Despite the increasingly diversified discourses in international commercial arbitration, this device of socio-legal regulation remains a relatively under-theorized subject. In particular, far too little attention has been paid to analyzing international commercial arbitration through critical approaches such as Third World Approaches to International Law (TWAIL). TWAIL is broadly understood as a methodological reorientation in international law by highlighting the historical links between the foundations of this field of law and the history of capitalism and imperialism as well as the colonial (...) and Eurocentric legacies in the structure and operation of the current international legal regime. With this in mind, two fronts in international commercial arbitration invite a reexamination through a TWAIL perspective and by drawing on the concept of hegemony. One front is the transnational account of arbitration, and the other one is the epistemic community of arbitration. By examining these two notions through a narrative of hegemony of Western legal traditions, we posit that any effective attempt at redefining or reforming arbitral governance structure towards sustaining diversity requires a deeper understanding of historical and current world power structures and creating a vision for the prospect of dehegemonization. From the ancient Egyptian tale of a Shipwrecked Sailor through to Sinbad and Robinson Crusoe, the stranded castaway living and philosophizing alone on a strange, desert island is a theme which has captured the imaginations of writers spanning cultures and millennia. Most familiar to Western literary historians is Daniel Defoe’s Robinson Crusoe, which inspired generations of writers from Jonathan Wyss and William Golding to Michel Tournier and J.M.Coetzee. However, little attention has been paid to Defoe’s antecedents, such as the remarkable (...) HayyIbn Yaqzan by twelfth-century Arab physician and philosopher, Muhammad Ibn Tufayl. Mahmoud Baroud here conducts a detailed comparative textual analysis of Hayy Ibn Yaqzan and Robinson Crusoe, and concludes that Daniel Defoe was likely to have been deeply influenced by Ibn Tufayl’s Arabic text. In many areas, technology has facilitated many things, diagnosing diseases, regulating traffic and teaching students in schools rely on Intelligent systems to name a few. At present, traditional classroom-based education is no longer the most appropriate in schools. From here, the idea of intelligent e-learning for students to increase their culture and keep them updated in life began. E-learning has become an ideal solution, relying on artificial intelligence, which has a footprint in this through the development of systems based on (...) education without a teacher taking into account the individual differences of students. This study describes intelligent tutoring system for teaching the Data Manipulation Language (DML) Commands Using SQLite to non IT students to overcome the difficulties they face. The System was built as education system by using the researcher own authoring tool that based on mobile and web App. The basic idea of this system is a systematic introduction into the concept of Database and its DML query. The system presents the topic of DML Commands, help student to execute what they are learn from the system content using the practical part of the system and administers automatically adapted at run time to the student’s individual growth. The system was assessed by a group of teachers and students and the outcome showed as 91% from the database specialists, 94% from Diploma students group and 89% from the secondary school students group. The quality of the products coming from different lines of production requires some tests called comparative life tests. For lines having the same facility, the lifetime of the product is distributed by Burr XII, the lifetime distribution, and units are tested under type-I generalized hybrid censoring scheme. The observed censoring data are used under maximum likelihood and the Bayes method to estimate the model parameters. The theoretical results are discussed and assessed through data analysis and Monte Carlo simulation study. Finally, (...) we reported some brief comments obtained from numerical computation. Objectivity is one of the most basic and difficult issues in modern and contemporary philosophy. The present paper is devoted to this issue from view- point of Husserl’s transcendental phenomenology. Since perception, particularly sense perception, in view of intentionality, as lowest level of objectivity can act as the base for perceiving the objectivity of