The objective of the study was to investigate the relationship between childhood IQ of parents and characteristics of their adult offspring. It was a prospective family cohort study linked to a mental ability survey of the parents and set in Renfrew and Paisley in Scotland. Participants were 1921-born men and women who took part in the Scottish Mental Survey in 1932 and the Renfrew/Paisley study in the 1970s, and whose offspring took part in the Midspan Family study in 1996. There (...) were 286 offspring from 179 families. Parental IQ was related to some, but not all characteristics of offspring. Greater parental IQ was associated with taller offspring. Parental IQ was inversely related to number of cigarettes smoked by offspring. Higher parental IQ was associated with better education, offspring social class and offspring deprivation category. There were no significant relationships between parental IQ and offspring systolic blood pressure, diastolic blood pressure, cholesterol, glucose, lung function, weight, body mass index, waist hip ratio, housing, alcohol consumption, marital status, car use and exercise. Structural equation modelling showed parental IQ associated with offspring education directly and mediated via parental social class. Offspring education was associated with offspring smoking and social class. The smoking finding may have implications for targeting of health education. (shrink)

For much of the first fifty years of its existence, analytic philosophy shunned discussions of normativity and ethics. Ethical statements were considered as pseudo-propositions, or as expressions of pro- or con-attitudes of minor theoretical significance. Nowadays, in contrast, prominent analytic philosophers pay close attention to normative problems. Here we focus our attention on the work of Searle, at the same time drawing out an important connection between Searle’s work and that of two other seminal figures in this development: H.L.A. (...) class='Hi'>Hart and John Rawls. We show that all three thinkers tend to assume that there is but one type of normativity within the realm of social institutions – roughly, the sort of normativity that is involved in following the results of chess – and that they thereby neglect features that are of crucial significance for an adequate understanding of social reality. In this article the focus is on ritual theory and its relevance for pastoral care during the grief process. For these purposes the first task at hand is finding an appropriate description of what ritual implies, especially in the context of pastoral care. It includes studying different descriptions from different study fields to provide a broad theoretical view of ritual and to identify relevant perspectives. This view is narrowed to ritual as performance as well as legitimisation of experience. Concerning the (...) pastoral aspect of grief care the research mainly focuses on the work of the Dutch practical theologian, Corja Menken-Bekius and the American practical theologian David Hogue. Menken-Bekius' works on ritual from a clinical pastoral perspective while Hogue gives a neuropsychological perspective. Included in the processing of these two views are the works of anthropologist, Roy Rappaport and psychologist, Onno Van der Hart. Finding a description of ritual is not an easy task. The one offered is created with careful consideration of the inclusions and exclusions within the 'idea' of ritual. Meaning is subjective when it comes to ritual. A general meaning might be ascribed to a specific ritual, yet each individual might have a different experience and might attach different meanings. This happens unwittingly and unwillingly. What is found to be important in the rituals proposed in this article, is the ability of rituals to provide a framework of order within a situation of chaos and that it also creates a moment of remembrance. Cloth, $45.00.In this book, Verity Harte seeks to provide an account of Plato's view of mereology. According to Harte, Plato presents two distinct models about the relation of part to whole, but actually only ever accepts (...) one of these two models. Plato presents one model in the Parmenides, Theaetetus, and one passage in the Sophist. In this model, which Harte compares to a conception of part and whole recently advanced by David Lewis, the whole is simply identical to its collective parts and Plato attends to this model only to call attention to its problems. Harte explicates Plato's presentation of this model in the last section of Chapter 1 and in Chapter 2 of her book. The second model—the only one Plato actually accepts, according to Harte—Plato initially outlines in the Parmenides, but then explicates in finer detail in the Sophist, Philebus, and Timaeus. In this conception, wholes are now understood as "structures, the identity of whose parts is determined only in the context of the whole they compose" (3). Harte presents her evidence for Plato's endorsement of this model in Chapters 3 and 4, and then draws conclusions in Chapter 5.The book has several significant virtues, including especially clarity of exposition, and care and thoroughness in the review of the relevant texts from Plato's later dialogues. But this same care and attention to detail does not at all extend to any of Plato's discussions of part and whole in earlier works, and Harte's peremptory refusal to consider the relevant passages in these other works is puzzling, at best.Indeed, Harte bothers to identify only two such passages from earlier works, and then only to explain why they and other passages like them do not merit further attention: the Republic's