In this paper I argue that Christopher Kutz misapplies his theory of joint action when he attributes shareowners responsibilities on the basis of their intentional participation in the corporations in which they invest. Instead I propose that his theory of joint action should be used to attribute shareowners responsibilities on the basis of their intentional participation in the stock market. If shareholders’ accountability is grounded in their intentional participation in the stock market, then shareholders cannot take responsibility for corporation’s individual (...) actions. Instead they are solely responsible for the benefits they gain from holding shares if these are a result of moral wrongdoing and for this they should be held accountable. (shrink)

This paper looks at the specific proposed amendments to European directive 2007/36/EC and 2013/34/EU, and evaluates as to how such amendments alter shareholders’ moral responsibilities. To be responsible is here simply to be understood as being under an obligation, where an obligation is a requirement on an agent to either act or refrain from acting in a given way. In order to determine whether changes to the proposed directives alter shareholders’ moral responsibilities the following analysis argues that we need to (...) look at three factors: whether such changes do in fact alter the subject matter of shareholders’ obligations, a closer look at the agent i.e. shareholders to whom the obligation is to apply and thirdly whether they do actually apply. The principal findings of experimental economics are that impersonal exchange in markets converges in repeated interaction to the equilibrium states implied by economic theory, under information conditions far weaker than specified in the theory. In personal, social, and economic exchange, as studied in two-person games, cooperation exceeds the prediction of traditional game theory. Faced with an ever-growing number of ethical marketing issues and uncertainty about the impact of specialized ethics journals, researchers are struggling to keep abreast of developments in the field. In order to address these challenges, our paper provides a comprehensive review of the literature on marketing ethics over almost 50 years, offers a citation analysis and develops a unique marketing ethics impact factor (MEIF). We contribute to the field in three important ways. First, we present a state-of-the-art picture of marketing (...) ethics research. This provides an account of the research focus in each decade, assesses the importance of specific topics in the debate and identifies existing research gaps. Second, we identify the most influential papers and researchers in the marketing ethics area. Third, we evaluate the most important journals in terms of their impact on marketing ethics. To this end, we have developed an MEIF. This improves our ability to judge a journal's influence on this particular sub-discipline. (shrink)

There is an epistemological conflict between religion and science. While the claims of science are justified using epistemic methods whose reliability has been corroborated by other people and by other methods, the claims of religion are not justified in the same way. Different methods are used. This thesis offers both a comprehensive description of the distinctive epistemic methods of religion and a philosophical appraisal of the claim that such methods are knowledge-conferring. The methods explored are various and care has been (...) taken to sample a broad range of religious cultures. It is found that the same religious methods, when used to answer the same questions, generate different answers for different practitioners. Additionally, the results of religious methods fail to agree with the results of other epistemic methods when employed independently. This lack of independent agreement is the primary reason for the exclusion of religious methods from science. It is further argued that this lack of agreement is evidence that religious methods are unreliable, and the agreement generated by scientific methods is evidence for their reliability. (shrink)

