The facticity of sexuality is a key driver of the asylum procedure in “LGBT” cases, where non-heterosexual identities can be grounds for gaining” refugee status.” The procedure becomes a test of sexual veracity by means of a truthful performance. This performance is primarily discursive, but it is also bodily in terms of the way bodily comportment is considered indicative of a “true story.” Underlying this process is a conception of sexuality as a fixed, invisible but ever present identity. Sexuality, we (...) argue, gets configured in ways akin to what is commonly called an “infrastructure.” The veracity and facticity of accounts of, and for, this ‘infrastructure of selfhood’ can only be ascertained in live encounters during the asylum procedure. This article ethnographically highlights how such a particular facticity is composed in the Dutch asylum procedures. Building on Judith Butler’s work on narrative accounts of the self, we show how the state intervenes in crucial ways in asserting the authority to assign truth to such a narrative account. (shrink)

This chapter discusses the main types of so-called ’subjective measures of consciousness’ used in current-day science of consciousness. After explaining the key worry about such measures, namely the problem of an ever-present response bias, I discuss the question of whether subjective measures of consciousness are introspective. I show that there is no clear answer to this question, as proponents of subjective measures do not employ a worked-out notion of subjective access. Individuals unvaccinated against COVID-19 (C19) experienced prejudice and blame for the pandemic. Because people vastly overestimate C19 risks, we examined whether these negative judgements could be partially understood as a form of scapegoating (ie, blaming a group unfairly for an undesirable outcome) and whether political ideology (previously shown to shape risk perceptions in the USA) moderates scapegoating of the unvaccinated. We grounded our analyses in scapegoating literature and risk perception during C19. We obtained support for our speculations through two vignette-based (...) studies conducted in the USA in early 2022. We varied the risk profiles (age, prior infection, comorbidities) and vaccination statuses of vignette characters (eg, vaccinated, vaccinated without recent boosters, unvaccinated, unvaccinated-recovered), while keeping all other information constant. We observed that people hold the unvaccinated (vs vaccinated) more responsible for negative pandemic outcomes and that political ideology moderated these effects: liberals (vs conservatives) were more likely to scapegoat the unvaccinated (vs vaccinated), even when presented with information challenging the culpability of the unvaccinated known at the time of data collection (eg, natural immunity, availability of vaccines, time since last vaccination). These findings support a scapegoating explanation for a specific group-based prejudice that emerged during the C19 pandemic. We encourage medical ethicists to examine the negative consequences of significant C19 risk overestimation among the public. The public needs accurate information about health issues. That may involve combating misinformation that overestimates and underestimates disease risk with similar vigilance to error. (shrink)

Nobody's Law shows how people - who are disappointed, disenchanted, and outraged about the justice system - gradually move away from law. Using detailed case studies and combining different theoretical perspectives, this book explores the legal consciousness of ordinary people, businessmen, and street-level bureaucrats in the Netherlands. The empirical research in this study tells an original and alternative narrative about the role of law in everyday life. While previous studies emphasize the law's hegemony and argue that it's 'all over', Hertogh (...) shows that legal proliferation makes it harder for people to know, and subsequently identify with, the law. As a result, official law has become increasingly remote and irrelevant to many people. The central finding presented in this highly topical text is that these developments signal a process of 'legal alienation'- a gradual and mundane process with potentially serious consequences for the legitimacy of law. This article reviews the Dutch societal debate on euthanasia/assisted suicide in dementia cases, specifically Alzheimer's disease. It discusses the ethical and practical dilemmas created by euthanasia requests in advance directives and the related inconsistencies in the Dutch legal regulations regarding euthanasia/assisted suicide. After an initial focus on euthanasia in advanced dementia, the actual debate concentrates on making euthanasia/assisted suicide possible in the very early stages of dementia. A review of the few known cases of assisted suicide of people with so-called (...) early dementia raises the question why requests for euthanasia/assisted suicide from patients in the early stage of Alzheimer's disease are virtually non-existent. In response to this question two explanations are offered. It is concluded that, in addition to a moral discussion on the limits of anticipatory choices, there is an urgent need to develop research into the patient's perspective with regard to medical treatment and care-giving in dementia, including end-of-life care. Recent evaluation of the practice of euthanasia and related medical decisions at the end of life in the Netherlands has shown a slight decrease in the frequency of physician-assisted death since the enactment of the Euthanasia Law in 2002. This paper focuses on the absence of euthanasia cases concerning patients with dementia and a written advance euthanasia directive, despite the fact that the only real innovation of the Euthanasia Law consisted precisely in allowing physicians to act upon such directives. The (...) author discusses two principal reasons for this absence. One relates to the uncertainty about whether patients with advanced dementia truly experience the suffering they formerly feared. There is reason to assume that they don’t, as a consequence of psychological adaptation and progressive unawareness (anosognosia). The second, more fundamental reason touches upon the ethical relevance of shared understanding and reciprocity. The author argues that, next to autonomy and mercifulness, “reciprocity” is a condition sine qua non for euthanasia. The absence thereof in advanced dementia renders euthanasia morally inconceivable, even if there are signs of suffering and notwithstanding the presence of an advance euthanasia directive. This does not mean, however, that advance euthanasia directives of patients with dementia are worthless. They might very well have a role in the earlier stages of certain subtypes of the disease. To illustrate this point the author presents a case in which the advance directive helped to create a window of opportunity for reciprocity and shared decision-making. (shrink)

