This article tackles an old, classical problem, which is acquiring a new epochal relevance with the techno-aesthetic processing of form and substance, expression and content. The field of digital architecture is embarked in the ancient controversy between the line and the curve, binary communication and fuzzy logic. Since the 1990s, the speculative qualities of digital architecture have exposed spatial design to the qualities of growing or breeding, rather than planning. However, such qualities still deploy the tension between discrete spaces and (...) continual curving. In this context, the article suggests the computational coexistence of discrete coding with continual morphing, defying any easy resolution for an aesthetic of continuity or discontinuity, the superiority of the analog or the meta-logic of the digital. The metaphysical dimension of such coexistence needs to include the abstract capacities of experiencing the transition from one state to another as the registering of algorithmic processing. Computation is intrinsic to microperceptions, incomputable quantities deploying the infectious property of the digital code. The article draws on the digital architecture of Greg Lynn to explore whether the computational nature of the digital calculus has the potential to challenge the bifurcation between the biological and the mathematical, the physical and the mental. The Representational Theory of the Mind (RTM) has been forcefully and subtly developed by Jerry A. Fodor. According to the RTM, psychological states that explain behavior involve tokenings of mental representations. Since the RTM is distinguished from other approaches by its appeal to the meaning or "content" of mental representations, a question immediately arises: by virtue of what does a mental representation express or represent an environmental property like coto or shoe? This question asks for a general account of the (...) semantics of mental representation. Fodor places two conditions on the requisite theory: it must be physi calistic (that is, it must be couched in nonsemantic and nonintentional terms, free of expressions like "refers to" or "denotes" or "means that"), and it must be atomistic (that is, it must allow that the thinker can have a single intentional state without having any others). What is wanted, then, is a reductive theory that "naturalizes" content by specifying sufficient conditions, in physicalistic and atomistic terms, for a mental symbol to represent or express a certain property. Affiliation is both an antecedent and a consequence of emotional mimicry (i.e. imitating a counterpart’s emotional expression). Thus, interacting with a disliked partner can decrease emotional mimicry, which in turn can further decrease liking. This perpetuating circle has not been investigated in the context of mental health stigma yet. The present study tested the influence of the label “schizophrenia” on liking, interpersonal closeness, and emotional mimicry. In an online experiment (n = 201), participants recruited from the general population saw several (...) videos of actors displaying emotional expressions. Actors were described with one of four labels: “schizophrenia”, “healthy”, “diabetes”, and a negative adjective (e.g. “hot-tempered”). Emotional mimicry was measured using OpenFace 2.2. Liking and interpersonal closeness were assessed with questionnaires. Overall, compared to other labels, participants reported less liking and interpersonal closeness to the actor with the schizophrenia label. However, no effect on emotional mimicry was found. The decreased liking of the schizophrenia actors was explained by a lack of knowledge about schizophrenia and the explicit stigma of schizophrenia. Our study contributes to the literature by highlighting the need to reduce the stigma of schizophrenia. (shrink)

Law and economics scholarship has traditionally analyzed efficient breach cases monolithically. By grouping efficient breach cases together, this literature treats the subjective motives and the distributive effects of the breach as immaterial. The Restatement (Third) of Restitution and Unjust Enrichment introduced a distinction based on the intent and the effects of the breach, allowing courts to use disgorgement remedies in cases of ‘opportunistic’ breach of contract (i.e., ‘deliberate and profitable’ breaches). In this article, we evaluate this approach, focusing on the (...) effects of disgorgement remedies on allocative and productive efficiency, information-forcing and competitive effects, and restraint of breach-searching incentives. We show that, even from a purely consequentialist perspective, disgorgement remedies may be normatively warranted, especially when involving sellers’ breach. Recent experimental evidence revealed that the preferences and reactions of ordinary people are in line with our evaluation of the effects of opportunistic breach. (shrink)

