Technological advances in the field of medicine and health sciences not only manipulate the normal human body and sex but also provide for surgical and hormonal management of hermaphroditism. Consequently, sex assignment surgery has not only become a standard care for babies born with genital abnormalities in the West but even in some Muslim states. On the positive side, it goes a long way in saving children born with abnormal genitalia from numerous legal interdictions of the pre-sex corrective surgery. Nevertheless, (...) the larger ethical and legal questions that medical management of genital abnormality raises to some extent have not been adequately appreciated by contemporary Muslim responses. The COVID-19 pandemic is an unprecedented time in history. Surrounding this pandemic are many enormous uncertainties across the globe. Severe consequences have assessed for the incomes of almost 84% of employers and 68% of self-employed who are working and living in countries that are or have went through a phase of closing workplaces. Similarly, the global rate of unemployment is also expected to be increased in the coming years as 54% of employers worldwide are running their businesses in the hardest-hit (...) sectors. All of these clearly show the uneven impact of the Coronavirus crisis which will remarkably compound already present inequalities, difficulties, and vulnerabilities. The economic ramifications for 186 countries under the crunch of the COVID-19 pandemic is also considered tremendous for Pakistan. The core aim of this research was to test a new conceptual framework depicting the ramifications of restructuring processes carried out by management for their organizations amidst the COVID-19 pandemic on an Institute’s reputation as an employer brand. It also investigates the impact of perceived restructuring on a corporate brand promise made by the university or institute from the viewpoints of other key stakeholders and potential job seekers. The current study had proposed four hypotheses and according to the results of Structural Equation Modeling, the direct hypothesis based upon the relationship between restructuring and employer branding has been rejected. This study shows that restructuring and employer branding has a negative and insignificant effect on each other. The second direct hypothesis of the study that measures the effect of restructuring on corporate branding has been accepted. A corporate brand is a kind of a hub and it considers how an institute treats and deals with all of its stakeholders. It is different from employer brand as the perceptions of employees were the main focus. So, according to the results restructuring did not cause massive damage to the overall outlook of the institute. Furthermore, for the purpose of mediation analysis, the maximum likelihood method by bootstrapping was adopted to test the indirect hypotheses of the study. Crowdsourcing was introduced as a mediator in this study with restructuring, employer, and corporate brand all together in one framework, which is the novel aspect of this study. There are two indirect hypotheses and according to the results both of them did not show any insignificant results. Firstly, the study analyzed mediation among crowdsourcing, restructuring, and employer branding which was fully accepted as the results showed full mediation between these constructs. Secondly, the study analyzed mediation among crowdsourcing, restructuring, and corporate branding which was partially accepted as results showed partial mediation between these constructs. (shrink)

