We define and investigate a uniformly locally o-minimal structure of the second kind in this paper. All uniformly locally o-minimal structures of the second kind have local monotonicity, which is a local version of monotonicity theorem of o-minimal structures. We also demonstrate a local definable cell decomposition theorem for definably complete uniformly locally o-minimal structures of the second kind. Consider a definably complete uniformly locally o-minimal expansion of the second kind of a densely linearly ordered abelian group. Let $f:X \rightarrow R^n$ be a definable map, where X is a definable set and R is the universe of the structure. We demonstrate the inequality $\dim ) \leq \dim $ in this paper. As a corollary, we get that the set of the points at which f is discontinuous is of dimension smaller than $\dim $. We consider locally o-minimal structures possessing tame topological properties shared by models of DCTC and uniformly locally o-minimal expansions of the second kind of densely linearly ordered abelian groups. We derive basic properties of dimension of a set definable in the structures including the addition property, which is the dimension equality for definable maps whose fibers are equi-dimensional. A decomposition theorem into quasi-special submanifolds is also demonstrated.

We first show that the projection image of a discrete definable set is again discrete for an arbitrary definably complete locally o‐minimal structure. This fact together with the results in a previous paper implies a tame dimension theory and a decomposition theorem into good‐shaped definable subsets called quasi‐special submanifolds. Using this fact, we investigate definably complete locally o‐minimal expansions of ordered groups when the restriction of multiplication to an arbitrary bounded open box is definable. Similarly to o‐minimal expansions of ordered (...) fields, Łojasiewicz's inequality, Tietze's extension theorem and affiness of pseudo‐definable spaces hold true for such structures under the extra assumption that the domains of definition and the pseudo‐definable spaces are definably compact. Here, a pseudo‐definable space is a topological space having finite definable atlases. We also demonstrate Michael's selection theorem for definable set‐valued functions with definably compact domains of definition. (shrink)

BackgroundFew comparative studies of clinical ethics consultation practices have been reported. The objective of this study was to explore how American and Japanese experts analyze an Alzheimer's case regarding ethics consultation.MethodsWe presented the case to physicians and ethicists from the US and Japan (one expert from each field from both countries; total = 4) and obtained their responses through a questionnaire and in-depth interviews.ResultsEstablishing a consensus was a common goal among American and Japanese participants. In attempting to achieve consensus, the (...) most significant similarity between Japanese and American ethics consultants was that they both appeared to adopt an "ethics facilitation" approach. Differences were found in recommendation and assessment between the American and Japanese participants. In selecting a surrogate, the American participants chose to contact the grandson before designating the daughter-in-law as the surrogate decision-maker. Conversely the Japanese experts assumed that the daughter-in-law was the surrogate.ConclusionOur findings suggest that consensus building through an "ethics facilitation" approach may be a commonality to the practice of ethics consultation in the US and Japan, while differences emerged in terms of recommendations, surrogate assessment, and assessing treatments. Further research is needed to appreciate differences not only among different nations including, but not limited to, countries in Europe, Asia and the Americas, but also within each country. This paper analyses and compares some of the automated reasoners that have been used in recent research for compliance checking. Although the list of the considered reasoners is not exhaustive, we believe that our analysis is representative enough to take stock of the current state of the art in the topic. We are interested here in formalizations at the _first-order_ level. Past literature on normative reasoning mostly focuses on the _propositional_ level. However, the propositional level is of little usefulness for (...) concrete LegalTech applications, in which compliance checking must be enforced on (large) sets of individuals. Furthermore, we are interested in technologies that are _freely available_ and that can be further investigated and compared by the scientific community. In other words, this paper does not consider technologies only employed in industry and/or whose source code is non-accessible. This paper formalizes a selected use case in the considered reasoners and compares the implementations, also in terms of simulations with respect to shared synthetic datasets. The comparison will highlight that lot of further research still needs to be done to integrate the benefits featured by the different reasoners into a single standardized first-order framework, suitable for LegalTech applications. The main purpose of this book is to offer to philosophers and students abroad who show a great interest in Japanese philosophy and the philosophy of the Kyoto school major texts of the leading philosophers. This interest has surely developed out of a desire to obtain from the thought of these philosophers, who stood within the interstice between East and West, a clue to reassessing the issues of philosophy from the ground up or to drawing new creative possibilities.The present condition (...) seems to be, however, that the material made available to further realize this kind of intellectual dialogue is far too scarce. This book is intended to be of some help in this regard.The book presents selected texts of representative philosophers of the Kyoto school such as Nishida Kitaro, Tanabe Hajime, Miki Kiyoshi, Nishitani Keiji, and others who best illustrate the characteristics of this school, and works that together portray its image as a whole. Those who are interested in Japanese philosophy or specifically the philosophy of the Kyoto School can survey a comprehensive representation from this book.These texts are, of course, quite difficult and cannot be well understood without sufficient preliminary knowledge. Expository essays have therefore been included after each text to provide guidance. In each of these commentaries a scholar of our time with deep understanding of the philosopher in question has provided an account of his life, intellectual journey, and the significance of the text included here.From this book will emerge a new dialogue of ideas that in turn will engender new developments in philosophy, thereby further expanding the network of philosophical thought worldwide. In the October edition of the Journal of Medical Ethics, Akabayashi and colleagues state that ’to establish a heterogeneous [induced pluripotent stem cell] iPSC bank covering roughly 80% of Japan’s population…the Japanese government decided to invest JPY110 billion over 10 years in regenerative medicine research; a quarter of this was to be allocated to the iPSC stock project'. While they claim this amount of money to be an unfair distribution of state resources, we believe their assessment is based on a (...) misunderstanding of the facts. Similarly, other criticisms by them are based on mistaken interpretations. This article is a rebuttal to the arguments that form the basis of Akabayashi and colleagues’ five criticisms by explaining their misinterpretations. (shrink)

