Conversely to the United States, lobbying consulting in France is a relatively recent activity and is perceived negatively by a majority of the population. Influencing public decision-making is certainly a sensitive occupation at both managerial and societal levels. This is why ethics applied to business can play a central role while establishing the practice of lobbying in France. This paper examines the issues and the practices of ethics in lobbying consulting. The field for this exploratory study is a lobbying consultancy (...) firm based in France. Our research is developed through a 3-month participant observation and complemented with secondary data on the lobbying profession in France. The results of this research are developed along two lines: The practice of ethics in lobbying consultancy firms reveals its limits as well as a framework worth developing. The players and the represented client topics are potential dangers for ethical lobbying firms. This intervention research has nevertheless allowed us to observe the emergence of an effective regulation approach: the ethics of exemplarity as potentially illustrated by a representative actor of the French lobbying consulting profession. The stakes of ethics are both internal and external to lobbying consulting professionals in France. Internally, ethics act as a structuring element enabling this profession to establish itself with practices and deontological codes; externally, it clarifies the relationship between lobbying consultants and their major stakeholders including customers, government, and the civil society. _Learning to Unlearn: Decolonial Reflections from Eurasia and the Americas _is a complex, multisided rethinking of the epistemic matrix of Western modernity and coloniality from the position of border epistemology. Colonial and imperial differences are the two key concepts to understanding how the logic of coloniality creates ontological and epistemic exteriorities. Being at once an enactment of decolonial thinking and an attempt to define its main grounds, mechanisms, and concepts, the book shifts the politics of knowledge from “studying the other” (...) toward “the thinking other”. Addressing areas as diverse as the philosophy of higher education, gender, citizenship, human rights, and indigenous agency, and providing fascinating and little-known examples of decolonial thinking, education, and art, Madina V. Tlostanova and Walter D. Mignolo deconstruct the modern architecture of knowledge—its production and distribution as manifested in the corporate university. In addition, the authors dwell on and define the echoing global decolonial sensibilities as expressed in the Americas and in peripheral Eurasia. The book is an important addition to the emerging transoceanic inquiries that introduce decolonial thought and non-Western border epistemologies not only to update or transform disciplines but also to act and think decolonially in the global futures to come. ‘Borders’ will be in the twenty-first century what ‘frontiers’ where in the nineteenth. Frontiers were conceived as the line indicating the last point in the relentless march of civilization. On the one side of the frontiers was civilization; on the other, nothing; just barbarism or emptiness. The march of civilization and the idea of the frontiers created a geographic and bodygraphic divide. Certain areas of the planet were designated as the location of the barbarians, and since the eighteenth century, of (...) the primitives. In one stroke, bodies were classified and assigned a given place on the planet. But who had the authority to enact such a classification, and what was the logic of that classification? Furthermore, the classification of the world by region, and the link established between regions and people inhabiting them, was parallel to the march of civilization and companions of it: on the other side of the epistemic frontiers, people do not think or theorize; hence, one of the reasons they were considered barbarians. This article focuses on the analysis of the geo-politics and body-politics of being, and perception as the key concepts in the decolonial option grounded in the spatiality and corporeality of our cognitive and perceptive mechanisms. Revived spatiality refers in this case not only to a physical space that we inhabit but also to our bodies as specific spatial entities – the privileged white male bodies or the damned, non-white, dehumanized and often gendered and sexualized bodies from the underside of modernity. The article presents a decolonial interpretation of the human/non-human binary aimed at rethinking the fundamental modern/colonial division into anthropos and humanitas and the subsequent animalization of large human groups. The main questions are then what does it mean to be animalized by and in modernity and what ways out are possible, desired and attainable for the dehumanized others? The main goal of the article is to further question liberal Western humanism from a decolonial perspective, without yet dropping this concept altogether, and considering instead another humanism model suggested by Sylvia Wynter. Contemporary critical anti-humanist and “other humanism” theories often find a much more accurate and immediate realization through artistic metaphors and activist art projects than traditional theory, problematizing the border between the human and the animal, the man-made and the natural, the individual and the communal. Therefore, the article dwells at some length on one such project balancing between art and critical anthropology – the works of the Northern Caucasus decolonial artist Taus Makhacheva. (shrink)

In the context of the continuing dominance of delocalised Western feminist theoretical models, which allow the non-Western and not quite Western ‘others’ to either be epistemically annihilated or appropriated, it becomes crucial to look for transformative feminist theoretical tools which can eventually help break the so-called mere recognition patterns and move in the direction of transversal dialogues, mutual learning practices and volatile but effective feminist coalitions. Speaking from the position of postcolonial and postsocialist feminist others vis-a-vis the dominant Western/northern gender (...) studies mainstream, and drawing on examples from a broad range of social contexts (from the Armenian queer social movement to a recent Indian gang rape controversy), the authors of this article address the validity of two such transformative feminist tools: border thinking that operates on a more general theoretical level, and disidentification that offers a more praxial operational realisation of the border principle. More than a decade has passed since North American Indigenous scholars began a public dialogue on how we might “Indigenize the academy.” Discussions around how to “Indigenize” and whether it’s possible to “decolonize” the academy in Canada have proliferated as a result of the Truth and Reconciliation of Canada, which calls upon Canadians to learn the truth about colonial relations and reconcile the damage that is ongoing. Indigenous scholars are increasingly leading and writing about efforts in their institutions; efforts include (...) land- and Indigenous language-based pedagogies, transformative community-based research, Indigenous theorizing, and dual governance structures. Kim Anderson’s paper invites dialogue about how Indigenous feminist approaches can spark unique Indigenizing practices, with a focus on how we might activate Indigenous feminist spaces and places in the academy. In their responses, Elena Flores Ruíz uses Mexican feminist Indigenizing discourse to ask what can be done to promote plurifeminist indigenizing practices and North-South dialogues that acknowledge dynamic Indigenous pasts and diverse contexts for present interactions on Turtle Island. Georgina Tuari Stewart proceeds to describe Mana Wahine indigenous feminist theory from Aotearoa before proceeding to develop a “kitchen logic” of mana, which parallels Anderson’s understanding of tawow. Finally, Madina Tlostanova reflects on how several ways of advancing indigenous feminist academic activism described by Anderson intersect with examples from her own native Adyghe indigenous culture divided between the neocolonial situation and the post-Soviet trauma. As soon as the economy of Kazakhstan is highly resource‐oriented despite numerous efforts to change the structure of the national economy, constant assessment of the scientific and innovation sphere of the country is actual and