In the fatwas given today related to whether individual or social life, the area of jawāz either has been very wide or very narrow. Those, who feature the behavior making prohibited things lawful, have nearly defined even necessity within the pragmatism on the basis of need and they keep the area in question very wide. On the other hand, those who confine the evidence of maṣlaḥa to a methodological principle, have nearly disregarded needs in solving individual and social problems. Whereas, (...) in the fiqh, the needs have been categorized as necessary/ḍarūrī, human want/ḥājī and making beautiful/taḥsīnī, and many principles have been constructed for taking stock of them. One of the principles is the lex of “Need/al-Ḥāje, general or particular, is dealt with as to meet necessity/al-Ḍarūra.” When it is determined how this lex has come out since the first period and its conditions in the context of implementation are determined, it will be come out that necessary cannot be reduced to need. In the same way, it will be come out that the maṣlaḥa is not an evidence disconnected with life. So, in the article, we will discuss the concepts of necessary and need. Then, we will show what the conditions to be considered in implementation of this lex are, what its base is in the sharia, how it has come out since the first period, and how it has been used in actual issues of the fiqh as well as in a specific example. Thus, with this study, we purpose to contribute to the solution of the actual issues of the fiqh. -/- SUMMARY The notions of need and necessity (ḍarūra, ḥāje) which are of four notions cited in the lex were individually examined and the differences between them were explained. The notions of general or particular (umūmī, khuṣūṣī), because of their using as adjective of the notion of ḥāje, were explained in the context of it. In the literature, the conception of ḥāje was used in the meaning both for all needs containing ḍarūra and just for needs apart from ḍarūra. A similar situation applies to the conception of ḍarūra. Ḍarūra having two descriptions was used in the meaning of ḥāje at times. This closure in using has caused the idea that both concepts have the same notion. In fact, from this point of view, there are the implications about that the lex is unnecessary. In this study, it is purposed that the mentioned idea and implications are wrong. As a requirement, the differences between the mentioned concepts were also examined under a separate title. -/- As for the notions of umūmī and khuṣūṣī, the scope of umūmī and khuṣūṣī ḥāje were not transparently defined and were just explained through examples in the classical period. In the context of ḥāje, the descriptions about the scope of these notions have been done after the lex took its final shape and became popular in this shape. According to these descriptions, umūmī ḥāje is the needs regarding all community. Khuṣūṣī ḥāje is the needs regarding a certain group in the community. There are interpretations as well about that individual needs must be dealt with in the scope of khuṣūṣī ḥāje. This study has same opinion. Taking into consideration of the historical development of the lex, this situation has been more clearly understood. Taking into consideration of the historical development of the lex, it is seen that the first person to make the lex a current issue is Juweynī (d. 1085). Juweynī mentioned the lex in different shapes. These combine in the point of umūmī ḥāje: “Umūmī ḥāje is dealt with as khuṣūṣī ḍarūra.” Juweynī not mentioning the notion of khuṣūṣī ḥāje in the lex shows that there is the differentiation between umūmī and khuṣūṣī ḥāje in his mind. Juweynī has a clear attitude in umūmī ḥāje while is hesitant in khuṣūṣī ḥāje. Another point which he is clear is that the needs dealt with as ḍarūra is not pure advantage and relaxation and it must have some conditions. Likewise, Gazzalī (d. 1111) and ‘Izz b. ʿAbd al-salām (d. 1262) continued the clear attitude of him. Both asserted some conditions about ḥāje dealt with as ḍarūra. But both did not mention any notation to imply these conditions in the lex. However, Ibn al-Wakīl (d. 1317) seems to want to show all ḥāje not to be dealt with as ḍarūra by adding the notation of in some situation: “Umūmī ḥāje is dealt with as ḍarūra in some situation.” In the historical development, it is seen that the first person to mention the notion of “khuṣūṣī ḥāje” in a lex is Zarkashī (d. 1392). But he mentioned this notion in another lex not in the lex in question. It is claimed that the addition of “khuṣūṣī ḥāje” to the lex was done in time of Ibn al-Wakīl or before and Zarkashī divided the lex in two as umūmī ḥāje and khuṣūṣī ḥāje. But this study proves for the mentioned claims to be unsuitable the historical development. Because, the first person to mention the notions both of umūmī ḥāje and khuṣūṣī ḥāje in one lex is Suyūtī (d. 1505): “Ḥāje, umūmī or khuṣūsī, is dealt with as to meet ḍarūra.” The lex has been fixed and become popular as it is. After this, especially in the recent period, the clear definitions have started to be done regarding what scope the notions of umūmī and khuṣūsī ḥāje in question in the lex is and the conditions about ḥāje have been dwelled on. In this study, the conditions in question have been treated under four items. In this study, this conditions have been analyzed with regard to functionality of the lex. It has been determined that the idea claimed about that ḥāje must not oppose to a special base, in the context of the first conditions especially, will cancel the functionality of the lex. The current use of the lex, because of the study’s boundaries, has been dealt with over a specific example topic. The issue of being a resident has been preferred as an example topic. Though there is an alliance about having a residence as a need, there is a conflict about the buying a residence by bank credit. While some have not allowed this by claiming that credit is against to a special base, some have allowed it on the basis of this lex. According to the second group, when its conditions are met, the buying a residence by credit is permissible. Because, residence is among essential needs. In this study, it is stated that the preferred opinion is this. However, by taking into account the spirit of sharia it is expressed that every need for having a residence cannot be dealt with as necessity. It has been emphasized that instead of accepting everything as a need dictated especially by the consumerism that elevates human desires to an uncontrollable level, identifying a suitable need for our own values is important. This study deals with the lex of “Need, general or particular, is dealt with as to meet necessity” used in the fatwās today. The study determining the historical development and break points of the lex and the conditions argued about it examines daily use of it on the basis of a current example. Taftāzānī, Masʻūd ibn ʻUmar, 1322-1389?. Tahdhīb al-manṭiq wa-al-kalām.

