This paper defends the Blockian Proviso against its critics, Kinsella in particular, and interprets it as a law of non-contradiction in the theory of just property rights. I demonstrate that one may not lawfully appropriate in such a way as to forestall others from appropriating an unowned land because such appropriation would result in conflict-generating norms, and conflict-generating norms are not rationally justifiable and just norms. The Blockian Proviso, which precludes forestalling, operates therefore at the level of original appropriation and (...) determines, according to the homestead principle of justice in first acquisition, what may and what may not be lawfully appropriated. Hence, the Blockian Proviso is not an add-on to the homestead principle but part and parcel thereof. (shrink)

Modern technology offers an increasing number of tools for teaching mathematics, but technology adoption in schools encounters many barriers. The Technology Acceptance Model explains that technology usage is dependent on intentions, which rest on perceived ease of use and perceived usefulness. Less is known about the relationship between intentions and actual behaviour. In the current study we show that the level of cognitive investment on the part of the teachers, captured by the construct of Need for Cognition (NC), is crucial (...) in the use of technology in mathematical instruction, while controlling for a variety of background factors. Furthermore NC moderates the relationship between intentions and technology use, such that high NC weakens the relationship between the perceived usefulness of technology in pedagogy and its actual use. Can ownership status influence probability judgements under condition of uncertainty? In three experiments, we presented our participants with a recording of a real horse race. We endowed half of our sample with a wager on a single horse to win the race, and the other half with money to spend to acquire the same wager. Across three large studies, we found the endowment effect – owners demanded significantly more for the wager than buyers were willing to pay to acquire it. (...) However, we also found that probability estimates of each horse winning the race did not differ between owners and non-owners of the betting slip. Our results demonstrate that distorted perception of probability is unlikely to be a mechanism explaining the endowment effect. (shrink)

The present paper investigates the question of whether right-libertarians must accept easements by necessity. Since easements by necessity limit the property rights of the owner of the servient tenement, they apparently conflict with the libertarian homestead principle, according to which the person who first mixes his labor with the unowned land acquires absolute ownership thereof. As we demonstrate in the paper, however, the homestead principle understood in such an absolutist way generates contradictions within the set of rights distributed on its (...) basis. In order to avoid such contradictions, easements by necessity must be incorporated into the libertarian theory of property rights and the homestead principle must be truncated accordingly. (shrink)

In this commentary, I critically assess Rex Welshon’s position on the neural substrates of ownership unity. First, I comment on Welshon’s definition of ownership unity and underline some of the problems stemming from his phenomenological analysis. Second, I analyze Welshon’s proposal to establish a mechanistic relation between neural substrates and ownership unity. I show that it is insufficient and defend my own position on how neural mechanisms may give rise to whole subjects of experience, which I call the neuro-integrative account (...) of consciousness. Lastly, I comment on Welshon’s philosophical contribution and claim that it leaves the reader theoretically stranded. (shrink)

