A flurry of discussions about plagiarism and predatory publications in recent times has brought the issue of scientific misconduct in India to the fore. The debate has framed scientific misconduct in India as a recent phenomenon. This article questions that framing, which rests on the current tendency to define and police scientific misconduct as a matter of individual behavior. Without ignoring the role of individuals, this article contextualizes their actions by calling attention to the conduct of the institutions, as well (...) as social and political structures that are historically responsible for governing the practice of science in India since the colonial period. Scientific conduct, in other words, is here examined as a historical phenomenon borne of the interaction between individuals’ aspirations and the systems that impose, measure, and reward scientific output in particular ways. Importantly, historicizing scientific misconduct in this way also underscores scientist-driven initiatives and regulatory interventions that have placed India at the leading edge of reform. With the formal establishment of the Society for Scientific Values in 1986, Indian scientists became the first national community worldwide to monitor research integrity in an institutionally organized way. Although scholars have long recognized that classical Stoicism affected Walt Whitman’s work, a full account of the extent of this debt has yet to be produced. Although he drew inspiration from many sources, we argue that Whitman’s “spinal ideas”—the ontological, moral, metaphysical and political threads of order in his thinking—are most consistently Stoic in origin. We do so by examining Whitman’s poetry, prose, correspondence, manuscripts, notebooks, and autobiography in the context of the primary and secondary Stoic material with which he (...) was familiar. We demonstrate that a number of ideas at the heart of Whitman’s literary vision—his pantheism, materialism, cosmopolitanism, reconciliation of evil and death, and conceptions of both providence and virtue—were strongly indebted to Stoic thought. As background to this argument, we first explore the transmission of Stoicism to America and its reception among American readers. We also show how and why Whitman came under the influence of Stoic teachings. (shrink)

We live in a world of one-size-fits-all law. People are different, but the laws that govern them are uniform. "Personalized Law" - rules that vary person by person - will change that. Here is a vision of a brave new world, where each person is bound by their own personally-tailored law. "Reasonable person" standards would be replaced by a multitude of personalized commands, each individual with their own "reasonable you" rule. Skilled doctors would be held to higher standards of care, (...) the most vulnerable consumers and employees would receive stronger protections, age restrictions for driving or for the consumption of alcohol would vary according the recklessness risk that each person poses, and borrowers would be entitled to personalized loan disclosures tailored to their unique needs and delivered in a format fitting their mental capacity. The data and algorithms to administer personalize law are at our doorstep, and embryos of this regime are sprouting. Should we welcome this transformation of the law? Does personalized law harbor a utopic promise, or would it produce alienation, demoralization, and discrimination? This book is the first to explore personalized law, offering a vision of law and robotics that delegates to machines those tasks humans are least able to perform well. It inquires how personalized law can be designed to deliver precision and justice and what pitfalls the regime would have to prudently avoid. (shrink)

The conditional probability interpretation of quantum gravity has been criticized for violating the constraints of the theory and also not giving the correct expression for the propagator. We have shown that following Page’s proposal of constructing an appropriate projector for the stationary state of a closed system, we can arrive at the correct expression for the propagator by using conditional probability rule. Also, it is shown that a unitary evolution of states of a subsystem at local level may be a (...) consequence of non-unitary projection of appropriate states at global level. (shrink)

In this paper I present and defend a highly demanding principle of justice in education that has not been seriously discussed thus far. According to the suggested approach, “all the way equality”, justice in education requires nothing short of equal educational outcome between all individual students. This means not merely between equally able children, or between children from different groups and classes, but rather between all children, regardless of social background, race, sex and ability. This approach may seem implausible at (...) first, due to the far-reaching implications it entails, primarily its requirement to deny better-off children their advantage for the sake of equality. However the paper argues that all-the-way-equality, in fact, does a better job realizing the goals of justice in education than alternative conceptions of justice. It is further argued that at least some of the principle’s most radical consequences, those that make it seem counterintuitive, can be mitigated by balancing all-the-way-equality with competing interests. Erdelyi's two key tenets – that repression may be conscious (“suppression”) and that it is context-sensitive – resonate well with findings on unipolar depression. Drawing from this field, I argue that (1) “oppression,” namely, pressure from significant others to refrain from attending to certain mental contents, influences individuals' repression/suppression; and that, (2) individuals actively create the very contexts that facilitate their repression/suppression.