Free Energy Principle underlies a unifying framework that integrates theories of origins of life, cognition, and action. Recently, FEP has been developed into a Markovian monist perspective. The paper expresses scepticism about the validity of arguments for Markovian monism. The critique is based on the assumption that Markovian models are scientific models, and while we may defend ontological theories about the nature of scientific models, we could not read off metaphysical theses about the nature of target systems from our theories (...) of nature of scientific models. The paper draws attention to different ways of understanding Markovian models, as material entities, fictional entities, and mathematical structures. I argue that none of these interpretations contributes to the defence of a metaphysical stance. This is because scientific representation is a sophisticated process, and properties of Markovian models—such as the property of being neither physical nor mental—could not be projected onto their targets to determine the ontological properties of targets easily. al-Juzʼ al-awwal. Dirāsāt fī al-manṭiq wa-falsafat al-ʻulūm -- al-juzʼ al-thānī. Dirāsāt fī al-manhaj wa-al-ʻilm al-ʻArabī.

The paper draws on scientific resources formed around the notion of Free Energy Principle to reconstruct two well-known defences of panpsychism. I reconstruct the argument from continuity by expanding the mind-life continuity thesis under the rubric of the Free Energy Principle (FEP), by showing that FEP does not provide an objective criterion for demarcating the living from the inanimate. Then I will reconstruct the argument from intrinsic nature. The FEP-based account of consciousness is centred on the notion of ‘temporal depth’ (...) of generative models. I argue that even evolution can be modelled as a temporally deep system. Since we have no access to the intrinsic perspective of evolution to see whether or not it models itself as a temporally deep system, we must draw an analogy from our own case and conclude that evolution is consciousness involving. Thus the paper reconstructs two main arguments for panpsychism. (shrink)

Equivalence: ‘Ought not’ is equivalent to ‘impermissible.’ OIC: ‘Ought’ implies ‘can’ and ‘ought not’ implies ‘can refrain from.’ BRI: Necessarily, one is morally blameworthy for doing something only if it is overall morally impermissible for one to do it. Since Equivalence seems unassailable, one can escape the inconsistency by renouncing any one of the other (...) members. Research has paid scant attention to reparative behavior to compensate for unintended wrongdoing or to the role of emotions in doing the right thing. We propose a new approach to investigating reparative behavior by looking at moral emotions and psychological proximity. In this study, we compare the effects of moral emotions (guilt and shame) on the level of compensation for financial harm. We also investigate the role of transgressors’ perceived psychological proximity to the victims of wrongdoing. Our hypotheses were tested (...) through a scenario based questionnaire on a sample of 261 participants. Analyses indicate that (1) guilt has a stronger effect on the level of compensation than shame; (2) psychological proximity influences the level of guilt, shame, and compensation; and (3) shame interacts with psychological proximity to predict compensation, whereas guilt mediates the relationship between psychological proximity and compensation. I argue that emotional sensitivity (or insensitivity) has a marked negative influence on ethical perception. Diminished capacities of ethical perception, in turn, mitigate what we are morally responsible for while lack of such capacities may altogether eradicate responsibility. Impairment in ethical perception affects responsibility by affecting either recognition of or reactivity to moral reasons. It follows that emotional insensitivity (together with its attendant impairment in ethical perception) bears saliently on moral responsibility. Since one distinguishing mark of the psychopath is emotional (...) insensitivity, emotional insensitivity and the resulting impairment in moral perception either excuses the psychopath from moral culpability or moderates the degree to which he is culpable. This article explores the work of the influential poststructuralist and postcolonial anthropologist Saba Mahmood. Mahmood’s work in anthropology adopts an Asadian and Butlerian approach, particularly in the seminal Politics of Piety: The Islamic Revival and the Feminist Subject. In this work, Mahmood critically interpellates the categories of ‘Western’ secular feminism through an exploration of the lives of pious Muslim women of Salafi orientations in Cairo in Egypt. Mahmood’s work constitutes an important intervention at a point in (...) time when secular feminist discourses are increasingly instrumentalized across the political spectrum in anti-Muslim discourses in the ‘Western’ world and in Europe. I argue, however, that in wanting to use the understandings and practices of pious Muslim women in Egypt in order to critique Western secular feminism, Mahmood fails to pose critical questions about the historicity of these practices and understandings, and lends her analysis to a form of cultural relativism which offers few prospects for a way forward for feminism. Derk Pereboom has advanced a four-case manipulation argument that, he claims, undermines both libertarian accounts of free action not committed to agent-causation and compatibilist accounts of such action. The first two cases are meant to be ones in which the key agent is not responsible for his actions owing to his being manipulated. We first consider a “hard-line” response to this argument that denies that the agent is not morally responsible in these cases. We argue that this response invites a (...) dialectically uncharitable reading of the argument. In this paper we study a notion of HL-extension for a structure in a finite relational language $\mathcal {L}$. We give a description of all finite minimal HL-extensions of a given finite $\mathcal {L}$ -structure. In addition, we study a group-theoretic property considered by Herwig–Lascar and show that it is closed under taking free products. We also introduce notions of coherent extensions and ultraextensive $\mathcal {L}$ -structures and show that every countable $\mathcal {L}$ -structure can be extended to a countable (...) ultraextensive structure. Finally, it follows from our results that the automorphism group of any countable ultraextensive $\mathcal {L}$ -structure has a dense locally finite subgroup. (shrink)