important. By way of qualitative, quantitative, comparative, and descriptive analysis 13 indicators related to science and innovations were investigated to define the level of scientific and innovative development in Kazakhstan. Science and innovation in Kazakhstan are under‐financed and state‐based financing of innovative activities seems to be (...) ineffective, and the innovations are still unprofitable. The scientific human capital is affected by “brain drain,” when best graduates go into business or leave the country to build careers in better financial conditions. Eight indicators are found to be universal and comparable for various countries, and can be applied with the purpose of defining the level of scientific and innovative development of a country or countries. The results of the study can be applied by governmental officials for developing policies related to science and innovations. The methods, set of indicators, and findings of the study can be used by other researchers for investigating and comparing the level(s) of scientific and innovative development in other country or countries. The problem of formation of professional intercultural competence is relevant in the conditions of post-industrial postmodern society. The article highlights main trends in factors of intercultural competence. The article considers different approaches to determining the foreign language competence of tourism experts to intercultural competence. The analysis of theoretical and methodological approaches gives grounds to define the concept of German-language competence and qualifications of tourism experts. In the context of the study, the features of intercultural competence are identified. The objectives of (...) the article are to determine main aspects of the formation of professional German-speaking competence of future tourism experts. In the course of the research the world and domestic experience of professional competence formation of future tourism experts and formation aspects of foreign language professional competence are analyzed. Also, based on the study, it can be argued that there is no single approach to the future tourism professionals formation of intercultural competence. Methods of analysis, synthesis, a research method and method of content analysis were used in the research. Based on the study, it is proved that levels of intercultural competence are controlled processes in the context of the use of modern educational technologies. Future tourism experts combine knowledge and skills in professional terms to achieve a high level of qualification. The results of the study are the basis for extracurricular activities in the formation of foreign language competence. (shrink)

Abu Nasr Muhammad Alfarabi, the medieval Muslim philosopher and the founder of Islamic Neoplatonism, is best known for his political treatise, Mabadi ara ahl al-madina al- fadhila (Principles of the Opinions of the Inhabitants of the Virtuous City), in which he proposes a theory of utopian virtuous city. Prominent scholars argue for the Platonic nature of Alfarabi’s political philosophy and relate the political treatise to Plato’s Republic. One of the most striking similarities between Alfarabi’s Mabadi ara ahl al-madina (...) al- fadhila and Plato’s Republic is that in both works the theory of virtuous city is accompanied by a theory of soul. It is true that Alfarabi’s theory of soul differ considerably from that of Plato’s Republic. However, we propose that notwithstanding the differences, the two theories of soul do play an identically important role in the respective theory of virtuous city. The present article explores the relationship between the soul and the city in Plato’s Republic and Alfarabi’s Mabadi ara ahl al-madina al- fadhila, and intends to show that in both works the coexistence of the theory of soul and the city is neither coincidental nor a casual concurrence of two themes. Rather, the concept of soul serves as a foundation on which Plato and Alfarabi erect their respective theory of perfect association. Thus, Alfarabi’s treatise resembles Plato’s Republic not only in the coexistence of the theory of soul and the city, but also in the important role of the concept of soul in the theory of virtuous city. In his political treatise, Mabadi ara ahl al-madina al-fadhila, Abu Nasr Alfarabi, the medieval Muslim philosopher, proposes a theory of virtuous city which, according to prominent scholars, is modeled on Plato’s utopia of the Republic. No doubt that Alfarabi was well-versed in the philosophy of Plato and the basic framework of his theory of city is platonic. However, his theory of city is not an exact reproduction of the Republic’s theory and, despite glaring similarities, the two theories do differ (...) in many aspects. In both, Alfarabi’s Mabadi ara ahl al-madina al-fadhila and Plato’s Republic, the theory of virtuous city is accompanied by a theory of the soul. Since the theory of soul plays a foundational role in both theories of the virtuous city, the present article intends to provide an explanation for the differences between the two theories of the city in terms of the differences between the two theories of the soul. The spread of Islam from the Arabian Peninsula to the North Africa and al-Andalus in the west, to the Chinese borders and the Indian Subcontinent in the east, helped Muslims to establish close contact with many different cultures. One of the consequences of this is that both the increase in scientific accumulation and the emergence of new needs in military, financial and similar aspects accelerated the studies on geography. Islamic geographers of the first period, not only did they describe the (...) cities to which they travelled but also they depicted the cities about which they could collect data. These first works, which can be considered as a kind of written maps, have some common features, although they are written in different geographies and revealed by different schools. One of these common points is the terminology that they used in depictions of cities. This terminology suggests that there was a common city typology among Muslim geography scholars that stands out in the depiction of cities. In this study, particularly we will try to answer a number of questions such as what the concepts of authors are and what they mean and the relationship between these concepts by examining the uses of authors in their works.SummaryThe depictions of settlements which were designated as madīna in the works of the medieval Muslim geographers have some common characteristics. One of them is the terminology used by the authors in depictions of cities. In this study, particularly I tried to answer a number of questions such as what the concepts of authors are and what they mean and the relationship between these concepts by examining the uses of authors in their works. Then, a common city typology which is prominent in the depiction of cities among the Muslim geography scholars has been put forward. The structural elements that are considered to constitute this typology also revealed the topographic elements of a city at that time.The cities conquered by muslims had a great impact on the emergence of the terminology used by Muslim geographers in depicting cities. I can say that especially Persian influence; the cities in Iran, Khurāsān which were captured from the Sāsānians and Mā Warāʾ al-Nahr districts was effective. However, geography writers did not restrict using this terminology for only these regions, they also had continued to use in depiction of other regions such as North Africa and al-Andalus. This means that a common language and terminology emerged and started to be used.Geography authors point to five main elements that I have examined in separate titles while describing Islamic cities that they called "madīna". These are kuhandiz, shahristān, rabad, the part so-called “the adjacent agricultural fields / agricultural fields surrounded by wall” by us and the last part rustāq connected to main city center. Depending on ways of development of cities, these elements sometimes developed from inside to out, in other words from center to environment, sometimes surrounded by independent walls and sometimes adjacent to each other. However, a city did not have to have all these elements at the same time. This situation was totally related to development level of city, and the cities which had all these elements were the military, administrative and economically developed centers of the period. From the methodical point of view, it