In the psychological literature, love is often seen as a construct inseparable from that of close, interpersonal relationships. As a result, it has been often assumed that the same motivational factors underlie both phenomena. This often leads researchers to propose that love does not exist in itself—that it is an emotion which stems solely from a need for attachment, fulfillment of reproductive aims, or for social exchange. The popular cultural imagination, however, perceives love as a unique, mysterious, altruistic, ever-lasting bond (...) between two people—a vision of love which is at odds with its supposed psychological origins. We propose that an ideal of love and its enactment in our culture is a result of two intertwining factors. Within the last few centuries, interpersonal relationships and love have replaced religion as islands of existential comfort. Toward this end, lovers project illusory meaning on their partners. The laborious and turbulent process of withdrawing these projections can lead to what many thinkers think “love” is: bestowal of value on another, and consequent respect for, and care for that person, unmotivated by one's own needs, within the context of a real relationship. This book examines the tension inherent in the waging of ethical war, and argues that war and its relationship to ethics need to be rethought fundamentally.

McCullough et al 1 confront a challenge that no organisation has fully eradicated: incivility. They emphasise that civility is not merely a matter of common decency and good conduct but also a moral imperative, an aspirational value that should be promoted and modelled by all the members of the institutions and throughout all the stages of practitioners’ careers. In their fusion of ancient wisdom and philosophical classics with their own insights on contemporary workplaces, they forward a defensible case for why (...) civility matters and is worthy of continuous contemplation. Given the clarity and persuasion of their piece, I do not seek to challenge their claims. Instead, I will complement their argument with a perspective highlighting the difficulties of identifying low-level workplace mistreatments and responding to them impartially. While organisations should certainly not skimp on their efforts to promote civility and hold their transgressors accountable, there are nonetheless boundaries to good intentions.2 The unexamined pursuit of civility, if characterised by inconsistent definitions of harm and inappropriate allegations of uncivil acts, runs the risk of fostering its own toxicity spirals. In 2007 a social scientist and a designer created a spatial installation to communicate social science research about the regulation of emerging science and technology. The rationale behind the experiment was to improve scientific knowledge production by making the researcher sensitive to new forms of reactions and objections. Based on an account of the conceptual background to the installation and the way it was designed, the paper discusses the nature of the engagement enacted through the experiment. The article combines a criticism of public understanding of science with the sociology of expectations to examine how particular expectations toward scientific progress have performative effects for the construction of publics as citizens of science. By analyzing a particular controversy about gene therapy in Denmark, the article demonstrates how different sets of expectations can be used to discriminate among three different assemblages: the assemblage of consumption, the assemblage of comportment, and the assemblage of heroic action. Each of these assemblages makes (...) medical science, scientific citizenship, politics, patients, doctors, and expectations toward the future emerge in particular ways. By their radically different expectations toward science and their different constructions of what it means to be a scientific citizen, the assemblages construct the objectives of the governance of science in three very different ways. Responsible sustainable consumer behavior involves a complex pattern of environmental and social issues, in line with the view of sustainability as a construct with both environmental and social pillar. So far, environmental dimension was far more researched than social dimension. In this article, we investigate the antecedents of both environmentally and socially RSCB and willingness to behave in environmentally/socially responsible way. We include measures of concern, perceived consumer control/effectiveness, personal/social norms and ethical ideologies/obligation to better explain and extend the traditional (...) theory of planned behavior. Additionally, we test the impact of information availability about environmental or social impact on RSCB. Our findings on a representative sample of 426 respondents show that in general, antecedents of environmentally and socially responsible sustainable consumption are similar in their effect on consumer behavior, with personal norms, concern and ethical ideologies having the strongest impact on RSCB. When comparing both types of behavior, socially responsible behavior is more influenced by perceived behavioral control and possibly social norms than environmentally responsible behavior, while information availability plays its role for both behaviors. Sustainable responsible consumption can be achieved by embracing both dimensions of sustainability and consumers need to have a sense for both social and environmental issues. The complexity and struggles between doing what is good for environment and society could be the reason why consumers have difficulties achieving sustainable responsible consumption. (shrink)

