El interés de la presente compilación es el de recoger algunas de las principales reflexiones del pensamiento político contemporáneo. Se propone como tarea central el examen y la problematización de algunos presupuestos extendidos en la tradición de la filosofía occidental. Por medio de este cuestionamiento, se busca desestabilizar asunciones que atraviesan nuestros modos habituales de concebir el sujeto, la acción y el espacio políticos, y de comprender la manera como estos son configurados por el lenguaje. Es así como una amplia (...) gama de autores encuentra un espacio común de discusión: la urgencia de plantear alternativas tanto crítica como de compresión de lo político, que permitan movilizar nuevas maneras de concebir la acción y la configuración de nuestros modos de ser en común; alternativas que incluso pueden encontrarse ya allí, a la sombra de lo político, en sus recodos escondidos, silenciados; en lugares o motivos que tal vez han pasado desapercibidos por no hacer parte de un discurso e interpretación dominantes. En particular, interesa aquí rescatar aquellas reflexiones que abordan esta tarea desde tres ejes temáticos concretos: la pregunta por la relación entre ley y violencia, la necesidad de repensar el ser en común, y, por último, el problema de cómo concebir los pasajes y discontinuidades entre la singularidad de la contingencia histórica, cultural, lingüística, y la posibilidad o promesa de lo universal. La philosophie tragique a eu comme lieu de naissance la pensée nietzschéenne. L'intention de Nietzsche fut d'extraire le terme du tragique du contexte du théâtre pour construire avec lui une réflexion au service de la vie. Notre intention dans cet ouvrage est de comprendre comment la pensée de Rosset suit celle de Nietzsche et à quel moment elle s'éloigne pour écrire sa propre version de la philosophie tragique. Sur ce point nous tentons de répondre : quel est l'apport de Rosset (...) à la lignée de la philosophie tragique? Ou bien quel est l'avantage de suivre une philosophie tragique sans tomber dans la simplicité de l'optimisme? On peut voir que ces questions lient complètement la philosophie et l'éthique et invitent à échapper au sens amer et fataliste qu'habituellement on concède au terme du tragique pour l'ouvrir à la célébration de la vie. Enfin, on insiste sur la question : Rosset est-il vraiment un continuateur de Nietzsche et parvient-il à resémantiser le terme de philosophie tragique pour l'enrichir et l'amplifier, pour le singulariser avec sa propre réflexion? This essay argues that the practical reason approach to the study of social conventions fails to adequately account for the fluency of social action in environments that we experience as familiar. The practical reason approach, articulated most recently in Andrei Marmor’s Social Conventions: From Language to Law does help us, though not wholly adequately, to understand how we tend to react to, and experience, unfamiliar situations or unfamiliar behaviors, that is, those situations in which a certain practice becomes problematic or (...) is problematized, or where we are obliged to, or moved to, justify or deliberate. The reason why the practical reason approach is not wholly adequate when it comes to understanding unfamiliar situations or unfamiliar behaviors is that it tends to subsume the unfamiliar under the familiar, that is, it tends to negatively evaluate anything that is deemed to be not in accordance with the rules and reasons already familiar to the observer. This excludes the possibility of the observer having to transform himself or herself, and thus change what is familiar to him or her. (shrink)

Partiendo de la obra de Vicent Martínez en la que explicita qué entiende por “racionalidad práctica” en el marco de sus estudios fi-losóficos para la paz —también para la paz entre los géneros—, repensamos aquí nuestras propias contribuciones a la interacción entre la fenomenología y el feminismo, particularmente la vinculación de la crítica fenomenológica del objetivismo con el desenmascaramiento de la razón patriarcal, para demostrar que el reconocimiento no indiferente de la pluralidad no está reñido con la autonomía y la (...) universalidad de la razón, sino exclusivamente con la razón instrumental dominante hasta el siglo XXI. Consideramos esta última desde el diagnóstico husserliano de la crisis de las ciencias, y desde la crítica a la Modernidad emprendida por la Escuela de Frankfurt. Con la mirada puesta en la tercera generación de la misma y en el fenomenólogo francés Maurice Merleau-Ponty, reivindicamos una razón ampliada, que no solo tiene implicaciones epistemológicas, sino existenciales, y que puede ayudar a superar incluso los dualismos surgidos en el feminismo, una tradición de pensamiento que, en diálogo con la fenomenología, gana radicalización filosófica a la vez que la fenomenología arraiga en el movimiento feminista y, con él, en la autoresponsabilidad de la humanidad.Starting from the work of Vicent Martínez in which he explains what he understands by "practical rationality" in the framework of his philosophical studies for peace–also for peace between genders–, I rethink my own contributions to the interaction between phenomenology and feminism, particularly the link of the phenomenological critique of objectivism and the unmasking of patriarchal reason in order to demonstrate that the non-indifferent recognition of plurality is not at odds with the autonomy and universality of reason, but exclusively with the instrumental reason which dominates until the 21st century. I consider this dominating reason from Husserl's diagnosis of the crisis of the sciences as well as from the criticism to Modernity undertaken by the Frankfurt School. I will pay attention on the third generation of this School as well as on the French phenomenologist Maurice Merleau-Ponty in order to reclaim an enlarged reason which not only has epistemological implications, but existential. This reason can even help overcome the dualisms that have arisen within feminism. Feminism is a tradition of thought that, in dialogue with phenomenology, can attain a philosophical radicalization while phenomenology can take root in the feminist movement and with it, in the self-responsibility of humanity. One of the fundamental events in the life of Saint Augustine was its encounter with Cicero. The reading of the dialogue Hortensius led St. Augustine to study Philosophy. Cicero provided him with a vague concept of Wisdom that made him see that happiness is not in the material but in the spiritual world. However Saint Augustine was disappointed by the probabilism of Cicero in subjects as important as God, the immortality of human soul..., questions on which the Christian doctrine has (...) a valuable answer. Somehow Cicero's dialogue Hortensius brought Saint Augustine to Christian thought. (shrink)