other objects, whether real or unreal, it has been discussed in this paper. To do this, objectivity of the sense perception and its role in leading the (...) mind toward essential and ideal objects, and conversely, the role of latter objects in objectivity of the perception itself will be explored. Because the concepts of objectivity and evidence are correlate in Husserl’s philosophy, and since evidence as the self-given manifests itself, from the very beginning, in the lowest level, namely the objects of sense perception, and considering that evidence and objectivity of sense perception concern this lowest level, the critical viewpoint of Husserl’s phenomenology provides a firm and new basis for objectivity if taken at its full competence. One of the main arguments intended to show that content externalism undermines the privileged access thesis is the ‘slow switching argument’, originally proposed by Boghossian. In this argument, it is supposed that a subject is unknowingly switched back and forth between Earth and Twin Earth: then it is claimed that, given externalism, when the subject is on Earth thinking that water is wet, he cannot know the content of his thought a priori, for he cannot, by mere reflection, rule out (...) the relevant alternative hypothesis that he is on Twin Earth thinking that twater is wet. One of the controversies surrounding this argument stems from the fact that it is not clear which epistemological principle underlies it. Here, I examine two suggestions made in the literature as to what that underlying principle might be. I argue that neither of these suggested principles is plausible, and thus that the slow switching argument never gets off the ground. (shrink)

Along the lines of a previous work, the geometrical structure of Hibert bundles describing extended quantum free particles is repeated with Galilei external and internal independent symmetries. Then, in order to introduce the interaction, this structure is extended by replacing configuration and momentum spaces by the socelled spaces of trajectories and extended velocity boosts, respectively. These provide representations giving the probability amplitudes for the particle to follow certain trajectories. The interaction can be introduced in the transformation law from functions on (...) the space of trajectories (free dynamics) to functions on spacetime (intracting dynamics). This transformation law, which makes use of a universal distribution, is seen as a functional in our work according to a quantum functional theory which generalizes the ideas of de Broglie. Intertwining of induced representations gives the free propagator in the space of trajectories and, henceforth, the propagator with interaction in space-time for the extended particle. (shrink)

This essay focuses on Mahmoud Darwish’s exilic experience as depicted in Memory for Forgetfulness: August, Beirut, 1982 (1986). For Darwish, the siege of Beirut was a climactic moment in which he realized that he is stuck on a perpetual threshold. Imposed by the sovereign power, this exilic threshold characterizes the Palestinian refugees in Lebanon bereft of their rights as citizens and held outside their homeland and political domain. I wish to argue that, rather than being trapped in this condition, (...) Darwish takes it as a vantage point to critically reconstruct the notions of homeland and political belonging. This involves a contrapuntal approach to the notions of homeland, diaspora, and memory, and acts as a form of resistance. It converts the exilic threshold that keeps the poet neither outside nor inside the political domain into a site of worldliness in both the Arendtian and Saidian sense of the term. Elaborating on Judith Butler’s account of cohabitation and diasporic thinking, I argue that the exilic condition Darwish describes can give rise to a political ethic that resists the homogenization of spaces and temporalities, and allows for an alternative sense of political belonging. Norms provide a valuable mechanism for establishing coherent cooperative behaviour in decentralised systems in which there is no central authority. One of the most influential formulations of norm emergence was proposed by Axelrod :1095–1111, 1986). This paper provides an empirical analysis of aspects of Axelrod’s approach, by exploring some of the key assumptions made in previous evaluations of the model. We explore the dynamics of norm emergence and the occurrence of norm collapse when applying the model over extended durations. It (...) is this phenomenon of norm collapse that can motivate the emergence of a central authority to enforce laws