This paper shares results from a pedagogical experiment that assigns undergraduates to “cheat” on a final class essay by requiring their use of text-generating AI software. For this assignment, students harvested content from an installation of GPT-2, then wove that content into their final essay. At the end, students offered a “revealed” version of the essay as well as their own reflections on the experiment. In this assignment, students were specifically asked to confront the oncoming availability of AI as a (...) writing tool. What are the ethics of using AI this way? What counts as plagiarism? What are the conditions, if any, we should place on AI assistance for student writing? And how might working with AI change the way we think about writing, authenticity, and creativity? While students (and sometimes GPT-2) offered thoughtful reflections on these initial questions, actually composing with GPT-2 opened their perspectives more broadly on the ethics and practice of writing with AI. In this paper, I share how students experienced those issues, connect their insights to broader conversations in the humanities about writing and communication, and explain their relevance for the ethical use and evaluation of language models. In the last two decades there has been a meteoric rise of international criminal tribunals and courts and also a strengthening chorus of critics against them. Today it is hard to find strong defenders of international criminal tribunals and courts. This book attempts such a defense against an array of critics. It offers a nuanced defense, accepting many criticisms but arguing that the idea of international criminal tribunals can be defended as providing the fairest way to deal with mass atrocity (...) crimes in a global arena. Fairness and moral legitimacy will be at the heart of this defense. The authors take up the economic and political arguments that have been powerfully expressed, as well as arguments about sovereignty, punishment, responsibility, and evidence; but in the end they show that these arguments do not defeat the idea of international criminal courts and tribunals. Can Covid-19 vaccines be used off-label? Should they be? These were questions on the minds of parents, pediatricians, and the media when the FDA fully approved the Pfizer-BioNTech Covid-19 vaccine for people aged 16 and up. Yet the American Academy of Pediatrics cautioned against pediatric off-label use of the vaccine, and the CDC Covid-19 Vaccine Provider Agreement appears to prohibit it. After briefly contextualizing ethical and legal precedents regarding off-label use, we offer an analysis of the ethical permissibility of and (...) considerations for pediatric off-label Covid-19 vaccination based on individual benefits, risks, and available alternatives. Our analysis challenges the ethics of a blanket prohibition on off-label pediatric Covid-19 vaccination, as it limits clinician ability to provide care they may determine to be clinically and ethically appropriate. At the same time, our analysis acknowledges that Covid-19 creates population-level ethical considerations that are at times in tension with individual health interests. (shrink)

In this article, I consider the possibilities and limitations for testimonial justice in an international criminal courtroom. I begin by exploring the relationship between epistemology and criminal law, and consider how testimony contributes to the goals of truth and justice. I then assess the susceptibility of international criminal courts to the two harms of testimonial injustice: epistemic harm to the speaker, and harm to the truth-seeking process. I conclude that international criminal courtrooms are particularly susceptible to perpetrating testimonial injustice. Hearers (...) in the international criminal courtroom should practice testimonial justice, but the institution is not structured in a way that can prevent every instance of testimonial injustice. The article argues that Nicholson's editorship of the Journal of Natural Philosophy, Chemistry, and the Arts was a means to expand his philosophical significance among natural philosophers at (...) home and abroad—and was, in fact, a form of epistemological subversion that challenged the “Banksian Learned Empire.”. In ‘The Complex Case of Ellie Anderson’, Joona Rasanen and Anna Smajdor raise several ethical questions about the case. One question asks, but does not answer, whether Ellie faced discrimination for being transgender when her mother was not allowed access to Ellie’s sperm following her death. In raising the question, the authors imply anti-trans bias may have influenced this determination. However, this inference is not supported by current ethical and legal guidance for posthumous use of gametes, with which Ellie’s case (...) is consistent. We consider the authors’ responses to their other ethical queries, and how their suggestions for what options might have been available to Ellie and her family are instructive for addressing attempts in the USA and UK to restrict minors’ access to gender-affirming medical treatment, including puberty-blocking therapy. Decades of research have focused on children's reasoning about math equivalence problems for both practical and theoretical insights. Not only are math equivalence problems foundational in arithmetic and algebra, they also represent a class of problems on which children's thinking is resistant to change. Feedback is one instructional tool that can serve as a key trigger of cognitive change. In this paper, we review all experimental studies on the effects of feedback on children's understanding of math equivalence. Meta-analytic results indicate (...) that feedback has positive effects for low-knowledge learners and negative effects for high-knowledge learners, and these effects are stronger for procedural outcomes than conceptual outcomes. Findings highlight the variable influences of feedback on math equivalence understanding and suggest that models of thinking and reasoning need to consider learner characteristics, learning outcomes, and learning materials, as well as the dynamic interactions among them. A long-standing theme in discussion of perception and thought has been that our primary cognitive contact with individual objects and events in the world derives from our perceptual contact with them. When I look at a duck in front of me, I am not merely presented with the fact that there is at least one duck in the area, rather I seem to be presented withthisthing (as one might put it from my perspective) in front of me, which looks to (...) me to be a duck. Furthermore, such a perception would seem to put me in a position not merely to make the existential judgment that there is some duck or other present, but rather to make a singular, demonstrative judgment, that that is a duck. My grounds for an existential judgment in this case derives from my apprehension of the demonstrative thought and not vice versa. (shrink)