should be noted that the examples given in the study were selected from among the other cities in order to ensure that to understand the subject in best way and ensure that the silhouette on the city typology is seen better. Because it is possible to find examples of each element in all city depictions of Islamic geography writers. Kuhandiz, shahristān/madīna, and rustāq are the elements that can be seen in the pre-Islamic period. It is possible to think of the Islamic period as a period in which these words were conceptualized, new madīnas and rabads were formed, surrounded by walls and rabads were gradually transformed into madīnas. In geography texts, it is seen that there is a concept confusion between kuhandiž and buildings named qalʿa, ḥiṣār and ḥiṣn. However, as some writers hade tried to emphasize, "kuhandiz" had been using for these structures which were previously known as fortress (especially ḥiṣn or qalʿa) due to their proportion to shahristāns / madīnas of city centers, and were notably seen in the regions of Khurāsān and Mā Warāʾ al-Nahr. Kuhandižs represent the centers of pre-Islamic cities and were continued to be used for the same purpose in the early Islamic period. But, these old areas were gradually abandoned due to the development of new parts of settlement under Muslim administration. Shahristāns were residential areas where the majority of people lived. With the Islamic period, the word “shahristān” had been terminologically changed to “madīna” and use of this concept by scientific circles was gradually disappeared in time. At this point, it is one of the issues to be considered in the examination of geography works that the use of “madīna” in Arabic both for the concept of the city in which we examine the structural elements in this article, and for “shahristān” which is one of the elements of the city.As it is understood from the geographical texts, madīna was continued to be established by Muslims in cities for centuries. These are also examples of change in cities as a result of development and housing activities after the conquests. However, we don’t have much information in the geography works about the cities which had more than one shahristān /madīna before the inhabit of Muslims. As far as we can reach, the only example in our resources with multiple madīnas/shahristān belonging to the pre-Islamic period is Bukhara.As in the developed cities of the period such as Bukhara, Samarqand, Marw and Balkh, it is seen a generaly circular fortification wall which usually surrounded main center of cities including kuhandizs, madīnas/ shahristān and mostly later rabads. So, it is more appropriate to consider the areas between these walls and other parts of city (kuhandiz, shahristān/madīna, rabad) as an independent element because of the fact that they were lands with determined borders and were defined by separate concepts. I have used “adjacent agricultural area” for this element for now. Thus, this area constitutes one of the structural elements of the cities.Rustāqs were parts of Persian-Sāsānian urbanization and land administration, and had continued to be partially implemented during the Islamic period. They were the source of livelihood of the cities from foundation stage and were an indispensable tool of the society based on agriculture in that ages. Depending on size, the cities could have dozens of them. As can be seen in the case of Balkh, the rustāḳs especially connected to the big city centers were not composed of one or several villages. Moreover, these rustāqs could contain big settlements called madīna which were their centers. (shrink)

The eminent scholar Lewis R. Gordon offers a probing meditation on freedom, justice, and decolonization. What is there to be understood and done when it is evident that the search for justice, which dominates social and political philosophy of the North, is an insufficient approach for the achievements of dignity, freedom, liberation, and revolution? Gordon takes the reader on a journey as he interrogates a trail from colonized philosophy to re-imagining liberation and revolution to critical challenges raised by Afropessimism, theodicy, (...) and looming catastrophe. He offers not forecast and foreclosure but instead an urgent call for dignifying and urgent acts of political commitment. Such movements take the form of examining what philosophy means in Africana philosophy, liberation in decolonial thought, the unshackling of political philosophy from the liberal moral theory setting the stage for the decolonization of justice and normative life, unleashing the obstacles to cultivating emancipatory politics, challenging reductionist forms of thought that proffer harm and suffering as conditions of political appearance and the valorization of nonhuman being. He asserts instead emancipatory considerations for occluded forms of life and the irreplaceability of existence in the face of catastrophe and ruin, and he concludes, through a discussion with the Circassian philosopher and decolonial theorist, Madina Tlostanova, with the project of shifting the geography of reason. In the Qur’ān the most significant words used to indicate settlement are diyār, qarya, madīna, miṣr and balad. Among these, qarya and madīna are the most important ones. While Qarya means, county, city, urban, land and settlement, madīna means town. Miṣr is used for a city as well as for a specific name of a country. Diyār indicates a geographic border and the places of a settlement, and balad infers a political unity of a number of settlements. Due to this (...) use in ‘Arabic, the word balad is used as a country and a state at the same time. Recently, there are some studies focusing on examining the terms of qarya and madīna. Hovewer, we cannot encompass the semantic area of these words only by looking up their dictionary meaning and how they were used in the Qur’ān. Therefore, in this study the old cities are examined as they exist in their places. In this study, we have utilised from the modern and contemporary scientific findings which were made for urbanization and its history. For a better understanding of the concept of urbanization, some prophets’ stories have been revised. In Qur’ān the words indicating urbanization are related to society, nature, place, human, art, economy, politics and reconstruction. Therefore, the concepts of the diyār, qarya, madīna, miṣr and balad used to describe the settlements point to the relationship of society with different elements and activities.Summary: Cities, the birth of the cities, sociology, history, anthropology and cultural history are the major subjects in social science. Among them, the birth of cities are especially important for history, anthropology and sociology. For some researchers, cities are the most important revolution of humanity. Cities do not merely mean the places where the human settle down or form a society. In many human languages there is a strong relation between the words expressing civilization and settlement. There is a strong connection between cities and civilization. In Turkish, the word civilization/uygarlık comes from Uygurlar/Uighurs which means those who settled down first. Again in Turkish, the word of madaniyet which is originally Arabic is derived from madīna which means city. In English and French, civilization derives from civitas which is originally Latin. Civitas means a settlement and also the people who live within it. In ‘Arabic, the word hadārī, means settling in a place, is used for civilization, In this study, the words related to urbanization to which social science like sociology, history, anthropology and cultural history attribute a great importance are investigated from the mufassirs’ perspective. As a result of the researches, it was observed that the words qarya, madīna, diyār miṣr and balad were used in the Qur’ān in close terms with the city. Before examining the words which refer to city in the Qur’ān like qarya, madīna, diyār, mıṣr and balad, the approaches of sociology, history and anthropology are investigated for comparative purposes. According to modern and contemporary researches, jobs like art writing, music and architecture appeared after urbanization. The evolution of humanity from primitive period to modernity is because of urbanization. Cities are the crops of social relationships between people. Urbanization caused wider social interactions and the formation of more complicated societies. People who constitute societies and complicated relationships founded cities. With the increase of specialization