What is the strength of anthropological fieldwork when we want to understand human technologies? In this article we argue that anthropological fieldwork can be understood as a process of gaining insight into different contextualisations in practiced places that will open up new understandings of technologies in use, e.g., technologies as multistable ontologies. The argument builds on an empirical study of robots at a Danish rehabilitation centre. Ethnographic methods combined with anthropological learning processes open up new way for exploring how robots (...) enter into professional practices and change values, social relations and materialities. Though substantial funding has been invested in developing health service robots, few studies have been undertaken that explore human-robot interactions as they play out in everyday practice. We argue that the complex learning processes involve not only so-called end-users but also staff, management, doings and discourse in a complex amalgamation of materials and values. (shrink)

ABSTRACT: René Descartes' Cogito is an example of a paradigmatic thought experiment, herald of both subjectivism and new science in Europe's Modern Age, that seems to have escaped the attention of thought experiment philosophers. On deep analysis, the Cogito appears as universal instantiation. The Cogito has strong rhetorical effects for it narratively generalizes from I to all human kind, and its historical and philosophical success can be explained from its concise enthymematic structure that rings true in many possible senses. We (...) consider it a preeminent example of a thought experiment as it states the power of thinking as its very contents. From Descartes' methodology of doubt we can conclude that, e.g., on a Wittgensteinian interpretation, the Cogito is a logical thought experiment rather than a psychological one. RESUMO: O Cogito de René Descartes é um exemplo de experimento mental paradigmático, precursor tanto do subjetivismo quanto da nova ciência, na Idade Moderna europeia, o qual parece ter escapado à atenção dos filósofos que estudaram o experimento mental. Na análise profunda, o Cogito aparece como uma instanciação universal. O Cogito tem fortes efeitos retóricos por si mesmo, generalizando narrativamente desde o eu para toda a espécie humana, e seu sucesso histórico e filosófico pode ser explicado por sua estrutura entimemática concisa, que soa através de muitos sentidos possíveis. Consideramos que é um exemplo proeminente de um experimento mental, na medida em que afirma o poder de pensar como seus próprios conteúdos. A partir da metodologia da dúvida de Descartes, podemos concluir que, em uma interpretação wittgensteiniana, o Cogito é um experimento mental mais lógico que psicológico. (shrink)