Critique has been a central theme in the German philosophical tradition since the publication of Immanuel Kant's Critique of Pure Reason. Some successors turned Kant's critique against itself and used it to challenge the authority of his system. Others extended his critique, applying it to aesthetics, epistemology, ethics, metaphysics, and political philosophy and generating new forms of criticism that were then taken up by Idealism, Romanticism, Marxism, Neo-Kantianism, Phenomenology, and Critical Theory. Yet these various legacies of Kantian critique are rarely (...) brought into dialogue. Critique in German Philosophy seeks to address this problem by exploring the figures, works, movements, and philosophical subfields that have contributed to the development of the concept of critique in German philosophy, as well as their relation to one another. In so doing, it also challenges the standard ways philosophers have understood the task of philosophical critique. Attending to both canonical and previously overlooked texts and thinkers, the contributors bring to light alternative conceptions of critique in the German philosophical tradition with profound implications. In offering a critical revision of the history of modern European philosophy, the volume also raises new questions about what it means for philosophy to be "critical" today. (shrink)

This paper offers a brief reply to William Morgan’s critique of my review of Andrei Marmor’s Social Conventions . Morgan’s principal critique is that I am wrong to think that the constitutive rules of games do not determine their aims and values. In particular, with regards to chess, Morgan argues that the rules of chess determine that the aim of playing chess is to win the game. I defend my position that one can play the game of chess without the (...) aim of winning - e.g. one can aim to play beautifully, and not, as Morgan suggests, only to win beautifully. More broadly, I argue for an account of games that is sensitive to the gap between playing and the game’s constitutive rules. Ultimately, the argument points to the descriptive priority for the social sciences of the concept of ‘play’ over the concept of games understood as ‘rule-governed domains’. (shrink)

The last decade has witnessed a particularly intensive debate over methodological issues in legal theory. The publication of Julie Dickson's Evaluation and Legal Theory (2001) was significant, as were collective returns to H.L.A. Hart's 'Postscript' to The Concept of Law. While influential articles have been written in disparate journals, no single collection of the most important papers exists. This volume - the first in a three volume series - aims not only to fill that gap but also propose a systematic (...) agenda for future work. The editors have selected articles written by leading legal theorists, including, among others, Leslie Green, Brian Leiter, Joseph Raz, Ronald Dworkin, and William Twining, and organized under four broad categories: 1) problems and purposes of legal theory; 2) the role of epistemology and semantics in theorising about the nature of law; 3) the relation between morality and legal theory; and 4) the scope of phenomena a general jurisprudence ought to address. This paper considers the similarities between Adam Smith's device of the impartial spectator and the use of perspectival devices in common law reasoning. The paper adopts a reading of Smith's device as one involving the exercise of imaginative sympathy by an ordinarily virtuous, and culturally and historically situated, spectator who does not have a stake in the outcome of the scene being evaluated. The point here is to show that the impartial spectator is 1) a device of common, ordinary virtue (...) – both in the sense of being located in a culture at a specific point in time, and in the sense of possessing only moderate, achievable virtues ; and 2) a device that enables a focus on a situation, which requires imaginative work, emotional engagement and careful, particularised description. Having so modelled Smith's device, the paper shows the similarities between it and the use of perspectival devices in common law reasoning, specifically here via the ‘right-thinking member of society' test in defamation law. This paper discusses a much-neglected aspect of Neil MacCormick's theory of legal reasoning, namely what he calls ‘consequential reasoning’. For MacCormick, consequential reasoning is both an omnipresent feature of legal reasoning in England and Scotland, as well as being a valuable one. MacCormick articulates the value of consequential reasoning by seeing it as contributing to the forward-looking requirement of formal justice, ie, of deciding the instant case on grounds that one is willing to adopt when deciding future similar cases. This (...) paper situates consequential reasoning in the overall picture of legal reasoning MacCormick develops in Legal Reasoning and Legal Theory, going on to show the evolution of his view on consequential reasoning in later work, which culminates in Rhetoric and the Rule of Law. It is argued that MacCormick's later view of consequential reasoning, ie, of a process of testing possible rulings by evaluating the acceptability or unacceptability.. (shrink)

Using Leventhal’s (Social exchange: Advances in theory and research, Plenum Press, New York, 1980 ) rules of procedural justice as well as deontic justice (Folger in Research in social issues in management, Information Age, Greenwich, CT, 2001 ), we examine how personal value for diversity moderates the negative relationship between perceived discrimination against minorities (i.e., racial minorities and females) at work and the perceived procedural justice of minorities’ treatment by the organization. Through a field survey of 190 employees, we found (...) that observers high in personal value for diversity have stronger negative reactions to the mistreatment of women and racial minorities than observers low in personal value for diversity. These findings support and extend the deontic justice perspective because those who personally value diversity had the strongest negative reactions toward the discriminatory treatment of minorities. Shows the relevance of Schiller’s thought for contemporary philosophy, particularly aesthetics, ethics, and politics. This book seeks to draw attention to Friedrich Schiller (1759–1805) as a philosophical thinker in his own right. For too long, his philosophical contribution has been neglected in favor of his much-deserved reputation as a political playwright. The essays in this collection make two arguments. First, Schiller presents a robust philosophical program that can be favorably compared to those of his age, including Rousseau, Kant, Schelling, and (...) Hegel, and he proves to be their equal in his thinking on morality, aesthetics, and politics. Second, Schiller can also guide us in our more contemporary philosophical concerns and approaches, such as phenomenology, hermeneutics, aesthetics, and politics. This paper considers whether, and if so how, the modelling of joint action in social philosophy – principally in the work of Margaret Gilbert and Michael Bratman – might assist in understanding and applying the concept of concerted practices in European competition law. More specifically, the paper focuses on a well-known difficulty in the application of that concept, namely, distinguishing between concerted practice and rational or intelligent adaptation in oligopolistic