and jobs, people of one or more job were able to meet the needs of each other through social cooperation.Before the urbanization the human-nature relation was more important but in cities human-human relation got more important. Cities caused social status to be a result of human-human relations. In these social categories, jobs like managers, merchants, guilds, soldiers and religious groups like religious leaders and darvīsh appeared. The physical features of a city are as important as their social structure. A city firstly has walls, administration, bazaar, laws, and the sense of common belonging among people.In the Qur’ān, it can be noticed that the history of settlement is developed chronologically. In the Qur’ān, the words qarya, madīna, diyār miṣr and balad are used in the meaning of the city. These words have a close relationship with people and society. For example, because societies and cities were not formed during the time of Adam, there is no word in the stories that evokes society and the city. The same is true for Idrīs. When we look at the narratives about Noah, for the first time there are words like the people, mala/the leaders of the community, erāzil/shameless, and the ship. Although no word meaning city or city is used in these stories, it is seen that society and social strata are formed. In the Hoad period, the word house, palace, building and Irem were used in addition to the word peoples/tribe. In addition to the words that express the civilized developments in the stories of Noah and Hoad, the existence of the words diyār and madīna draws attention during the reign of Ṣāleḥ. In the Qur’ān, the first terms related to urbanization were mentioned in the story of Hoad, and the words meaning settlement and city were mentioned in the story of Ṣāleḥ. Moreover, the words realm and madīna were used in the story of Ṣāleḥ. In the periods of Abraham and Moses, the words qarya and miṣr were added to this. The word Midian was used specifically for the city of Shu‘ayb, and the word balad was used for Mecca during the time of Prophet Muhammad.As mentioned in Noah’s era peoples and the states of people were present; in Hoad’s era, vineyard, garden, agriculture, houses, buildings and small scale settlements started to be constructed. In the Qur’ān, during the era of prophet Hoad, words like: vineyard, garden, agriculture, houses, building and palace, were used, however there is not a single word which means city. In Ṣāleḥ’s era the words dār and diyār were used in a general meaning? Therefore, it can be safely said that urbanization seriously started in Ṣāleḥ’s era. Additionally, dār also means house, vineyard, garden, grassland, region and home. Descriptions of dār, diyār and madīna in Ṣāleḥ’s parable point out the three directions of Thamūd peoples about urbanization. The word dār refers to the architectural features of their houses; the word diyār refers to their vineyards, gardens, houses and lands; and the word madīna refers to the largest and most important settlement in their homes. As modern and contemporary science has argued, according to the commentators, madīna is used for the settlements surrounded by walls, with its bazaar, army, ruler, tradesman and merchant.In the Qur’ān, the word qarya is closer to diyāri even if its used as madīna in some of the parables. Nevertheless, qarya is different from diyār due to its two distinctive features of political structure and intimacy. Qarya is a city or city state in some way, but it is not only a center but also a city or city state with a political structure with villages, towns, mountains, slopes and plains. So today, it refers to a city which has political integrity with its provincial borders or environment. Diyār was used for the places which were suitable for agriculture, while qarya was used for the cities of Sāmī people as a common word in Sāmī languages. For this reason, qarya was never used for the settlements of Copti, which are African communities; instead, the misr, which is a common word in Coptic and Arabic, was preferred. Even the word miṣr which means city in the Coptic language was used as a country name in the Egyptian regions. The word Balad indicates more a political formation, so it only means country. In the time period of Jahiliyyah they used balad for Mecca which owned a political formation.In the Qur’ān the words qarya and balad are used for Mecca but words like diyār, madīna and miṣr were never used for it. The use of the name qarya for Mecca indicates that it was established by a non-Arab like Abraham on the one hand and that it was the common place of all people. The word of madīna is not used to describe it because Mecca has not embody walls, bazaar, army or craftmanship. The reasons for not using diyār is because there are no vineyards or gardens. The lack of the word miṣr for Mecca also indicates that there is no influence of North African races such as Hāmī in Mecca.Briefly, Qarya is a settlement with its village and towns which is under administration. Madīna is a important center which exists inside qarya with walls, bazaar and architecture. Diyār is a settlement of the city center with houses, vineyards and gardens. Miṣr is a city where the Northern Africans are residing and Balad is a settlement where is prominences as political organization. (shrink)

Khalīfa b. Khayyāt(d. 240/854-855) was an historian- muḥaddith in the ʿAbbāsid’s period. There are references in sources to his competence in history and lineage rather than Ḥadīth. Two works of him have survived. The first one is al-Ṭabaḳāt which is about study of men and the second one is al-Taʾrīkhwhich chronologically narratesthe events in the history of Islam until 232 AH. The latter is the most significant work to be applied for the historiography of ibnKhayyāt. In this article, Khalīfa b. (...) Khayyāt’s methodology in historiography is examined. In this study, the early period of Islamic histography is handled and the subject is discussed comparatively. The main characteristics of his historiography are his adoption of a chronological style that facilitates the follow-up of the book, his knowledge for the lineage of those who died in wars and the details about the wars. Also, among the charactersitics are his application of isnād to his history book as a muḥaddith, his knowledge for the previous resources via his teachers who belong to the schools of al-Madīna and ʿIrāḳ and when required, his usage of ayah, ḥadīth and poems. These issues are dealed in the artcile with examples. Besides, a study in the West about Khalīfa b. Khayyātasserts that he was a follower of Umayyad dynasty and so this affected his historiography. In this article, this assertion is tackled by analyzing the whole book and it concludes that it is not valid because of some narrations against this assertion.SummaryKhalīfa b. Khayyāt (d. 240 / 854-55), who grew up in Basra, one of the most important centers of scholarship of the time and the meeting point of scholars, and he continued his scholarly works in this city. Since his grandfather and father are engaged in the field of Ḥadīth, Khalīfa b. Khayyāt started his scholarly adventure at an early age and he took his first education in the field of Ḥadīth.Scholars, in the early periods, continued their studies in the fields of sciences related to each other. Khalīfa b. Khayyāt’s studies are also in this kind. Although there are references in sources to his accumulation of Ḥadīth, Khalīfa b. Khayyāt ’s main area of ​​expertise is history and nasab/genealogy. The fact that his works and references to him in later sources are largely related to historical events, knowledge of the nasab/genealogy, and wafayāt (death dates of Ḥadīth scholars and narrators) reveals his considerable knowledge on these issues. Khalīfa b. Khayyāt lived in the period of ʿAbbāsid caliphs al-Maʾmūn (813-833) and al-Muʿtaṣim (833-842). This period is important because of the fact that the al-Mihna incident took place and the pressure on the Ḥadīth scholars increased. Although Khalīfa b. Khayyāt is not one of the direct opponents of Muʿtazila, his participation in a debate against them provides clues about the place where he stands. The scholarly atmosphere of Basra, enabled Khalīfa b. Khayyāt to benefit from a wide range of teacher-student network. In addition to his professors from whom he benefitted in the field of Ḥadīth, he had the opportunity to obtain the knowledge and understanding of the history of that time through his teachers who are important historians of the period in his field. Two works related