Sparrow highlights three potential applications of in vitro eugenics, that is, (a) research into the heredity of genetic disorders, (b) production of cell lines with specific genotypes, and (c) breeding better babies, and points to the need for researchers to discuss in advance the potential ethical problems that may emerge if the realization of this technology occurs in the near future. In this commentary, we pose a question for the sake of discussion. Is it, in fact, appropriate to label all (...) three applications raised by Sparrow as eugenics? By doing so, an unnecessary level of concern might be borne among the public, and as a result, the sound development of this specialized technology would be affected. If the label of eugenics is to be applied to all three of these applications, then Sparrow must justify how he perceives (a) and (b) as not inherently different from (c). (shrink)

When I deliver an introductory lecture on Japanese Philosophy, I always raise the following question: Is it appropriate to modify the word philosophy with an adjective such as Japanese? Philosophy is, after all, a discipline that addresses universal problems, and so transcends the restrictions implied in geographical descriptors. However, as Kuki Shūzō argues in his essay “Tokyo and Kyoto,” I think that this is only part, and not the whole truth of the matter.One’s thinking takes place within the framework of (...) one’s cultural heritage, and the different nuances of each of the words one uses can influence how one thinks. It is for this reason that every philoso­phy has its own unique character. As Otto Pöggeler suggests, there is something about the thought of Japanese philosophers such as Nishida Kitarō and Nishitani Keiji that does not fit easily into the framework of “philosophy” in the Western tradition. This is a conse­quence of the fact that they did not simply passively adopt, but rather attempted to critically challenge Western philosophy. I suppose that their grounding in Japanese and other Eastern traditions contributed to their critical challenge of Western philosophy. And I submit that there is a strong tendency in traditional East Asian thought to not simply grasp things within a presupposed framework of “knowledge,” but rather, since “knowledge” itself is understood to be a certain kind of restriction, to return to its roots.Needless to say, neither Nishida’s nor Nishitani’s thought is merely a philosophical reiteration of such traditional East Asian teachings. Nevertheless, we can say that the East Asian idea that knowledge is at root something restrictive lives on in their thinking. The radical­ity of Nishida’s and Nishitani’s thought can be understood to lie in the manner in which they cast light on the limits of the “knowledge” pursued by Western philosophy, problematizing the basis on which this knowledge is established as well as the framework it sets up.I think that the “character” of this or that philosophy arises from such different ways of seeing things and different attitudes toward “knowledge.” It is crucial to point out, however, that the gaps resulting from these differences need not become hindrances for philosophical thinking. Indeed, I think that the existence of such gaps, rather than hindering “dialogues” between different philosophies, is precisely what enables them to be meaningful. This is also what I have in mind when I stress the importance of dialogue in my lectures on Japanese philoso­phy. It is, after all, the creative dialogue engendered in this manner that enables philosophy to progress along its path of radical inquiry. (shrink)

In this article, we provide an ethical analysis of the first porcine cardiac xenotransplant, performed in Maryland, USA in early 2022. David Bennett was offered the experimental procedure after he was deemed ineligible for human heart transplantation and mechanical circulatory support, based on a history of non-compliance. It was reported that Mr Bennett’s previous instances of non-compliance were for medically non-life-threatening conditions years earlier, where the risks of non-compliance were not as high. We argue that, in Mr Bennett’s case, a (...) history of non-compliance in a different context, should not necessarily rule him ineligible for a potentially life-saving treatment now. Furthermore, using previous non-compliance to exclude individuals from donor organs may have the unintended effect of placing the burden of testing xenotransplantation on those who are already disadvantaged. We then argue that it is not enough to rely on patient consent to ethically justify xenotransplantation research. Taking a broad ethical perspective is crucial when mapping a clinical pathway for xenotransplantation. (shrink)