markets. The paper argues that although Bratman's model of joint action (...) is more psychologically plausible and phenomenologically resonant, its less demanding character also makes it less useful than Gilbert's in our understanding of the legal concept of concerted practice and in dealing with the above difficulty. The paper proceeds in two parts: first, a discussion of the concept of concerted practices in European competition law; and second, a discussion of Gilbert and' Bratman's models of joint action, including a comparative assessment of their ability to provide an evidentiary target and an evidentiary platform for conceited practices. This paper offers a sympathetically critical discussion of one of the central features of Neil MacCormick’s last book, Practical Reason in Law and Morality (2008), namely, what he called ‘the Smithian Categorical Imperative’ (SCI). The SCI is presented by MacCormick as a synthesis of the best of Immanuel Kant and Adam Smith’s contributions to moral philosophy. The paper proceeds in three parts: the first two are dedicated to articulating and evaluating MacCormick’s understanding of Kant and Smith. The focus in these (...) two parts is on the following concepts: autonomy and universality in the case of Kant, and imagination and sympathy in the case of Smith. The third part then discusses the formulation and two applications of the SCI, the first of these relates to the practice of lying and breaking promises, and the second to the conjoined twins’ case. It is argued that MacCormick’s rapprochement between Kant and Smith in the form of the SCI is a genuinely important and original contribution to moral philosophy, and has important implications for theories of legal judgement. Nevertheless, the paper also considers whether, by modifying MacCormick’s interpretation of Kant and Smith (and especially the latter), we may be able to further extend MacCormick’s characteristically generous capacity to tread a middle path between otherwise antagonistic theoretical traditions. We present a proof of the equivalence between two deductive systems for constructive necessity, namely an axiomatic characterisation inspired by Hakli and Negri's system of derivations from assumptions for modal logic , a Hilbert-style formalism designed to ensure the validity of the deduction theorem, and the judgmental reconstruction given by Pfenning and Davies by means of a natural deduction approach that makes a distinction between valid and true formulae, constructively. Both systems and the proof of their equivalence are formally verified (...) using the state-of-the-art proof assistant Coq. The proof approach taken throughout the paper unveils the use of some alternative proof methods that allow for a smooth transition from the high-level mathematical proofs to their mechanised counterparts. The concept of person arises in the conjunction of Greek Philosophy carried out by Saint Augustine. Both men and women are persons because they carry the image of God in their soul. On bearing the mind God's mark in its memory, it will wish for happiness. On bearing God's mark in its intelligence, it will wish for Truth and on bearing God's mark in its will it will wish for the Good since the desire for happiness is a wish or (...) remembrance of God, the desire for Truth is a wish of God because He is the Truth, and the desire of Good and Beauty is a wish of God because He is the highest Good and the supreme Beauty. Human being's strongest motivations: happiness, truth, good and beauty, they all just come from being a person, from being the brightest bearer of the Trinitarian image which, on leaving its mark on him, at the same time marks the direction of his deepest desire. The anchorage of those metaphysical desires of man is in God and they can be thought of as anthropological universals. (shrink)

This paper integrates the inclusion and organizational ethics literatures to examine the relationship between employees’ perceptions of an organizational integration and learning approach to diversity and two employee outcomes: organizational citizenship behavior toward the organization and interpersonal workplace deviance. Findings across two field studies from the USA and Germany show that employees’ perceptions of an organizational integration and learning approach to diversity are positively related to perceived organizational ethical virtue. Perceived organizational ethical virtue further transmits the effect of employees’ perceptions (...) of an organizational integration and learning approach to diversity on both organizational citizenship behavior toward the organization and interpersonal workplace deviance. In addition, we find support for a moderated indirect effect model whereby the indirect effect of the perceived integration and learning approach to diversity on the dependent variables through perceived organizational ethical virtue is stronger when employees have high personal value for diversity rather than low personal value for diversity. These results underscore the importance of having a fit between employees’ perceptions of an organization’s approach to diversity and employees’ personal value for diversity in order for inclusion to result in positive employee behaviors. Results emphasize the ethical responsibility of organizations in terms of how they approach diversity. (shrink)

Introduction: Resilience is a multidimensional and dynamic construct associated with positive growth and the capacity to transform stressful and negative factors into opportunities of personal development and self-improvement when faced with difficult experiences. The resilience process of each individual integrates multiple analysis levels, which range from genetic-environmental interactions to a complex process of adaptation between the individual and his/her family, friends, co-workers, society, and culture.Objective: To determine whether resilience improves in students of occupational therapy when exposed for the first time (...) to practice placement education.Methodology: Quasi-experimental, prospective, observational, multi-center study with a sample composed of students from the Degree of Occupational Therapy of the public universities of Málaga and Castilla-La Mancha. Two weeks prior to the beginning of the practice education period, the participants completed a questionnaire that included sociodemographic data and the area of their internships. They were also given the Spanish version of the Connor-Davidson's resilience scale. All these instruments were also completed 1 week after the end of the clinical practice.Results: There were statistically significant differences between the variables that make up resilience and the different internship areas. On the other hand, there was a significant improvement of global resilience after the clinical practice period, in both women and men, when the internship area was not considered.Conclusions: The results show that resilient students are more optimistic and work to improve a situation beyond doing simply what is expected of them, knowing how to control their feelings. This is beneficial for students in practice education, since, during