The results show this effect is contextual, and depends on the size of the landscape being explored, with funding that includes explicit random allocation performing significantly better than peer review on large landscapes. Pluralism about scientific method is more-or-less accepted, but the consequences have yet to be drawn out. Scientists adopt different methods in response to different epistemic situations: depending on the system they are interested in, the resources at their disposal, and so forth. If it is right that different methods are appropriate in different situations, then mismatches between methods and situations are possible. This is most likely to occur due to method bias: when we prefer a particular kind of method, despite (...) that method clashing with evidential context or our aims. To explore these ideas, we sketch a kind of method pluralism which turns on two properties of evidence, before using agent-based models to examine the relationship between methods, epistemic situations, and bias. Based on our results, we suggest that although method bias can undermine the efficiency of a scientific community, it can also be productive through preserving a diversity of evidence. We consider circumstances where method bias could be particularly egregious, and those where it is a potential virtue, and argue that consideration of method bias reveals that community standards deserve a central place in the epistemology of science. The ethical problems associated with dementia have been thrown into focus by the ageing population. The elderly form a disadvantaged group in society and the author wonders if it is morally justified to pursue research into ways of arresting pathology without concomitant attention being paid to the quality of life of the surviving elderly. Precise diagnosis of dementia requires invasive, and potentially injurious, brain biopsy. Recent thinking has pointed to some of the advantages of biopsy. The question of consent in (...) a patient with impaired mental function has to be borne in mind. As for the special ethical problems associated with Huntington's chorea, it is argued there is no justification for withholding information from, or for authoritarian direction of, patients and 'at risk' relatives but the importance of full discussion before undertaking predictive procedures is stressed. In 2013 the Health Research Council of New Zealand began a stream of funding titled 'Explorer Grants', and in 2017 changes were introduced to the funding mechanisms of the Volkswagen Foundation 'Experiment!' and the New Zealand Science for Technological Innovation challenge 'Seed Projects'. All three funding streams aim at encouraging novel scientific ideas, and all now employ random selection by lottery as part of the grant selection process. The idea of funding science by lottery has emerged independently in several corners (...) of academia, including in philosophy of science. This paper reviews the conceptual and institutional landscape in which this policy proposal emerged, how different academic fields presented and supported arguments for the proposal, and how these have been reflected in actual policy. The paper presents an analytical synthesis of the arguments presented to date, notes how they support each other and shape policy recommendations in various ways, and where competing arguments highlight need for further analysis or more data. In addition, it provides lessons for how philosophers of science can engage in shaping science policy, and in particular highlights the importance of mixing complementary expertise: it takes a village to raise policy. There are now several proposals for introducing random elements into the process of funding allocation for research, and some initial implementation of this policy by funding bodies. The proposals have been supported on efficiency grounds, with models, including social epistemology models, showing random allocation could increase the generation of significant truths in a community of scientists when compared to funding by peer review. The models in the literature are, however, fairly abstract. This paper introduces some of the considerations that are (...) required to build on the modelling work towards a fully-fledged policy proposal, including issues of cost and fairness. (shrink)