to Khalīfa b. Khayyāt whose reliability is confirmed by djarh wa l tadil scholars reached to our time. One of the oldest Ṭabaḳāt works in the history of Islam is al-Ṭabaḳāt; the other one is the book, al-Taʾrīkh, which provides a new method for Islamic historiography.This study deals with the principles of the method of historiography, which can be put forward through Khalīfa b. Khayyāt 's al-Taʾrīkh. al-Taʾrīkhis important in terms of being the first example of chronological writing type in Islamic historiography and has not been subject to any independent study to date. There are two ongoing M.A. thesis about Khalīfa b. Khayyāt, however, no study has been identified that directly deals with its methodology of history. On the other hand, based on some riwāyats/narrations in al-Taʾrīkh, there is a work that claims that Khalīfa b. Khayyāt had sympathy towards Umayyads. The study named “Khalīfa b. Khayyāt’s History on the Umayyad Dynasty (660-750), prepared by Carl Wurtzel as his PhD. Dissertation, examined the life of Khalīfa, partly the historiography and the religious-political narrations in the work. On the case of Muʿāwiya’s (d. 60/680) request of the allegiance to Yazīd (d. 64/683), Wurtzel compared an event that took place between the envoy of Ibn al-Zubayr (d. 73/692) and Muʿāwiya with al-Balādhurī’s (d. 279/892-93) narrative and concluded that Khalīfa was an Umayyad sympathizer. However, Khalīfa b. Khayyāt’s exclusion of an event such as al-Mihna which was against the ʿAbbāsid and changed the course of history in his book, shouldn’t be considered as a symptom of sympathy; It would be more appropriate to accept it as a feature of history writing.At the top of Khalīfa b. Khayyāt's principles of historiography, adopting chronological method comes first. Accordingly, Khalīfa b. Khayyāt, gives a brief history about the siyar of the Prophet Muhammad at the introduction of the book. Then, by beginning from the first hijri year, he gives the important events, wars and deaths by the years. Sometimes, he refers to the people assigned by the caliphs of the period by referring to the Amîrs (Administrators) of the Hajj. He gives lists of those who died on both sides of the wars. The importance of mentioning the tribes of the deceased shows his competence in the knowledge of nasab. One of the highlights of his historiography is that he sometimes does not touch upon some of the events and situations that are considered to be turning points in Islamic history; and sometimes he does not go down into detail but just gives relevant narratives. For example, he doesn’t mention any narrations about the selection of the Caliph which perhaps the most fundamental point of separation between Ahl al-Sunnah and Shīʿa in the history of Islam.Although he gave detailed information about The Battle of The Camel (36/656) and Ṣiffīn cases (37/657), it is not possible to determine his views on this subject. In addition, he never mentioned the al-Mihna incident, which deeply influenced society and the scholarly environment during the ʿAbbāsid period. Isnād is also holds an important place in the methodology of history of Khalīfa who was a muḥaddith at the same time. In many of the narrations he used the words haddathanā and ahbaranā.In our study, the siyar section of al-Taʾrīkhwas examined in order to determine the sources of the Khalīfa’s historiography and has been seen that the works of Ibn Isḥāḳ (d. 151/768) and Ibn Hishām (d. 218/833) were the main sources of this chapter. Considering Khalīfa b. Khayyāt’s emphasize to isnād and his reach to Ibn Isḥāḳ 's work through the mediation of Bekr b. Suleiman, it can be said that he was dominant in historiography on the sources before him. Khalīfa b. Khayyāt rarely refers to Qur’anic verses and hadiths when describing events. He referred to the verses in only two places and hadiths in only five places. One of them, and perhaps the most remarkable one in the book is the Ḥadīth of the Prophet Muḥammad: “I am the guardian of whom; ‘Alī is his guardian” This narration is used in the letter of Caliph Mahdī (d. 169/785) of the ʿAbbāsid to khārijī (outer) Abd al-Salām b. Hishām who rebelled. The study is based on the principles outlined above. At the end of the study it is also considered that Khalīfa b. Khayyāt ’s works should be the subject of graduate studies which should be prepared with deep readings. (shrink)

In Mabādi’ ārā’ ahl al-madīna al-fādila as well as other major political writings of al-Fārābī, politics is accompanied by metaphysics. However, the co-existence of politics and Neoplatonic metaphysics in al-Fārābī is usually refuted on the basis of two major arguments: one, the Neoplatonic argument, which denies al-Fārābī’s politics; and two, the Straussian argument, which denies al-Fārābī’s Neoplatonic metaphysics. However, this article would show that the two arguments against the co-existence of politics and Neoplatonic metaphysics in al-Fārābī are faulty, and that (...) politics and Neoplatonic metaphysics certainly co-exist in al-Fārābī’s philosophical thought. It would be shown that, in fact, Neoplatonic metaphysics plays an important role in al-Fārābī’s politics and distinguishes his theory of the virtuous city from that of Plato’s Republic. (shrink)

Many different meanings are attributed to the term Sufi. From the philosophical standpoint the sufi sect leans towards the mystic tradition, while taken etymologically the word implies anything which is extracted from wool. Sufi was the term applied to those individuals who went through life wearing a woolen gown, spending their life in mediation and prayer. Other scholars are of the opinion that the terms sufi is derived from the root “Suffa” which is applicable to the platform built by Mohammad (...) in the mosque at Madina. Hence the term sufi applied to those benevolent and pure but homeless people who spent their time sitting on this platform and meditating upon this life and the hereafter. According to Gazzzali , the term sufi implies a man’s remaining at peace with the world, in mediation upon God. We can say that the Sufis are example of pure spiritual discipline which require a sense of dedication and humanity to get the ultimate goal of life i.e. self-realisation. (shrink)

The first poems about the Prophet Muḥammad appeared while he was alive. These first examples, which are panegyrics (madīḥ, i‛tiẕār, fakhr and ris̱ā), largely reflect the characteristics of the pre-Islamic qaṣīda poetry. Due to the developments in the following centuries, the number of poems about the Prophet increased. And thus, a separate literary genre was formed under the name al-madīḥ al-nabawī. Especially the fact that sufi leaning poets contributed to the literary richness in this field. Another factor is the beginning (...) of the tradition of writing mawlid poems in memory of the birth of the Prophet Muḥammad. The thirteenth century was an important period for poems praising the Prophet Muḥammad. Two important poets emerged in this century. One of them is Egyptian poet al-Būṣīrī and the other is Baghdad's famous poet, Yaḥyā al-Ṣarṣarī. Even after his death, Ṣarṣarî’s works with high literary value were read and memorized in the circles of science, literature and Sufism. Due to his competence in the field, al-Ṣarṣarī was known as the poet of the Prophet and Ḥassān b. Thābit of his time. However, it is understood that his poems, which lost their importance in literary circles over time, were not studied as much as they deserved in the modern period. In this article, his life and works are introduced and basic language and stylistic features of his poems are examined. Also, the image of the Prophet in his poems was determined within the framework of the political conditions of the period.Summary: In the field of madīh nabawī, which first appeared in the ‘Asr al-Sa’āda and has continued to the present day, especially two names stand out in the 7th/13th century, when famous poets such as Macduddīn al-Vitrī (d. 662/1264), Ibn al-Muraḥḥal (d. 699/1300) and Ṣafiyyuddīn al-Ḥillī (d. 749/1348) were also raised. One of them is the Egyptian poet al-Būṣīrī (d. 695/1296), who left his mark on the field of madīh nabawī with his many poems, especially Qaṣīda Burda, and the other is the Iraqi poet Yahya al-Ṣarṣarī (d. 656/1258), who was named Shā‘iru Rasūlillāh (The poet of the Prophet) and Ḥassānu Vaḳtihī (Ḥassān of that period) because of the quality of his poems in this field.al-Ṣarṣarī, was born in the village of al-Ṣarṣar, near Baghdad, spent most of his life in the shadow of Baghdad’s political