and so preserve the norms, rather than relying on individuals to punish defection. Our findings identify characteristics that significantly influence norm establishment using Axelrod’s formulation, but are likely to be of importance for norm establishment more generally. Moreover, Axelrod’s model suffers from significant limitations in assuming that private strategies of individuals are available to others, and that agents are omniscient in being aware of all norm violations and punishments. Because this is an unreasonable expectation, the approach does not lend itself to modelling real-world systems such as online networks or electronic markets. In response, the paper proposes alternatives to Axelrod’s model, by replacing the evolutionary approach, enabling agents to learn, and by restricting the metapunishment of agents to cases where the original defection is observed, in order to be able to apply the model to real-world domains. This work can also help explain the formation of a “social contract” to legitimate enforcement by a central authority. (shrink)

This article exploits the synergy of critical discourse studies and Corpus Linguistics to study the pervasive representation of Islam and Muslims in an approximate 670,000-word corpus of US news media stories published between 2001 and 2015. Following collocation and concordance analysis of the most frequent topics or categories which revolve around the representation of Islam and Muslims in US news stories, the Discourse-Historical Approach to critical discourse analysis was adopted to investigate how the discursive strategies of nomination and predication are (...) used in US news media stories. The findings indicated that, in general, Islam and Muslims are associated with violence, religious radicalism, and Islamic extremist militants. Finally, the article discusses the discursive themes resulting from the analysis of personal pronouns as well as the educational implications of the findings for social studies and multicultural education. Abstract: Tomatoes are part of the major crops in food security. Tomatoes are plants grown in temperate and hot regions of South American origin from Peru, and then spread to most countries of the world. Tomatoes contain a lot of vitamin C and mineral salts, and are recommended for people with constipation, diabetes and patients with heart and body diseases. Studies and scientific studies have proven the importance of eating tomato juice in reducing the activity of platelets in diabetics, which (...) helps in protecting them from developing deadly blood clots. A tomato classification approach is presented with a data set containing approximately 5,266 images with 7 species belonging to tomatoes. The Neural Network Algorithms (CNN), a deep learning technique applied widely in image recognition, is used for this task. (shrink)

Given the evolution of the public health and the changes from the phenomenon of globalization, this area has encountered new ethical challenges. In order to find a coherent approach to address ethical issues in PH policy, this study aimed to identify the evolution of public health ethics frameworks and the main moral values and norms in PH practice and policy. According to the research questions, a systematic search of the literature, in English, with no time limit was performed using the (...) main keywords in databases Web of Science and PubMed. Finally, the full text of 56 papers was analyzed. Most of the frameworks have common underpinning assumptions and beliefs, and the need to balance PH moral obligation to prevent harm and health promotion with respect for individual autonomy has been specified. As such, a clear shift from liberal values in biomedical ethics is seen toward the community’s collective values in PHE. The main moral norms in PH practice and policy included protecting the population against harm and improving PH benefits, utility and evidenced-based effectiveness, distributive justice and fairness, respect for all, privacy and confidentiality, solidarity, social responsibility, community empowerment and participation, transparency, accountability and trust. Systematic review of PHE frameworks indicates utilization of the aforementioned moral norms through an practical framework as an ethical guide for action in the PH policy. The validity of this process requires a systematic approach including procedural conditions. (shrink)