Autorzy artykułu argumentują, że libertarianie (tacy jak Murray Rothbard, Stephan Kinsella), którzy jednocześnie podpisują się pod zasadą proporcjonalności w obronie własności prywatnej oraz pod poglądem, iż posiadanie prawa własności prywatnej oznacza posiadanie prawa do jej obrony, popadają tym samym w dylemat polegający na tym, iż jeżeli jedynym sposobem obrony prawa własności prywatnej jest jego nieproporcjonalna obrona, to to własności tej - wbrew temu, co ów pogląd głosi - nie towarzyszy prawo do jej obrony. Najlepiej uzasadnionym sposobem wyjścia z tego dylematu (...) jest osłabienie peremptoryjności praw własności prywatnej, czyli skonceptualizowanie tychże praw jako absolutnych jedynie w słabym sensie tego słowa (korzystając z dystynkcji zaproponowanej przez Matthew H. Kramera). Z kolei libertarianie, którzy tak jak Walter Block chcieliby wybrnąć z rzeczonego dylematu poprzez zastąpienie zasady proporcjonalności zasadą delikatności, popadają w innego rodzaju problemy (nieintuicyjność moralną czy ogólną niekoherencję), co jest tylko kolejnym argumentem na rzecz tezy, iż osłabienie wymogów praw własności prywatnej jest najlepiej uzasadnionym sposobem przezwyciężenia rozważanego tu dylematu. In “Evictionism and Libertarianism,” published in this journal, Walter Block defends the view that, although the fetus is a human being with all the rights to its body, it may nonetheless be evicted from the woman’s body as a trespasser, provided the pregnancy is unwanted. We argue that this view is untenable: the statement that the unwanted fetus is a trespasser does not follow from the premises that the fetus uninvitedly resides in the woman’s body and that the woman is (...) a full self-owner. For this statement to follow, one more statement would have to be true; namely, the woman would have to hold her self-ownership rights specifically against the fetus, and for this to be the case, the fetus would have to have a correlative duty to the woman to abstain from interfering with her body. Murray Rothbard claims that it is “evident that our theory of proportional punishment—that people may be punished by losing their rights to the extent that they have invaded the rights of others—is frankly a retributive theory of punishment, a ‘tooth (or two teeth) for a tooth’ theory.” The present paper argues that it is not. The role that Rothbard assigns for victims in determining punishment justifies classifying his theory of punishment as corrective rather than retributive, for vesting victims with rights (...) over punishment defeats the retributive justice requirement that criminals are punished solely because they deserve it and in accordance with their respective deserts. Instead of giving offenders what they objectively deserve, the Rothbardian theory of punishment allows victims to seek compensation in various forms, including revenge. (shrink)

According to contemporary understanding of the universal tree of life, the traditionally recognized kingdoms of eukaryotic organisms—Protista, Fungi, Animalia and Plantae—are irregularly interspersed in a vast phylogenetic tree. There are numerous groups that in any Linnaean classification advised by phylogenetic relationships would form sister groups to those kingdoms, therefore requiring us to admit them the same rank. In practice, this would lead to the creation of ca. 25-30 new kingdoms that would now be listed among animals and plants as “major (...) types of life”. This poses problems of an aesthetic and educational nature. There are, broadly speaking, two ways to deal with that issue: a) ignore the aesthetic and educational arguments and propose classification systems that are fully consistent with the Hennigian principles of phylogenetic classification, i.e. are only composed of monophyletic taxa; b) ignore Hennigian principles and bunch small, relatively uncharacteristic groups into paraphyletic taxa, creating systems that are more convenient. In the paper, I present the debate and analyze the pros and cons of both options, briefly commenting on the deeper, third resolution, which would be to abandon classification systems entirely. Recent advances in eukaryotic classification and phylogeny are commented in the light of the philosophical question of the purpose and design principles of biological classification systems. The present paper probes the relation between the metaphysics of human freedom and the Rothbardian branch of Austrian economics. It transpires that Rothbard and his followers embrace metaphysical libertarianism, which holds that free will is incompatible with determinism and that the thesis of determinism is false as pertaining to human action. However, as we demonstrate, their economics with its reliance on value scales requires for its tenability compatibilist freedom. Moreover, we attempt to show that the notion of value scales (or (...) preferences) postulated by them implies that value scales are determinative of choices people make. We contend that it is for this reason that the said Austrians should jettison their metaphysical libertarianism. (shrink)

This paper argues—contra some Austro-libertarians—that whether a given exchange is welfare-enhancing or welfare-diminishing does not depend on whether that exchange is just or unjust, respectively. Rather, we suggest that in light of our two thought experiments, Austro-libertarianism has at least a pro tanto reason to conceive of justice and welfare as two logically distinct ideals. This would in turn, most interestingly, predict the possibility of (a) just but welfare-diminishing exchanges and (b) unjust but welfare-enhancing ones. Upon considering possible rejoinders to (...) our points, we suggest that Austro-libertarians abandon a justice-based notion of welfare. (shrink)

