In this paper, I survey liberal and communitarian defenses of privacy, paying particular attention to defenses of privacy in the workplace. I argue that liberalism cannot explain all our of intuitions about the wrongness of workplace invasions of privacy. Communitarianism, on the other hand, is able to account for these intuitions.

In this paper, I consider the claim that a corporation cannot be held to be morally responsible unless it is a person. First, I argue that this claim is ambigious. Person flags three different but related notions: metaphysical person, moral agent, moral person. I argue that, though one can make the claim that corporates are metaphysical persons, this claim is only marginally relevant to the question of corporate moral responsibility. The central question which must be answered in discussions of corporate (...) moral responsibility is whether corporations are moral agents or moral persons. I argue that, though we can make a case for saying corporations are moral agents, they are not moral persons, and hence, we can hold them responsible. In addition, we need not treat them the way we would be obligated to treat a moral person; we needn't have the same scruples about holding a corporation morally responsible as we would a moral person. John Stuart Mill and Harriet Taylor Mill were very much aware of the problem of domestic violence. In the years between 1849 and 1853, they wrote a series of newspaper articles and pamphlets on domestic violence. These works are notable for their passion, insight and the way they prefigure contemporary discussions of this topic. Care ethics can provide a valuable conceptual and normative resource for many issues in law, but given the conservative nature of law in general, much work needs to be done before care ethics can explicitly play such a role. In this paper I survey the landscape of law, discuss two attempts to incorporate care ethics into the normative framework of law, and suggest other avenues for incorporating care ethics in law and legal reasoning.

I argue that we can appeal to the following principle to defend both group and individual obligations to clean up air: if the consequences of everyone doing aare undesirable, then each (...) and every one ought to do was he can to prevent the undesirable consequences. The life and work of Rousseau the musician and aesthetician has been largely neglected in the debate about Rousseau's views on women. In this paper, I shall introduce a new text and a new female figure into the conversation: Collette, the shepherdess in Le devin du village, an opera written by Rousseau in 1752. We see an ambiguity in Collette-the text often expresses one view while the music expresses another. When we take Collette's music seriously the following picture emerges: the (...) natural desire of women to be free, a fairly active female agency, an incipient rebellion against the social role of women, and a final acceptance of the role of wife. This view of Collette supports the thesis that for Rousseau women are not naturally subordinate to men but are taught to be subordinate because it is required for the maintenance of the patriarchal family, the cornerstone of civil society. We see many glimpses of Collette's true, unsocialized, nature, especially in the melodies she sings. It is in song, the first and hence most natural language of humans, that we see Collette's longing for freedom. But she ends by singing the praises of civil society, albeit a rural society, and thus implicitly accepting the subordination she is destined to suffer at Colin's hands. (shrink)

We can explain our intuitions about corporate takeover cases by appeal to Peter French's picture of the corporation as a moral person. He argues that corporations are persons in much the same sense as you and I, and are entitled to the same rights as humans. On this analysis, takeovers are murders, attempted murders, attempts to enslave, etc. I want to explore the consequences of this view for corporate takeovers. I shall argue that, though French can explain why our moral (...) intuitions seem to arise in response to some concern about the corporations themselves, his analysis commits us to the wrong intuitions in some cases. I shall then offer an account of these intuitions which focuses on the character of corporations. (shrink)