YOUNG L, and WHARF HIGGINS J.Nursing Inquiry2010;17: 346–358 Using participatory research to challenge the status quo for women’s cardiovascular healthCardiovascular health research has been dominated by medical and patriarchal paradigms, minimizing a broader perspective of causes of disease. Socioeconomic status as a risk for cardiovascular disease is well established by research, yet these findings have had little influence. Participatory research (PR) that frames mixed method research has potential to bring contextualized clinically relevant findings into program planning and policy‐making arenas toward (...) developing meaningful health and social policies relevant to primary prevention. In this article we provide an overview of a PR program that included two quantitative and one qualitative studies and then we discuss lessons learned. The PR process we found was empowering for lone mothers, and transformative for lone mothers and researchers. Further, PR as an approach to research opened spaces in practice and policy‐making arenas to raise upstream issues relevant to the health of low income lone mothers. We conclude that while PR is an effective approach to social determinants research, as a time‐intensive endeavor, and one that does not easily align with research tradition, researchers must consider the strengths and drawbacks of PR when planning to implement such an approach. The standard inferentialist approaches to modal logic tend to suffer from not being able to uniquely characterize the modal operators, require that introduction and elimination rules be interdefined, or rely on the introduction of possible-world like indexes into the object language itself. In this paper I introduce a hypersequent calculus that is flexible enough to capture many of the standard modal logics and does not suffer from the above problems. It is therefore an ideal candidate to underwrite an inferentialist theory (...) of meaning for modal operators. Here I treat specifically the modal logics K, D, T, S4, B, and S5. I show that the calculi are adequate for each set of models, and show that they meet a large set of criteria that are generally thought necessary for a calculus to underwrite a theory of meaning. Drawing on my recent work using inferential role semantics and elements of speech act theory to analyze the role of derogatory terms (a.k.a. ‘hate speech’, or ‘slurs’) in the 1994 genocide of the Tutsi in Rwanda, as well as the role of certain kinds of reparative speech acts in post-genocide Rwanda, this paper highlights key pragmatist commitments that inform the methods and goals of this practical analysis of real world events. In “Genocidal Language Games”, I used conceptual tools from Wittgenstein, (...) Sellars, Lewis, and Brandom, with a nod to Searle’s concept of status-functions, to develop an analysis that helps to make sense of the view that a steady, deep, and widespread derogation of a group can at least partially constitute genocide, not only be an antecedent to it. In this paper, I sketch some of the tools and lessons of this project, with an eye to highlighting their pragmatist roots and the directions to which such real-world investigations lead. (shrink)

The standard view of classical cognitive science stated that cognition consists in the manipulation of language-like structures according to formal rules. Since cognition is ‘linguistic’ in itself, according to this view language is just a complex communication system and does not influence cognitive processes in any substantial way. This view has been criticized from several perspectives and a new framework (Embodied Cognition) has emerged that considers cognitive processes as non-symbolic and heavily dependent on the dynamical interactions between the cognitive system (...) and its environment. But notwithstanding the successes of the embodied cognitive science in explaining low-level cognitive behaviors, it is still not clear whether and how it can scale up for explaining high-level cognition. In this paper we argue that this can be done by considering the role of language as a cognitive tool: i.e. how language transforms basic cognitive functions in the high-level functions that are characteristic of human cognition. In order to do that, we review some computational models that substantiate this view with respect to categorization and memory. Since these models are based on a very rudimentary form of non-syntactic ‘language’ we argue that the use of language as a cognitive tool might have been an early discovery in hominid evolution, and might have played a substantial role in the evolution of language itself. There is a growing call for greater public involvement in establishing science and technology policy, in line with democratic ideals. A variety of public participation procedures exist that aim to consult and involve the public, ranging from the public hearing to the consensus conference. Unfortunately, a general lack of empirical consideration of the quality of these methods arises from confusion as to the appropriate benchmarks for evaluation. Given that the quality of the output of any participation exercise is difficult to (...) determine, the authors suggest the need to consider which aspects of the process are desirable and then to measure the presence or quality of these process aspects. To this end, a number of theoretical evaluation criteria that are essential for effective public participation are specified. These comprise two types: acceptance criteria, which concern features of a method that make it acceptable to the wider public, and process criteria, which concern features of the process that are liable to ensure that it takes place in an effective manner. Future research needs to develop instruments to measure these criteria more precisely and identify the contextual and environmental