In the present paper we argue that besides four traditional methods of property acquisition – that is, homesteading, production, voluntary transfer and rectification of injustice – libertarianism also recognizes a fifth method, namely the method of accession. We contend that not only have some libertarian scholars implicitly embraced the accession principle, but also that if libertarianism wants to distribute exclusive ownership to indivisible things produced from inputs supplied by two or more parties without running into conflict with its own principles (...) of justice, it has to recognize accession as the fifth mode of appropriation. As the main thesis of the paper goes against the received view concerning the very core of libertarianism, that is, its methods of property acquisition, the text indicates some new developments within the libertarian theory of justice. The present paper formulates the principled anarcho-capitalist case against the state and investigates the possible minarchist replies thereto. It identifies three and only three logically available ways of undermining the anarcho-capitalist case and argues that none of them works for minarchism due to the premises from which this theory starts. The sketch of the analysis presented in the paper suggests that minarchist research program falls short of theoretical soundness or even of logical validity.

Adiaphora and permissive natural law both conceptually pointed towards an arena of liberty in which the individual remained free to take up particular courses of action. In the Reformation debates over the external regulation of Christian freedom for the maintenance of peace and order, these two concepts became freighted with political significance; but they also in turn shaped attitudes over when and where obedience was due in relation to the civic regulation of liberty. Tudor apologetics deployed both ideas in order (...) to defend the English Reformation, especially the claim of the royal supremacy to have due authority to regulate ecclesiastical affairs in indifferent matters, limiting Christian freedom and requiring obedience. By situating these debates within the context of the conceptual development of adiaphora and permissive natural law from their original philosophical roots through to the Reformation, this article establishes the genealogy of claims that defined such apologetics. After surveying the seemingly intractable dilemmas in the thought of Thomas Starkey and John Whitgift over why obedience to lay ecclesiastical supremacy was due, this article considers the radical return to the permissive natural law traditions of the medieval period in the Elizabethan conformist thought of Richard Hooker. In this return, Hooker supplanted divine permissions and scriptural principles as the guide for the proper regulation of indifferent matters with an appeal to the light of reason as the divine instrument through which binding human laws are made to govern society and limit freedom for the public good, even in the life of the national church. In the present paper we argue that the theory of contracts embraced by many libertarian scholars and relied upon by them in sundry important debates (e.g. over morality of the fractional reserve banking or loan maturity mismatching etc.), that is, the title transfer theory of contracts (TTT) should be rejected as not being able to account for the binding force of future-oriented contracts, including contracts deemed enforceable by those scholars themselves. The TTT claims that the only contracts that should be (...) legally binding are these where the debtor’s failure to abide by them constitutes a violation of the creditor’s private property rights. However, as we argue, no default of the debtor in a future-oriented contract can in itself amount to such a violation. (shrink)

ABSTRACTCommentators have commonly noted the metaphysical role of participation in Richard Hooker’s Of the Lawes of Ecclesiastical Polity: participation both describes how creation is suspended from God and also how believers share in Christ through grace. Yet, the role in Hooker’s thought of the attendant Platonic language of ‘between’ and ‘desire’ has not received sustained attention. Metaxu describes the ‘in-between’ quality of participation: the participant and the participated remain distinct but are dynamically related as the former originates from and returns (...) to the perfection of the latter. Within this metaxological dynamic, desire acts as the physical and psychic motor driving the move between potentiality and perfect actuality, that is to say from multiplicity to divine unity: desire aims at goodness and so ultimately tends towards that which is goodness itself, namely God’s nature. For Hooker, desire becomes couched in amorous affectivity and has an erotic register. This essay explores, then, how Hooker appeals to a language of ‘between’ and ‘desire’ within his accounts of participation. First, it examines how human beings exist between the footstool and throne of God in Hooker’s legal ontology. Here, angelic desire acts as a hierarchical pattern of and spur to erotic participation in the divine nature. Second, this essay examines how theurgy transforms desire in Hooker’s account of liturgical participation as a redemptive commerce between heaven and earth. Here, angels still act as invisible, hierarchical intermediaries within earthly worship, but soon give way to immediate grace through participation in Christ within the sacraments. (shrink)