The importance of education and its profound effect on people's life make it a central issue in discussions of distributive justice. However, promoting distributive justice in education comes at a price: prioritising the education of some, as is often entailed by the principles of justice, inevitably has negative effects on the education of others. As a result, all theories of distributive justice in education face the challenge of balancing their requirements with conflicting interests. This article aims to contribute to developing (...) an account of conflicting interests by identifying a category of conflicting interests—non-positional conflicting interests—the realisation of which does not necessarily disrupt distributive justice. Non-positional conflicting interests include, for example, the interest in realising one's full potential and parents’ interest in familial relations. The article argues that the core dimensions of non-positional conflicting interests can usually be realised without upsetting distributive justice, and that actions that do upset distributive justice tend to be peripheral to these interests. Either way, there is no severe friction between distributive justice and non-positional conflicting interests: in the former cases, both are realised simultaneously. In the latter, tension exists; however, because the infringement on the conflicting interest is of relatively little weight, it is often justified, all things considered, in order to promote distributive justice. The conclusion is that while there are indeed cases in which distributive justice must retreat in the face of other interests, the friction between distributive justice and other interests is actually weaker than meets the eye. Scholars and lawmakers are familiar with a meta-narrative describing the liberal revolution of spousal law that occurred in the last decades of the twentieth century, which further transformed marriage, already transformed from a Catholic religious sacrament into a public institution and legal status model in the nineteenth century, into a private contract at the end of the twentieth. This Article addresses the liberal transformation of spousal law. The goals of the discussion are threefold: First, the Article examines the liberalization as (...) a historical narrative and the sub-narratives contained therein. Secondly, it explores the liberalization as the normative framework for the current normative debates. There has recently been a growth in research that examines how corporations respond to allegations of unethical actions. Although scholars have gained much insight about the range of responses available to and used by organizations, there has been almost no study of why firms choose one response over another. In this article, the authors present a framework of likely organizational response choices to allegations of wrongdoing; we propose that response choices are based on the degree of reputational risk from stakeholder (...) withdrawal of support and on perceived threats to the firm’s primary or secondary identity. A framework is presented to better characterize the role of individual differences in information processing style and their interplay with contextual factors in determining decision making quality. In Experiment 1, we show that individual differences in information processing style are flexible and can be modified by situational factors. Specifically, a situational manipulation that induced an analytical mode of thought improved decision quality. In Experiment 2, we show that this improvement in decision quality is highly contingent on the compatibility between the (...) dominant thinking mode and the nature of the task. That is, encouraging an intuitive mode of thought led to better performance on an intuitive task but hampered performance on an analytical task. The reverse pattern was obtained when an analytical mode of thought was encouraged. We discuss the implications of these results for the assessment of decision making competence, and suggest practical directions to help individuals better adjust their information processing style to the situation at hand and make optimal decisions. Boilerplate, the fine print of standard contracts, is more prevalent than ever in commercial trade and in electronic commerce. But what is in it, beyond legal technicalities? Why is it so hard to read and why is it often so one-sided? Who writes it, who reads it, and what effect does it have? The studies in this volume question whether boilerplate is true contract. Does it resemble a statute? Is it a species of property? Should we think of it as (...) a feature of the product we buy? Does competition improve boilerplate? Looking at the empirical reality in which various boilerplates operate, leading private law experts reveal subtle and previously unrecognized ways in which boilerplate clauses encourage information flow, but also reduce it; how new boilerplate terms are produced, and how innovation in boilerplate is stifled; how negotiation happens in the shadow of boilerplate, and how it is subdued. They offer a new explanation as to why boilerplate is often so one-sided. Sleep-related experiences [Watson, D. . Dissociations of the night: Individual differences in sleep-related experiences and their relation to dissociation and schizotypy. Journal of Abnormal Psychology, 110, 526–535] refer to a host of nocturnal altered-consciousness phenomena, including narcoleptic tendencies, nightmares, problem-solving dreams, waking dreams, and lucid dreams. In an attempt to clarify the meaning of this construct, we examined cross-sectional and longitudinal associations of sleep-related experiences , altered-consciousness tendencies , psychological distress, childhood maltreatment , and life stress in young adults. Both (...) types of SREs were found to be distinguishable from altered-consciousness tendencies. Transliminality emerged as a longitudinal predictor of both general SREs and lucid dreams. Psychological distress and an increase in life stress predicted an increase in general SREs over a 3-month interval. We conclude that transliminality is a general altered-consciousness trait that accounts for some of the individual differences in sleep-related experiences, and that general sleep experiences are an outcome of psychological distress and life stress. Immediate experience localizes the self within the limits of the physical body. This spatial unity has been challenged by philosophical and mystical traditions aimed to isolate concepts of mind and body. A more direct challenge of the spatial unity comes from a well-defined group of experiences called 'autoscopic phenomena' , in which the subject has the impression of seeing a second own body in an extrapersonal space. AP are known to occur in many human cultures and have been described in (...) healthy, as well as neurological and psychiatric populations. In this article we investigate the phenomenology of AP as described in the writings of the ecstatic Kabbalah of the thirteenth century, and search for similarities and differences with respect to AP from these and other populations. As part of the rationality debate, we examine the impact of deliberative and intuitive thinking styles on diversity preference behavior. A sample of 230 students completed the Rational Experiential Inventory and the Diversity Preference Questionnaire, an original measure of diversification behavior in different real-life situations. In cases where no normative solution was available, we found a clear preference for diversity-seeking in the gain domain and diversity-aversion in the loss domain, regardless of cognitive thinking style. However, in cases where one alternative (...) normatively dominated the other, participants high in deliberative thinking style were more calibrated to normative behavior, regardless of whether their intuitive tendency preference and the normative solution were contradictory or pointed in the same direction. Our findings support a model in which deliberative but not intuitive thinking style is the crucial predictor of rational behavior, since it enables people to better adjust their intuitive preference anchor when normative considerations require doing so. Vegetarians have argued at great length that meat-eating is wrong. Even so, the vast majority of people continue to eat meat, and even most vegetarians eventually give up on their diets. Does this prove these people must be morally corrupt? In Why It’s OK to Eat Meat, Dan C. Shahar argues the answer is no: it’s entirely possible to be an ethical person while continuing to eat meat—and not just the "fancy" offerings from the farmers' market but also the regular (...) meat we find at most supermarkets and restaurants. Shahar’s examination forcefully echoes vegetarians’ concerns about the meat industry’s impacts on animals, workers, the environment, and public health. However, he shows that the most influential ethical arguments for avoiding meat on the basis of these considerations are ultimately unpersuasive. Instead of insisting we all become vegetarians, Shahar argues each of us has broad latitude to choose which of the world’s problems to tackle, in what ways, and to what extents, and hence people can decline to take up this particular form of activism without doing anything wrong. Ecologically-motivated authoritarianism flourished initially during the 1970s but largely disappeared after the decline of socialism in the late-1980s. Today, 'eco- authoritarianism ' is beginning to reassert itself, this time modelled not after the Soviet Union but modern-day China. The new eco-authoritarians denounce central planning but still suggest that governments should be granted powers that free them from subordination to citizens' rights or democratic procedures. I argue that current eco-authoritarian views do not present us with an attractive alternative to market liberal (...) democracy even if we take a highly pessimistic view of our shared prospects under the latter sort of regime. The meritocratic principle of educational justice maintains that it is unfair that individuals with similar ability who invest equal effort, have unequal educational prospects. In this paper I argue that the conception of ability that meritocracy assumes, namely as an innate trait, is critically flawed. Absent a coherent conception of ability, meritocracy loses its ability to morally evaluate educational practices and policies, rendering it an unworkable principle of educational justice. Replacing innate ability with an alternative conception of ability is, therefore, (...) crucial for meritocratic educational justice. I propose incorporating an alternative conception of ability into meritocracy—as the ″current limits of student ability″. The account of meritocracy that follows entails that unequal educational prospects are fair only when they result from the constraints of individual potential (or from differential effort). I argue that this potential-based account of meritocracy, though demanding, is a plausible and attractive account of educational justice. (shrink)