these, they face difficult situations that require a resilient pattern, which helps reduce stress and the burnout syndrome. Using diversity climate theory and research, this paper examines the relationships among an organization’s actions which indicate a value for age diversity and potential applicants’ reactions toward that organization. Specifically, we investigate the interactive effects of an organization’s age diversity, an organization’s age diversity management practices, and potential applicants’ individual attitudes toward age diversity on two outcome variables, organizational attractiveness and expected age discrimination. We conducted an experimental survey study with a sample of 244 German employees likely to be in (...) the job market again in their careers. Organizational age diversity and age diversity management practices were positively related to organizational attractiveness and negatively related to expected age discrimination. Results also support a three-way interaction of an organization’s age diversity, an organization’s age diversity management practices, and potential applicants’ attitudes toward age diversity on both dependent variables. The findings demonstrate the importance of considering individual attitudes toward age diversity in assessing the effectiveness of an organization’s age diversity and age diversity management practices. El objetivo de este artículo es exponer y desarrollar la posición de Lester Embree sobre los colegas como objetos culturales. Para ello, contextualizaremos su tesis en su concepción de la fenomenología y la cultura como opuestas al naturalismo. Nos preguntaremos si es necesario también oponerse al culturalismo. Analizaremos, en relación con él, el sentido de la cultura básica y su dependencia de la naturaleza, entendida principalmente como physis y movimiento. Ejemplificaremos esto con una fenomenología de la danza y su concepción (...) del cuerpo que, a su vez, es un ejemplo de la necesidad de interdisciplinaridad.The aim of this article is to expound and to develop Lester Embree’s stance on colleagues as cultural objects. To this end, we contextualize his position within his conception of Phenomenology and Culture as opposed to naturalism. We will wonder whether it is also necessary to oppose to culturalism. Regarding that, we will analyze the meaning of the basic culture and its relationship with nature. We will exemplify this with a phenomenology of dance and its conception of the body, which in turn is an example of the need for interdisciplinarity. (shrink)

The Vestal Virgins are one of the most famous elements of Roman religion, yet despite their perennial appeal and the importance of some smaller scale studies of the priesthood, the priestesses have not received a monograph-length study since F. Giuzzi, Aspetti giuridici del sacerdozio romano. II sacerdozio di Vesta (Naples, 1968). Now we have books by R.L. Wildfang and M.C. Martini that could not be more different. The former offers a thorough survey of what the sources can tell us about (...) the priesthood in the period from the end of the Second Carthaginian War to the first century C.E. The latter is an analysis of early Roman historiography and the role the Vestals, in particular their periodic unchastity, played in the creation of the traditional account of the development of Rome. W's book puts forward two main arguments: (1) the Vestals were charged with the ritual purification of the city and with the storage and preparation of ritual materials, and (2) many aspects of the priesthood that have long puzzled scholars are tied to the Vestals' status as Roman citizens, but citizens who existed outside the traditional family structure. The book will be accessible to those new to the topic, but the notes will repay specialists. Ancient sources are quoted in translation, with original texts provided in an appendix. A second appendix provides a list of known Vestals. This slender volume could have been even thinner if the frequent repetitions were cut down. W's work might have been better as a hefty article, so little is there to know about the Vestals. W reserves 'fertility' to describe only those rites that deal with the reproduction of people, livestock and the growth of crops. Harvest rituals are linked to the harvesting of crops, while another set of rites, 'storage rites', are tied to the preservation of the harvest. The final group, purification rituals, aim at the cleansing of an individual, place or object of 'all forms of pollution that would render it or them unfit to come into contact with the religious sphere'. The book is arranged thematically. The first two chapters lay out all we can know about the priestesses' ritual obligations performed in the seclusion of the temple and out amongst the people. While a reader may not find W's interpretation of each of the Vestals' actions equally persuasive, the overall argument that the priestesses' activities were, by and large, purificatory is convincing. Two of the more interesting aspects of W.'s discussion are her considerations of Vesta's fire and of the water required for some of her rituals (pp. 8-11). Fire was seen by the Romans as both a fertile and a sterile force, and scholars have emphasised one or the other, or the contrast between them, in their interpretation of the Vestals. W points out that fertile fire is always described in masculine terms and is associated with Vulcan. Vesta's fire, however, is always associated with sterility and purity, and so should be understood as having a purificatory significance. W points out that Vesta's fire was used only in the manufacture of ritually necessary items: roasting spelt for mola salsa, baking brine for muries and burning ashes from the fetal cow from the Fordicidia and the tail of the October horse, both of which were used at the Parilia. For other rituals, the Vestals were required to use water, the purificatory substance par excellence, drawn only from the spring of Juturna and carried only in vessels that could not be set down. These restrictions ensured that the water was always fresh, running water that never touched profane earth. Chapters 3-5 trace out the unique position the Vestals occupied in Roman society, arguing that they existed outside the standard Roman familial and other social structures, yet remained fully part of the Roman state. W suggests that the initiation rite of captio removed the new priestess not only from her family but, more importantly, from her family cult, thus avoiding any potential contamination of familial and public cult. Virginity was required for multiple reasons, the most significant being that such a status allowed the priestess to remain a full member of the Roman state, but prevented her from being a member of a traditional family structure. Throughout the book, W makes much of the idea of Vestals as represen tatives of Roman citizen women without ever really dealing with the question to what extent any Roman woman, priestess or not, was a ciuis. Though W is probably correct, it is not entirely certain to what extent women were citizens in the Republic, and at least a reference to some key