It seems fitting now that this piece is being published after his death, which gives me permission to praise the book without reserve.Over the last few decades, the topic of death and dying has garnered renewed interest among Christian ethicists, and Verhey has been at the center of these conversations. Such conversations have brought into focus the reality that death is not merely the cessation of a life lived well (the “true” subject of ethics) but also that “dying well” is a legitimate subject within ethics. Dying offers unique opportunities for practicing virtues and for loving God, self, and neighbor, and care for the dying and grieving represents an important test of the faithfulness of Christian communities.After beginning with his own assessment of death in the modern West—acknowledging the benefits and triumphs of medicine, along with the pitfalls of medicalized death and the failure of the Church to resist medicalization—Verhey moves to the heart of his book: a retrieval of the Ars Moriendi tradition. Verhey engages a fifteenth-century abridged manual on the art of dying that appeared within the wider genre, one accompanied by wood-block prints (whose images appear alongside Verhey’s text). Placing the little book within its historical context, Verhey describes the view of death presented in it, a “commendacion” of death. He then moves on to the Ars Moriendi’s presentation of temptations faced by the dying person (“Moriens”), the virtues required, and questions, instructions, and prayers for the dying. Along the way, Verhey offers some of his own analysis; but he reserves the bulk of his critique and reformulations for the third section of his book, “Toward a contemporary Ars Moriendi.”Verhey’s articulation of a contemporary Ars Moriendi begins with a “commendacion” of life, in contrast to the medieval commendation of death. He demonstrates how the lens of Jesus’s resurrection serves to illuminate a proper Christian view of death: life is a good—though not the ultimate good—and death and suffering per se ought not to be considered good. At the same time, we need not fear death. Death and suffering are not the greatest evils, and [End Page 191] sometimes they must be risked or accepted “for the sake of God’s cause in the world” (215). Taking its cue from the Ars Moriendi tradition of remembering Jesus, the next chapter traces some of the details of the Passion narratives, including the seven final words of Jesus, and comments on these as they pertain to a modern context of dying. This remembering is then brought to bear on a contemporary retelling of the virtues necessary for dying well—again, relying upon and yet transforming the earlier tradition in nuanced ways. Verhey’s final section, on Christian communities’ care for the dying, includes sustained reflection on the practices of those communities and the resources they offer, focusing particularly on prayer. It offers critiques and additions—for example, recognizing the value of increased silence at funerals, “instead of rushing to fill the silence of death with our words” (348).Verhey’s engagement with the Ars Moriendi literature offers a creative and exemplary use of tradition for a contemporary concern. Our age—one that often refuses to face death—is brought into conversation with another era, when people took their dying seriously. This paper discusses the semantically parenthetical use of clauseembedding verbs such as see, hear, think, believe, discover and know. When embedding verbs are used in this way, the embedded clause carries the main point of the utterance, while the main clause serves some discourse function. Frequently, this function is evidential, with the parenthetical verb carrying information about the source and reliability of the embedded claim, or about the speaker’s emotional orientation to it. In this commentary, I will consider the implications of the argument made by Christopher Stratman in ‘Ectogestation and the Problem of Abortion’. Clearly, the possibility of ectogestation will have some effect on the ethical debate on abortion. However, I have become increasingly sceptical that the possibility of ectogestation will transform the problem of abortion. Here, I outline some of my reasons to justify this scepticism. First, I argue that virtually everything we already know about unintended pregnancies, abortion and adoption does (...) not prima facie support the assumption that a large shift to ectogestation would occur. Moreover, if ectogestation does not lead to significant restrictions to abortion, then there will be no radical transformation of the practice of abortion. Second, abortion is already associated with stigma, and so the presence of ectogestation would need to create additional stigma to modify behaviour. Finally, I argue that ectogestation shifts the debate away from the foetus to the human subject of the artificial womb—the gestateling, therefore creating a new category of killing—gestaticide. The current literature on presupposition focuses almost exclusively on the projection problem: the question of how and why the presuppositions of atomic clauses are projected to complex sentences which embed them. Very little attention has been paid to the question of how and why these presuppositions arise at all. As Kay (1992, p.335) observes, “treatments of the presupposition inheritance problem almost never deal with the reasons that individual words and constructions give rise, in the first place, to the particular presuppositions (...) that they do.”1 This is the question on which this paper will focus. Recall Grice’s well-worn example from Logic and Conversation about Smith, his