famous division of the soul into three parts in Book IV and the consideration of virtue as a whole and the several virtues as parts of that whole in the Protagoras. Harte acknowledges that Plato explicitly supplies, in the Protagoras discussion, two different sorts of relations of part and whole, in distinguishing the way in which parts of gold form a larger whole, and the way the parts of the face are related to the whole face (349d4-8), but seems oblivious to the clear implication that—at least when he wrote the Protagoras, and contrary to Harte's primary thesis—Plato recognized more than one way in which wholes could be composed of parts. But Harte dismisses the significance of both discussions by noting, first, that the "principle of opposition" given in the Republic by which Plato divides the soul provides "at most, a sufficient, and not necessary, condition on something having parts" and concludes that it thus "cannot be used to establish general claims about parts" (2). Harte never mentions that this same view of the partitioned soul seems to reappear in the Phaedrus and Timaeus—a dialogue in which the allegedly preferred conception of mereology is presented—and also passes over the Republic's representation of the tripartition of the kallipolis, and Plato's conception of the citizen as a part of a state. As for the Protagoras's discussion of the relationships between the virtues, Harte says only that "there is here no discussion of the nature of parts or of the relation between parts and whole" (2). She concludes that "in both works the focus of discussion is the examples themselves (the soul, the virtues) and not wholes of parts as such" (2). In his collection of essays, Law as a Leap of Faith, John Gardner lucidly develops a powerful account of legal positivism, primarily via a careful interrogation of H. L. A. Hart’s work, with a particular focus on Hart’s most important text, The Concept of Law. In this essay, I raise a question regarding the significance of legal subjects’ understanding of themselves as legal subjects. I claim that as Gardner fills out the picture of what it takes to have (...) an ideal legal system, we will find that there is no requirement that subjects have any understanding of themselves as legal subjects, much less an understanding either of what the law requires of them or of the legal status with respect to officials that the law gives them. In particular, I argue that Gardner’s account of the law is too focused on the perspective of officials, and leaves out the perspective of legal subjects. This manifests what I call a unidirectional legal optic: the view of the law is the view from a single perspective, namely the perspective of the official. This is not an accurate picture of the law and so should not be presented as the paradigmatic account of law. (shrink)

The purpose of this paper is to consider the frequently held view that since obligation is a rule-dependent concept it can be explicated by reference to rules. H.L.A. Hart's attempt to explicate the normative character of a legal system in terms of rules is examined and it is shown that (A) the notion that obligation is rule-dependent necessitates that there be an ultimate rule in the legal system, that (B) if obligation is rule-dependent and there is an ultimate rule (...) in the legal system it is mysterious, indeed unintelligible how rules themselves can oblige and (C) the attempt to capture the normative character if the legal system fails. The appeal of this analysis of obligation is traced to the tempting but ill-founded supposition that rationality always consists in applying a general rule to a specific case. (shrink)

Paper, $18.95.A new English translation of Heidegger’s best book, Sein und Zeit has been eagerly anticipated ever since the appearance of the Macquarrie/Robinson translation in 1962.1 For anyone (...) with an ear for German would find that, in turning Heidegger’s visceral prose into wooden terminology, this first pathbreaking and very scholarly translation failed completely to render the startling and wholly untraditional diction of this work, a diction that rocked a staid and stifling academia and that in lectures preceding the book’s publication had therefore attracted students in droves, among them Leo Strauss, Hanna Arendt, Hans-Georg Gadamer, Karl Löwith, Herbert Marcuse, and Hans Jonas. At long last, a new translation, Joan Stambaugh’s, is here, but, unfortunately, it is no better in this crucial regard, and it is not as scholarly either. (Macquarrie/Robinson do provide many detailed and useful accounts of their choices of translation.) Indeed, the new translation often seems to be a mere revision of the old and falls into much of the old translation’s terminological uprooting of Heidegger’s sometimes thick but always earthy language. I. We have been warned by Professor H. L. A. Hart not to think of the word ‘justice’ as an all-encompassing moral word, and, so far as it goes, the warning is surely one we should heed. But “justice” is a concept so complex as to make the warning necessary. I do not intend my remarks as countering Hart's claim, but they thrust in a different direction. They are aimed at the fact that our concept of justice permeates (...) and conditions our use of a wide variety of other concepts such as freedom, equality and happiness. It is a common practice, among those who seek to elucidate the concept of justice, to appeal to these other concepts in an unanalyzed way. Thus, John Rawls, in formulating his now famous “two principles,” which are offered as an elucidation of one sense of justice, assumes that we understand such notions