a Christian worldview that unifies the understanding of disability due to divine punishment caused by sin. While the internet user’s comment presents movements of centralization and dispersion of this Christian perspective. (shrink)

In the context of calls to decolonise education in European contexts, this paper draws on coloniality-based critiques of Eurocentric modernity to take up the links between democracy, slavery, and colonialism in education. Starting from the position that modernity requires epistemological support to sustain racism and white supremacy in European democracies, we read coloniality-based critiques of democracy with empirical literature about the teaching of slavery. We consider possibilities for revised critical engagements with democracy and with the history of European colonialism and (...) slavery. The paper builds on and contributes to recent decolonial critiques of democracy in education by explicitly engaging a tension raised around the possibility of disentangling democracy from its colonial roots.