girlfriend, and his trips to New York: (1) A: Smith doesn’t seem to have a girlfriend these days. B: He has been paying a lot of visits to NY recently. Grice says that in this dialogue, B implicates that Smith has, or may have, a girlfriend in New York. But in saying this, Grice under-describes his own example. For this proposition alone does not suffice to satisfy the requirements of (...) Relation, the maxim presumed to be operative in this case. Grice says that “[B] implicates that which he must be assumed to believe in order to preserve the assumption that he is observing the maxim of Relation.” But the assumption that B thinks that Smith might have a girlfriend in NY is not in itself sufficient to render B’s utterance relevant. An additional assumption is required, one which explicitly links the issue of having girlfriends to the issue of travel to NY: perhaps, the proposition that a person who has a girlfriend somewhere travels there frequently; or that many people have long-distance relationships, and these involve frequent trips to the same place. If A can work out that B is making this supposition, then she can immediately see the relevance of B’s response to her remark. Without it, relevance cannot be established. So this general background assumption must be implicated by the utterance.1 Now, this background assumption is not enough by itself to guarantee relevance. Suppose that B believes the background assumption, but does not believe that Smith might be traveling to NY to visit a girlfriend. Then his utterance is still in violation of Relation. B should invoke the background assumption only if it is relevant itself. (shrink)

Bernard Mandeville argued that traits that have traditionally been seen as detrimental or reprehensible, such as greed, ambition, vanity, and the willingness to deceive, can produce significant social goods. He went so far as to suggest that a society composed of individuals who embody these vices would, under certain constraints, be better off than one composed only of those who embody the virtues of self-restraint. In the twentieth century, Mandeville’s insights were taken up in economics by John Maynard Keynes, among (...) others. More recently, philosophers have drawn analogies to Mandeville’s ideas in the domains of epistemology and morality, arguing that traits that are typically understood as epistemic or moral vices (e.g. closed-mindedness, vindictiveness) can lead to beneficial outcomes for the groups in which individuals cooperate, deliberate, and decide, for instance by propitiously dividing the cognitive labor involved in critical inquiry and introducing transient diversity. We argue that mandevillian virtues have a negative counterpart, mandevillian vices, which are traits that are beneficial to or admirable in their individual possessor, but are or can be systematically detrimental to the group to which that individual belongs. Whilst virtue ethics and epistemology prescribe character traits that are good for every moral and epistemic agent, and ideally across all situations, mandevillian virtues show that group dynamics can complicate this picture. In this paper, we provide a unifying explanation of the main mechanism responsible for mandevillian traits in general and motivate the case for the opposite of mandevillian virtues, namely mandevillian vices. Virtue accounts of innovation ethics have recognized the virtue of creativity as an admirable trait in innovators. However, such accounts have not paid sufficient attention to the way creativity functions as a collective phenomenon. We propose a collective virtue account to supplement existing virtue accounts. We base our account on Kieran’s definition of creativity as a virtue and distinguish three components in it: creative output, mastery and intrinsic motivation. We argue that all of these components can meaningfully be attributed to (...) innovation groups. This means that we can also attribute the virtue of creativity to group agents involved in innovation. Recognizing creativity as a collective virtue in innovation is important because it allows for a more accurate evaluation of how successful innovation generally happens. The innovator who takes a collective virtue account of creativity seriously will give attention to the facilitation of an environment where the group can flourish collectively, rather than only nurturing the individual genius. In this paper, the meanings of sentences containing the word or and a modal verb are used to arrive at a novel account of the meaning of or coordinations. It is proposed that or coordinations denote sets whose members are the denotations of the disjuncts; and that the truth conditions of sentences containing or coordinations require the existence of some set made available by the semantic environment which can be ‘divided up’ in accordance with the disjuncts. The relevant notion of (...) ‘dividing things up’ is made explicit in the paper. Detailed attention is given to the question of how the proposed truth conditions are derived from the syntactic input. The account offered allows for the derivation of both the disjunctive and the nondisjunctive readings of modal/or sentences, including the much-discussed free choice readings of may/or sentences. The empirical phenomenon at the center of this paper is projection, which we define (uncontroversially) as follows: (1) Definition of projection An implication projects if and only if it survives as an utterance implication when the expression that triggers the implication occurs under the syntactic scope of an entailment-cancelling operator. Projection is observed, for example, with