When soldiers come home from war, some experience lingering emotional effects from the choices they were forced to make, and the outcomes of these choices. In this article, we consider the gap between objective assessments of blame and subjective assessments of self-blame, guilt, and shame after war, and we suggest a way of understanding how soldiers can understand their moral responsibility from both of these vantage points. We examine arguments from just war theory regarding the objective moral responsibility of combatants (...) and consider the role moral luck plays in our assessment of moral responsibility. We then use P.F. Strawson’s account of the reactive attitudes to demonstrate the limitations of focusing excessively on the objective stance to determine the blameworthiness of soldiers. We argue that we should think about blame alongside moral emotions like guilt and shame, which will allow us to better understand subjective blame and the experiences of soldiers who blame themselves after war. We claim that objective determinations of heroism or responsibility do not adequately capture the complexity of moral emotions for soldiers returning home after war. As part of a shared moral community, civilians owe veterans more than automated responses based on the civilian experience. (shrink)

In this article, I argue that we need a better understanding of the theoretical underpinnings of the current debates in international law surrounding hate speech and inchoate crimes. I construct a theoretical basis for speech acts as incitement to genocide, distinguishing these speech acts from speech as genocide and speech denying genocide by integrating international law with concepts drawn from speech act theory and moral philosophy. I use the case drawn on by many commentators in this area of international criminal (...) law, the trial of media executives for the roles they played in the Rwandan genocide through public speech acts by media entities insulting an ethnic group or advocating violence against an ethnic group. Each of these men were institutional leaders and were charged with using their positions within Rwandan society to distribute what I call genocidal hate speech, genocidal incitement speech, and genocidal participation speech. I argue for a distinction between these three types of speech, and a difference in individual criminal liability for the dissemination of each type of speech. I also argue that there should be a difference in individual criminal liability for speech acts within the context of an ongoing or recent genocide, and speech acts that can be separated from a site of mass violence. In the decades after the Second World War, learned society publishers struggled to cope with the expanding output of scientific research and the increased involvement of commercial publishers in the business of publishing research journals. Could learned society journals survive economically in the postwar world, against this competition? Or was the emergence of a sales-based commercial model of publishing – in contrast to the traditional model of subsidized journal publishing – an opportunity to transform the often-fragile finances of learned societies? (...) But there was also an existential threat: if commercial firms could successfully publish scientific journals, were learned society publishers no longer needed? This paper investigates how British learned society publishers adjusted to the new economic realities of the postwar world, through an investigation of the activities organized by the Royal Society of London and the Nuffield Foundation, culminating in the 1963 report Self-Help for Learned Journals. It reveals the postwar decades as the time when scientific research became something to be commodified and sold to libraries, rather than circulated as part of a scholarly mission. It will be essential reading for all those campaigning to transition academic publishing – including learned society publishing – away from the sales-based model once again. (shrink)

Miller recently dubbed the ‘Sobel Effect’. Academic historians of science have been concerned by this flood, partly because people other than them are making money out of ‘their’ subject, but also because of the ways it might affect the public perception of the history of science. This book defends antitheodicism, arguing that theodicies, seeking to excuse God for evil and suffering in the world, fail to ethically acknowledge the victims of suffering. The authors argue for this view using literary and philosophical resources, commencing with Immanuel Kant's 1791 "Theodicy Essay" and its reading of the Book of Job. Three important twentieth century antitheodicist positions are explored, including "Jewish" post-Holocaust ethical antitheodicism, Wittgensteinian antitheodicism exemplified by D.Z. Phillips and pragmatist antitheodicism defended by William James. The authors argue (...) that these approaches to evil and suffering are fundamentally Kantian. Literary works such as Franz Kafka'sThe Trial, Samuel Beckett's Waiting for Godot, and George Orwell's Nineteen Eighty-Four, are examined in order to crucially advance the philosophical case for antitheodicism. This article examines the evolution of peer review and the modern editorial processes of scholarly journals by analyzing a novel data set derived from the Royal Society’s archives and covering 1865-1965, that is, the historical period in which refereeing became firmly established. Our analysis reveals how the Royal Society’s editorial processes coped with both an increasing reliance on refereeing and a growth in submissions, while maintaining collective responsibility and minimizing research waste. By engaging more of its fellows in editorial activity, (...) the society was able to establish an equilibrium of number of submissions per reviewer that was relatively stable over time. Nevertheless, our analysis shows that the distribution of editorial work was significantly uneven. Our findings reveal interesting parallels with current concerns about the scale and distribution of peer review work and suggest the strategic importance of the management of the editorial process to achieve a creative mix of community commitment and professional responsibility that is essential in contemporary journals.