BackgroundThe Act Regarding the Promotion of the Appropriate Supply of Hematopoietic Stem Cells for Transplant regulates only how public banks store and provide umbilical cord blood for research or transplantation. Japan had no laws to regulate how the private banks manage the procedures, harvesting, preparation, and storage of such blood. As a result, the status of UCB distribution remains unknown. We conducted a survey to investigate the current status of UCB storage and provision to private biobanks by Japanese institutions that (...) handle childbirth.MethodsQuestionnaire forms were mailed to 3,277 facilities handling childbirth that were registered in the Japan Council for Quality Health Care website.ResultsOf the 1,192 institutions handling childbirth that participated in the survey, 34.4% responded that they currently provide UCB to private biobanks, while 16.1% of facilities did so in the past. Moreover, some institutions currently provide or formerly provided UCB to medical treatment facilities, research institutions, companies, or overseas treatment facilities, research institutions, or companies. A certain number of institutions handling childbirth did not even provide explanations or obtain consent when the UCB was harvested from private bank users.ConclusionsThis is the first study to determine the status of UCB provision to private banks by Japanese institutions handling childbirth. Future studies will need to examine in detail how institutions handling childbirth provide explanations to private bank users and UCB providers as well as how these institutions obtain consent. We study definably complete locally o‐minimal expansions of ordered groups. We propose a notion of special submanifolds with tubular neighborhoods and show that any definable set is decomposed into finitely many special submanifolds with tubular neighborhoods.

The following two assertions are equivalent for an o-minimal expansion of an ordered group $$\mathcal M=(M,<,+,0,\ldots )$$. There exists a definable bijection between a bounded interval and an unbounded interval. Any definable continuous function $$f:A \rightarrow M$$ defined on a definable closed subset of $$M^n$$ has a definable continuous extension $$F:M^n \rightarrow M$$.

We define a discrete closure operator for definably complete locally o‐minimal structures. The pair of the underlying set of and the discrete closure operator forms a pregeometry. We define the rank of a definable set over a set of parameters using this fact and call it ‐dimension. A definable set X is of dimension equal to the ‐dimension of X. This paper discusses sufficient conditions for a definably complete expansion of a densely linearly ordered abelian group to have uniformly locally o‐minimal open cores of the first/second kind and strongly locally o‐minimal open core, respectively.

We present a sequent calculus of a paraconsistent logic QMPT0, which has the paraconsistent-type excluded middle law (PEML) as an initial sequent. Our system shows that the presence of PEML is essentially important for QMPT0. It also has special rules when the set of constant symbols is finite. We also discuss the cut-elimination property of our system.

The massive and unstoppable emergence of electronic books in libraries has altered their organization. This disruptive technology has led to structural changes. Currently, an e-book exists only if its metadata exists. The objective of this article is to analyse the impact that the massive incorporation of electronic books in university library systems is having in the processes of assignment of subject headings and classification codes. We carried out a survey of more than six hundred libraries, which means almost all the (...) university libraries in Portugal, Spain, England, United States, Brazil, Sweden, Norway, Finland and Australia. From the results obtained, it is deduced that: 1) librarians expect e-books to be provided with descriptive metadata related to the subject headings and classification codes; 2) the bibliographic records provided by publishers/providers seem to be improvable; 3) the quality of the metadata provided by the providers does not seem to be taken into account when selecting publishers for the purchase; 4) the discovery tools are also clearly improvable; 5) it seems that there is no “frustration” or “stress” among librarians about the changes produced in relation to technical processes; and, 6) it does not seem that we are facing a paradigm shift motivated by these issues. BackgroundPrevious studies have found that the decision-making process for stored unused frozen embryos involves much emotional burden influenced by socio-cultural factors. This study aims to ascertain how Japanese patients make a decision on the fate of their frozen embryos: whether to continue storage discard or donate to research.MethodsTen Japanese women who continued storage, 5 who discarded and 16 who donated to research were recruited from our infertility clinic. Tape-recorded interviews were transcribed and analyzed for emergent themes.ResultsA model of patients’ decision-making (...) processes for the fate of frozen embryos was developed, with a common emergent theme, “coming to terms with infertility” resulting in either acceptance or postponing acceptance of their infertility. The model consisted of 5 steps: 1) the embryo-transfer moratorium was sustained, 2) the “Mottainai”- embryo and having another child were considered; 3) cost reasonability was taken into account; 4) partner’s opinion was confirmed to finally decide whether to continue or discontinue storage. Those discontinuing, then contemplated 5): the effect of donation. Great emotional conflict was expressed in the theme, steps 2, 4, and 5.ConclusionsPatients’ 5 step decision-making process for the fate of frozen embryos was profoundly affected by various Japanese cultural values and moral standards. At the end of their decision, patients used culturally inherent values and standards to come to terms with their infertility. While there is much philosophical discussion on the moral status of the embryo worldwide, this study, with actual views of patients who own them, will make a significant contribution to empirical ethics from the practical viewpoint.