utterances containing aspectual verbs like stop, as shown in (2) and (3) with examples from English and Paraguayan Guaraní (Paraguay, Tupí-Guaraní).1 The Guaraní example in (...) (2) and its English translation have at least the following implications: (i) Carla has previously smoked, and (ii) Carla stopped smoking. The first but not the second of these implications is also conveyed by the question version of sentence (2), as in (3a), or when (2) is embedded under entailment-cancelling sentential operators, such as negation, as in (3b), the antecedent of a conditional, as in (3c), or an epistemic modal, as in (3d). Racism is a key driver of the social, political, and economic injustices that cause and maintain health inequities. Over centuries and across continents, racism has become deeply ingrained within societies. Therefore, we believe that it is our professional and ethical obligation as scientists, and public health scholars specifically, to address racism head on in order to ameliorate racialized health disparities. We argue that greater focus is needed on addressing racism rather than race and how race is described or defined. We (...) offer input from public health scholarship to help bioethicists and other scientists contribute to addressing racism. To do so effectively and comprehensively, public health scholars, bioethicists, and other scientists should work together to identify and implement equity-driven collaborations to eliminate the deleterious effects of racism on individuals, families, and communities. The basic linguistic phenomenon of presupposition is commonplace and intuitive, little different from the relation described by the word presuppose in its everyday usage. In ordinary language, when we say that someone presupposes something, we mean that they assume it, or take it for granted. The term is used in the same way when we talk of a speaker presupposing something, although typically we are interested in those assumptions which are revealed by what the speaker says. To begin with the (...) most venerable case of presupposing, first discussed by Frege 1892, when a speaker makes an assertion, “there is always an obvious presupposition that the simple or compound proper names used have reference.” So a speaker who says. Energy justice literature generally treats its three tenets, distributional justice, procedural justice and recognition justice, as separate and independent issues. These are seen as separate dimensions by which criteria can be formulated for a just state of affairs. And a just state of affairs regarding energy should fulfill all criteria. However, we show, using empirical research on six European energy communities that the tenets of energy justice are interdependent and negotiated in practice. We show this interdependency using three core concerns (...) of justice—risk, effort and power—which we identified through our empirical work. Our findings reveal that community members are often willing to take risks and put in effort, if they are compensated with more power within the community. Similarly, members are willing to compromise power if no effort or risk-taking is required from them. This demonstrates the interdependency of the tenets “procedural justice” and “distributional justice” within energy communities. We reflect on the need for energy justice theory and policymakers to recognize the significance of this interdependency. (shrink)

In this paper, I review a number of arguments in favor of treating many of the central cases of presupposition as the result of conversational inference, rather than as lexically specified properties of particular expressions. I then argue that, despite the standard assumption to the contrary, the view of presupposition as constraints on the common ground is not consistent with the provision of a conversational account of particular presuppositional constraints. The argument revolves crucially around the workings of accommodation. I then (...) offer an alternative view of the phenomenon of presupposition, which is compatible with a variety of sources for presuppositions. On the view offered here, presupposition is seen as a property of utterances. I argue that the presuppositions of an utterance are those propositions which an interpreter must take the speaker to accept in order to take the speaker to be fully cooperative, in the Gricean sense. Grice observes that the primary discourse function of disjunction is the presentation of alternatives, each of which is relevant in the same way to a given topic. After a brief introduction , I offer in Chapter Two an account of Grice's observation and of further felicity conditions on disjunction, for example, the constraint against disjunctions in which one disjunct entails another. Using an enriched version of the Stalnakerian model of assertion, I define two constraints on information update--Relevant Informativity and Simplicity--and (...) show that these suffice to account for the observations. ;I then argue that the requirement to abide by Relevant Informativity and Simplicity provides a basis for an account of two further properties of disjunctive sentences: their presupposition projection properties and the possibility of anaphora between disjuncts. I argue that presuppositions project in disjunction except where projection would lead to infelicity of the kind characterized in Chapter Two. To state this account, a treatment of presupposition which allows projection to be sensitive to considerations of felicity is required. I show that the Stalnakerian view of presupposition, combined with Heim's notion of local accommodation, provides the