In this paper, we provide an axiomatic foundation of pessimism and optimism towards ambiguity that emerges due to growing awareness. In our setup, this corresponds to a discovery of finer “descriptions” of the original contingencies. A decision-maker can form subjective probabilistic beliefs on the original state space and behaves as an expected utility maximizer. However, as finer contingencies are discovered, he may perceive ambiguity with respect to the newly identified states and thus be unable to extend her initial probabilistic beliefs (...) to the expanded state space in an additive way. As a result, the decision-maker’s new beliefs are now “ambiguous” and represented by a probability distribution combined, for each refinement of an original state, with a degree of confidence in this probability estimate. We provide a parametric representation of preferences, identify the DM’s degree of ambiguity as well as his attitude towards ambiguity as captured by the degree of optimism and pessimism. We illustrate the relation of our model to some well-known capacities, such as the E-capacities introduced by Eichberger and Kelsey, the JP-capacities of Jaffray and Philippe and the NEO-additive capacities developed by Chateauneuf et al.. This paper examines the problem of migration from the point of view of libertarian political philosophy. The author presents a theory of natural rights to private property and uses it to infer that the right to migration does not exist in the libertarian order. He points out that according to the the libertarian theory of justice, the decision-making process concerned with the reception of immigrants in a given location is governed by a communitarian-syndicalist rule, which recognises the local community’s right (...) to make such decisions. Emotion Review, Volume 14, Issue 2, Page 132-160, April 2022. Autonomic nervous system activity is a fundamental component of emotional responding. It is not clear, however, whether positive emotional states are associated with differential ANS reactivity. To address this issue, we conducted a meta-analytic review of 120 articles, measuring ANS activity during 11 elicited positive emotions, namely amusement, attachment love, awe, contentment, craving, excitement, gratitude, joy, nurturant love, pride, and sexual desire. We identified a widely dispersed collection of studies. Univariate (...) results indicated that positive emotions produce no or weak and highly variable increases in ANS reactivity. However, the limitations of work to date – which we discuss – mean that our conclusions should be treated as empirically grounded hypotheses that future research should validate. (shrink)

What is the origin of individual differences in ideology and personality? According to the parasite stress hypothesis, the structure of a society and the values of individuals within it are both influenced by the prevalence of infectious disease within the society's geographical region. High levels of infection threat are associated with more ethnocentric and collectivist social structures and greater adherence to social norms, as well as with socially conservative political ideology and less open but more conscientious personalities. Here we use (...) an agent-based model to explore a specific opportunities-parasites trade-off hypothesis, according to which utility-maximizing agents place themselves at an optimal point on a trade-off between the gains that may be achieved through accessing the resources of geographically or socially distant out-group members through openness to out-group interaction, and the losses arising due to consequently increased risks of exotic infection to which immunity has not been developed. We examine the evolution of cooperation and the formation of social groups within social networks, and we show that the groups that spontaneously form exhibit greater local rather than global cooperative networks when levels of infection are high. It is suggested that the OPTO model offers a first step toward understanding the specific mechanisms through which environmental conditions may influence cognition, ideology, personality, and social organization. Radiation therapy therapists face challenging daily tasks that leave them prone to high attrition and burnout and subsequent deficits in performance. Here, we employed an accelerated alpha-theta neurofeedback protocol that is implementable in a busy medical workplace to test if 12 RTTs could learn the protocol and exhibit behavior and brain performance-related benefits. Following the 3-week protocol, participants showed a decrease in subjective cognitive workload and a decrease in response time during a performance task, as well as a decrease in (...) desynchrony of the alpha electroencephalogram band. Additionally, novel microstate analysis for neurofeedback showed a significant decrease in global field power following neurofeedback. These results suggest that the RTTs successfully learned the protocol and improved in perceived cognitive workload following 3 weeks of neurofeedback. In sum, this study presents promising behavioral improvements as well as brain performance-related evidence of neurophysiological changes following neurofeedback, supporting the feasibility of implementing neurofeedback in a busy workplace and encouraging the further study of neurofeedback as a tool to mitigate burnout. This study examined the effect of history of harsh parenting on readiness for aggression in young adults testing the mediating effect of emotional reaction to frustration and provocation that is assumed to arise in the context of a history of physical punishment and psychological aggression. Data were collected from 402 participants including 187 Poles and 215 Americans. Participants reported retrospectively on corporal punishment and psychological aggression experienced during childhood. Based on self-report instruments, sensitivity to provocation and frustration and three patterns (...) of readiness for aggression in adulthood were assessed. Contrary to the US sample, sensitivity to provocation and frustration were mediators in the Polish sample alone. The important role of contextual factors that define harsh parenting circumstances, such as cultural context and sex of the parent, are discussed. (shrink)