ancient sources and to recent scholarship on this question should be made (e.g. L. Peppe, Posizione giuridica e ruolo sociale della donna romana in eta repubblicana [Milan, 1984]). The sixth chapter, 'The Vestals in the Romans' History', looks at the appearance of Vestals in the early history of Rome, refining the common assumption that accusations of, and convictions for, incestum arose only in periods of great stress and danger. W adds that a priestess's involvement, or her family's involvement, in one of the groups taking part in the conflict or struggle of the moment also played a role. This chapter traces changes over the course of 300 years in the attitudes of the priestesses and the Romans more generally toward the priesthood, its role in society This content downloaded from 204.235.148.90 on Sat, 26 Jul 2014 11:47:09 AM All use subject to JSTOR Terms and Conditions 214 THE CLASSICAL REVIEW and its requirement of 30 years of chastity. The argument hangs on even less evidence than other sections of the work. In contrast to their central place in W's book, the Vestals play only a small (though crucial, in her interpretation) role in M.'s work. The basic argument of the book is that episodes of Vestal incestum are linked in the historiographic tradition to key moments in the development of the Roman state: the separation of augurium from regnum, the development of a mixed patrician-plebeian aristocracy, the creation of a monetary system and the expansion of the colonial system outside Italy. The history of Rome can be seen as alternating phases of stasis and transformation; instances of Vestal incestum mark the transitions (p. 95). The work falls into two parts that are not well integrated. The first is a useful discussion of the historiography of the Roman Republic, taking in turn each element of the story of the founding of Rome from the arrival of Aeneas to the death of Remus. M. traces how early Roman writers, especially Fabius Pictor, reshaped the tradition already present in some Greek authors, distancing Rome from the Greek world and adding an Italic element to the tale. This detailed analysis is well worth consulting and will be of interest to those working on many aspects of cultural life in the Republic. The second, larger, section of the book comprises a series of studies of the Vestals known to have been convicted of incestum during the Republic. After dealing with issues of dating and sources, M. links each case of incestum to a major event in Roman history. Not all the events are equally important for the creation of the Rome of the middle and late Republic. One wonders why M. chose to tie the conviction of Minucia, somewhere between 339 and 332, to the admission of plebeians to the praetorship in 337 rather than to the conclusion of the Latin War in 338. Some explanation is warranted. The connection M. draws is often very vague, as in the case of Sextilia (pp. 144-54), convicted and interred alive in either 275 or 274. M. sees this as marking the end of any meaningful distinction between patricians and plebeians, following as it does the first time a plebeian censor completed a lustrum. The gap of five or six years between Sextilia's conviction and Cn. Domitius Calvinus Maximus' censorship in 280 passes unremarked. Similarly, in discussing the three Vestals accused of incestum in 114-113 (pp. 188-210), M. steps away from the commonly accepted interpretation of the event as part of the continuing struggle between Gracchan and senatorial forces, arguing instead that it is tied to the establishment in 118 of the colony of Narbo Martius, Rome's first colony in Gaul. Here, as elsewhere, there is no evidence that any ancient author linked the founding of the colony and Vestal unchastity; the temporal gap makes an association even more unlikely. Ultimately, it is not possible to accept M.'s argument that Vestal incestum punctuated key stages in the development of the 'cosmo Romano' in the way she imagines. Even so, M.'s effort to reintegrate the Vestals into the larger narrative of Rome's history is thought-provoking, and it is to be hoped that it will spark further work in the same vein. The field is perhaps in a better position to undertake work on this scale now that we have W's careful and comprehensive collection and interpre tation of what there is to know about the Vestals. This essay argues that the practical reason approach to the study of social conventions (and social normativity more generally) fails to adequately account for the fluency of social action in environments that we experience as familiar. The practical reason approach, articulated most recently in Andrei Marmor’s Social Conventions: From Language to Law (2009) does help us, though not wholly adequately, to understand how we tend to react to, and experience, unfamiliar situations or unfamiliar behaviors, that is, those situations in which (...) a certain practice becomes problematic or is problematized, or where we are obliged to, or moved to, justify or deliberate. The reason why the practical reason approach is not wholly adequate when it comes to understanding unfamiliar situations or unfamiliar behaviors is that it tends to subsume the unfamiliar under the familiar, that is, it tends to negatively evaluate anything that is deemed to be not in accordance with the rules and reasons already familiar to the observer. This excludes the possibility of the observer having to transform himself or herself, and thus change what is familiar to him or her. (shrink)

Their historical support to the financing needs of small savers, as well as their assimilation into the framework of contemporary microfinance, gives them an important specific weight in the economic-financial literature of our time. In this sense, our research has carried out a systematic review of the main contributions focused on the area of credit unions over the period 1936–2020, (...) using Scopus and WoS as bibliographic databases. In summary, the main countries, journals, authors, articles, and the main collaborative research networks at the level of authors or countries have been analyzed. In the same way, the implementation of strategic diagrams based on Callon’s procedure has facilitated the classification of the most important terms linked to financial cooperativism, which has served to detect future lines of research related to the terms : asymmetric-information, capital-provision, cooperative-principles, customer-reduction, gender-issues, neoinstitutionalism, poverty, and urban-economy. La retinopatía diabética proliferativa es una de las afecciones oftalmológicas que más ensayos ha suscitado. El objetivo de este trabajo consiste en analizar algunos aspectos éticos en la experimentación en pacientes con esta afección. The Second World War and the atrocities committed in research with prisoners in Japanese and Nazi concentration camps, awakened consciousness for the development of human rights that had gradually been conquered throughout history. That´s why a series of laws, rules and statements that deal with bioethical aspects in clinical trials, were passed. Special attention must be given to the doctor-patient relationship during the research and consider the benefit/risk ratio when conducting experiments on human beings. Proliferative Diabetic Retinopathy is one of the ophthalmological disorders that has given rise to more trials. In Resp. 509c7 and 9 Socrates declares that he has omitted many things in the exposition of the analogy between the supreme Good and the sun. In fact Socrates’ exposition leaves some questions open which are seminal with regard to the interpretation of the aforesaid analogy : 1) Why Plato designates the sun as analogon of the Good? 2) Why the original manifestation of the Good consists in a plurality of intelligible beings? 