About 2 million minor children in the U.S. have at least one parent incarcerated for criminal offenses. There are about 33,000 undocumented persons detained by Immigration and Customs Enforcement in jails and federal detention centers around the country, and 79% of the minor children of these detainees are U.S. citizens. There are few government programs that measure and respond to the harm caused to these children by the incarceration and detention of their parents, and the negative effects on these children (...) are largely ignored in public policy debates about incarceration and immigration detention. I argue that we have an obligation to these children based on the special status of children, the harm caused to children by the arrest, detention and incarceration of their parents, current incarceration and detention policies even in the presence of alternatives that would, on balance, create less harm. There are now over 1.1 million people overseen by Immigration and Customs Enforcement (ICE), with about 33,000 detained in jails and federal detention centers around the country at any particular time. The average detention time is two months, but some are detained for much longer periods. Since its inception, one hundred and twenty one deaths and countless cases of medical neglect have occurred. Given its secrecy, and lack of accountability and oversight, it is not clear how many of these deaths (...) are the result of grossly inadequate medical care. ICE is a branch of a government agency in a democratic country, thus the citizens on whose behalf it allegedly operates have an obligation to ensure that it operates in conformity with the fundamental principles of justice on which this nation was founded. ICE is a young and rapidly growing bureaucracy with little oversight. It operates using a mix of federal, state, local and private centers, many of which are penal institutions. It has a history of serious abuse, and even when it operates in conformity with its penal standards, it inflicts additional harm onto vulnerable people, especially asylum seekers and parents of minor children. It thus requires our constant vigilance and concern. Our immigration policies and detention practices are deeply troubling, but until we elect to reform them, we have a special obligation to the vulnerable populations that we house in ICE detention. Através da análise qualitativa dos planos de ensino de 11 universidades gaúchas, pode-se inferir que a concepção de homem predominante na Psicologia Clínica, como disciplina acadêmica, (...) é a concepção própria da Psicanálise.This article aims to know the concepts of man that can be found in the bibliography used in courses of clinical psychology in universities of Rio Grande do Sul. As a first step, we went through a bibliographical survey about the ways man has been comprehended along history up to Modern Age and the advent of Psychology as science. From the qualitative analysis of the teaching plans of eleven universities of Rio Grande do Sul, it is possible to infer that the psychoanalytical concept of man is the predominant conception found in clinical psychology as an academic discipline. However, I was also curious as to what this author might construe as a “feminist” approach to religious diversity. These days it is fairly common for a book written by a woman to contain the word “feminism” in the title, even though there may be little specifically feminist content in the book. Additionally, I have been [End Page 205] somewhat skeptical that there is a specifically feminist approach to issues of religious diversity. My issue with many other feminist theologians is not especially their lack of a specifically feminist approach to issues of religious diversity but their lack of knowledge about and interest in any religion other than Christianity and its near relatives.What I found is a good addition to the rather considerable library of theologies of religious pluralism written by Christian theologians. And there is a specifically feminist angle to the arguments made in this book, or at least an angle on issues of religious diversity that I have not seen utilized by others, the vast majority of whom are men, who have written such books.The five chapters of this book follow a predictable outline. The first chapter is devoted to framing the contours of the Christian theology, which will be the basis for Fletcher’s entire approach to religious pluralism. An informative chapter on the history of the encounters of some Christians with members of other religions follows this. The third chapter, predictably, reviews and critiques the by now familiar Christian theologies of religious diversity—exclusivist, inclusivist, pluralist, and particularist. These chapters of review and critique are followed by two constructive chapters, one of which offers Fletcher’s specifically feminist suggestions and the other of which discusses how a Christian could honor both specific loyalty to Christianity and the ethical requirements imposed when one recognizes the theological legitimacy of religious diversity.The approach to Christian theology outlined in the first chapter frames Fletcher’s inquiry throughout the entire book. Given that the author is a Christian, it is not surprising that her theology of religious pluralism turns on her understanding of the terms “God” and “Jesus of Nazareth.” According to her, Christian theology revolves around two poles. The first of these is that God is an “incomprehensible mystery” (p. 9), which, for her, opens the possibility that people who are not Christians might have valuable insights into that which Christians call “God.” The other pole of Christian theology is the distinctively “Christian affirmations about what is known of God through Jesus” (p. 16). Balancing the incomprehensibility of God and the specific affirmations about God is the difficult task of someone seeking to construct a Christian theology of religious pluralism. According to Fletcher, a third component is also needed in a theology of religious pluralism. Theologians must also take account of the “complex nexus of personal, social, political, and religious contexts” (p. 21) in which their work occurs.The second chapter of this book contains an interesting account of some historical encounters between Christians and members of other religions. Much of the information contained in this chapter would be unknown to many readers of this book. One of the encounters supplied the title for the author. In 1609, a Hindu debater challenged Roberto de Nobili (1577–1656), a Jesuit missionary to Southern India who lived the lifestyle of a Hindu saṅnyāsi (mendicant). The aim of my article is to relate Roberto Esposito’s reflections on Europe to his more recent proposal of instituent thought. I will try to do so by focusing on three theoretical cornerstones of Esposito’s thought: the first concerns the evidence of a link between Europe, philosophy and politics. The second is deconstructive: it highlights the inadequacy of the answers of the most important contemporary ontological-political paradigms to the European crisis, as well as the impossibility of interpreting this crisis through (...) theoretical-political categories such as sovereignty. The third relates more directly to the proposal of a new political ontology, which Esposito defines as instituent thought. Esposito’s discussion of political theology is the central theoretical nucleus of this study. This discussion will focus, in particular, on the category of negation, from which any political ontology that is based on pure affirmativeness or absolute negation is criticized. In his opinion, philosophical theories developed on the basis of these assumptions have proved to be incomplete or ineffective in relation to the current European and global philosophical and political crisis. Esposito therefore perceives the urgent need to propose a line of thought that is neither negatively destituent, nor affirmatively constituent, but instituent, capable of thinking about order through conflict. Provided that we do not think of the institution statically–in a conservative sense–but dynamically, as constant instituting in which conflict can become an instrument of a politics increasingly inspired by justice. In a series of what Leistner calls iProbes—a portmanteau of iPhone and probe—Leistner reveals the face of war through the extensions of man. As digital photography becomes more ubiquitous, and as the phones we carry with us become more advanced, the process (...) of capturing images becomes more democratic and more spontaneous. Leistner's photos result from both access and impulse. This paper is an attempt to develop a paradigm in problem solving where the notion of virtuality plays a central role. Following a brief discussion on virtual simulation, the paper attempts to identify a notion of virtuality based on the identification of the self (man or computer) with the problem solver. It is shown that such an identification/distinction possibly violates some general principle of the problem environment.To deal with this violation, a new problem is generated and a new virtualization act (...) is required, in order to attain a correspondence between virtuality and reality. A better understanding of this approach requires a combination of analog and digital reasoning: the analog being related to the environment in which the problem solving is required, and the digital to the problem solver's “mental” activities.We will briefly analyze the recursive approach to problem solving and suggest a possible problem solving methodology based on virtuality. The paper concludes with comments on the relation between etnology and virtual reality. (shrink)