Is Popper's philosophy alive or dead? If we make a judgment based on recent discussion in academic philosophy of science, he definitely seems to be fading. Popper is still seen as an important historical figure, a key part of the grand drama of 20th century thinking about science. He is associated with an outlook, a mindset, and a general picture of scientific work. His name has bequeathed us an adjective, "Popperian," that is well established. But the adjective is used for (...) very general ideas that, according to most current philosophers, Popper did not develop convincingly. His detailed account is often seen as attractive on first impression, but full of holes that become bigger rather than smaller as discussion continues. The picture and the name remain, which is more than 1 most philosophers can hope for. But the name attaches more and more to a set of instincts and intuitions, less and less to views that are seeing ongoing philosophical development. Inside science itself, Popper's standing is quite different. He continues to be just about the only philosopher who can seize the imagination and command the loyalty of successful professional scientists. And he is popular within science not only for purposes of general commentary and public relations. Popper's philosophy is a resource drawn on by scientists in their internal debates about scientific matters. This has been especially marked in some parts of biology (Hull 1999). From the point of view of philosophers, this affection on the part of scientists may have an unflattering explanation. Popper offers a rather heroic view of the scientific character, featuring an appealing combination of creativity and hard-headedness. It is no surprise that scientists like to be described this way. It is no surprise that they prefer this picture to the one often (though inaccurately) associated with Hempel and Carnap – the scientist as a sort of logic-driven pattern-recognition machine. The same applies to the picture associated with Kuhn, who presents the normal scientist as a narrow-minded, indoctrinated member of a peculiar collective enterprise, an enterprise devoted to solving tiny puzzles most of the time but prone to occasional fits of crisis and chaos.. Philosophers, linguists and others interested in problems concerning natural language frequently employ tools from logic and model theory. The question arises as to the proper interpretation of the formal methods employed—of the relationship between, on the one hand, the formal languages and their set-theoretic models and, on the other hand, the objects of ultimate interest: natural language and the meanings and truth conditions of its constituent words, phrases and sentences. Two familiar answers to this question are descriptivism and instrumentalism. More (...) recently, a third answer has been proposed: the logic as modelling view. This paper seeks to clarify and assess this view of logic. The conclusion is that we can successfully adopt the modelling perspective on a given piece of logical machinery only if we have to hand some other machinery to which we take the descriptive attitude. Thus, logic as modelling is not a full-fledged alternative to the descriptive view— for it cannot stand alone: it can at best be an addition to the descriptive perspective. The paper first presents the argument in a general, abstract form, before working through a detailed case study. The case examined is the one with respect to which the logic as modelling view has been developed in the greatest detail in the literature: the case of fuzzy model theory as an account of vagueness in natural language. In this article we argue that a widespread adoption of nudging can alter legal and political institutions. Debates on nudges thus far have largely revolved around a set of philosophical theories that we call individualistic approaches. Our analysis concerns the ways in which adherents of nudging make use of the newest findings in the behavioral sciences for the purposes of policy-making. We emphasize the fact that most nudges proposed so far are not a part of the legal system and are (...) also non-normative. We propose two ideal types: “law-as-normative” and “law-as-instrumental”, that allow us to understand and evaluate the relation of nudges and the law. We stress the importance of law as a safeguard for the possible negative consequences of nudges and conclude with proposals that could complement nudging policies. (shrink)

One of Tarski’s stated aims was to give an explication of the classical conception of truth—truth as ‘saying it how it is’. Many subsequent commentators have felt that he achieved this aim. Tarski’s core idea of defining truth via satisfaction has now found its way into standard logic textbooks. This paper looks at such textbook definitions of truth in a model for standard first-order languages and argues that they fail from the point of view of explication of the classical notion (...) of truth. The paper furthermore argues that a subtly different definition—also to be found in classic textbooks but much less prevalent than the kind of definition that proceeds via satisfaction—succeeds from this point of view. On the face of it there would seem to be possible only the one answer implied by Mr. Weiss' position; no. The past is past and as such is sheer fact without becoming. What then shall we make of a notion like that of atonement? Does this idea, if interpretable (...) at all, point merely to a change taking place in some present or to take place in some future? Does it involve merely a change in knowledge, interpretation, consciousness, so that while it is admittedly a genuine change related to a determinate past, it is in no sense a change in the past? In a world where exploitation and uneven development condemn billions to suffering, the proper understanding of the intellectual relationship between Hegel and Marx appears a small matter indeed. Marx‟s Capital, however, remains the single most important text for comprehending the system that generates this suffering. The question of the proper reading of this work thus remains important. Sooner or later this brings us to the Hegel/Marx question. In a recent article in Science and Society John Rosenthal forcefully argues that there (...) is one and only one place where Hegelian themes play a role in Capital (Rosenthal 1999). In Rosenthal‟s view, Marx‟s description of the relationship between money and ordinary commodities deliberately echoes the relationship between universals and finite things in Hegel‟s system of idealism. The fact that Marx found this aspect of Hegel‟s thought useful is not at all to Hegel‟s credit. According to Rosenthal, Hegel‟s thought perversely grants abstractions priority over flesh and blood human subjects in a way that exactly parallels the way money, a “real abstraction,” perversely dominates social agents in capitalism. Apart from this, Rosenthal insists, Marx abandons his earlier experiments with Hegelian motifs in Capital. In specific, nothing like Hegelian dialectics can be found, a “methodology” based on bad puns and spurious reasoning. In order to justify this thesis Rosenthal attacks on two main fronts. First, he hopes to convince the reader that Hegel‟s use of the key terms “universality,” 1 “particularity,” and “individuality” is irredeemably flawed. Rosenthal complains that Hegel‟s term “universality” is systematically ambiguous, sometimes referring to the relatively more inclusive, on other occasions to the all-inclusive. The sense of the term “particularity” shifts in Hegel‟s writings between what is relatively unique (“bare” particularity) and what is relatively more determinate (“specificity”).. (shrink)