factors that will mediate the effectiveness of the different participation methods. Imprecise definition of key terms in the “public participation” domain have hindered the conduct of good research and militated against the development and implementation of effective participation practices. In this article, we define key concepts in the domain: public communication, public consultation, and public participation. These concepts are differentiated according to the nature and flow of information between exercise sponsors and participants. According to such an information flow perspective, an exercise’s effectiveness may be ascertained by the efficiency with which full, (...) relevant information is elicited from all appropriate sources, transferred to all appropriate recipients, and combined to give an aggregate/consensual response. Key variables that may theoretically affect effectiveness—and on which engagement mechanisms differ—are identified and used to develop a typology of mechanisms. The resultant typology reveals four communication, six consultation, and four participation mechanism classes. Limitations to the typology are discussed, and future research needs identified. In social and cultural theory, topology has been used to articulate changes in structures and spaces of power. In this introduction, we argue that culture itself is becoming topological. In particular, this ‘becoming topological’ can be identified in the significance of a new order of spatio-temporal continuity for forms of economic, political and cultural life today. This ordering emerges, sometimes without explicit coordination, in practices of sorting, naming, numbering, comparing, listing, and calculating. We show that the effect of these practices (...) is both to introduce new continuities into a discontinuous world by establishing equivalences or similitudes, and to make and mark discontinuities through repeated contrasts. In this multiplication of relations, topological change is established as being constant, normal and immanent, rather than being an exceptional form, which is externally produced; that is, forms of economic, political and cultural life are identified and made legible in terms of their capacities for continuous change. Outlining the contributions to this Special Issue, the introduction discusses the meaning of topological culture and provides an analytic framework through which to understand its implications. What is the strange eros that haunts Foucault's writing? In this deeply original consideration of Foucault's erotic ethics, Lynne Huffer provocatively rewrites Foucault as a Sapphic poet. She uncovers eros as a mode of thought that erodes the interiority of the thinking subject. Focusing on the ethical implications of this mode of thought, Huffer shows how Foucault's poetic archival method offers a way to counter the disciplining of speech. At the heart of this method is a conception of the archive (...) as Sapphic: the past's remains are, like Sappho's verses, hole-ridden, scattered, and dissolved by time. Listening for eros across fragmented texts, Huffer stages a series of encounters within an archive of literary and theoretical readings: the eroticization of violence in works by Freud and Eve Kosofsky Sedgwick, the historicity of madness in the Foucault-Derrida debate, the afterlives of Foucault's antiprison activism, and Monique Wittig's Sapphic materialism. Through these encounters, Foucault's Strange Eros conceives of ethics as experiments in living that work poetically to make the present strange. Crafting fragments that dissolve into Sapphic brackets, Huffer performs the ethics she describes in her own practice of experimental writing. Foucault's Strange Eros hints at the self-hollowing speech of an eros that opens a space for the strange. (shrink)

Scholars have proposed a number of courses and programs intended to improve the ethical behavior of scientists in an attempt to maintain the integrity of the scientific enterprise. In the present study, we conducted a quantitative meta-analysis based on 26 previous ethics program evaluation efforts, and the results showed that the overall effectiveness of ethics instruction was modest. The effects of ethics instruction, however, were related to a number of instructional program factors, such as course content and delivery methods, in (...) addition to factors of the evaluation study itself, such as the field of investigator and criterion measure utilized. An examination of the characteristics contributing to the relative effectiveness of instructional programs revealed that more successful programs were conducted as seminars separate from the standard curricula rather than being embedded in existing courses. Furthermore, more successful programs were case based and interactive, and they allowed participants to learn and practice the application of real-world ethical decision-making skills. The implications of these findings for future course development and evaluation are discussed. (shrink)