A sophisticated version of the zombie argument due to David Chalmers runs roughly as follows: a zombie world is ideally primarily conceivable, and whatever is ideally primarily conceivable is primarily possible. Thus, a zombie world is primarily possible, which implies, in turn, that either physicalism is false or Russellian monism is true. Appealing to some plausible mereological considerations, Daniel Giberman presents a novel argument to the effect that zombies are not ideally primarily conceivable. I shall argue, firstly, that a main (...) premise of Giberman's argument is ill-supported, as it trades on a confusion between the primary and the secondary intensions of the "actually" operator. I then consider two lines of reasoning, which might be extracted from Giberman's text, in favour of another chief premise of his argument. I shall argue that the first line of reasoning is flawed, and the second one, in effect, will transform Giberman's argument into a kind of "parity argument" in which his mereological considerations play no role. One of the main issues concerning different versions of content externalism is whether or not they are compatible with the privileged access thesis. According to the so-called ‘illusion version’ of externalism, in reference failure cases (such as cases in which an empty proper name is involved) the subject suffers an illusion of entertaining a thought. In this paper, I shall concentrate on a recent argument offered by Jessica Brown, which she calls the “illusion argument”, to the effect that the illusion (...) version of externalism undermines the privileged access thesis (Brown, 2004). After criticizing Brown's argument, I shall try to reconstruct the illusion argument in a more defensible and straightforward way. I will exploit, in my argument, solutions proposed by Goldman and Alston for the so-called ‘generality problem’ (Goldman, 1986; Alston, 1995). Moreover, I shall offer a stronger formulation of the global reliability condition for knowledge, upon which my reconstruction of the illusion argument is based. (shrink)

Several lines of reasoning have been proposed to show the incompatibility of content externalism with justification internalism. In this paper I examine two such lines of reasoning, which both rely on the general idea that since content externalism is incompatible with certain aspects of the alleged privileged character of self-knowledge, it would tend to undermine justification internalism as well. I shall argue that both lines of reasoning, as they stand, lack plausibility, though the core idea of the second line can (...) be reconstructed into a new argument which shows considerable promise. In particular, relying upon the reliability constraint on knowledge, I shall argue that the so-called ‘two-concept’ version of content externalism is incompatible with ‘the transparency of sameness of content’, and thereby would also undermine justification internalism. Extant research notes a tendency to propound the idea that female managers are secondary to men. Gender differences constitute an ethical issue and the discursive constructions of gender management are central to research in business ethics. Drawing on evidence gathered from a time–space intersection that has been widely neglected by research in this area, we address whether female business leaders develop gender-stereotypic management styles as well as their propensity to adopt masculine management patterns such as making risky decisions and implementing (...) formal management systems. Our findings suggest that gender-stereotypic management styles are chosen strategically and target-driven, which implies a selective use of masculine and feminine management styles. Furthermore, as part of the masculine approach, female business owners adopt risk-taking decisions and implement formal management systems. Our results provide support for the argument that gender is context dependent and, hence, the findings of this study may be useful for contemporary jurisdictions featuring male-dominated societies and a strong intervention by the State in the economy. Salgının başlangıç aşamalarında kapsamlı bir çözüm bulunamadığı için âdeta şok yaşayan dünya, salgının yayılmasını önlemek için bir çözüm olarak tamamen karantinaya kapanmak zorunda kaldı. Uzun süren kapanmadan dolayı dünyanın her yerinde insanlar, psikolojik olarak bunalımlı bir dönem geçirmekteler. Hemen hemen herkes, bu bunalımdan bir çıkış yolu aramaktadır. Öte yandan, mezkûr bunalımlı dönemin toplumsal ve dinî açılardan da belirli yankıları olduğu söylenebilir. Örneğin boşanma ve intihar vakalarının artması bunlar arasında gösterilebilir. Dinî açıdan (...) bakıldığında ise, salgının yol açtığı psikolojik yükü hafifletmek için, pek çok bireyin manevi ibadetlere başvurduğu görülmektedir. Böylece, bu psikolojik bunalım