The Anxiety-Buffering Properties of Cultural and Subcultural Worldviews: Terror Management Processes among Juvenile Delinquents Terror management research indicates that people reminded of mortality strongly affirm values and standards consistent with their cultural worldview and distance themselves from values and standards inconsistent with it. However, limited research has addressed how individuals holding beliefs inconsistent with the dominant worldview cope with death-related anxiety. The present article aims to determine which worldview subcultural groups rely on when reminded of mortality: mainstream or subcultural? Juvenile (...) delinquents living in residential reformatories in Poland were invited to participate in a terror management study examining the anxiety-buffering strategies of individuals belonging to a group largely outside mainstream culture. Following reminders of mortality, juvenile delinquents increased support for values consistent with the mainstream cultural worldview and decreased support for values consistent with the subcultural worldview, as compared to control conditions. The present results suggest that when faced with existential threat, the subcultural worldview does not provide an adequate anxiety buffer, leading members of this subcultural group to display increased identification with mainstream cultural values. Additionally, participants' state anxiety following death reminders was mediated by mainstream cultural worldview defense. (shrink)

The undoing hypothesis proposes that positive emotions serve to undo sympathetic arousal related to negative emotions and stress. However, a recent qualitative review challenged the undoing effect by presenting conflicting results. To address this issue quantitatively, we conducted a meta-analytic review of 16 studies ( N = 1,220; 72 effect sizes) measuring sympathetic recovery during elicited positive emotions and neutral conditions. Findings indicated that in most cases, positive emotions did not speed sympathetic recovery compared to neutral conditions. However, when a (...) composite index of cardiovascular reactivity was used, undoing effects were evident. Our findings suggest the need for further work on the functions of positive emotions. Adaptation and Validation of the Steen Happiness Index into Polish Authentic happiness is a construct comprising 3 factors: pleasure, engagement, and meaning. Three studies involving altogether 464 participants adapted and validated the authentic happiness measure Steen Happiness Index into Polish. In Study 1 the Polish version of the scale was developed and its convergence with the original SHI was assessed using bilingual response method, r =.98, p <.001. In Study 2 cluster analysis confirmed the theoretical profiles of happiness, testing the (...) proposed 3-factor structure of the scale, χ2 = 180.62, GFI =.95, CFI=.97, SRMR =.04, RMSEA =.04, RMSEA 90% CI [.25 -.45]. Test-retest reliability yielded satisfactory results, rtt =.87, p <.01. This is the first study providing empirical support for the structural validity of the authentic happiness construct. It also shows the cross-cultural generality of the construct. We discuss some practical applications of the scale. (shrink)

Dicer is a key player in microRNA (miRNA) and RNA interference (RNAi) pathways, processing miRNA precursors and doublestranded RNA into ~21-nt-long products ultimately triggering sequence-dependent gene silencing. Although processing of substrates in vertebrate cells occurs in the cytoplasm, there is growing evidence suggesting Dicer is also present and functional in the nucleus. To address this possibility, we searched for a nuclear localization signal (NLS) in human Dicer and identified its C-terminal double-stranded RNA binding domain (dsRBD) as harboring NLS activity. We (...) show that the dsRBD-NLS can mediate nuclear import of a reporter protein via interaction with importins β, 7, and 8. In the context of full-length Dicer, the dsRBD-NLS is masked. However, duplication of the dsRBD localizes the full-length protein to the nucleus. Furthermore, deletion of the N-terminal helicase domain results in partial accumulation of Dicer in the nucleus upon leptomycin B treatment, indicating that CRM1 contributes to nuclear export of Dicer. Finally, we demonstrate that human Dicer has the ability to shuttle between the nucleus and the cytoplasm. We conclude that Dicer is a shuttling protein whose steady-state localization is cytoplasmic. (shrink)