The purpose of this work is to provide a metaphysical theory of properties and scientific laws. This sentence will require some unpacking. By a ‘metaphysical’ theory here, I mean a theory of what exists in the world. In this investigation I am primarily concerned with a theory of what properties there are in the world and the role they play in scientific laws. This may be contrasted with a linguistic or epistemic project, as it is not primarily about our language, (...) ideas, or theorizing but rather about what is in the world itself. Properties are what we may pre-philosophically think of as the characteristics of an object: such as its height, weight, color, etc. Investigation may cause us to doubt whether some of these pre-philosophical properties are genuine in a metaphysical sense: whether or not the property is actually present as a feature of the world. By scientific laws, I mean the statements we make in the form of exceptionless generalities about the world within the sciences. Here I do not mean to evaluate how science comes about these generalizations, only that they do and how these generalizations may be grounded in a metaphysical theory of properties. The link between these two things: properties and scientific laws, comes about because our scientific laws prominently feature properties: velocity, temperature, charge, viscosity, etc. After a review of some of the theories currently proposed in the philosophical literature along with a treatment of some of the problems that arise out of these theories, I will propose a new theory. This theory, entitled ‘Constitutive Trope Theory’ is a form of a ‘bundle trope theory’ as it proposes that objects in the world are composed entirely out of particularized properties. However, rather than proposing a primitive relation that does the bundling, this theory will propose that, at least for the objects we are familiar with, properties arise out of relations between lower-level properties that instantiate them. For example, a mammal may exist because of the relationship between the organs that lead to its unique properties as a mammal. Those organs in turn exist because of relationships between their cells that lead to their unique properties as a particular kind of organ. And so on down the chain until we hit ‘foundational properties’: properties which are not dependent on any other properties for their existence. I will say very little about these properties as I do not believe that any such properties have currently been found and will argue that such theorizing is premature before such properties have been empirically identified. Following this account, I will consider some of the problems that must be overcome and some final considerations in favor of this theory over other competing theories of properties and scientific laws. The book asks how we can make sense of career paths for PhD graduates, something that has rarely been systematically studied. It offers a coherent synthesis of the empirically-based insights that arose from the experiences of 48 early career researchers, who were participants in a 10-year qualitative longitudinal research program. The book has the power to inform other researchers’ conceptual and methodological approaches to the study of post-PhD career trajectories. The authors draw on the conceptual lens of ‘identity-trajectory’, which emerged (...) from their research program, to examine the decision-making processes underpinning the careers of PhD graduates, whether contingent researchers and teachers, assistant professors within the academy or professionals elsewhere. The book highlights the role of personal agency in negotiating academic and non-academic work and careers within broader personal lives. It will be compelling reading for researchers and students working in the areas of Education and Sociology, particularly those with an interest in examining career development and decision-making. Dealing with situations where parents’ views about treatment for their child are strongly opposed to doctors’ views is one major area of ethical challenge in paediatric health care. The traditional approach focuses on the child’s best interests, but this is problematic for a number of reasons. The Harm Principle test is regarded by many ethicists as more appropriate than the best interests test. Despite this, use of the best interests test for intervening in parental decisions is still very common in (...) clinical settings and can lead to confusion. In this paper, I propose the Zone of Parental Discretion as a means of putting into practice the key ideas of the Harm Principle, in a clear, step-by-step process. The Zone of Parental Discretion provides a tool for ethical deliberation by clinicians and ethicists about all situations in which parents and doctors disagree about treatment of a child, whether parents are refusing medically recommended treatment, or requesting non-recommended treatment. This Article analyzes the interaction between the burden of proof and evidentiary discovery rules. Both sets of rules can affect incentives for prospective injurers to invest in evidence technology. This interaction becomes acutely important in the private international law setting, where jurisdictions are split on the question whether the burden of proof should be treated as a substantive or procedural matter. When a tort occurs in Europe, but the case is litigated in American courts, treating the burden of proof as (...) a procedural matter preserves the complementarity of incentives created by the burden of proof and evidentiary rules. Conversely, treating the burden of proof as a substantive matter creates a mismatch in incentives created by the burden of proof and evidentiary rules. (shrink)