A premise which seems to be preponderate in the philosophy of medical practice developed by Pellegrino and Thomasma is the medical prescription to save life whenever possible. This premise is confronted with a polemical vitalism and examined in the light of some reading principles derived from G. Canguilhem's philosophy of the life-sciences. It is argued that the primarity of life in the account given by Pellegrino and Thomasma of the foundations of medical practice is closely related to biological concepts of (...) life. This relation is shown to be problematic. The biological concept results in an ontology of the living body as the condition of possibility of medical practice, thus linking up this practice with an uncriticized biological value and finality. Maya Zehfuss critiques constructivist theories of international relations (currently considered to be at the cutting edge of the discipline) and finds them wanting and even politically dangerous. Zehfuss uses Germany's first shift toward using its military abroad after the end of the Cold War to illustrate why constructivism does not work and how it leads to particular analytical outcomes and forecloses others. Pressure from the public and non-governmental organisations is pushing lead companies in the cocoa and chocolate sectors towards becoming more environmentally sustainable and socially just. Because of this, several sustainability programmes, certification schemes and delivery initiatives have been introduced. These have changed the relationship between chocolate companies, cocoa exporters, and small-scale farmers. This paper observes how large companies in the cocoa export and consumer markets are shifting away from their traditionally remote position in the cocoa sector. The pressure to ensure (...) sustainability and justice has provoked more mutually dependent relationships with cocoa producers. Our analysis outlines the implications this emerging reconfiguration of global-local relationships has for procedural justice principles of interdependence and refutability, and the distributive justice principles of need and equity. These principles are important because they enable the different dimensions of inclusion: ownership, voice, risk, and reward. This paper highlights and qualifies arrangements surrounding these justice principles that manifest in the way five service delivery initiatives - associated with sustainability programmes and led by major buying companies in Ghana’s cocoa sector – are implemented. We show inclusiveness as an outcome of dynamic global-local relationships that are constantly reworked in response to smallholder farmers’ agency and state regulations. Portraying inclusiveness as an outcome of interactions changes its conceptualisation from a predefined ethical standpoint included in the design of standards to a result of unfolding mutual dependencies, which refashion how inclusive agriculture value chains work. Focused on the notion of the threshold of objectivity, my article dissects the empirical mirror-glass of the philosophy of Joseph Melançon. I propose to thrust this emblematic perspective of determinist discourse against the literary turn, acclaimed for its underpinning ambiguous subjectivity – here notably made relevant by Pierre Bourdieu. Both discursive practices complete each other and reject each other in a self-feeding spiral: incessant motivation for a hybrid, vexing study of mutual tensions.

The paper follows the discursive path of one of the dominant, and yet forgotten, terms in the history of ideas - that of?degeneration.? The richness of uses and various illuminations of the term, as well as its discursive dispersion and blurring, can be seen from the mid 19th until the first decades of the 20th century. The term was almost inescapable in studies of thinkers from various fields starting in the middle of the 19th century, it was successfully adopted from (...) French, Italian and British medical terminology into the art discourse of modern European societies. By focusing on music, the given term became permanently tied to thinking about relations of music and society in the German-speaking world. In a complex discursive development of the term, the author necessarily made certain choices, paying special attention to the Austro-Hungarian psychologists, Max Nordau who carried the concept of?degeneration? from the medical to the art sphere. The debate regarding the?degeneration of music,? was developed chronologically, starting from the Second Reich. While Wagner developed a theory of?degeneration? and its overcoming through?regeneration,? he was still considered?degenerated.? The given example reveals the complexity of the problem we face when we study the concept of?degeneration of music.? The consideration is completed with a glance at the life of?degenerated? musicians and music during the Weimar Republic, that is, their interpretation in the Third Reich. (shrink)