instability and the social collapse that developed in parallel. He was killed in 656/1258 by the Mongolian forces that invaded Baghdad. al-Ṣarṣarī was extremely knowledgeable in fiqh, hadith, language, and ‘ilm al-qirāa. Our poet adopted the views of the Hanbalī law school. In addition, he turned to Sufism and became a murīd (disciple) of Ali ibn Idrīs al-Ya‘kūbī, a student of Abdalqadīr al-Gīlanī who was accepted as the founder of Qādiriyya. He was closely attached to the Sunnah of the Prophet and was fond of reading the Quran. He was chaste and patient and was content with what he had himself. All his works are poetic and they all concern the madīh nabawī or fiqh.Since his poems, almost all of which are about the praise of the Prophet, have a high literary value, they were read, memorized and narrated for a long time in the circles of science, literature and Sufism. In terms of its structure, his poems are based on the traditional forms of Arab qasīda. In the introductory sections of his poems, he often expresses his longing for Madina. The main subject in poems is usually the Prophet and his superior features. In the last part, he usually says salāt for the Prophet and seeks help from him. It can be said that he used simple language in his poems. The vocabulary reflects the characteristics of the urban life in which he lived. The source of inspiration for his poems are the Qur’an and especially the hadith of the Prophet. He uses the potential of literary arts as much as possible while conveying his feelings. But he does not allow the correct information to be lost due to these arts on a serious subject such as depicting the Prophet. We can see a lot of badī‘ (creative) art in some of his poems. But we can immediately understand that these arts do not spoil the beauty of his expression. The poet provides rhythm and harmony in his poetry with the meter and rhyme in accordance with the classical Arabic qasida rules. In addition, he strengthens the musicality in poetry with puns (jinās) and repetition.The influence of the instability of the region where al-Ṣarṣarī lived on his poems is obvious. According to him, the main reason for the terrible situation that Muslims were in was that they were away from the way of the Prophet. He thought that it would be possible to go back to the old peaceful days by following the way of the Prophet. Perhaps as a result of this opinion, he allocated his qasīda to the narration of the Prophet and his Companions. In his poems, he describes the Prophet with his names, superior qualities, physical and moral characteristics. He says that the sentences describing the Prophet are the ornament of poems and believes that praising him is a mean of salvation in the next world. He also hoped that the poems he said in order to achieve spiritual ascension would protect himself against the troubled events of the period.In his poems, especially on the occasion of mawlīd, al-Ṣarṣarī mentions the Prophet’s physical characteristics and likens his smiling face to a bright full moon, his brows to the letter nûn, his teeth to pearls. He describes the Prophet as a man with black eyes, broad shoulders, born with kohl-lined eyes, and who emanates a beautiful scent as a requirement of his creation. The poet, who also touches on the Prophet’s powerful address, states that his speech is more effective than Luqman’s wise words by virtue of his jawami‘ al-kalim (comprehensive speech) and faṣl al-khiṭab (clear speech), and that his soft address, which states nothing other than the truth, is a blessing from Allah. He additionally describes the Prophet’s plain words, easy to understand by all, as more valuable than jewels. al-Ṣarṣarī, who praises the Prophet in terms of morality with basic human virtues such as bashfulness, justice, modesty, and courage, emphasizes that he is, a paragon of patience, perseverance, kindness, and compassion through analogies such as, “his clothes are peace and perseverance”, his “cover is kindness and forgiveness”. In his world of imagery, the Prophet’s benevolence is so abundant like the rain that the clouds cannot compete with him. Also, he does not shame anybody for what he gives. He bestows the most valuable possessions like gold and camels. Even the respectable personalities of the tribe benefit from his grace. He is so generous that he is giving even when the clouds are stingy about giving rain during times of drought. He welcomes with a smile those who approach him with requests. The donations he makes privately are entirely satisfying.The image of prophethood in al-Ṣarṣarī’s poems, is centralized around the thought of nūr Muhammadī (prophetic light) and the miracles of the Prophet. He reminds that the Prophet never gave up despite the calamities he encountered and that he was supported with extraordinary events in various stages of his life since he was born, and reflects the understanding that the prophet is spiritually supporting the community with his nūr, and in the case the community follow his sunnah, overcoming the Mongolian attacks, which seems like a miracle, is possible. The mention of Qattāl (warrior), Māḥī (eliminator of disbelief), Ẓāhir, Ẓāfir, Manṣūr and Muẓaffar (victorious) among the Prophet’s names, especially those that evoke the superiority he gained in his fight against the disbelievers, giving greater prominence to his courage and valor among his virtues are also related to the political and social conditions of the period. The couplets about the Companions of the Prophet following the couplets that describe the Prophet’s valor, the emphasis of their aid to the Prophet, and the particular mention of their fighter spirit may be considered in the same context. Perhaps, in this way, the poet aims to boost the courage of the Muslims who are exposed to Mongolian attacks with respect to protecting their spiritual and holy values against the enemy. (shrink)

In the ḥadīth sources it is being conveyed that the companions (ṣaḥāba) refrained from asking questions to the Prophet. This situation is generally associated with the verse of sūrat al-Māʾida 5:101. An-Navvās b. Samʿān (d. 50/670), Abū Umāma al-Bāhilī (d. 86/705) and Anas b. Mālik (d. 93/711-12) are among the companions who consider this situation as the ban on the asking questions. The concern that asking questions may cause additional obligations that were not presumed to be obligatory also attracts attention (...) in these records. Keeping all numerous questions addressed to the Prophet in mind we may ask if there is a Prophetic prohibition on asking questions. We will seek an answer to this question, which constitutes the main axis of this article, especially in the framework of the narrations mentioned among the reasons of the al-Māʾida 101. We will evaluate the information concerned in their historical context and internal coherence inductively. Our investigation differs in this respect from the investigations, which dealt with the disapproval of excessive and unnecessary questions. As a result of our research, we think that it is possible to talk about a ban on asking questions about religious issues in the last three years of the Medina period. We will first discuss the dating and nature of this ban, from which only Bedouin and visitors who come to Madina were excluded. Then, we especially will evaluate the theological consequences of answer of the Prophet, which mentioned in the same context, of whether the pilgrimage is religious duty for every year. In the last part of the article, the prohibition of asking questions will be discussed in the light of Hans-Georg Gadamer’s principle “Der hermeneutische Vorrang der Frage”, which deals with the effect of the questions on the direction and nature of the answer.Summary: It is reported in Qurʾān and Ḥadīth that the Prophet Muḥammad (PBUH) was asked a lot of questions and he responded based on the revealed knowledge or his own. He did not like the questions which remain outside of the daily religious life like the questions whether he is able to know the end of the world or to show miracle. There are some reports which covey that the Prophet frowned upon some questions because they could cause new assignments or lead to complicate the existing ones. The Companions like an-Nawwās b- Samʿān (d. 50/670), Abū Umāma al-Bāhilī (d. 86/705) and Anas b. Mālik (d. 93/711-12) have been describing this situation as the ban of asking of religious implications.This issue which companions formulated exactly as the ban of the asking questions was regarded in research until now just as the depreciation