necessary framework. ;Similarly, I argue that anaphora across disjunction is disallowed only when it leads to an infelicitous disjunction. In certain configurations, anaphora between disjuncts leads to entailment between disjuncts, which is ruled out independently. The account is given using a version of Neale's E-type analysis of unbound anaphora. I show that the analysis has further desirable consequences with respect to more complex examples of inter-disjunct anaphora. ;Throughout Chapters Three and Four, I contrast my own proposals with accounts given in the Dynamic Semantic literature, offering a critique of Dynamic Semantic approaches to the phenomena discussed. ;In Chapter Five, I examine anaphora between NPs contained inside a disjunction and a pronoun in a following sentence. I argue that these pronouns are also E-type, but show that these cases require a reformulation of the E-type analysis. I develop a new account in which the interpretation of E-type pronouns is derived compositionally from the content of the antecedent clause. (shrink)

Over the past four decades, software engineering has emerged as a discipline in its own right, though it has roots both in computer science and in classical engineering. Its philosophical foundations and premises are not yet well understood. In recent times, members of the software engineering community have started to search for such foundations. In particular, the philosophies of Kuhn and Popper have been used by philosophically-minded software engineers in search of a deeper understanding of their discipline. It seems, however, (...) that professional philosophers of science are not yet aware of this new discourse within the field of software engineering. Therefore, this article aims to reflect critically upon recent software engineers’ attempts towards a philosophy of software engineering and to introduce our own philosophical thoughts in this context. Since linguists began extensive work on presupposition in the 1970's, a long and heterogeneous list has been compiled of expressions, expression types and constructions that give rise to presuppositions. In the current literature, the principal (but by no means sole) diagnostic for presupposition typically appealed to is the tendency of the particular element of meaning to project, i.e. to escape the scope of operators such as negation, the question operator, or modals. An important intuition also routinely appealed to is that (...) the element of meaning is in some sense backgrounded, or treated by the speaker as taken for granted. There seems little doubt that there are interesting and theoretically relevant distinctions to be made between different types of presuppositions within this heterogeneous set. But the study of these distinctions is of interest primarily in light of the intuition that the members of this set share some common feature: that there is some singular phenomenon of presupposition to be described and explained. This paper is concerned with what presuppositions have in common, and offers an alternative to the current standard view. On the view currently prevalent in the linguistic literature, presuppositions constitute constraints on the common ground, or on an interlocutor’s “take” on the common ground, at the point at which 1 the presupposing utterance is interpreted. I do not intend to offer here a detailed critique of this standard theory, but perhaps a few words of justification are in order. The motivation for seeking a new account comes in part from the same considerations cited by Abbott 2000, in her critique of the standard view. Abbott’s central point is that the driving idea behind the common ground view is that presuppositions are identified with “old” information, or information that the speaker is treating as “old.” This idea, while perhaps helpful as an initial approximation, rapidly runs up against the observation that it is normal and commonplace for.... This article develops and applies a knowledge-based framework for understanding and interpreting executive compensation under the rubric of ethical consideration. This framework classifies six major ethical considerations that reflect issues in compensation design. We emphasize that these six ethical considerations are influenced by liberty and equality concepts. This framework helps to highlight areas where executive compensation has not been well spelled out.

All kinds of fraud are costly for the people engrossed both financially and often in terms of the time needed to clear their name when illegal use has been made of their personal details. The relationship among ethics, internal control, and fraud is important in the understanding of corporate social responsibility. This article uses an Ethical Process Throughput Model embedded in the Fraud triangle in order to better understand the interconnectedness of ethical positions and internal control systems that handle fraudulent (...) situations. Ethical positions are utilized to underscore how ethical behavioral control systems can be appropriately applied, which can provide unparalleled security, enhanced convenience, heightened accountability, better fraud detection and is very effective in depressing fraud, thereby improving CSR among organizations. We often praise and blame groups of people like companies or governments, just like we praise and blame individual persons. This makes sense. Because some of the most important problems in our society, like climate change or mass surveillance, are not caused by individual people, but by groups. Philosophers have argued that there exists such a thing as group responsibility, which does not