hâlinin, temel olarak dinî ilgilendiren birçok soruyu da beraberinde getirdiği dikkat çekmektedir. Kelâm açısından bakıldığında, insan ve Tanrı arasındaki ilişkinin mahiyetine yönelik sorularla karşılaştığımız söylenebilir. Hiç şüphe yok ki Korona, herkes için ağır felaketlere yol açan ve insanların pek haz etmedikleri durumlar arasında kabul edilmekte. Her geçen gün duyduğumuz artan ölüm vakaları; Çin, İran ve Amerika'da karşılaşılan yoğun bakım hastalarının korkunç manzaraları, sıradanlaşır hale geldi. Ancak bireylere sorulduğunda, herkes bu virüsün özü itibariyle oldukça kötü bir durum olduğunu söylemektedir. Konu teolojik açıdan ele alındığında, şu sorular karşımıza çıkmaktadır: eğer Korona bir kötülük olarak görülürse, bu durumun Tanrı’dan gelmesi mümkün müdür? Eğer Tanrı’dan geldiği iddia edilirse, Tanrı’nın bu derece bir eyleme sebep olması nasıl anlaşılmalıdır? Tanrı kötü bir fiille nitelendirilebilir mi? Bu sorular doğal olarak günlük hayatımıza yansıdığı için, pek çok Müslüman belirli açmazlarla karşı karşıya kalmaktadır. Bu çalışmada salgın hastalıklar ve veba konusu, kelâm açısından tartışılarak, üç temel noktaya ışık tutulmaya çalışılacaktır. Birincisi: ağrı ve acı problemi ve bu problemin kelâm kitaplarında nasıl geçtiği ve hangi açılardan tartışıldığı. İkinci olarak ise: “Salgın ve veba meseleleri Allah'ın hükmünden midir, değil midir?” meselesi. Son olarak ise: "Salgınların Allah'ın hükmünden olduğunu söylemek, kulun tedbir almayı bırakmasını mı gerektirir?" sorusudur. Araştırma, Mu'tezile, Eş'ariler, Mâtüridiler ve Ehl-i Hadis gibi ekollerinönde gelen kelamcılarından bazılarını seçerek; ve mümkün olduğunca onların bakış açılarını yansıtmaya çalışarak bir perspektif sunmayı amaçlamaktadır. Makalede, tüm İslam kelâm ekollerinden kelamcıların görüşlerine yer vermiş ve bunların her birinin Kur'an, Sünnet ve hadislerden delillerini zikredilip karşılaştırmalı bir yaklaşımla el aldığımız konuda bir sonuca varmaya çalışılmıştır. The Coronavirus pandemic has been ongoing for almost two years now. Not only did it surprise the whole world in the initial stages of its occurrence, but also the world left it in shock. Therefore, the instant solution strategies included complete lockdowns in order to prevent the spread of such a disease. However, as the lockdowns lasted longer, it generated negative psychological effects on people globally. This being the case, collective endeavors and efforts were performed, in the hope of achieving a concrete solution in order to overcome the bad repercussions that seemed visible on societal levels, which of course, included religious aspects; and in some cases resulted in social separation as well as a dramatic rise in suicide rates. On the one hand, this caused a retraction from the religion and religiously oriented rituals, but on the other hand, it also made people turn more to religion as it provided a psychological relief from the heavy burdens of the pandemic. These psychological conditions had theological resonances that made already complicated issues even more complex. Among them, the nature of God’s actions and the human position in this matter can be given as examples. This article is an attempt to place and define the issue of the pandemics and plagues from the perspective of Islamic theology, in particular, to shed light on three main points. The first is the problem of pains and aches, and how it was mentioned in theological literaturey and discussed by Islamic theologians, as the issue of pandemics and plagues indisputably fall under this matter. The second point tackles the problem of whether “such calamities as pandemics and plagues come from God's Decree, or not?”. The last point focuses on the issue of fatalism and tries to show whether the de facto acceptance that pandemics are from God’s Decree would require the servant to stop taking measures in response to them. To answer the questions at stake, this paper will focus on four different perspectives of the Mu’tazila, Ash‛arī s, Māturīdis, and Ahl al-Hadīth, by using a selective methodology and focusing on their prominent and pioneering theologians of these schools. Imagination has always been a mysterious issue for modern philosophy and psychology. In this paper, however, I will not deal with modern theories of imagination; instead, I will suggest an alternative notion of imaginal power by stepping back toward Persian illuminative thought within which we may glimpse a hint of a transcendent concept of imagination as the source of human subjectivity and its power to create the object and the world. My objective here is to extend some noetic aspects of (...) this concept