3) Why the original manifestation of the Good (...) consists not only in a purely objective intelligible being, but also in an intellect, that is in a form of consciousness? 4) How can be explained the fact that Plato perceives the Good as origin not only of intelligible, but also of physical reality? While the first question can be simply answered by referring to the infinite manifestativity of the Good, the other three questions require a significant effort in the field of speculation. Basing on some clues given by Plato in the exposition of the analogy between the Good and the sun, this article attempts to answer these questions by conjecturing that Plato could have presupposed the image of an infinite sphere consisting in intelligible light. This image, which could have already been presupposed by Parmenides, would offer a conceptual background capable of explaining on the one hand the unity of intelligibility and intellect characterizing the original manifestation of the Good, on the other hand why in Plato’s perspective the Good can be perceived as origin not only of intelligible, but also of physical light. Clinical practices are considered one of the cornerstones in nurses' education. This study provides a framework to determine how factors in the academic environment, influence nursing student's satisfaction with their practices. A cross-sectional analytical study was conducted in a convenience sample of 574 nursing students at a private university in Valencia, during the 2016/2017 academic year, 79% were women. Two statistical methodologies were used for data analysis: hierarchical regression models and fuzzy sets qualitative comparative analysis. The HRM indicate that the (...) students' mean score influences all dimensions of satisfaction. Furthermore, in the fsQCA, the type of service and center, as well as the type of management, the preference in the choice of the practice center and the number of students per period per clinical educator influence satisfaction with clinical practices. These results could be used to understand how academic factors influence nursing students' satisfaction with their clinical practices and to create intervention programmes that improve it. This will help prepare students to be the future nursing workforce. (shrink)

This essay takes into account the pedagogical reform for the poor proposed in England by Andrew Bell, Joseph Lancaster and Patrick Colquhoun between Eighteenth and Nineteenth century. Differentiating individuals and reproducing social order through the implementation of a pedagogical plan is a response both to the excessive expectations of well-being raised among the English poor by the Revolution in France, and to the uncontrolled spread of crime and undisciplined behaviours in the new manufacturing districts. This is why social reformers looked (...) at the pedagogical reform of mutual instruction as a way to build the conditions of reproduction of social differences: the plans proposed by Bell and Lancaster, based on emulation, competition and merit, are supported by Colquhoun because they offer a possible solution for the problems of crime and immoral behaviour. «The order of Merit», triggered by emulation, distinction and reward, thus become the main tool of influencing poor’s expectations so to predict and discipline their conduct as future waged workers. Thought, according to Hegel, is not only the product of a faculty of a subject, or a means by which a thinking subject tries to grasp a world that is alien to him. It is also the very structure of the world, that is disclosed to a subject through the thinking activity of a subject. The fundamental question that crosses the whole post-Kantian philosophy is that of the relation between thought and reality, i.e. the question of whether reality depends on (...) the categorial requirements imposed by the thinking subject, or whether reality maintains some form of independence from the thinking subject. Seen from this standpoint, Hegel can be read both as an author who radicalizes Kant’s transcendental perspective, and also as a critic of that perspective. In other words, he can be seen as an idealist: according to Hegel, any philosophy is idealist if it claims that something finite, qua finite, is essentially connected with something other. He can also be seen as an anti-idealist: insofar as his philosophy aims to overcome a hyper-transcendentalist perspective, i.e. it is so since it rejects idealism as subjective idealism. Moreover, Hegel’s anti-idealism can be characterized as realism. This is because, if we admit that overcoming transcendentalism without falling back again on a pre-critical conception of thought and of reality involves an idea of thought which is not reducible to a "mentalistic" conception of it, we need to conceive of thought as something that is not alien to reality. Hegel conceives of thought as intimately connected with the world, as its own rational structure. This “realism” of thought is what makes Hegelian idealism, so to speak, anti-idealistic. Through this "realism" of thought Hegel pursues two goals. On the one hand, Hegel attempts to overcome a subjectivistic and instrumentalistic conception of thought, according to which a subject talks and relates to a reality that is always only a construction of him, and so it is necessarily the simulacrum of something that remains inaccessible in its truth. On the other hand, Hegel attempts to overcome a conception of reality characterized merely as alien and opposite to thought itself, and which is the counterpart of the subjectivistic and instrumentalistic conception of thought. By pursuing these two goals it should be gained a conception of reality which could warrant some form of objectivity, but which cannot be equated with the substantialistic conception of the pre-Kantian metaphysics. continent. 2.2 (2012): 76–81 Comments on Eugene Thacker’s “Cosmic Pessimism” Nicola Masciandaro Anything you look forward to will destroy you, as it already has. —Vernon Howard In pessimism, the first axiom is a long, low, funereal sigh. The cosmicity of the sigh resides in its profound negative singularity. Moving via endless auto-releasement, it achieves the remote. “ Oltre la spera che piú larga gira / passa ’l sospiro ch’esce del mio core ” [Beyond the sphere that circles widest / penetrates (...) the sigh that issues from my heart]. 