boil down to individual responsibility. This type of responsibility can only exist in groups that are organized with (...) joint knowledge, actions and intentions. However, often disorganized groups without joint knowledge, actions and intentions are precisely the kinds of groups that cause problems. Therefore, in such cases, it becomes difficult, according to traditional accounts of collective responsibility to attribute responsibility to such groups. This has problematic implications. Therefore, I propose a new way of seeing collective responsibility, which is able to attribute the vice of irresponsibility to such disorganized groups. This involves seeing responsibility not as a relationship between the group and some action, but rather, as a virtue. In cases where it is difficult to establish whether a group is responsible for something, we should ask ‘is this group responsible, or irresponsible?’ This line of questioning is likely to be a more productive and philosophically legitimate way of holding groups morally responsible in such cases. This paper offers a critical analysis of Stalnaker''s work on presupposition (Stalnaker1973, 1974, 1979, 1999, 2002). The paper examines two definitions of speaker presupposition offered by Stalnaker – the familiar common ground view, and the earlier,less familiar, dispositional account – and how Stalnaker relates this notion to the linguistic phenomenon of presupposition. Special attention is paid to Stalnaker's view of accommodation. I argue that given Stalnaker's views, accommodation is not rightly seen as driven by the presuppositional requirements of utterances, but (...) only by the interests of speakers in eliminating perceived differences among presuppositions. I also consider the revisions which are needed either to the definition of speaker presupposition or to the definition of sentence presupposition in light of the possibility of informative presupposition. There is a long-standing and rarely contested view that Gricean conversational reasoning—the kind of reasoning that supports the identification of conversational implicatures—cannot produce pragmatically generated modification of the contents of embedded clauses. The goal of this paper is to argue against this view: to argue that embedded pragmatic effects can be seen as continuous with ordinary, utterance-level, conversational implicature. I will further suggest, though, that embedded pragmatic effects do force on us a particular conception of semantics. This descriptive scientific-phenomenological study set forth to discover what is like to survive a building collapse as a firefighter. The participants of the study were 3 uniformed and sworn professional firefighters performing interior operations at a commercial building structure fire. The 3 participants all become trapped and had to self-rescue as a result of a structural collapse. The data collected from the participant interviews was analyzed and transformed so as to form the structure of the study.

Stefan Collini's Absent Minds is a rich, critical history of a cliché: that English culture is peculiarly hostile to intellectuals. Despite striking differences in the organization of intellectual life in the U.S. and Britain, precisely the same cliché pervades American writing. The explanation may lie less in structure than in the transnational mobility of the language of the intellectual.

This report concerns the fragmented visual percepts in a woman, TR, following a right entorhinal–perirhinal infarct. In a previous report, Weddell [Weddell, R. A. . A visual disorder producing highly selective deletion of recurring letters. Cortex, 41, 471–485] linked TR’s highly selective tendency to delete recurrent letters with her fragmented percepts. The conflation of same-identity form elements was attributed to anterior extrastriate damage, which reduced the amount of information sustainable in fully resolved visual percepts, and the present experimental investigation of (...) her subjective account of segment formation and resolution completes the story. She said that complex objects and long words first appeared as blurred regions, which sometimes included form elements. It is argued that figure-centred attentional mechanisms subdivided this blurred region into up to 3–4 parts. String length, lexical status , and background colour and/or luminance determined fragment length. Two rules described the fragment resolution sequence: largest segments usually resolved first, left-to-right resolution accounting for a few sequences. This resolution sequence occurred when stimuli were exposed too briefly for saccadic exploration, implicating endogenous attentional shifts. Experiment 4 confirmed TR’s assertion that spatial, orthographic, and phonological information were stored during the fragment resolution process. Moreover, TR exerted considerable voluntarily control over the fragment resolution sequence and some influence over fragment length. Finally, these findings were interpreted in terms of an extended version of a neural network model of vision largely derived from nonhuman primate studies. (shrink)

This article reviews in detail Grice’s conception of conversational implicature, then surveys the major literature on scalar implicature from early work to the present. Embedded implicature is illustrated, and it is explained why this phenomenon poses a challenge to the Gricean view. Some alternate views of conversational implicature are then presented. The article concludes with a brief look at formal appraches to the study of implicature.

EVENTAL AESTHETICS RETROSPECTIVE 1. LOOKING BACK AT 10 ISSUES OF EVENTAL AESTHETICS.