and extract further conclusions theoretically. To this end, I will first introduce a brief account of the noetic characteristic of the Illuminationist perspective of the imagination, then I outline aspects of its efficiency which may shed some light on the modern debate on the subject and its relation to the object. Boghossian’s discrimination argument aims to show that content externalism undermines the privileged access thesis. Simon Dierig has recently proposed a new objection to Boghossian’s argument according to which having a “twater thought” is not an alternative, and a fortiori not a relevant alternative, to possessing a “water thought”. Dierig also considers, and criticizes, a modified version of the discrimination argument which would be immune to his objection. I shall argue, first, that he fails to advance a successful objection to the (...) original version of the argument; and, second, that his criticism of the modified version is misconceived. (shrink)

This article is aimed to rephrase and critique the arguments presented by Joseph LaPorte about the truth of theoretical identity statements in natural sciences. LaPorte is classified as an essentialist who accepts the real kinds, but he denies the essence of the kinds to be discovered. His arguments are based on the vagueness of the terms of kinds. In his view while science progress we convention (not discover) what is related to the kinds. I evaluate LaPorte's arguments and show they (...) can be applied only for the border terms in scientific theories and so the generalization of the claim is not defensible. (shrink)

Modern dönemde iletişim ve ulaşımda teknolojinin gelişmesiyle birlikte dünya küçük bir köy haline gelmiştir. Bu dönemde Batı sistemi maneviyatı ve ahireti bırakıp maddiyat ve dünya için belli araç ve gereçleri üreterek modern medya alanına egemen olma gücünü elde etmiştir. Bu durum özellikle İslam’a saldıran söylemlerin tırmanması, dini gruplara saldırıların artması ve İslami içeriklerle savaşın büyümesiyle birlikte İslami medyayla uğraşanların hitap önceliklerini tekrar gözden geçirmelerini gerekli kılmıştır. Aslında bu meydan okumalar İslam medyasının daha önce sıkıntısını yaşadığı ve halen de devam eden (...) sorunlara dayanmaktadır. Medya alanında çalışılabilecek çok sayıda konu bulunmaktadır. Bunlar arasında en az tercih edilen konu ise makâsıd ya da evleviyyât bakış açısı ve makâsıd ictihâdı çerçevesinde medyaya bakma konusudur. Bu çalışmada bu konu araştırma konusu olarak seçilmiştir. Bu konunun seçimi, birtakım varsayımlara dayanmaktadır. En önemlisi de makâsıd ilminin ölçü olması ve evleviyyât fıkhıdır. Bu ölçü genel olarak medya ilminin öncüleri ve özel olarak da İslami medyanın öncüleri için makâsıd bakışını sunabilen bilişsel teorilerin ve yöntemsel imkânların amaçladığı önemli niteliklerden biridir. Böylece makalenin sorusu şu şekilde ifade edilebilir: Ümmetin kalkınmasını, liderliğini ve diğer milletler üzerindeki etkisini gerçekleştirmek amacıyla makasıdü’ş-şerî‘aya dayalı öncelikler fıkhının kuralları, çağdaş medya alanına nasıl uygulanabilir? Bu çalışma iki bölümde ele alınmıştır. Birinci bölümde medya alanındaki öncelikler fıkhı kavramı ve bu alandaki bu fıkhı dikkate almanın delilleri ele alınmıştır. İkinci bölümde öncelikler fıkhının kurallarını modern medya alanına tatbik etme konusu ele alınmıştır. Ayrıca makâsıd kuralları, nevazil fıkhının kuralları ve vesail kuralları olan üç kural çeşidine göre her bir mertebe için örnekler verilmiştir. Bu düşünceyi temellendirmenin birçok yönü bulunmaktadır. Fakat bu konu iki yönden ele alınmıştır. Birincisi medya yönündür. Burada öncelikleri modern medya ilminde düzenleme teorisi ele alınmıştır. İkincisi makâsıd yönüdür. Burada makâsıdü’ş-şeri‘a ilmine dayanan önceliklerin kuralları ele alınmıştır. Bu çalışmada biraz karşılaştırma yöntemi kullanmanın yanı sıra genel olarak niteleme, tahlil ve istinbât yöntemleri kullanılmıştır. Bu çalışma neticesinde makâsıd ilmini medya alanıyla ilgili ictihâdî bakışta işletmenin zaruri olduğuna ve bunun bilimsel bir lüks olmayıp zorunlu olduğu sonucuna varılmıştır. Ayrıca modern İslami düşünce medyasının genel olarak makâsıdü’ş-şeri‘a ölçüleri ve özel olarak da hitap ve medya makâsıdının ölçüleriyle yönlendirmesi gerektiği sonucu elde edilmiştir. Medyanın yakın, orta ve uzak stratejilerini geliştirerek evleviyyât fıkhını işler hale getirmenin zorunlu olduğunu öneriyoruz. Ayrıca medya ve makâsıdü’ş-şeri‘a alanlarında araştırma yapan ve bu ilimlerle meşgul olanların medyayı makâsıd fıkhıyla çerçeveleme ve medya alanında makâsıdı çalıştırma konusunda ortak ciddi çalışmalar yapmalarını öneriyoruz.