Nature doesn’t seem reducible to rigid systems and classifications. Although resorting to metaphors may give rise to contradictions, it allows the elaboration of explanatory models which help us to organize thought and to find orientation in the natural world. Giving form through metaphors stands for seeking the way by which mankind looks for both solutions and new configurations to face nature’s enigmas. The creation of morphological and/or evolutionary metaphors framed in a schematic way what Hugo called “man’s groping in the (...) universe of nature”. Circles, arrows, spirals, scales, etc. stood for research directions: for example, scale became metaphor of an “animal universe” that – as it was thought to be in the Eighteenth Century – organized itself in a bottom-up scale. The circle referred to “metamorphosis” , which reminds us of Goethe’s thinking. Metaphors are never an aim in themselves: they always determine a way of thinking as well as choices and research directions. Such a use of the linguistic image deeply influences the very notion of metaphor as figures of speech . If, on the one hand, metaphor shows unknown structures of nature, on the other it rediscovers its own ‘naturalness’. Starting from the deep interconnection between functional and formal tasks in morphological discussion, metaphor turned from “figure” to “figuration”, Gestaltung , and in doing so it revealed a dynamic structure able to make us understand new links and directions in the sense of a metamorphic nature. Far from limiting itself to a historical retrospection, the methodological significance of having recourse to metaphor profoundly informs the most recent questions in the scientific field and notably in life sciences, in the very moment in which it leads and encourages a renewed dialogue between sciences and philosophy. This paper aims to investigate some important elements of the thought of George Bernard Shaw, more commonly known as one of the most famous playwrights of the twentieth century. Shaw’s philosophy dwells on the relationship between man and nature and especially the concept of freedom. Among all his works, it was decided here to analyse Saint Joan. In re-imagining the historical Joan as a heroine in a play of ideas, Shaw made use of the known facts about Joan of Arc (...) and Joan’s statements at her trial. Nonetheless, he made changes to emphasize her personal dignity and independence by contrast with the tyranny of institutions. Although he departed from the historical background, whitewashed her adversaries, and condensed episodes in Joan’s biography, he sought to be true to her confidence, courage, integrity, and common sense. His theatrical presentation is, in some respects, at odds with the Preface that accompanies the published play. (shrink)