To be a moral patient is to be an individual deserving of moral consideration ; and to be so deserving requires that the individual have a “welfare” in that it must be capable of being made better or worse off. Discussion regarding education’s aims, especially its ultimate aims, is a key topic in the philosophy of education. These aims or values play a pivotal role in regulating and structuring moral and other types of normative education. We outline two plausible strategies to identify and justify education’s ultimate aims. The first associates these aims with a normative standpoint, such as the moral, prudential, or aesthetic, which is overriding, in a sense of ‘overriding’ to be explained. The second associates education’s ultimate aims (...) with the intrinsic value of personal well-being. We advance reasons to doubt that these strategies are successful. The shortcomings of these strategies impute yet further urgency to the issue of how we are to ascertain and validate education’s ultimate aims. (shrink)

The potential of the soil to hold plant nutrients is governed by the cation-exchange capacity of any soil. Estimating soil CEC aids in conventional soil management practices to replenish the soil solution that supports plant growth. In this study, a multiple model integration scheme supervised with a hybrid genetic algorithm-neural network was developed and employed to predict the accuracy of soil CEC in Tabriz plain, an arid region of Iran. The standalone models and extreme learning machine ) were implemented for (...) incorporation into the MM-GANN. In addition, it was tested to enhance the prediction accuracy of the standalone models. The soil parameters such as clay, silt, pH, carbonate calcium equivalent, and soil organic matter were used as model inputs to predict soil CEC. With the use of several evaluation criteria, the results showed that the MM-GANN model involving the predictions of ELM and ANN models calibrated by considering all the soil parameters as inputs provided superior soil CEC estimates with a Nash Sutcliffe Efficiency = 0.87, Root Mean Square Error = 2.885, Mean Absolute Error = 2.249, Mean Absolute Percentage Error = 12.072, and coefficient of determination = 0.884. The proposed MM-GANN model is a reliable intelligence-based approach for the assessment of soil quality parameters intended for sustainability and management prospects. (shrink)

In this paper, I expose a conundrum regarding divine creation as Leibniz conceives of such creation. What energizes the conundrum is that the concept of omnibenevolence—“consequential omnibenevolence”—that the Leibnizian argument for the view that the actual world is the best of all possible worlds presupposes, appears to sanction the conclusion that God has no practical reasons to create the actual world.

Different aspects of competition in stock exchanges have been discussed from either a positive or normative perspective, but this article seeks to come up with an approach encompassing both positive and normative dimensions of competition in various aspects of stock exchanges' activities. As far as the positive nature of the securities market and industry is concerned, conflicting trends are emerging. The liberalization of securities markets and the disappearance of technical barriers have dismantled the monopoly of national stock exchanges but led (...) to more consolidation. However, we are also witnessing a destabilizing and fragmenting effect of competition on these markets. Following an analysis of the normative/positive dichotomy in approaching competition in financial services, we discuss the centrality of information disclosure in creating a competitive and stable financial market. Disclosure of information, therefore, reinforces both competitive and prudential objectives alike. In a further attempt, we discuss the tension between the principles of competition and prudence alongside the conflict between competition objectives and economies of scope and scale. While arguments in weighing competition against economies of scope and scale are evenly balanced, the unique characteristics of such markets do not allow the absolute application of competition principles when it comes to prudential concerns. In this paper, inspired by the late twentieth century developments in philosophy of science, I propose an ontological scheme to accommodate the scientifically-informed anti-substantivalist views of the self. I call the position structural realist theory of the self. More specifically, I argue that SRS provides a middle ground for bringing a metaphysical reconciliation between the two recurring, and apparently competing forms of such anti-substantivalist views, i.e., eliminativism and pluralism. The notion of the structural self, as the underpinning pattern that is (...) the subject of the ontological commitments in SRS, is not as cumbersome as the orthodox substantivalist notion, and yet accounts for the relation of the different aspects and elements of the self by integrating them structurally into a central unifying pattern of selfhood. I use the experimental studies of Northoff et al. about the processing of the self-related stimuli in the cortical midline structure of the brain, to argue that the underlying pattern of the selfhood could be sought at the level of information processing. I also add a programmatic suggestion about how the different situated, experiential and extended aspects of the selfhood could be structurally incorporated into this underlying pattern. (shrink)