as maximum liberty and equality of opportunity before the concept of justice has itself been clarified. Few in recent decades have done more than Rawls to enrich the philosophical literature on justice, but I want to suggest that some very misleading inferences might be drawn from this opening gambit. The question 'Why should I obey the law?' introduces a contemporary puzzle that is as old as philosophy itself. The puzzle is especially troublesome if we think of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Philosophers from Socrates to H.L.A. Hart have struggled to give reasoned support to the idea that we do have a general moral duty to obey the law but, more recently, the greater (...) number of learned voices has expressed doubt that there is any such duty, at least as traditionally conceived. We can see from the analysis set out here that the two accounts that were the focus of consideration are complementary to one another. It has been my contention that a problem like specifying a concept such as ‘refrain’ is highly complex. One part of it is the problem of determining the relation between the action (or event) and the result. Another part of the problem is that of describing the event itself; what kind of an event is it? These (...) two projects are related and so it is clear that the results must be consistent. However, it is equally clear that the definition which is useful for one project is not the same as that which is helpful for another. The point is that it should not be assumed that an account that initially looks incompatible with one's own must be refuted. It is sometimes better to consider what is needed for a complete account, and whether many different approaches may contribute pieces to the puzzle.We have here one puzzle piece: an analysis of refraining. It should not be assumed that we have thereby completed the puzzle of omission, but omission can be approached the same way; that is, by coordinating parallel projects.Accordingly, the first benefit of the present analysis is that it sets up an approach which is modular in nature. It allows for parallel projects to be pursued separately and coordinated. This kind of approach is sorely needed in this area to counter unproductive dispute.To see how such an approach can be applied to further problems profitably consider the following persistent controversy. Many philosophers are at odds over the importance of the notion of duty, or more informally, reasonable expectation in the understanding of refraining. A number of them (e.g., Hart and Honore, John Casey, and Phillipa Foot) hold that the determining feature for the ascription of responsibility to an agent for not doing something to prevent a harm (say, a death) is the presence of a duty or reasonable expectation that the agent do something about the situation. For example, John Casey holds, “If a man does not do x, we cannot properly say that his not doing x is the cause of some result y, unless in the normal course of events he could have been expected to do x.” Casey, Actions and Consequences (1978).Other philosophers object that a person can cause a result by refraining from (causally) preventing it, and that such an event can be explained without any reference to duty. These two views appear to conflict, but in fact they are both right (but both incomplete). The reason that the above statements are generally thought to constitute a disagreement is that ‘refrain’ is generally taken as the fundamental term of analysis for omissions. Thus, if Casey says, “If a man does not do x...” he is taken to mean “...if a man refrains from doing x...” But he need not mean that. He may mean to say only that the man failed to do x. See my analysis in “Contemplating Failure,” supra note 10. Failing to do something can be, and ordinarily is, thought of as stronger than simple nonaction. But it is much weaker than refraining. For one thing, it has no awareness requirement. Thus, an account like Casey's can explain the ascription of responsibility and the presence of an omission where Green's account (or the account offered here) cannot, and vice versa. Casey's view can explain why we hold (or at least that we hold) responsible the night watchman who forgets to check one of the windows, the bookkeeper who (accidentally) omits an entry in the accounts, or the private duty nurse who fails to prevent a death by falling asleep on the job. No refraining is present in any of these cases. Consequently, any thesis based on refraining alone cannot explain them. But in many cases refraining is precisely what is important, and Green (and others of the same persuasion) are correct to point out that no reference to duty is necessarily required to account for these cases. Analysis based on refraining best explains intentional or conscious omission. Analysis based on duty or reasonable expectation is the only way to explain unconscious omission. More often than not, both elements are present. A complete account of omission needs both. So here again, the better way to view these putatively competing accounts is as parallel projects which work toward a common, but complex end. The approach taken here allows for this kind of much needed coordination. The second benefit of the present analysis is that it clarifies and focuses on the significance of the mental element of refraining. Refraining is conscious omission. Consciousness and omission are its distinguishing features. The effects of seeing the concept this way are pervasive. Here is one example. If I refrain from reporting my full income to the IRS, I have committed fraud, and punitive or even criminal sanctions may be