Features of threatening cues and the associated context influence the perceived imminence of threat and the defensive responses evoked. To provide additional knowledge about how the directionality of a threat (i.e. directed-towards or away from the viewer) might impact defensive responses in humans, participants were shown pictures of a man carrying a gun (threat) or nonlethal object (neutral) directed-away from or towards the participant. Cardiac and electrodermal responses were collected. Compared to neutral images, threatening images depicting a gun directed-towards the (...) participant induced sustained bradycardia and an increased electrodermal response, interpreted as immobility under attack. This defensive immobility reaction is evoked by high perceived threat and inescapable situations and indicates intense action preparation. Pictures of guns directed-away from the participant induced shorter bradycardia and no significant modulation of the electrodermal response compared to neutral pictures, which might be consistent with the perception of a less threatening situation. The results show that the directionality of threat stimuli is a key factor that prompts different patterns of defensive responses. (shrink)

MuckMy assignment is to celebrate Rita's editorial work on Buddhist-Christian Studies, the journal of our society. But I want to begin by acknowledging Rita's contributions to the Society for Buddhist-Christian Studies overall. Her contributions to our society have been enormous. She was a founder and visionary at the beginning. She has, I believe, held every office in the (...) society except for treasurer. And her unfailing willingness to work on whatever needed to be worked on has been an inspiration to us all.But now I want to focus on her work on the editing of Buddhist-Christian Studies. I was chosen for this because Rita and I were coeditors of the journal for ten years, from 1995 to 2005.In one sense Rita and I were guinea pigs. For the first fifteen years of the society, David Chappell, the founding editor, edited the journal. When David retired, the board decided that it would be good to have two editors of the journal, one a Buddhist, one a Christian. It was also in keeping with society commitments that one of us was a man and one a woman.The question was whether two very different people could make a coeditorship work. Coeditorships do not always work. There are two issues. The first is choosing people who actually have the skills to do the job. Coeditorships seem like a great idea when decision makers are wrestling with the internal politics of an organization, especially the issues of proper representation among office holders. In order to avoid appearing to favor one or another identity group within an organization, office-holding choices are often made according to representation rather than skill sets.There is a second issue with coeditorships. Even when the chosen pair satisfies both the representational needs of an organization and the skill sets requirements, there is a question as to whether these two particular people can work together well enough to produce a good journal, whether their work styles mesh, whether their personalities have a reasonable chance of relating positively. In case you are thinking to yourselves, this sounds like my marriage, the analogy is apt.So I would like to spend a few moments remembering for you how this worked with Rita and me. My conclusion is that is worked very well, and I have heard Rita say that from her point of view it worked very well. And there are ten volumes of [End Page 85] Buddhist-Christian Studies sitting on many of our shelves, silent testimonies to the fact that this coeditorship worked well enough so that the journal came out, came out on time, and produced essays and reviews that furthered the aims of the Society for Buddhist-Christian Studies.My recollections will be in the form of personal anecdotes and stories, since to my mind that is really what made it the fun, voluntary endeavor that the work of the society has become for many of us. I will talk about Rita, I will talk about the editing process, and I will reflect a bit on the challenges and rewards of coediting.Rita GrossI first saw Rita Gross at one of the early meetings of the forerunner of the society, the Cobb-Abe dialogue group. It was at a press conference called by the organizers of the meeting to get some publicity. Rita was being interviewed along with a male scholar who shall remain nameless. I remember two things about the press conference. One was that Rita was wearing a pair of platform shoes that appeared to me to be tippy, and I remember thinking how hard it must be to balance oneself while wearing those things. The second thing I remember was the dynamics between Rita and the male scholar. The male scholar was coming across toward her as one of the most condescending people I have ever seen, and those of you who know Rita know that she does not take to patronization very well. After the second or third of these snide comments coming Rita's way from this very famous man, she just lit into him... (shrink)