of the Prophet upon the unnecessary questions. In this interpretation the idea played a role that the ban of the asking may not conform to the religious pedagogic of the Prophet and the real existence of a lot of asked questions contradict that. Therefore the imperative “do not ask” in al-Māʾida 5:101 (O believers, do not ask about things which, if made known to you, may vex you) were interpreted not as the prohibition of the asking questions in real sense, but as just the depreciation of the unnecessary questions.We argue that it is possible to talk about a prohibition of the asking questions in real sense. We are of the view that the asking to religious matters was prohibited in the last years of the Medina period. In a time of Madina period when the fundamental principles of Islam emerged the questions of companions let the Prophet think that they may lead to additional religious obligations. Therefore the Prophet warned his companions in these words: “Do not ask me about the details of the things which I do not mention to you” and “Allāh Taʿālā has remained silent about some things, out of compassion for you, not forgetfulness so do not seek after them.”The imperative “do not ask” in al-Māʾida 5:101 has to been understood in the light of the Prophet’s advice as quoted above. According to the expressions of the companions reported in hadith collections, it is obvious that the imperative “do not ask” signifies not only “do not ask unnecessary questions”, but “do not ask questions related to theology matters in general”.Anas b. Mālik served the Prophet nine or ten years and was not criticised by the Prophet anytime. A companion like Anas cannot have refrained from the asking questions because they may be unnecessary. Anas interpreted “ do not ask” in al-Māʾida 5:101 in words: “We were forbidden in the Qurʾān that we ask the Prophet anything". Anas’s observation reveals that the companions considered the “do not ask” in al-Māʾida 5:101 as a general prohibition for the questions to religious issue.According to our research it seems this ban was promulgated in last three years of Medina Period, and Bedouin and visitors were excluded. Al-Nawwās b. Samʿān noticed that the ban of the asking questions was only for the residents in Medina: “I was in Medina one year. The reason why I did not stay in Medina was my wish to ask the Prophet a religious issue. So, whoever stayed in Medina was not permitted to ask the Prophet questions.” Abū Umāma al-Bāhilī interpreted the ban of the asking in al-Māʾida 5:101 as a general ban. He reported that the companions give a garment (burda) as gift to a Bedouin in order to let him ask the Prophet questions. The ban on asking questions in Medina was not related to unnecessary questions. It was indeed related to the questions that might have caused addition to already well-defined obligatory rulings in Islam. Accordingly, the questions became unnecessary because they were asked in the time of revelation. With the ban of the asking the Prophet questions accentuated that God and his Messenger are aware what necessary and what was not. It means that God can intervene if it is necessary. For that they do not need ask the Prophet. Aṭ-Ṭabarī, al-Qurṭubī, en-Nawawī, Ibn RaJab el-Ḥanbalī and Ibn Ḥajar al-ʿAsqalānī are the scholars who interpreted the ban of asking in this general sense.We especially will evaluate the theological consequences of the Prophet’s response, as reported in the sources: “ If I said yes, the pilgrimage will be a religious duty for every year.” Here one may not misconstrue that the Prophet could determine the religious obligations arbitrarily. He meant that the believers have to practice only that which were revealed to them. The Prophet wanted to teach his followers the principle that became essential rule of Islamic jurisprudence: “What is not forbidden is permitted”.The Prophet did not perform tarāwīḥ-prayer in congregation in the month of fasting due to the apprehension that it might become obligatory for the believers and they would not be able to follow it. In this human reaction of the Prophet we see that the Prophet did not consider himself as the founder of the Islamic norms. In this context the following questions are important: Does God consider the human questions when making something obligatory? Is God influenceable in terms of His orders? Ibn Ḥajar observes: The scholars of Ahl al-Sunnah accept the causality in terms of the Islamic norms. Accordingly something can become a religious norm because the humans asked about that. But God’s decision does not depend on the humans. God can consider human questions, if He so wills. (shrink)

The Tafsīr al-Muqātil (d. 150/767) is the oldest available complete commentary text. In this respect, it has been a focus of attention. In this tafsīr, the references to the Battle of Badr in the explanation of some Makkī surahs are remarkably numerous. Badr was the first war that the Prophet made with the polytheists of Makkah, and it took place in the second year of the migration to Madīna (A. H. 2). The polytheists were far superior to the Muslims in (...) terms of both equipment and numbers. Therefore, the success achieved in this expedition meant a lot not only in terms of survival but also in terms of morale of Muslims. Details of this war are included in Surah Anfāl, and various aspects of it are referred to in other Madanī surahs. It is not difficult to understand the mention of such an important war in Madanī surahs. However, the references to the Battle of Badr -which has not yet taken place- in the commentary of the Makkī surahs, are particularly challenging. In this tafsīr, 66 verses of various Makkī surahs are explained through the Battle of Badr. This study was carried out in order to reveal the background of the Badr references of the Makkī surahs in Muqātil tafsīr. Muqātil stands out in the Hadith in terms of reliability, and in the Kalām as a widely discussed personality with his various views. Although he has been criticized from various aspects of his Tafsīr, it is generally considered a great authority. His work is easy to understand; it combines narration and insight. The similar of every possible verse has been given. The author's mastering at the Arabic language showed itself in the words of the Qur’ān. Almost no words remained unexplained. Muqātil is closely related to the Arabic language that had been in effect in the era of revelation, and he generally carried out his tafsīr activities by considering the era of revelation. In Muqātil's view of tafsīr, no verse is independent from the experiences of the period, and each verse gains meaning with its context. In his tafsīr, Muqātil draws a view of Badr without alternatives. While other tafsīrs include other achievements of Muslims in addition to Badr, such as the victory of the Battle of the Ditch and the conquest of Makkah, in the tafsīr of Muqātil the difference of Badr as the biggest blow against the polytheists of Makkah is clearly stated. It may not be very convincing to explain his insistence on Badr as random touches and sometimes anachronistic mistakes, given his skill in tafsīr and his command of the Qur’ān in terms of both content and language. Badr stands as a conscious choice, not a mistake in Muqātil. As it can be seen in examining the verses, the forward-looking statements present in the majority of the verses; this emphasis also prepared the ground for Muqātil's explanations. In any case, Muqātil sometimes did not care about falling into historical inconsistency. If we exclude these 5 verses, which can be explained with Badr although they are Makkī, the attitudes of other commentators regarding the emphasis of Badr in the Makkī verses in the remaining 61 verses are as follows: al-Ṭabarī (d.310/923) included the views pointing to Badr in only 3 of the 61 verses in his tafsīr. This shows us that the emphasis of Badr in the Makkī verses was not generally adopted by other early commentators except Muqātil. Because in al-Ṭabarī's tafsīr, the views on tafsīr from the era of Aṣ-ṣaḥābah (the Companions), Tābiʿūn (the second generation following the Companions) and Tābiʿū al-Tābʿīn (the third generation) are mentioned together with isnad (the chain of reporters), except for Muqātil and al-Kalbī. al-Zad̲j̲d̲j̲ād̲j̲ (d. 311/923), who was contemporary of Ṭabarī, included Badr in only two of the 61 verses in his philological tafsīr. In other words, al-Zad̲j̲d̲j̲ād̲j̲ is on a very different line from Muqātil regarding Badr. al-Māturīdī (d. 330/944) included Badr among other explanations in