The pragmatic framework developed by H.P. Grice in “Logic and Conversation” explains how a speaker can mean something more than, or different from, the conventional meaning of the sentence she utters. But it has been argued that the framework cannot give a similar explanation for cases where these pragmatic effects impact the understood content of an embedded clause, such as the antecedent of a conditional, a clausal disjunct, or the clausal complement of a verb. In this paper, I show that (...) such an explanation is available. One of the central arguments of the paper is that in a significant subset of cases, local pragmatic effects are a consequence of a global pragmatic requirement. In these cases, local pragmatic effects are a consequence of ‘acting locally’ to resolve a potential global pragmatic violation. These cases do not require us to posit application of pragmatic principles to the contents of embedded clauses. The account does, though, require the assumption that interpreters can identify and reason about the contents of unasserted sub-parts of sentences, an assumption that I motivate in section 3. Building on this, in section 4 of the paper, I argue that once we have recognized that interpreters can, and do, reason independently about the contents of non-asserted clauses, it becomes unproblematic to assume that in some cases, Gricean conversational principles do apply directly to these contents, providing an alternative route to account for local pragmatic effects. In revisiting the ideas of this paper in my response to the commentaries, I consider in more detail the revisions to Grice’s broader program that are necessitated by these moves, in particular acknowledging the problematicity of Grice’s notion of what is said. In this paper I apply an old problem of Quine's (the inscrutability of reference in translation) to a new style of theory about mental content (causal/nomological/informational accounts of meaning) and conclude that no "naturalization" of content of the sort currently popular can solve Quine's "gavagai" enigma. I show how failure to solve the problem leads to absurd conclusions not about one's own mental life, but about the non-mental world. I discuss various ways of attempting to remedy the accounts so as (...) to avoid the problem and explain why each attempt at solving the problem would take the information theorists further from their self-assigned task of "naturalizing" semantics. We define a notion of projective meaning which encompasses both classical presuppositions and phenomena which are usually regarded as non-presuppositional but which also display projection behavior—Horn’s assertorically inert entailments, conventional implicatures (both Grice’s and Potts’) and some conversational implicatures. We argue that the central feature of all projective meanings is that they are not-at-issue, defined as a relation to the question under discussion. Other properties differentiate various sub-classes of projective meanings, one of them the class of presuppositions according to Stalnaker. (...) This principled taxonomy predicts differences in behavior unexpected on other models among the various conventional triggers and conversational implicatures, while holding promise for a general, explanatory account of projection which applies to all the types of meanings considered. In this paper, we develop the notion of a natural convention, and illustrate its usefulness in a detailed examination of indirect requests in English. Our treatment of convention is grounded in Lewis’s seminal account; we do not here redefine convention, but rather explore the space of possibilities within Lewis’s definition, highlighting certain types of variation that Lewis de-emphasized. Applied to the case of indirect requests, which we view through a Searlean lens, the notion of natural convention allows us to give (...) a nuanced answer to the question: Are indirect requests conventional? In conclusion, we reflect on the consequences of our view for the understanding of the semantics/pragmatics divide. (shrink)

The arts and nursing are profoundly connected. While the relationship between nursing and art has persisted over time, the majority of nursing scholarship on the arts has historically centered upon the art of nursing practice and the cultivation and application of aesthetic knowing. However, there is a burgeoning use of arts‐based strategies is nursing education, research, and practice. Correspondingly, there is a need to understand how such approaches can uniquely contribute knowledge to the nursing discipline in order to support arts‐integration (...) for nursing scholars. We structure our inquiry into arts’ contributions according to two dominant methods of engaging with arts‐based strategies: knowing about (e.g., phenomena) vis‐à‐vis art‐viewing, and knowing through (e.g., embodied knowing) vis‐à‐vis art‐making. In doing so, we explore critical contributions of art to nursing research and educational practices, including arts’ capacity to augment traditional research and communication approaches, democratize the research space, challenge issues of representation, and facilitate education, dissemination, and reflexivity. Jennifer Bird-Pollan has recently argued that Nozickians are wrong to oppose the estate tax. Promising to argue from within the Nozickian framework, she presses the fundamental point that the estate tax does not violate anyone’s rights: neither the deceased nor their would-be heirs can claim a right to any holdings subject to the estate tax. This paper shows that Bird-Pollan’s discussion fails on three fronts. First, she frequently misinterprets Nozick, and thus does not defend the estate tax from a Nozickian (...) perspective. Second, even if Bird-Pollan is correct in denying that the deceased and their potential heirs have a right to the holdings in question, it does not follow that the estate tax is licit, because Nozickians can oppose it on other grounds. For example, Nozickians may hold that the enforcement of the estate tax will violate other rights people have. The government’s preemptive claims to holdings subject to estate taxes, along with the force required to enforce those claims, are unjustified. The crucial premise motivating these conclusions is the Nozickian denial that our current state possesses the authority to enforce the estate tax. This is the third front on which Bird-Pollan’s argument fails: she must show that Nozickians ought to believe government has the moral authority to enforce the estate tax, yet she makes no effort to do so.