1 The axiomatic sigh of the pessimist is in a way the pure word of philosophy, a thought that thinks without you, speaks where you are not. The live pneumatic form of the soul’s eventual exit from the dead body’s mouth, the sigh restores consciousness to the funeral of being, to the passing away that is existence. Pessimism speaks in piercing aphorisms because first it sighs. “Beyond the sphere passeth the arrow of our sigh. Hafiz! Silence.” 2 … pessimism is guilty of that most inexcusable of Occidental crimes—the crime of not pretending it’s for real. To the pessimist, the ‘real’ world—the world on whose behalf we are expected to wake up in the morning—is a ceaseless index of its own unreality. The pessimist’s day is not an illumined space for the advancement of experience and action, but a permanently and inescapably reflective zone, the vast interior of a mirror where each thing is only insofar as it is, at best, a false image of itself. Within this speculative situation, inside the doubleness of the mirror, pessimism splits into two paths, false and true, one that tries to fix pessimism (establish a relation with the mirror) and decides in favor of the apparent real, and another that totally falls for pessimism (enters the mirror) and communes with the greater reality of the unreal. These two paths are distinguished by their relation to pessimism’s guilt vis-à-vis the world’s reality-project. The first form, that which remains pessimism for the world and puts on a smiling face, stays guilty to itself (i.e. unconscious) and thus turns hypocritical, becoming at once the pessimism of the commoner who really just wants things to be better for himself and the pessimism of the elite who wants to critically refashion reality in his own image. The general form of this worldly, hypocritical pessimism is the impulse to ‘make the world a better place’, which is the global mask under which the world is diurnally made worse. The second form, that which follows pessimism away from the world and ceases to put on a smiling face, refuses guiltiness as itself theessential Occidental mode of pretense and turns honest, becoming at once the intelligent pessimism required of all ordinary action and the radical pessimism necessary for self-knowledge: seeing that no one is capable of doing good. The general form of this universal, honest pessimism is the impulse not to worry, to give up and embrace dereliction, which is the only real way the world is actually improved. Where worldly pessimism is the engine productive of interminably warring secular and sacred religions (good-projects), universal pessimism strives hopelessly for the paradise of a supremely instantiated pessimus: things are getting so bad that there is no longer any time for them to get worse; things are so constantly-instantly worst that this is BEST. Cosmic pessimism is the mode of universal pessimism which can yet discourse with the world, which has not chosen silence and can spread the inconceivably BAD NEWS in an orderly form ( kosmos ) that the world can understand (if it wanted to). … the result of a confusion between the world and a statement about the world. That is what the world is (the result of a confusion between the world and a statement about the world). … a generalized misanthropy without the anthropos. Pessimism crystallizes around this futility—it is its amor fati , rendered as musical form. Pessimism’s love of fate is a blind love, a love of the blindness of being human in a cosmos conceived around the human’s eclipse, a heavy levitation in the contradictory space between the inescapability of its having been and the impossibility of its will-be. Pessimism’s song of futility is a sensible way of loving fate, with a minimum of eros, by means of a kind of matrimonial love of the fatal. As music, pessimism stays open to the irreparable and the inexorable without the binding of affirmation, in the apparent absence of the radical, infinitely surplus will that absolute amor fati seems to require. Crying, laughing, sleeping—what other responses are adequate to a life that is so indifferent? “Unless a man aspires to the impossible, the possible that he achieves will scarcely be worth the trouble of his achieving it. We should aspire to the impossible, to absolute and infinite perfection [….] The apocatastasis is more than a mystical dream: it is a norm of action, it is a beacon for high deeds [….] For true charity is a species of invasion [….] It is not charity to rock and lull our fellow men to sleep in the inertia and heaviness of matter, but rather to arouse them to anguish and torment of spirit.” 3 … the impossibility of ever adequately accounting for one’s relationship to thought. “The paroxysm of interior experience leads you to regions where danger is absolute, because life which self-consciously actualizes its roots in experience can only negate itself [….] There are no arguments [….] On the heights of despair, the passion for the absurd is the only thing that can still throw a demonic light on chaos [….] I live because the mountains do not laugh and the worms do not sing .” 4 It took three attempts before she was fully decapitated, all the while she continued, perhaps miraculously, to sing. According to the earliest account of Cecilia’s martyrdom, the beheading turns out worse. After not severing her head in three strokes, “the cruel executioner left her half dead” (seminecem eam cruentus carnifex dereliquit). 5 Cecilia’s effortlessly powerful endurance of the three strokes—a fitting icon for pessimism as an art of dereliction—demonstrates the “passivity and absence of effort [….] in which divine transcendence is dissolved.” 6 There’s a ghost that grows inside of me, damaged in the making, and there’s a hunt sprung from necessity, elliptical and drowned. Where the moving quiet of our insomnia offers up each thought, there’s a luminous field of grey inertia, and obsidian dreams burnt all the way down. Like words from a pre-waking dream. Shipley Pessimism is the refusal to seek distraction, the refusal to remodel failure into a platform for further (doomed) possibilities, the refusal of comfort, the acceptance of the sickness of healthy bodies, the cup of life overflowing with cold vomit. If, as Ligotti suggests when discussing Invasion of the Body Snatchers , 1 humans prefer the anxieties of their familiar human lives to the contentment of an alien one, then the pessimist, we could argue, represents some perverted combination of the two, preferring (presuming he has a choice) the defamiliarization of human life to the contentment of its unquestioned mundanity. The quasi-religious state of mind that Wittgenstein would mention on occasion, that of “feeling absolutely safe,” 2 is a state the pessimist could only imagine being approximated by death, or perhaps some annihilative opiate-induced stupor. This Wittgensteinian commingling of certainty and faith looks every bit the futile gesture, a mere rephrasing of collapse or partial collapse. The only certainty open to the pessimist is that of the toxic formula of life itself—a formula known and lacuna-free. Certainty, far from being the gateway to deliverance, becomes the definitive impediment; and the possibility of salvation, as long as it remains, becomes crucially reliant on postulations of ignorance, epistemic gaps, a perennial incompleteness: “the perfect safety of wooed death […] the warm bath of physical dissolution, the universal unknown engulfing the miniscule unknown.” 