This article tries to study the evolution of the place and significance of the term “fiction” in Bentham’s critical strategy against English law. If, in an initial phase, Bentham uses fictions to bring to light mystification operating in English law, he then attacks the theories that sought to justify and ground political society and law. Bentham proposes a foundation justified with the help of the principle of utility, which he presents as a “fundamental axiom” that needs no proof. Paradoxically, his (...) argumentation, taken as a whole, becomes intrinsically problematical on recognizing the inevitable linguistic necessity of fictions and the fictitious character of utility: every legal discourse will, in consequence, invoke the fictions that it previously criticised. He must therefore refine his theory of fictions and construct its positivity with the aim of drawing up a legal discourse that satisfies the demands of his theory of law. (shrink)

What is the secret of good government? Both Mill in his Representative Government, and Bentham, in his Constitutional Code, believe that neither individual qualities or institutions are sufficient on their own and both are interested in institutional devices such as voting systems, civic education or public administrations that can shape and foster a new democratic citizenry. The paper will compare their two different approaches to the way individual aptitudes can be harnessed to democratic policies and processes.

Le nouvel et dernier ouvrage de Jean-Pierre Cléro consacre à la philosophie de Jeremy Bentham est intéressant à plus d’un titre. Tout d’abord, il unifie et bénéficie de l’ensemble des textes et réflexions que Jean-Pierre Cléro a pu élaborer depuis de nombreuses années sur les différents aspects de la philosophie benthamienne. Ensuite, il débute habilement par une relecture particulièrement vive et intéressante de la vie de Bentham. Loin de se contenter de la classique biographie, Jean-Pierre Cléro propose une relecture des (...) différents évènements qui, selon lui, ont structuré la vie de Bentham tout en délivrant des clés qui permettront de mieux comprendre l’évolution de sa pensée. Sans sombrer dans la facilité d’une « psychologisation biographique », il s’agit bien plutôt de comprendre l’auteur à travers des éléments marquants de sa vie. Les travaux récents ont permis de rendre justice à la théorie du langage qu’a élaborée Bentham et d’expliquer les enjeux théoriques de son attachement aux mots. C’est désormais chose faite grâce au travail de Malik Bozzo-Rey, Jean-Pierre Cléro et Claire Wrobel. _Le langage de la morale_ est la traduction d’un livre écrit en 1952 sous le titre _The Language of Morals_ ; sous ce titre en anglais, il précède d’une trentaine d’années _Moral Thinking_ (1981), tandis que sous le titre français et traduit par Jean-Baptiste Le Bohec et Frédéric Naudin, il suit de deux ans _Penser en morale_, traduit récemment pour les éditions Hermann (en 2021) par Claire Wrobel, Malik Bozzo-Rey et moi-même (qui l’ai aussi préfacé). Ma première rencontre avec David Lieberman date de 2014. A l’initiative de mon co-directeur de thèse Malik Bozzo-Rey, David Lieberman avait été invité à participer à mon comité de suivi de thèse. Il avait lu les quelques pages présentant les avancées de mes recherches et sa participation à ce comité comme ses commentaires avaient été très soutenant et généreux. La suite de ma recherche doctorale a largement été nourrie par ses travaux et n’ont pas cessé de l’être depuis. La (...) grande force et l'originalité de David a été l'inflexion qu'il a porté à la division entre ce qui relève de la philosophie politique et de la philosophie du droit chez Bentham. Il développe une interprétation ‘politique’ de la philosophie de Bentham en se concentrant sur l’idéal de codification et il voit dans ce thème et cet objet ce qui orchestre la continuité des écrits de Bentham des années 1780 à ceux de 1832. Bas C. van Fraassen, in his Terry Lectures at Yale University, is concerned to elucidate what empiricism is, and could be, given past and current failures of characterization. He contends that naïve empiricism—the metaphilosophical position that characterizes empiricism in terms of a thesis—is self-refuting, and he offers a reductio ad absurdum to substantiate this claim. Moreover, in place of naïve empiricism, van Fraassen endorses stance empiricism: the metaphilosophical position that characterizes empiricism in terms of certain attitudes and commitments. This study attempts an exposition of different perceptions of obligation to medical treatment that have emerged from the Islamic theological understanding and how they contribute to diversity of options and flexibility in clinical practice. Particularly, an attempt is made to formulate an Islamic perspective on ordinary and extraordinary means of medical treatment. This distinction is of practical significance in clinical practice, and its right understanding is also important to public funded healthcare authorities, guardians of the patients, health and life insurance (...) institutions, and employers who provide health care coverage to their employees. Not only these parties, but also lawyers and justice administration functionaries such as public prosecutors and judges are in need of understanding this distinction to deal with relevant litigations. The distinction could be made regarding terminally ill patients and non-terminally ill patients separately. The essential factors that matter in making the distinction between ordinary and extraordinary means of treatment are: (1) patient capacity (2) expert advice, and (3) nature of medication. Regarding terminally ill patients, medical treatment can become extraordinary because of (1) patient capacity and (2) nature of medication. In both these case the deciding condition applies: the expert advice taken from a group of physicians. In regards to non- terminally ill patients, extraordinary medical treatment includes three cases: (1) treatment that is known to be useless and futile, (2) treatment that endangers the life or cause more harm than what it removes, and (3) useful treatment, but the patient is unable to bear the cost. Patient autonomy has a critical role in making decisions in medical practice and it is accepted by international conventions on health care and various national medical codes. However, pertaining to terminally ill patients, this right becomes very problematic in regards to end of life decisions. Utilitarian ethicists motivated by materialistic worldview and individualism have made patient autonomy based arguments for the permissibility of active euthanasia. An appraisal of pro-euthanasia arguments that include the best interest, golden rule, and autonomy is made (...) in this paper. The best interest and golden rule arguments are based on subjective moral judgment thus failing the universalization test. The argument from autonomy is unconvincing because of the confounded autonomy of the terminally ill patients. (shrink)