only 4 of the 61 verses in his tafsīr, and did not mention Muqātil's view even among the possible meanings of the other verses. al-Rāzī (d. 606/1210) included Badr in 10 of 61 verses among other explanations. In the remaining 51 verses, he did not find it necessary to mention Muqātil's view along with other possibilities. Apparently, al-Rāzī, like others, did not consider Muqātil's explanations reasonable. Nevertheless, Razi was the commentator who gave greater place to the Badr emphasis of Muqātil in his tafsīr. In this case, how can the passion for Badr, seen in the Muqātil tafsīr, be explained? We think it would be correct to seek the reasons of Muqātil's -sometimes reasonable, sometimes inappropriate, and sometimes anachronistic- explanations of Badr in the importance he gave to this expedition and in the method of relying on concrete data in the interpretation of the Qur’ānic verses. Ibn al-Qāṣṣ (d. 335/946), one of the representatives of the Shāfiʿī school of law in the 4th/10th century, compiled a short treatise of extraordinary nature: Fawāʾid Ḥadīth Abī ʿUmeyr. In this work, he deduces sixty different wajhs (verdicts, comments) from a ḥadīth reporting the Prophet’s interest and affection to a child known as Abū ʿUmayr and his family during a visit he paid after Abū ʿUmayr’s birdie died by jokingly telling him in rhyme, “yā Abā ʿUmayr, mā faʿala al-nughayr” (O (...) Abū ʿUmayr, what happened to the nughayr?) This study deals with the primary goal of the composition of the Fawāʾid, its content, and structural qualities as well as the author’s approach in deducing verdicts. As one of the aṣḥāb al-wujūh, the author’s legal/madhhab notion and the literalist and external perspective he developed regarding the interpretation of texts, seems to have directly affected his deductive reasoning and determined his approach. This concise work not only sheds light over certain aspects of the relationship between ḥadīth and fiqh at the time of Ibn al-Qāṣṣ, but also exemplifies to what extent methodological tendencies and personal factors might affect the process of deriving verdicts from ḥadīth and could push the limits in that regard. The report of Abū ʿUmayr, which is in the focus of the work, is, in essence, reflects a singular and special aspect of the close relationship between the Prophet and Anas b. Malik’s family. Nevertheless, it is surprising that many ḥadīth scholars from the early times, not only Ibn al-Qāṣṣ, have chosen this ḥadīth as an example in which they can demonstrate their skill in the field of fiqh al- ḥadīth. Fawāʾid seems to be a work in which the juridical point of view centered and resembles the classical fiqh commentaries in a sense. In the work, different variants of the Abū ʿUmayr report were brought together and evaluated within the framework of the text and textual possibilities as possible. The author also analyzed some words in the narrative text for being a base for a verdict, referred to Qurʾānic verses, prophetic ḥadīths, reports, and legal opinions, tried to solve the disputes and the conflicts among legal evidences in various ways, and stated occasionally his personal opinions. Fawāʾid reflects the author’s rich accumulation of legal knowledge, while at the same time gives an idea about his knowledge of ḥadīth and his approach to the ḥadīth. Considering what the author did and wanted to do, it is understood that he deals with ḥadīth as well as fiqh, and he has a certain level of relationship not only with fuqahāʾ (muslim jurisprudents), but also with ḥadīth scholars. Ibn al-Qāṣṣ’s interest in fiqh and ḥadīth must have lead him to take initiative to eliminate the tension between the ahl al-ḥadīth of Shāfiʿī school of law who focused on transmitting ḥadīths and the fuqahāʾ of Shāfiʿī school of law who care about the fiqh perspective, in that period of time. It can also be said that he tried to establish a reconciliation between the ahl al-ḥadīth (the traditionists) and the ahl al-raʾy (the rationalists) and bring the parties together in the middle way. The work seems to have been written as a result of such considerations. As Ibn al-Qāṣṣ was considered as one of the aṣḥāb al-wujūh, that is, as a jurist who was bound of a madhhab Imām for legal reasoning, he seems to have followed the methodology of Shāfiʿī school of law for deriving legal solutions from the sources. Legal notion of the author and his literalist and textualist perspective with regards to the interpretation of texts, seems to have directly affected his way of reasoning from the ḥadīth and determined his approach. This approach, as mentioned in many contemporary studies, is not sufficient and appropriate for the evaluation of ḥadīth texts, which were transmitted by meaning, not word-by-word, and shaped by the transmitter’s dispositions. It is also difficult to say that Ibn al-Qāṣṣ sufficiently considered the physical, historical, social, and cultural context surrounding the text as well as other extra-textual elements, which complete the meaning. This situation implies that some of the wajhs recorded in the work are the author’s attempt to find a base and evidence for his ideas, which he already had, rather than deductions drawn from the ḥadīth. It makes the scientific quality and accuracy of his efforts controversial. The verdicts presented in the work, as wajh and fāʾida are predominantly jurisprudential and compatible with the opinions of the Shāfiʿī School of law, however, there are also controversial ones, and the author pointed to them without revealing his own tendency. It does not seem that these wajhs in the work are systematically ranked. In this vein, similar wajhs are sometimes in succession, sometimes scattered, and some wajhs are repetitive. The degree of accuracy, clarity and quality of some wajhs also seem arguable. Zayn al-Dīn al-ʿIrāqī (d. 806/1404), who made a general evaluation of these wajhs, said that: “Some of the (meanings of the) wajhs in the work are apparent, some of them are hidden and some are strained.” The work’s editor drew attention in the footnotes to the wajhs, which might be subject to objection. The early ḥadīth scholars, who reported this ḥadīth in their compilations, deduced six or seven judgments from the ḥadīth under the headings (bāb) specified for this ḥadīth. This appears quite modest in comparison to the treatise of Ibn al-Qāṣṣ. The given ḥadīth has also taken its place in the fiqh literature, and it has been questioned in the context of the issue of Madīna’s being of ḥarām region (holy land) and hunting ban in this region. In conclusion, Ibn al-Qāṣṣ’s treatise of Fawāʾid Ḥadīth Abī ʿUmayr, is a short but worthy example of the ḥadīth literature in terms of its purpose and interesting content. This work can be considered as a study that exemplifies how the purpose of writing can be determinative on the structure of a work, and in particular to what extent methodological tendencies and personal factors might affect the process of deriving verdicts from ḥadīth and could push the limits in that regard. The author’s universe of meaning, which focused on the apparent meaning and to draw as many judgments as possible from the text, should be related to his personal intention and purpose as well as to the fiqh perspective of his time. Due to the textual approach and the method for drawing inferences, which are observed in the work, the tool-purpose relationship between the text and the judgment sometimes remains obscure and sometimes becomes unimportant. In some respects, this work is a striking example of the consequences of ignoring the context and historical reality surrounding texts for specific purposes. (shrink)

The article explores the location of Central and Eastern Europe in transnational feminist studies. Despite the acknowledgement of the situatedness of knowledge, feminist theorising nevertheless seems to continue to be organised around a limited number of central axes and internalised progress narratives. The authors argue that there is a pressing need for theories which can approach the near absence of Central and Eastern European perspectives from transnational feminist theorising, and challenge the limited number of discursive tropes associated with post-socialist Central (...) and Eastern Europe – especially that of a ‘lag’, where difference is translated into a temporal distance. Instead, the authors suggest that a more inclusive vision of transnational feminist studies can be achieved by applying the decolonial framework to the post-socialist context, as explicated in the work of Madina Tlostanova.