Mele endeavors to analyze autonomy, understood as an actual condition of self-governance, in two stages. An account of ideally self-controlled agents is developed first. This account is then supplemented with features sufficient for individual autonomy.

The question of judgment has become one of the central problems in recent social, political and ethical thought. This paper explores Hannah Arendt's decisive contribution to this debate by attempting to reconstruct analytically two distinctive perspectives on judgment from the corpus of her writings. By exploring her relation to Aristotelian and Kantian sources, and by uncovering debts and parallels to key thinkers such as Benjamin and Heidegger, it is argued that Arendt's work pinpoints the key antinomy within political judgment itself, (...) that between the viewpoints of the political actor and the political spectator. The paper concludes by highlighting some lacunae and difficulties in the development of Arendt's account, difficulties that set challenges for those theorists (such as Seyla Benhabib and Alessandro Ferrara) who wish to appropriate and extend Arendt's contribution into the field of contemporary critical theory. This research aims to reveal the historical roots and elements of the background for the formation of the Orang Rimba's religion. This study is based on field research with a descriptive approach of religious phenomenon. The research derives some conclusions: the Orang Rimba is monotheist, that is, they are not adherents to dynamism, polytheism, or animism as it has been understood. The history of the Orang Rimba's religion is affected by two elements; namely, Rimba culture and Islamic culture. Evidence suggests (...) that Islam is one element of Orang Rimba's religion as the following: Mantra of Getting Honey, such as Basmallah, Allah, Istighfar, Muhammad and Ya Karim; Orang Rimba Faith in God, the Prophet Muhammad, the Angel and Doomsday; the values of the ceremony of Death: Ratib Laa Ilaha Illallah; and the values of the ceremony Berdekir. It has proved the existence of a new theory about the spread of Islam in the Suku Anak Dalam community since the 14th century and at the same time undermined the old theory of the Orang Rimba's religion that has been misunderstood over the years.CONTRIBUTION: Researchers can use this new theory's findings as reference material on the Orang Rimba's religion. Estimation of discharge flowing through rivers is an important aspect of water resource planning and management. The most common way to address this concern is to develop stage-discharge relationships at various river sections. Various computational techniques have been applied to develop discharge ratings and improve the accuracy of estimated discharges. In this regard, the present study explores the application of the novel hybrid multigene genetic programming-generalized reduced gradient technique for estimating river discharges for steady as well as unsteady flows. It (...) also compares the MGGP-GRG performance with those of the commonly used optimization techniques. As a result, the rating curves of eight different rivers were developed using the conventional method, evolutionary algorithm, the modified honey bee mating optimization algorithm, artificial neural network, MGGP, and the hybrid MGGP-GRG technique. The comparison was conducted on the basis of several widely used performance evaluation criteria. It was observed that no model outperformed others for all datasets and metrics considered, which demonstrates that the best method may be different from one case to another one. Nevertheless, the ranking analysis indicates that the hybrid MGGP-GRG model overall performs the best in developing stage-discharge relationships for both single-value and loop rating curves. For instance, the hybrid MGGP-GRG technique improved sum of square of errors obtained by the conventional method between 4.5% and 99% for six out of eight datasets. Furthermore, EA, the MHBMO algorithm, and artificial intelligence models performed satisfactorily in some of the cases, while the idea of combining MGGP with GRG reveals that this hybrid method improved the performance of MGGP in this specific application. Unlike the black box nature of ANN, MGGP offers explicit equations for stream rating curves, which may be counted as one of the advantages of this AI model. (shrink)