Fodor and LePore's attack on conceptual role semantics relies on Quine's attack on the traditional analytic/synthetic and a priori/a posteriori distinctions, which in turn consists of four arguments: an attack on truth by convention; an appeal to revisability; a claim of confirmation holism; and a charge of explanatory vacuity. Once the different merits of these arguments are sorted out, their proper target can be seen to be not the Traditional Distinctions, but an implicit assumption about their superficial availability that we (...) have abundant reason to reject. Once we reject it, we can see how issues of the absorbtion of conventions, the revisability of belief, and confirmation holism are compatible with the Traditional Distinctions, and that Quine's discussion only serves to camouflage the question of whether some confirmation relations are constitutive of meaning and knowable a priori. El presente estudio aborda el nacimiento como problema filosófico desde una perspectiva intersubjetiva y corporeizada derivada del análisis del Cuerpo y el Otro presente en la Fenomenología de la Percepción de Merleau-Ponty. A partir de lo anterior, se discuten las limitaciones que tendría la coexistencia (Mitdasein) de Heidegger y la Otredad de Lévinas enmarcada en la relación del rostro en su intento de aproximarse a una filosofía del nacimiento desde una perspectiva de mundo compartido (madre-padre-hijo). At its proper and most radical, humanistic inquiry is about problems that do not have ready solutions. If this fundamental feature had been accepted, debates about the humanities in recent years might have taken a different kind of turn, whereby, instead of appending new and ever more purposeful modifiers to the word humanities--the digital, the environmental, the neuro, the medical, the public--the ways in which humanistic modes of intellectual labor operate could have assumed a more central focus. This would not (...) have to mean adopting a conservative or conservatively disciplinary stance toward the humanities. Rather, it would demonstrate the ways in which humanistic inquiry approaches intellectual problems conceptually, methodologically, and practically, without necessarily seeking to legitimize the relevance of its undertakings by way of social utility and consensus.This possibility of reimagining humanistic study is the basic assumption and orientation of this book. Many books make use of Foucault's theories, but few use his work to reflect on the conundrums, dead ends, and potentialities of humanistic inquiry in the current Western academy. Resumen Este artículo analiza la construcción de la infancia en las novelas El mercurio (1968), El río de la luna (1981) y Esta pared de hielo (2005), de José María Guelbenzu, a la luz de los conceptos mítico-simbólicos de Bachelard y Durand para demostrar que funciona como un absoluto primigenio al que se busca volver constantemente, pues resguarda a los personajes hasta el inminente choque con la realidad adulta. Esto para concluir que desde la adultez los personajes observan la infancia (...) con el anhelo de volver allí, lo que tiene una función paliativa mediante la memoria y la palabra, por ello, la narrativa de Guelbenzu plantea regresar al ámbito infantil desde las imágenes literarias y así conservar ese mundo de fantasía. Abstract This article analyzes the construction of childhood in the novels El mercurio (1968), El río de la luna (1981) and Esta pared de hielo (2005), by José María Guelbenzu, in the light of the mythical-symbolic concepts of Bachelard and Durand to demonstrate that it functions as a primitive absolute to which it is sought to return constantly, since it protects the characters until the imminent clash with adult reality. This to conclude that in their adulthood the characters observe childhood with the desire to return there, this has a palliative function through memory and word, therefore, Guelbenzu’s narrative proposes the return to the child environment trough literary images to preserve that world of fantasy. Miller has recently argued that the standard liberal and moderate positions on abortion are incapable of grounding the claim that ‘all non-disabled adult humans are equal’. The reason, he claims, is such accounts base the intrinsic moral worth of a human being on some property (or set of properties) which comes in degrees. The main claim of this paper is the following: In a typical rational legal system, legal adjudication is necessarily discretional. Discretion is the result of what I call ‘systemic indeterminacy’. Systemic indeterminacy is the thesis that claims that typical rational legal systems that have an interpretative code with more than one interpretative directive and the non-redundancy clause are necessarily indeterminate. Since typical rational legal systems do not have redundant rules a plurality of interpretative directives will necessarily yield a plurality of (...) interpretative results. Due to the non-liquet rule judges are obligated to choose among the different interpretative results provided by the interpretative code. In other words, by building a thesis on legal indeterminacy as the consequence of having a plurality of interpretative directives that necessarily yield different results, I proceed to provide an account of discretion as a necessary feature of legal adjudication.