The notion of the “manly Englishman” and the “effeminate Bengali” was a recurring theme in nineteenth-century colonial discourse, and has now become the subject of extensive scholarly discussion in various academic disciplines. Both the colonizer and the colonized produced varied, com plex and ambivalent images of each other and their religious traditions. This paper looks at how the colonized reacted to the colonizers’ versions of Hinduism, focusing particularly on how Swami Vivekananda, a nineteenth century Bengali Hindu saṃnyāsi, responded to colonial (...) and missionary representations of Hinduism as an effeminate religion. In doing so, the paper draws attention to how Vivekananda drew on resources from within and outside the tradition, in order to forge a distinctive style of Hinduism— “a man-making religion”—a robust kind of Vedantic spirituality that combined both physical and spiritual manliness. In _Always More Than One_, the philosopher, visual artist, and dancer Erin Manning explores the concept of the "more than human" in the context of movement, perception, and experience. Working from Whitehead's process philosophy and Simondon's theory of individuation, she extends the concepts of movement and relation developed in her earlier work toward the notion of "choreographic thinking." Here, she uses choreographic thinking to explore a mode of perception prior to the settling of experience into established categories. Manning (...) connects this to the concept of "autistic perception," described by autistics as the awareness of a relational field prior to the so-called neurotypical tendency to "chunk" experience into predetermined subjects and objects. Autistics explain that, rather than immediately distinguishing objects—such as chairs and tables and humans—from one another on entering a given environment, they experience the environment as gradually taking form. Manning maintains that this mode of awareness underlies all perception. What we perceive is never first a subject or an object, but an ecology. From this vantage point, she proposes that we consider an ecological politics where movement and relation take precedence over predefined categories, such as the neurotypical and the neurodiverse, or the human and the nonhuman. The purpose of the following text is to give readers a general introduction to Gordon Pask’s conversation theory, which is considered here to be a cybernetic and epistemological account of concept-forming and concept-sharing through conversational discourse and practice. While Pask devoted three lengthy tomes to articulate the theory and its applications, I believe it is necessary to give readers who are interested in conversation theory a general introduction to what I believe are the key features of his work in this (...) area. I argue that conversation theory should be considered an inferential account of the theory of concepts rather than a representational account, by virtue of Pask’s argument that a concept must be a process that involves many other concepts. This article explores the idea that affect is collective. By emphasizing that affect does not rest in the individual, a theory of affect is foregrounded that is in conversation with Gilbert Simondon’s concept of individuation, and, more specifically, the concept of the preindividual. The preindividual, in Simondon, is aligned with what Gilles Deleuze calls ‘a life’ — the force of living beyond life itself. This force of life, I suggest, is the resonant field of life’s outside, the more-than of human (...) life where the body is but one verging surface on the field of experience, where the body is always more than One. The more-than-Oneness of the body is always already collective, cutting as it does between life-welling and life-living. It is here, at this virtual-actual juncture, that the force of affect resides, activating the body-becoming. (shrink)

In the past decade, several Descartes scholars have gone on record claiming that, for biological purposes, Descartes likely accepts the practical scientific necessity of the existence of “physical natures,” even while his official substance-mode ontology and his characterization of matter in terms of extension do not license the existence of physical natures. In this article, I elaborate on the historical context of Descartes’s biology, the “practical scientific necessity” just mentioned, and argue, contrary to other interpretations, that Descartes does offer a (...) philosophical justification for the existence of physical natures, albeit not by appeal to the categories of substance and mode, or matter as such, but by appeal to our “nature” as a union between mind and body.