There are various reasons for favouring Ψ-epistemic interpretations of quantum mechanics over Ψ-ontic interpretations. One such reason is the correlation between quantum mechanics and Liouville dynamics. Another reason is the success of a specific epistemic model (Spekkens, 2007), in reproducing a wide range of quantum phenomena. The potential criticism, that Spekkens' restricted knowledge principle is counter-intuitive, is rejected using `everyday life' examples. It is argued that the dimensionality of spin favours Spekkens' model over Ψ-ontic models. van Enk's extension of Spekkens' (...) model (2007) can even reproduce Bell Inequality violations, but requires negative probabilities to do so. An epistemic account of negative probabilities is the missing element for deciding the battle between Ψ-epistemic and Ψ-ontic interpretations in favour of the former. (shrink)

Project selection by funding bodies directly influences the division of cognitive labour in scientific communities. I present a novel adaptation of an existing agent-based model of scientific research, in which a central funding body selects from proposed projects located on an epistemic landscape. I simulate four different selection strategies: selection based on a god's-eye perspective of project significance, selection based on past success, selection based on past funding, and random selection. Results show the size of the landscape matters: on small (...) landscapes historical information leads to slightly better results than random selection, but on large landscapes random selection greatly outperforms historically-informed selection. A crucial aspect of the human mind is the ability to project the self along the time line to past and future. It has been argued that such self-projection is essential to re-experience past experiences and predict future events. In-depth analysis of a novel paradigm investigating mental time shows that the speed of this “self-projection” in time depends logarithmically on the temporal-distance between an imagined “location” on the time line that participants were asked to imagine and the location of another (...) imagined event from the time line. This logarithmic pattern suggests that events in human cognition are spatially mapped along an imagery mental time line. We argue that the present time-line data are comparable to the spatial mapping of numbers along the mental number line and that such spatial maps are a fundamental basis for cognition. (shrink)