The paper is based on the New Institutional Economic Theory, which emphasizes institutions as a vital component in the creation of wealth and economic growth. It is widely accepted that formal institutions change rapidly through political and legislative decisions. Informal institutions are deeply embedded in customs, tradition and inherited behavioral norms. Thus, change comes at a very slow pace. This research is focused on the business ethics segment of informal institutions.The paper is based on the effects of institutional changes on (...) the position and the slope of demand curve for ethical business behavior. Business people faced with opportunity costs that influenced their behavior. Additional statistical analyses provide evidence of business ethics perception, which is more expressed in the group of managers than in the administration group. Behavior of the middle-aged population differs significantly in comparison to other groups when deciding on ethical dilemmas in real business situations.Cet article s’inspire de la Nouvelle Economie Institutionnelle qui met l’accent sur les institutions en tant que composante fondamentale du processus de création de richesses et de la croissance économique, Il est généralement reconnu que les institutions formelles se modifient rapidement sous l’impulsion de décisions politiques et législatives. Les institutions informelles, quant à elles, sont profondément ancrées dans les coutumes, les traditions, et les normes de comportement héritées d’anciennes générations. Ainsi, dans le cas de ces institutions, le changement est beaucoup plus lent. Cet article met l’accent sur l’éthique des affaires en tant qu’une des composantes des institutions formelles.Une des idées qui sous-tend l’article est l’analyse des effets des changements institutionnels sur la position et la pente de la courbe de demande pour des comportements éthiques dans les affaires. Les hommes d’affaires font face à des coûts d’opportunité qui influencent leur comportement. Des analyses statistiques supplémentaires donnent la preuve de la perception de l’éthique des affaires, perception qui est plus aiguë parmi les managers que parmi les administratifs. Le comportement de la population d’âge intermédiaire diffère de manière significative de celui des autres groupes face à des dilemmes éthiques que suscitent certaines situations concrètes du monde des affaires. BackgroundHuntington’s disease has a poor prognosis. For HD patients in the Netherlands, one way of dealing with their poor prognosis is by drawing up an advance euthanasia directive. Little is known about the perspectives of HD patients on their AED.AimTo gain insight into patients’ views on and attitudes towards their AED, and changes over time.MethodsA longitudinal qualitative interview study using 1 to 6 semi-structured interviews over a period of maximum three years. Nine HD patients who either had an AED or (...) were thinking about drawing it up participated in this study.ResultsWe identified two themes that characterize patients’ perspectives on their AEDs: general character of the AED; uncertainty around their AED. Ad The conditions that the participants described in their AED were generally not very specific for the person. Mostly they were general notions of unbearable suffering. Familiarity with HD in the family could play a role in drawing up an AED. Ad Participants generally were aware of the tentative character of their AED and could have doubts concerning their own willingness or the willingness of others in the future. Sometimes these doubts were so great, that it prevented them from drawing up an AED. However, patients did not alter their AED during the follow-up period or changed in their view or attitude on their AED.ConclusionHD patients that draw up an AED usually describe general conditions for euthanasia and recognize that these conditions may change as the disease progresses. An AED or the wish to draw one up may be a good conversation starter for conversations about goals and preferences for future care. (shrink)

An automated system for monitoring facial expressions could increase the reliability, sensitivity, and precision of the research on the relationship between facial signs and experiences of pain, and it could lead to new insights and diagnostic methods. This commentary examines whether the research on facial expression of pain, as reported by Williams, provides a sufficient basis for machine understanding of pain-associated facial expressions.

The aim of my paper is to review the discussion concerning various difficulties which surround the definition of depression and the methods of diagnosing and treating the disease against the background of the now dominant reductionist paradigm in psychiatry, as well as to answer the question whether a new approach to psychiatric disorders proposed by philosophers of psychiatry working within the phenomenologically inspired embodied and enactive paradigm indeed offers a solution to these difficulties. I present the issues specific to the (...) subject of depression in light of the more general problems related to biological psychiatry that have recently caused much debate. In the second part of the paper, I consider enactive, phenomenological and embodied theories of depression and the possibilities of new methods of treatment. My goal is to assess whether these theories indeed add anything important to the conceptions that are already present in psychiatry. I conclude that even if the embodied philosophy of psychiatry does not solve many of the problems faced by modern psychiatry, it can, nevertheless, provide a useful theoretical basis for future changes. Assessments of quality in healthcare often focus on treatment outcome or patient safety, but rarely acknowledge the importance of patients’ encounters with healthcare personnel. The aim of this study was to gain an improved understanding of negative experiences of healthcare encounters by investigating experiences of the general population. A questionnaire was distributed to a randomly selected sample population of 1484 inhabitants in Stockholm County, Sweden. The material was subjected to conventional content analysis. Seventeen different types of complaint about negative encounters (...) were identified, including unpleasant behavior, not being listened to, inadequate information, and discrimination. Two possible underlying explanations are discussed; structural factors relating to the organization and allocation of healthcare, and individual factors relating to the staff’s attitudes and professional practice. The results indicate that different strands of actions are needed to reduce patients’ negative experiences of encounters in healthcare, depending on the setting as well as on which of the two factors predominates.