3 The height of Leibniz’s Panglossian insanity nurtured the idea that our knowing everything—via the universal calculus—could be accurately described a triumph, as opposed to a nightmare in which our every futility is laid bare. Stagnancy and boredom are perhaps two of the greatest ills of Western civilisation, and the most potent pessimism tells you that you’re stuck with both. The most we can hope for, by way of salvation, is to throw open our despair to the unknown. The fact that Schopenhauer’s pessimism stopped short of morality and allowed him to play the flute, as Nietzsche complained, highlights the predicament of a man who despite having adorned nothingness with a smiling face still found himself alive. The demand here is that it be felt: a cross-contamination of intellect and emotion. The safety net of numerous parentheses makes for a failed philosophy, rather than a philosophy of failure. Depressives make bad pessimists, because, unless they choose to die, living will always infect them with necessities of hope, forcing them to find something, anything (all the various “as ifs”) to make existence tolerable. For as Cioran observed, while “[d]epressions pay attention to life, they are the eyes of the devil, poisoned arrows which wound mortally any zest and love of life. Without them we know little, but with them, we cannot live.” 4 And even when cured of our depressions we’ll find ourselves consumed, eaten alive by the hyper-clinical (borderline autistic) mania that replaces them: a predicament captured all too clearly in the microscriptual fictions of Robert Walser, where spectral men and women stifle their depressive madness with protective comas of detail, their failed assimilations buried beneath thick crusts of remote data. Like Beckett’s Malone their stories may have ended, but cruelly their lives have not. Pessimism is an extraneous burden (a purposeless weight) that makes everything else harder to carry, while at the same time scooping it out and making it lighter. If pessimism had a sound it would be the harsh non-noise of tinnitus—the way that every person would hear themselves if they refused their distractions long enough to listen: a lungless scream from the extrasolar nothing of the self. The music of pessimism—if indeed we can imagine such a thing—is the reverberating echo of the world’s last sound, conjectured but never heard, audible only in its being listened for. The one consolation of this hollow paradox of audibility being, that “he will be least afraid of becoming nothing in death who has recognized that he is already nothing now.” 5 The pessimist suffers a derangement of the real, a labyrinthitis at the nucleus of his being: he’s the stumbling ghost relentlessly surprised that others can see him. If Cioran’s refusal is manifested in sleep (when even saying ‘no’ is too much of a commitment), then Pessoa’s resides in the dreams inside that sleep. Pessoa chooses to exploit the fact that he’s being “lived by some murmuring non-entity both shadowy and muddied” 6 by growing more voids to live him. His is a Gnostic breed of sleep, “sleeping as if the universe were a mistake,” 7 a sleep that dreams through Thacker’s cosmic pessimism (“a pessimism of the world-without-us.”, “the unhuman orientation of deep space and deep time” 8 ), through the critical error of there being anything at all when there could be nothing. The metaphysical pessimist is someone who, however well life treats them, still desires to wake from it, as from the poisonous air of a bad dream. Pessimism is a paradox of age, being simultaneously young and old; its youth residing in a refusal to accept the authority of existence (its rich history, its inherent beneficence), a refusal to “get over” the horror of what it sees with its perpetually fresh eyes, and its maturity in the unceremonious disposal of the philosophical playthings (those futile architectures) of adolescence. As Thacker remarks: “Pessimism abjures all pretenses towards system—towards the purity of analysis and the dignity of critique.” 9 A sentiment shared with Pessoa, who duly categorizes those that choose to enact this futile struggle: “The creators of metaphysical systems and of psychological explanations are still in the primary stage of suffering.” 10 If the pessimist has shared a womb with anyone, it’s with the mystic and not the philosopher. As Schopenhauer tells us: “The mystic is opposed to the philosopher by the fact that he begins from within, whereas the philosopher begins from without. […] But nothing of this is communicable except the assertions that we have to accept on his word; consequently he is unable to convince.” 11 The crucial difference between the mystic and the pessimist is not the latter’s impassivity and defeatism, but his unwillingness/inability to contain in any way the spread of his voracious analyticity, his denial of incompleteness, his exhaustive devotion to failure. The truth of our predicament, though heard, is destined to remain unprocessed. Like the revelations of B.S. Johnson’s Haakon (“We rot and there’s nothing that can stop it / Can’t you feel the shaking horror of that?” 12 ) the pessimist’s truths are somehow too obvious to listen to, as if something inside us were saying, “Of course, but haven’t we gotten over that?” Pessimism is simple and ugly, and has no desire to make itself more complex or more attractive. The true moral pessimist knows that the Utilitarian’s accounts will always be in the red. He can see that for all his computational containments, his only honest path is a negative one, and that such a path has but one logical destination: that of wholesale human oblivion. Thacker notes how at the core of pessimism lies the notion of “the worst,” through which death is demoted by the all-pervasive suffering of a life that easily eclipses its threat. And so with doom made preferable to gloom, death begins to glint with promise, “like beauty passing through a nightmare.” 13 But even among pessimists suicide is, for the most part, thought to be an error. Schopenhauer, for instance, regarded suicide a mistake grounded in some fundamentally naïve disappointment or other. Pessoa too thought suicide an onerous escape tactic: “To die is to become completely other. That’s why suicide is a cowardice: it’s to surrender ourselves completely to life.” 14 There is a call here to be accepting of and creative with the puppetry of your being, an insistence that it’s somehow a blunder to attempt to hide in death from the horrors you find inlife. 15 Tied up with this perseverance is the slippery notion of the good death, for maybe, as Blanchot warns, suicide is rarely something we can hope to get right, for the simple reason that “you cannot make of death an object of the will.” 16 “Even in cases where the entire corpus of an author is pessimistic, the project always seems incomplete,” 17 and this is not simply because the project itself belies something yet to be disclosed, but because the project itself is a thing waiting.