reasonable. If I fail to report my full income through ignorance or mistake (say, I misunderstood the instructions) correcting the error and requiring payment is reasonable, but certainly criminal sanction is not. This oversimplifies the distinction, but it illustrates the focus of my pursuit.With regard to positive actions, law and philosophy have long recognized this important distinction as manifested in the difference between negligence and intentional tort, or manslaughter and murder. Due (I think) to the extraordinary flexibility of language and the weakness and variability of social conventions regarding omissions, this distinction has not been clearly articulated. Applied ontology is the attempt to put to use the rigorous tools of philosophical ontology in the development of category systems which can be of use in the formalization and systematization of knowledge of a given domain. In what follows we shall sketch some elements of the ontology of legal and socio-political institutions, paying attention especially to the normativity involved in such institutions. We shall see that there is more than one type of normativity, but that this fact that has (...) often been ignored in standard attempts by philosophers to build ontologies of legal and other socio-political entities. In order to provide a sound system of categories for legal and socio-political institutions and entities, however, the manifold of normativity needs to be addressed. The classical examples of normative statements have been moral propositions; they do not merely describe states of affairs; they tell us how states of affairs ought to be. The distinction between how things are and how they ought to be is the basis of the distinction between fact and value. Analytic philosophers for a long time shunned discussions of normativity and ethics. They considered ethical statements as pseudo-propositions, or as expressions of pro- or con-attitudes of no theoretical significance.1 Nowadays, in contrast, prominent analytic philosophers discuss normative problems and there are important books written by such philosophers on topics such as law and justice. Here we pay attention to three seminal thinkers in this development: H. L. A. Hart, John Rawls, and John R. Searle in concerning ourselves especially with the way in which they deal with the issue of normativity. This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two (...) great lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share. It has become commonplace to ask, whenever anything has gone wrong, what lessons can be learned from the experience. But the appearance of open‐endedness in that question is misleading: not every answer that we could give to it is acceptable. There are, in the context of such a question, tacit constraints in what counts as a valid lesson to be learned. The article considers what these constraints might be and the different kinds of lessons one might learn from experience, which (...) the common way of taking the question ignores. Initially I attempt to distinguish between lessons that have to do with action and those that have to do with understanding, between lessons that are about the results of our actions and those that are about the meaning of actions and events. On closer examination, however, these distinctions are seen to break down, to represent a difference of degree rather than of kind. In the latter part of the article, therefore, I find the crucial distinction to be between lessons that we can apply, while being ourselves unchanged, and lessons which, by changing the way in which we see and respond to people and events, re‐constitute ourselves and thus express themselves through us willy‐nilly in our subsequent thoughts, words and actions. As a model for processing information about people's perceptions to understand the complex world and society in which they live, the cultural schema serves as a key concept in Cultural Linguistics when directing to the perception and processing of information about people, and social groups, and events. Cultural schema theory is valuable in deciphering culturally structured concepts, covering the entire range of human experience expressed in many fields such as education, belief, religion, etc. Through the practice of sacred rituals, each (...) religious believer can form his system of ideas about entities in his or her belief world. Those experiences and experiences are conceptualized through the language picture. In the process of cultural development and integration, the cultural awareness of the Catholic community also reflects certain changes in Catholicism in the West in harmony with the customs and beliefs of Eastern countries. like Vietnam, expressed through the practice of funeral rites and traditional marriage of the Vietnamese. In this article, by using quantitative and qualitative methods, we have conducted a character analysis of the above cultural schemas based on the corpus of 120 discourses drawn during the implementation perform funeral and marriage rites for Vietnamese Catholics. Research results show that cultural schemas (event diagrams, role schemas, image schemas, propositional schemas, and emotional schemas) reflect the cultural knowledge (beliefs, standards, principles, and expectations) of each Vietnamese Catholic about DEATH and MARRIAGE as a journey or a new transformation in one's life... That is the basis for them to transmit achieve and explain the basic values of these two concepts, helping us to understand more deeply the mind of the Vietnamese Catholic community in Vietnam when performing two important rituals in human life in reality.
